This Directive DIG-01-2025 updates the Public Zone information of the Maritime Terrestrial Zone (Zona Marítimo Terrestre, ZMT) onto the CR-SIRGAS horizontal reference system for the 2014.59 measurement epoch, CRTM05 projection.

Based on the provisions of articles 129 of the Political Constitution; 102, 140 and 240 of Law No. 6227 General Law of Public Administration dated May 2, 1978 and its amendments; 1 and 2 of Law No. 59 Law for the Creation and Organization of the National Geographic Institute of July 4, 1944 and its amendments; 2 of Law No. 8905 Amendment of article 2 of Law No. 5695, Creation of the National Registry, and its amendments; and modification of Law No. 59, Creation and Organization of the National Geographic Institute, of July 4, 1944, and its amendments dated December 7, 2010; 2 and 3 of Law No. 5695 Law for the Creation of the National Registry dated May 28, 1975 and its amendments.

1. 1That publication is a requirement for the effectiveness of norms, in accordance with the interpretation of articles 129 of the Constitution; 140 and 240 subsection 1) of the General Law of Public Administration.
2. 2That through Law No. 8905 the National Geographic Institute, hereinafter IGN, was established as a dependency of the National Registry, and, in accordance with Law No. 59, the IGN was established as "the scientific and technical body governing national cartography, responsible for the execution of the official basic Map and the basic geographical Description of the Republic of Costa Rica and for the studies, research or work and the development of national policies of a cartographic, geographic, geodetic, geophysical and similar nature related to said works, in order to support planning processes"; the IGN being permanently and on behalf of the State, the official authority on geodetic matters and the spatial representation of the geography and cartography of the Republic of Costa Rica, its authority extending to activities of any order originating from the tasks entrusted to it.
3. 3That georeferencing to the national coordinate system as a mechanism to delimit the Public Zone of the Maritime Terrestrial Zone (ZMT), for the purposes of preparing regulatory plans, approving survey plans, granting concessions in the Restricted Zone and other aspects of coastal territorial planning and management; the digital georeferenced information on the delimitation of the ZMT held by the IGN being named the Digital Georeferenced Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).
4. 4That the IGN is the authority responsible for the determination, maintenance, expansion and updating of the National Geodetic Network of Costa Rica, as the Geodetic Reference Framework for the sustainability of the Official Coordinate System and the spatial representation of the national territory; hence, the geographic information provided by the IGN is a basic input for the development of activities carried out in the planning and management process, and similarly, it supports the definition of guidelines and policies for the public and private sectors, because it contributes to the visualization and comprehensive analysis of the territory, and to decision-making, consequently to sustainable development.
5. 5That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulations established by: a) Executive Decree No. 7841-P Regulation to Law No. 6043 on the Maritime Terrestrial Zone of December 16, 1977, published in Supplement No. 16 of the Official Gazette La Gaceta No. 20 of January 27, 1978 and its amendments; b) Executive Decree No. 33797-MJ-MOPT Declares as the official horizontal datum for Costa Rica, the CR05, and its associated cartographic projection, CRTM05 of March 30, 2007, published in the Official Gazette La Gaceta No. 108 of June 6, 2007; c) Executive Decree No. 36642-MP-MOPT-MINAET Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone of June 28, 2011, published in the Official Gazette La Gaceta No. 136 of July 14, 2011; and d) Executive Decree No. 40962-MJP Update of the Official Horizontal Geodetic Reference System for Costa Rica of January 24, 2018, published in the Official Gazette La Gaceta No. 66 of April 17, 2011.
6. 6That Executive Decree No. 33797-MJ-MOPT Declares as the official horizontal datum for Costa Rica, the CR05, and its associated cartographic projection; provided that the official horizontal "datum" for Costa Rica, the CR05, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the 2005.83 measurement epoch; however, said reference system is outdated due to changes in the new definitions of the International Terrestrial Reference Frame (ITRF), plate tectonics phenomena and seismic events, creating the need to represent specific geographic zones where Costa Rica exercises its sovereignty, in cartographic projection systems different from the one made official by that Decree.
7. 7That Executive Decree No. 40962-MJP Update of the Official Horizontal Geodetic Reference System for Costa Rica, declares in its article 1 that "The official horizontal geodetic reference system for Costa Rica, denominated as CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the 2014.59 measurement epoch, and henceforth, the changes and its update, shall be governed according to the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) denominated SIRGAS-CON"; furthermore, article 2 establishes that "The cartographic projection system CRTM05 shall continue to be the official one for the cartographic representation of the continental national territory, extended for the purposes of applying this cartographic projection, to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this line being defined in accordance with articles 5, 6 and 7 of the United Nations Convention on the Law of the Sea, as the starting point for calculating the maximum width of all jurisdictional marine areas of the Costa Rican State."

