Notice 6 Delimitation of the public zone (zona pública) corresponding to a mangrove (manglar) sector in Cabo Blanco, District 04° Lepanto, Canton 01° Puntarenas, Province 06° Puntarenas Go to the latest version Version of the Regulation: 1 of 1 NATIONAL GEOGRAPHIC INSTITUTE NOTICE No. 006-2025 MARITIME-TERRESTRIAL ZONE (ZONA MARÍTIMO TERRESTRE) DELIMITATION OF THE PUBLIC ZONE CORRESPONDING TO A MANGROVE SECTOR IN CABO BLANCO, DISTRICT 04° LEPANTO, CANTON 01° PUNTARENAS, PROVINCE 06° PUNTARENAS Pursuant to the provisions of Articles 140 and 240 of Ley Nº6227, the General Law of Public Administration, dated May 2, 1978, and its amendments; Ley Nº59, the Law Creating and Organizing the National Geographic Institute (IGN), dated July 4, 1944, and its amendments; Ley Nº8905, Amendment to Article 2 of Ley N°5695, Creation of the National Registry (Registro Nacional), and its amendments; and amendment to Ley N°59, Creation and Organization of the National Geographic Institute (IGN), of July 4, 1944, and its amendments, dated December 7, 2010; Ley N.º6043, the Law on the Maritime-Terrestrial Zone, dated March 2, 1977, and its implementing regulation; and Articles 2 and 3 of Ley Nº5695, the Law Creating the National Registry, dated May 28, 1975, and its amendments.

1.- That pursuant to Ley Nº8905, the IGN was established as a division of the National Registry, which shall execute the contracts and agreements necessary for the exercise of its functions. Likewise, pursuant to Ley Nº59, the IGN is "the leading scientific and technical agency in national cartography, charged with the production of the official base map and basic geographic description of the Republic of Costa Rica, and with the studies, research, tasks, and development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to those works, with the aim of supporting planning processes." 2.- That Ley Nº59 establishes the IGN on a permanent basis and as representative of the State as the official authority in geodetic matters and in the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any kind originating from the work entrusted to it.

3.- That pursuant to Article 62 of Decreto Ejecutivo N°7841-P, the Regulation to the Law on the Maritime-Terrestrial Zone, dated December 16, 1977, and its amendments, the IGN's competence for the delimitation of the public zone of the Maritime-Terrestrial Zone and its officialization through publication in the Official Gazette La Gaceta is recognized; Article 63 of Decreto Ejecutivo N°7841-P provides that "The National Geographic Institute (IGN) shall publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone." 4.- That Decreto Ejecutivo N°36642-MP-MOPT-MINAET, the Regulation of Specifications for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone, dated June 28, 2011, provides in Article 18 that for the delimitation of the public zone of the Maritime-Terrestrial Zone, the IGN may employ two execution methodologies, as set forth in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime-Terrestrial Zone through the placement of boundary markers (mojones) and/or georeferenced digital delimitation (delimitación digital georreferenciada), with the aim of expediting delimitations and providing greater technical certainty to interested parties.

5.- That Decreto Ejecutivo N°33797-MJ-MOPT, which declares CR05 as the official horizontal datum for Costa Rica, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, dated March 30, 2007, among other matters establishes the National Geodetic Network of Horizontal Reference CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral work carried out in the country must be referenced, specifically providing in Article 11 that: "The National Geodetic Network of Horizontal Reference CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities carried out in the national territory by any public agency, person, or private entity, whether national or foreign, must be referenced."; while Article 7 states that "As cartographic data are produced in the new cartographic projection system CRTM05, the National Geographic Institute (IGN) will publish through appropriate means the information that has been made official." 6.- That Decreto Ejecutivo Nº40962-MJP, Updating the Official Horizontal Geodetic Reference System for Costa Rica, declares in Article 1 that "The official horizontal geodetic reference system for Costa Rica, designated CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, changes and updates shall be governed according to the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) designated SIRGAS-CON"; and that Article 2 establishes that "The cartographic projection system CRTM05 shall continue to be the official system for the cartographic representation of the continental national territory, extended for purposes of applying this cartographic projection to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this baseline being defined in accordance with Articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for computing the maximum breadth of all marine jurisdictional areas of the Costa Rican State." Furthermore, Article 12 of the aforementioned decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which all work in the continental territory of the country must be referenced, by providing that "The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended to the baseline of the territorial sea, and the 'Universal Transverse Mercator' (UTM) cartographic projection, zones 16 and 17, for the insular marine jurisdictional areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities carried out in the national territory by any public agency, person, or private entity, whether national or foreign, that undertakes or contracts geodetic and cartographic work must be referenced, thereby helping to avoid public expenditure and, in turn, obtaining reliable, uniform, and comparable geographic information that is of general utility and that supports decision-making at the various levels of the State." 7.- That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime-Terrestrial Zone enables the accurate delimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores), endorsing survey plans (planos de agrimensura), granting concessions in the restricted zone (zona restringida), and other aspects of coastal land-use planning.

