Palm Tax Student Scholarship RegulationReglamento de Becas Estudiantiles del Impuesto a la Palma

This Regulation has the purpose of regulating the internal procedure for the granting of student scholarships derived from the palm tax in the canton of Corredores as provided in article 13 of Law N° 7139.

For the purposes of a correct interpretation of this Regulation, some terms are defined that shall have only the following meaning.

A. Oil Palm: Elaeis guineensis, commonly called African oil palm and oil palm, is a species of the genus Elaeis, which produces an oleaginous fruit, of the most common varieties Ghana and Nigeria.

B. Palm Producer: The individual, engaged in the agricultural exploitation and production of the extensive cultivation and harvest of oil palm, for profit or subsistence purposes.

C. Scholarship: Subsidy or economic aid derived from the tax on production, per metric ton of palm fruit, in the canton of Corredores.

D. Student: The student is that subject whose main occupation is the activity of studying, perceiving such activity from the academic field.

E. Child of a Palm Producer: Family link existing between the child and their parents, including children by adoptive filiation, in which one of the two parents has the status of palm producer.

F. Condition of Scarce Resources: For the purposes of this regulation, it shall be understood as those palm producers who have a palm cultivation area in production, from 1 up to a maximum of 25 hectares.

G. Municipal Council: Collegiate body of the local government, the authority that ultimately approves the lists of beneficiaries of the study scholarships derived from the tax on oil palm production.

The granting of scholarships shall correspond exclusively to the Municipal Council of Corredores, upon a recommendatory opinion (dictamen) of the Special Scholarships Committee (Comisión Especial de Becas).

The scholarships shall be granted to those students who are enrolled in primary and secondary education of the Costa Rican educational system, whether in both public and private schools and high schools, as well as those students who are pursuing a public or private university degree, which shall be granted as complementary aid to be used for food, purchase of uniforms, teaching materials, transportation, or any other expense related to the student's educational activities.

Requirements and Application Procedure to Apply for the Scholarship

The student interested in a scholarship must meet the following requirements:

• a)Be the child of a palm producer of the canton.
• b)Hold the condition of scarce resources according to the definition indicated in article two of this regulation.
• c)Be enrolled in a public or private educational center, at the levels indicated in the previous article.
• d)Submit the complete scholarship application form together with the supporting documents (atestados) within the deadline and at the designated place.
• e)Not enjoy another student scholarship or subsidy, from a public institution or private entity, with the exception indicated in article 19° subsection c of this regulation.

The palm producer whose child aspires to a scholarship must pay tax on this concept to the Municipality of Corredores and be up to date in the payment of this and the other local taxes.

For the scholarship application to be admitted, the interested student if of legal age, or whoever holds parental authority in the case of minors, and who meet all the requirements indicated in article 5° of this regulatory body, must, during the reception period established in article 9° subsection c of this Regulation, submit the following documentation to the Secretariat Department of the Municipal Council (departamento de Secretaria del Concejo Municipal).

• a)Completed official form.
• b)Birth certificate or copy of the minor's identity document.
• c)Photocopy of the identity document of the parents or guardian, in the case of being a minor.
• d)Copy of the applicant's identity document, in the case of being of legal age.
• e)Certificate of enrollment (Constancia de matrícula) issued by the Directorate of the respective educational center. This must indicate that the student is enrolled, the level they are pursuing, and whether or not they are a beneficiary of any scholarship.
• f)Copy of the last report card from the previous year, issued by the corresponding educational center.
• g)Certification issued by the company receiving the palm product, or failing that, a notarized affidavit (declaración jurada protocolizada) indicating the number of hectares in production that the parent has.
• h)Bank certification in the name of the student applying for the scholarship, indicating the IBAN account number, where the scholarship could be deposited.

