In the case of bodies that hold public sessions, publicity must be guaranteed through the use of virtual means that allow citizens to follow the deliberations in real time. (Thus added the previous subsection by Article 2 of the Law Authorizing Virtual Sessions for Collegiate Bodies of the Public Administration, No. 10379 of October 2, 2023)"

IV.Pursuant to the foregoing, the use of technologies for holding sessions of collegiate bodies with "telepresence or virtual presence," of all or part of their members, is juridically possible for strengthening effectiveness and efficiency as guiding principles of public administration, as long as such technology guarantees the security and effectiveness of communication that allows participants to intervene, deliberate, share information, and decide to participate in votes when applicable, as if they were physically present, with probative evidence of such fact being recorded through mechanisms such as audio or video recordings and filmings that guarantee the integrity of what was carried out.

V.That, given the need to adapt to technological changes to improve administrative efficiency and effectiveness, and juridical security, SENARA must issue internally the regulations that allow for holding sessions in the virtual modality through platforms offered by information technologies so that members of its collegiate bodies can participate totally or partially under the virtual modality.

The following is hereby issued REGULATION FOR HOLDING VIRTUAL AND MIXED SESSIONS OF COLLEGIATE BODIES OF THE NATIONAL GROUNDWATER, IRRIGATION, AND DRAINAGE SERVICE (SERVICIO NACIONAL DE AGUAS SUBTERRÁNEAS, RIEGO Y AVENAMIENTO, SENARA)

This Regulation is intended to regulate the holding of virtual or mixed sessions in collegiate bodies of the National Groundwater, Irrigation, and Drainage Service (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, SENARA), in accordance with the following applicable regulations.

The provisions of this Regulation are mandatory in those cases where any collegiate body of SENARA agrees to hold sessions by virtual means, in which all or some of its members have virtual presence through the platforms offered by information technologies.

To hold a virtual or mixed session of a collegiate body, the electronic means used must be previously indicated in the convocation (convocatoria) and be capable of allowing the connectivity of the body's members who participate under that modality and guaranteeing the simultaneity, interactivity, and integrality of communication among all participants. All aspects established in the convocation (convocatoria) made for this purpose must be respected, and evidence of such circumstance, as well as the technological means used, must be recorded during the session.

For holding virtual sessions and mixed sessions of collegiate bodies, compliance with the principles governing the operation of every collegiate body must be ensured, such as collegiality, simultaneity, deliberation, and economy, regardless of the technological tools used to be present. Likewise, in all matters not indicated in this Regulation, all those principles and operating rules established by the body according to its own regulations and the General Public Administration Act (Ley General de la Administración Pública) shall apply.

For the purposes of this Regulation, the following shall be understood as:

Simultaneity: The individuals comprising the collegiate body must concur simultaneously in the formation of the body's will. Simultaneity is inherent to deliberations and the procedure for forming the collegial will. All regulation of the procedure for forming the will is based on that simultaneity, which enables deliberation and the formation of the body's will.

Interactivity: This mechanism allows for bidirectional, multidirectional, and synchronous communication in real time, meaning it is transmitted live and direct, from one point to another or among several points at once.

Integrality: Communication must be integral, allowing for the transmission of image, audio, and video, enabling those interacting to see each other, hear each other's voices, and allowing for real-time data transmission.

Virtual session: Is that session held by the collegiate bodies of the National Groundwater, Irrigation, and Drainage Service (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, SENARA), in which all members of the body are not gathered in person, but rather participate through the connectivity established with the use of the technological platform previously defined in the convocation (convocatoria) and with common access for all members of the body, presenters, and guests.

Mixed session: Is that session held by the collegiate bodies of the National Groundwater, Irrigation, and Drainage Service (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, SENARA), in which one or several of its members participate through the connectivity established with the use of the technological platform previously defined in the convocation (convocatoria), with common access for all its members, presenters, and guests, and another portion of its members participate in person at the location defined in the convocation (convocatoria).

Collegiate bodies: Bodies formally created by law, decrees, regulations, or administrative acts, composed of two or more persons whose functioning and decisions are taken jointly and according to their own regulations or the law.

Technological platforms: tools created by technological means for establishing simultaneous, real-time connectivity between two or more points that allow communication from multiple spaces, guaranteeing integral and simultaneous communication that includes video, audio, and data, and allowing all connected persons auditory, verbal, and visual interaction in real time.

