in the entirety of the text - Complete Text of Regulation 46056 Renders Ineffective the Declaration of Public Utility for the Interests of the State of the Asociación Acueducto Tablazo Centro No. 46056-MJP THE PRESIDENT OF THE REPUBLIC The MINISTER OF JUSTICE AND PEACE Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, on articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) item b) of the General Law of Public Administration No. 6227 of May 2, 1978, on article 32 of the Law of Associations No. 218 of August 8, 1939, and articles 27 and following of the Regulation to the Law of Associations No. 29496-J, published in La Gaceta No. 96 of May 21, 2001.
I.- That article 32 of the Law of Associations No. 218 of August 8, 1939 and its amendments, grants the Executive Branch the power to declare of public utility those simple, federated, or confederated associations, whose development and activities are particularly useful for the interests of the State, and that thereby contribute to solving a social need.
II.- That the Asociación Acueducto Tablazo Centro, legal identification number three-zero zero two-three hundred seventy-eight thousand eighty-two, was registered in the Registry of Associations of the Public Registry on August thirteenth, two thousand four, in volume five hundred twenty-nine, entry seven thousand seven hundred eighty-eight.
III.- That article 32 of the Law of Associations establishes: "At any time, the Ministry of Justice and Peace shall revoke this benefit, if the reasons for which it was granted cease to exist. (...)". Likewise, subsection 33 bis of the Regulation to the Law of Associations adds: "The declaration of public utility shall be revocable at any time; however, in the event of the non-submission or incomplete submission of the work report, the association shall be given notice, a single time, within a period of ten business days. Likewise, the repeal of public utility shall be carried out by means of a reasoned resolution resulting from the procedure for the repeal of the benefit of public utility which shall be governed by the provisions of the General Law of Public Administration (...)". Finally, clause 33 ter of the Regulation to the Law of Associations indicates: "In the event that any association renounces the declaration of public utility, it must submit the corresponding documentation to the Legal Advisory Office of the Ministry of Justice and Peace which, without further proceeding, shall proceed to carry out the repeal." IV.- That the Asociación Acueducto Tablazo Centro, legal identification number three-zero zero two-three hundred seventy-eight thousand eighty-two, represented by Mr. Ronny Esteban Arias López, bearer of identity card number one-thousand eighty-zero seven hundred four, was declared of public utility by the Ministry of Justice and Peace through Executive Decree No. 41954-MJP, dated August sixth, two thousand nineteen.
V.That the Asociación Acueducto Tablazo Centro, by means of a document dated August twelfth, two thousand twenty-three, communicated its formal resignation to the benefit of the declaration of public utility.

Therefore:

l.- Que el artículo 32 de la Ley de Asociaciones Nº218 del 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.- Que la Asociación Acueducto Tablazo Centro, cédula jurídica número tres-cero cero dos-trescientos setenta y ocho mil ochenta y dos, se inscribió en el Registro de Asociaciones del Registro Público el trece de agosto del dos mil cuatro, al tomo quinientos veintinueve, asiento siete mil setecientos ochenta y ocho.
III.- Que el artículo 32 de la Ley de Asociaciones establece: " En cualquier momento, el Ministerio de Justicia y Paz, revocará este beneficio, si desaparecen los motivos por los cuales fue concedido. (...)". V.Que la Asociación Acueducto Tablazo Centro, mediante documento de fecha doce de agosto del dos mil veintitrés comunicó renuncia formal al beneficio de la declaratoria de utilidad pública.