For the granting of scholarships, the following procedure shall apply:

• a)Program dissemination: The Municipal Council shall order what is appropriate to ensure that the widest possible dissemination campaign about the scholarship program is carried out.
• b)Distribution of forms: The forms may be requested starting from the third week of January at the Municipal Council Secretariat Department (Departamento de Secretaría Concejo Municipal) and at the distribution centers that are duly indicated; in addition, they will be available on the website of the Municipality of Corredores.
• c)Reception of forms and supporting documents: The forms together with their supporting documents shall be received at the Municipal Council Secretariat Department and via email, no later than the last day of February. Exceptionally, they shall be received after the indicated deadline, in those cases where there is a reasonable justification, provided it does not exceed three business days.
• d)Review (study): The Special Scholarships Committee shall assess and recommend, via an opinion (dictamen), the approval or rejection of the scholarships, no later than the last day of the month of March. For such purposes, it shall consider, in addition to the documentation and information received, any other mechanism that allows it to corroborate the information. The respective opinion shall contain the final list of recommended students, in alphabetical order, with identity card number, grade report, and the name of the educational center.
• e)Awarding of scholarships: It shall be the responsibility of the Municipal Council to award the scholarships through an agreement. For this, it shall base its decision on the opinion of the Special Scholarships Committee.
• h)Communication of the agreement: The Municipal Council Secretariat Department shall communicate the agreement to the beneficiaries within the next three business days after the act becomes final.

Otherwise, it shall be held as a remainder (remanente) for the following period.

The Special Scholarships Committee shall be composed of five members of the Municipal Council, appointed by the President. Likewise, other administrative officials and advisors may be called to participate, as required. The Committee shall designate at its first session, from among its members, a coordinator and a secretary.

The functions of the Special Scholarships Committee shall be the following:

• a)Request from the Municipal Council the inclusion of the amount allocated to the scholarship item in the respective ordinary budget.
• b)Assess and recommend to the Municipal Council, by means of an opinion (dictamen), those students eligible to receive the scholarship.
• c)Evaluate and propose changes to the Regulation and other relevant regulations.
• d)Submit reports to the Municipal Council and any other tasks that this Body assigns to it.
• e)Follow up on the granted scholarships.

If there are remainders (remanentes) of the scholarship amounts, the Special Scholarships Committee, at its discretion, may distribute them in equal percentages to the already assigned scholarships, or they may be conserved and budgeted to be delivered in subsequent periods. The Special Scholarships Committee shall render the respective report to the Municipal Council, which in turn shall give the order to the Administration.

The distribution of scholarships shall address the following limitations:

• a)For the purposes of this regulation, it shall be understood that only one scholarship shall be given per palm producer, which may be used by one of their children without any exception, for which they must comply with the requirement indicated in article 5° subsection b of this regulation, as well as the other admissibility requirements that the beneficiary must meet.
• b)The granting of scholarships to children of members of the Municipal Council or of any other official covered by the principles of probity, impartiality, and transparency established by the Law against Corruption and Illicit Enrichment in the Public Function, N° 8422, is not appropriate.

The amount of the scholarship shall be calculated using the following formula:

Value of Factor (Y), according to schooling University 50% Secondary 35% Primary 15% Value of Factor (B) according to schooling.

University 15 students Secondary 15 students Primary 15 students * Formula= (X * Y%) ÷ B = Scholarship amount per student per month.

(Factor X multiplied by factor Y %) and the result is divided by factor B It shall be delivered in monthly installments (tractos mensuales) through deposit or transfer to the bank account authorized for this purpose. It shall be granted for the duration of the school year (curso lectivo) for which it was requested, which, in any case, shall not exceed 10 months, counting from February to November.

45 scholarships shall be granted per year distributed as follows: 15 scholarships for secondary students, 15 scholarships for primary students, and 15 scholarships for university students. Regarding the number of scholarships to be granted per year, the Special Scholarships Committee may vary it for reasons of convenience, as well as based on the budgetary content available. If there are variations in the number of scholarships to be granted, the Special Scholarships Committee must inform at least 15 days in advance, before the requirements for the period in which it will be applied are published. So that it is said that it may vary in the quantity and the percentage of the scholarship budget available, in accordance with article 12, subsection C) (Evaluate and propose changes to the Regulation and other relevant regulations).