The operational aspects of each collegiate body that adopts the virtual or mixed session modality, such as: the convocation (convocatoria), the type of session, absences, formation of the quorum, agenda, and documents or reports submitted for knowledge and resolution, deliberation, votes, minutes (actas) and means of challenge, and other aspects of each body's operation shall be governed by the body's own regulations, by the stipulations of the Constitutive Law of SENARA and the General Public Administration Act (Ley General de la Administración Pública), and other rules of the juridical order applicable to them.

The National Groundwater, Irrigation, and Drainage Service (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, SENARA), through the IT Management Unit (Unidad de Gestión Informática), shall provide the technological conditions and infrastructure necessary to enable effective communication and interoperability for the collegiate bodies that agree to meet virtually or in a mixed manner. Likewise, the IT Management Unit (Unidad de Gestión Informática) shall assign official email addresses so that members of the collegiate bodies can connect to sessions through them, and shall provide the required training to its members to guarantee their proper functioning.

• a)The holding of sessions of the collegiate body under the virtual or mixed modality must be agreed upon by the body previously and in a generic manner, defining the platform to be used for this purpose.
• b)Every convocation (convocatoria) for sessions of a collegiate body under the virtual or mixed modality shall so indicate in the convocation (convocatoria), specifying the platform to be used to establish connectivity.
• c)It shall be the obligation of the secretariat of the collegiate body, or failing that, of its president, to issue the convocation (convocatoria), ensuring, with proof of receipt, that all its members received the convocation (convocatoria).
• d)It shall be the obligation of the member of the collegiate body to confirm with the secretariat of the body, or failing that, with the president, the email address they will use to establish their connectivity, thus being validly convened upon receipt of the convocation (convocatoria) at that email address.
• e)The members of the collegiate body who connect by virtual means shall be obligated to have the sufficient and necessary technological resources for their virtual participation, whether their own or institutional.

Upon commencing the session virtually or in a mixed manner, its president must verify the existence of a quorum by verifying the in-person presence or virtual connection of each of the members. Similarly, during the course of the session, the person directing it must be attentive to ensure the connectivity of its members is maintained.

If any of the convened members presents connectivity problems to the session or their connectivity is unstable, they must so inform the president through the chat or any alternate means, in which case the president shall allow a prudential amount of time until the connection can be established.

If the connectivity of any or several members of the collegiate body is interrupted or unstable, they shall so inform the president through the chat or by any alternate means so that a recess is declared for a prudential time until the connection can be reestablished.

The session shall only be concluded in the event that connectivity has been lost due to a power outage and service could not be restored in a reasonable time, or for any other technical reason where efforts to reestablish the connection have been exhausted without positive results and it leads to the presumption that the problem will not be resolved in a short time. In such case, evidence of this shall be recorded in the minutes (acta) of the session.

• a)The president of the Collegiate Body shall direct the session, ordering all those procedural aspects they deem appropriate for its proper conduct.
• b)Before initiating the session, the person presiding, with the support of the recording secretary (secretaría de actas), must conduct connectivity tests to ensure that participants have the capability to transmit audio, video, or data.
• c)Those present wishing to speak must do so by raising their hand through the platform, and must lower it once their intervention concludes.
• d)Those not speaking must keep their microphones off, in order to avoid noise or interference in the communication.
• e)It is the obligation of the members of the collegiate body who participate virtually in the session to ensure that the location they are in has the necessary technological means to guarantee their participation, under conditions of security, session privacy, and, where applicable, confidentiality of information.

When a mixed session is to be held, it is necessary to have a videoconference room or duly equipped venue that makes possible the participation of persons in person and others virtually. Furthermore, the equipment used by all participants must be technologically compatible to guarantee the proper functioning of the collegiate body.

Similarly, the technological system used must guarantee the authenticity and integrity of the will and the conservation of what was carried out in the virtual session of the collegiate body, and must therefore allow the full and exact identification of the persons who are in session.

There must be security measures aimed at preventing the alteration of communication, the identification of the member, and guaranteeing the very content of the telematic transmission.

Persons participating in the virtual modality must abide by the following interaction rules:

• a)Be punctual when entering the chat or videoconference room.
• b)Use the official name on the platform and not a pseudonym, abbreviated forms, or third-party user accounts.
• c)Address other members observing the general rules of social conduct and respect.
• d)To speak, one must raise the virtual hand and wait until the person presiding so indicates, and address the point under discussion.
• e)Upon entering the session, you must activate the camera so that the person presiding over the meeting can verify the identity of the participants, in cases where identity cannot be proven by other means.
• f)Limit your interventions to the time established for the session.
• g)Notify the person presiding over the session if you need to momentarily step away. Upon rejoining, you must also notify the person presiding.
• h)All participation shall be in real time and not deferred, in such a way as to allow all persons participating in the session to listen to and communicate with each other simultaneously and permanently.

