in the entirety of the text - Full Text of Norm 45118 Reform for Setting tariffs for services of the Ministry of Agriculture and Livestock No. 45118-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers granted in Articles 140, subsections 3), 8), 18) and 20) and 146 of the Political Constitution, Articles 25, 27 subsection 1), 28 subsection 2) paragraph b) of Law No. 6227 of May 2, 1978, General Law of Public Administration, Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock and Law No. 8495 of April 6, 2006, General Law of the National Animal Health Service.
1st.- That the National Animal Health Service (SENASA) is the competent authority in matters of animal health and safety of products of animal origin, in accordance with the provisions of Law No. 8495 of April 6, 2006, General Law of the National Animal Health Service, and as a body of minimal deconcentration of the Ministry of Agriculture and Livestock.
2nd.- That through Executive Decree No. 27763-MAG of March 10, 1999 and its reforms, the tariffs for the services that the Ministry of Agriculture and Livestock offers to the National Productive Sector and especially to the Agricultural Sector are established, those stipulated in articles 3 and 4 bis corresponding to those offered through the National Animal Health Service (SENASA).
3rd.- That through Executive Decree No. 44336-MAG-S-SP-MOPT of January 12, 2024, the National System for Individual Identification and Traceability of Bovine Cattle was created, with the objective of establishing effective control over the movement, origin, health status, and traceability of the animals, thus strengthening animal health, national and international trade, and food safety.
4th.- That, as part of the implementation of this traceability (rastreabilidad) system, it is necessary to apply individual identification to each bovine, which implies the provision of a specialized technical service under the responsibility of SENASA, whose cost must be fixed and regulated through the corresponding tariffs.
5th.- That in accordance with the provisions of article 5 of Executive Decree No. 27763-MAG of March 10, 1999 and its reforms, those examinations that the National Veterinary Services Laboratory (LANASEVE) performs in fulfillment of the microbiological sampling programs for pathogenic agents and the contaminant residue program are exempt from the payment of tariffs, when these are in its catalog of services offered.
6th.- That it is necessary to incorporate a provision related to those cases in which the laboratory examinations are not implemented at LANASEVE and the samples must be sent to external national or foreign laboratories, establishing that it is the responsibility of the administered parties to assume the cost of shipping and carry out the payment process for the cost of the laboratory examination(s) directly with the external laboratory.
7th.- That in accordance with the provisions of article 5 bis of Executive Decree No. 27763-MAG of March 10, 1999 and its reforms, SENASA may establish agreements for the provision of specific sanitary services, such as the diagnostic test for Brucella. In this context, the creation of a budget code is required that allows for the correct invoicing and collection for said service, in accordance with the principles of legality and transparency in the use of public funds.
8th.- That by virtue of the principle of service at cost established in article 6 of Law No. 8495 of April 6, 2006, General Law of the National Animal Health Service, it is appropriate to set new tariffs and make adjustments to existing ones, that reflect the real costs of service provision, guaranteeing their sustainability and effectiveness.
9th.- That in accordance with the provisions of article 12 of Executive Decree No. 37045-MP-MEIC of February 22, 2012 and its reform "Regulation to the Law for the Protection of Citizens from Excessive Requirements and Administrative Procedures", the present regulation complies with the principles of regulatory improvement, in accordance with report DMR-DAR-INF-166-2025 dated June 16, 2025 issued by the Directorate of Regulatory Improvement of the Ministry of Economy, Industry, and Commerce.

1º.- Que el Servicio Nacional de Salud Animal (SENASA) es la autoridad competente en materia de sanidad animal y seguridad de los productos de origen animal, conforme a lo establecido en la Ley N° 8495 del 6 de abril de 2006, Ley General del Servicio Nacional de Salud Animal, y como órgano de desconcentración mínima del Ministerio de Agricultura y Ganadería.
2º.- Que mediante Decreto Ejecutivo Nº 27763-MAG del 10 de marzo de 1999 y sus reformas, se encuentran establecidas las tarifas de los servicios que el Ministerio de Agricultura y Ganadería ofrece al Sector Productivo Nacional y en especial al Sector Agropecuario, correspondiendo las estipuladas en los artículos 3 y 4 bis a las que ofrece a través del Servicio Nacional de Salud Animal (SENASA).
3º.- Que mediante Decreto Ejecutivo N.° 44336-MAG-S-SP-MOPT del 12 de enero de 2024 se creó el Sistema Nacional de Identificación Individual y Rastreabilidad del Ganado Bovino, con el objetivo de establecer un control efectivo sobre el desplazamiento, procedencia, estado sanitario y trazabilidad de los animales, fortaleciendo así la sanidad animal, el comercio nacional e internacional y la seguridad alimentaria.
4º.- Que, como parte de la implementación de este sistema de trazabilidad, se requiere aplicar una identificación individual a cada bovino, lo cual implica la prestación de un servicio técnico especializado a cargo de SENASA, cuyo costo debe ser fijado y regulado mediante las tarifas correspondientes.
5º.- Que conforme a lo dispuesto en el artículo 5 del Decreto Ejecutivo Nº 27763-MAG del 10 de marzo de 1999 y sus reformas, están exceptuadas del pago de las tarifas, aquellos exámenes que el Laboratorio Nacional de Servicios Veterinarios (LANASEVE) realice en cumplimiento de los programas de muestreo microbiológico de agentes patógenos y del programa de residuos de contaminantes, cuando los mismos se encuentren en su catálogo de servicios ofrecidos.
6º.- Que se hace necesario incorporar disposición relativa a aquellos casos en que los exámenes de laboratorio no estén implementados en el LANASEVE y deban las muestras remitirse a laboratorios externos nacionales o extranjeros, estableciéndose que corresponde a los administrados asumir el costo del envío y realizar el proceso de pago del costo del examen o exámenes de laboratorio directamente con el laboratorio externo.
7º.- Que conforme a lo dispuesto en el artículo 5 bis del Decreto Ejecutivo N.° 27763-MAG del 10 de marzo de 1999 y sus reformas, SENASA podrá establecer convenios para la prestación de servicios sanitarios específicos, como la prueba diagnóstica de Brucella. En este contexto, se requiere la creación de un código presupuestario que permita la correcta facturación y recaudación por dicho servicio, de conformidad con los principios de legalidad y transparencia en el uso de fondos públicos.
8º.- Que en virtud del principio de servicio al costo establecido en el artículo 6 de la Ley N° 8495 del 6 de abril de 2006, Ley General del Servicio Nacional de Salud Animal, es procedente fijar nuevas tarifas y realizar ajustes a las existentes, que reflejen los costos reales de prestación de los servicios, garantizando su sostenibilidad y eficacia.
9º.- Que de conformidad con lo establecido en el artículo 12 del Decreto Ejecutivo N° 37045- MP-MEIC del 22 de febrero de 2012 y su reforma "Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y TrámitesAdministrativos", el presente reglamento cumple con los principios de mejora regulatoria, de acuerdo con el informe DMR-DAR-INF- 166-2025 de fecha 16 de junio de 2025 emitido por la Dirección de Mejora Regulatoria del Ministerio de Economía, Industria y Comercio.