The Special Scholarships Committee shall use as a differentiating criterion for the selection of scholarships, primarily the amount of area in production that the palm producer whose child is applying for the scholarship benefit has, as well as the fulfillment of the other admissibility requirements. For this purpose, it shall prepare an exhaustive list (lista taxativa) in ascending order, of the beneficiaries using the previously indicated criterion, said list shall be included in the committee opinion indicated in article 9 subsection d, of this regulation.

The obligations of the scholarship holder are the following:

• a)Continue studying throughout the entire school year.
• b)Maintain an academic performance with average grades that must be equal to or greater than 70.
• c)Timely report any change in the condition of small and/or medium palm producer, which implies a variation of the conditions for which the scholarship was granted, also including the condition of having ceased to be an oil palm producer.
• d)Timely provide grade certification to the Special Scholarships Committee, this according to the academic grade they are pursuing, meaning the study modality, be it by periods, quarterly, four-month terms, semesters, to verify the academic performance of the beneficiary.

Causes for Suspension and its Procedure

The scholarship benefit shall be lost for the following causes:

• a)Breach of the obligations stipulated in the previous article. Excepted are those cases in which it is proven that the low grade average was due to situations related to a disability or illness of the scholarship holder or their parents, according to a report from the guidance counselor; likewise due to accident, family disintegration, domestic violence, physical or sexual abuse, death of one of the members of the family nucleus, and cases of misfortune, all duly verified. These reasons shall be confirmed by the Guidance Counselor of the educational center and by the Special Scholarships Committee.
• b)Due to verification of an economic situation different from that stated in the application, understanding that it could have changed or that the information provided by the applicant was false or altered.
• c)For having a benefit for education from another public institution or private entity, with the exception of students who receive special scholarships for reasons of disability and other reasonable grounds.
• d)When they have abandoned their studies.

In the event that the scholarship holder incurs any of the faults indicated in article 19° of this Regulation, the Special Scholarships Committee shall proceed to notify the parent or guardian, in the case of minors, or the scholarship holder, when of legal age, about the possible loss of the benefit, for the purpose of them providing any exculpatory evidence (prueba de descargo) within a period of five business days. The Committee shall analyze the case and recommend to the Municipal Council to resolve what is appropriate. Against the agreement of the Municipal Council, the remedies of revocation (revocatoria) and appeal (apelación) shall be available, in accordance with article 171 of the Municipal Code, within a period of five business days.

Final and Transitional Provisions

This Regulation repeals all previous municipal provisions on the matter regulated herein.

Transitional Provision I.-This Regulation shall come into force once it is published in the official gazette La Gaceta. A period of 15 days after its publication shall be granted, which shall be allocated to a non-binding public consultation. The observations made in this regard must be submitted to the Secretariat Department of the Municipal Council.

Transitional Provision II.-All those applications that were approved prior to the entry into force of this regulation shall be delivered in accordance with the existing guidelines or, failing that, in accordance with the procedure that was applied exceptionally in the event that there was no guideline or regulation to govern it, with reference to the date on which they were approved, this with prior authorization by means of an agreement of the Municipal Council, which shall be done retroactively.

Este Reglamento tiene por objeto regular el procedimiento interno para el otorgamiento de becas estudiantiles provenientes del impuesto a la palma en el cantón de corredores según lo dispuesto en el artículo 13 la Ley N° 7139.

Para efectos de una correcta interpretación de este Reglamento, se definen algunos términos que deberán tener sólo el siguiente significado.

A. Palma Aceitera: Elaeis guineensis, comúnmente llamada palma africana de aceite y palma aceitera, es una especie del género Elaeis, que produce un fruto oleaginoso, de las variedades más comunes la Ghana y Nigeria.

B. Productor Palmero: Es la persona física, dedicada a la aceitera, con fines de lucro o de subsistencia.

C. Beca: Subvención o ayuda económica procedente del impuesto sobre la producción, por tonelada métrica del fruto de palma, en el cantón de corredores.

