en la totalidad del texto - Complete Text of Regulation 44926 Amendment to the Creation of the Fund for prevention, exclusion, and combat against fusarium oxysporum f.sp cubense tropical race 4 and other pests and diseases affecting banana cultivation and repeal of the banana contingency fund No. 44926 MAG-H THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF AGRICULTURE AND LIVESTOCK AND THE MINISTER OF FINANCE In exercise of the powers and attributions conferred upon them by articles 140, subsections 3) and 18), and 146 of the Political Constitution; articles 25.1, 27.1, and 28 subsection 2, item b of Law No. 6227; "Ley General de la Administración Pública" of May 2, 1978; Law No. 5515 "Impuesto sobre articles 1, 2, and 4 of Law No. 4895; "Crea la Corporación Bananera Nacional (CORBANA)" of November 16, 1971, and its amendments.

1. That the banana activity is carried out in the Caribbean zone of the country, mostly in the Province of Limón, where the greatest number of production units are established and where the largest volume of fruit is produced.

2. That the existence of the banana activity and of the national producing companies is a matter of public interest, because said activity is one of the most important within the Costa Rican productive structure, as banana is the primary agricultural export product and has generated, in recent years, around USD 1.22 billion in foreign currency, and constitutes one of the productive branches that uses the most labor per hectare, currently generating employment for more than 100,000 people, of which 42,200 are direct jobs, which pay the highest level of agricultural wages, and, furthermore, it is developed in areas of the country that for many years have not had other types of productive activities that, like the banana activity, contribute in such a decisive way to their development.

3. That by Law No. 5515, it is authorized that part of what is collected from the banana export tax be destined for independent banana producers, who receive it through funds administered by the Corporación Bananera Nacional, in accordance with its legal objective of promoting national banana development through the execution of banana development plans that involve not only aspects related to banana production but also the creation of infrastructure, as well as addressing social and environmental matters with the purpose of promoting sustainable agriculture.

4. That consequently, the Corporación Bananera Nacional is the sole specialized technical public entity in banana matters, whose fundamental mission is national banana development, which implies that it has the responsibility of enhancing the banana activity in a comprehensive manner, considering economic, productive, social, and environmental aspects, and therefore it is its responsibility to guide the banana sector in developing corporate social responsibility policies.

5. That important population centers are concentrated around the banana plantations (estimated at 347,700 people, representing 80% of the total population of the province), whose work and economic activity and their human, family, and community development are linked to the production units, which is why maintaining the banana activity is of national interest, given the formal jobs it generates and the foreign currency entering the country.

6. That through Executive Decree No. 42037-MAG-H "Creation of the Fund for prevention, exclusion, and combat against fusarium oxysporum f.sp cubense tropical race 4 and other pests and diseases affecting the cultivation of banana and repeal of the banana contingency fund," resources were allocated for two purposes:

• a)For actions of prevention, exclusion, and combat of Fusarium oxysporum f sp cubense tropical race 4, a fungus causing the wilt of banana plants that is causing the abandonment of plantations with great economic and social losses in other Latin American countries. The resources of this fund were allocated to the objective of supporting the State in prevention actions at ports, airports, borders, national highways, the purchase of materials for prevention and eventual containment of the disease, training or instruction of officials, in addition to supporting the carrying out of national and international coordination or training activities to carry out actions jointly with other governments or international organizations. Likewise, the resources were allocated to support strategic investigations for the prevention, exclusion, and combat of Fusarium oxysporum f sp cubense tropical race 4.
• b)To request reimbursable loans from public and private financial entities, duly authorized by current regulations, with the purpose of financing agricultural, livestock, fisheries, and rural development productive projects. Said loans shall be destined to strengthen food security, promote sustainable production, and improve the competitiveness of the agricultural sector, in accordance with the guidelines established in Executive Decree 42037-MAG-H.

