in the entirety of the text - Complete Text of Norm 44506 Repeals the Declaration of Public Utility for the interests of the State of the Asociación Planta Recicladora de Basura de Barra del Tortuguero de Pococi No. 44506-MJP THE PRESIDENT OF THE REPUBLIC, AND THE MINISTER OF JUSTICE AND PEACE Pursuant to the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Law of Associations No. 218 of August 8, 1939 Associations No. 29496-J, published in La Gaceta No. 96 of May 21, 2001, articles 25, subsection 1) and 28, subsection 2), items a) and b) of the General Law of Public Administration, as well as the provisions of article 3, subsection ch) of the Income Tax Law No. 7092 and articles 103 and 104 of the Code of Tax Norms and Procedures No. 4755.
I.-That article 32 of the Law of Associations No. 218 of August 8, 1939 and its amendments, grants the Executive Branch the power to declare of public utility simple, federated, or confederated associations, whose development and activities are particularly useful for the interests of the State, and which therefore contribute to solving a social need.
II.-That the Asociación Planta Recicladora de Basura de Barra del Tortuguero de Pococí, legal identification number three-zero zero two- five hundred one thousand four hundred twenty-eight, was registered in the Associations Registry of the Public Registry on September sixth, two thousand seven, at volume 571, entry 1731. Likewise, said entity was declared of public utility through Executive Decree No. 37234-JP of June fifteenth, two thousand twelve.
III.-That article 32 of the Regulations to the Law of Associations establishes: "At any time, the Ministry of Justice and Peace, shall revoke this benefit, if the reasons for which it was granted disappear. (...)". Likewise, numeral 32 of the Regulations to the Law of Associations, adds: "(...) The declaration shall be revocable at any time, by means of a reasoned resolution..." I.-Que el artículo 32 de la Ley de Asociaciones N° 218 del 08 de agosto de 1939 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.
II.-Que la Asociación Planta Recicladora de Basura de Barra del Tortuguero de Pococí, cédula jurídica número tres-cero cero dos- quinientos un mil cuatrocientos veintiocho, se inscribió en el Registro de Asociaciones del Registro Público el seis de setiembre del dos mil siete, al tomo 571, asiento 1731. Asimismo, dicha entidad fue declarada de utilidad pública mediante el Decreto Ejecutivo N° 37234-JP del quince de junio de dos mil doce.
III.-Que el artículo 32 del Reglamento a la Ley de Asociaciones establece: ".En cualquier momento, el Ministerio de Justicia y Paz, revocará este beneficio, si desaparecen los motivos por los cuales fue concedido. (...) ". Asimismo, el ordinal 32 del Reglamento a la Ley de Asociaciones, agrega: "(...) La declaratoria será revocable en cualquier momento, mediante resolución razonada..." IV.-Que la asociación Planta Recicladora de Basura de Barra del Tortuguero de Pococí, cédula jurídica número tres-cero cero dos- quinientos un mil cuatrocientos veintiocho, por medio de su representante legal el señor Rafael Enrique Obando Vargas, cédula 1-0388-0245, incumplió con la presentación del informe anual de labores correspondiente al año 2022 y no se presentaron elementos de valor que permitan justificar dichos incumplimientos.