The president of the collegiate body, once the agreements have been discussed, shall submit the matter to a vote of the members of the body, which may be done by consulting each member one by one, or by asking the members in favor to kindly raise the virtual hand available on the platform. In either case, at the time of voting, the members of the body exercising their right to vote must turn on their cameras.

Likewise, if there are votes against or abstentions, the reason on which they are based must be recorded in the minutes (actas).

The Recording Secretary (Secretaría de Actas) shall draft the minutes (acta) of each in-person, virtual, or mixed session, which shall contain:

• a)The attendees.
• b)The electronic address from which each member of the body connected.
• c)The date of the virtual session.
• d)The start and end time shall be recorded.
• e)The content of the deliberations, which shall comply with all the procedural requirements indicated by the juridical order.
• f)Without prejudice to other formalities established by the juridical order, a written backup (minutes (acta) of the session) and an audio backup must be created for every virtual or mixed session.

The sessions held virtually or in a mixed manner must be in accordance with the operating rules of collegiate bodies; therefore, the powers, duties, and responsibilities of their members and of those who preside over them shall be maintained, according to the functions established in the internal juridical-administrative framework of the National Groundwater, Irrigation, and Drainage Service (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento, SENARA).

It shall be the obligation of the recording secretary (secretaría de actas) and the person presiding over the virtual or mixed session of the collegiate body to verify that the audio recording of the session is made.

This regulation takes effect upon its publication in the official gazette La Gaceta. Let it be published.

UNANIMOUS AND FINAL AGREEMENT

Este Reglamento tiene por objeto regular la realización de sesiones virtuales o mixtas en órganos colegiados del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA)., conforme con la siguiente normativa aplicable.

Lo dispuesto en este Reglamento es de acatamiento obligatorio en aquellos casos que algún órgano colegiado del SENARA acuerde llevar a cabo sesiones por medios virtuales, en las que todos o algunos de sus miembros tengan presencia virtual a través de las plataformas que ofrecen las tecnologías de información.

Para llevar a cabo una sesión virtual o mixta de un órgano colegiado, el medio electrónico utilizado debe ser previamente señalado en la convocatoria y ser capaz de permitir la conectividad de los miembros del órgano que participen bajo esa modalidad y garantizar la simultaneidad, interactividad e integralidad entre la comunicación de todas y todos los participantes. Se deberán respetar todos los aspectos establecidos en la convocatoria realizada para el efecto y durante el desarrollo de la sesión, debiendo dejarse constancia de tal circunstancia, así como el medio tecnológico utilizado.

Para la realización de sesiones virtuales y sesiones mixtas de órganos colegiados se deberá asegurar el cumplimiento de los principios que rigen el funcionamiento de todo órgano colegiado, como lo son el de colegialidad, simultaneidad, deliberación y economía, independientemente de las herramientas tecnológicas que se utilicen para estar presente. De igual manera en todo lo no indicado en este Reglamento, regirán todos aquellos principios y normas de funcionamiento que tenga establecido el órgano según su propia normativa y en la Ley General de la Administración Pública.

Para los efectos de este Reglamento se entenderá por:

Simultaneidad: Las personas físicas que integran el órgano colegiado deben concurrir en forma simultánea a la formación de la voluntad del órgano. La simultaneidad es inherente a las deliberaciones y al procedimiento de formación de la voluntad colegiada. Toda la regulación que se hace del procedimiento de formación de la voluntad parte de esa simultaneidad que es la que permite la deliberación y formación de la voluntad del órgano.

Interactividad: Este mecanismo permite una comunicación bidireccional, multidireccional y sincrónica en tiempo real, es decir se transmite en vivo y en directo, de un punto a otro o entre varios puntos a la vez.

Integralidad: La comunicación debe ser integral, permitiendo el envío de la imagen, audio y video, permitiendo ver a las personas con que se interactúan, escuchar su voz y permitiendo una transmisión de datos en tiempo real.

Sesión virtual: Es aquella sesión que realicen los órganos colegiados del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), en la cual todos los miembros del órgano no están reunidos de manera presencial, sino que participan a través de la conectividad establecida con el uso de la plataforma tecnológica previamente definida en la convocatoria y con acceso común a todos los integrantes del órgano, expositores e invitados.

