Reform of AyA Permanent Connection RequirementsReforma Reglamento para la prestación de servicios de Acueductos y

This procedure materializes the service, by means of the water connection (acometida de agua), which has been planned or not on public roads or on an aqueduct and right-of-way easement (servidumbre de acueducto y de paso) in favor of AyA; to which a meter or hydrometer is installed.

For these purposes, the applicant must meet the requirements set forth in the Regulation for the Provision of AyA Services, and in turn the operator must verify the existence of other conditions, which it can obtain, either because they are recorded in the institutional database or because it has access to the virtual platforms of other institutions, such as: the Property Registry (Registro de Propiedad), the National Cadastre (Catastro Nacional), and the Colegio de Ingenieros y Arquitectos de Costa Rica.

43665-MP-MEIC, called "Celerity of Administrative Procedures in the Costa Rican Public Sector" establishes in its

"Regarding verification. Any requirement demanded for an administrative procedure that is recorded in public databases of the Public Administration must be verified by the body or entity before which the procedure is carried out. It is strictly prohibited to request from the administered party any certification, verification, or information that is recorded in the public databases of another public entity or body. Each institution must define internally the manner in which it will leave a record of the verification in the administrative file of each procedure.

In cases of force majeure or fortuitous event, in which the entity or public body that will verify the required information cannot consult the public databases, it may request a Sworn Statement (Declaración Jurada) or, failing that, carry out the subsequent verification of said information." For its part, article 269, subsection 1) of the Ley General de la Administración Pública establishes:

37045-MP-MEIC - Regulation to the Law for the Protection of the Citizen from Excess Requirements and Administrative Procedures, and its amendments, state that administrative procedures must be structured in such a way that they are clear, simple, agile, rational, and easily understood by individuals, in order to improve their relations with the Public Administration, making its activity effective and efficient. Furthermore, through the permanent review of the procedure processes executed by the Public Administration, excesses of documentation and requirements that have no legal basis and lack the respective technical studies that justify them shall be eliminated. Such processes must obey clear and simple rules easily complied with by the citizen.

article 2° of this law, the Instituto Costarricense de Acueductos y Alcantarillados shall have the following powers and prerogatives, in addition to those that general laws grant to establishments of its nature:

(...)

• j)It shall issue its own regulations." (....)

(...)

i. To issue, amend, and interpret the internal regulations necessary for the better development of the Institute's purposes; (...)

article 11 of the Ley General de la Administración Pública; a principle that subjects the Administration to acting in accordance with the legal system. Under this hypothesis, it may only carry out those acts or provide those public services that said system authorizes, according to the hierarchical scale of its sources. Thus, the acts emanating from it must be previously authorized by a written rule, that is, the act must be regulated. Por Tanto; Based on the provisions of article 11 of the Constitución Política; articles 11, 269 subsection 1) of the Ley General de la Administración Pública; articles 3 and 4 of Law 8220 and its amendments Law 8990 and Law 10700; articles 4 and 5 of Decreto Ejecutivo No. 37045-MP-MEIC and its amendments; articles 5 and 11 of the Constitutive Law of AyA and the Decree of Celerity No. 43665-MP-MEIC, the following modification to the RPS is approved:

For the request for a permanent connection, the property owner, or the authorized applicant or their legal representative, as provided in article 15 of this Regulation, must submit, through the physical or virtual platforms that AyA or the delegated operator offers, whether in physical or digital form, the following requirements:

a. Application form, provided by AyA, completed and signed by the owner, the authorized applicant, or their legal representative.

b. Identification document of the owner, authorized applicant, or their legal representative. If there is access to the Civil Registry's technological platform on which the photo and signature of the interested party are displayed, AyA shall exempt them from presenting this requirement and it will only be necessary to provide the identification number of the identity card.

c. Cadastral plan (plano catastrado). In the event that the property does not have a cadastral plan, or is in the process of a segregation or subdivision (fraccionamiento), a survey plan (plano de agrimensura) must be submitted that complies with the provisions of Article No. 2 subsection q) of Decreto Ejecutivo No. 34331, current Regulation to the National Cadastre Law with its respective filing slip (minuta de presentación) and the corresponding seal of the Colegio Federado de Ingenieros y Arquitectos (CFIA) pursuant to the provisions of the current Special Regulation for the Topography Project Administrator (APT) of the CFIA and its amendments or the regulations that replace them. If technological feasibility exists, AyA shall exempt the applicant from presenting this requirement.

d. Project Number processed through the Construction Project Administration (APC) platform of the CFIA, duly approved, in order for AyA to verify the existence of the requirement of a valid construction permit, in the case of a property to be built. The permit must coincide with the flow rate and purposes for which the availability was approved.

