1. 1That, considering the technical opinion provided by the Research Department through official communications INCOPESCA-DOPA-DINV-067-2025 and INCOPESCA-DOPA-DINV-059-2024, as well as official communication INCOPESCA-DOPA-035-2025, the Directorate of Fisheries and Aquaculture Planning presented the proposal for the closure in the Golfo de Nicoya for 2025.
2. 2That INCOPESCA has scientific studies that support the establishment of this closure period on the proposed dates.
3. 3That through Board of Directors agreement AJDIP/040-2023, dated 02-28-2023, the research report in official communication DOPA-014-2023 was ratified, containing the results of the research on bycatch capture in the semi-industrial fishery for sardine species of the *Ophistonema* sp. complex in the Golfo de Nicoya, carried out by the Research Department, which is conclusive in confirming that non-target bycatch represents less than 3% of the total sardine catch, falling within the 10% maximum allowable tolerance margin in accordance with the provisions of point 1.4. of the Board of Directors Agreement AJDIP/100-2021.
4. 4That the fishing dynamics of the Golfo de Nicoya feature a new fishing activity under the small-scale commercial tourism modality, who have been incorporated into the National Closures Commission (Comisión Nacional de Vedas).
5. 5That in the Golfo de Nicoya, INCOPESCA is carrying out the research projects titled "Characterization of the corvina fishery caught by the small-scale fleet, Golfo de Nicoya, Costa Rica," and "Estimation of the biomass and population dynamics of the anchoveta *Cetengraulis mysticetus* in the Golfo de Nicoya."
6. 6That once the proposed closure for the Golfo de Nicoya in 2025 was discussed and analyzed by the directors who are members of the Board of Directors of the Instituto Costarricense de Pesca y Acuicultura, Therefore;

Agrees 1°—Based on the technical opinion INCOPESCA-DOPA-DINV-067-2025 issued by the Research Department and endorsed by the Directorate of Fisheries and Aquaculture Planning through official communication INCOPESCA-DOPA-035-2025, to establish a fishing closure, except for the exceptions that will be indicated below. Said fishing closure is in effect from May 1 through July 31, 2025, both dates inclusive, in the entire area bounded by an imaginary straight line starting at Punta Torres, known as Peñón (09°53´31" North Latitude, 084°43´52" West Longitude) to the Faro de la Isla Negritos offshore (09°49´14" North Latitude, 084°49´35" West Longitude) and from there to the eastern part of Punta Cuchillos on the Península de Nicoya (09°50´03" North Latitude, 084°53´42" West Longitude) and from there seaward to the mouth of the Río Tempisque in the Golfo de Nicoya, as shown on the attached map.

2°—During the period from June 15 to July 31, 2025, and based on the results of report DOPA-014-2023, entry is permitted for semi-industrial sardine vessels to carry out fishing operations solely in the zone designated C, which is bounded by an imaginary line starting at Punta Torres, known as Peñón (09°53´31" North Latitude, 084°43´52" West Longitude) to the Faro de la Isla Negritos offshore (09°49´14" North Latitude, 084°49´35" West Longitude) and from there to the eastern part of Punta Cuchillos on the Península de Nicoya (09°50´03" North Latitude, 084°53´42" West Longitude) and from there to the Faro de Puntarenas (9° 58´ 36.03´´ North Latitude 84° 51´ 03.93´´ West Longitude), for the purpose of supplying sardine for bait to the national fishing fleet, whose surplus may be marketed for other purposes as established.

1. 3That all landings made by the semi-industrial sardine purse-seine fleet of sardine and bycatch shall be duly inspected by INCOPESCA inspectors. The time slot established for such purposes shall be from 06:00 hours to 20:00 hours. Exceptionally, landing may occur outside this time slot upon prior coordination made during the regular working hours on the day of landing and with authorization from the Head of the INCOPESCA Enforcement Department (Dpto. de Fiscalización) or whoever represents them in their absence.

4°—The INCOPESCA Research Department shall carry out biological sampling to maintain records to verify the legal minimum size at first capture and evaluate the reproductive behavior of sardines.

5°—A maximum bycatch quota for non-target species of 10% is established for the vessels of the semi-industrial sardine purse-seine fleet, relative to the total sardine catch.

6°—In all matters concerning the research projects that INCOPESCA is carrying out in the Golfo de Nicoya, the Head of the Research Department shall establish the guidelines for the execution of the activities of each project during the closure, as well as coordination with the fishers and the National Coast Guard Service (Servicio Nacional de Guardacostas) regarding their implementation, and, prior to the start of the closure, shall issue a report to the Enforcement Department.

7°—Small-scale fishers using hand lines to catch barracuda or candado (*Sphyraena ensis*) in zones B and C are exempt from this closure, provided they have authorization to do so in their respective fishing license.

8°—The activity related to the extraction of pianguas is exempt from this closure, as well as the activity related to marine organism aquaculture developed in the Golfo de Nicoya.

9°—Taking into consideration the socio-economic situation of the coastal communities, in the area referred to in point 1 of this agreement, fishing for domestic consumption shall be permitted during this closure. Those who choose to carry out such fishing must comply with the provisions of Board of Directors agreement AJDIP-511-2017.