8.- That the georeferenced digital information on the delimitation of the public zone of the Maritime-Terrestrial Zone held by the IGN is referred to as the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) on the Maritime-Terrestrial Zone (ZMT).

9.- That the Georeferenced Digital Geodatabase (GDG) of the IGN on the Maritime-Terrestrial Zone (ZMT) is technically grounded in the application of the regulations established by: a) Decreto Ejecutivo N°7841-P, Regulation to Ley No. 6043 on the Maritime-Terrestrial Zone; b) Decreto Ejecutivo N°33797-MJ-MOPT, which declares CR05 as the official horizontal datum for Costa Rica and its associated cartographic projection CRTM05; c) Decreto Ejecutivo N°36642-MP-MOPT-MINAET, Regulation of Specifications for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone; and d) Decreto Ejecutivo Nº40962-MJP, Updating the Official Horizontal Geodetic Reference System for Costa Rica.

10.- That Article 16 of Ley No.7575, the Ley Forestal, dated February 13, 1996, and its amendments, establishes that MINAE shall demarcate in the field the boundaries of the areas comprising the Natural Heritage of the State (Patrimonio Natural del Estado).

11.- That Article 11 of Chapter I, General Provisions of Ley N°6043, establishes that the "public zone also includes, regardless of its extent, all mangroves on the continental and insular coastlines and estuaries (esteros) of the national territory." 12.- That Decreto Ejecutivo N°36786-MINAET, the Manual for the Classification of Lands Devoted to the Conservation of Natural Resources within the Maritime-Terrestrial Zone in Costa Rica, dated August 12, 2011, establishes among its objectives "To identify within the Maritime-Terrestrial Zone those lands classifiable as forests, forestry-suitable land (Class VII and VIII soils), and wetlands (mangroves, estuaries, rias, marshes (marismas), coastal lagoons, swamps, flooded forests, salt flats (salitrales)), in order to certify them and incorporate them as part of the Natural Heritage of the State (PNE)." 13.- That Decreto Ejecutivo N°36786-MINAET, under point III.—Competencies for Delimitation and Certification, establishes that "The classification of lands within the ZMT shall be the responsibility of the Conservation Areas (Áreas de Conservación, AC) of SINAC and of private professionals duly accredited by the respective Professional Colleges (Colegios Profesionales), so that they may classify forests, forestry-suitable lands (Class VII and VIII soils), (mangroves, estuaries, rias, marshes, coastal lagoons, swamps, flooded forests, salt flats) and wetlands.

The validity of classification documents issued by private professionals shall be subject to approval by the AC having territorial jurisdiction. The ACs of SINAC with jurisdiction over the ZMT shall also be responsible for the verification, inspection, demarcation, and certification of lands of the Natural Heritage of the State and protection zones.

The location and delimitation of areas of the Natural Heritage of the State within the Maritime-Terrestrial Zone must be carried out as part of the process of approving the Coastal Regulatory Plan (Plan Regulador Costero, PRC), as defined by Ley 6043, since the Coastal Regulatory Plan is the land-use planning instrument that defines and locates all zones available for concession within the ZMT and for the classification of the ZMT at the level of cadastral plans (planos de catastro). Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the areas of the PNE so that they are not counted toward the total area available for concession." 14.- That the IGN employed the georeferenced digital delimitation methodology to delimit the public zone of the Maritime-Terrestrial Zone corresponding to a mangrove sector in Cabo Blanco, District 04º Lepanto, Canton 01º Puntarenas, Province 06º Puntarenas.

15.- That through official memorandum ACT-OR-T-085-2023 of January 25, 2023, signed by Fabián Jesús Bonilla Salguero, Surveying Engineer; official memorandum ACT-OSRPL-050-2023 of January 16, 2023, signed by Pedro Andrey Rojas Chaves, Acting Sub-Regional Head for Paquera-Lepanto; and official memorandum ACT-OR-DR-086-2023 of January 25, 2023, signed by Nelson Marín Mora, Director of the Tempisque Conservation Area, all officials of SINAC-MINAE, the technical report was submitted granting approval (visto bueno) to the survey and delimitation carried out.