e. Payment of the connection fee, in accordance with the provisions of article 76 of this regulation.

f. In the case of requests for new services for activities that generate special-type wastewater (aguas residuales de tipo especiales), the interested party must submit a sworn statement indicating that the discharge into the sanitary sewer system will comply with the regulation and the approval note from the Ministerio de Salud, describing the type of activity to be developed, as well as the quantity and quality of the discharge to be released; likewise, the specification of the treatment system to comply with current environmental regulations.

g. In those cases where the public service must be provided, in territories of the country with special characteristics, under the modality of territories administered by the State or its institutions with a special legal regime such as in the maritime-terrestrial zone (zona marítimo terrestre), in border zones (zonas fronterizas), in leasehold zones (zonas en arriendo), in indigenous territories (territorios indígenas), in tourist development poles (polos de desarrollo turístico), in areas within the railway right-of-way (derecho de vía férrea), among others, the applicants must submit the express authorization of the corresponding Entity, according to the regulation that governs them.

In accordance with the verification of the necessary conditions for the approval of services indicated generally in article 15 of this Regulation, it is the responsibility of AyA to verify the requirements detailed therein, as well as the general conditions established therein for all procedures.

When the administered party appears before AyA to request the sanitation and/or water service for population use on an agricultural, forest, or livestock plot, and for the purpose of constructing the dwellings or buildings authorized by the current INVU Regulation for the National Control of Subdivisions (Fraccionamientos) and Urbanizations (Urbanizaciones), they must comply with the requirements requested for such purpose in this regulation for each scenario.

Once the submission of all requirements is completed; the Institution shall have a period of 15 business days for the resolution of the request.

To provide the aqueduct and sanitation service in the case of unregistered lands and when technically feasible, the property must have a positive service availability, associated with the purposes, nature, and purpose for which it was approved. In addition, it must meet the following requirements in physical form or digital format:

a. Application form, provided by AyA, completed and signed by the possessor or legal representative.

b. Presentation of the identification document of the property holder or legal representative.

c. The possessor must sign the sworn statement, the form for which will be supplied by AyA, which will be signed by the applicant and two witnesses with a description of the nature of the property, indicating what their possessory acts consist of, the existence of buildings, the improvements made, and that the property is not registered.

d. Payment of the connection fees, in accordance with the provisions of article 76 of this regulation.

In accordance with the verification and rectification of necessary conditions for the approval of services, AyA shall verify, through the official and available virtual platforms, the following conditions:

I. Registry certifications of Cadastral Plans

II.Registry or administrative certifications of valid legal entities, agents with powers of judicial and extrajudicial representatives or those empowered for the purpose, guardians, executors, and curators.

In the event that no cadastral plan exists for the property, a survey plan must be submitted that complies with the provisions of Article No. 2 subsection q) of the current Regulation to the National Cadastre Law with its respective filing slip and the corresponding seal of the CFIA pursuant to the provisions of the current Special Regulation for the Topography Project Administrator (APT) of the CFIA and its amendments or the regulations that replace them. If technological feasibility exists, AyA shall exempt the applicant from presenting this requirement.

e. Project Number processed through the Construction Project Administration (APC) platform of the CFIA, duly approved, in order for AyA to verify the existence of the requirement of a valid construction permit, in the case of a property to be built. The permit must coincide with the flow rate and purposes for which the availability was approved.

f. That the possessor and their property are not in default with AyA. Cases defined by other rules or agreements are excepted.

In the event that registry movements related to the ownership of the property are detected, AyA shall process the request for the legitimate holder for such purpose.

However, in the face of cadastral variations, such as modification of areas and/or boundaries that affect an increase in the flow rate and the number of services defined for the granting of the service availability certificate, the extension does not proceed, and therefore the interested party must carry out the procedure indicated in article 30 of this regulation.

Once the submission of all requirements is completed; the Institution shall have a period of 15 business days for the resolution of the request.

Firm Agreement.

Con este trámite se materializa el servicio, mediante la acometida de agua, que ha sido prevista o no sobre vía pública o sobre servidumbre de acueducto y de paso a favor de AyA; a la cual se le instala un medidor o hidrómetro.

Para tales efectos, el solicitante debe de cumplir los requisitos dispuestos en el Reglamento para la Prestación de los Servicios de AyA, y a su vez el operador debe de verificar la existencia de otras condiciones, las cuales puede lograr, ya sea porque constan en la base de datos institucional o bien, porque tiene acceso a las plataformas virtuales de otras instituciones, como por ejemplo: el Registro de Propiedad, el Catastro Nacional y el Colegio de Ingenieros y Arquitectos de Costa Rica.

