Notice 3 Delimitation of the public zone (zona pública) corresponding to a sector of the mangrove estuary (estero-manglar) in Palo Seco, district 01° Parrita, canton 09° Parrita, province 06° Puntarenas —You are viewing the latest version of this regulation— Go to the latest version Version of the Regulation: 1 of 1 INSTITUTO GEOGRÁFICO NACIONAL NOTICE No. 03-2025 MARITIME-TERRESTRIAL ZONE (ZONA MARÍTIMO TERRESTRE) DELIMITATION OF THE PUBLIC ZONE CORRESPONDING TO A SECTOR OF THE MANGROVE ESTUARY IN PALO SECO, DISTRICT 01° PARRITA, CANTON 09° PARRITA, PROVINCE 06° PUNTARENAS Based on the provisions of articles 140 and 240 of Law No. 6227, General Administrative Procedure Act (Ley General de la Administración Pública), dated May 2, 1978, and its amendments; Law No. 59, Law on the Creation and Organization of the Instituto Geográfico Nacional, dated July 4, 1944, and its amendments; Law No. 8905, Amendment to Article 2 of Law No. 5695, Creation of the National Registry, and its amendments; and amendment to Law No. 59, Creation and Organization of the Instituto Geográfico Nacional, of July 4, 1944, and its amendments, dated December 7, 2010; Law No. 6043, Law on the Maritime-Terrestrial Zone, dated March 2, 1977, with its corresponding regulations; and articles 2 and 3 of Law No. 5695, Law on the Creation of the National Registry, dated May 28, 1975, and its amendments.

1.- By virtue of Law No. 8905, the Instituto Geográfico Nacional, hereinafter IGN, is established as a unit of the National Registry, which shall enter into the contracts and agreements necessary for the exercise of its functions. Likewise, in accordance with Law No. 59, the IGN is "the scientific and technical authority governing national cartography, dedicated to the production of the official base map and the basic geographic description of the Republic of Costa Rica, and to studies, research, work, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to such works, for the purpose of supporting planning processes." 2.- Law No. 59 establishes the IGN on a permanent basis, representing the State, as the official authority in geodetic matters and in the spatial representation of the geography of the Republic of Costa Rica, with its authority extending to activities of any kind originating from the work entrusted to it.

3.- In accordance with article 62 of Executive Decree No. 7841-P, Regulations to the Law on the Maritime-Terrestrial Zone, dated December 16, 1977, and its amendments, the IGN's competence to delimit the public zone of the Maritime-Terrestrial Zone is recognized, along with its official publication in the Official Gazette La Gaceta; article 63 of Executive Decree No. 7841-P states that "The Instituto Geográfico Nacional shall publish a notice in the Official Gazette for each section of the maritime-terrestrial zone in which it has demarcated the public zone." 4.- Executive Decree No. 36642-MP-MOPT-MINAET, Specifications Regulations for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone, dated June 28, 2011, establishes in article 18 that for the delimitation of the public zone of the Maritime-Terrestrial Zone, the IGN may use one of two execution methodologies, as set forth in articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime-Terrestrial Zone through the placement of boundary markers (mojones) and/or georeferenced digital delimitation (delimitación digital georreferenciada), with the aim of expediting delimitations and providing greater technical certainty to interested parties.

