Notice 8 Demarcation of the public zone (zona pública) of the mangrove (manglar) located at Playa Arbolito, District 03° Veintisiete de Abril, Canton 03° Santa Cruz, Province 05° Guanacaste —You are viewing the latest version of this regulation— Go to the latest version Version of the Regulation: 1 of 1 INSTITUTO GEOGRÁFICO NACIONAL NOTICE Nº 08-2025 MARITIME-TERRESTRIAL ZONE (ZONA MARÍTIMO TERRESTRE) DEMARCATION OF THE PUBLIC ZONE CORRESPONDING TO THE MANGROVE LOCATED AT PLAYA ARBOLITO, DISTRICT 03° VEINTISIETE DE ABRIL, CANTON 03° SANTA CRUZ, PROVINCE 05° GUANACASTE On the basis of the provisions of Articles 140 and 240 of Law Nº6227, General Law of Public Administration, dated May 2, 1978, and its amendments; Law Nº59, Law on the Creation and Organization of the Instituto Geográfico Nacional, dated July 4, 1944, and its amendments; Law Nº8905, Reform of Art. 2 of Law N°5695, Creation of the National Registry, and its amendments; and amendment to Law N°59, Creation and Organization of the Instituto Geográfico Nacional, of July 4, 1944, and its amendments dated December 7, 2010; Law N.º6043, Law on the Maritime-Terrestrial Zone, dated March 2, 1977, with its respective regulations; and Articles 2 and 3 of Law Nº5695, Law on the Creation of the National Registry, dated May 28, 1975, and its amendments.

1.- By virtue of Law Nº8905, the Instituto Geográfico Nacional, hereinafter IGN, is established as a dependency of the National Registry, which shall execute the contracts and agreements necessary for the exercise of its functions. Furthermore, pursuant to Law Nº59, the IGN is "the scientific and technical body directing national cartography, charged with producing the official basic map and basic geographic description of the Republic of Costa Rica, and with conducting studies, research, tasks, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and related nature, with a view to supporting planning processes." 2.- Law Nº59 establishes the IGN, on a permanent basis and as representative of the State, as the official authority on geodetic matters and the spatial representation of the geography of the Republic of Costa Rica, with its authority extending to activities of any kind that originate from the work entrusted to it.

3.- Pursuant to Article 62 of Executive Decree N°7841-P, Regulation to Law N°6043 on the Maritime-Terrestrial Zone, dated December 16, 1977, and its amendments, the IGN's competence to demarcate the public zone of the Maritime-Terrestrial Zone, and to make that demarcation official through publication in the Official Gazette La Gaceta, is recognized; Article 63 of Executive Decree N°7841-P states that "The Instituto Geográfico Nacional shall publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone." 4.- Executive Decree N°36642-MP-MOPT-MINAET, Specifications Regulation for the Demarcation of the Public Zone of the Maritime-Terrestrial Zone, dated June 28, 2011, establishes pursuant to Art. 18 that for the demarcation of the public zone of the Maritime-Terrestrial Zone, the IGN may employ two methods of implementation, described in Articles 19 and 20, corresponding to the demarcation of the public zone of the Maritime-Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital demarcation (delimitación digital georreferenciada), with the aim of expediting demarcations and providing greater technical certainty to interested parties.