D. Estudiante: El estudiante es aquel sujeto que tiene como ocupación principal la actividad de estudiar, percibiendo tal actividad desde el ámbito académico E. Hijo de Productor Palmero: Vínculo de familia existente entre el hijo y sus padres, incluyendo los hijos por filiación adoptiva, en el cual alguno de los dos progenitores cuente con la calidad de productor palmero.

F. Condición de Escasos Recursos: Para efectos de este reglamento entiéndase que serán aquellos productores palmeros que cuenten con un área de cultivo de palma en producción, de 1 hasta un máximo de 25 hectáreas.

G. Concejo Municipal: Cuerpo colegiado del gobierno local, autoridad que en definitiva aprueba las listas de los beneficiarios (as) de las becas de estudio provenientes del impuesto sobre la producción de palma aceitera.

Corresponderá en forma exclusiva al Concejo Municipal de Corredores el otorgamiento de las becas, previo dictamen recomendatorio de la Comisión Especial de Becas.

Las becas se otorgarán aquellos estudiantes que se encuentren cursando la primaria y secundaria del sistema educativo costarricense ya sea en escuelas y colegios tanto Públicos como Privados, así como aquellos estudiantes que cursen una carrera Universitaria de carácter Público o Privado, la cual se otorgará como ayuda complementaria para ser utilizadas en alimentación, compra de uniformes, materiales didácticos, transporte, o cualquier otro gasto relacionado con las actividades educativas del estudiante.

Requisitos y procedimiento de solicitud para optar por la beca

El estudiante interesado en una beca deberá cumplir con los siguientes requisitos:

• a)Ser hijo de un productor de palma del cantón.
• b)Ostentar la condición de escasos recursos según la definición indicada en el artículo segundo de este reglamento.
• c)Cursar en un centro de enseñanza pública o privada, de los niveles indicados en el artículo anterior.
• d)Presentar el formulario de solicitud de beca completo junto con los atestados durante el plazo y en el lugar señalado.
• e)No disfrutar de otra beca o subsidio estudiantil, proveniente de una institución pública o entidad privada, con la excepción indicada en el artículo 19° inciso c de este reglamento.

El productor de palma cuyo hijo aspire a una beca, deberá tributar por tal concepto ante la Municipalidad de Corredores y encontrarse al día en el pago de ese y los demás tributos locales.

Para que la solicitud de beca sea admitida, el estudiante interesado en caso de ser mayor de edad, o quien ostente la patria potestad en caso de los menores de edad, y que cumplan con todos los requisitos indicados en el artículo 5° de este cuerpo normativo. Deberá durante el período de recepción establecido en el artículo 9° inciso c de este Reglamento presentar ante el departamento de Secretaria del Concejo Municipal la siguiente documentación a) Formulario oficial lleno.

• b)Constancia de nacimiento o copia del documento de identidad del menor.
• c)Fotocopia del documento de identidad de los padres o del encargado, en caso de ser menor de edad.
• d)Copia del documento de identidad del solicitante, en caso de ser mayor de edad.
• e)Constancia de matrícula extendida por la Dirección de centro educativo respectivo. Esta deberá indicar que el estudiante se encuentra matriculado, el nivel que cursa y si es beneficiario o no de alguna beca.
• f)Copia del último reporte de calificaciones del año anterior, extendido por el centro educativo correspondiente.
• g)Certificación emitida por parte de la empresa recibidora del producto de palma, o en su defecto declaración jurada protocolizada donde se indique la cantidad de hectáreas en producción con que cuenta el progenitor.
• h)Certificación bancaria a nombre del estudiante que solicita la beca, donde se indique el número de cuenta IBAN, donde podría ser depositada la beca.

