in the entirety of the text - Full Text of Regulation 45057 Renders without effect Declares of public utility for the interests of the State the Administrative Association of the Communal Aqueduct of Uvita and Bahía No. 45057-MJP THE PRESIDENT OF THE REPUBLIC THE MINISTER OF JUSTICE AND PEACE Based on the provisions of articles 140, subsection 18) and 146 of the Political Constitution, articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) item b) of the General Law of Public Administration No. 6227 of December 1, 1978, article 32 of the Law of Associations No. 218 of August 8, 1939, and articles 27 and following of the Regulation to the Law of Associations No. 29496-J, published in La Gaceta No. 96 of May 21, 2001.
I.—That article 32 of the Law of Associations No. 218 of August 8, 1939 and its amendments, grants the Executive Branch the power to declare of public utility the simple, federated, or confederated associations, whose development and activities are particularly useful for the interests of the State, and that thereby contribute to solving a social need.
II.—That the Asociación Administradora del Acueducto Comunal de Uvita y Bahía, legal ID number three-zero zero two-two hundred four thousand five hundred forty-four, was registered in the Registry of Associations of the Public Registry on October second, nineteen ninety-six, in volume four hundred thirty-seven, entry sixteen thousand seven hundred thirty-six.
III.—That article 32 of the Law of Associations establishes: "... At any time, the Ministry of Justice and Peace. shall revoke this benefit, if the reasons for which it was granted disappear. (...)." Likewise, ordinal 33 bis of the Regulation to the Law of Associations, adds: "The declaration of public utility shall be revocable at any time, notwithstanding, in the event of non-submission or incomplete submission of the work report, the association shall be forewarned a single time, within a period of ten business days. Likewise, the repeal of the public utility shall be carried out by means of a reasoned resolution resulting from the procedure for repeal of the public utility benefit, which shall be governed by the provisions of the General Law of Public Administration (...)." Finally, numeral 33 ter of the Regulation to the Law of Associations, indicates: "In the event that any association renounces the declaration of public utility, it must submit the corresponding documentation to the Legal Advisory Department of the Ministry of Justice and Peace, which. without further formality. shall proceed with the repeal. ..
IV.—That the Asociación Administradora del Acueducto Comunal de Uvita y Bahía, by means of a document dated August eight, two thousand twenty-three, signed by Mr. Luis Sibaja Monge, formally submitted a renunciation of the benefit of the declaration of public utility.

en la totalidad del texto - Texto Completo Norma 45057 Deja sin efecto Declara de utilidad pública para los intereses del Estado la Asociación Administradora del Acueducto Comunal de Uvita y Bahía Nº 45057-MJP EL PRESIDENTE DE LA REPÚBLICA El MINISTRO DE JUSTICIA Y PAZ Con fundamento en lo dispuesto en los artículos 140, inciso 18) y 146 de la Constitución Política, en los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de Administración Pública Nº 6227 del 1º de diciembre de 1978, en el artículo 32 de la Ley de Asociaciones Nº 218 del 8 de agosto de 1939 y los artículos 27 y siguientes del Reglamento a la Ley de Asociaciones Nº 29496-J, publicado en La Gaceta Nº 96 del 21 de mayo del 2001.
I.- Que el artículo 32 de la Ley de Asociaciones Nº 218 del 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.- Que la Asociación Administradora del Acueducto Comunal de Uvita y Bahía, cédula jurídica número tres-cero cero dos-doscientos cuatro mil quinientos cuarenta y cuatro, se inscribió en el Registro de Asociaciones del Registro Público el dos de octubre de mil novecientos noventa y seis, al tomo cuatrocientos treinta y siete, asiento dieciséis mil setecientos treinta y seis.
III.- Que el artículo 32 de la Ley de Asociaciones establece: "... En cualquier momento, el Ministerio de Justicia y Paz. revocará este beneficio, si desaparecen los motivos por los cuales fue concedido. (...)". Asimismo, el ordinal 33 bis del Reglamento a la Ley de Asociaciones, agrega: "La declaratoria de utilidad pública será revocable en cualquier momento, no obstante, en caso de la no presentación o presentación incompleta del informe de labores, se prevendrá a la asociación una única vez, por el plazo de diez días hábiles. Asimismo, la derogatoria de la utilidad pública se realizará mediante resolución razonada resultante del procedimiento de derogatoria del beneficio de utilidad pública el cual se regirá por lo establecido en la Ley General de Administración Pública (...)". Finalmente, el numeral 33 ter del Reglamento a la Ley de Asociaciones, indica: "En caso de que alguna asociación renuncie a la declaratoria de utilidad pública, deberá presentar la documentación correspondiente ante la Asesoría Jurídica del Ministerio de Justicia y Paz quien. sin más trámite. procederá a realizar la derogatoria. ..
IV.- Que la Asociación Administradora del Acueducto Comunal de Uvita y Bahía, mediante documento de fecha ocho de agosto del dos mil veintitrés, suscrito por el señor Luis Sibaja Monge presentaron formal renuncia al beneficio de la declaratoria de utilidad pública.