"De la verificación. Cualquier requisito exigido para un trámite administrativo que conste en bases de datos públicas de la Administración Pública, deberá ser verificado por el órgano o ente ante el cual se realiza la gestión. Queda terminantemente prohibido solicitar al administrado, cualquier certificación, constancia o información que conste en las bases de datos públicas de otra entidad u órgano público. Cada institución deberá definir a lo interno, la forma como dejará la constancia de la verificación en el expediente administrativo de cada trámite.

En los casos de fuerza mayor o caso fortuito, en la que la entidad u órgano público que va a verificar la información requerida no pueda consultar las bases de datos públicas, podrá solicitar una Declaración Jurada o en su defecto realizar la verificación posterior de dicha información".

Por su parte, el artículo 269 inciso 1) de la Ley General de la Administración Pública establece:

"1. La actuación administrativa se realizará con arreglo a normas de economía, simplicidad, celeridad y eficiencia".

Además, mediante la revisión permanente de los procesos de trámites que ejecuta la Administración Pública, se eliminarán los excesos de documentación y requisitos que no tengan fundamento legal y no cuenten con los respectivos estudios técnicos que los justifiquen. Dichos procesos deberán obedecer a reglas claras y sencillas de fácil cumplimiento por el ciudadano.

(...)

• j)Se dará sus propios reglamentos." (....)

(...)

i. Dictar, reformar e interpretar los reglamentos internos necesarios para el mejor desarrollo de los fines del Instituto; (...)

Bajo esta hipótesis, solo podrá realizar aquellos actos o prestar aquellos servicios públicos que autorice dicho ordenamiento, conforme a la escala jerárquica de sus fuentes. De tal forma, los actos que de ella emanen, deberán estar previamente autorizados por norma escrita, es decir, el acto deberá estar regulado. Por Tanto; Con fundamento en lo dispuesto en el artículo 11 de la Constitución Política; artículos 11, 269 inciso 1) de la Ley General de la Administración Pública; artículos 3 y 4 de la Ley 8220 y sus reformas Ley 8990 y Ley 10700; artículos 4 y 5 del Decreto Ejecutivo N° 37045-MP-MEIC y sus reformas; artículos 5 y 11 de la Ley Constitutiva de AyA y el Decreto de Celeridad N° 43665-MP-MEIC, se aprueba la siguiente modificación al RPS:

Para la solicitud de una conexión permanente, el propietario del inmueble, o el solicitante autorizado o su representante legal, conforme lo dispone el artículo 15 de este Reglamento, deberá presentar ante las plataformas físicas o virtuales que AyA o el operador delegado ofrezca, ya sea forma física o digital, los siguientes requisitos:

a. Formulario de solicitud, proporcionado por AyA, completo y firmado por el propietario, el solicitante autorizado, o su representante legal.

b. Documento de identificación del propietario, solicitante autorizado o su representante legal. De existir acceso a la plataforma tecnológica del Registro Civil en el que se despliegue la foto y firma del interesado, AyA lo eximirá de la presentación de este requisito y únicamente será necesario que proporcione el número de identificación de la cédula de identidad.

c. Plano catastrado. En caso de que el inmueble no cuente con plano catastrado, o bien, se encuentre en proceso de una segregación o fraccionamiento, deberá de presentar un plano de agrimensura que cumpla con lo estipulado en el Artículo N° 2 inciso q) del Decreto Ejecutivo N° 34331, Reglamento de la Ley de Catastro Nacional vigente con su respectiva minuta de presentación y el correspondiente sello del Colegio Federado de Ingenieros y Arquitectos (CFIA) conforme a lo dispuesto en el Reglamento Especial del Administrador de Proyectos de Topografía (APT) del CFIA vigente y sus reformas o las normativas que los sustituya. De existir factibilidad tecnológica, AyA eximirá al solicitante de la presentación de este requisito.

d. Número de Proyecto tramitado ante la plataforma Administración de Proyectos de Construcción (APC) del CFIA, debidamente aprobado con el fin de que AyA constate la existencia del requisito del permiso de construcción vigente, en caso de que se trate de un inmueble por edificar. El permiso deberá ser coincidente con el caudal y fines para el que se aprobó la disponibilidad.

e. El pago de la tarifa de conexión, conforme a lo establecido en el artículo 76 de este reglamento.