Para el otorgamiento de las becas se aplicará el siguiente procedimiento:

• a)De la divulgación del programa: El Concejo Municipal ordenará lo que corresponda con tal de que se cumpla con la campaña de divulgación más amplia posible acerca del programa de becas.
• b)De la entrega de los formularios: Los formularios podrán solicitarse a partir de la tercera semana de enero en el Departamento de Secretaría Concejo Municipal y en los centros de distribución que se indique oportunamente; además, estará disponible en la página web de la Municipalidad de Corredores.
• c)De la recepción de los formularios y atestados: Los formularios junto con sus atestados serán recibidos en el Departamento de Secretaría Concejo Municipal y por medio de correo electrónico, a más tardar el último día de febrero. Excepcionalmente se recibirán después del plazo señalado, en aquellos casos en los que haya una justificación razonable, siempre que no lo exceda en tres días hábiles.
• d)Del estudio: La Comisión Especial de Becas valorará y recomendará mediante dictamen la aprobación o rechazo de las becas, a más tardar el último día del mes de marzo. Para tales efectos, considerará, además de la documentación e información recibida, cualquier otro mecanismo que le permita corroborarla. El dictamen respectivo contendrá la lista final de estudiantes recomendados, en orden alfabético, con número cédula de identidad, boleta, y el nombre del centro educativo.
• e)De la adjudicación de las becas: Corresponderá al Concejo Municipal adjudicar mediante acuerdo las becas. Para esto se basará en el dictamen de la Comisión Especial de Becas.
• h)De la comunicación del acuerdo: El Departamento de Secretaría Concejo Municipal comunicará el acuerdo a los beneficiarios dentro de los próximos tres días hábiles posteriores a la firmeza del acto.

De lo contrario, será tenida como remanente para el siguiente periodo.

La Comisión Especial de Becas estará conformada por cinco miembros de Concejo Municipal, nombrados por el Presidente. De igual manera podrán ser llamados a participar otros funcionarios administrativos y asesores, según se requiera. La Comisión designará en su primera sesión, de entre sus integrantes, un coordinador y un secretario.

Serán funciones de la Comisión Especial de Becas las siguientes:

• a)Solicitarle al Concejo Municipal la inclusión del monto destinado al rubro de becas en el presupuesto ordinario respectivo.
• b)Valorar y recomendar al Concejo Municipal, mediante dictamen, a aquellos estudiantes susceptibles de recibir la beca.
• c)Evaluar y proponer los cambios al Reglamento y demás normativa atinente.
• d)Rendir informes al Concejo Municipal y cualesquiera otras labores que ese Órgano le señale.
• e)Dar seguimiento de las becas otorgadas.

De existir remanentes de los montos de becas, la Comisión Especial de Becas a criterio discrecional podrá distribuir en porcentajes iguales a las becas ya asignadas, o podrán en su efecto ser conservados y presupuestados para ser entregados en los subsiguientes periodos. La Comisión Especial de Becas rendirá el respectivo informe al Concejo Municipal, que a su vez dará la orden a la Administración.

La entrega de las becas atenderá las siguientes limitaciones:

• a)Para efectos de este reglamento deberá entenderse que solo se entregara únicamente una beca por cada productor palmero, la cual podrá ser aprovechada por uno de sus hijos sin excepción alguna, para lo cual deberá cumplir con el requisito indicado en el artículo 5° inciso b de este reglamento, así como también los demás requisitos de admisibilidad que deberá cumplir el beneficiario.
• b)No procede el otorgamiento de becas a hijos de miembros del Concejo Municipal o de cualquier otro funcionario cubierto por los principios de probidad, imparcialidad y transparencia dispuestos por la Ley contra la Corrupción y el Enriquecimiento Ilícito en la Función Pública, N° 8422.

El monto de la beca se calculará utilizando la siguiente formula:

Valor del Factor (Y), según escolaridad Universidad 50% Secundaria 35% Primaria 15% Valor del Factor (B) según escolaridad.

Universidad 15 estudiantes Secundaria 15 estudiantes Primaria 15 estudiantes * Formula= (X * Y%) ÷ B = Monto de la beca por estudiante al mes.

(Factor X multiplicado por el factor Y %) y el resultado se divide por el factor B Se entregará en tractos mensuales a través de depósito o transferencia a la cuenta bancaria autorizada al respecto. Se otorgará durante el plazo que dura el curso lectivo para el que la solicitó, que, en cualquier caso, no superará los 10 meses, contados desde febrero hasta noviembre.