5.- Executive Decree N°33797-MJ-MOPT declares the CR05 as the official horizontal datum (datum horizontal) for Costa Rica, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, dated March 30, 2007. This decree, among other matters, designates the CR05 National Geodetic Horizontal Reference Network (Red Geodésica Nacional de Referencia Horizontal CR05) and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral work carried out in our country must be referenced, stating specifically in Article 11 that: "The CR05 National Geodetic Horizontal Reference Network and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities carried out within the National Territory by any public agency, person, or national or foreign private entity must be referenced."; while Article 7 states that "As cartographic data is produced under the new CRTM05 cartographic projection system, the Instituto Geográfico Nacional shall publish by appropriate means that information which has been made official." 6.- Executive Decree Nº40962-MJP, Update of the Official Horizontal Geodetic Reference System for Costa Rica, dated January 24, 2018, declares in its Article 1 that "The official horizontal geodetic reference system for Costa Rica, designated as CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59; and henceforth, changes and updates thereto shall be governed in accordance with the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) designated SIRGASCON"; and Article 2 establishes that "The CRTM05 cartographic projection system shall remain the official system for the cartographic representation of the continental national territory, extended for purposes of applying this cartographic projection to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, said baseline being defined pursuant to Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for calculating the maximum breadth of all marine jurisdictional areas of the Costa Rican State." Furthermore, Article 12 of the aforementioned decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which references must be made within the continental territory of our country, by stating that "The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended to the territorial sea baseline, and the 'Universal Transverse Mercator' (UTM) cartographic projection, zones 16 and 17, for marine and insular jurisdictional areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities carried out within the national territory by any public agency, person, or national or foreign private entity undertaking or contracting geodetic and cartographic work must be referenced, thereby helping to avoid public expenditure and, on the other hand, to obtain reliable, uniform, and comparable geographic information that is of general use and supports decision-making at the various levels of the State." 7.- Georeferencing to the national coordinate system as a mechanism for demarcating the public zone of the Maritime-Terrestrial Zone enables the correct demarcation of the public zone for purposes of preparing coastal regulatory plans (planes reguladores costeros), the approval of cadastral survey plans (visado de planos de agrimensura), the granting of concessions (concesiones) in the Restricted Zone (Zona Restringida), and other aspects of coastal territorial planning.

8.- The georeferenced digital information on the demarcation of the public zone of the Maritime-Terrestrial Zone held by the IGN is designated the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime-Terrestrial Zone (ZMT).

9.- The Georeferenced Digital Geodatabase (GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime-Terrestrial Zone (ZMT) is technically grounded in the application of the regulations established by: a) Executive Decree N°7841-P, Regulation to Law N°6043 on the Maritime-Terrestrial Zone; b) Executive Decree N°33797-MJ-MOPT, declaring the CR05 as the official horizontal datum for Costa Rica and its associated cartographic projection, CRTM05; c) Executive Decree N°36642-MP-MOPT-MINAET, Specifications Regulation for the Demarcation of the Public Zone of the Maritime-Terrestrial Zone; and d) Executive Decree Nº40962-MJP, Update of the Official Horizontal Geodetic Reference System for Costa Rica.

10.- Article 16 of Law N°7575, Ley Forestal, dated February 13, 1996, and its amendments, establishes that MINAE shall demarcate on the ground the boundaries (linderos) of the areas comprising the Natural Heritage of the State (Patrimonio Natural del Estado).

11.- Article 11 of Chapter I, General Provisions of Law N°6043, establishes that "The public zone also comprises, regardless of its extent, all mangroves on the continental and insular coastlines (litorales) and estuaries (esteros) of the national territory." 12.- Executive Decree N°36786-MINAET, Manual for the Classification of Land Dedicated to the Conservation of Natural Resources within the Maritime-Terrestrial Zone in Costa Rica, dated August 12, 2011, sets out among its objectives "To identify within the Maritime-Terrestrial Zone those lands that qualify as forests, lands of forestry aptitude (aptitud forestal) (Class VII and VIII soils), and wetlands (humedales) (mangroves, estuaries, tidal inlets (rías), salt marshes (marismas), coastal lagoons (lagunas costeras), swamps (pantanos), flooded forests (bosques anegados), salt flats (salitrales)), in order to certify them and incorporate them as part of the Natural Heritage of the State (PNE)." 13.- Executive Decree N°36786-MINAET, under Section III — Competencies for Demarcation and Certification, establishes that "The classification of lands within the ZMT shall fall to the Conservation Areas (Áreas de Conservación, AC) of SINAC and to private professionals duly accredited by the respective professional associations, to classify forests, lands of forestry aptitude (Class VII and VIII soils), (mangroves, estuaries, tidal inlets, salt marshes, coastal lagoons, swamps, flooded forests, salt flats), and wetlands.

