in the entirety of the text - Complete Text of Norma 44564 The metallic mining moratorium is declared and the metallic reserve areas are frozen in favor of the State in the District of Cutris, Canton of San Carlos, Province of Alajuela No. 44564-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In use of the powers conferred by articles 50, 140 subsections 3), 18) and 146 of the Political Constitution; articles 27 subsection 1) and 28 subsection 2) paragraph b) of the General Law of Public Administration No. 6227 of May 2, 1978; and articles 1 and 3 of the Mining Code, Law No. 6797 of October 4, 1982.

1. That the State has absolute, inalienable, and imprescriptible dominion over all mineral resources existing in the national territory and in its patrimonial sea, whatever the origin, physical state, or nature of the substances they contain.

2. That the general utilization of mineral resources is a task of the State, and the Ministry of Environment and Energy is responsible for planning policies related to natural, energy, mining, and environmental protection resources; as well as direction, oversight, and control; therefore, ensuring environmental balance for the benefit of the communities of the district of Cutris, Canton of San Carlos, in the Province of Alajuela, is of national interest.

3. That the problem of illegal gold exploitation in the Crucitas area began in the year 2017, which has caused illegal extraction of mining material, invasion of farms, damage to water bodies, excavation of riverbeds, widening of watercourses, as well as contamination by sediments from the use of hazardous, highly polluting substances such as cyanide and mercury, generating environmental impacts and a decrease in the mining reserves found in the subsoil, the dominion of which belongs to the State.

4. That it is in the interest of the State to safeguard the mining resources in the District of Cutris of the Canton of San Carlos, of the Province of Alajuela with the sound purpose of looking after the interests of the Nation.

5. That, in accordance with the Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree No. 37045-MP-MEIC and its amendments, it was determined that this proposal does not establish or modify procedures, requirements, or processes that the administered party must comply with, a situation for which the prior control procedure or Regulatory Improvement process was not carried out.

THEY DECREE:

THE METALLIC MINING MORATORIUM IS DECLARED AND THE METALLIC RESERVE AREAS ARE FROZEN IN FAVOR OF THE STATE IN THE DISTRICT OF CUTRIS, CANTON OF SAN CARLOS, PROVINCE OF ALAJUELA Article One. The moratorium on metallic mining, in any modality, is declared, and the metallic reserve areas are frozen in favor of the State, in the District of Cutris, of the Canton of San Carlos, Province of Alajuela for a term of twelve (12) months, automatically renewable, starting from the signing of this provision.

Article Two. This moratorium includes all metallic mining reserve areas located in the District of Cutris, of the Canton of San Carlos, Province of Alajuela.

Article Three. The Executive Branch shall not grant exploration permits or exploitation concessions for metallic mining activities, in any modality, until a comprehensive plan for the sustainable use of the metallic mining resource has been prepared, to ensure that mining development contributes to increasing national social, environmental, economic, and political balance. This balance must primarily occur for the benefit of guaranteeing that mining activity is developed in total harmony with the environment and the economic development of the country.

Article Four. The Ministry of Environment and Energy shall proceed, through the Directorate of Geology and Mines, to execute the provisions of article three of this Executive Decree, and the provisions of Executive Decree No. 34492-MINAE in effect since June 4, 2008, in order to order and ensure compliance with the following provisions: 3.6. Coordinate with the Public Ministry the process of complaints for illegal extraction of materials. 3.7. Train the Public Force regarding illegal mining, in order to prevent the illegal practice in the country and 3.8. Coordinate with the National Environmental Technical Secretariat and the Administrative Tribunal, with the purpose of strengthening the control phase and the weakening of illegal mining.

Article Five. It shall take effect upon its publication.

CONSIDERING:

THEREFORE,

en la totalidad del texto - Texto Completo Norma 44564 Se declara la moratoria de minería metálica y se congelan las áreas reserva metálica a favor del Estado en el Distrito de Cutris, Cantón de San Carlos Provincia de Alajuela N° 44564-MINAE EL PRESIDENTE DE LA REPUBLICA Y EL MINISTRO DE AMBIENTE Y ENERGIA En uso de las facultades que les confieren los artículos 50, 140 incisos 3), 18) y 146 de la Constitución Política; artículos 27 inciso 1) y 28 inciso 2) acápite b) de la Ley General de la Administración Pública No. 6227 del 2 de mayo de 1978; y el artículo 1 y 3 del Código de Minería, Ley No. 6797 del 4 de octubre de 1982.