Se otorgarán 45 becas por año distribuida de la siguiente manera, 15 becas para estudiantes de secundaria, 15 becas para estudiantes de primaria y 15 becas para estudiantes universitarios. De la cantidad de becas que se otorgarán por año, la Comisión Especial de Becas podrá variarlo por razones de conveniencia, así como del contenido presupuestario con el que se cuente. De existir variaciones sobre la cantidad de becas que se otorgarán la Comisión Especial de Becas, deberá informar con al menos 15 días de anticipación, de previo hacer publicados los requisitos para el periodo en cual será aplicado). Para que se diga que se podrá variar en la cantidad y el porcentaje del presupuesto de becas con el que se cuenta, de conformidad con el artículo 12, inciso C) (Evaluar y proponer los cambios al Reglamento y demás normativa atinente).

La Comisión Especial de Becas, utilizará como criterio diferenciador para la escogencia de becas, principalmente la cantidad del área en producción con que cuente el productor palmero cuyo hijo este optando por el beneficio de la beca, así como el cumplimiento de los demás requisitos de admisibilidad. Para lo cual elaborará una lista taxativa de forma ascendente, de los beneficiarios utilizando el criterio anteriormente indicado, dicha lista se incluirá en el dictamen de comisión indicado en el artículo 9 inciso d, de este reglamento.

Son obligaciones del becario las siguientes:

• a)Mantenerse estudiando durante todo el curso lectivo.
• b)Mantener un rendimiento académico con calificaciones en promedio que deberán ser iguales o superiores a 70.
• c)Reportar oportunamente cualquier cambio en la condición de pequeño y/o mediano productor de palma, que implique variación de las condiciones por las cuales se otorgó la beca, incluyendo también la condición de haber dejado de ser productor de palma aceitera.
• d)Aportar oportunamente certificación de notas a la Comisión Especial de Becas, esto según el grado académico que este cursando, entiéndase esto como la modalidad de estudio, sean estos por periodos, trimestrales, cuatrimestre, semestres, esto para verificar el rendimiento académico del beneficiario.

Causas de suspensión y su procedimiento

El beneficio de la beca se perderá por las siguientes causas:

• a)Incumplimiento de las obligaciones estipuladas en el artículo anterior. Se exceptúan aquellos casos en los que se compruebe que el bajo promedio en las calificaciones ha obedecido a situaciones relacionadas con alguna discapacidad o enfermedad del becario o de sus padres, según informe del orientador; así mismo por accidente, desintegración familiar, violencia intrafamiliar, abusos físicos o sexuales, muerte de alguno de los miembros del núcleo familiar, y casos de infortunio, todos debidamente comprobados. Estos motivos serán constatados por el Orientador del Centro educativo y por la Comisión Especial de Becas.
• b)Por comprobación de una situación económica distinta de la advertida en la solicitud, entendiendo que pudo variar o que la información suministrada por el solicitante haya sido falsa o alterada.
• c)Por contar con un beneficio para educación por parte de otra institución pública o instancia privada, a excepción de los estudiantes que reciban becas especiales por razones de discapacidad y otros motivos razonables.
• d)Cuando haya abandonado sus estudios.

En caso de que el becario incurra en alguna de las faltas indicadas en el artículo 19° de este Reglamento, la Comisión Especial de Becas procederá a comunicarle al padre de familia o encargado, en el caso de los menores de edad, o al becario, cuando sea mayor de edad, sobre la posible pérdida del beneficio, a efectos de que aporten cualquier prueba de descargo dentro del plazo de cinco días hábiles. La Comisión analizará el caso y recomendará al Concejo Municipal para que resuelva lo que corresponda. Contra el acuerdo del Concejo Municipal, cabrán los recursos de revocatoria y de apelación, conforme al artículo 171 del Código Municipal, dentro del plazo de cinco días hábiles.

Este Reglamento deroga todas las disposiciones municipales anteriores sobre la materia que aquí se Reglamenta.

Se otorgará un plazo de 15 días posteriores a su publicación el cual se destinará a consulta pública no vinculante. Las observaciones que se hagan al respecto deberán presentarse ante el Departamento de Secretaría del Concejo Municipal.