Given that article 10 establishes the obligation for the IGN to officially publish through the Official Gazette La Gaceta, and the geoportal of the National Territorial Information System (SNIT), the update parameters of the CR-SIRGAS horizontal reference system over time, as deemed appropriate, namely: "Article 10: The National Geographic Institute shall be responsible for officially publishing through the Official Gazette La Gaceta, and the geoportal of the National Territorial Information System (SNIT) the update parameters of the CR-SIRGAS horizontal reference system over time, as deemed appropriate, for geodetic, topographic, cartographic and cadastral purposes." In turn, article 12 of the cited decree reinforces the application of CRTM05 as the cartographic projection for presenting the coordinates of the official system of Costa Rica, which must be referenced in the continental territory of our country, by stating that "The CR-SIRGAS horizontal reference system and its associated cartographic projection CRTM05 for the continental territory extended to the baseline of the territorial sea and, the "Universal Transverse Mercator" (UTM) cartographic projection, zones 16 and 17 for jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities carried out in the national territory by any public entity, person or private entity, national or foreign, that undertake or contract geodetic and cartographic work must be referenced, thereby contributing to avoiding public spending and obtaining, on the other hand, reliable, uniform and comparable geographic information, which is of general utility and supports decision-making at the different levels of the State."

1. 8That Directive DIG-001-2020 Transformation parameters to pass from epochs 2014.59 to 2019.24 in ITRF14 corresponding to CR-SIRGAS of August 21, 2020, published in the Official Gazette La Gaceta No. 223 of September 04, 2020; and Directive DIG-001-2022 Transformation parameters to pass from datum CR05 to CR-SIRGAS of June 20, 2022, published in the Official Gazette La Gaceta No. 114 of June 20, 2022; provide transformation parameters between the epochs of the CRSIRGAS system (2014.59-2019.24); as well as transformation parameters between the CR05 and CR-SIRGAS reference systems.
2. 9That through Directive DIG-001-2023 NTIG_ CR01_01.2023: Geodetic Reference System of Costa Rica of June 30, 2023, published in the Official Gazette La Gaceta No. 155 of August 25, 2023, the Technical Standard for Geographic Information NTIG_CR01_06.2016: Geodetic Reference System of Costa Rica was updated by NTIG_ CR01_06.2023: Geodetic Reference System of Costa Rica.

10.-That Executive Decree No. 37773-JP-H-MINAE-MICIT Creates the National Territorial Information System (SNIT) of May 07, 2013, published in the Official Gazette La Gaceta No. 134 of July 12, 2013, has the general objective of promoting the generation of basic and thematic geographic products, services and information of national, regional and local coverage, in addition to publishing in an integrated and georeferenced manner the territorial information produced both by public entities and bodies and by private persons, individual or legal, and homologating standardized geospatial information within the framework of a common data infrastructure; therefore, the creation of the SNIT and its establishment consolidate it as the geoportal of the Spatial Data Infrastructure for Costa Rica (IDECORI), which is based on articles 1 and 2, by providing:

"Article 1º- The National Territorial Information System is hereby created, which may be named by its acronym SNIT, as a system that publicizes and publishes in an integral manner thematic territorial information duly georeferenced, standardized and made compatible with the base territorial information constituted by the official cadastral and topographic cartography, generated in a first stage from orthophotogrammetric, topographic and cartographic surveys, by the Cadastre and Registry Regularization Program at different scales, as well as aerial orthophotography, satellite imagery, and any other type of medium deemed appropriate by the National Registry." "Article 2º- The SNIT has the general objectives of promoting the generation of georeferenced geographic products, services and information of national, regional and local coverage and of publishing in an integrated and georeferenced manner the territorial information produced by public entities and bodies, as well as by private persons, individual or legal, and of standardizing standardized geospatial information within the framework of a common data infrastructure.".

The following is hereby provided:

UPDATE OF PUBLIC ZONE INFORMATION OF THE MARITIME TERRESTRIAL ZONE WITH RESPECT TO THE CR-SIRGAS HORIZONTAL REFERENCE SYSTEM FOR THE 2014.59 MEASUREMENT EPOCH 1º-Based on Executive Decree No. 40962- MJP Update of the Official Horizontal Geodetic Reference System for Costa Rica of January 24, 2018, the information of the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) was updated, transferring it from the CR05 horizontal reference system to the CR-SIRGAS horizontal reference system for the 2014.59 measurement epoch, CRTM05 projection, as a mechanism for delimiting the ZMT.

