throughout the entire text - Complete Text of Regulation 44851 Repeals the Declaration of public utility for the interests of the State of the Asociación Administradora del acueducto y alcantarillado sanitario de Matapalo Santa Cruz, Guanacaste No. 44851-MJP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Pursuant to the provisions set forth in articles 140, subsection 18) and 146 of the Political Constitution, in articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) heading b) of the Ley General de Administración Pública No. 6227 of December 1, 1978, in article 32 of the Ley de Asociaciones No. 218 of August 8, 1939, and articles 27 and subsequent of the Reglamento a la Ley de Asociaciones No. 29496-J, published in La Gaceta No. 96 of May 21, 2001.
I.-That article 32 of the Ley de Asociaciones No. 218 of August 8, 1939, and its amendments, grants the Executive Branch the power to declare of public utility simple, federated, or confederated associations, whose development and activities are particularly useful for the interests of the State, and that therefore contribute to solving a social need.
II.-That the Asociación Administradora del Acueducto y Alcantarillado Sanitario de Matapalo Santa Cruz Guanacaste, legal identification number three-zero zero two-three hundred forty-nine thousand three hundred twenty-five, was registered in the Associations Registry of the Public Registry on September six, two thousand, in volume five hundred ten, entry fourteen thousand three hundred fifty-two.
III.-That article 32 of the Ley de Asociaciones establishes: ". At any time, the Ministry of Justice and Peace, shall revoke this benefit, if the reasons for which it was granted disappear. (...)". en la totalidad del texto - Texto Completo Norma 44851 Deroga Declaratoria de utilidad pública para los intereses del Estado la Asociación Administradora del acueducto y alcantarillado sanitario de Matapalo Santa Cruz, Guanacaste N° 44851-MJP EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE JUSTICIA Y PAZ Con fundamento en lo dispuesto en los artículos 140, inciso 18) y 146 de la Constitución Política, en los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de Administración Pública N° 6227 del 1° de diciembre de 1978, en el artículo 32 de la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y los artículos 27 y siguientes del Reglamento a la Ley de Asociaciones N° 29496-J, publicado en La Gaceta N° 96 del 21 de mayo del 2001.
I.-Que el artículo 32 de la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.-Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario de Matapalo Santa Cruz Guanacaste, cédula jurídica número tres-cero cero dos-trescientos cuarenta y nueve mil trescientos veinticinco, se inscribió en el Registro de Asociaciones del Registro Público el seis de setiembre del dos mil, al tomo quinientos diez, asiento catorce mil trescientos cincuenta y dos.
III.-Que el artículo 32 de la Ley de Asociaciones establece: ". En cualquier momento, el Ministerio de Justicia y Paz, revocará este beneficio, si desaparecen los motivos por los cuales fue concedido. (...)". Asimismo, el ordinal 33 bis del Reglamento a la Ley de Asociaciones, agrega: "(...) La declaratoria será revocable en cualquier momento, mediante resolución razonada...
IV.-Que la Asociación Administradora del Acueducto y Alcantarillado Sanitario de Matapalo Santa Cruz Guanacaste, por medio de su representante legal el señor Efraín Milanés Obando Álvarez, portador de la cédula de identidad cinco-cero ciento cincuenta y cuatro-cero cuatrocientos sesenta y cuatro, manifestaron su deseo de renunciar al beneficio de la declaratoria de utilidad pública. Por tanto,
DEROGAR LA DECLARATORIA DE UTILIDAD PÚBLICA DE LA ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DE MATAPALO SANTA CRUZ GUANACASTE