7. That in the current situation, it is a priority to redouble actions for the prevention and exclusion of the disease at border posts and merchandise entry docks, and to use all of these resources to support the State, particularly the Servicio Nacional de Salud Animal and the Servicio Fitosanitario del Estado, organs of the Ministry of Agriculture and Livestock, in the entire scheme of prevention, exclusion, and combat of the pathogen's entry into the national territory that threatens the production and development of the activity and the country. Given that this fund was constituted and divided according to two objectives, it is necessary to unify it.

8. That in conformity with the second and third paragraphs of article 12 bis of the Regulation to the Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Executive Decree No. 37045-MP-MEIC of February 22, 2012; Section I, called "Control Previo de Mejora Regulatoria" of the "Formulario de Evaluación Costo Beneficio," was completed, with the evaluation of the normative proposal yielding a negative result and it containing no procedures, requirements, or formalities, and therefore it was determined that it was not necessary to continue with the cited regulatory analysis.

THEY DECREE AMENDMENT OF ARTICLE 2 OF EXECUTIVE DECREE NO. 42037-MAG-H "CREATION OF THE FUND FOR PREVENTION, EXCLUSION, AND COMBAT AGAINST FUSARIUM OXYSPORUM F.SP CUBENSE TROPICAL RACE 4 AND OTHER PESTS AND DISEASES AFFECTING THE CULTIVATION OF BANANA AND REPEAL OF THE BANANA CONTINGENCY FUND" OF NOVEMBER 8, 2019.

CONSIDERING

Therefore,

en la totalidad del texto - Texto Completo Norma 44926 Reforma Creación del Fondo de prevención, exclusión y combate contra el fusarium oxysporum f.sp cubense raza 4 tropical y de otras plagas y enfermedades que afecten el cultivo de banano y derogatoria del fondo de contigencias bananeras Nº 44926 MAG-H El PRESIDENTE DE LA REPÚBLICA, EL MIMSTRO DE AGRICULTURA Y GANADERIA Y EL MINISTRO DE HACIENDA En ejercicio de las facultades y atribuciones que les confieren los artículos 140, incisos 3), y 18) y 146 de la Constitución Política; los artículos 25.1, 27.1 y 28 inciso 2 acápite b de la Ley Nº 6227; "Ley General de la Administración Pública" del 2 de mayo de 1978; Ley Nº 5515 "Impuesto sobre artículos 1, 2 y 4 de la Ley Nº 4895; "Crea la Corporación Bananera Nacional (CORBANA)" del 16 de noviembre de 1971 y sus reformas.

1. Que la actividad bananera se realiza en la zona Caribe del país, mayormente en la Provincia de Limón, en la cual están establecidas la mayor cantidad de unidades productivas y donde se produce el mayor volumen de fruta.

2. Que la existencia de la actividad bananera y de las empresas productoras nacionales, es materia de interés público, porque dicha actividad es de las más importantes dentro de la estructura productiva costarricense. al ser el banano el primer producto de exportación agrícola y generar en los últimos años alrededor de USD 1 220 millones en divisas y constituir una de las ramas productivas que más mano de obra utiliza por hectárea, generando en la actualidad empleo para más de 100 000 personas. de los cuales 42 200 son empleos directos, a los que se paga el más alto nivel de salarios agrícolas, además. de que se desarrolla en zonas del país que no han contado por muchos años con otro tipo de actividades productivas que como la actividad bananera, coadyuven en forma tan determinante en su desarrollo.

3. Que por Ley No. 5515 se autoriza que parte de lo recaudado por el impuesto de exportación de banano sea destinado a los productores independientes de banano. quienes lo reciben a través de fondos que administra la Corporación Bananera Nacional, conforme a su objetivo legal de impulsar el desarrollo bananero nacional mediante la ejecución de planes de fomento bananero que implica no solo aspectos relativos a la producción bananera sino también a la creación de infraestructura. Así como la atención de asuntos sociales y ambientales con el fin de promover una agricultura sostenible.

4. Que en consecuencia la Corporación Bananera Nacional es el único ente público técnico especializado en materia bananera, que tiene corno misión fundamental el desarrollo bananero, nacional, lo cual implica que tiene la responsabilidad de potenciar la actividad bananera de una forma integral, considerando aspectos económicos, productivos, sociales y ambientales, por lo que le corresponde orientar al sector bananero al desarrollo de políticas de responsabilidad social corporativa.

5. Que alrededor de las plantaciones bananeras se concentran importantes centros de población (estimada en 347 700 personas, que representa el 80% de la población total de la provincia), cuya actividad laboral y económica y su desarrollo humano, familiar y comunitario está ligado a las unidades productivas, por lo que resulta de interés nacional mantener la actividad bananera, dado los empleos formales que general y las divisas que ingresan al país.

6. Que mediante Decreto Ejecutivo Nº 42037-MAG-H "Creación del Fondo de prevención, exclusión y combate contra el fusarium oxysporum f.sp cubense raza 4 tropical y de otras plagas y enfermedades que afecten el cultivo de banano y derogatoria del fondo de contingencias bananeras" se destinaron recursos para dos propósitos:

• a)Para acciones de prevención, exclusión y combate del Fusarium oxysporum f sp cubense raza 4 tropical, hongo causante de la marchitez de las plantas de banano que está provocando abandono de plantaciones con grandes pérdidas económicas y sociales en otros países de Latinoamérica. Los recursos de este fondo se destinaron al objetivo de apoyar al Estado en las acciones de prevención en puertos, aeropuertos, fronteras, carreteras nacionales, compra de materiales para la prevención y eventual contención de la enfermedad, entrenamiento o capacitación de funcionarios, además de apoyar la realización de actividades nacionales e internacionales de coordinación o capacitación para realizar acciones en conjunto con otros gobiernos o con organismos internacionales. De igual forma, los recursos se destinaron para apoyar las investigaciones estratégicas para prevención, exclusión y combate del Fusarium, oxysporum f sp cubense raza 4 tropical.
• b)Solicitar los créditos reembolsables ante las entidades financieras públicas y privadas, debidamente autorizadas por la normativa vigente, con el propósito de financiar proyectos productivos agropecuarios, pesqueros y de desarrollo rural. Dichos créditos estarán destinados a fortalecer la seguridad alimentaria, fomentar la producción sostenible y mejorar la competitividad del sector agropecuario, en concordancia con los lineamientos establecidos en el Decreto Ejecutivo 42037-MAG-H.

7. Que en la coyuntura actual resulta prioritario redoblar acciones para la prevención y exclusión de la enfermedad en los puestos fronterizos y muelles de ingreso de mercaderías, y utilizar la totalidad de estos recursos para apoyo al Estado, particularmente al Servicio Nacional de Salud Animal y al Servicio Fitosanitario del Estado, órganos del Ministerio de Agricultura y Ganadería, en todo el esquema de prevención, exclusión y combate de ingreso del patógeno al territorio nacional que amenaza la producción y desarrollo de la actividad y el país. Siendo que este fondo se constituyó y se dividió según dos objetivos, se hace necesario unificarlo.

8. Que de conformidad con los párrafos segundo y tercero del artículo 12 bis del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo Nº 37045-MP-MEIC del 22 de febrero de 2012; se procedió a llenar la Sección I denominada "Control Previo de Mejora Regulatoria" del "Formulario de Evaluación Costo Beneficio", siendo que la evaluación de la propuesta normativa dio resultado negativo y que no contiene trámites, requisitos ni procedimientos, por lo que se determinó que no se requería proseguir con el análisis regulatorio de cita.

REFORMA DEL ARTÍCULO 2 AL DECRETO EJECUTIVO Nº 42037-MAG-H "CREACIÓN DEL FONDO DE PREVENCIÓN, EXCLUSIÓN Y COMBATE CONTRA EL FUSARIUM OXYSPORUM F.SP CUBENSE RAZA 4 TROPICAL Y DE OTRAS PLAGAS Y ENFERMEDADES QUE AFECTEN EL CULTIVO DE BANANO Y DEROGATORIA DEL FONDO DE CONTIGENCIAS BANANERAS" DEL 8 DE NOVIEMBRE 2019.

CONSIDERANDO

Por tanto,
