in the entirety of the text - Complete Text of Norm 002 Delimitation of the public zone corresponding to a mangrove sector on Esterillos Centro Beach, district 01 Parrita, Canton 09 Parrita, province 06 Puntarenas NATIONAL GEOGRAPHIC INSTITUTE DEPARTMENT OF GEODESY AND GEOPHYSICS NOTICE No. 002-2024 MARITIME TERRESTRIAL ZONE DELIMITATION OF THE PUBLIC ZONE CORRESPONDING TO A SECTOR OF MANGROVE ON ESTERILLOS CENTRO BEACH, DISTRICT 01 PARRITA, CANTON 09 PARRITA, PROVINCE 06 PUNTARENAS Pursuant to the provisions of articles 140 and 240 of Law No. 6227 General Public Administration Law of May 2, 1978, and its amendments; Law No. 59 Law on the Creation and Organization of the National Geographic Institute of July 4, 1944, and its amendments; Law No. 8905 Reform of article 2 of Law No. 5695, Creation of the National Registry, and its amendments; and modification of Law No. 59, Creation and Organization of the National Geographic Institute, of July 4, 1944, and its amendments, dated December 7, 2010; Law No. 6043 Law on the Maritime Terrestrial Zone of March 2, 1977, with its respective regulation; and articles 2 and 3 of Law No. 5695 Law on the Creation of the National Registry of May 28, 1975, and its amendments.

1. 1That by means of Law No. 8905, the National Geographic Institute, hereinafter IGN, was established as a dependency of the National Registry, which shall sign the contracts and agreements necessary for the exercise of its functions. Likewise, in accordance with article 1 of Law No. 59, the IGN is "the scientific and technical dependency governing national cartography, destined for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and for studies, research or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes."
2. 2That Law No. 59 constitutes the IGN permanently and in representation of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any nature originating from the works entrusted to its charge.
3. 3That in accordance with the provisions of Law No. 59, article 62 of Executive Decree No. 7841-P Regulation to the Law on the Maritime Terrestrial Zone of December 16, 1977, and its amendments, the competence of the IGN is recognized for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta; likewise, article 63 of Executive Decree No. 7841-P states that "The National Geographic Institute must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone."
4. 4That Executive Decree No. 36642-MP-MOPTMINAET Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone of June 28, 2011, establishes according to article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or digital georeferenced delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.
5. 5That in Executive Decree No. 33797-MJ-MOPT Declaring CR05 as the official horizontal datum for Costa Rica, linked to the International Terrestrial Reference Frame (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83 of March 30, 2007, among other aspects, it determines the National Horizontal Reference Geodetic Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically indicating in article 11 that: "The National Horizontal Reference Geodetic Network CR05 and the CRTM05 cartographic projection system, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed in the National Territory by any public dependency, national or foreign private person or entity, must be referenced."; while article 7 provides that "As cartographic data are produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish by adequate means that information which has been officialized."
6. 6That Executive Decree No. 40962-MJP Update of the Official Horizontal Geodetic Reference System for Costa Rica declares in its article 1 that "The official horizontal geodetic reference system for Costa Rica, denominated CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Frame ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, the changes and its update shall be governed according to the new definitions of the ITRF implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) denominated SIRGAS-CON"; in addition, article 2 establishes that "The CRTM05 cartographic projection system shall continue to be the official one for the cartographic representation of the continental national territory, extended for purposes of the application of this cartographic projection, up to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this line defined in accordance with articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for computing the maximum width of all jurisdictional marine areas of the Costa Rican State."

For its part, article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which references must be made in the continental territory of our country, by stating that "The horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended to the baseline of the territorial sea and, the 'Universal Transverse Mercator' (UTM) cartographic projection, zones 16 and 17 for jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed in the national territory by any public dependency, national or foreign private person or entity, that undertake or contract geodetic and cartographic works, must be referenced, thereby contributing to avoiding public expenditure and obtaining, on the other hand, reliable, uniform, and comparable geographic information, which is of general utility and supports decision-making at the different levels of the State."

