in the entirety of the text - Full Text of Norm 312 Reform of the Regulation for the monitoring, control and surveillance of fishing vessels of the national and foreign fleets (AJDIP/076-2022.)

COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE (Thus repealed this norm by agreement N° AJDIP/162-2024 of July 2, 2024) AJDIP/312-2023.-Puntarenas, on the nineteenth day of the month of December of two thousand twenty-three.

1That by means of Board of Directors Agreements AJDIP/077-2020, AJDIP/076-2022, AJDIP/247-2022, AJDIP/030-2023 and AJDIP/031-2023, respectively, the "Regulation for the Monitoring, Control and Surveillance of Fishing Vessels of the National and Foreign Fleets" was established, which entails the obligation for vessels of the national and foreign fishing fleet to have duly installed and in use a radio beacon system linked to the INCOPESCA Control, Monitoring and Surveillance Center.
2That in those regulatory provisions, not only was said obligation contemplated; but they also comprise differentiated effective dates for the various fishing fleets; among which are vessels belonging to the medium-scale sport and tourist fishing fleet, the last of which has been incorporated and for which its effective date was initially set as of January 1, 2024.
3That with the aim of advancing in the implementation process of the aforementioned, from the Executive Presidency direct contact was established with representatives of sport and tourist fishing, in which Agreement AJDIP/076 2022 was presented, so that it could be complemented with a broader wording for that fishing sector.
4That based on said process, the creation of a Working Committee of representatives of sport and tourist fishing was established for the purpose of conducting the assessments and recommendations of an alternative text of regulation exclusively for sport and tourist fishing.
5That on the part of Mr. Guillermo Ramírez Gätgens, Head of the Institutional Legal Advisory Office, and Miguel Durán Delgado, Director of Fisheries and Aquaculture Management, an opinion is issued by means of which it is recommended to request the referred Committee to present the input no later than the month of March 2024, in order to carry out the respective socialization process.
6That likewise, on the part of Messrs. Ramírez Gätgens and Durán Delgado, a recommendation is presented in order to extend the effective date of Agreement AJDIP/076-2022 to July 1 of the year 2024.
7That, having duly analyzed the proposed modification and considering it appropriate, the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture, Therefore;

AGREES:

1°-To approve the requested extension recommended and modify Board of Directors agreement AJDIP/076-2022, in its Transitory Provision II, so that henceforth it shall read in the following manner:

Transitory Provision II: "For medium-scale Sport and Tourist Fishing vessels, this regulation shall be applicable as of July 1 of the year 2024".

2°-To render void Board of Directors Agreement AJDIP/116-2023.

3°-To request the Working Committee established for the follow-up of the matter, the presentation of the alternative text of regulation exclusively for sport and tourist fishing no later than the month of March of the year 2024.

4°-Final Agreement. It takes effect as of its approval.

5°-Let it be published.

Considering:

en la totalidad del texto - Texto Completo Norma 312 Reforma Reglamento para el seguimiento, control y vigilancia de embarcaciones pesqueras de las flotas nacional y extranjera (AJDIP/076-2022.)

INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA (Así derogada esta norma mediante acuerdo N° AJDIP/162-2024 del 2 de julio del 2024) AJDIP/312-2023.-Puntarenas, a los diecinueve días del mes diciembre de dos mil veintitrés.

1Que por medio de los Acuerdos de Junta Directiva AJDIP/077-2020, AJDIP/076-2022, AJDIP/247-2022, AJDIP/030-2023 y AJDIP/031-2023, respectivamente, se estableció el "Reglamento para el Seguimiento, Control y Vigilancia de Embarcaciones Pesqueras de las Flotas Nacional y Extranjera", mismo que conlleva la obligatoriedad para las embarcaciones de la flota pesquera nacional y extranjera de contar debidamente instalada y en uso un sistema de radio baliza enlazada con el Centro de Control, Monitoreo y Vigilancia del INCOPESCA.
2Que en esas disposiciones reglamentarias no sólo se contempló la obligatoriedad dicha; sino que comprenden plazos diferenciados de entrada en vigencia para las diversas flotas pesqueras; entre las cuales se encuentran las embarcaciones pertenecientes a la flota de pesca deportiva y turística de mediana escala, última de las cuales ha sido incorporada y para la cual se tenía en principio su entrada en vigencia a partir del 01 de enero del 2024.
3Que con el fin de avanzar en el proceso de implementación de lo señalado, desde la Presidencia Ejecutiva se estableció contacto directo con representantes de la pesca deportiva y turística, en la cual se presentó el Acuerdo AJDIP/076 2022, con el fin que se pudiera complementar con una redacción más amplia para ese sector pesquero.
4Que en base a dicho proceso se estableció la creación de una Comisión de trabajo de representantes de la pesca deportiva y turística con el propósito que se hicieran las valoraciones y recomendaciones de un texto alternativo de reglamentación exclusiva para la pesca deportiva y turística.
5Que por parte del señor Guillermo Ramírez Gätgens. Jefe de la Asesoría Jurídica Institucional y Miguel Durán Delgado, Director de Ordenamiento Pesquero y Acuícola, se emite criterio por medio del cual se recomienda solicitar a la Comisión referida la presentación del insumo a más tardar en el mes de marzo del 2024, con fin de realizar el proceso de socialización respectivo.
6Que asimismo, por parte de los señores Ramírez Gätgens y Durán Delgado se presenta recomendación con el fin de que se prorrogue la entrada en vigencia del Acuerdo AJDIP/076-2022 al 01 de julio del año 2024.
7Que, debidamente analizada la modificación propuesta y por considerarla procedente, la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, Por tanto;

ACUERDA:

1°-Aprobar la solicitud de prórroga recomendada y modificar el acuerdo de Junta Directiva AJDIP/076-2022, en su Transitorio II, para que en lo sucesivo se lea de la siguiente manera:
