throughout the entire text - Complete Text of Norm 052 Declares a closed season for sardine *Ophistonema sp* fishing with any type of net COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/052-2024.-Puntarenas, on the twenty-seventh day of February, two thousand twenty-four.

1. 1That through Board of Directors Agreement AJDIP/049-2020, a closed season was established for the semi-industrial sardine purse-seine (bolichera) fishery for *Ophistonema sp* (purse seine, cerco), in the area comprised by an imaginary line running from Punta Agujas (84°38´57´´ West Longitude, 09°43´46´´ North Latitude) to the Lighthouse of Isla Negritos offshore (84°49´35´´ West Longitude, 09°49´14´´ North Latitude) and from there to the eastern part of Punta Cuchillo on the Nicoya Peninsula (09°50´03" North Latitude, 084°53´42" West Longitude) and from these lines seaward to the mouth of the Tempisque River; from March 1 through May 31, 2024.
2. 2That Board of Directors Agreement AJDIP/049-2020 established that bycatch (captura incidental) in the sardine fishery may not exceed 10% of the vessel's total catch.
3. 3That the Directorate of Fisheries and Aquaculture Management (Dirección de Ordenamiento Pesquero y Acuícola), will additionally establish the corresponding measures so that all landings made as part of this agreement are duly inspected by the Enforcement Department (Departamento de Fiscalización). In turn, the Research Department (Departamento de Investigación) will conduct biological sampling of said catches to evaluate the reproductive behavior of the sardines.
4. 4That the Directorate of Fisheries and Aquaculture Management held meetings with representatives of the semi-industrial sardine purse-seine (bolichera) fishery sector, in which they requested that the original measures dating from 2018 be reestablished, allowing entry to fish one day a week into the closed area defined as Tárcoles, so that they can supply sardine for bait to the national fishing fleet.
5. 5That with the implementation of this closed season, exactly as it has been conceived, the urgent need to protect the sardine resource during its reproductive stage is addressed in pursuit of the sustainability of this fishery resource while simultaneously resolving the bait requirements of the national fishing fleet, which is why the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture; NOW THEREFORE.

1º-To declare a closed season for sardine *Ophistonema sp* fishing with any type of fishing net from March 1 through May 31, 2024, in the following zones of the Costa Rican Pacific coast. For these purposes, the total area defined in considering clause 1 is divided into two zones: Zone C of the Gulf of Nicoya, which for the purposes of this agreement is that which is comprised by an imaginary line that starts at the area known as Peñón or Punta Torres (9°53'31" North Latitude and 84°43'52" West Longitude) and extends to the lighthouse at Punta Isla Negritos offshore (84°49´35´´ West Longitude, 09°49´14´´ North Latitude); from there another imaginary line to Punta Cuchillo on the Nicoya Peninsula (09°50´03" North Latitude, 084°53´42" West Longitude) and from this point another imaginary line to the Puntarenas Lighthouse (9° 58´ 36.03´´ North Latitude 84° 51´ 03.93´´ West Longitude). Tárcoles Zone, which for the purposes of this agreement is that which is comprised by an imaginary line extending from Punta Agujas (84°38´57´´ West Longitude, 09°43´46´´ North Latitude) to the lighthouse on Punta Isla Negritos offshore (84°49´35´´ West Longitude, 09°49´14´´ North Latitude) and from this last point, another imaginary line to Peñón or Punta Torres (9°53'31" North Latitude and 84°43'52" West Longitude).

2º-During this closed season, in the zone called Tárcoles, the entry of one of the three semi-industrial sardine vessels is authorized to fish one day a week, so that they can supply sardine for bait to the national fishing fleet. Surpluses may be commercialized for other purposes as established in Board of Directors Agreement AJDIP/100-2021. This access will be utilized in 12-hour daytime blocks each, on an alternating weekly basis by each vessel, such that no more than one vessel may be within said zone in the same week, and prior to their entry, their owners, shipowners (armadores), or Captain must; coordinate the week in which each vessel will enter and must notify the Registration Department (Departamento de Registro) and the Enforcement Department (Departamento de Fiscalización) of Incopesca of the schedule with the date and time of entry of each vessel into the Tárcoles zone established in this closed season.

