1. 1That in accordance with the provisions of Law 7384 and Law 8436, the Costa Rican Institute of Fisheries and Aquaculture has the relevant powers and authority to establish regulations for the protection, control, surveillance, and regulation of fishing and aquaculture activity.
2. 2That fishing and aquaculture activity, pursuant to Law 8436, must be understood, interpreted, and applied as a series of acts related to scientific, commercial, sport fishing or aquaculture, as well as all collateral processes involving the utilization, extraction, transport, commercialization and industrialization, and protection of aquatic resources.
3. 3That due to its scope and importance, fishing activity was considered and declared of public utility and social interest, thereby establishing the responsibility and authority of INCOPESCA to exercise effective control as the executing authority of Law 8436.
4. 4That, along the same lines, Law 8436 establishes and defines as an authorization that administrative act through which the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA) enables natural or legal persons to carry out aquaculture and fishing activity under the terms indicated in that Law, among which are the authorizations for transport of fishery and aquaculture products.
5. 5That in Title X, Chapter I, Law No. 8436 establishes the acts considered, according to the type of infraction, as crimes, infractions, sanctions, and appeals. Attributing to INCOPESCA the application of administrative sanctions, as well as the management of collections; obligating on the other hand the administrative police authorities to provide support to INCOPESCA; in addition to granting the National Coast Guard Service the authority to carry out operations to arrest or seize goods used in the commission of crimes or infractions committed in violation of that Law.
6. 6That the effective application of the sanctions and measures for the protection and regulation of the optimal utilization of hydrobiological resources, contemplated in Law No. 8436, requires joint and coordinated work among the Public Institutions of the central and decentralized administration.
7. 7That it is for this reason that those who, pursuant to the provisions of Law No. 8436, hold a license, authorization, permit, or concession, shall be obligated to keep an operations logbook of their activity, in accordance with the requirements, requisites, and formalities established by INCOPESCA.
8. 8That the activity of transporting aquatic flora and fauna products must be carried out in strict observance of the regulatory provisions contemplated in Law 8436; as well as subject to the regulations that INCOPESCA imposes in the use of its powers and authority.
9. 9That in order to have clarity in the development of the activity of transporting fishery and aquaculture products, it is convenient and necessary to establish provisions that regulate said activity, for which reason the Members of the Board of Directors.

AGREE:

1. 1That every natural or legal person engaged in the transport of fishery and aquaculture products must have the corresponding authorization issued by INCOPESCA; for which purpose they will be obligated to keep and use an operations logbook (Transport Guide) with the characteristics and conditions established by INCOPESCA.

2º—Only the transport of those fishery and aquaculture products that comply with the regulations established by INCOPESCA regarding size, species, origin, landing, and capture shall be authorized.

1. 3That every national vehicle transporting fishery and aquaculture products must carry the current veterinary operation certificate, the current authorization for the transport of fishery and aquaculture products, the invoices of product origin, and the Transport Guide.
2. 4That every foreign vehicle transporting fishery and aquaculture products and circulating through national territory must obligatorily carry the respective Single Customs Declaration (Declaración Única Aduanera, DUA) document and may be verified at control posts.
3. 5That every vehicle transporting fishery and aquaculture products, whose origin is national and which circulates through national territory where control posts are located, both border posts and those located in: Talamanca, Coto Brus, Corredores, Golfito, Sixaola, La Cruz, Upala, Los Chiles, San Carlos, Sarapiquí, Pococí, and any other that may be established; must request from the police authority or animal quarantine (SENASA) official stationed in the area, the corresponding review seal and signature for the fishery product, seal and signature that must be stamped on the corresponding Transport Guide.

6º—Failure to comply with the provisions set forth in this regulation shall be sanctioned in accordance with the provisions established in Law 8436.

1. 7That vehicles used for the commission of illicit acts typified in the Fisheries and Aquaculture Law shall be liable for the payment of fines imposed on their occupants or owners. Therefore, action shall be taken before the judicial office hearing the case for the annotation of the judicial lien in the margin of the National Registry of Movable Goods of the Ministry of Justice, on the vehicle involved in the criminal acts. The foregoing in order to secure the movable good, and to prevent its disposal until the criminal process is concluded.

8º—Approve the following improvements to the transport guide for fishery and aquaculture products, taking into consideration that within a period of three months after the publication of this agreement, Mr. Martin Méndez Hernández of the Chorotega Regional Office shall present a report on possible recommendations in accordance with the various needs expressed by users.

- Modification of column titles - Letterheads, watermarks, and consecutive number in the footer.

- Addition of two columns with product description and destination.

- Addition of filling instructions on the back of the Guide, with examples.

9º—Mr. Martín Méndez Hernández is instructed to initiate a socialization process of the improved transport guide among users.

10.—The transport guide attached hereto shall be taken as an integral part of this agreement 11.—Final agreement.

