in the entirety of the text - Full Text of Regulation 44266 Declaration of a National Phytosanitary Emergency Status for the Prevention and Control of the Giant African Snail (A. fulica) N° 44266-MAG THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred upon them by articles 140, subsections 3), 8), 18), and 20) and 146 of the Political Constitution; articles 25, 27.1, 28.2 b) of the General Public Administration Law (Ley General de la Administración Pública), Law N° 6227 of May 2, 1978; articles: 2 subsection a), b), c), 5 subsections a), c), e), h), i), k), m), 8 subsections a), g), h), i), j), 12, 13, 14, 15, 16, 17, 18, 19, and 20 of the Phytosanitary Protection Law (Ley de Protección Fitosanitaria), Law N° 7664 of April 8, 1997, and the Law on the Implementation of the Uruguay Round Agreements of Multilateral Trade Negotiations and the Agreement on Sanitary and Phytosanitary Measures, Law N° 7473 of December 20, 1994.
I.—That it is an essential function of the State to protect the health and life of people and animals, as well as to guarantee the protection of crops from pests that endanger or cause damage to agricultural production.
2.—That it is the responsibility of the Ministry of Agriculture and Livestock (Ministerio de Agricultura y Ganadería), through the State Phytosanitary Service (Servicio Fitosanitario del Estado), to ensure the phytosanitary protection of crops in our country, ordering, once the existence of a pest is verified, the technical and control measures that prevent its spread.
3.—That the giant African snail (Achatina fulica (Bowdich, 1822)) is considered one of the most damaging pests in the world due to its high resistance to environmental variables, polyphagous diet, and high reproductive potential that favors its dispersal, causing great economic damage to agriculture and the environment.
4.—That in the year 2021, the State Phytosanitary Service (Servicio Fitosanitario del Estado) confirmed the incursion of the Giant African Snail (Achatina fulica (Bowdich, 1822)) according to report N° 89840 from the Phytosanitary Diagnostic Laboratory of the State Phytosanitary Service (Laboratorio de Diagnóstico Fitosanitario del Servicio Fitosanitario del Estado), in the community of Curubandé, Curubandé district, Liberia canton, Guanacaste province, which triggered an alert and warranted that this pest be given adequate control, with the aim of preventing it from reaching populations that would generate risk to national agriculture, public health, and the environment.
5.—That, based on the foregoing, the Executive Branch decreed a National Emergency Status, by means of Decree N° 43001-MAG of May 10, 2021, which in its Article 5 established the necessary technical phytosanitary measures for the containment and eradication of the aforementioned pest, through the "Action Plan for the Giant African Snail Achatina fulica (Bowdich, 1822)" (Plan de acción para el caracol gigante africano Achatina fulica (Bowdich, 1822)).
6.—That the term set forth in Decree N° 43001-MAG of May 10, 2021, 7.—That from the year 2021 to the date of issuance of this Decree, the State Phytosanitary Service (Servicio Fitosanitario del Estado) has implemented the phytosanitary measures contained in the "Action Plan for the Giant African Snail Achatina fulica (Bowdich, 1822)" (Plan de acción para el caracol gigante africano Achatina fulica (Bowdich, 1822)) version 1 of February 2021, originally designed for emergency response.
8.—That, to date, each of the actions indicated in the "Action Plan for the giant African snail Achatina fulica (Bowdich, 1822)" (Plan de acción para el caracol gigante africano Achatina fulica (Bowdich, 1822)) of February 2021, has been fully completed, with the exception of the activities of placing and checking traps, due to a technical aspect, since the implementation of the use of said traps was not effective.
9.—That, according to the situation report as of June 2023, issued by the State Phytosanitary Service (Servicio Fitosanitario del Estado), in the last monitoring, two small live individuals and some empty adult shells of the Giant African Snail (Achatina fulica (Bowdich, 1822)) were detected.
10.—That, by reason of the foregoing, the authorities of the State Phytosanitary Service (Servicio Fitosanitario del Estado) have updated the "Action Plan for the Giant African Snail Achatina fulica (Bowdich, 1822)" (Plan de acción para el Caracol Gigante Africano Achatina fulica (Bowdich, 1822)), giving rise to a second version of the plan, dating from June 2023, which establishes the actions to be carried out in the defined attention area and the follow-up, for which reason it is necessary to extend the emergency response period until the year 2025.
