in the entirety of the text - Complete Text of Regulation 194 Amendment to the Regulation for the Exercise of Subaquatic Sport Fishing (Agreement AJDIP/098-2017) COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/194-2024.-Puntarenas, on the thirtieth day of July, two thousand twenty-four.

1That through Board of Directors Agreement AJDIP/098-2017, the "Regulation for the Exercise of Subaquatic Fishing" was established, which regulates matters pertaining to the exercise of this activity throughout the national territory.
2That Article 4 of the referenced Agreement expressly indicates the following: "Incopesca shall authorize the practice of subaquatic sport fishing solely through the practice of apnea or free-diving sport diving. Subaquatic fishing using autonomous diving equipment such as oxygen tanks or semi-autonomous equipment such as compressors is not permitted."
3That through Agreement AJDIP/149-2024, a motion raised by Ms. Jeannette Pérez Blanco was accepted, through which it was requested to obtain scientific technical criteria on the possibility of modifying the wording of Article 4 of AJDIP/098-2017, in order to determine an exception to the prohibition of fishing by means of tank diving, to be applicable only to those tournaments destined for the fishing of Lionfish in the Costa Rican Caribbean.
4That through official letter INCOPESCA-DOPA-RHCA-060-2024, signed by Mr. Erick Umaña Vargas, Head of the Huetar Caribe Regional Office and endorsed by Mr. Miguel Durán Delgado, Director of Fisheries and Aquaculture Management, the requested scientific technical criteria is issued, in which it is noted that the lionfish (Pterois volitans) is famous for its voracious eating habits and high reproduction rate, and currently lives on the Caribbean coasts, thus representing a threat to commercially valuable marine species that inhabit the coasts of Limón such as lobsters, shrimp, and snappers.
5That likewise, it is highlighted that through Board of Directors Agreements AJDIP/280-2013 and AJDIP/051-2014, different fishing and commercialization activities are authorized with the objective of lowering, eradicating, and/or eliminating these populations of invasive species; additionally, Executive Decree No. 39627-MINAE-MAG-TUR creates a Management Commission for the Lionfish, where it is explicitly stated that the extraction activities of this species are indispensable and of public interest.
6That based on the arguments presented, a positive scientific technical criteria is issued regarding the proposal to amend Board of Directors Agreement AJDIP/098-2017, in order to determine an exception to the prohibition of fishing by means of tank diving, to be applicable only to those tournaments destined for the fishing of Lionfish in the Costa Rican Caribbean.
7That having duly analyzed the proposed amendment and considering it appropriate, the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture, Therefore;

AGREES 1º-To amend Article 4 of Board of Directors Agreement AJDIP/098-2017, based on scientific technical criteria INCOPESCA-DOPA-RHCA-060-2024, so that henceforth it reads as follows:

"Incopesca shall authorize the practice of subaquatic sport fishing solely through the practice of apnea or free-diving sport diving. Subaquatic fishing using autonomous diving equipment such as oxygen tanks or semi-autonomous equipment such as compressors is not permitted. Except in those fishing tournaments approved by INCOPESCA, destined for the fishing of Lionfish (Pterois volitans) in the Costa Rican Caribbean, where the use of diving with oxygen tanks is authorized." 2º-Final Agreement.

3º-Let it be published.

Considering:

en la totalidad del texto - Texto Completo Norma 194 Reforma Reglamento para el ejercicio de la pesca deportiva subacuática (acuerdo AJDIP/098-2017) INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/194-2024.-Puntarenas, a los treinta días del mes julio de dos mil veinticuatro.

1Que por medio del Acuerdo de Junta Directiva AJDIP/098-2017, se estableció el "Reglamento para el Ejercicio de la Pesca Subacuática", mismo que regula lo atinente al ejercicio de esta actividad a lo largo del territorio nacional.
2Que en el Artículo 4 del Acuerdo de referencia se indica expresamente lo siguiente: "El Incopesca, autorizará la práctica de la pesca deportiva subacuática, únicamente mediante la práctica de buceo deportivo de apnea o pulmón. No se permite la pesca subacuática utilizando equipos autónomos de buceo como tanques de oxígeno o equipos semiautónomos como compresores."
3Que por medio de Acuerdo AJDIP/149-2024, se acoge moción planteada por parte de la señora Jeannette Pérez Blanco, por medio de la cual se solicita contar con criterio técnico científico sobre la posibilidad de modificar la redacción del Artículo 4 del AJDIP/098-2017, con el fin de determinar una excepción a la prohibición de pesca por medio de buceo con tanque, a ser aplicable únicamente para aquellos torneos destinados a la pesca del Pez León en el Caribe costarricense.
4Que por medio de oficio INCOPESCA-DOPA-RHCA-060-2024, suscrito por el señor Erick Umaña Vargas, Jefe de la Oficina Regional Huetar Caribe y avalado por el señor Miguel Durán Delgado, Director de Ordenamiento Pesquero y Acuícola, se emite el criterio técnico científico solicitado, en el que se señala que el pez león (Pterois volitans), es famoso por sus voraces hábitos alimenticios y alta reproducción, actualmente vive en las costas del Caribe por lo que representa una amenaza para las especies marinas de valor comercial que habitan las costas de Limón tales como langostas, camarones y pargos.
5Que asimismo, se resalta que por medio de los Acuerdos de Junta Directiva AJDIP/280-2013 y AJDIP/051-2014, se autoriza diferentes actividades de pesca y comercialización con el objetivo de bajar, erradicar y/o eliminar estas poblaciones de especies invasoras, además el Decreto Ejecutivo Nº 39627-MINAE-MAG-TUR, crea una Comisión de Manejo para el Pez León, donde

indispensables y de interés público.

6Que en base a los argumentos expuestos, se emite criterio técnico científico positivo a la propuesta de modificación del Acuerdo de Junta Directiva AJDIP/098-2017, con el fin de determinar una excepción a la prohibición de pesca por medio de buceo con tanque, a ser aplicable únicamente para aquellos torneos destinados a la pesca del Pez León en el Caribe costarricense.
7Que debidamente analizada la modificación propuesta y por considerarla procedente, la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, Por tanto;

ACUERDA 1º-Modificar el Artículo 4 del Acuerdo de Junta Directiva AJDIP/098-2017, en base al criterio técnico científico INCOPESCA-DOPA-RHCA-060-2024, para que en lo sucesivo se lea de la siguiente manera:

"El Incopesca, autorizará la práctica de la pesca deportiva subacuática, únicamente mediante la práctica de buceo deportivo de apnea o pulmón. No se permite la pesca subacuática utilizando equipos autónomos de buceo como tanques de oxígeno o equipos semiautónomos como compresores. Excepto en aquellos torneos de pesca aprobados por el INCOPESCA, destinados a la pesca del Pez León (Pterois volitans) en el Caribe costarricense, donde se autoriza el uso de buceo con tanques de oxígeno." 2º-Acuerdo Firme.

3º-Publíquese.
