throughout the entire text - Complete Text of Norm 44852 Repeals the Declaration of public utility for the interests of the State of the Asociación Administradora del Acueducto y Alcantarillado Sanitario de San Lorenzo Siquirres Limón N°44852-MJP THE PRESIDENT OF THE REPUBLIC THE MINISTER OF JUSTICE AND PEACE Based on the provisions set forth in articles 140, subsection 18) and 146 of the Political Constitution, in articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) paragraph b) of the General Public Administration Law N° 6227 of December 1O, 1978, in article 32 of the Associations Law N° 218 of August 8, 1939 and articles 27 and following of the Regulation to the Associations Law N° 29496-J, published in La Gaceta N° 96 of May 21, 2001.
I.-Article 32 of the Associations Law N°218 of August 8, 1939 and its amendments, grants the Executive Branch the power to declare of public utility those simple, federated or confederated associations, whose development and activities are particularly useful for the interests of the State, and that thereby contribute to solving a social need.
II.-That the Asociación Administradora del Acueducto y Alcantarillado Sanitario de San Lorenzo Siquirres Limón, legal identification number three- zero zero two- six hundred seventy-eight thousand one hundred forty-nine, was registered in the Associations Registry of the Public Registry on December twenty-sixth, two thousand twelve, in volume two thousand thirteen, entry one hundred seventy-eight thousand four hundred twenty-four.
III.-That article 32 of the Associations Law establishes: "... At any time, the Ministry of Justice and Peace shall revoke this benefit, if the reasons for which it was granted disappear. (...) ". Likewise, ordinal 33 bis of the Regulation to the Associations Law adds: "(...) The declaration shall be revocable at any time, by means of a reasoned resolution... ".
IV.-That the Asociación Administradora del Acueducto y Alcantarillado Sanitario de San Lorenzo Siquirres Limón, through its legal representative Mrs. Margarita Araya Campo, holder of identity card number three-zero two hundred- thousand two hundred twenty-two, failed to submit the annual reports corresponding to the periods 2022 and 2023, and therefore, expressed their desire to renounce the benefit of the declaration of public utility. Therefore:
THEY DECREE:

en la totalidad del texto - Texto Completo Norma 44852 Deroga Declara de utilidad pública para los intereses del Estado la Asociación Administradora del Acueducto y Alcantarillado Sanitario de San Lorenzo Siquirres Limón N°44852-MJP EL PRESIDENTE DE LA REPÚBLICA El MINISTRO DE JUSTICIA Y PAZ Con fundamento en lo dispuesto en los artículos 140, inciso 18) y 146 de la Constitución Política, en los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de Administración Pública N° 6227 del 1O de diciembre de 1978, en el artículo 32 de la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y los artículos 27 y siguientes del Reglamento a la Ley de Asociaciones N° 29496-J, publicado en La Gaceta N° 96 del 21 de mayo del 2001.
I.-El artículo 32 de la Ley de Asociaciones N°218 del 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.-Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario de San Lorenzo Siquirres Limón, cédula jurídica número tres- cero cero dos- seiscientos setenta y ocho mil ciento cuarenta y nueve, se inscribió en el Registro de Asociaciones del Registro Público el veintiséis de diciembre del dos mil doce, al tomo dos mil trece, asiento ciento setenta y ocho mil cuatrocientos veinticuatro.
III.-Que el artículo 32 de la Ley de Asociaciones establece: "... En cualquier momento, el Ministerio de Justicia y Paz, revocará este beneficio, si desaparecen los motivos por los cuales fue concedido. (...) " . Asimismo, el ordinal 33 bis del Reglamento a la Ley de Asociaciones, agrega: "(...) La declaratoria será revocable en cualquier momento, mediante resolución razonada... ".
IV.-Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario de San Lorenzo Siquirres Limón, por medio de su representante legal la señora Margarita Araya Campo, portadora de la cédula de identidad número tres-cero doscientos- mil doscientos veintidós, incumplieron en la presentación de los informes anuales correspondientes a los períodos 2022 y 2023, por lo que, manifestaron su deseo de renunciar al beneficio de la declaratoria de utilidad pública. Por tanto:
DEROGAR LA DECLARATORIA DE UTILIDAD PÚBLICA DE LA ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DE SAN LORENZO SIQUIRRES LIMÓN