The validity of classification documents issued by private professionals shall be subject to the approval issued by the AC with territorial jurisdiction. The ACs of SINAC with jurisdiction in the ZMT shall also be responsible for the verification, oversight, land boundary determination (deslinde), and certification of lands of the Natural Heritage of the State and protection zones.

The location and demarcation of Natural Heritage of the State areas within the Maritime-Terrestrial Zone must be carried out as part of the Coastal Regulatory Plan (Plan Regulador Costero, PRC) approval process, as defined by Ley 6043, since the Coastal Regulatory Plan is the territorial planning instrument that defines and locates all areas to be granted as concessions within the ZMT and for the classification of those areas at the level of cadastral plans. Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the PNE areas so that they are not counted in the total area available for concession." 14.- The IGN employed the georeferenced digital demarcation methodology to demarcate the public zone of the Maritime-Terrestrial Zone of the mangrove located at Playa Arbolito, in District 03° Veintisiete de Abril, Canton 03° Santa Cruz, Province 05° Guanacaste.

15.- By means of official communications DDUR-DCT-IGN-837-10-2024 dated October 30, 2024, sent by the Municipality of Santa Cruz, Urban and Rural Development Directorate, Cadastre and Topography Department, and SINAC-ACT-OR-DR-1489-2024 dated October 18, 2024, from the Área de Conservación Tempisque, the respective technical reports on the demarcation carried out of the public zone of the mangrove located at Playa Arbolito were submitted, and approval (visto bueno) was granted for the survey and demarcation performed.

16.- The demarcation of the public zone of the ZMT for the Canton of Santa Cruz was carried out under the Cooperation Agreement (Convenio de Cooperación) between SINAC and the Municipality of Santa Cruz, and executed through the contracting of the firm STEREOCARTO CENTROAMÉRICA S.A., procurement process 2022LA-000021-0021000001, pursuant to official communications CTPR-SINAC_ACT-0043-10-2023 (DDUR-DCT-SINAC_ACT-0630-10-20223) of October 10, 2023.

17.- The georeferenced digital demarcation of the public zone corresponding to the mangrove located at Playa Arbolito was carried out on September 13, 2023, by the Área de Conservación Tempisque and the firm STEREOCARTO CENTROAMERICA S.A., pursuant to official communication SINAC-ACT-OR-DR-1489-2024 dated October 18, 2024.

18.- By means of official communication DIG-GDF-012-2024-PU-INF — Report on the Demarcation of the Mangrove at Playa Arbolito, dated December 19, 2024, issued by the Topography Sub-process of the Geodesy and Geophysics Department of the Instituto Geográfico Nacional, a technical review report was issued for the publication of the georeferenced digital demarcation of the public zone of a mangrove sector at Playa Arbolito in relation to the work carried out by SINAC-ACT, wherein the demarcation performed was technically endorsed for publication.

19.- Article 140 of Law N°6227, General Law of Public Administration, states that "an administrative act shall produce its effects after it has been communicated to the administered party, except where it grants rights only, in which case it shall produce effects from the moment it is adopted," a provision that must necessarily be read in conjunction with numeral 204(1) of the same legal body, which defines the appropriate instrument for communicating acts of a general nature by stating that: "General acts shall be communicated by publication, and specific acts by notification." HEREBY GIVES NOTICE:

First: That on September 13, 2023, the Área de Conservación Tempisque and the firm STEREOCARTO CENTROAMÉRICA S.A. carried out the field work for the georeferenced digital demarcation, referenced to the national coordinate system, of the public zone of the mangrove located at Playa Arbolito, in District 03° Veintisiete de Abril, Canton 03° Santa Cruz, Province 05° Guanacaste.

Second: The Instituto Geográfico Nacional publishes the georeferenced digital demarcation of the public zone of the maritime-terrestrial zone corresponding to the mangrove located at Playa Arbolito, in District 03° Veintisiete de Abril, Canton 03° Santa Cruz, Province 05° Guanacaste, based on the Specifications Regulation for the Demarcation of the Public Zone of the Maritime-Terrestrial Zone and the methodology used and validated by the Área de Conservación Tempisque (ACT).