1. 3That all landings made by the semi-industrial sardine purse-seine (bolichera) fleet will be duly inspected by the inspectors of the Institution. Said inspection must cover not only the sardine landings, but also that of the bycatch (fauna de acompañamiento). In turn, the Fisheries Research Department (Departamento de Investigación Pesquera) will conduct biological sampling of said catches to evaluate the reproductive behavior of the sardines and compliance with the legal minimum size at first capture (talla legal de primera captura).

4º-For the landings, the established time slot will be as follows: From 06.00 hours to 20.00 hours. Those landings made under the protection of this agreement without institutional presence due to situations attributable to the shipowner (armador) will result in the loss of the benefit of fishing in the closed Tárcoles zone under the terms of this agreement.

1. 5That Board of Directors Agreement AJDIP/049-2020 established that bycatch (captura incidental) in the sardine fishery may not be greater than 10% of the vessel's total catch.

6º-As long as new research is not available, the sardine closed season is maintained under the conditions established in Agreement AJDIP/049-2020.

7º-The National Coast Guard Service (Servicio Nacional de Guardacostas) in coordination with the Enforcement Department (Departamento de Fiscalización) of INCOPESCA, will carry out the pertinent actions under the protection of what is established in this agreement, in order to control and monitor illegal fishing activities in the closed zone, especially the Tárcoles zone.

en la totalidad del texto - Texto Completo Norma 052 Decreta veda de pesca de sardina Ophistonema sp con cualquier tipo de red INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/052-2024.-Puntarenas, a los veintisiete días del mes febrero de dos mil veinticuatro.

1. 1Que mediante Acuerdo de Junta Directiva AJDIP/049-2020, se estableció una veda para la pesca semi-industrial sardinera bolichera de Ophistonema sp (cerco), en el área comprendida por una línea imaginaria que va desde Punta Agujas (84°38´57´´ Longitud Oeste, 09°43´46´´ Latitud Norte) al Faro de la Isla Negritos afuera (84°49´35´´ Longitud Oeste, 09°49´14´´ Latitud Norte) y desde ahí hasta la parte Este de Punta Cuchillo en la Península de Nicoya (09°50´03"Latitud Norte, 084°53´42" Longitud Oeste) y de estas líneas aguas adentro hasta la desembocadura del río Tempisque; a partir del 01 de marzo hasta el 31 de mayo de 2024.
2. 2Que el Acuerdo de Junta Directiva AJDIP/049-2020, estableció que la captura incidental en la pesca de sardina no puede ser superior al 10% de la captura total de la embarcación.
3. 3Que la Dirección de Ordenamiento Pesquero y Acuícola, adicionalmente establecerá las medidas correspondientes para efectos de que todas las descargas que se realicen como parte de este acuerdo sean debidamente inspeccionadas por el Departamento de Fiscalización. A su vez el Departamento de Investigación realizará muestreos biológicos de dichas capturas para evaluar el comportamiento reproductivo de las sardinas.
4. 4Que la Dirección de Ordenamiento Pesquero y Acuícola sostuvo reuniones con los representantes del sector de pesca semi-industrial de sardina bolichera (cerco), en la cual solicitaron se reestablezcan las medidas originales que datan del año 2018, permitiendo el ingreso a faenar un día a la semana al área vedada definida como Tárcoles, a efectos que puedan suplir sardina para carnada a la flota pesquera nacional.
5. 5Que con la puesta en marcha de esta veda, tal cual se ha concebido, se atiende la imperiosa necesidad de proteger el recurso sardina en su etapa de reproducción en procura de la sostenibilidad de este recurso pesquero y a la vez solventar los requerimientos de carnada de la flota pesquera nacional, razón por la cual, la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura; POR TANTO.