16.- That through official memorandum DIG-GDF-0220-2024 of June 10, 2024, issued by the Topography Sub-process of the Geodesy and Geophysics Department of the National Geographic Institute (IGN), a technical review report was issued for the publication of the georeferenced delimitation of the public zone, in connection with the work carried out by SINAC-ACT regarding the delimitation of a mangrove sector in Cabo Blanco, with the delimitation having been technically approved for publication.

17.- That Article 140 of Ley N°6227, the General Law of Public Administration, provides that "the administrative act shall take effect after it has been communicated to the person administered, except where it grants only rights, in which case it shall take effect from the moment it is adopted," a provision that must necessarily be read in conjunction with Article 204, paragraph 1) of the same body of law, which defines the appropriate instrument for communicating acts of a general nature, stating that: "General acts shall be communicated by publication and specific acts by notification." HEREBY COMMUNICATES:

First: That on November 29, 2022, SINAC-ACT carried out the fieldwork for the georeferenced digital delimitation, referenced to the national coordinate system, of the public zone of a mangrove sector located in Cabo Blanco, District 04º Lepanto, Canton 01º Puntarenas, Province 06º Puntarenas.

Second: The National Geographic Institute (IGN) publishes the georeferenced digital delimitation of the public zone comprising 38 points forming part of a mangrove sector in Cabo Blanco, District 04º Lepanto, Canton 01º Puntarenas, Province 06º Puntarenas, based on the Regulation of Specifications for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone and the methodology used and validated by the Tempisque Conservation Area (SINAC-ACT).

Third: That the delimited public zone corresponds to a mangrove sector in Cabo Blanco, District 04º Lepanto, Canton 01º Puntarenas, Province 06º Puntarenas, in accordance with official memoranda DIG-GDF-0220-INF-087-2024-PU—Review of the Delimitation of the Mangrove in Río Cabo Blanco, issued by the Topography Sub-process of the Geodesy and Geophysics Department of the National Geographic Institute (IGN), and official memoranda ACT-OR-T-085-2023 of January 25, 2023, ACT-OSRPL-050-2023 of January 16, 2023, and ACT-OR-DR-086-2023 of January 25, 2023, from the Tempisque Conservation Area (SINAC-ACT).

Fourth: That the public zone of the Maritime-Terrestrial Zone pertaining to the mangrove sector verified and delimited by the Tempisque Conservation Area in a mangrove sector of Cabo Blanco corresponds to the following coordinates in the official cartographic projection system of Costa Rica CRTM05:

Fifth: That the sectors located in the mangrove in Cabo Blanco, District 04º Lepanto, Canton 01º Puntarenas, Province 06º Puntarenas, which as of this date have an official delimitation of the public zone of the Maritime-Terrestrial Zone through the placement of boundary markers and respective publication in the Official Gazette La Gaceta, retain their official status.

Sixth: The official technical data for the georeferenced digital delimitation of the public zone of the Maritime-Terrestrial Zone of a mangrove sector in Cabo Blanco, District 04º Lepanto, Canton 01º Puntarenas, Province 06º Puntarenas, have been recorded in the Georeferenced Digital Geodatabase of the Maritime-Terrestrial Zone (ZMT) of the IGN in a file in vector shapefile format, under the code: RN/IGN_GDG-IGN-ZMT mojones.

Seventh: Takes effect upon publication.

1.- Que mediante Ley Nº8905 se estableció al Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, de conformidad con la Ley Nº59, el IGN es "la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación".

2.- Que la Ley Nº59 constituye al IGN de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.

3.-Que de conformidad con el artículo 62 del Decreto Ejecutivo N°7841-P Reglamento a la Ley sobre la Zona Marítimo Terrestre del 16 de diciembre de 1977 y sus reformas, se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto Ejecutivo N°7841-P señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública." 4.-Que el Decreto Ejecutivo N°36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre del 28 de junio del 2011, establece según el artículo 18 que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.

5.- Que el Decreto Ejecutivo N°33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83 del 30 de marzo del 2007, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera." ; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado." 6.- Que el Decreto Ejecutivo Nº40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara en su artículo 1 que "El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON"; además que el artículo 2 establece que "El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense." Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que "El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (UTM), zonas 16 y 17 para las áreas marinas insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado." 7.- Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.

8.- Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).

9.- Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N°7841-P Reglamento a la Ley No. 6043 sobre la Zona Marítimo Terrestre, b) el Decreto Ejecutivo N°33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05, c) el Decreto Ejecutivo N°36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre y d) el Decreto Ejecutivo Nº40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica.

