en la totalidad del texto - Usted está en la última versión de la norma - Texto Completo Norma 44796 Declares the cadastral zone of District 04 Mata de Plátano, canton 08 Goicoechea Province 01 San José N°44796-JP THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND PEACE Based on subsections 3) and 18) of article 140 and 146 of the Political Constitution of Costa Rica, on articles 25 subsection 1), 27 subsection 1) and 28 subsection b) of the General Public Administration Act, Law N° 6227 of May 2, 1978, the Law Creating the National Registry (Registro Nacional), Law N° 5695 of May 28, 1975 (amended by laws N° 8766 of September 1, 2009, Law N° 8823 of May 5, 2010, Law N° 8710 of February 3, 2009, Law N° 7764 of April 17, 1998, and by Law N° 5950 of October 27, 1976. I.-That by means of Law N° 8710, published in La Gaceta N° 48 of March 10, 2009, article 2 of Law N° 5695, Law Creating the National Registry (Registro Nacional), published in the Official Gazette La Gaceta N° 106 of June 7, 1975 and its amendments, is reformed, indicating that the National Cadastre (Catastro Nacional) becomes part of the Real Estate Registry (Registro Inmobiliario).
II.-That Executive Decree (Decreto Ejecutivo) N° 35509-J of September 30, 2009, Organization Regulation of the Real Estate Registry (Registro Inmobiliario) published in the Official Gazette La Gaceta N° 198 of October 13, 2009, establishes that the Real Estate Registry (Registro Inmobiliario) is composed of the Cadastral Subdirectorate (Subdirección Catastral) and the Registry Subdirectorate (Subdirección Registral).
III.-That the Real Estate Registry (Registro Inmobiliario) of the National Registry (Registro Nacional), based on the National Cadastre Law (Ley de Catastro Nacional) N° 6545 of March 25, 1981, published in the Official Gazette La Gaceta N° 73 of April 15, 1981 in its article 13 has the exclusive power, the execution and maintenance of the Cadastre, a function that may be partially delegated to other state institutions.
IV.-That in accordance with the provisions of article 1 Executive Decree (Decreto Ejecutivo) N° 30106-J which "Declares the Entirety of the Cantons of the National Territory as a Cadastral Zone" published in La Gaceta N° 19 of January 28, 2002 and article 7 of the Regulation to the National Cadastre Law (Reglamento a la Ley del Catastro Nacional), Executive Decree (Decreto Ejecutivo) N° 34331, published in the Official Gazette La Gaceta N° 41 of February 27, 2008 which has been in effect since September 27, 2008, the entirety of the cantons of the national territory were declared a cadastral zone.
V.-That because the cadastral survey (levantamiento catastral) work of Canton 08 Goicoechea, District 04 Mata de Plátano, Province 01 San José has been completed, and in accordance with the provisions of article 19 of the National Cadastre Law (Ley de Catastro Nacional) and 10 of its regulation, the holders of properties (inmuebles) in said district were invited to a public exhibition to learn the results of the survey and express their conformity or non-conformity by means of publication in the Official Gazette La Gaceta N° 199 of October 27, 2023, page 73 and in the nationally circulated newspapers La Nación of October 30, 2023, page 18 and La Teja of October 28, 2023, page 9, an exhibition that was held from October 30 to November 6, 2023.
VI.-That in a resolution at eleven o'clock on September eleventh of the year two thousand twenty-four, the Real Estate Registry (Registro Inmobiliario) of the National Registry (Registro Nacional) declared the cadastral data resulting from the cadastral survey (levantamiento catastral) carried out in Canton 08 Goicoechea, District 04 Mata de Plátano, Province 01 San José as final (firmes).
VII.-That the terms established in article 20 of the National Cadastre Law (Ley del Catastro Nacional) have already elapsed and the claims filed by the owners were resolved by the Directorate of the Real Estate Registry (Registro Inmobiliario) of the National Registry (Registro Nacional). Therefore:

l.-Que mediante Ley N° 8710, publicada en La Gaceta N° 48 del 10 de marzo de 2009 se reforma el artículo 2 de la Ley N° 5695, Ley de Creación del Registro Nacional, publicada en el Diario Oficial La Gaceta N° 106 del 07 de junio de 1975 y sus reformas, indicando que el Catastro Nacional pasa a formar parte del Registro Inmobiliario.
ll.-Que el Decreto Ejecutivo N° 35509-J de 30 de setiembre de 2009, Reglamento de Organización del Registro Inmobiliario publicado en el Diario Oficial La Gaceta N° 198 del 13 de octubre de 2009, establece que el Registro Inmobiliario está conformado por la Subdirección Catastral y la Subdirección Registral.
III.-Que el Registro Inmobiliario del Registro Nacional, con fundamento en la Ley de Catastro Nacional N° 6545 de 25 de marzo de 1981, publicada en el Diario Oficial La Gaceta N° 73 del 15 de abril de 1981 en su artículo 13 tiene como potestad exclusiva, la ejecución y mantenimiento del Catastro, función que puede delegar parcialmente en otras instituciones estatales.
IV.-Que de conformidad con lo que establece el artículo 1° Decreto Ejecutivo N° 30106-J donde se "Declara Zona Catastral la Totalidad de los Cantones del Territorio Nacional" publicado en La Gaceta N° 19 de 28 de enero de 2002 y el artículo 7 del Reglamento a la Ley del Catastro Nacional, Decreto Ejecutivo N° 34331, publicado en el Diario Oficial La Gaceta N° 41 del 27 de febrero del 2008 el cual rige desde el 27 de setiembre de 2008, la totalidad de los cantones del territorio nacional fueron declarados zona catastral.
V.-Que por haber concluido los trabajos de levantamiento catastral del Cantón 08 Goicoechea, Distrito 04 Mata de Plátano, Provincia 01 San José, y de conformidad con lo que establece el artículo 19 de la Ley de Catastro Nacional y 10 de su reglamento, fueron invitados los titulares de inmuebles de dicho distrito a una exposición pública para conocer los resultados del levantamiento y manifestar su conformidad o disconformidad mediante publicación en el Diario Oficial La Gaceta N° 199 de 27 de octubre del 2023, página 73 y en los diarios de circulación nacional La Nación del 30 de octubre del 2023, página 18 y La Teja del 28 de octubre del 2023, página 9, exposición que se llevó a cabo del 30 de octubre al 06 de noviembre del 2023.
VI.-Que en resolución de las once horas del once de setiembre del año dos mil veinticuatro, el Registro Inmobiliario del Registro Nacional declaró firmes los datos catastrales resultantes del levantamiento catastral efectuado en el Cantón 08 Goicoechea, Distrito 04 Mata de Plátano, Provincia 01 San José.
VII.-Que ya transcurrieron los términos de los plazos establecidos en el artículo 20 de la Ley del Catastro Nacional y fueron resueltos, por la Dirección del Registro Inmobiliario del Registro Nacional, los reclamos presentados por los propietarios. Por tanto:
SE DECLARA ZONA CATASTRADA EL DISTRITO 04 MATA DE PLATANO, CANTON 08 GOICOECHEA, PROVINCIA 01 SAN JOSÉ
