PROTOCOL I PROVISIONS FOR DRAWING UP REPORTS ON EVENTS INVOLVING HARMFUL SUBSTANCES (in accordance with Article 8 of the Convention)

Obligation to report

• 1)The master or other person in charge of any ship involved in one of the events referred to in Article II of this Protocol shall submit the appropriate report without delay, providing the details of the event and describing them as fully as possible, in accordance with this Protocol.
• 2)If the ship referred to in paragraph 1) of this Article is abandoned, or if its report is incomplete or impossible to obtain, the ship’s owner, charterer, manager or operator, or their agents, shall assume, to the extent possible, the obligations imposed on the master by this Protocol.

Cases in which a report is required

• 1)A report shall always be made whenever an event involves:
• a)a discharge exceeding the permitted level or a probable discharge of oil or noxious liquid substances, for any reason, including discharges made to safeguard the ship’s safety or human life at sea; or
• b)a discharge or probable discharge of harmful substances carried in packaged form, including those carried in containers, portable tanks, road or rail vehicles, and shipborne barges; or
• c)damage, failure or breakdown on a ship 15 m or more in length that:
• i)affects the ship’s safety, such as, but not limited to, collisions, groundings, fires, explosions, structural failures, flooding and cargo shifting; or
• ii)impairs the safety of navigation, such as, but not limited to, failure or breakdown of the steering gear, propulsion machinery, generating system and essential navigational aids on board; or
• d)a discharge of oil or noxious liquid substances during the ship’s operations that exceeds the permitted quantity or instantaneous discharge rate under this Convention.
• 2)For the purposes of this Protocol:
• a)The oil referred to in paragraph 1) a) of this Article is as defined in Regulation 1.1 of Annex I to the Convention.
• b)The noxious liquid substances referred to in paragraph 1) a) of this Article are as defined in Regulation 1.10 of Annex II to the Convention.
• c)The harmful substances in packaged form referred to in paragraph 1) b) of this Article are substances considered marine pollutants under the International Maritime Dangerous Goods Code (IMDG Code).

Contents of the report In all cases, reports shall state:

• a)the identity of the ships involved;
• b)the time, type and geographic location of the event;
• c)the quantity and type of harmful substances involved;
• d)assistance and salvage measures.

Supplementary report Any person required under this Protocol to submit a report shall, when possible, be required:

• a)to supplement the initial report, as necessary, by providing information about events subsequent to the event; and
• b)to comply, to the fullest extent possible, with requests from affected States for additional information concerning the event.

Procedures for reporting events

• 1)Reports shall be transmitted to the nearest coastal State through the fastest available telecommunications channels and with the highest possible priority.
• 2)To comply with this Protocol, the Parties to this Convention shall issue, or arrange for the issuance of, regulations or instructions concerning the procedures to be followed for reporting events involving harmful substances, based on the guidelines prepared by the Organization.

Obligación de informar

• 1)El capitán u otra persona a cuyo cargo esté cualquier buque involucrado en uno de los sucesos a que se hace referencia en el artículo II del presente Protocolo enviará el oportuno informe facilitando los pormenores del suceso sin demora y describiéndolos con la máxima amplitud posible, de conformidad con lo dispuesto en el presente Protocolo.
• 2)En el supuesto de que el buque al que se hace referencia en el párrafo 1) del presente artículo sea abandonado, o de que su informe sea incompleto o imposible de obtener, el propietario, el fletador, el gestor o el armador del buque, o los agentes de éstos, asumirán en todo lo posible las obligaciones que impone al capitán lo dispuesto en el presente Protocolo.

Ficha Artículo 1

Casos en que se informará

• 1)Se informará siempre que un suceso entrañe:
• a)una descarga superior al nivel autorizado o una probable descarga de hidrocarburos o de sustancias nocivas líquidas, sea cual fuere el motivo, incluidas las que se hagan para salvaguardar la seguridad del buque o la vida humana en la mar; o
• b)una descarga o una probable descarga de sustancias perjudiciales que se transporten en bultos, incluidas las que se lleven en contenedores, tanques portátiles, vehículos de carretera o ferroviarios y gabarras de buque; o
• c)un daño, fallo o avería en un buque de eslora igual o superior a 15 m que:
• i)afecte a la seguridad del buque, como por ejemplo, y sin que la enumeración sea exhaustiva, abordajes, varadas, incendios, explosiones, fallos estructurales, inundaciones y corrimientos de la carga; o
• ii)vaya en detrimento de la seguridad de la navegación, como por ejemplo, y sin que la enumeración se exhaustiva, fallos o averías del aparato de gobierno, las máquinas propulsoras, el sistema electrógeno y las ayudas a la navegación esenciales de a bordo; o
• d)una descarga de hidrocarburos o de sustancias nocivas líquidas, efectuada en el curso de las operaciones del buque, que rebase la cantidad o el régimen instantáneo de descarga permitidos en virtud del presente Convenio.
• 2)A los efectos del presente Protocolo:
• a)Los hidrocarburos a que se hace referencia en el párrafo 1) a) del presente artículo son los definidos en la regla 1.1 del Anexo I del Convenio.
• b)Las sustancias nocivas líquidas a que se hace referencia en el párrafo
• 1)a) del presente artículo son las definidas en la regla 1.10 del Anexo II del Convenio.
• c)Las sustancias perjudiciales en bultos a que se hace referencia en el párrafo 1) b) del presente artículo son las sustancias consideradas como contaminantes del mar en el Código marítimo internacional de mercancías peligrosas (Código IMDG).

Ficha Artículo 2

Contenido del informe En los informes, en cualquier caso, se hará constar:

• a)identidad de los buques involucrados;
• b)hora, tipo y situación geográfica del suceso;
• c)cantidad y tipo de las sustancias perjudiciales involucradas;
• d)medidas de auxilio y salvamento.

Ficha Artículo 3

Informe complementario Toda persona obligada en virtud de lo dispuesto en el presente Protocolo a enviar un informe estará obligada, cuando ello sea posible:

• a)a complementar el informe inicial, según sea necesario, a facilitar información acerca de los acontecimientos posteriores al suceso; y
• b)a satisfacer en la mayor medida posible las peticiones de información adicional relativa al suceso que hagan los Estados afectados.

Ficha Artículo 4

Procedimientos para informar acerca de sucesos

• 1)Los informes se cursarán al Estado ribereño más próximo por los canales de telecomunicaciones más rápidos de que se disponga y dándoles la máxima prioridad posible.
• 2)A fin de dar cumplimiento a lo dispuesto en el presente Protocolo, las Partes en el presente Convenio emitirán o dispondrán que se emitan reglamentos o instrucciones relativos a los procedimientos que habrán de seguirse para informar acerca de sucesos en que estén involucradas sustancias perjudiciales, basándose para ello en las directrices elaboradas por la Organización.