ACUERDA 1º-Decretar la veda de pesca de sardina Ophistonema sp con cualquier tipo de red de pesca a partir del 01 de marzo hasta el 31 de mayo del 2024, en las siguientes zonas del litoral pacífico costarricense. Para dichos efectos, el área total definida en el considerando 1, se divide en dos zonas: Zona C del Golfo de Nicoya, que para efectos de este acuerdo es aquella que está comprendida por una línea imaginaria que inicia en la zona conocida como el Peñón o Punta Torres (9°53'31" Latitud Norte y 84°43'52" Longitud Oeste) y se extiende hasta el faro de la Punta de Isla Negritos afuera (84°49´35´´ Longitud Oeste, 09°49´14´´ Latitud Norte); de ahí otra línea imaginaria hasta Punta Cuchillo en la Península de Nicoya (09°50´03" Latitud Norte, 084°53´42" Longitud Oeste) y desde este punto otra línea imaginaria hasta el Faro de Puntarenas (9° 58´ 36.03´´ Latitud Norte 84° 51´ 03.93´´Longitud Oeste). Zona Tárcoles, que para efectos de este acuerdo es aquella que está comprendida por una línea imaginaria que se extiende desde Punta Agujas (84°38´57´´Longitud Oeste, 09°43´46´´ Latitud Norte) hasta el faro en la Punta de Isla Negritos afuera (84°49´35´´ Longitud Oeste, 09°49´14´´ Latitud Norte) y desde este último punto, otra línea imaginaria hasta el Peñón o Punta Torres (9°53'31" Latitud Norte y 84°43'52" Longitud Oeste).

2º-Durante esta veda, en la zona denominada Tárcoles, se autoriza el ingreso de una de las tres embarcaciones semi-industrial sardineras para faenar un día a la semana, a efectos de que puedan suplir sardina para carnada a la flota pesquera nacional. Los excedentes podrán ser comercializados para otros fines según lo establecido en el acuerdo de Junta Directiva AJDIP/100-2021. Este acceso será utilizado en franjas diurnas de 12 horas cada una de forma semanal alterna por cada embarcación de modo que no podrán estar dentro de dicha zona más de una embarcación en la misma semana y de previo a su ingreso, deberán sus propietarios, armadores o Capitán; coordinar la semana en que ingresará cada embarcación y deberán notificar al Departamento de Registro y al Departamento de Fiscalización del Incopesca el cronograma con la fecha y hora de ingreso de cada embarcación a la zona Tárcoles establecida en esta veda.

1. 3Que todas las descargas que se realicen por parte de la flota semi-industrial bolichera de sardina serán debidamente inspeccionadas por parte de los inspectores de la Institución. Dicha inspección debe cubrir no solo las descargas de sardina, sino también la de fauna de acompañamiento. A su vez el Departamento de Investigación Pesquera realizará muestreos biológicos de dichas capturas para evaluar el comportamiento reproductivo de las sardinas y el cumplimiento de la talla legal de primera captura.

4º-Para los desembarques la franja horaria establecida será la siguiente: A partir de las 06.00 horas hasta las 20.00 horas. Aquellos desembarques que se efectúen al amparo de este acuerdo sin presencia institucional por situaciones imputables al armador conllevará la pérdida del beneficio de ejercer la pesca en la zona Tárcoles vedada en los términos de este acuerdo.

1. 5Que el acuerdo de Junta Directiva AJDIP/049-2020 estableció que la captura incidental en la pesca de sardina no puede ser superior al 10% de la captura total de la embarcación.

6º-Mientras no se cuente con nuevas investigaciones, se mantiene la veda de sardina en las condiciones establecidas en el acuerdo AJDIP/049-2020.

7º-El Servicio Nacional de Guardacostas en coordinación con el Dpto. de Fiscalización del INCOPESCA, realizarán las acciones pertinentes al amparo de lo establecido en el presente acuerdo, a efectos de controlar y fiscalizar actividades de pesca ilegal en la zona vedada, especialmente, la zona Tárcoles.

Considerando