5.- Executive Decree No. 33797-MJ-MOPT declares CR05 as the official horizontal datum for Costa Rica, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, dated March 30, 2007. This decree, among other aspects, establishes the National Geodetic Reference Network (Red Geodésica Nacional de Referencia Horizontal) CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral (catastro) work carried out in the country must be referenced, stating specifically in article 11 that: "The National Geodetic Reference Network CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all geodetic and cartographic surveys and activities carried out within the national territory by any public agency, private national or foreign individual or entity, must be referenced."; while article 7 states that "As cartographic data are produced in the new CRTM05 cartographic projection system, the Instituto Geográfico Nacional shall publish through appropriate means the information that has been made official." 6.- Executive Decree No. 40962-MJP, Update of the Official Horizontal Geodetic Reference System for Costa Rica, dated January 24, 2018, declares in article 1 that "The official horizontal geodetic reference system for Costa Rica, known as CR05 and materialized through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, changes and updates thereto shall be governed in accordance with the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS), known as SIRGASCON"; furthermore, article 2 establishes that "The CRTM05 cartographic projection system shall continue to be the official system for cartographic representation of the national continental territory, extended for purposes of applying this cartographic projection to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, with said baseline defined in accordance with articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for computing the maximum breadth of all marine jurisdictional areas of the Costa Rican State." Furthermore, article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which all references within the continental territory of the country must be made, by stating that "The CRSIRGAS horizontal reference system and its associated CRTM05 cartographic projection for the continental territory extended to the baseline of the territorial sea, and the 'Universal Transverse Mercator' (UTM) cartographic projection, zones 16 and 17, for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all geodetic and cartographic surveys and activities carried out within the national territory by any public agency, private national or foreign individual or entity undertaking or contracting geodetic and cartographic work must be referenced, thereby contributing to the avoidance of public expenditure and, in turn, obtaining reliable, uniform, and comparable geographic information of general utility that supports decision-making at the various levels of the State." 7.- Georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime-Terrestrial Zone enables the correct delimitation of the public zone for the purposes of developing coastal regulatory plans (planes reguladores costeros), endorsing survey plans (planos de agrimensura), granting concessions in the Restricted Zone (Zona Restringida), and other aspects of coastal territorial planning.

8.- The georeferenced digital information on the delimitation of the public zone of the Maritime-Terrestrial Zone maintained by the IGN is referred to as the Geodatabase Digital Georreferenciada (GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime-Terrestrial Zone (ZMT).

9.- The Geodatabase Digital Georreferenciada (GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime-Terrestrial Zone (ZMT) is technically grounded in the application of the regulations established by: a) Executive Decree No. 7841-P, Regulations to Law No. 6043 on the Maritime-Terrestrial Zone; b) Executive Decree No. 33797-MJ-MOPT, declaring CR05 as the official horizontal datum for Costa Rica and its associated cartographic projection, CRTM05; c) Executive Decree No. 36642-MP-MOPT-MINAET, Specifications Regulations for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone; and d) Executive Decree No. 40962-MJP, Update of the Official Horizontal Geodetic Reference System for Costa Rica.

10.- Article 16 of Law No. 7575, Ley Forestal, dated February 13, 1996, and its amendments, establishes that MINAE shall demarcate in the field the boundaries of the areas that make up the State Natural Heritage (Patrimonio Natural del Estado).

11.- Article 11 of Chapter I, General Provisions, of Law No. 6043, establishes that the "public zone also includes, regardless of its extent, all mangroves on the continental and insular coastlines and estuaries of the national territory." 12.- Executive Decree No. 36786-MINAET, Manual for the Classification of Land Dedicated to the Conservation of Natural Resources within the Maritime-Terrestrial Zone in Costa Rica, dated August 12, 2011, establishes among its objectives the aim to "Identify within the Maritime-Terrestrial Zone those lands classified as forests, with forestry aptitude (Class VII and VIII soils), wetlands (mangroves, estuaries, rias, salt marshes, coastal lagoons, swamps, flooded forests, and salt flats), in order to certify and incorporate them as part of the State Natural Heritage (PNE)." 13.- Executive Decree No. 36786-MINAET, under section III.—Competencies for delimitation and certification, establishes that "The classification of land within the ZMT shall be the responsibility of the Conservation Areas (AC) of SINAC and of duly accredited private professionals certified by the respective Professional Associations, to classify forests, lands with forestry aptitude (Class VII and VIII soils), (mangroves, estuaries, rias, salt marshes, coastal lagoons, swamps, flooded forests, and salt flats) and wetlands.

