Notice 17 Delimitation of the Public Zone of the Maritime-Terrestrial Zone Corresponding to a Mangrove Sector at Playa Pedregosa, District 08° Cabo Velas, Canton 03° Santa Cruz, Province 05° Guanacaste Go to the latest version Version of the Regulation: 1 of 1 INSTITUTO GEOGRÁFICO NACIONAL DELIMITATION OF THE PUBLIC ZONE OF THE MARITIME-TERRESTRIAL ZONE CORRESPONDING TO A MANGROVE SECTOR AT PLAYA PEDREGOSA, DISTRICT 08° CABO VELAS, CANTON 03° SANTA CRUZ, PROVINCE 05° GUANACASTE No. 017-2025.— On the basis of the provisions set forth in Articles 140 and 240 of Ley Nº 6227, the General Administrative Procedure Act (Ley General de la Administración Pública), dated May 2, 1978, and its amendments; Ley Nº 59, the Law on the Creation and Organization of the Instituto Geográfico Nacional, dated July 4, 1944, and its amendments; Ley Nº 8905, the Amendment to Article 2 of Ley N° 5695, creating the National Registry (Registro Nacional), and its amendments; and the amendment to Ley N° 59, on the Creation and Organization of the Instituto Geográfico Nacional, of July 4, 1944, and its amendments, dated December 7, 2010; Ley Nº 6043, the Law on the Maritime-Terrestrial Zone (Ley sobre la Zona Marítimo Terrestre), dated March 2, 1977, together with its implementing regulations; and Articles 2 and 3 of Ley Nº 5695, the National Registry Creation Act (Ley de Creación del Registro Nacional), dated May 28, 1975, and its amendments.

1st.— By virtue of Ley Nº 8905, the Amendment to Article 2 of Ley N° 5695, creating the National Registry, and its amendments; and the amendment to Ley N° 59, on the Creation and Organization of the Instituto Geográfico Nacional, dated July 4, 1944, and its amendments of December 7, 2010, the Instituto Geográfico Nacional, hereinafter IGN, was established as a dependency of the National Registry, which shall enter into the contracts and agreements necessary for the exercise of its functions. Likewise, in accordance with Ley N° 59, the Law on the Creation and Organization of the Instituto Geográfico Nacional, dated July 4, 1944, and its amendments, the IGN is "the leading scientific and technical authority on national cartography, responsible for producing the official Base Map and the basic geographic description of the Republic of Costa Rica, as well as for conducting studies, research, tasks, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, for the purpose of supporting planning processes." 2nd.— Ley Nº 59 establishes the IGN on a permanent basis, as the official authority on behalf of the State in matters of geodesy and the spatial representation of the geography of the Republic of Costa Rica, with its authority extending to all activities that originate from the work entrusted to it.

3rd.— In accordance with Article 62 of Decreto Ejecutivo N° 7841-P, the Regulations to the Law on the Maritime-Terrestrial Zone (Zona Marítimo Terrestre), dated December 16, 1977, and its amendments, the IGN's authority to delimit the public zone (zona pública) of the Maritime-Terrestrial Zone is recognized, with its formalization effected through publication in the Diario Oficial La Gaceta; Article 63 of Decreto Ejecutivo N° 7841-P states that "The Instituto Geográfico Nacional shall publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone." 4th.— Decreto Ejecutivo N° 36642-MP-MOPT-MINAET, the Specifications Regulations for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone, dated June 28, 2011, provides in Article 18 that, for the delimitation of the public zone of the Maritime-Terrestrial Zone, the IGN may employ two implementation methodologies, as set forth in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime-Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation (delimitación digital georreferenciada), with the aim of expediting delimitations and providing greater technical certainty for interested parties.

