"Article 16 BIS. Forms of canceling the pecuniary consideration.

The annual amount of the pecuniary consideration (contraprestación pecuniaria) may be canceled in kind through advertising spaces or slots in radio, television, social media, and corporate websites, or annually on the anniversary date of the permit issuance, the permittee must deposit the amount to be canceled as pecuniary consideration into the Special Account of the National Parks Fund number 41220-5 of the Banco Nacional de Costa Rica, in accordance with the provisions of articles 35 and 41 of the Biodiversity Law.

The spaces to be disseminated must have the approval of the Institutional Communication Department of MINAE (DECI), which will coordinate the pertinent matters with the Conservation Area of the National System of Conservation Areas (SINAC), and shall be aimed at disseminating information related to the Environment and Energy sectors, in the following manner:

1 Broadcast during peak audience hours, four thirty-second spots per day.

2 Broadcast once a week, a fifteen-minute program, on the day and time jointly determined with MINAE. This program may be divided into segments by mutual agreement, provided the aforementioned total time is met.

3 Provide at no cost, the monitoring of MINAE's aired spaces, the recording and copying of spots and programs of the radio stations and of MINAE, useful for the Ministry's environmental education programs.

4 Provide at no cost, editing equipment and its operators for up to six hours per month, so that MINAE may edit materials to be used both in the spots and in the weekly fifteen-minute programs.

The permittee must inform the Institutional Communication Department (DECI) of MINAE and the corresponding Conservation Area of the hours and days on which the spots or programs will be scheduled. The material may be changed at the time MINAE deems it necessary or pertinent, and may request the repetition of any space that has already been disseminated, if deemed necessary.

In the event of non-compliance with payment in kind, or payment by barter for airtime spaces, the DECI shall inform the pertinent Conservation Area so that the corresponding administrative measures may be taken, which are the sending of a written warning notification and, in a second act, the suspension of the Use Permit for the Installation of Telecommunications Infrastructure in Protected Wilderness Areas and State Natural Heritage Administered by the National System of Conservation Areas.

Private radiocommunication posts may cancel the annual amount of the pecuniary consideration (contraprestación pecuniaria) by means of payment in kind through SMS messages on environmental topics, following prior coordination with the Institutional Communication Department of MINAE and the corresponding Conservation Area, or annually on the anniversary date of the permit issuance, the permittee must deposit the amount to be canceled as pecuniary consideration into the Special Account of the National Parks Fund number 41220-5 of the Banco Nacional de Costa Rica, in accordance with the provisions of articles 35 and 41 of the Biodiversity Law.

The permittee must inform the Institutional Communication Department (DECI) of MINAE and the corresponding Conservation Area of the hours and days on which the SMS messages will be disseminated. The material may be changed at the time MINAE deems it necessary or pertinent, and may request the repetition of any space that has already been disseminated, if deemed necessary.

"Artículo 16 BIS. Modalidades de cancelación de la contraprestación pecuniaria.

El monto anual de la contraprestación pecuniaria podrá ser cancelado en especie mediante espacios o pautas publicitarias en los medios de comunicación de radio, televisión, redes sociales y páginas corporativas, o anualmente en la fecha de cumplimiento de emisión del permiso, el permisionario deberá? depositar, el monto a cancelar como contraprestación pecuniaria, en la Cuenta Especial del Fondo de Parques Nacionales número 41220-5 del Banco Nacional de Costa Rica, conforme con lo dispuesto en los artículos 35 y 41 de la Ley de Biodiversidad.

Los espacios que se difundirán deben contar con el visto bueno del Departamento de Comunicación Institucional del MINAE (DECI), quien coordinará con el Área de Conservación del Sistema Nacional de Áreas de Conservación (SINAC), lo pertinente y estarán dirigidos a divulgar información relacionada con los sectores de Ambiente y Energía, de la siguiente forma:

1 Transmitir durante las horas de mayor audiencia, cuatro cuñas al día de treinta segundos cada una.

2 Transmitir una vez a la semana, un programa de quince minutos, el día y hora que conjuntamente con el MINAE se determine. Este programa puede ser fraccionado de mutuo acuerdo, siempre y cuando se cumpla con el tiempo antes señalado.

3 Facilitar sin costo alguno, el monitoreo de los espacios al aire de MINAE, la grabación y copiado de cuñas y programas de las radioemisoras y del MINAE, útiles para los programas de educación ambiental del Ministerio.

4 Prestar sin costo alguno, equipo de edición y sus operadores hasta por seis horas al mes, para que el MINAE edite materiales que serán utilizados tanto en las cuñas como en los programas semanales de quince minutos.

El permisionario deberá informar al Departamento de Comunicación Institucional (DECI) del MINAE y al Área de Conservación correspondiente, las horas y días en que va a pautar las cuñas o programas. El material podrá cambiarse en el momento en que el MINAE lo considere necesario, o pertinente y puede solicitar la repetición de algún espacio que ya se hubiese difundido; en caso de considerarlo necesario.

En caso de incumplimiento de pago en especie, o pago por canje en espacios al aire, el DECI informará al Área de Conservación pertinente para que se tomen las medidas administrativas correspondientes, las cuales son el envío de una notificación de advertencia escrita y en un segundo acto, la suspensión del Permiso de Uso para la Instalación de Infraestructura de Telecomunicaciones en Áreas Silvestres Protegidas y Patrimonio Natural del Estado Administradas por el Sistema Nacional de Áreas de Conservación.

Los puestos de radiocomunicación privada podrán cancelar el monto anual de la contraprestación pecuniaria, por medio del pago en especie por mensajes SMS en temas ambientales, previa coordinación con el Departamento de Comunicación Institucional de MINAE y el Área de Conservación correspondiente, o anualmente en la fecha de cumplimiento de emisión del permiso, el permisionario deberá? depositar el monto a cancelar como contraprestación pecuniaria, en la Cuenta Especial del Fondo de Parques Nacionales número 41220-5 del Banco Nacional de Costa Rica, conforme con lo dispuesto en los artículos 35 y 41 de la Ley de Biodiversidad.

El permisionario deberá informar al Departamento de Comunicación Institucional (DECI) del MINAE y al Área de Conservación correspondiente, las horas y días en que se van a difundir los SMS. El material podrá cambiarse en el momento en que el MINAE lo considere necesario, o pertinente y puede solicitar la repetición de algún espacio que ya se hubiese difundido; en caso de considerarlo necesario.

En caso de incumplimiento de pago en especie o pago por canje con SMS, el DECI informará al Área de Conservación pertinente, para que se tomen las medidas administrativas correspondientes, las cuales son: el envío de una advertencia escrita y en un segundo acto, la suspensión del Permiso de Uso para la Instalación de Infraestructura de Telecomunicaciones en Áreas Silvestres Protegidas y Patrimonio Natural del Estado Administradas por el Sistema Nacional de Áreas de Conservación.