1. 7That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of the elaboration of regulatory plans, the approval of survey plans, the granting of concessions in the Restricted Zone, and other aspects of coastal territorial planning.
2. 8That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).
3. 9That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P Regulation to Law No. 6043 on the Maritime Terrestrial Zone; b) Executive Decree No. 33797-MJMOPT Declaring CR05 as the official horizontal datum for Costa Rica, and its associated cartographic projection, CRTM05; c) Executive Decree No. 36642-MP-MOPT-MINAET Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone; and d) Executive Decree No. 40962-MJP Update of the Official Horizontal Geodetic Reference System for Costa Rica.

10.-That article 16 of Law No. 7575 Forestry Law of February 13, 1996, and its amendments, establishes that the Ministry of Environment and Energy (MINAE) shall delimit on the ground the boundaries of the areas that constitute the Natural Heritage of the State.

11.-That article 11 of Chapter I General Provisions of Law No. 6043 establishes that the "Public zone is also, whatever its extension, that occupied by all the mangroves of the continental and insular coastlines and estuaries (esteros) of the national territory." 12.-That Executive Decree No. 36786-MINAET Manual for the classification of lands dedicated to the conservation of natural resources within the Maritime Terrestrial Zone in Costa Rica of August 12, 2011, establishes among its objectives "To identify within the Maritime Terrestrial Zone those lands that classify as forests, of forest aptitude (Class VII and VIII soils), wetlands (mangroves, estuaries (esteros), rías, salt marshes (marismas), coastal lagoons, swamps, flooded forests, salt flats (salitrales)), to certify them and incorporate them as part of the Natural Heritage of the State (PNE)." 13.-That Executive Decree No. 36786-MINAET in Point III.-Competencies for the delimitation and certification establishes that "The classification of lands within the ZMT shall correspond to the Conservation Areas (AC) of the National System of Conservation Areas (SINAC) and to private professionals duly accredited by the respective Professional Associations to classify forests, lands of forest aptitude (Class VII and VIII soils), (mangroves, estuaries (esteros), rías, salt marshes (marismas), coastal lagoons, swamps, flooded forests, salt flats (salitrales)) and wetlands.

The validity of the classification documents issued by private professionals shall be subject to the approval issued by the AC whose territorial competence corresponds. The ACs of SINAC with jurisdiction in the ZMT shall also be responsible for the verification, oversight, demarcation (deslinde), and certification of the lands of the Natural Heritage of the State and the protection zones.

The location and delimitation of the Natural Heritage of the State areas within the Maritime Terrestrial Zone must be carried out as part of the approval process of the Coastal Regulatory Plan (PRC), defined by Law 6043, since the Coastal Regulatory Plan is the territorial planning instrument that defines and locates all the zones to be concessioned within the ZMT and for their classification at the level of cadastral plans. Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the PNE areas so as not to count them in the total area to be concessioned." 14.-That the IGN used the Digital Delimitation methodology to delimit the public zone of the Maritime Terrestrial Zone corresponding to a mangrove sector of Esterillos Centro Beach, district 01 Parrita, canton 09 Parrita, province 06 Puntarenas.

15.-That the digital delimitation of a mangrove sector on Esterillos Centro Beach corresponds to the technical report presented by topographical engineer Oscar Corrales Segura and report SINAC-ACOPAC-PNMA-RBS-TT-072 dated October 26, 2023, from the Central Pacific Conservation Area (ACOPAC), to which approval is granted for the survey and delimitation carried out by the respective Conservation Area.

16.-That through official communication DIG-GDF-0012-2024 dated January 15, 2024, generated by the Topography Subprocess of the Department of Geodesy and Geophysics of the National Geographic Institute, the Technical Review Report was issued for the publication of the georeferenced delimitation of the Public Zone, in relation to the work carried out by ACOPAC concerning the delimitation of a sector of mangrove on Esterillos Centro Beach, technically endorsing the delimitation carried out for its publication; information that was communicated to the Directorate of the IGN for its competence through official communication DIG-GDF-0013-2024 dated January 15, 2024.