5th.— Decreto Ejecutivo N° 33797-MJ-MOPT, Declaring the Official Horizontal Datum (datum horizontal) for Costa Rica as CR05, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, dated March 30, 2007, which, among other matters, establishes the National Horizontal Reference Geodetic Network (Red Geodésica Nacional) CR05 and its associated cartographic projection CRTM05 as the official system to which all coordinates of geodetic, cartographic, and cadastral works carried out in Costa Rica must be referenced. It specifically states in Article 11 that: "The National Horizontal Reference Geodetic Network CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica, to which all surveys and cartographic and geodetic activities carried out in the National Territory by any public agency, person, or domestic or foreign private entity must be referenced."; while Article 7 states that "As cartographic data are produced in the new cartographic projection system CRTM05, the Instituto Geográfico Nacional shall publish, through appropriate means, information that has been officially adopted." 6th.— Decreto Ejecutivo Nº 40962-MJP, the Update of the Official Horizontal Geodetic Reference System for Costa Rica, dated January 24, 2018, declares in Article 1 that "The official horizontal geodetic reference system for Costa Rica, known as CR05 and materialized through the National Geodetic Network, changes its designation to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59; henceforth, changes and updates thereto shall be governed in accordance with the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) known as SIRGAS-CON"; while Article 2 establishes that "The cartographic projection system CRTM05 shall continue to be the official system for the cartographic representation of the continental national territory, extended for purposes of applying this cartographic projection to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, with such baseline defined in accordance with Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for computing the maximum breadth of all marine jurisdictional areas of the Costa Rican State." For its part, Article 12 of the aforementioned decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which references in the continental territory of Costa Rica must be made, stating that "The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended to the baseline of the territorial sea, and the 'Universal Transverse Mercator' (UTM) cartographic projection, zones 16 and 17, for the marine and insular jurisdictional areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, to which all surveys and cartographic and geodetic activities carried out in the national territory by any public agency, person, or domestic or foreign private entity undertaking or contracting geodetic and cartographic works must be referenced, thereby contributing to the avoidance of public expenditure and, at the same time, obtaining reliable, uniform, and comparable geographic information of general utility that supports decision-making at the various levels of the State." 7th.— By means of Directriz DIG-01-2025, the Update of Public Zone Information of the Maritime-Terrestrial Zone with respect to the Horizontal Reference System CR-SIRGAS for the Measurement Epoch 2014.59, dated May 28, 2025, the information in the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the IGN concerning the Maritime-Terrestrial Zone was updated, transferring it from the horizontal reference system CR05 to the horizontal reference system CR-SIRGAS for the measurement epoch 2014.59, CRTM05 projection, as the delimitation mechanism for the Maritime-Terrestrial Zone.

8th.— Georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime-Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans, the endorsement of survey maps (planos de agrimensura), the granting of concessions in the Restricted Zone (Zona Restringida), and other aspects of coastal land-use planning.

9th.— The georeferenced digital information on the delimitation of the public zone of the Maritime-Terrestrial Zone held by the IGN is referred to as the Georeferenced Digital Geodatabase (GDG) of the IGN on the Maritime-Terrestrial Zone.

10.— The Georeferenced Digital Geodatabase (GDG) of the IGN on the Maritime-Terrestrial Zone is technically grounded in the application of the regulatory framework established by: a) Decreto Ejecutivo N° 7841-P, the Regulations to Ley N° 6043 on the Maritime-Terrestrial Zone; b) Decreto Ejecutivo N° 33797-MJ-MOPT, Declaring the Official Horizontal Datum for Costa Rica as CR05 and its associated cartographic projection CRTM05; c) Decreto Ejecutivo N° 36642-MP-MOPT-MINAET, the Specifications Regulations for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone; d) Decreto Ejecutivo Nº 40962-MJP, the Update of the Official Horizontal Geodetic Reference System for Costa Rica; and e) Directriz DIG-01-2025, the Update of Public Zone Information of the Maritime-Terrestrial Zone with respect to the Horizontal Reference System CR-SIRGAS for the measurement epoch 2014.59.

11.— Article 16 of Ley N° 7575, Ley Forestal, dated February 13, 1996, and its amendments, establishes that MINAE shall demarcate in the field the boundaries of the areas comprising the State Natural Heritage (Patrimonio Natural del Estado).

12.— Article 11 of Chapter I, General Provisions, of Ley N° 6043, the Law on the Maritime-Terrestrial Zone, dated March 2, 1977, and its amendments, establishes that the "Public zone also includes, regardless of its extent, all land occupied by mangroves (manglares) of the continental and insular coastlines and estuaries (esteros) of the national territory." 13.— Decreto Ejecutivo N° 36786-MINAET, the Manual for the Classification of Lands Dedicated to the Conservation of Natural Resources within the Maritime-Terrestrial Zone in Costa Rica, dated August 12, 2011, sets among its objectives to "Identify within the Maritime-Terrestrial Zone those lands classified as forests, forestry-suitable land (Class VII and VIII soils), wetlands (humedales) (mangroves, estuaries, inlets (rías), salt marshes (marismas), coastal lagoons, swamps, flooded forests, salt flats (salitrales)), in order to certify them and incorporate them as part of the State Natural Heritage (PNE)." 14.— Decreto Ejecutivo N° 36786-MINAET, in Section III.— Jurisdiction for Delimitation and Certification, establishes that "The classification of lands within the ZMT shall be the responsibility of the Conservation Areas (Áreas de Conservación, AC) of SINAC and of private professionals duly accredited by the relevant Professional Associations (Colegios Profesionales) to classify forests, forestry-suitable land (Class VII and VIII soils), (mangroves, estuaries, inlets, salt marshes, coastal lagoons, swamps, flooded forests, salt flats), and wetlands.