1. 2That the updated information on the ZMT is available for internal and external users through the Digital Georeferenced Geodatabase (GDG), whose update is recorded in the geoportal of the SNIT, through files in vector shapefile format, under the coding: 1) Public zone boundary markers; 2) Public zone lines; 3) Public zone estuaries and channels.

3º-It takes effect upon its publication in the Official Gazette La Gaceta.

La presente Directriz DIG-01-2025, actualiza la información de la Zona Pública de la Zona Marítima Terrestre sobre el sistema de referencia horizontal CR-SIRGAS para la época de medición 2014.59 proyección CRTM05.

Con fundamento en lo normado por los artículos 129 de la Constitución Política; 102, 140 y 240 de la Ley Nº 6227 Ley General de la Administración Pública de fecha 2 de mayo de 1978 y sus reformas; 1 y 2 de la Ley Nº 59 Ley de Creación y Organización del Instituto Geográfico Nacional del 4 de julio de 1944 y sus reformas; 2 de la Ley Nº 8905 Reforma del artículo 2 de la ley N° 5695, Creación del Registro Nacional, y sus reformas; y modificación de la Ley N° 59, Creación y Organización del Instituto Geográfico Nacional, de 4 de julio de 1944, y sus reformas de fecha 7 de diciembre del 2010; 2 y 3 de la Ley Nº5695 Ley de Creación del Registro Nacional de fecha 28 de mayo de 1975 y sus reformas.

1. 1Que la publicación es un requisito de eficacia de las normas, de conformidad con la interpretación de los artículos 129 Constitucional; 140 y 240 inciso 1) de la Ley General de la Administración Pública.
2. 2Que mediante Ley Nº 8905 se estableció al Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, y, de conformidad con la Ley Nº 59, se instauró al IGN como "la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación"; siendo el IGN de manera permanente y en representación del Estado, la autoridad oficial en materia geodésica y de la representación espacial de la geografía y cartografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la Zona Pública de la Zona Marítimo Terrestre (ZMT), a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento y planificación territorial costero; siendo que la información digital georreferenciada sobre delimitación de la ZMT con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).
4. 4Que el IGN es la autoridad responsable de la determinación, mantenimiento, ampliación y actualización de la Red Geodésica Nacional de Costa Rica, como Marco Geodésico de Referencia para la sostenibilidad del Sistema Oficial de Coordenadas y la representación espacial del territorio nacional; de ahí que, la información geográfica que provee el IGN, es un insumo básico para el desarrollo de las actividades que se lleven a cabo en el proceso de planeación y de ordenamiento, y asimismo, apoya la definición de las orientaciones y políticas de los sectores público y privado, porque contribuye a la visualización y al análisis integral del territorio, la toma de decisiones, en consecuencia, al desarrollo sostenible.
5. 5Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P Reglamento a la Ley N°. 6043 sobre la Zona Marítimo Terrestre del 16 de diciembre de 1977, publicado en el Alcance N° 16 del Diario Oficial La Gaceta N°20 del 27 de enero de 1978 y sus reformas; b) el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05 del 30 de marzo del 2007, publicado en el Diario Oficial La Gaceta N° 108 del 06 de junio del 2007; c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre del 28 de junio del 2011, publicado en el Diario Oficial La Gaceta N° 136 del 14 de julio del 2011; y d) el Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica del 24 de enero del 2018, publicado en el Diario Oficial La Gaceta N° 66 del 17 de abril del 2011.
6. 6Que el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada; dispuso que el "datum" horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83; no obstante, dicho sistema de referencia esta desfasado en el tiempo debido a los cambios en las nuevas definiciones del Marco Internacional de Referencia Terrestre (ITRF), fenómenos de la tectónica de placas y eventos sísmicos, surgiendo la necesidad de representar zonas geográficas particulares donde Costa Rica ejerce su soberanía, en sistemas de proyección cartográfica distintos del oficializado mediante ese Decreto.
7. 7Que el Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica, declara en su artículo 1 que "El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON"; además que el artículo 2 establece que "El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense."

Siendo que el artículo 10 es el que establece la obligación al IGN de publicar oficialmente a través del Diario Oficial La Gaceta, y el geoportal del Sistema Nacional de Información Territorial (SNIT) los parámetros de actualización del sistema de referencia horizontal CR-SIRGAS en el tiempo, conforme se considere, a saber: "Artículo 10: El Instituto Geográfico Nacional se encargará de publicar oficialmente a través del Diario Oficial La Gaceta, y el geoportal del Sistema Nacional de Información Territorial (SNIT) los parámetros de actualización del sistema de referencia horizontal CR-SIRGAS en el tiempo, conforme se considere, para los fines geodésicos, topográficos, cartográficos y catastrales." Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación del CRTM05 como la proyección cartográfica para la presentación de las coordenadas del sistema oficial de Costa Rica la cual se deben referenciar en el territorio continental de nuestro país, al señalar que "El sistema de referencia horizontal CR-SIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (UTM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado."

