AJDIP/312-2023.-Puntarenas, on the nineteenth day of the month of December of two thousand twenty-three.
- 1That by means of Board of Directors Agreements AJDIP/077-2020, AJDIP/076-2022, AJDIP/247-2022, AJDIP/030-2023 and AJDIP/031-2023, respectively, the "Regulation for the Monitoring, Control and Surveillance of Fishing Vessels of the National and Foreign Fleets" was established, which entails the obligation for vessels of the national and foreign fishing fleet to have duly installed and in use a radio beacon system linked to the INCOPESCA Control, Monitoring and Surveillance Center.
- 2That in those regulatory provisions, not only was said obligation contemplated; but they also comprise differentiated effective dates for the various fishing fleets; among which are vessels belonging to the medium-scale sport and tourist fishing fleet, the last of which has been incorporated and for which its effective date was initially set as of January 1, 2024.
- 3That with the aim of advancing in the implementation process of the aforementioned, from the Executive Presidency direct contact was established with representatives of sport and tourist fishing, in which Agreement AJDIP/076 2022 was presented, so that it could be complemented with a broader wording for that fishing sector.
- 4That based on said process, the creation of a Working Committee of representatives of sport and tourist fishing was established for the purpose of conducting the assessments and recommendations of an alternative text of regulation exclusively for sport and tourist fishing.
- 5That on the part of Mr. Guillermo Ramírez Gätgens, Head of the Institutional Legal Advisory Office, and Miguel Durán Delgado, Director of Fisheries and Aquaculture Management, an opinion is issued by means of which it is recommended to request the referred Committee to present the input no later than the month of March 2024, in order to carry out the respective socialization process.
- 6That likewise, on the part of Messrs. Ramírez Gätgens and Durán Delgado, a recommendation is presented in order to extend the effective date of Agreement AJDIP/076-2022 to July 1 of the year 2024.
- 7That, having duly analyzed the proposed modification and considering it appropriate, the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture, Therefore;
AGREES:
1°-To approve the requested extension recommended and modify Board of Directors agreement AJDIP/076-2022, in its Transitory Provision II, so that henceforth it shall read in the following manner:
Transitory Provision II: "For medium-scale Sport and Tourist Fishing vessels, this regulation shall be applicable as of July 1 of the year 2024".
2°-To render void Board of Directors Agreement AJDIP/116-2023.
3°-To request the Working Committee established for the follow-up of the matter, the presentation of the alternative text of regulation exclusively for sport and tourist fishing no later than the month of March of the year 2024.
4°-Final Agreement. It takes effect as of its approval.
5°-Let it be published.