10.- Que el artículo 16 de la Ley No.7575, Ley Forestal del 13 de febrero de 1996 y sus reformas, establece que el Ministerio del Ambiente y Energía (MINAE) delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.- Que el artículo 11 del Capítulo I, Disposiciones Generales de la Ley N°6043, establece que la "Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional." 12.- Que el Decreto Ejecutivo N°36786-MINAET Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica del 12 de agosto del 2011, establece entre sus objetivos "Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE)." 13.- Que el Decreto Ejecutivo N°36786-MINAET en el punto III.-Competencias para la delimitación y certificación establece que "La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.

La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y concesionar." 14.- Que el IGN, utilizó la metodología de Delimitación Digital Georreferenciada, para delimitar la zona pública de la Zona Marítimo Terrestre correspondiente a un del sector manglar en Cabo Blanco, distrito 04º Lepanto, cantón 01º Puntarenas, provincia 06º Puntarenas.

15.- Que mediante el oficio ACT-OR-T-085-2023 de 25 de enero2023, suscrito por Fabián Jesús Bonilla Salguero, Ingeniero Topógrafo, el oficio el ACT-OSRPL-050-2023 del 16 de enero de 2023, suscrito por Pedro Andrey Rojas Chaves, Jefe a.i. Subregional Paquera- Lepanto y el ACT-OR-DR-086-2023 del 25 de enero 2023, suscrito por Nelson Marín Mora, Director del Área Conservación Tempisque, todos funcionarios del Sistema Nacional de Áreas de Conservación-Ministerio de Ambiente y Energía, respectivamente presentan el informe técnico al cual se le otorga el visto bueno al levantamiento y delimitación realizada.

16.- Que mediante el oficio DIG-GDF-0220-2024 de fecha 10 de junio de 2024, generado por el Subproceso de Topografía del Departamento de Geodesia y Geofísica del Instituto Geográfico Nacional, se emitió el Informe de revisión técnica para la publicación de delimitación georreferenciada de la zona pública, en relación con los trabajos realizados por SINAC-ACT relativos a la delimitación de un sector de manglar en Cabo Blanco avalada técnicamente la delimitación realizada para su publicación.

17.- Que el artículo 140 de la Ley N°6227 Ley General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204 inciso 1) del mismo cuerpo normativo, que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicarán por publicación los actos generales y por notificación, los concretos".

COMUNICA:

Primero: Que el 29 de noviembre del 2022, SINAC-ACT realizó el trabajo de campo para la delimitación digital georreferenciada al sistema nacional de coordenadas de la zona pública de un sector en manglar ubicado en Cabo Blanco, distrito 04º Lepanto, cantón 01º Puntarenas, provincia 06º Puntarenas.

Segundo: El Instituto Geográfico Nacional publica la delimitación digital georreferenciada de la zona pública de 38 puntos que forman parte de un sector de manglar en Cabo Blanco, distrito 04º Lepanto, cantón 01º Puntarenas, provincia 06º Puntarenas, con base al Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre y a la metodología usada y validada por el Área de Conservación Tempisque (SINAC-ACT).

Tercero: Que la zona pública delimitada corresponde a un sector de manglar Cabo Blanco, distrito 04º Lepanto, cantón 01º Puntarenas, provincia 06º Puntarenas en conformidad a los oficios DIG-GDF-0220-INF-087-2024-PU-Revisión de delimitación de manglar en Río Cabo Blanco, generado por el Subproceso de Topografía del Departamento de Geodesia y Geofísica del Instituto Geográfico Nacional, y los oficios ACT-OR-T-085-2023 de 25 de enero 2023, ACT-OSRPL-050-2023 del 16 de enero de 2023 y ACT-OR-DR-086-2023 del 25 de enero 2023, del Área de Conservación Tempisque, (SINAC-ACT).

Cuarto: Que la zona pública de la Zona Marítimo Terrestre concerniente al sector de manglar verificado y delimitado por el Área de Conservación Tempisque en un sector de manglar de Cabo Blanco corresponde a las coordenadas, en el sistema de proyección cartográfica oficial de Costa Rica CRTM05, siguientes:

Sexto: Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre de un sector de manglar en Cabo Blanco en distrito 04º Lepanto, cantón 01º Puntarenas, provincia 06º Puntarenas, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN en archivo con formato vectorial shape, bajo la codificación: RN/IGN_GDG-IGN-ZMT mojones.

Sétimo: Rige a partir de su publicación.