The validity of classification documents issued by private professionals shall be subject to the approval of the AC with territorial jurisdiction. The SINAC Conservation Areas with jurisdiction over the ZMT shall also be responsible for the verification, oversight, boundary demarcation (deslinde), and certification of State Natural Heritage lands and protection zones.

The location and delimitation of State Natural Heritage areas within the Maritime-Terrestrial Zone must be carried out as part of the process of approving the Coastal Regulatory Plan (Plan Regulador Costero, PRC), as defined by Law No. 6043, since the Coastal Regulatory Plan is the territorial planning instrument that defines and locates all areas to be granted in concession within the ZMT and for the classification thereof at the level of cadastral plans. Por tanto, the Coastal Regulatory Plan must clearly and expressly indicate the PNE areas so that they are not counted toward the total area available for concession." 14.- The IGN used the georeferenced digital delimitation methodology to delimit the public zone of the Maritime-Terrestrial Zone in the mangrove estuary of Palo Seco, located at Playa Palo Seco in district 01° Parrita, canton 09° Parrita, province 06° Puntarenas.

15.- By means of official communication SINAC-ACOPAC-OSRAP-P.N.E.-048-2024, dated June 11, 2024, issued by the Área de Conservación Pacífico Central of SINAC of MINAE and signed by Mr. Roger Delgado Jiménez, approval was granted for the survey and delimitation carried out by that entity in accordance with its competence over the State Natural Heritage.

16.- By means of the report submitted by surveyor (topógrafo) Jean Henry Venegas Díaz, TA-8923, dated June 14, 2024, entitled INFORME DELIMITACION DE ESTERO PALO SECO, the official recognition of the demarcation carried out on a sector of the mangrove estuary of Palo Seco was requested.

17.- By means of official communication DIG-GDF-008-2024-PU-INF-Revisión de delimitación del estero-manglar Palo Seco, dated December 4, 2024, generated by the Surveying Sub-process of the Geodesy and Geophysics Department of the Instituto Geográfico Nacional, a technical review report was issued for the publication of the georeferenced digital delimitation of the public zone corresponding to the mangrove estuary at Playa Palo Seco, in which the delimitation carried out was technically validated for publication.

18.- Article 140 of Law No. 6227, General Administrative Procedure Act, states that "the administrative act shall take effect after it has been communicated to the party concerned, except where it exclusively grants rights, in which case it shall take effect from the moment it is adopted." This provision must necessarily be read in conjunction with article 204, paragraph 1) of the same body of law, which defines the appropriate instrument for communicating acts of a general nature by stating that: "General acts shall be communicated by publication, and specific acts by notification." HEREBY ANNOUNCES First: On June 14, 2024, surveyor Jean Henry Venegas Díaz, TA-8923, carried out the field work for the georeferenced digital delimitation, referenced to the national coordinate system, of the public zone of a sector of the mangrove estuary located in Palo Seco, district 01° Parrita, canton 09° Parrita, province 06° Puntarenas.

Second: The Instituto Geográfico Nacional publishes the georeferenced digital delimitation of the public zone at 02 points forming part of a sector of the mangrove estuary located at Estero Palo Seco, district 01° Parrita, canton 09° Parrita, province 06° Puntarenas, based on the Specifications Regulations for the Delimitation of the Public Zone of the Maritime-Terrestrial Zone and the methodology used and validated by the Área de Conservación Pacífico Central (SINAC-ACOPAC).

Third: The delimited public zone corresponds to a sector of the mangrove estuary of Palo Seco, district 01° Parrita, canton 09° Parrita, province 06° Puntarenas, in accordance with official communication DIG-GDF-008-2024-PU-INF-Revisión de delimitación del estero-manglar Palo Seco dated December 4, 2024, generated by the Surveying Sub-process of the Geodesy and Geophysics Department of the Instituto Geográfico Nacional, and official communication SINAC-ACOPAC-OSRAP-P.N.E.-048-204 dated June 11, 2024, issued by the Área de Conservación Pacífico Central of SINAC of MINAE, and the INFORME DELIMITACIÓN DEL ESTERO-MANGLAR PALO SECO dated June 14, 2024, signed by surveyor Jean Henry Venegas Díaz, TA-8923.