Third: That the demarcated public zone corresponds to the mangrove located at Playa Arbolito, in District 03° Veintisiete de Abril, Canton 03° Santa Cruz, Province 05° Guanacaste, in conformity with official communications DIG-GDF-012-2024-PU-INF — Report on the Demarcation of the Mangrove at Playa Arbolito, dated December 19, 2024, issued by the Topography Sub-process of the Geodesy and Geophysics Department of the Instituto Geográfico Nacional; DDUR-DCT-IGN-837-10-2024 dated October 30, 2024; and SINAC-ACT-OR-DR-1489-2024 dated October 18, 2024, issued by the Municipality of Santa Cruz and the Área de Conservación Tempisque, respectively.

Fourth: That the georeferenced digital demarcation of the public zone of the mangrove at Playa Arbolito corresponds to the following coordinates in the official cartographic projection system of Costa Rica CRTM05/CR05:

Fifth: That the sectors located in District 03° Veintisiete de Abril, Canton 03° Santa Cruz, Province 05° Guanacaste, that as of the date of this notice have an existing demarcation of the public zone of the Maritime-Terrestrial Zone through the placement of boundary markers and the respective publication in the Official Gazette La Gaceta, shall retain their official status.

Sixth: The official technical data for the georeferenced digital demarcation of the public zone corresponding to the mangrove located at Playa Arbolito, in District 03° Veintisiete de Abril, Canton 03° Santa Cruz, Province 05° Guanacaste, have been recorded in the Georeferenced Digital Geodatabase of the Maritime-Terrestrial Zone (ZMT) of the IGN in a vector shapefile, under the code: ZONA PÚBLICA-MOJONES.

Seventh: This notice takes effect upon publication.

1.- Que mediante Ley Nº8905 se establece el Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, de conformidad con la Ley Nº59, el IGN es "la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación".

2.- Que la Ley Nº59 constituye al IGN de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.

3.-Que de conformidad con el artículo 62 del Decreto Ejecutivo N°7841-P Reglamento a la Ley sobre la Zona Marítimo Terrestre del 16 de diciembre de 1977 y sus reformas, se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto Ejecutivo N°7841-P señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública." 4.-Que el Decreto Ejecutivo N°36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre del 28 de junio del 2011, establece según el artículo 18 que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.

5.- Que el Decreto Ejecutivo N°33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83 del 30 de marzo del 2007, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera." ; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado." 6.- Que el Decreto Ejecutivo Nº40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica del 24 de enero del 2018, declara en su artículo 1 que "El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGASCON"; además que el artículo 2 establece que "El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense." Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que "El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (UTM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado." 7.- Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.

8.- Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).

9.- Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N°7841-P Reglamento a la Ley No. 6043 sobre la Zona Marítimo Terrestre; b) el Decreto Ejecutivo N°33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05; c) el Decreto Ejecutivo N°36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre; y d) el Decreto Ejecutivo Nº40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica.

10.- Que el artículo 16 de la Ley N°7575, Ley Forestal del 13 de febrero de 1996 y sus reformas, establece que el Ministerio del Ambiente y Energía (MINAE) delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.- Que el artículo 11 del Capítulo I, Disposiciones Generales de la Ley N°6043, establece que la "Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional." 12.- Que el Decreto Ejecutivo N°36786-MINAET Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica del 12 de agosto del 2011, establece entre sus objetivos "Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE)." 13.- Que el Decreto Ejecutivo N°36786-MINAET en el punto III.-Competencias para la delimitación y certificación establece que "La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.

La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en el área total a concesionar." 14.- Que el IGN utilizó la metodología de Delimitación Digital Georreferenciada, para delimitar la zona pública de la Zona Marítimo Terrestre del manglar situado en Playa Arbolito en el distrito 03º Veintisiete de Abril, cantón 03º Santa Cruz, provincia 05º Guanacaste.

15.- Que mediante los oficios DDUR-DCT-IGN-837-10-2024 de fecha 30 de octubre de 2024 enviado por la Municipalidad de Santa Cruz, Dirección de Desarrollo Urbano y Rural Departamento de Catastro y Topografía, y el SINAC-ACT-OR-DR-1489-2024 de fecha 18 de octubre de 2024 del Área de Conservación Tempisque presentan los respectivos informes técnicos de la delimitación realizada de la zona pública del manglar situado en Playa Arbolito, al cual se le otorga visto bueno al levantamiento y delimitación realizada.

