in the entirety of the text - Complete Text of Regulation 45058 Revokes the Declaration of public utility for the interests of the State of the Administrative Association for the Aqueduct and Sanitary Sewer of La Argentina, Barrio El Carmen, and Pocora Sur No. 45058-MJP THE PRESIDENT OF THE REPUBLIC THE MINISTER OF JUSTICE AND PEACE Based on the provisions set forth in Articles 11, 140 subsection 18), and 146 of the Political Constitution, in Articles 25 subsection 1), 27 subsection 1), and 28 subsection 2) heading b) of the General Law on Public Administration No. 6227 of December 1, 1978, in Article 32 of the Law on Associations No. 218 of August 8, 1939, and Articles 27 and following of the Regulations to the Law on Associations No. 29496-J, published in La Gaceta No. 96 of May 21, 2001.
I.— That Article 32 of the Law on Associations No. 218 of August 8, 1939 and its amendments, grants the Executive Branch the power to declare of public utility those simple, federated, or confederated associations whose development and activities are particularly useful for the interests of the State, and which thereby contribute to meeting a social need.
II.— That the Administrative Association for the Aqueduct and Sanitary Sewer of La Argentina, Barrio El Carmen, and Pocora Sur, legal identification number three-zero-zero-two-five hundred fifty-three thousand two hundred sixty-six, was registered in the Associations Registry of the National Public Registry since the twentieth day of October of two thousand eight, in volume five hundred seventy-six, entry sixty-three thousand four hundred fifteen.
III.— That Article 32 of the Law on Associations establishes: “At any time, the Ministry of Justice and Peace shall revoke this benefit, if the reasons for which it was granted disappear. (... )”. Likewise, Article 33 bis of the Regulations to the Law on Associations adds: “The declaration of public utility shall be revocable at any time, however, in the case of non-submission or incomplete submission of the work report, the association shall be granted a single period of ten business days to comply. Furthermore, the repeal of the public utility declaration shall be carried out by means of a reasoned resolution resulting from the procedure for the repeal of the public utility benefit, which shall be governed by the provisions of the General Law on Public Administration (. . .)”.
IV.— That the Administrative Association for the Aqueduct and Sanitary Sewer of La Argentina, Barrio El Carmen, and Pocora Sur, through its legal representative, Mr. Walter Gerardo Cambronero Salazar, holder of identity card number six- zero one hundred ninety-five-zero seven hundred nine, failed to submit the annual work report for the years 2023 and 2024, failing to present items of value to allow for a valid justification of said non-compliance.
THEY DECREE THE REPEAL OF THE DECLARATION OF PUBLIC UTILITY OF THE ASSOCIATION ADMINISTRATIVE ASSOCIATION FOR THE AQUEDUCT AND SANITARY SEWER OF LA ARGENTINA, BARRIO EL CARMEN, AND POCORA SUR

1.- Que el artículo 32 de la Ley de Asociaciones Nº 218 del 08 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.- Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario de la Argentina Barrio el Carmen y Pocora Sur, cédula jurídica número tres-cero cero dos- quinientos cincuenta y tres mil doscientos sesenta y seis, se inscribió en el Registro de Asociaciones del Registro Público Nacional desde el día veinte de octubre de dos mil ocho, al tomo quinientos setenta y seis, asiento sesenta y tres mil cuatrocientos quince, III.- Que el artículo 32 de la Ley de Asociaciones establece: En cualquier momento, el Ministerio de Justicia y Paz. revocará este beneficio, si desaparecen los motivos por los cuales fue concedido. (... )". Asimismo, el ordinal 33 bis del Reglamento a la Ley de Asociaciones, agrega: "La declaratoria de utilidad pública será revocable en cualquier momento, no obstante. en caso de la no presentación o presentación incompleta del informe de labores, se prevendrá a la asociación, una única vez, por el plazo de diez días hábiles. Asimismo. la derogatoria de la utilidad pública se realizará mediante resolución razonada resultante del procedimiento de derogatoria del beneficio de utilidad pública el cual, se regirá por lo establecido en la Ley General de Administración Pública (. . .)".
IV.- Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario de la Argentina Barrio el Carmen y Pocora Sur, por medio de su representante legal el señor Walter Gerardo Cambronero Salazar, portador de la cédula de identidad número seis- cero ciento noventa y cinco-cero setecientos nueve, incumplió con la presentación del informe anual de labores correspondiente a los años 2023 y 2024, no presentando elementos de valor que permitan acreditar justificación valida de dichos incumplimientos.