Fourth: The georeferenced digital delimitation of the public zone of the mangrove estuary of Palo Seco corresponds to the following coordinates in the official cartographic projection system of Costa Rica, CRTM05/CR05:

Fifth: The sectors located in the mangrove estuary of Palo Seco, district 01° Parrita, canton 09° Parrita, province 06° Puntarenas, that as of the date of this notice already have a delimitation of the public zone of the Maritime-Terrestrial Zone through the placement of boundary markers with respective publication in the Official Gazette La Gaceta, retain their official status.

Sixth: With this demarcation, boundary markers M413, M414, and AP-609-0247, published in the Official Gazette La Gaceta No. 184 of September 25, 2003, and No. 05 of January 6, 2012, respectively, are hereby eliminated.

Seventh: The official technical data of the georeferenced digital delimitation of the public zone corresponding to the mangrove estuary of Palo Seco, located at Playa Palo Seco, district 01° Parrita, canton 09° Parrita, province 06° Puntarenas, have been recorded in the Geodatabase Digital Georreferenciada of the Maritime-Terrestrial Zone (ZMT) of the IGN in a vectorial shape format file, under the coding: ZONA PÚBLICA-MOJONES.

Eighth: This notice takes effect upon publication.

1.- Que mediante Ley Nº8905 se establece el Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, de conformidad con la Ley Nº59, el IGN es "la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación".

2.- Que la Ley Nº59 constituye al IGN de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.

3.-Que de conformidad con el artículo 62 del Decreto Ejecutivo N°7841-P Reglamento a la Ley sobre la Zona Marítimo Terrestre del 16 de diciembre de 1977 y sus reformas, se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto Ejecutivo N°7841-P señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública." 4.-Que el Decreto Ejecutivo N°36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre del 28 de junio del 2011, establece según el artículo 18 que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.

5.- Que el Decreto Ejecutivo N°33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83 del 30 de marzo del 2007, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera." ; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado." 6.- Que el Decreto Ejecutivo Nº40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica del 24 de enero del 2018, declara en su artículo 1 que "El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGASCON"; además que el artículo 2 establece que "El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense." Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que "El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (UTM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado." 7.- Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.

8.- Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).

9.- Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N°7841-P Reglamento a la Ley No. 6043 sobre la Zona Marítimo Terrestre; b) el Decreto Ejecutivo N°33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05; c) el Decreto Ejecutivo N°36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre; y d) el Decreto Ejecutivo Nº40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica.

10.- Que el artículo 16 de la Ley N°7575, Ley Forestal del 13 de febrero de 1996 y sus reformas, establece que el Ministerio del Ambiente y Energía (MINAE) delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.- Que el artículo 11 del Capítulo I, Disposiciones Generales de la Ley N°6043, establece que la "Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional." 12.- Que el Decreto Ejecutivo N°36786-MINAET Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica del 12 de agosto del 2011, establece entre sus objetivos "Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE)." 13.- Que el Decreto Ejecutivo N°36786-MINAET en el punto III.-Competencias para la delimitación y certificación establece que "La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.

La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en el área total a concesionar." 14.- Que el IGN utilizó la metodología de Delimitación Digital Georreferenciada, para delimitar la zona pública de la Zona Marítimo Terrestre en el estero-manglar Palo Seco situado en Playa Palo Seco en el distrito 01° Parrita, cantón 09° Parrita, provincia 06º Puntarenas.

15.- Que mediante el oficio SINAC-ACOPAC-OSRAP-P.N.E.-048-2024 de fecha 11 de junio de 2024 emitido por el Área de Conservación Pacifico Central del Sistema de Áreas de Conservación del Ministerio de Ambiente y Energía suscrito por el señor Roger Delgado Jimenez, se le otorga visto bueno del levantamiento y delimitación realizados por dicho ente según su competencia del Patrimonio Natural del Estado.

