1. That, by Board of Directors agreement AJDIP/049-2020, dated April 2, 2020, the area of the closed season (veda) was established for semi-industrial purse-seine (bolichera) (cerco) fishing of sardine Ophistonema sp. in the zone bounded by an imaginary straight line running from Punta Agujas (84°39´19´´ West Longitude, 09°43´18´´ North Latitude) to the Faro de la Isla Negritos outer light (84°49´25´´ West Longitude, 09°49´20´´ North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula (09°49´48" North Latitude, 84°51´54" West Longitude) and from this line outward to the mouth of the Tempisque River.
2. That, Board of Directors agreement AJDIP/049-2020, dated April 2, 2020, established the sardine closed season (veda) permanently for at least 5 years, until new scientific research is available that determines a change to the agreement.
3. That, due to the expiration of the appointment term for the members of the closed season (veda) commission, it has not been possible to convene; therefore, meetings were held between the vessel owners (armadores) or their representative, the Head of the Research Department, and the Director of Fisheries Management to define the conditions for the Ophistonema spp. sardine closed season (veda) for this year 2025.
4. That, Board of Directors agreement AJDIP/049-2020, dated April 2, 2020, established that incidental catch (captura incidental) in the sardine fishery may not exceed 10% of the vessel's total catch.
5. That, vessels of the medium-scale, advanced, and semi-industrial commercial fleet are required to notify INCOPESCA of their arrival in port so that the Inspection Department (Departamento de Fiscalización) can coordinate the inspection of their catches. In turn, the Research Department will conduct biological sampling of said catches to evaluate the reproductive behavior of the sardines.
6. That, the Directorate of Fisheries and Aquaculture Management held meetings with representatives of the semi-industrial purse-seine (bolichera) (cerco) sardine fishing sector, in which they requested that, in order to supply sardine as bait for the national fishing fleet, entry into the closed zone defined as Tárcoles be permitted for restricted operations (faenar) for 12 daylight hours per week per vessel.
7. That, the objective of this closed season (veda) is to limit fishing effort to protect the sardine resource during its reproductive stage, in pursuit of the sustainability of this fishery resource, while also meeting the bait requirements of the national fishing fleet; by reason of which, the Board of Directors; Therefore, AGREES 1. To decree the closed season (veda) for fishing of sardine Ophistonema sp. in the Gulf of Nicoya with any type of net beginning March 15 and up to and including June 15, 2025.
For the purposes of this agreement, within the total area defined in recital (considerando) 1, three zones are recognized:
The Tárcoles Zone, which for the purposes of this agreement is that which is bounded by an imaginary straight line extending from Punta Agujas (84°39´19´´ West Longitude, 09°43´18´´ North Latitude) to the Isla Negritos outer lighthouse (84°49´25´´ West Longitude, 09°49´20´´ North Latitude); from there, another imaginary straight line to Punta Cuchillo on the Nicoya Peninsula (84°51´54" West Longitude, 09°49´48" North Latitude); and from this last point, another imaginary straight line to the Peñón or Punta Torres (84°43'52" West Longitude, 9°53'35" North Latitude).
Zone C of the Gulf of Nicoya which, solely for the purposes of this agreement, is the zone that begins at the point known as the Peñón or Punta Torres (84°43'52" West Longitude, 9°53'35" North Latitude); from there, an imaginary straight line to Punta Cuchillo on the Nicoya Peninsula (84°51´54" West Longitude, 09°49´48" North Latitude); and from this last point, another imaginary straight line to the Puntarenas Lighthouse (84°51´04´´ West Longitude, 9°58´35´´ North Latitude).
In the entire remaining area of the Gulf of Nicoya extending from the mouth of the Tempisque River to the imaginary straight line running from Punta Cuchillo on the Nicoya Peninsula (84°51´54" West Longitude, 09°49´48" North Latitude) to the Puntarenas Lighthouse (84°51´04´´ West Longitude, 9°58´35´´ North Latitude) described in the preceding paragraph, the operation of semi-industrial fishing vessels using purse-seine (cerco) or "bolichera" nets for the capture of sardine Ophistonema sp. remains permanently prohibited.
2. In order to supply sardine as bait to the national fishing fleet, each of the three sardine vessels is authorized to operate (faenar) within the zone called Tárcoles for only 12 daylight hours (from 06:00 hours to 18:00 hours) per week. Excess sardine may be commercialized in accordance with the provisions of Board of Directors agreement AJDIP/100-2021.
3. That, prior to and during the closed season (veda) period, the vessel owners (armadores) must coordinate and provide a monthly schedule to the Registration Department and the Inspection Department (Departamento de Fiscalización) of INCOPESCA, clearly indicating the day of the week each vessel will enter to operate (faenar) within the Tárcoles zone.
