"Article 29.—On the use of testing laboratories for conformity assessment processes. Tests required for conformity assessment processes must be performed by laboratories accredited to the INTE-ISO/IEC 17025 standard by ECA or by an accreditation body signatory to the Mutual Recognition Arrangement (MRA) of the International Laboratory Accreditation Cooperation (ILAC), for the specific laboratory activities.
In the event that no laboratories in the country comply with the foregoing, the following procedure shall apply:
1. The OCP may subcontract the services of non-accredited laboratories for the specific laboratory activities, provided that:
i. Priority is given to those that have accreditation to the INTE/ISO 17025 standard.
ii. The OCP applies criterion ECA-MC-C01, so as to demonstrate the technical competence of said laboratory in the execution of said contracted laboratory activities.
2. The OCP may accept test results provided by the applicant, issued by non-accredited laboratories for the specific laboratory activities, provided that:
i. Priority is given to results issued by those that have accreditation to the INTE/ISO 17025 standard.
ii. The OCP applies an internal procedure that ensures the validity of the results provided by the applicant, which considers at least that the sampling was carried out by laboratory personnel, evaluates the validity of the results, without being limited to evaluating other aspects that the OCP deems necessary to guarantee the rigor required in the conformity assessment process. ECA shall request and evaluate the indicated procedure as one of the requirements of the OCP accreditation process."