16.- Que mediante el informe presentado por el topógrafo Jean Henry Venegas Díaz TA- 8923 de fecha 14 de junio de 2024 de nombre INFORME DELIMITACION DE ESTERO PALO SECO se solicitó la oficialización de la demarcación realizada de un sector del Estero-Manglar Palo Seco.

17.- Que mediante el oficio DIG-GDF-008-2024-PU-INF-Revisión de delimitación del estero-manglar Palo Seco de fecha 04 de diciembre de 2024, generado por el Subproceso de Topografía del Departamento Geodesia y Geofísica del Instituto Geográfico Nacional, se emitió el informe de revisión técnica para la publicación de delimitación georreferenciada de la zona pública correspondiente al estero-manglar en Playa Palo Seco donde se avalada técnicamente la delimitación realizada para su publicación.

18.- Que el artículo 140 de la Ley N°6227 Ley General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204 inciso 1) del mismo cuerpo normativo, que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicarán por publicación los actos generales y por notificación, los concretos".

COMUNICA Primero: Que, el 14 de junio del año 2024, el Topógrafo Jean Henry Venegas Días, TA-8923 realizó el trabajo de campo para la delimitación digital georreferenciada al sistema nacional de coordenadas de la zona pública de un sector de estero-manglar ubicado Palo Seco, distrito 01º Parrita, cantón 09º Parrita, provincia 06º Puntarenas.

Segundo: El Instituto Geográfico Nacional publica la delimitación digital georreferenciada de la zona pública de 02 puntos que forman parte de un sector de estero-manglar ubicado en el Estero Palo Seco, distrito 01º Parrita, cantón 09º Parrita, provincia 06º Puntarenas, con base al Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre y a la metodología usada y validada por el Área de Conservación Pacifico Central (SINAC-ACOPAC).

Tercero: Que la zona pública delimitada corresponde a un sector del Estero-Manglar Palo Seco, distrito 01º Parrita, cantón 09º Parrita, provincia 06º Puntarenas en conformidad a los oficios DIG-GDF-008-2024-PU-INF-Revisión de delimitación del estero-manglar Palo Seco de fecha 04 de diciembre de 2024, generado por el Subproceso de Topografía del Departamento de Geodesia y Geofísica del Instituto Geográfico Nacional, y los oficios SINAC-ACOPAC-OSRAP-P.N.E.-048-204 del 11 de junio del 2024 emitido por el Área de Conservación Pacifico Central del Sistema de Áreas de Conservación del Ministerio de Ambiente y Energía y el INFORME DELIMITACIÓN DEL ESTERO-MANGLAR PALO SECO de fecha 14 de junio de 2024 suscrito por el topógrafo Jean Henry Venegas Díaz TA-8923 .

Cuarto: Que la delimitación digital georreferenciada de la zona pública del estero-manglar Palo Seco corresponde a las siguientes coordenadas en el sistema de proyección cartográfica oficial de Costa Rica CRTM05/ CR05:

Quinto: Que los sectores ubicados en Estero-Manglar Palo Seco, distrito 01º Parrita, cantón 09º Parrita, provincia 06º Puntarenas, que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

Sexto: Con esta demarcación se eliminan los mojones M413, M414 y AP-609-0247; publicados en el Diario Oficial La Gaceta N°184 del 25 de setiembre de 2003 y N°05 del 06 de enero de 2012, respectivamente.

Séptimo: Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública correspondiente Estero-Manglar Palo Seco ubicado Playa Palo Seco, distrito 01° Parrita, cantón 09° Parrita, provincia 06º Puntarenas, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN en archivo con formato vectorial shape, bajo la codificación: ZONA PÚBLICA-MOJONES Octavo: Rige a partir de su publicación.