4. That all vessel owners (armadores) or vessel captains are required to request a landing inspection in accordance with the established procedure. Landings (descargas) made by the semi-industrial purse-seine (bolichera) sardine fleet shall be duly inspected by the Institution's inspectors. Said inspection must cover not only sardine landings but also the accompanying fauna. For landings, the established time window shall be from 06:00 hours to 20:00 hours.
5. Those landings carried out under the protection of this agreement without institutional presence due to situations attributable to the vessel owner (armador) shall result in the loss of the benefit of conducting fishing in the closed Tárcoles zone under the terms of this agreement, unless INCOPESCA has previously authorized the landing to be carried out without institutional presence; in which case, the vessel owners (armadores) or the captain must submit, within a maximum period of one month, the sworn landing declaration form that has already been provided to them.
6. Any situation not expressly provided for in this agreement shall be addressed and analyzed initially by the Head of the Inspection Department (Dpto. de Fiscalización) for the respective assessment; if warranted, it will be forwarded to the Directorate of Fisheries and Aquaculture Management for its attention.
7. In turn, the Fisheries Research Department shall conduct biological sampling of said catches to evaluate the reproductive behavior of the sardines and compliance with the legal minimum catch size.
8. That, in accordance with the provisions of Board of Directors agreement AJDIP/049-2020, dated April 2, 2020, incidental catch (captura incidental) in the sardine fishery may not exceed 10% of the vessel's total catch.
9. The National Coast Guard Service, in coordination with the Inspection Department (Dpto. de Fiscalización) of INCOPESCA, shall carry out the pertinent actions under the provisions established in this agreement, for the purpose of controlling and monitoring illegal fishing activities in the closed area, especially the Tárcoles zone.

ACUERDA 1º-Decretar la veda de pesca de sardina Ophistonema sp. en el Golfo de Nicoya con cualquier tipo de red a partir del 15 de marzo y hasta el 15 de Junio 2025 inclusive.
Para efectos de este acuerdo, del área total definida en el considerando 1, se reconocen tres zonas:
Zona Tárcoles, que para efectos de este acuerdo es aquella que está comprendida por una línea recta imaginaria que se extiende desde Punta Agujas (84°39´19´´Longitud Oeste, 09°43´18´´ Latitud Norte) hasta el faro Isla Negritos afuera (84°49´25´´ Longitud Oeste, 09°49´20´´ Latitud Norte) a partir de allí, otra línea recta imaginaria hasta Punta Cuchillo en la Península de Nicoya (84°51´54" Longitud Oeste, 09°49´48" Latitud Norte) y desde este último punto, otra línea recta imaginaria hasta el Peñón o Punta Torres (84°43'52" Longitud Oeste, 9°53'35" Latitud Norte).

En toda el área restante del Golfo de Nicoya que se extiende desde la desembocadura del río Tempisque hasta la línea recta imaginaria que va desde Punta Cuchillo en la Península de Nicoya (84°51´54" Longitud Oeste, 09°49´48" Latitud Norte) hasta el Faro de Puntarenas (84°51´04´´Longitud Oeste, 9°58´35´´ Latitud Norte) descrita en el párrafo anterior, se mantiene prohibida de forma permanente la operación de buques de pesca semi-industrial con red de cerco o bolichera para la captura de sardina Ophistonema sp.
2º-A efecto que se pueda suplir sardina como carnada a la flota pesquera nacional, se autoriza a cada una de las tres embarcaciones sardineras faenar dentro de la zona denominada Tárcoles, únicamente 12 horas diurnas (desde las 06.00 horas hasta las 18.00 horas) a la semana. Los excedentes de sardina podrán ser comercializados según lo establecido en el acuerdo de Junta Directiva AJDIP/100-2021.
5º-Aquellos desembarques que se efectúen al amparo de este acuerdo sin presencia institucional por situaciones imputables al armador, conllevará la pérdida del beneficio de ejercer la pesca en la zona Tárcoles vedada en los términos de este acuerdo, salvo que, previamente el INCOPESCA haya autorizado la realización del desembarque sin presencia institucional en cuyo caso, los armadores o el capitán, deberán remitir, en el plazo máximo de un mes, el formulario de declaración jurada de desembarque que ya les fue entregado.
6º-Cualquier situación no prevista expresamente en este acuerdo, será atendida y analizada de forma primaria por el Jefe del Dpto. de Fiscalización para su valoración respectiva, si amerita, será trasladado a la Dirección de Ordenamiento Pesquero y Acuícola para su atención.
7º-A su vez, el Departamento de Investigación Pesquera realizará muestreos biológicos de dichas capturas para evaluar el comportamiento reproductivo de las sardinas y el cumplimiento de la talla legal de primera captura.
9- El Servicio Nacional de Guardacostas en coordinación con el Dpto. de Fiscalización del INCOPESCA, realizarán las acciones pertinentes al amparo de lo establecido en el presente acuerdo, a efectos de controlar y fiscalizar actividades de pesca ilegal en la zona vedada, especialmente, la zona Tárcoles.
