I.—That by Law No. 8710, published in La Gaceta No. 48 of March 10, 2009, article 2 of Law No. 5695, Law Creating the National Registry, published in the Official Gazette La Gaceta No. 106 of June 7, 1975, and its reforms, is amended, indicating that the National Cadastre becomes part of the Real Property Registry (Registro Inmobiliario).
II.—That Executive Decree No. 35509-J of September 30, 2009, Regulation of Organization of the Real Property Registry, published in the Official Gazette La Gaceta No. 198 of October 13, 2009, establishes that the Real Property Registry is composed of the Cadastral Subdirectorate (Subdirección Catastral) and the Registry Subdirectorate (Subdirección Registral).
III.—That the Real Property Registry of the National Registry, based on the National Cadastre Law No. 6545 of March 25, 1981, published in the Official Gazette La Gaceta No. 73 of April 15, 1981, in its article 13, has the exclusive power to execute and maintain the Cadastre, a function that it may partially delegate to other state institutions.
IV.—That the Legislative Assembly, on November 27, 2001, approved Law No. 8154, "Loan Agreement No. 1284/OC-CR, Cadastre and Registry Regularization Program (Programa de Regularización del Catastro y Registro)," signed between the Government of the Republic and the Inter-American Development Bank (IDB), published in the Official Gazette La Gaceta No. 237 of December 10, 2001, for the execution of the Cadastre and National Registry Regularization Program, which, by provision of the same law, is under the charge of an Executing Unit assigned to the Ministry of Finance as a deconcentrated body.
V.—That the Cadastre and National Registry Regularization Program had the task of cadastral surveying with the objective of forming the national cadastre and making the cadastral and registry information of properties compatible, in application of the provisions of the Cadastre Law No. 6545 of March 25, 1981, published in the Official Gazette La Gaceta No. 73 on April 15, 1981, a function that concluded on May 7, 2014.
VI.—That in accordance with the provisions of article 1 of Executive Decree No. 30106-J, "Declares a Cadastral Zone the Entirety of the Cantons of the National Territory," published in La Gaceta No. 19 of January 28, 2002, and article 7 of the Regulation to the National Cadastre Law, Executive Decree No. 34331, published in the Official Gazette La Gaceta No. 41 of February 27, 2008, which has been in effect since September 27, 2008, the entirety of the cantons of the national territory were declared a cadastral zone (zona catastral).
VII.—That the Regulation to the National Cadastre Law, Executive Decree No. 34331, which has been in effect since September 27, 2008, and which was published in the Official Gazette La Gaceta No. 41 of February 27, 2008, establishes the technical requirements for the preparation of survey plans (planos de agrimensura).
VIII.—That because the cadastral surveying work of Canton 01 San José, District 11 San Sebastián, Province 01 San José, has concluded, and in accordance with the provisions of article 19 of the National Cadastre Law and article 10 of its regulation, the property titleholders of said district were invited to a public exhibition to know the results of the survey and express their conformity or non-conformity, an exhibition that was held from October 10 to 17, 2023.
IX.—That the invitation to the public exhibition of the results of the cadastral survey of Canton 01 San José, District 11 San Sebastián, Province 01 San José, was published in the Official Gazette La Gaceta No. 184, of October 6, 2023, page 105, and in the nationally circulated newspapers La Teja on October 8, 2023, page 7, and La Nación on October 10, 2023, page 11.
X.—That in a resolution at ten hours thirty minutes on March 6, two thousand twenty-four, the Real Property Registry of the National Registry declared firm the cadastral data resulting from the cadastral survey carried out in Canton 01 San José, District 11 San Sebastián, Province 01 San José.
XI.—That the terms of the deadlines established in article 20 of the National Cadastre Law have already elapsed, and the claims presented by the owners were resolved by the Directorate of the Real Property Registry of the National Registry.
DISTRICT 11 SAN SEBASTIAN IS DECLARED A CATASTRAL ZONE, CANTON 01 SAN JOSE, PROVINCE 01 SAN JOSE.

I.-Que mediante Ley Nº 8710, publicada en La Gaceta Nº 48 del 10 de marzo de 2009 se reforma el artículo 2 de la Ley Nº 5695, Ley de Creación del Registro Nacional, ·publicada en el Diario Oficial La Gaceta No. 106 del 07 de junio de 1975 y sus reformas, indicando que el Catastro Nacional pasa a formar parte del Registro Inmobiliario.
