in the entirety of the text - Complete Text of Norm 162 Repeals Transitorio II of the Regulations for the monitoring, control, and surveillance of fishing vessels of the national and foreign fleets (AJDIP/076-2022 and agreements No. AJDIP/116-2023 and AJDIP/312-2023) INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/162-2024.-Puntarenas, on the second day of July, two thousand twenty-four.

1. 1That by means of Agreement AJDIP/312-2023 of December 12, 2023, in its operative part, the Board of Directors agreed: "1- To approve the recommended extension request and modify the Board of Directors agreement AJDIP/076-2022, in its Transitorio II, so that henceforth it reads as follows: Transitorio II: "For medium-scale Sport and Tourist Fishing vessels, these regulations shall be applicable as of July 1, 2024".

2-To render without effect Board of Directors Agreement AJDIP/116-2023.

3-To request from the working Commission established for monitoring the matter, the submission of alternative text for exclusive regulations for sport and tourist fishing no later than the month of March 2024".

1. 2That to date it has not been possible to have a clear, effective, and participatory proposal that defines the conditions and scope of the text to be incorporated into Agreement AJDIP/077-2020, "Regulations for the monitoring, control, and surveillance of fishing vessels of the national and foreign fleets"; or failing that, as has been proposed by the Legal Advisory Office, the Directorate of Fisheries and Aquaculture Management, and in part the tourist-sport fishing sector, the creation of new exclusive regulations for that activity that include the mandatory requirement of having a location, monitoring, and control system for medium-scale fishing vessels belonging to that sector.
2. 3That while it is true, time has elapsed more than sufficiently, and for the reasons stated, it has not been feasible from within the Administration to unilaterally develop a reasonable, balanced, and fair proposal, in accordance with the line of action that has prevailed in the conduct of this Administration towards the various productive sectors.
3. 4That due to the conditions and arguments indicated above, and given that this Board of Directors is faced with the dichotomy of the entry into force of Transitorio II of Agreement AJDIP/312-2023 and the effective reality of not having sufficient elements to define an adequate text in accordance with the reality of the medium-scale tourist-sport fishing sector; in order to safeguard institutional interests, particularly those of that national productive sector, it is pertinent to repeal Transitorio II of Agreement AJDIP/076-2022 and its amendment contained in Agreement AJDIP/312-2023; as well as any other that opposes it.
4. 5That having duly considered the arguments cited in the preceding recitals, once the proposed motion was discussed and analyzed, the Board of Directors of the Instituto Costarricense de Pesca y Acuicultura, Therefore;

AGREES:

1º-To repeal Transitorio II of Agreement AJDIP/076-2022, as well as its amendments contained in Agreement AJDIP/116-2023, and any other that opposes it. Likewise, Agreement AJDIP/312-2023 is repealed.

2º-Final Agreement. Effective upon its adoption.

3º-To be published.

Considering:

en la totalidad del texto - Texto Completo Norma 162 Deroga el transitorio II del Reglamento para el seguimiento, control y vigilancia de embarcaciones pesqueras de las flotas nacional y extranjera (AJDIP/076-2022 y acuerdos N° AJDIP/116-2023 y AJDIP/312-2023 INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/162-2024.-Puntarenas, a los dos días del mes julio de dos mil veinticuatro.

1. 1Que por medio del Acuerdo AJDIP/312-2023 del 12 de diciembre de 2023, en su parte dispositiva, la Junta Directiva acordó: "1- Aprobar la solicitud de prórroga recomendada y modificar el acuerdo de Junta Directiva AJDIP/076-2022, en su Transitorio II, para que en lo sucesivo se lea de la siguiente manera: Transitorio II: "Para las embarcaciones de Pesca Deportiva y Turística de mediana escala, el presente reglamento será aplicable a partir del 01 de julio del año 2024".

2-Dejar sin efecto el Acuerdo de Junta Directiva AJDIP/116-2023.

3-Solicitar a la Comisión de trabajo instaurada para el seguimiento del tema, la presentación del texto alternativo de reglamentación exclusiva para la pesca deportiva y turística a más tardar en el mes de marzo del año 2024".

1. 2Que a la fecha no ha sido posible contar con una propuesta clara, efectiva y participativa que venga a definir las condiciones y alcances del texto que se quiere incorporar al Acuerdo AJDIP/077-2020, "Reglamento para el seguimiento, control y vigilancia de embarcaciones pesqueras de las flotas nacional y extranjera"; o si en su defecto, tal y como lo han planteado desde la Asesoría Jurídica, la Dirección de Ordenamiento Pesquero y Acuícola y en parte el sector de pesca turística-deportiva, la creación de una nueva reglamentación exclusiva para esa actividad que contemple la obligatoriedad de contar con un sistema de localización, seguimiento y control para las embarcaciones pesqueras de mediana escala pertenecientes a ese sector.
2. 3Que si bien es cierto, ha transcurrido de manera sobrada el tiempo, y por las razones señaladas no ha sido factible desde el seno de la Administración, desarrollar de manera unilateral una propuesta razonable, equilibrada y justa, en concordancia con la línea de acción que ha imperado en el actuar de la presente Administración, para con los diversos sectores productivos.
3. 4Que por las condiciones y argumentaciones supra indicadas y siendo que se encuentra esta Junta Directiva ante la dicotomía de la entrada en vigencia del transitorio II del Acuerdo AJDIP/312-2023 y la efectiva realidad de no contar con los elementos suficientes para delimitar un texto adecuado conforme a la realidad del sector pesquero turístico deportivo de mediana escala; en aras de salvaguardar los intereses institucionales particularmente de ese sector productivo nacional, resulta pertinente derogar el Transitorio II del Acuerdo AJDIP/076-2022 y su reforma contenida en el Acuerdo AJDIP/312-2023; así como cualquier otro que se le oponga.
4. 5Que debidamente valoradas las argumentaciones citadas en los considerandos precedentes, una vez discutida y analizada la propuesta planteada, la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, Por tanto;

ACUERDA:

1º-Derogar el Transitorio II del Acuerdo AJDIP/076- 2022, así como sus reformas contenidas en el Acuerdo AJDIP/116-2023, y cualquier otro que se le oponga. De igual manera se deroga el Acuerdo AJDIP/312-2023.

2º-Acuerdo Firme. Rige a partir de su adopción.

3º-Publíquese.
