Anyone who directly or through an intermediary performs any of the following acts shall be punished with three months to one year of imprisonment:
- a)Causes harm to a domestic or domesticated animal, which results in a persistent weakening of its health or entails the loss of a sense, an organ, a limb, or renders it unable to use an organ or a limb, or causes it suffering or intense pain or prolonged agony.
- b)Performs sexual acts with animals. A sexual act shall be understood as sexual relations between a person and an animal, i.e., acts of penetration by oral, anal, or vaginal route.
- c)Practices vivisection of animals for purposes other than research.
A domestic animal shall be understood as any animal that, due to its evolutionary and behavioral characteristics, coexists with human beings. A domesticated animal shall be understood as any animal that, through human effort, has changed its wild condition.
The maximum sentence may be increased by one third when the perpetrator of these acts performs them by taking advantage of a relationship of power to intimidate, threaten, coerce, or subjugate one or more persons, as well as when the act is committed between two or more persons, or when it involves persons in management or administration positions, or who are legal representatives, workers, or owners of an establishment dedicated to the breeding, reproduction, and sale of companion animals.
Organizations duly registered in the Judicial Registry may represent the diffuse interests of the animals affected by the acts described in this norm.
It shall take effect upon its publication.
