in the entirety of the text - Complete Text of Norm 44046 Declares of public interest the construction of public community docks in the Province of Puntarenas No. 44046-MOPT THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF PUBLIC WORKS AND TRANSPORT In exercise of the powers and prerogatives conferred by articles 140 subsection 3) and 146 of the Political Constitution; based on articles 1, 2 and 4 of Ley N° 3155, of August 5, 1963 and its amendments; articles 22 and 23 of Ley N° 6043, of March 2, 1977; and articles 25 subsection 1), 27 subsection 1) and 28 subsection 2.b) of Ley N° 6227, of May 2, 1978.
I.-That Ley N° 3155 of August 5, 1963 and its amendments, confers upon the Ministry of Public Works and Transport the competence to plan, build, improve and maintain deep-water and cabotage ports, inland navigation routes and terminals, and ferry systems.
II.-That, regarding maritime transport, the port infrastructure on the coasts allows for adequate loading and unloading tasks and maneuvers with the proper safeguarding and preventive measures for the safety of persons, vessels and other material and natural assets.
III.-That, in the case of coastal communities, the construction of minor port infrastructure allows them to have the minimum conditions suitable for carrying out loading and unloading tasks, in a comfortable, safe manner and with adequate risk prevention, for the intermodality of maritime-land transport and vice versa with which the inhabitants of these territories live daily, given their inescapable link to the sea.
IV.-That various coastal communities of the Golfo de Nicoya, as well as Pavones, Zancudo and La Pitahaya in the Estero de Puntarenas do not have minor port infrastructure that allows maritime transport in a safe and adequate manner.
V.-That the absence of minor port infrastructure in the coastal communities of the Golfo de Nicoya, Pavones, Zancudo and La Pitahaya in the Estero de Puntarenas puts at risk the life, physical integrity and safety of the persons, inhabitants of these zones, who use vessels to transport themselves, which compromises public safety and public order.
VI.-That it is necessary, convenient and timely for the public interest, the construction of several public docks in the province of Puntarenas with which to protect the life and safety of persons.
VII.-That, by virtue of the foregoing considerations, for reasons of timeliness and convenience for public safety and public order, in matters of transit and transport via maritime vessels, it is necessary to declare of public interest the construction of public docks in the Province of Puntarenas. Therefore, They decree:

en la totalidad del texto - Texto Completo Norma 44046 Declara de interés público la construcción de embarcaderos públicos vecinales en la Provincia de Puntarenas N° 44046-MOPT EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE OBRAS PÚBLICAS Y TRANSPORTES En el ejercicio de las facultades y prerrogativas conferidas en los artículos 140 inciso 3) y 146 de la Constitución Política; con fundamento en los artículos 1, 2 y 4 de la Ley N° 3155, del 5 de agosto de 1963 y sus reformas; los artículos 22 y 23 de la Ley N° 6043, del 2 de marzo de 1977; y los artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2.b) de la Ley N° 6227, del 2 de mayo de 1978.
I.-Que la Ley N° 3155 de 5 de agosto de 1963 y sus reformas, confiere al Ministerio de Obras Públicas y Transportes la competencia para planificar, construir, mejorar y mantener los puertos de altura y cabotaje, las vías y terminales de navegación interior y los sistemas de transbordadores.
ll.-Que, en cuanto al transporte marítimo, la infraestructura portuaria en las costas permite las adecuadas labores y maniobras de embarque y desembarque con el adecuado resguardo y medidas preventivas para la seguridad de las personas, las embarcaciones y otros bienes materiales y naturales.
III.-Que, para el caso de las comunidades costeras, la construcción de infraestructura portuaria menor permite que éstas cuenten con las condiciones mínimas aptas para la realización de labores de embarque y desembarque, de forma cómoda, segura y con la adecuada prevención de riesgos, para la intermodalidad de transporte marítimo-terrestre y viceversa con la que conviven diariamente las personas habitantes de estos territorios, dado su ineludible ligamen al mar.
IV.-Que diversas comunidades costeras del Golfo de Nicoya, así como de Pavones, Zancudo y La Pitahaya en el Estero de Puntarenas no cuentan con infraestructura portuaria menor que permita el transporte marítimo de manera segura y adecuada.
V.-Que la ausencia de infraestructura portuaria menor en las comunidades costeras del Golfo de Nicoya, Pavones, Zancudo y de La Pitahaya en el Estero de Puntarenas pone en riesgo la vida, integridad física y seguridad de las personas, habitantes de estas zonas, que utilizan embarcaciones para transportarse, lo cual compromete la seguridad y el orden público.
VI.-Que es necesaria, conveniente y oportuna para el interés público, la construcción de varios embarcaderos públicos en la provincia de Puntarenas con los cuales se proteja la vida y seguridad de las personas.
VII.-Que, en virtud de las anteriores consideraciones, por razones de oportunidad y conveniencia para la seguridad pública y el orden público, en materia de tránsito y transporte mediante embarcaciones marítimas, es necesario declarar de interés público la construcción de embarcaderos públicos en la Provincia de Puntarenas. Por tanto,