II.-Que el Decreto Ejecutivo Nº 35509-J de 30 de setiembre de 2009, Reglamento de Organización del Registro Inmobiliario publicado en el Diario Oficial La Gaceta Nº 198 del 13 de octubre de 2009, establece que el Registro Inmobiliario está conformado por la Subdirección Catastral y la Subdirección Registral.
III.-Que el Registro Inmobiliario del Registro Nacional, con fundamento en la Ley de Catastro Nacional Nº 6545 de 25 de marzo de 1981, publicada en el Diario Oficial La Gaceta No. 73 del 15 de abril de 1981 en su artículo 13 tiene como potestad exclusiva, la ejecución y mantenimiento del Catastro, función que puede delegar parcialmente en otras instituciones estatales.
IV.-Que la Asamblea Legislativa, el 27 de noviembre de 2001, aprobó la Ley Nº 8154, "Convenio de Préstamo Nº 1284/OC-CR, Programa de Regularización del Catastro y Registro", suscrito entre el Gobierno de la República· y el Banco Interamericano de Desarrollo (BID), publicada en el Diario Oficial La Gaceta No. 237 del 10 de diciembre del 2001 para la ejecución del Programa de Regularización del Catastro y Registro Nacional, que por disposición de la misma ley, está a cargo de una Unidad Ejecutora adscrita al Ministerio de Hacienda como órgano desconcentrado.
V.-Que el Programa de Regularización del Catastro y Registro Nacional, tuvo como tarea el levantamiento catastral con el objetivo de formar el catastro nacional y compatibilizar la información catastral y registra! de los inmuebles, en aplicación de lo que dispone la Ley de Catastro Nº 6545 de 25 de marzo de 1981 publicada en el Diario Oficial La Gaceta No. 73 el 15 de abril de 1981, función que culminó el 07 de mayo de 2014.
VI .-Que de conformidad con lo que establece el artículo 1 ° Decreto Ejecutivo N º 30106-J donde se "Declara Zona Catastral la Totalidad de los Cantones del Territorio Nacional" publicado en La Gaceta Nº 19 de 28 de enero de 2002 y el artículo 7 del Reglamento a la Ley del Catastro Nacional, Decreto Ejecutivo Nº 34331, publicado en el Diario Oficial La Gaceta No. 41 del 27 de febrero del 2008 el cual rige desde el 27 de setiembre de 2008, la totalidad de los cantones del territorio nacional fueron declarados zona catastral.
VII .-Que el Reglamento a la Ley de Catastro Nacional, Decreto Ejecutivo Nº 34331 el cual rige desde el 27 de setiembre de 2008 y que fue publicado en el Diario Oficial La Gaceta No. 41 del 27 de febrero del 2008, establece los requerimientos técnicos para el levantamiento de planos de agrimensura.
VIII.-Que por haber concluido los trabajos de levantamiento catastral del Cantón 01 San José, Distrito 11 San Sebastián, Provincia 01 San José, y de conformidad con lo que establece el artículo 19 de la Ley de Catastro Nacional y 10 de su reglamento, fueron invitados los titulares de inmuebles de dicho distrito a una exposición pública para conocer los resultados del levantamiento y manifestar su conformidad o disconformidad, exposición que se llevó a cabo del 10 al 17 de octubre del 2023.
IX.-Que la invitación a la exposición pública de los resultados del levantamiento catastral del Cantón 01 San José, Distrito 11 San Sebastián, Provincia 01 San José, fue publicada en el Diario Oficial La Gaceta# 184, del 6 de octubre del 2023, página 105 y en los diarios de Circulación Nacional La Teja de 08 de octubre del 2023, página 7 y La Nación de 10 de octubre del 2023, página 11.
X.-Que en resolución de las diez horas treinta minutos del seis de marzo del año dos mil veinticuatro, el Registro Inmobiliario del Registro Nacional declaró firmes los datos catastrales resultantes del levantamiento catastral efectuado en el Cantón 01 San José, Distrito 11 San Sebastián, Provincia 01 San José.
XI.-Que ya transcurrieron los términos de los plazos establecidos en el artículo 20 de la Ley del Catastro Nacional y fueron resueltos, por la Dirección del Registro Inmobiliario del Registro Nacional, los reclamos presentados por los propietarios.
SE DECLA RA ZONA CATASTRADA EL DISTRITO 11 SAN SEBASTIAN, CANTÓN 01 SAN JOSE, PROVINCIA 01 SAN JOSE.