1º. Que el Estado tiene el dominio absoluto, inalienable e imprescriptible de todos los recursos minerales que existen en el territorio nacional y en su mar patrimonial, cualquiera que sea el origen, estado físico o naturaleza de las sustancias que contengan.

2º. Que el aprovechamiento general de los recursos minerales es tarea del Estado, y le corresponde al Ministerio de Ambiente y Energía la planificación de las políticas relacionadas con los recursos naturales, energéticos, mineros y de protección al ambiente; así como la dirección, la vigilancia y el control; por lo que asegurar el equilibrio ambiental en beneficio de las comunidades del distrito de Cutris, Cantón de San Carlos, en la Provincia de Alajuela, es de interés nacional.

3º. Que la problemática de 2017, lo que ha provocado extracciones ilegales de material minero, invasión de fincas, daño a los cuerpos de agua, excavaciones de lechos, ampliaciones de los cursos de agua, así como en contaminación por sedimentos provenientes de la utilización de sustancias peligrosas, altamente contaminantes como el cianuro y el mercurio, generando afectaciones ambientales y disminución en la reservas mineras que se encuentran en el subsuelo, las cuales pertenecen en su dominio al Estado.

4° Que es de interés del Estado resguardar los recursos mineros en el Distrito de Cutris del Cantón de San Carlos, de la Provincia de Alajuela con el sano propósito velar por los intereses de la Nación.

5°. Que, de conformidad con el Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo No. 37045-MP-MEIC y sus reformas, se determinó que la presente propuesta no establece ni modifica trámites, requisitos o procedimientos, que el administrado deba cumplir, situación por la que no se procedió con el trámite de control previo ni de Mejora Regulatoria.

SE DECLARA LA MORATORIA DE MINERIA METALICA Y SE CONGELAN LAS ÁREAS RESERVA MÉTALICA A FAVOR DEL ESTADO EN EL DISTRITO DE CUTRIS, CANTÓN DE SAN CARLOS, PROVINCIA DE ALAJUELA Artículo Primero. Se declara la moratoria de minera metálica, en cualquier modalidad, y se congelan las áreas de reserva metálica a favor del Estado, en el Distrito de Cutris, del Cantón de San Carlos, Provincia de Alajuela por el plazo de doce (12) meses, prorrogables automáticamente, a partir de la firma de esta disposición.

Artículo Segundo. Esta moratoria incluye todas las áreas de reserva de minería metálica que se encuentren en el Distrito de Cutris, del Cantón de San Carlos, Provincia de Alajuela.

Artículo Tercero. El Poder Ejecutivo no otorgará permisos de exploración, ni concesiones de explotación para actividades de minería metálica, en cualquier modalidad, hasta contar con la elaboración de un plan integral de uso sostenible del recurso minero metálico, para asegurar que el desarrollo minero contribuya a incrementar el equilibrio social, ambiental, económico y político nacional. Equilibrio que debe darse principalmente en beneficio de garantizar que la actividad minera se desarrolle en total armonía con el ambiente y el desarrollo económico del país.

Artículo Cuarto. Proceda el Ministerio de Ambiente y Energía, por medio de la Dirección de Geología y Minas, a ejecutar lo dispuesto en el artículo tercero del presente Decreto Ejecutivo, y lo establecido en el Decreto Ejecutivo No. 34492-MINAE que rige desde 04 de junio 2008, a efecto de ordenar y velar por el cumplimiento de las siguientes disposiciones: 3.6. Coordinar con Ministerio Público el proceso de denuncias por extracción ilegal de materiales. 3.7. Capacitar a la Fuerza Pública en lo relativo a minería ilegal, con el fin de evitar la práctica ilegal en el país y 3.8. Coordinar con la Secretaría Técnica Nacional Ambiental y el Tribunal Administrativo, con el propósito de fortalecer la fase de control y el debilitamiento de la minería ilegal.
