This agreement amends Articles 4 and 5 of Agreement AJDIP/280-2014 to clarify restrictions on fishing and storage of live bait in the Costa Rican Pacific Ocean. in the entirety of the text - Complete Text of Regulation 252 Reform of Management Measures for the Use of Live Bait by the Commercial Fishing Fleet and Sport Fishing in the Costa Rican Pacific Ocean COSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE AJDIP/252-2023.-Puntarenas, on the seventeenth day of the month of October, two thousand twenty-three.
1That it is the responsibility of the Costa Rican Institute of Fisheries and Aquaculture, INCOPESCA, to coordinate the fishing sector, as well as to promote and manage the development of fisheries and aquaculture at the national level.
2That by means of Agreement AJDIP/280-2014, the Management Measures for the use of Live Bait by the Commercial Fishing Fleet and Sport Fishing in the Costa Rican Pacific Ocean were established.
3That by means of Board of Directors Agreement AJDIP/190-2023, given observations from the National Coast Guard Service and small-scale fishing sectors, the application of Article 4, subsections a, b, and c; as well as the entirety of Article 5, of Agreement AJDIP/280-2014, was temporarily suspended, because it was causing detriment to small-scale commercial fishing activities, tourism-related fishing, and sport fishing.
4That due to the foregoing, a report was received through official communication INCOPESCA-PE-AJ144-2023, signed by the Directorate of Fisheries and Aquaculture Management and the Legal Advisory Office, in which it is recommended to modify Board of Directors Agreement AJDIP/280-2014, since its reading shows that the small-scale commercial fleet has been excluded from the possibility of fishing for and storing live bait in live wells within the areas described in subsections a, b, and c of Article 4, a situation that must be clarified, as must the limitations regarding commercial longline fishing, tourism-related fishing, and sport fishing.
5That in order to avoid detriment to the small-scale commercial fishing fleet, tourism-related fishing, and sport fishing, and since it is evident that there are drafting errors in Agreement AJDIP/280-2014, which was issued with the purpose of regulating fishing with live bait carried out by fishing fleets using surface longlines, it is recommended, for legal certainty, as well as the need to maintain in a clear and transparent manner the regulation of the exploitation of sailfish for tourism-related and sport fishing, and to respect the activities that artisanal fishers of our country have long carried out, mainly in the inner part of the gulfs defined in Article 4 of said Agreement.
6That the technical criteria that served as the basis for adopting Agreement AJDIP/280-2014 have not suffered injury that would justify carrying out new assessments in this regard, given that the purpose of the aforementioned Agreement is to amend its drafting.
7That having received the explanations from the Directorate of Fisheries and Aquaculture Management and the Institutional Legal Advisory Office and having carried out the corresponding analysis and assessment, we have proceeded to adjust and clarify the inconsistencies found in Agreement AJDIP/280-2014, thereby fulfilling the mandate derived from Agreement AJDIP/190-2023 and guaranteeing compliance with the principle of sustainable democratic access to fishery resources, which is why the latter, having fulfilled its purposes and objectives, has no legal reason to remain in force, and therefore the appropriate action is to repeal it.
8That INCOPESCA must ensure that the fisheries legal system is equitable and facilitative for all the country's fishing fleets, and for this reason, this Agreement aims to guarantee equal opportunities to all sectors alike, in this case rectifying an unjustified detriment against the artisanal fishing fleet.