17.-That article 140 of Law No. 6227 General Public Administration Law states that "the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce them from the moment it is adopted," a provision that must necessarily be related to numeral 204 subsection 1) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating that: "General acts shall be communicated by publication and concrete acts by notification." HEREBY COMMUNICATES:

1. 1That, on October 25, 2023, the field work was carried out for the digital delimitation georeferenced to the national coordinate system of the public zone of a mangrove sector located on Esterillos Centro Beach, district 01 Parrita, canton 09 Parrita, province 06 Puntarenas.

2º-The National Geographic Institute publishes the georeferenced digital delimitation of the public zone of 02 points that form part of a mangrove sector located on Esterillos Centro Beach, district 01 Parrita, canton 09 Parrita, province 06 Puntarenas, based on the Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone and the methodology used and validated by the Central Pacific Conservation Area (ACOPAC) of SINAC-MINAE.

1. 3That the delimited public zone corresponds to a mangrove sector of Esterillos Centro Beach, district 01 Parrita, canton 09 Parrita, province 06 Puntarenas, in accordance with official communications DIG-GDF-0012-2024 dated January 15, 2024, generated by the Topography Subprocess of the Department of Geodesy and Geophysics of the National Geographic Institute, and official communication SINAC-ACOPAC-PNMA-RBS-TT-072 dated October 26, 2023, from the Central Pacific Conservation Area (ACOPAC).
2. 4That the public zone of the Maritime Terrestrial Zone concerning the mangrove sector verified and delimited by the Central Pacific Conservation Area on Esterillos Centro Beach corresponds to the following coordinates, in the official cartographic projection system of Costa Rica CRTM05:

MANGROVE SECTOR ON ESTERILLOS CENTRO BEACH

1. 5That the sectors located on Esterillos Centro Beach, district 01 Parrita, canton 09 Parrita, province 06 Puntarenas, which to date have delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official status.

6º-The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone of the mangrove on Esterillos Centro Beach in district 01 Parrita, canton 09 Parrita, province 06 Puntarenas, have been recorded in the Digital Georeferenced Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN in a file with vector shape format, under the codification: RN/IGN_GDG-IGN-ZMT_mojones.

7º-It shall become effective as of its publication.-Given in Curridabat, San José March 20, 2024.

1. 1Que mediante Ley Nº 8905 se estableció al Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, de conformidad con el artículo 1 de la Ley Nº 59, el IGN es "la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación."
2. 2Que la Ley Nº 59 constituye al IGN de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con lo dispuesto en la Ley N° 59, el artículo 62 del Decreto Ejecutivo N° 7841-P Reglamento a la Ley sobre la Zona Marítimo Terrestre del 16 de diciembre de 1977 y sus reformas, se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta; asimismo, el artículo 63 del Decreto Ejecutivo N° 7841-P señala que "El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública."
4. 4Que el Decreto Ejecutivo N° 36642-MP-MOPTMINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre del 28 de junio del 2011, establece según el artículo 18 que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, indicados en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que en el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83 del 30 de marzo del 2007, entre otros aspectos determina a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, indicando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera." ; en tanto el artículo 7 dispone que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."
6. 6Que el Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara en su artículo 1 que "El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON"; además, el artículo 2 establece que "El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense."

Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que "El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (UTM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado."

1. 7Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
2. 8Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).
3. 9Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre; b) el Decreto Ejecutivo N° 33797-MJMOPT Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05; c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre; y d) el Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica.

10.-Que el artículo 16 de la Ley N° 7575 Ley Forestal del 13 de febrero de 1996 y sus reformas, establece que el Ministerio del Ambiente y Energía (MINAE) delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.-Que el artículo 11 del Capítulo I Disposiciones Generales de la Ley N° 6043, establece que la "Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional." 12.-Que el Decreto Ejecutivo N° 36786-MINAET Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica del 12 de agosto del 2011, establece entre sus objetivos "Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE)." 13.-Que el Decreto Ejecutivo N° 36786-MINAET en el Punto III.-Competencias para la delimitación y certificación establece que "La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección.