1. 1Que de conformidad con lo regulado en la ley 7384 y en la ley 8436, el Instituto Costarricense de la Pesca y Acuacultura tiene las competencias y facultades pertinentes para establecer las regulaciones de protección, control, vigilancia y regulación de la actividad pesquera y acuícola.
2. 2Que la actividad pesquera y acuícola, al tenor de lo indicado en la ley 8436 debe ser entendida, interpretada y aplicada como una serie de actos relacionados con la pesca científica, comercial, deportiva o de acuicultura, así como, todos los procesos colaterales que conlleven el aprovechamiento, la extracción, el transporte, la comercialización e industrialización y la protección de los recursos acuáticos.
3. 3Que en razón de su envergadura e importancia la actividad pesquera fue considerada y declarada de utilidad pública e interés social, estableciendo para ello la responsabilidad y atribución al INCOPESCA de ejercer el efectivo control como autoridad ejecutora de la Ley 8436.
4. 4Que, en esa misma línea, la Ley 8436 se establece y define como autorización aquel acto administrativo mediante el cual el Instituto Costarricense de Pesca y Acuicultura (INCOPESCA) habilita a personas físicas o jurídicas para que desarrollen la actividad acuícola y de pesca en los términos indicados en esa Ley, dentro de las cuales se encuentran las autorizaciones de transporte de producto pesquero y acuícola.
5. 5Que en el Título X, Capítulo I, la Ley N°. 8436, establece los actos considerados, según tipo de infracción, como de delitos, infracciones, sanciones y recursos. Atribuyéndole al INCOPESCA la aplicación de sanciones de carácter administrativo, así como la gestión de cobros; obligando por otra parte a las autoridades de policía administrativa a brindar apoyo al INCOPESCA; además de otorgar al Servicio Nacional de Guardacostas la competencia de realizar operativos para arrestar o decomisar bienes utilizados en la comisión de delitos o infracciones cometidos por infracción a esa Ley.
6. 6Que la efectiva aplicación de las sanciones y medidas para la protección y regulación del aprovechamiento óptimo de los recursos hidrobiológicos, contempladas en la Ley N°. 8436, requiere un trabajo conjunto y coordinado entre las Instituciones Públicas de la administración central y descentralizada.
7. 7Que es por ello que quienes al tenor de lo preceptuado en la Ley N°. 8436, posean una licencia, autorización, permiso o concesión, estarán obligados a llevar un libro de registro de operaciones de su actividad, conforme a los requerimientos, requisitos y formalidades que establezca el INCOPESCA.
8. 8Que la actividad de transporte de productos de flora y fauna acuáticos deberá realizarse en estricta observancia a las disposiciones normativas contempladas en la Ley 8436; así como con sujeción a la reglamentación que en uso de sus facultades y atribuciones imponga el INCOPESCA.
9. 9Que a efecto de contar con claridad en el desarrollo de la actividad transporte de productos pesqueros y acuícolas, resulta conveniente y necesario establecer disposiciones que regulen dicha actividad, por lo que los Señores Miembros de Junta Directiva.

ACUERDA:

1. 1Que, toda persona física o jurídica que se dedique al transporte de productos pesqueros y acuícolas deberán contar con la autorización correspondiente emitida por el INCOPESCA; para lo cual estarán obligadas a llevar y utilizar un libro de registro de operaciones (Guía de Transporte) con las características y condiciones que establezca el INCOPESCA.

2º-Únicamente se autorizará el transporte de aquel producto pesquero y acuícola que cumpla con las regulaciones establecidas por el INCOPESCA en cuanto a talla, especie, procedencia, desembarque y captura.

1. 3Que, todo vehículo nacional que transporta producto pesquero y acuícola debe portar el certificado veterinario de operación vigente, la autorización para el transporte de productos pesqueros y acuícolas vigente, las facturas de origen del producto y la Guía de Transporte.
2. 4Que, todo vehículo extranjero que transporte producto pesquero y acuícola y que circule por el territorio nacional, obligatoriamente deberá portar el respectivo documento Declaración Única Aduanera (DUA) y podrá ser verificado por los puestos de control.
3. 5Que todo vehículo de transporte de productos pesqueros y acuícolas, cuyo origen sea nacional y que circule por el territorio nacional donde se encuentren ubicados los puestos de control tanto fronterizos como aquellos ubicados en: Talamanca, Coto Brus, Corredores, Golfito, Sixaola, La Cruz, Upala, Los Chiles, San Carlos, Sarapiquí, Pococí y cualquier otro que se establezca; deberá requerir de la autoridad policial o de cuarentena animal (SENASA) destacada en la zona, el sello y firma de revisión correspondiente del producto pesquero, sello y firma que deberán estamparse en la Guía de Transporte correspondiente.

6º-El incumplimiento a lo señalado en la presente regulación será sancionado de conformidad con lo establecido en ley 8436.

1. 7Que los vehículos utilizados para la comisión de los hechos ilícitos tipificados en la Ley de Pesca y Acuicultura responderán por el pago de las multas impuestas a sus ocupantes o dueños. Por lo tanto, se gestionará ante el despacho judicial que conozca la causa, la anotación del gravamen judicial al margen del Registro Nacional de Bienes Muebles del Ministerio de Justicia, sobre el vehículo involucrado en los hechos delictivos. Lo anterior con el fin de asegurar el bien mueble, y que no se disponga del mismo hasta que se dé por terminado el proceso penal.

8º-Aprobar las siguientes mejoras a la guía de transporte de productos pesqueros y acuícolas, tomando en consideración que en un plazo de tres meses después de la publicación de este acuerdo, el señor Martin Méndez Hernández de la Regional de Chorotega presente un informe sobre las posibles recomendaciones de acuerdo con las diversas necesidades expuestas de los usuarios.

- Modificación en los títulos de columnas - Membretes, sellos de agua y número de consecutivo al pie de página.

- Adición de dos columnas con descripción del producto y destino.

- Adición de instrucciones de llenado en el dorso de la Guía, con ejemplos.

9º-Se le instruye al señor Martín Méndez Hernández para que inicie un proceso de socialización de la guía de transporte mejorada a los usuarios.

10.-Téngase como parte integral del presente acuerdo, la guía de transporte que se anexa 11.-Acuerdo firme.
