This executive decree reforms the boundaries of Cocos Island National Park and transforms the Seamounts Marine Management Area into the Bicentennial Marine Management Area, adjusting their geographic coordinates. The National Park is expanded to approximately 54,844 km², while the new management area covers about 106,284 km² in Costa Rican jurisdictional waters of the Pacific. The reform responds to the need to strengthen the country's marine protected area system, in compliance with international commitments and based on Constitutional Article 50 guaranteeing a healthy environment. 1st - That article 50 of the Political Constitution enshrines in favor of all inhabitants of the Nation the right to a healthy and ecologically balanced environment, it being understood that this right includes the conservation, sustainable use and management of biodiversity and the equitable distribution of benefits derived from it. The Costa Rican State, in the exercise of its competences, must ensure this constitutional right, for which it employs, among other tools, the creation of marine protected areas (áreas marinas protegidas) that adjust to current social, economic, and biological needs.
2nd - That it is in the State's interest to strengthen the country's system of protected areas by virtue of the need for efficient management of the natural resources existing in the jurisdictional waters and in compliance with the commitments undertaken by the country with the international community.
3rd - Because of the above, Executive Decree No. 29834-MINAE, of August 23, 2001, entitled "Expands the boundaries of Isla del Coco National Park," and Executive Decree No. 36452-MINAE, dated March 3, 2011, entitled "Creates the Montes Submarinos Marine Management Area," were promulgated.
4th - That by Agreement AJDIP/155-2023 of July 11, 2023, of the Board of Directors of INCOPESCA, the communication from the National Geographic Institute (Instituto Geográfico Nacional), DIG-GED-0045-2023, is received and approved, with the conversion of the coordinates of Isla del Coco National Park and the Bicentennial Marine Management Area.
5th - That in accordance with the second and third paragraphs of article 12 of the Regulations to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, Executive Decree No. 37045-MP-MEIC of February 22, 2012, this Decree does not create or modify procedures, requirements, or formalities, therefore it does not require the Regulatory Improvement Process.
Therefore;
Amendment to article 1 of Executive Decree No. 29834-MINAE of August 23, 2001, entitled "Expands the boundaries of Isla del Coco National Park"; and Amendment to article 1 of Executive Decree No. 36452-MINAE of March 3, 2011, entitled "Creates the Montes Submarinos Marine Management Area"

1 °- Que el artículo 50 de la Constitución Política consagra a favor de todos los habitantes de la Nación el derecho a un ambiente sano y ecológicamente equilibrado, siendo que este derecho incluye la conservación, uso y manejo sostenible de la biodiversidad y la equitativa distribución de beneficios derivados de ésta. El Estado costarricense en el ejercicio ele sus competencias, debe asegurar este derecho constitucional para lo cual dispone, entre otras herramientas, de la creación de áreas marinas protegidas que se ajusten a las necesidades sociales, económicas y biológicas actuales.
2Que es interés del Estado, fortalecer el sistema de áreas protegidas del país en virtud de la necesidad de un manejo eficiente de los recursos naturales existentes en las aguas jurisdiccionales y en cumplimiento con los compromisos asumidos por el país con la comunidad internacional.
3° - Por lo anterior, se promulgó el Decreto Ejecutivo Nº 29834-MlNAE, del 23 de agosto del 2001, denominado "Amplía los límites del Parque Nacional Isla del Coco"; y el Decreto Ejecutivo Nº 36452-MINAE, de fecha 03 de marzo de 2011, denominado ''Crea Área Marina de Manejo de Montes Submarinos".
4Que mediante Acuerdo AJDIP/155-2023 del once de julio de 2023 de la Junta Directiva del lNCOPESCA, se da por recibido y aprobado el oficio del Instituto Geográfico Nacional, DIG-GED-0045-2023, con la conversión de las coordenadas del Parque Nacional Isla del Coco y el Área Marina de Manejo del Bicentenario.
5 ° Que de conformidad con los párrafos segundo y tercero del artículo 12 del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N º 37045-MP-MEIC del 22 de febrero de 2012; el presente Decreto no crea ni modifica trámites, requisitos o procedimientos por lo que no requiere del Trámite de Mejora Regulatoria.
Por Tanto;
Reforma al artículo 1 del Decreto Ejecutivo Nº 29834-MINAE del 23 de agosto ele 2001, denominado "Amplía los límites del Parque Nacional Isla del Coco"; y Reforma al artículo 1 ° del Decreto Ejecutivo Nº 36452-MINAE del 03 de marzo de 2011, denominado "Crea Área Marina de Manejo Montes Submarinos"
CONSIDERANDO:
