en la totalidad del texto - Complete Text of Regulation 44961 Repeals the Public Utility Declaration for the El Coco and Moravia de Siquirres Aqueduct Association No. 44961-MJP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on the provisions of Articles 11, 140, subsection 18), and 146 of the Political Constitution, Articles 25 subsection 1), 27 subsection 1), and 28 subsection 2) item b) of the General Public Administration Law No. 6227 of May 2, 1978, Article 32 of the Associations Law No. 218 of August 8, 1939, and Articles 27 and following of the Regulations to the Associations Law No. 29496-J, published in La Gaceta No. 96 of May 21, 2001.

I.-That Article 32 of the Associations Law No. 218 of August 8, 1939, and its amendments, grants the Executive Branch the power to declare of public utility those simple, federated, or confederated associations whose development and activities are particularly useful for the interests of the State, and that thereby contribute to meeting a social need.

II.-That Article 32 of the Associations Law establishes: "... At any time, the Ministry of Justice and Peace shall revoke this benefit, if the reasons for which it was granted disappear. (...)". Likewise, subsection 33 bis of the Regulations to the Associations Law adds: "The public utility declaration shall be revocable at any time; however, in the event of non-presentation or incomplete presentation of the activities report, the association shall be given notice, once only, for a period of ten business days. Likewise, the repeal of the public utility status shall be carried out by means of a reasoned resolution resulting from the procedure for repealing the public utility benefit, which shall be governed by the provisions of the General Public Administration Law (...)". Finally, subsection 33 ter of the Regulations to the Associations Law indicates: "In the event that any association renounces the public utility declaration, it must submit the corresponding documentation to the Legal Advisory Office of the Ministry of Justice and Peace, which, without further formality, shall proceed with the repeal." III.-That the Asociación del Acueducto de El Coco y Moravia de Siquirres, legal identification number tres-cero cero dos-doscientos cuarenta y siete mil ciento cuarenta y ocho, was declared of public utility by Executive Decree No. 41956-MJP of August 5, two thousand nineteen, published in the Official Gazette La Gaceta No. 188 of October 4, two thousand nineteen.

IV.-That the Asociación del Acueducto de El Coco y Moravia de Siquirres, legal identification number tres-cero cero dos-doscientos cuarenta y siete mil ciento cuarenta y ocho, failed to submit the annual reports corresponding to the years 2022 and 2023, and, through its legal representative, Mr. Luis Guillermo Meza Jiménez, identity card number tres-cero trescientos veintisiete-cero setecientos cuarenta y cuatro, by means of the brief dated October 17, two thousand twenty-four, expressly renounced the public utility declaration granted by the Ministry of Justice and Peace, in order to avail itself of the provisions of Articles 2 and 3 of Law No. 8776, Exoneration for Community Aqueduct and Sewer System Administration Associations (ASADAS).

en la totalidad del texto - Texto Completo Norma 44961 Deroga Declaratoria de utilidad pública para la Asociación del Acueducto de El Coco y Moravia de Siquirres N° 44961-MJP EL PRESIDENTE DE LA REPÚBLICA Y El MINISTRO DE JUSTICIA Y PAZ Con fundamento en lo dispuesto en los artículos 11, 140, inciso 18) y 146 de la Constitución Política, en los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de Administración Pública N° 6227 del 02 de mayo de 1978, en el artículo 32 de la Ley de Asociaciones N° 218 del 08 de agosto de 1939 y los artículos 27 y siguientes del Reglamento a la Ley de Asociaciones N° 29496-J, publicado en La Gaceta N° 96 del 21 de mayo del 2001.

I.-Que el artículo 32 de la Ley de Asociaciones N° 218 del 08 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.

II.-Que el artículo 32 de la Ley de Asociaciones establece: "... En cualquier momento, el Ministerio de Justicia y Paz, revocará este beneficio, si desaparecen los motivos por los cuales fue concedido. (...)". Asimismo, el ordinal 33 bis del Reglamento a la Ley de Asociaciones, agrega: "La declaratoria de utilidad pública será revocable en cualquier momento, no obstante, en caso de la no presentación o presentación incompleta del informe de labores, se prevendrá a la asociación, una única vez, por el plazo de diez días hábiles. Asimismo, la derogatoria de la utilidad pública se realizará mediante resolución razonada resultante del procedimiento de derogatoria del beneficio de utilidad pública el cual, se regirá por lo establecido en la Ley General de Administración Pública (...)". Finalmente, el numeral 33 ter del Reglamento a la Ley de Asociaciones, indica: "En caso de que alguna asociación renuncie a la declaratoria de utilidad pública, deberá presentar la documentación correspondiente ante la Asesoría Jurídica del Ministerio de Justicia y Paz quien, sin más trámite, procederá a realizar la derogatoria." III.-Que la Asociación del Acueducto de El Coco y Moravia de Siquirres, cédula jurídica número fres-cero cero dos-doscientos cuarenta y siete mil ciento cuarenta y ocho, fue declarada de utilidad pública, mediante Decreto Ejecutivo N° 41956-MJP del cinco de agosto del dos mil diecinueve, publicado en el Diario Oficial La Gaceta N° 188 del cuatro de octubre del dos mil diecinueve.

IV.-Que la Asociación del Acueducto de El Coco y Moravia de Siquirres, cédula jurídica número tres-cero cero dos-doscientos cuarenta y siete mil ciento cuarenta y ocho, incumplió con la presentación de los informes anuales correspondientes a los años 2022 y 2023, y, por medio de su representante legal, el señor Luis Guillermo Meza Jiménez, cédula de identidad número tres-cero trescientos veintisiete-cero setecientos cuarenta y cuatro, través del memorial de fecha diecisiete dé octubre del dos mil veinticuatro, Ministerio de Justicia y Paz, para acogerse a lo establecido en los artículos 2 y 3 de la Ley N° 8776, Exoneración a las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales (ASADAS).

DEROGAR LA DECLARATORIA DE UTILIDAD PÚBLICA DE LA ASOCIACIÓN DEL ACUEDUCTO DE EL COCO Y MORAVIA DE SIQUIRRES