10.—The small-scale commercial tourism and sport fishing tournament may be held on Saturday, July 12, 2025, in the zone around the Faro de Puntarenas in accordance with the provisions established by the event organizers, provided that it has authorization from INCOPESCA. Likewise, the organizers must coordinate with the Head of the Enforcement Department for the presence of INCOPESCA inspectors to verify compliance with the regulations applicable to said activity. It shall be the obligation of the organizers to verify that those registering for their tournaments have the respective valid fishing license granted by INCOPESCA for their vessels and the respective fishing cards for the participants, and they must submit a report to the INCOPESCA Enforcement Department containing said information three days before the event takes place. Failure by the event organizers to submit the report shall cause the immediate revocation of the authorization granted by INCOPESCA for said activity.

11.—The Head of the INCOPESCA Enforcement Department must carry out the pertinent coordination between INCOPESCA, SENASA, and the Ministerio de Seguridad Pública (Ministry of Public Security), in order to guarantee control and surveillance operations during the closure season.

12.—All vessels whose home port of operation is located within the closed area of the Golfo de Nicoya, but whose fishing license authorizes them to operate on the Pacific coast outside the closed area of said Golfo, and which, consequently, must navigate to move outside the area to carry out their fishing activity, may execute said activity and process the corresponding fuel. The Head of the INCOPESCA Registry Department must prepare a list with the names of the vessel owners and the name and registration number of the vessels that meet the described condition, and shall forward it to the National Coast Guard Service and to the Enforcement Department as a support element for control and surveillance actions during the closure season, which must be submitted and communicated to all competent entities prior to the closure period coming into effect.

13.—The attached map shall be considered an integral part of this agreement.

14.—Final agreement.

1. 1Que, considerando el criterio técnico brindado por el Departamento de Investigación mediante los oficios oficio INCOPESCA-DOPA-DINV-067-2025 e INCOPESCA- DOPA-DINV-059-2024, así como el oficio INCOPESCA-DOPA-035-2025, la Dirección de Ordenamiento Pesquero y Acuícola presentó la propuesta para la veda en el golfo de Nicoya 2025.
2. 2Que el Incopesca cuenta con estudios científicos que fundamentan el establecimiento de este periodo de veda en las fechas propuestas.
3. 3Que mediante el acuerdo de Junta Directiva AJDIP/040-2023, de fecha 28-02-2023 se ratificó el informe de investigación oficio DOPA-014-2023, con los resultados de la investigación sobre la captura de fauna de acompañamiento en la pesca semiindustrial de las especies de Sardina del complejo Ophistonema sp. en el Golfo de Nicoya, realizado por el Departamento de Investigación, el cual es concluyente en cuanto a la confirmación que la captura incidental no objetivo, representa menos del 3% de la captura total de sardina, ubicándose dentro del 10% del margen máximo de tolerancia permitido conforme a lo normado mediante el punto 1.4. del Acuerdo de Junta Directiva AJDIP/100-2021.
4. 4Que la dinámica pesquera del Golfo de Nicoya presenta una nueva actividad de pesca en la modalidad comercial turística de pequeña escala, quienes se han incorporado al seno de la Comisión Nacional de Vedas.
5. 5Que en el Golfo de Nicoya el INCOPESCA está desarrollando los proyectos de investigación denominados "Caracterización de la pesquería de corvinas capturadas por la flota de pequeña escala, Golfo de Nicoya, Costa Rica", "Estimación de la biomasa y dinámica poblacional de la anchoveta Cetengraulis mysticetus en el Golfo de Nicoya".
6. 6Que una vez discutida y analizada la propuesta de veda para el Golfo de Nicoya 2025 por parte de los señores directores miembros de la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, Por tanto;

Acuerda 1°-En base al criterio técnico INCOPESCA-DOPA-DINV-067-2025 emitido por el Dpto. de Investigación y avalado por la Dirección de Ordenamiento Pesquero y Acuícola mediante oficio INCOPESCA-DOPA-035-2025, establecer una veda de pesca, salvo las excepciones que más adelante se indicarán. Dicha veda de pesca rige a partir del 01 de mayo hasta el 31 de julio del 2025, ambas fechas incluidas, en toda el área delimitada por una línea recta imaginaria que inicia en Punta Torres conocida como Peñón (09°53´31" Latitud Norte, 084°43´52" Longitud Oeste) hasta el Faro de la Isla Negritos afuera (09°49´14" Latitud Norte, 084°49´35" Longitud Oeste) y desde ahí hasta la parte Este de Punta Cuchillos en la Península de Nicoya (09°50´03" Latitud Norte, 084°53´42" Longitud Oeste) y de ahí aguas adentro hasta la desembocadura del río Tempisque en el golfo de Nicoya, según se observa en el mapa adjunto.

2°-Durante el período comprendido entre el 15 de junio al 31 de julio del 2025 y con fundamento en los resultados del informe DOPA-014-2023, se permite el ingreso a las embarcaciones semi-industriales sardineras, para realizar faenas de pesca únicamente en la zona denominada C la cual está delimitada por una línea imaginaria que inicia en Punta Torres conocida como Peñón (09°53´31" Latitud Norte, 084°43´52" Longitud Oeste) al Faro de la Isla Negritos afuera (09°49´14" Latitud Norte, 084°49´35" Longitud Oeste) y desde ahí hasta la parte Este de Punta Cuchillos en la Península de Nicoya (09°50´03" Latitud Norte, 084°53´42" Longitud Oeste) y de ahí hasta el Faro de Puntarenas (9° 58´ 36.03´´ Latitud Norte 84° 51´ 03.93´´Longitud Oeste), con el fin de suplir sardina para carnada a la flota pesquera nacional y cuyos excedentes podrán ser comercializados para otros fines según lo establecido.

1. 3Que toda descarga que realice la flota semiindustrial bolichera de sardina y fauna de acompañamiento, será debidamente inspeccionada por parte de los inspectores del Incopesca. La franja horaria establecida para dichos fines será a partir de las 06.00 horas hasta las 20.00 horas. Excepcionalmente podrá desembarcarse fuera de este horario, bajo previa coordinación efectuada durante el horario laboral ordinario del día de la descarga y autorización por parte de la Jefatura del Dpto. de Fiscalización del Incopesca o quién lo represente en su ausencia.

4°-El Departamento de Investigación del Incopesca realizará muestreos biológicos que permitan mantener registros para verificar las tallas legales de primera captura y evaluar el comportamiento reproductivo de las sardinas.

1. 5Que se establece una cuota de captura incidental máxima de especies no objetivo del 10%, con respecto a la captura total de sardina a los barcos de la flota semiindustrial bolichera de sardina.

6°-En todo lo concerniente a los proyectos de investigación que el INCOPESCA está desarrollando en el Golfo de Nicoya, el Jefe del Dpto. de Investigación deberá establecer los lineamientos para la ejecución de las actividades de cada proyecto durante la veda, así como la coordinación con los pescadores y el servicio nacional de guardacostas respecto del desarrollo de las mismas y de previo al inicio de la veda, deberá emitir un informe al Dpto. de Fiscalización.

7°-Se exceptúa de esta veda, la pesca realizada por pescadores de pequeña escala utilizando cuerdas de mano para la captura de barracuda o candado (Sphyraena ensis) en las zonas B y C, siempre que así lo tengan autorizado en su respectiva licencia de pesca.

8°-Se exceptúa de esta veda, la actividad relacionada a la extracción de pianguas, así como la actividad relacionada con los cultivos de organismos marinos que se desarrollan en el golfo de Nicoya.

9°-Tomando en consideración la situación socioeconómica de las comunidades costeras, en la zona comprendida en el punto 1 de este acuerdo, durante la presente veda se permitirá la pesca para el consumo doméstico. Quienes opten por realizar esta pesca, deberán cumplir con lo establecido en el acuerdo de Junta Directiva AJDIP-511-2017.

10.-El torneo de pesca comercial turística y deportiva de pequeña escala, se podrá realizar, el día Sábado 12 de julio 2025 en la zona en torno al faro de Puntarenas de conformidad con lo establecido por los organizadores del evento, siempre que cuente con la autorización del INCOPESCA. Así mismo, los organizadores deben coordinar con el Jefe del Departamento de Fiscalización la presencia de inspectores del Incopesca a fin de verificar el cumplimiento de la normativa aplicable a dicha actividad. Será obligación de los organizadores, verificar que quienes se inscriban en sus torneos cuentan con la respectiva licencia de pesca vigente otorgada por el INCOPESCA para sus embarcaciones y los respectivos carnés de pesca para los participantes, debiendo presentar, tres días antes de la realización del evento, un informe al Dpto. de Fiscalización del INCOPESCA conteniendo dicha información. El incumplimiento de presentación del informe por parte de los organizadores del evento, ocasionará la revocatoria inmediata de la autorización otorgada por el INCOPESCA a dicha actividad.

11.-La Jefatura del departamento de fiscalización del INCOPESCA, debe realizar las coordinaciones pertinentes entre el Incopesca, Senasa y el Ministerio de Seguridad Pública, con el fin de garantizar los operativos de control y vigilancia durante la época de veda.

12.-Todas aquellas embarcaciones cuyo puerto base de operación se encuentre ubicado dentro del área vedada del Golfo de Nicoya, pero cuya licencia de pesca les autoriza faenar en el litoral pacífico fuera del área vedada de dicho Golfo y que, por consiguiente, deben navegar para trasladarse fuera del área a realizar su actividad pesquera; podrán ejecutar dicha actividad y tramitar el combustible correspondiente. El jefe del Departamento de Registro del INCOPESCA, debe elaborar un listado con los nombres de los armadores y el nombre y número de matrícula de las embarcaciones que se encuentran en la condición descrita y lo trasladará al Servicio Nacional de Guardacostas y al departamento de Fiscalización como elemento de apoyo de las acciones de control y vigilancia durante la época de veda, mismo que deberá presentarse y comunicarse a todas las entidades competentes, previo a la entrada en vigencia del periodo de veda.

13.-Téngase como parte integral del presente acuerdo, el mapa que se anexa.