The validity of classification documents issued by private professionals shall be subject to the approval of the AC having territorial jurisdiction. The AC of SINAC with jurisdiction over the ZMT shall also be responsible for the verification, oversight, boundary determination (deslinde), and certification of State Natural Heritage lands and protection zones (zonas de protección).

The location and delimitation of State Natural Heritage areas within the Maritime-Terrestrial Zone must be carried out as part of the approval process for the Coastal Regulatory Plan (Plan Regulador Costero, PRC), as defined by Ley 6043, since the Coastal Regulatory Plan is the land-use planning instrument that defines and locates all zones to be conceded within the ZMT and for classifying them at the level of cadastral maps (planos de catastro). Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the PNE areas so that they are not counted in the total area available for concession." 15.— The IGN employed the Georeferenced Digital Delimitation methodology to delimit the public zone of the Maritime-Terrestrial Zone corresponding to a mangrove sector at Playa Pedregosa, district 08º Cabo Velas, canton 03º Santa Cruz, province 05º Guanacaste.

16.— By means of official communications ACT-OSRSCC-997-2023 dated August 31, 2023, signed by Mr. Orlando Matarrita Suárez, Acting Head of the Subregional Office of Santa Cruz Carrillo, Guanacaste; and DDUR-DCT-IGN-0110-02-2024 dated February 27, 2024, signed by Ms. Alejandra Sancho Perlaza and Ms. Karina Cruz Campos, both engineers in the Department of Cadastre and Topography (Departamento de Catastro y Topografía) of the Municipality of Santa Cruz; the completed delimitation and technical report are presented and approved.

17.— The delimitation of the public zone of the ZMT in the canton of Santa Cruz was carried out under the Cooperation Agreement between the Sistema Nacional de Áreas de Conservación and the Municipality of Santa Cruz, and was implemented through the hiring of the company STEREOCARTO CENTROAMERICA S.A., under tender 2022LA-000021-0021000001, pursuant to official communication CTPR-SINAC_ACT-0043-10-2023 (DDUR-DCTSINAC_ACT-0630-10-2023) dated October 10, 2023.

18.— By means of official communication DIG-GDF-007-2025 dated May 28, 2025, issued by the Topography Sub-process of the Department of Geodesy and Geophysics of the Instituto Geográfico Nacional, a Technical Review Report was issued for the publication of the georeferenced digital delimitation of the public zone, in connection with the work carried out by SINAC-ACT concerning the delimitation of a mangrove sector at Playa Pedregosa, with the delimitation technically endorsed for publication.

19.— Article 140 of Ley N° 6227, the General Administrative Procedure Act, dated May 2, 1978, and its amendments, states that "the administrative act (acto administrativo) shall take effect after it is communicated to the person administered, except where it solely confers rights, in which case it shall take effect from the moment it is adopted," a provision that must necessarily be read in conjunction with Article 240, paragraph 1), of the same legal body, which defines the appropriate instrument for communicating acts of a general nature by stating that: "General acts shall be communicated by publication, and specific acts by notification." HEREBY ANNOUNCES:

First: That, between August 31, 2023 and February 27, 2024, SINAC-ACT carried out the fieldwork for the georeferenced digital delimitation to the national coordinate system of the public zone of a mangrove sector at Playa Pedregosa, district 08° Cabo Velas, canton 03º Santa Cruz, province 05º Guanacaste.

Second: The Instituto Geográfico Nacional publishes the georeferenced digital delimitation of the public zone defined by 13 points describing a mangrove sector located at Playa Pedregosa, district 08º Cabo Velas, canton 03º Santa Cruz, province 05º Guanacaste, on the basis of the Specifications Regulations for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone and the methodology used and validated by the Área de Conservación Tempisque (SINAC-ACT).

Third: That the delimited public zone corresponds to a mangrove sector located at Playa Pedregosa, district 08º Cabo Velas, canton 03º Santa Cruz, province 05º Guanacaste, in accordance with official communications DIG-GDF-007-2025 dated May 28, 2025, issued by the Topography Sub-process of the Department of Geodesy and Geophysics of the Instituto Geográfico Nacional; ACT-OSRSCC-997-2023 dated August 31, 2023, signed by Mr. Orlando Matarrita Suárez, Acting Head of the Subregional Office of Santa Cruz Carrillo, Guanacaste; and DDUR-DCT-IGN-0110-02-2024 dated February 27, 2024, signed by Ms. Alejandra Sancho Perlaza and Ms. Karina Cruz Campos, both engineers in the Department of Cadastre and Topography of the Municipality of Santa Cruz.