1. 8Que la Directriz DIG-001-2020 Parámetros de transformación para pasar de las épocas 2014.59 a la 2019.24 en el ITRF14 correspondiente con CR-SIRGAS del 21 de agosto del 2020, publicada en el Diario Oficial La Gaceta N° 223 del 04 de setiembre de 2020; y la Directriz DIG-001-2022 Parámetros de transformación para pasar del datum CR05 a CR-SIRGAS del 20 de junio del 2022, publicada en el Diario Oficial La Gaceta N° 114 del 20 de junio de 2022; brindan parámetros de transformación entre las épocas del sistema CRSIRGAS (2014.59-2019.24) ; así como parámetros de transformación entre los sistemas de referencia CR05 y CR-SIRGAS.
2. 9Que mediante la Directriz DIG-001-2023 NTIG_ CR01_01.2023: Sistema de Referencia Geodésico de Costa Rica del 30 de junio del 2023, publicada en el Diario Oficial La Gaceta N° 155 del 25 de agosto del 2023, se actualizó la Norma Técnica de Información Geográfica NTIG_CR01_06.2016: Sistema de Referencia Geodésico de Costa Rica, por NTIG_ CR01_06.2023: Sistema de Referencia Geodésico de Costa Rica.

10.-Que el Decreto Ejecutivo N° 37773-JP-H-MINAE-MICIT Crea Sistema Nacional de Información Territorial (SNIT) del 07 de mayo de 2013, publicado en el Diario Oficial La Gaceta N° 134 del 12 de julio de 2013, tiene como objetivo general promover la generación de productos, servicios e información geográfica básica y temática de cubrimiento nacional, regional y local, además de publicar en forma integrada y georreferenciada la información territorial producida tanto por entes y órganos públicos como por personas privadas, físicas o jurídicas, y homologar la información geoespacial estandarizada en el marco de una infraestructura de datos común; por lo que la creación del SNIT y su establecimiento lo consolidan como el geoportal de la Infraestructura de Datos Espaciales para Costa Rica (IDECORI), que se fundamenta en los artículos 1 y 2, al disponer:

"Artículo 1º- Créase el Sistema Nacional de Información Territorial, que podrá denominarse por sus siglas como SNIT, como un sistema que publicita y publica en forma integral la información territorial temática debidamente georeferenciada, estandarizada y compatibilizada a la información territorial de base constituida por la cartografía catastral y topográfica oficial, generada en una primera etapa a partir de los levantamientos ortofotogramétricos, topográficos y cartográficos, por el Programa de Regularización del Catastro y Registro a diferentes escalas, así como la ortofotografía aérea, la imagen de satélite, así como cualquier otro tipo de medio que estime el Registro Nacional." "Artículo 2º- El SNIT tiene objetivos generales promover la generación de productos, servicios e información geográfica georeferenciada de cubrimiento nacional, regional y local y publicar en forma integrada y georeferenciada la información territorial producida por entes y órganos públicos, así como por personas privadas, físicas o jurídicas, y uniformar la información geoespacial estandarizada en el marco de una infraestructura de datos común.".

Se procede con lo siguiente:

ACTUALIZACIÓN DE INFORMACIÓN DE LA ZONA PÚBLICA DE LA ZONA MARÍTIMO TERRESTRE CON RESPECTO AL SISTEMA DE REFERENCIA HORIZONTAL CR-SIRGAS PARA LA ÉPOCA DE MEDICIÓN 2014.59 1º-Con fundamento en el Decreto Ejecutivo Nº 40962- MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica del 24 de enero del 2018, se procedió a actualizar la información de la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT), pasándola del sistema de referencia horizontal CR05 al sistema de referencia horizontal CR-SIRGAS para la época de medición 2014.59, proyección CRTM05, como mecanismo de delimitación de la ZMT.

1. 2Que la información actualizada sobre la ZMT se encuentra disponible para las personas usuarias internas y externa a través de la Geodatabase Digital Georreferenciada (GDG), cuya actualización consta en el geoportal del SNIT, mediante archivos con formato vectorial shapefile, bajo la codificación: 1) Zona pública mojones; 2) Zona pública líneas; 3) Zona pública rías y canales.

3º-Rige a partir de su publicación en el Diario Oficial La Gaceta.