f. En el caso de solicitudes de nuevos servicios, para actividades que generen aguas residuales de tipo especiales, el interesado deberá presentar, una declaración jurada en la que indique que la descarga al alcantarillado sanitario, cumplirá con el reglamento y nota de aprobación del Ministerio de Salud, que describa el tipo de actividad a desarrollar, así como la cantidad y calidad de la descarga a verter; asimismo la especificación del sistema de tratamiento para cumplir con la normativa ambiental vigente.

g. En aquellos casos en que se deba brindar el servicio público, en territorios del país con características especiales, bajo la modalidad de territorios administrados por el Estado o sus instituciones con régimen jurídico especial como en la zona marítimo terrestre, en las zonas fronterizas, en las zonas en arriendo, en los territorios indígenas, en los polos de desarrollo turístico, en las áreas dentro del derecho de vía férrea, entre otros, los solicitantes deberán presentar la autorización expresa del Ente correspondiente, según la norma que los regule.

De acuerdo con la verificación de las condiciones necesarias para la aprobación de los servicios indicada de manera general en el artículo 15 de este Reglamento, le corresponde a AyA verificar los requisitos ahí desglosados, así como las condiciones generales ahí establecidas para todos los trámites.

Cuando el administrado se apersone ante el AyA a solicitar el servicio de saneamiento y/o agua para uso poblacional en una parcela agrícola, forestal o pecuaria, y para efectos de construir las viviendas o edificaciones que autoriza el Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones del INVU vigente, deberá el cumplir con los requisitos que para tal fin se solicitan en la presente normativa para cada supuesto.

Cumplida la presentación de la totalidad de requisitos; la Institución contará con un plazo de 15 días hábiles para la resolución de la solicitud.

Para brindar el servicio de acueducto y saneamiento en el caso de terrenos sin inscribir y cuando técnicamente sea factible, el inmueble debe contar con disponibilidad de servicios positiva, asociada a los fines, naturaleza y propósito para la que fue aprobada. Además, debe cumplir los siguientes requisitos de forma física o formato digital:

a. Formulario de solicitud, proporcionado por AyA, completo y firmado por el poseedor o representante legal.

b. Presentación del documento de identificación del titular del inmueble o representante legal.

c. El poseedor deberá suscribir la declaración jurada cuyo formulario será suplido por AyA, la cual será firmada por el solicitante y dos testigos con una descripción de la naturaleza del inmueble, señalando en qué consisten sus actos posesorios, la existencia de edificación, las mejoras realizadas y que la propiedad no se encuentra inscrita.

d. Cancelación de las tarifas de conexión, conforme a lo establecido en el artículo 76 de este reglamento.

De acuerdo con la verificación y subsanación de condiciones necesarias para la aprobación de servicios, AyA verificará a través de las plataformas virtuales oficiales y disponibles, las siguientes condiciones:

I. Certificaciones registrales de Planos Catastrados

II.Certificaciones registrales o administrativas de personerías jurídicas vigentes, apoderados con facultades de representantes judiciales y extrajudiciales o facultados al efecto, tutores, albaceas y curadores.

En caso de que para la propiedad no exista plano catastrado, deberá presentar un plano de agrimensura que cumpla con lo estipulado en el Artículo N° 2 inciso q) Reglamento de la Ley de Catastro Nacional vigente con su respectiva minuta de presentación y el correspondiente sello del CFIA conforme a lo dispuesto en el Reglamento Especial del Administrador de Proyectos de Topografía (APT) del CFIA vigente y sus reformas o las normativas que los sustituya. De existir factibilidad tecnológica, AyA eximirá al solicitante de la presentación de este requisito.

e. Número de Proyecto tramitado ante la plataforma Administración de Proyectos de Construcción (APC) del CFIA, debidamente aprobado con el fin de que AyA constate la existencia del requisito del permiso de construcción vigente, en caso de que se trate de un inmueble por edificar. El permiso deberá ser coincidente con el caudal y fines para el que se aprobó la disponibilidad.

f. Que el poseedor y su inmueble, no se encuentren con deudas en mora con AyA. Se exceptúan los casos definidos por otras normas o convenios.

En caso de que se detecten movimientos registrales relacionados con la titularidad del inmueble, AyA tramitará la solicitud al titular legitimado para tal efecto.

No obstante, ante variaciones catastrales, tales como modificación de áreas y/o linderos que incidan en un incremento del caudal y del número de servicios definidos para el otorgamiento de la constancia de disponibilidad de servicios, no procede la prórroga y por tanto deberá el interesado realizar el trámite señalado en el artículo 30 de este reglamento.

Cumplida la presentación de la totalidad de requisitos; la Institución contará con un plazo de 15 días hábiles para la resolución de la solicitud.

Acuerdo Firme.