La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en el área total a concesionar." 14.-Que el IGN utilizó la metodología de Delimitación Digital, para delimitar la zona pública de la Zona Marítimo Terrestre correspondiente a un sector de manglar de Playa Esterillos Centro, distrito 01º Parrita, cantón 09º Parrita, provincia 06º Puntarenas.

15.-Que la delimitación digital de un sector de manglar en Playa Esterillos Centro corresponde al informe técnico presentado por el ingeniero topógrafo Oscar Corrales Segura y el informe SINAC-ACOPAC-PNMA-RBS-TT-072 de fecha 26 de octubre de 2023 del Área de Conservación Pacífico Central (ACOPAC) al cual se le otorga visto bueno al levantamiento y delimitación realizado por el Área de Conservación respectiva.

16.-Que mediante el oficio DIG-GDF-0012-2024 de fecha 15 de enero de 2024, generado por el Subproceso de Topografía del Departamento de Geodesia y Geofísica del Instituto Geográfico Nacional, se emitió en el Informe de revisión técnica para la publicación de delimitación georreferenciada de la Zona Pública, en relación con los trabajos realizados por ACOPAC relativos a la delimitación de un sector de manglar en Playa Esterillos Centro, avalando técnicamente la delimitación realizada para su publicación; información que fue comunicada a la Dirección del IGN para lo de su competencia mediante oficio DIG-GDF-0013-2024 de fecha 15 de enero de 2024.

17.-Que el artículo 140 de la Ley N° 6227 Ley General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204 inciso 1) del mismo cuerpo normativo, que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: "Se comunicarán por publicación los actos generales y por notificación, los concretos".

COMUNICA:

1. 1Que, el 25 de octubre del 2023, se realizó el trabajo de campo para la delimitación digital georreferenciada al sistema nacional de coordenadas de la zona pública de un sector de manglar ubicado Playa Esterillos Centro, distrito 01º Parrita, cantón 09º Parrita, provincia 06º Puntarenas.

2º-El Instituto Geográfico Nacional publica la delimitación digital georreferenciada de la zona pública de 02 puntos que forman parte de un sector de manglar ubicado Playa Esterillos Centro, distrito 01º Parrita, cantón 09º Parrita, provincia 06º Puntarenas, con base al Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre y a la metodología usada y validada por el Área de Conservación Pacífico Central (ACOPAC) del SINAC-MINAE.

1. 3Que la zona pública delimitada corresponde a un sector de manglar de Playa Esterillos Centro, distrito 01º Parrita, cantón 09º Parrita, provincia 06º Puntarenas en conformidad a los oficios DIG-GDF-0012-2024 de fecha 15 de enero de 2024, generado por el Subproceso de Topografía del Departamento de Geodesia y Geofísica del Instituto Geográfico Nacional, y el oficio SINAC-ACOPAC-PNMA-RBS-TT-072 de fecha 26 de octubre de 2023 del Área de Conservación Pacífico Central (ACOPAC).
2. 4Que la zona pública de la Zona Marítimo Terrestre concerniente al sector de manglar verificado y delimitado por el Área de Conservación Pacífico Central en Playa Esterillos Centro corresponde a las coordenadas, en el sistema de proyección cartográfica oficial de Costa Rica CRTM05, siguientes:

SECTOR MANGLAR EN PLAYA ESTERILLOS CENTRO

1. 5Que los sectores ubicados en Playa Esterillos Centro, distrito 01º Parrita, cantón 09º Parrita, provincia 06º Puntarenas, que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

6º-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre del manglar en Playa Esterillos Centro en distrito 01º Parrita, cantón 09º Parrita, provincia 06º Puntarenas, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN en archivo con formato vectorial shape, bajo la codificación: RN/IGN_GDG-IGN-ZMT_mojones.