Sesión mixta: En aquella sesión que realicen los órganos colegiados del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), en la que uno o varios de sus integrantes participan a través de la conectividad establecida con el uso de la plataforma tecnológica previamente definida en la convocatoria, con acceso común a todos sus integrantes, expositores e invitados y otra parte de sus integrantes participan de modo presencial en el lugar definido en la convocatoria.

Órganos colegiados: Órganos creados formalmente por la ley, decretos, reglamentos o actos administrativos, integrados por dos o más personas cuyo funcionamiento y decisiones se toman de manera conjunta y según lo establezca su propia normativa o la ley.

Plataformas tecnológicas: herramientas creadas por medios tecnológicos para realizar conectividad simultánea y en tiempo real entre dos o más puntos y que permiten la comunicación desde múltiples espacios, que garantizan una comunicación integral y simultánea que incluye video, audio y datos, y permita a todas las personas conectadas una interacción auditiva, verbal y visual en tiempo real.

Los aspectos de funcionamiento de cada órgano colegiado que se acoja a la modalidad de sesión virtual o mixta, como son: la convocatoria, el tipo de sesión, ausencias, conformación del quórum, orden del día y documentos o informes que se someterán a conocimiento y resolución, deliberación, votaciones, actas y medios de impugnación, y demás aspectos del funcionamiento de cada órgano se regirán por la normativa propia de cada órgano, y por lo estipulado en la Ley Constitutiva de SENARA y Ley General de la Administración Pública, y demás normas del ordenamiento jurídico que se les aplique.

El Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA), por medio de la Unidad de Gestión Informática, facilitará las condiciones tecnológicas e infraestructura necesaria para posibilitar la comunicación eficaz y la interoperabilidad de los órganos colegiados que acuerden sesionar de manera virtual o mixta. De igual manera la Unidad de Gestión Informática asignará las direcciones de correo electrónicas oficiales para que los miembros de los órganos colegiados se puedan conectar a sesiones a través de ellas, y brindará la capacitación requerida a sus integrantes para garantizar su adecuado funcionamiento.

• a)La realización de sesiones del órgano colegiado bajo la modalidad virtual o mixta debe ser acordada por el órgano previamente y de manera genérica, definiendo la plataforma que se utilizará para tal fin.
• b)Toda convocatoria a sesiones de un órgano colegiado bajo la modalidad virtual o mixta, así lo indicará en la convocatoria, señalando la plataforma que se utilizará para establecer la conectividad.
• c)Será obligación de la secretaría del órgano colegiado, o en su defecto de su presidente, realizar la convocatoria asegurándose, con razón de recibido, que todos sus miembros recibieron la convocatoria.
• d)Será obligación del integrante del órgano colegiado acreditar con la secretaría del órgano, o en su defecto con el presidente, el correo electrónico que utilizará para establecer su conectividad, quedando así válidamente convocado con el recibido de la convocatoria a ese correo electrónico.
• e)Será obligación que los miembros del órgano colegiado que se conecten por medios virtuales, disponer de los recursos tecnológicos suficientes y necesarios para su participación de manera virtual, sean propios o institucionales.

Al iniciar la sesión de manera virtual o mixta, su presidente deberá verificar la existencia de quórum mediante la verificación de presencialidad o conexón virtual de cada uno de los miembros. De igual manera en el transcurso de la sesión, quien la dirija debe estar atento a que la conectividad de sus miembros se mantenga.

Si alguno de los miembros convocados presenta problemas de conectividad a la sesión o su conectividad es inestable, así deberá informarlo al presidente por medio del chat o cualquier medio alterno, caso en el cual el presidente dará un espacio de tiempo prudencial hasta que pueda establecerse la conexión.

Si la conectividad de alguno o varios de los miembros del órgano colegiado se interrumpe o es inestable, así lo informará al presidente por el chat o por cualquier medio alterno para que decrete un receso por un tiempo prudencial hasta que se logre restablecer la conexión.

Únicamente se dará por finalizada la sesión en el caso que se haya perdido conectividad debido a falta de fluido eléctrico y no se haya logrado restablecer el servicio en un tiempo razonable, o por cualquier otra razón técnica en que se han agotado los esfuerzos de restablecer la conexión sin que haya tenido resultados positivos y haga presumir que el problema no se solucionará en un corto tiempo. En tal caso se dejará evidencia de ello en el acta de la sesión.

• a)El presidente del Órgano Colegiado dirigirá la sesión disponiendo todos aquellos aspectos de orden que considere apropiados para su buena marcha.
• b)Antes de dar inicio a la sesión, quien presida, con el apoyo de la secretaría de actas, deberá hacer las pruebas de conectividad para asegurarse que se cuenta con la posibilidad de transmitir audio, video o datos por parte de los participantes.
• c)Los presentes que deseen hacer uso de la palabra deberán hacerlo levantando la mano por medio de la plataforma, debiendo bajarla una vez que termine su intervención d) Quienes no estuvieren haciendo uso de la palabra, deberán mantener sus micrófonos apagados, con el fin de evitar ruidos o interferencias en la comunicación.
• e)Es obligación de los integrantes del órgano colegiado que participan virtualmente en la sesión, asegurarse que en el lugar que se encuentren tienen los medios tecnológicos necesarios para garantizar su participación, en condiciones de seguridad y la privacidad de la sesión y en su caso la confidencialidad de la información.

Cuanto se trate de realizar una sesión mixta, es necesario que se cuente con una sala de videoconferencias o recinto debidamente equipado que haga posible la participación de personas de manera presencial y otras de manera virtual. Además, será necesario que los equipos con que cuenten todos los participantes sean tecnológicamente compatibles para garantizar el adecuado funcionamiento del órgano colegiado.

Del mismo modo, el sistema tecnológico utilizado debe garantizar la autenticidad e integridad de la voluntad y la conservación de lo actuado en la sesión virtual del órgano colegiado, por lo que debe permitir la plena y exacta identificación de las personas que están sesionando.

Deben existir medidas de seguridad tendientes a evitar la alteración de la comunicación, la identificación del miembro y garantizar el contenido mismo de la transmisión telemática.

Las personas que participan en la modalidad virtual deberán acatar las siguientes reglas de interacción:

• a)Ser puntual a la hora de ingresar al chat o sala de videoconferencia.
• b)Utilizar el nombre oficial en la plataforma y no un pseudónimo ni formas abreviadas ni a través de usuarios de terceras personas.
• c)Dirigirse a las demás personas integrantes en observancia a las reglas generales de trato social y respeto.
• d)Para hacer uso de la palabra, se deberá levantar la mano virtual y esperar a cuando la persona que preside se lo indique y referirse al punto por tratar.
• e)Al ingresar a la sesión deberá activar la cámara para que quien preside la reunión pueda comprobar la identidad de las personas participantes, en los casos en que no se pueda acreditar la identidad por otros medios.
• f)Ajustar sus intervenciones al tiempo establecido para la sesión.
• g)Comunicar a la persona que preside la sesión, si tuviera necesidad de ausentarse momentáneamente de esta. Al reincorporarse, también debe avisar a quien presida la sesión.
• h)Toda participación será en tiempo real y no diferido, de tal manera que permita a todas las personas que participan en la sesión, escuchar y comunicarse entre sí al mismo tiempo y de forma permanente.

El presidente del órgano colegiado, una vez analizados los acuerdos, someterá el asunto a votación de los integrantes del órgano, lo cual podrá hacer consultando a cada miembro uno por uno, o bien solicitándoles a los miembros que estén de acuerdo que se sirvan levantar la mano virtual que tiene la plataforma. En cualquiera de los casos, al momento de las votaciones los integrantes del órgano que ejercen su derecho a voto deben encender las cámaras.

De igual manera de existir votos en contra o abstenciones, deberá quedar acreditado en actas el motivo en que se fundamenta.

La Secretaría de Actas levantará el acta de cada sesión presencial, virtual o mixta, la cual contendrá:

• a)Las personas asistentes.
• b)La dirección electrónica desde la cual se ha conectado cada integrante del órgano.
• c)Fecha de la sesión virtual.
• d)Se consignará la hora de inicio y finalización.
• e)El contenido de las deliberaciones, el cual cumplirá con todos los requisitos de forma que indica el ordenamiento jurídico.
• f)Sin perjuicio de otras formalidades que establezca el ordenamiento jurídico, de toda sesión virtual o mixta deberá crearse un respaldo escrito (acta de la sesión) y un respaldo en audio.

Las sesiones que se celebren de forma virtual o mixta deben ser conforme con las normas de funcionamiento de los órganos colegiados, por lo que se mantendrán las facultades, deberes y responsabilidades de sus miembros y de quienes los presiden, según las funciones establecidas en el marco jurídico-administrativo interno del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento (SENARA).

Será obligación de la secretaría de actas y de la persona que presida la sesión virtual o mixta del órgano colegiado, verificar que se realice la grabación en audio de la sesión.

Este reglamento rige a partir de su publicación en el diario oficial La Gaceta. Publíquese.