Fourth: The public zone of the Maritime-Terrestrial Zone corresponding to a mangrove sector at Playa Pedregosa, district 08° Cabo Velas, canton 03° Santa Cruz, province 05° Guanacaste, corresponds to the following coordinates in the official cartographic projection system of Costa Rica CRTM05/CR05 and its update with respect to the Horizontal Reference System CR-SIRGAS:

Sixth: The official technical data for the georeferenced digital delimitation of the public zone of the Maritime-Terrestrial Zone of a mangrove sector at Playa Pedregosa, district 08° Cabo Velas, canton 03° Santa Cruz, province 05° Guanacaste, have been recorded in the Georeferenced Digital Geodatabase (GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime-Terrestrial Zone (ZMT), in a shapefile vector-format file, under the coding: ZONA PUBLICA_ mojones.

Seventh: With this delimitation, boundary marker M21A, published in the Diario Oficial La Gaceta N° 91 of May 14, 1984, is removed from the Maritime-Terrestrial Zone Registry.

Eighth: This takes effect upon publication.

1. 1Que mediante Ley Nº 8905 Reforma del artículo 2 de la ley N° 5695, Creación del Registro Nacional, y sus reformas; y modificación de la Ley N° 59, Creación y Organización del Instituto Geográfico Nacional, de 4 de julio de 1944, y sus reformas del 07 de diciembre del 2010, se estableció al Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, de conformidad con la Ley N° 59 Ley de Creación y Organización del Instituto Geográfico Nacional del 4 de julio de 1944 y sus reformas, el IGN es "la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación"
2. 2Que la Ley Nº 59 constituye al IGN de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con el artículo 62 del Decreto Ejecutivo N° 7841-P Reglamento a la Ley sobre la Zona Marítimo Terrestre del 16 de diciembre de 1977 y sus reformas, se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto Ejecutivo N° 7841-P señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública."
4. 4Que el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre del 28 de junio del 2011, establece según el artículo 18 que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83 del 30 de marzo del 2007, el cual entre otros aspectos determina a la Red Geodésica Nacional de Referencia Horizontal CR05 y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera."; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."
6. 6Que el Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica del 24 de enero de 2018, declara en su artículo 1 que "El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON"; mientras que el artículo 2 establece que "El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense."

Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que "El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (UTM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado."

1. 7Que por medio de la Directriz DIG-01-2025 Actualización de Información de la zona pública de la Zona Marítimo Terrestre con respecto al Sistema de Referencia Horizontal CR-SIRGAS para la época de medición 2014.59 del 28 de mayo del 2025, se procedió a actualizar la información de la Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre, pasándola del sistema de referencia horizontal CR05 al sistema de referencia horizontal CR-SIRGAS para la época de medición 2014.59, proyección CRTM05, como mecanismo de delimitación de la Zona Marítimo Terrestre.
2. 8Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
3. 9Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre.

10.-Que la Geodatabase Digital Georreferenciada (GDG) del IGN sobre la Zona Marítimo Terrestre se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre; b) el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05; c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre; d) el Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica; y e) la Directriz DIG-01-2025 Actualización de Información de la zona pública de la Zona Marítimo Terrestre con respecto al Sistema de Referencia Horizontal CR-SIRGAS para la época de medición 2014.59.

11.-Que el artículo 16 de la Ley N° 7575 Ley Forestal del 13 de febrero de 1996 y sus reformas, establece que el Ministerio del Ambiente y Energía (MINAE) delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

12.-Que el artículo 11 del Capítulo I Disposiciones Generales de la Ley N° 6043 Ley sobre la Zona Marítimo Terrestre del 02 de marzo de 1977 y sus reformas, establece que la "Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional." 13.-Que el Decreto Ejecutivo N°36786-MINAET Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica del 12 de agosto de 2011, establece entre sus objetivos "Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE)." 14.-Que el Decreto Ejecutivo N° 36786-MINAET en el Punto III.-Competencias para la delimitación y certificación establece que "La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.

La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y concesionar." 15.-Que el IGN utilizó la metodología de Delimitación Digital Georreferenciada, para delimitar la zona pública de la Zona Marítimo Terrestre correspondiente a un sector de manglar en playa Pedregosa, distrito 08º Cabo Velas, cantón 03º Santa Cruz, provincia 05º Guanacaste.

