Accession to the International Convention for the Conservation of Atlantic TunasAdhesión al Convenio Internacional para la Conservación del Atún del Atlántico

The Adhesion of the Republic of Costa Rica to the International Convention for the Conservation of Atlantic Tunas, signed in Rio de Janeiro, Brazil, on the fourteenth of May, nineteen hundred and sixty-six; and the Protocol of Amendments to the International Convention for the Conservation of Atlantic Tunas, adopted on November 18, 2019, in Palma de Mallorca, Spain, are approved, in each and every part.

THE GOVERNMENT OF THE REPUBLIC OF COSTA RICA:

Considering that the International Convention for the Conservation of Atlantic Tunas of May 14, 1966 Bearing in mind that Article 11 of the Protocol of Amendments states that no provision of this Convention shall prejudice the rights, jurisdiction and obligations of States under international law and that this Convention shall be interpreted and applied in a manner consistent with international law.

Bearing in mind that Article 10, paragraph 1, of the Protocol of Amendments states that this Convention shall be open for signature by any Government that is a member of the United Nations or of any of its specialized agencies. Any such Government that has not signed this Convention may accede to it at any time.

Bearing in mind that Article 10, paragraph 2, of the Protocol of Amendments states that this Convention is subject to ratification or approval by the signatory countries in accordance with their constitutions and that the instruments of ratification, approval or adhesion shall be deposited with the Director of the Food and Agriculture Organization of the United Nations.

Bearing in mind that Costa Rica, in its capacity as a Developing Coastal State, in accordance with Articles 58 and 116 of the Convention on the Law of the Sea, is entitled to legitimate fishing rights in its Exclusive Economic Zone in the Caribbean Sea, as well as on the High Seas, and has the international obligation to contribute to the establishment of international management and conservation measures for the tunas and related species that are regulated within the "Convention Area".

COSTA RICA declares that it will accept and assume, through the deposit of the instrument of adhesion with the Food and Agriculture Organization of the United Nations, all the rights and obligations that will be established for these purposes, as a Contracting Party to the International Convention for the Conservation of Atlantic Tunas and the Protocol of Amendments to the Convention.

The Texts of the International Convention for the Conservation of Atlantic Tunas, signed in Rio de Janeiro, Brazil, and the Protocol of Amendments to the Convention, adopted on November 18, 2019, form an integral part of this law. These equally authentic texts are duly certified in pdf version by the Food and Agriculture Organization of the United Nations. These texts are as follows:

"INTERNATIONAL CONVENTION FOR THE CONSERVATION OF ATLANTIC TUNAS FINAL ACT OF THE CONFERENCE OF PLENIPOTENTIARIES ON THE CONSERVATION OF ATLANTIC TUNAS (Sinalevi Note: As it has its own text, the International Convention for the Conservation of Atlantic Tunas can be consulted at the following Link) (Sinalevi Note: As it has its own text, the Protocol of Amendment to the International Convention for the Conservation of Atlantic Tunas can be consulted at the following Link)

The payment of the annual contribution from year three and subsequent years shall be made by the Costa Rican Institute of Fisheries and Aquaculture (Instituto Costarricense de Pesca y Acuicultura, INCOPESCA), which institution shall make the corresponding budgetary provisions.

The Republic of Costa Rica interprets that in the provisions set forth in the new Article XV of this Protocol, subparagraphs d) and e), for the case of amendments to the Convention, the acceptance of an amendment involves compliance with the constitutional procedure for the approval of international conventions and public treaties, established in Article 121, subsection 4, of the Political Constitution.

It shall take effect upon its publication.

Given at the Presidency of the Republic, San José, on the fourteenth day of the month of November of the year two thousand and twenty-three.

Se aprueban, en cada una de sus partes, la Adhesión de la República de Costa Rica al Convenio Internacional para la Conservación del Atún del Atlántico, suscrita en Río de Janeiro, Brasil, el catorce de mayo de mil novecientos sesenta y seis; el Protocolo de Enmiendas al Convenio Internacional para la Conservación del Atún del Atlántico, adoptadas el 18 de noviembre de 2019, en Palma de Mallorca, España.

EL GOBIERNO DE LA REPUBLICA DE COSTA RICA:

Teniendo en cuenta que la Convención Internacional Para la Conservación del Atún del Atlántico del 14 de mayo de 1966 Teniendo presente que el Artículo 11 del Protocolo de Enmiendas, manifiesta que ninguna disposición de este Convenio perjudicará los derechos, jurisdicción y obligaciones de los Estados en el marco del derecho internacional y que este Convenio se interpretará y aplicará de un modo coherente con el derecho internacional.

Teniendo presente que en el Artículo 10, numeral 1, del Protocolo de Enmiendas se manifiesta que el presente Convenio quedará abierto a la firma de todo Gobierno que sea miembro de las Naciones Unidas o de cualquiera de sus organismos especializados. Cualquiera de estos Gobiernos que no haya firmado el presente Convenio podrá adherirse a él en cualquier momento.

Teniendo presente que en el Artículo 10, numeral 2, del Protocolo de Enmiendas, se manifiesta que este Convenio queda sujeto a la ratificación o aprobación de los países signatarios de acuerdo con su constitución y que los instrumentos de ratificación, aprobación o adhesión se depositarán ante el Director de la Organización de las Naciones Unidas para la Alimentación y la Agricultura.

Teniendo presente que Costa Rica en su condición de Estado Ribereño en Desarrollo, de conformidad con los Artículos 58 y 116 de la Convención sobre el Derechos del Mar, le asiste legítimos derechos de pesca en su Zona Económica Exclusiva en el Mar Caribe, así como en la Alta Mar, y le asiste la obligación internacional de contribuir con el establecimiento de las medidas de ordenamiento y conservación internacional sobre los tunidos y especies afines que se encuentran reguladas por la "Zona de la Convención".

COSTA RICA declara que aceptará y asumirá, mediante el depósito del instrumento de adhesión ante la Organización de las Naciones Unidas para la Alimentación y la Agricultura, todos los derechos y obligaciones que para estos efectos se establecerán, como Parte Contratante del Convenio Internacional Para la Conservación del Atún del Atlántico y el Protocolo de Enmiendas al Convenio.

Los Textos del Convenio Internacional Para la Conservación del Atún del Atlántico, suscrito en Rio de Janeiro, Brasil y el Protocolo de Enmiendas al Convenio, adoptadas el 18 de noviembre de 2019, forman parte integrante de esta ley. Dichos textos igualmente auténticos están debidamente Certificados en versión pdf por la Organización de las Naciones Unidas Para la Alimentación y la Agricultura. Estos textos son los siguientes:

El pago de la contribución anual a partir del año tres y subsiguientes las realizará el Instituto Costarricense de Pesca y Acuicultura (l ncopesca), cuya institución deberá tomar las previsiones presupuestarias correspondientes.

La República de Costa Rica interpreta que en lo dispuesto en el nuevo artículo XV del presente Protocolo, incisos d) y e), para el caso de las enmiendas al Convenio, la aceptación de una enmienda involucra el cumplimiento del procedimiento constitucional para la aprobación de los convenios internacionales y tratados públicos, dispuesto en el artículo 121, inciso 4, de la Constitución Política.