11.—That the established actions must be continued in order to be able to decree the eradication of the pest and subsequent monitoring.
12.—That in accordance with the second and third paragraphs of Article 12 of the Regulation to the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures (Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos), Executive Decree N° 37045-MP-MEIC of February 22, 2012, this Decree does not create or modify procedures, requirements, or procedures, therefore it does not require the Regulatory Improvement Procedure (Trámite de Mejora Regulatoria). I.-Que es función esencial del Estado proteger la salud y la vida de las personas y animales, así como garantizar la protección de los cultivos de las plagas que pongan en riesgo o causen daños a la producción agrícola.
2.-Que corresponde al Ministerio de Agricultura y Ganadería a través del Servicio Fitosanitario del Estado, velar por la protección fitosanitaria de los cultivos en nuestro país, disponiendo, una vez comprobada la existencia de una plaga, las medidas técnicas y de control que eviten la propagación de estas.
3.-Que el caracol gigante africano (Achatina fulica (Bowdich, 1822) es considerado, una de las plagas más perjudiciales del mundo debido a su alta resistencia a variables ambientales, dieta polífaga y a un alto potencial reproductivo que favorece su dispersión, lo que causa grandes daños económicos en la agricultura y el ambiente.
4.-Que en el año 2021 el Servicio Fitosanitario del Estado confirmó la incursión de Caracol Gigante Africano (Achatina fulica (Bowdich, 1822) según reporte del laboratorio de Diagnóstico Fitosanitario del Servicio Fitosanitario del Estado N° 89840, en la comunidad de Curubandé, del distrito de Curubandé, cantón de Liberia, provincia de Guanacaste, lo que provocó alerta y ameritó que a esta plaga se le brindara un control adecuado, con la finalidad de que la misma no alcanzara poblaciones que generaran riesgo en el agro nacional, la salud pública y el ambiente.
5.-Que, sobre la base de lo anterior, el Poder Ejecutivo, decretó Estado de Emergencia Nacional, mediante el Decreto N° 43001-MAG del 10 de mayo del año 2021, el cual en su artículo 5, estableció las medidas fitosanitarias técnicas necesarias para la contención y erradicación de la plaga antes mencionada, mediante el "Plan de acción para el caracol gigante africano Achatinafulica (Bowdich, 1822)".
6.-Que el plazo dispuesto en el Decreto N° 43001-MAG del 10 de mayo del año 2021, venció el 10 de mayo del 2023.
7.-Que desde el año 2021 y hasta la fecha de emisión del presente Decreto, el Servicio Fitosanitario del Estado, ha implementado las medidas fitosanitarias que contiene el "Plan de acción para el caracol gigante africano Achatina fulica (Bowdich, 1822)" versión 1 del mes de febrero del año 2021, diseñado originalmente para la atención de la emergencia.
8.-Que, a la fecha, cada una de las acciones indicadas en el "Plan de acción para el caracol gigante africano Achatina fulica (Bowdich, 1822)" del mes de febrero del 2021, fueron cumplidas en su totalidad, con excepción de las actividades de colocación y revisión de trampas, debido a un aspecto de índole técnico, pues la implementación del uso de dichas trampas, no resultó efectiva.
9.-Que, de acuerdo con el informe de situación al mes de junio del 2023, emitido por el Servicio Fitosanitario del Estado, en el último monitoreo se detectaron dos individuos pequeños vivos y algunos caparazones de adultos vacíos del Caracol Gigante Africano (Achatina fulica (Bowdich, 1822).
10.-Que, a razón de lo anterior, las autoridades del Servicio Fitosanitario del Estado, han actualizado el "Plan de acción para el Caracol Gigante Africano Achatina fulica (Bowdich, 1822)", dando origen a una segunda versión del plan, que data del mes de junio del 2023, en el cual se establecen las acciones a desarrollar en el área de atención definida y el seguimiento, por lo que se requiere ampliar el plazo de atención de la emergencia hasta el año 2025.
11.-Que deben continuarse con las acciones establecidas, para poder decretar la erradicación de la plaga y posterior monitoreo.
12.-Que de conformidad con los párrafos segundo y tercero del artículo 12 del Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC del 22 de febrero de 2012, el presente Decreto no crea ni modifica trámites, requisitos o procedimientos por lo que no requiere del Trámite de Mejora Regulatoria. Por tanto,