16.-Que mediante oficios ACT-OSRSCC-997-2023 del 31 de agosto del 2023 suscrito por el señor Orlando Matarrita Suárez, Jefe a.i. de la Oficina Subregional de Santa Cruz Carrillo, Guanacaste; y DDUR-DCT-IGN-0110-02-2024 del 27 de febrero del 2024 suscrito por las señoras Alejandra Sancho Perlaza y Karina Cruz Campos, ambas Ingenieras del Departamento de Catastro y Topografía de la Municipalidad de Santa Cruz; presentan la delimitación realizada y el informe técnico al cual se le otorga visto bueno.

17.-Que la delimitación de la zona pública de la ZMT del cantón de Santa Cruz fue realizada bajo el Convenio de Cooperación entre el Sistema Nacional de Áreas de Conservación y la Municipalidad de Santa Cruz, y concretado por la contratación de la empresa STEREOCARTO CENTROAMERICA S.A., licitación 2022LA-000021-0021000001, según oficio CTPR-SINAC_ACT-0043-10-2023 (DDUR-DCTSINAC_ACT-0630-10- 2023) del 10 de octubre de 2023.

18.-Que mediante el oficio DIG-GDF-007-2025 del 28 de mayo de 2025, generado por el Subproceso de Topografía del Departamento de Geodesia y Geofísica del Instituto Geográfico Nacional, se emitió el Informe de revisión técnica para la publicación de delimitación georreferenciada de la zona pública, en relación con los trabajos realizados por SINAC-ACT relativos a la delimitación de un sector de manglar en Playa Pedregosa avalada técnicamente la delimitación realizada para su publicación.

19.-Que el artículo 140 de la Ley N° 6227 Ley General de la Administración Pública del 02 de mayo de 1978 y sus reformas, señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 240 inciso 1) del mismo cuerpo normativo, que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicarán por publicación los actos generales y por notificación, los concretos." COMUNICA:

Primero: Que, entre 31 de agosto de 2023 y el 27 febrero de 2024, SINAC-ACT realizó el trabajo de campo para la delimitación digital georreferenciada al sistema nacional de coordenadas de la zona pública de un sector de manglar en Playa Pedregosa, distrito 08° Cabo Velas, cantón 03º Santa Cruz, provincia 05º Guanacaste.

Segundo: El Instituto Geográfico Nacional publica la delimitación digital georreferenciada de la zona pública de 13 puntos que describen en un sector manglar ubicado en Playa Pedregosa, distrito 08º Cabo Velas, cantón 03º Santa Cruz, provincia 05º Guanacaste, con base al Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre y a la metodología usada y validada por el Área de Conservación Tempisque (SINAC-ACT).

Tercero: Que la zona pública delimitada corresponde a un sector manglar ubicado en Playa Pedregosa, distrito 08º Cabo Velas, cantón 03º Santa Cruz, provincia 05º Guanacaste en conformidad a los oficios DIG-GDF-007-2025 de fecha 28 de mayo de 2025, generado por el Subproceso de Topografía del Departamento de Geodesia y Geofísica del Instituto Geográfico Nacional; ACT-OSRSCC-997-2023 del 31 de agosto del 2023 suscrito por el señor Orlando Matarrita Suárez, Jefe a.i. de la Oficina Subregional de Santa Cruz Carrillo, Guanacaste; y DDUR-DCT-IGN-0110-02-2024 del 27 de febrero del 2024 suscrito por las señoras Alejandra Sancho Perlaza y Karina Cruz Campos, ambas Ingenieras del Departamento de Catastro y Topografía de la Municipalidad de Santa Cruz.

Cuarto: La zona pública de la Zona Marítimo Terrestre correspondiente a un sector de manglar en playa Pedregosa, distrito 08° Cabo Velas, cantón 03° Santa Cruz, provincia 05° Guanacaste, corresponde a las coordenadas, en el sistema de proyección cartográfica oficial de Costa Rica CRTM05/CR05 y su actualización con respecto al Sistema de Referencia Horizontal CR-SIRGAS, siguientes:

Sexto: Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre de un sector de manglar en Playa Pedregosa, distrito 08° Cabo Velas, cantón 03° Santa Cruz, provincia 05° Guanacaste, han quedado registrados en la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), en archivo con formato vectorial shape, bajo la codificación: ZONA PUBLICA_ mojones.

Sétimo:Con esta delimitación queda eliminado del Registro de Zona Marítimo Terrestre el mojón M21A publicado en el Diario Oficial La Gaceta N° 91 del 14 de mayo de 1984.

Octavo: Rige a partir de su publicación.