16.- Que la delimitación de la zona pública de la ZMT del cantón de Santa Cruz fue realizada bajo el Convenio de Cooperación entre el Sistema Nacional de Áreas de Conservación y la Municipalidad de Santa Cruz, y concretado por la contratación de la empresa STEREOCARTO CENTROAMÉRICA S.A., licitación 2022LA-000021-0021000001, según oficios CTPR-SINAC_ACT-0043-10-2023 (DDUR-DCT-SINAC_ACT-0630-10-20223) del 10 de octubre de 2023.

17.- Que la delimitación digital georreferenciada de la zona pública correspondiente al manglar situado en Playa Arbolito fue realizada el día 13 de setiembre de 2023, por el Área de Conservación Tempisque y la empresa STEREOCARTO CENTROAMERICA S.A, según oficio SINAC-ACT-OR-DR-1489-2024 de fecha 18 de octubre de 2024.

18.- Que mediante el oficio DIG-GDF-012-2024-PU-INF-Informe delimitación del manglar en Playa Arbolito de fecha 19 de diciembre de 2024, generado por el Subproceso de Topografía del Departamento Geodesia y Geofísica del Instituto Geográfico Nacional, se emitió el informe de revisión técnica para la publicación de delimitación georreferenciada de la zona pública de un sector de manglar en Playa Arbolito en relación con los trabajos realizados por SINAC-ACT, donde es avalada técnicamente la delimitación realizada para su publicación.

19.- Que el artículo 140 de la Ley N°6227 Ley General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204 inciso 1) del mismo cuerpo normativo, que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicarán por publicación los actos generales y por notificación, los concretos".

COMUNICA:

Primero: Que el día 13 de setiembre de 2023, el Área de Conservación Tempisque y la empresa STEREOCARTO CENTROAMÉRICA S.A realizaron el trabajo de campo para la delimitación digital georreferenciada al sistema nacional de coordenadas de la zona pública del manglar situado en Playa Arbolito en el distrito 03º Veintisiete de Abril, cantón 03º Santa Cruz, provincia 05º Guanacaste.

Segundo: El Instituto Geográfico Nacional publica la delimitación digital georreferenciada de la zona pública de la zona marítimo terrestre correspondiente al manglar situado en Playa Arbolito en el distrito 03º Veintisiete de Abril, cantón 03º Santa Cruz, provincia 05º Guanacaste, con base al Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre y a la metodología usada y validada por el Área de Conservación Tempisque (ACT).

Tercero: Que la zona pública delimitada corresponde almanglar situado en Playa Arbolito en el distrito 03º Veintisiete de Abril, cantón 03º Santa Cruz, provincia 05º Guanacaste, en conformidad a los oficios DIG-GDF-012-2024-PU-INF-Informe delimitación del manglar en Playa Arbolito de fecha 19 de diciembre de 2024, generado por el Subproceso de Topografía del Departamento Geodesia y Geofísica del Instituto Geográfico Nacional, DDUR-DCT-IGN-837-10-2024 de fecha 30 de octubre de 2024 y el SINAC-ACT-OR-DR-1489-2024 de fecha 18 de octubre de 2024, emitidos por la Municipalidad de Santa Cruz y el Área de Conservación Tempisque, respectivamente.

Cuarto: Que la delimitación digital georreferenciada de la zona pública del manglar en Playa Arbolito corresponde a las siguientes coordenadas en el sistema de proyección cartográfica oficial de Costa Rica CRTM05/ CR05:

Sexto: Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública correspondiente almanglar situado en Playa Arbolito en el distrito 03º Veintisiete de Abril, cantón 03º Santa Cruz, provincia 05º Guanacaste, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN en archivo con formato vectorial shape, bajo la codificación: ZONA PÚBLICA-MOJONES.

Sétimo: Rige a partir de su publicación.