9That in compliance with the provisions of Article 50 of the Political Constitution of Costa Rica, as well as the application of the principles of sustainable development, precautionary principle, preventive principle, and sustainable democratic access to fishery resources, and in accordance with the provisions of Law 7384, the Law Creating the Costa Rican Institute of Fisheries and Aquaculture, and Law 8436, the Law of Fisheries and Aquaculture, after analyzing the proposal presented, the Board of Directors of the Costa Rican Institute of Fisheries and Aquaculture, Therefore;
AGREES 1º-To modify Articles 4 and 5 of Board of Directors Agreement AJDIP/280-2014, so that henceforth they shall read as follows:
"Article 4. A prohibition zone is established for the fishing and storage of live bait in live wells, for the commercial fleet except tourism-related fishing and small-scale fishing; as well as for sport fishing, except in Responsible Fishing Marine Areas that so authorize; according to the following demarcation and characteristics:
a. In Golfo Dulce from an imaginary line between Cabo Matapalo (08°22'14",16 North Latitude, 83°17'43",01 West Longitude) and Punta Banco (08°21'18",21 North Latitude, 83°08'41",05 West Longitude), and from this line inland to the end of Golfo Dulce (towards Rincón de Osa, 08°41'24",83 North Latitude, 83°29'00",29 West Longitude), for vessels that do not have the respective valid fishing permits for this purpose.
b. In the Golfo de Nicoya from an imaginary line between Punta Peñón (09°53'31" North Latitude, 84°43'52" West Longitude) and Isla Negritos (09°49'14" North Latitude, 84°49'35" West Longitude), and from this line inland to the mouth of the Río Tempisque (10°15'21",6 North Latitude, 85°15'59",24 West Longitude), for those vessels that do not have the respective valid fishing permits for this purpose.
c. In the Golfo de Papagayo from an imaginary line between Cabo Velas (10°21'14",52 North Latitude, 85°52'35",74 West Longitude) to Punta Blanca (10°53'23",73 North Latitude, 85°57'00",04 West Longitude), and from this line inland, for those vessels that do not have the respective valid fishing permits for this purpose.
Considering:

Both the tourism-related commercial fleet and the small-scale fleet that do not use surface longline as fishing gear, as well as sport fishing, are authorized to carry out fishing activities using live bait within those 30 miles, in accordance with their navigation autonomy in concordance with the conditions and specifications authorized by their valid fishing license.
Within the 30 miles indicated in the first paragraph of this article, vessels belonging to the medium-scale commercial fishing fleet and advanced commercial fishing may capture bait in authorized sites and transport it in live wells for use in the vessel's own fishing operations; they may never carry out fishing activities with live bait using surface longline within the 30 miles established in this regulation." 2º-To repeal Board of Directors Agreement AJDIP/190-2023, having fulfilled its purposes.
3º-In all other respects, Agreement AJDIP/280-2014 and its amendments remain unchanged.
4º-Final Agreement. Communicate this Agreement to the National Coast Guard Service, the National Animal Health Service, the Ministry of Environment, and the Ministry of Public Security, for their respective competencies.
5º-Publish in the Official Gazette La Gaceta.

en la totalidad del texto - Texto Completo Norma 252 Reforma Medidas de ordenamiento para el uso de carnada viva para la flota pesquera comercial y de pesca deportiva en el Océano Pacífico Costarricense INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA AJDIP/252-2023.-Puntarenas, a los diecisiete días del mes octubre de dos mil veintitrés.
1Que corresponde al Instituto Costarricense de Pesca y Acuicultura, INCOPESCA, coordinar el sector pesquero, así como promover y ordenar el desarrollo de la pesca y la acuicultura a nivel nacional.
2Que por medio de Acuerdo AJDIP/280-2014 se establece las Medidas de Ordenamiento para el uso de Carnada Viva para la Flota Pesquera Comercial y de Pesca Deportiva en el Océano Pacífico Costarricense.
3Que por medio de Acuerdo de Junta Directiva AJDIP/190-2023, ante observaciones del Servicio Nacional de Guardacostas y sectores de pesca de pequeña escala, se suspendió de manera temporal la aplicación del artículo 4° incisos a, b y c; así como la totalidad del artículo 5°, del Acuerdo AJDIP/280-2014, en razón de que se estaba provocando afectación a las actividades de pesca comercial en pequeña escala, turística, así como la pesca deportiva.
4Que en razón de lo anterior, se recibe informe por medio del oficio INCOPESCA-PE-AJ144-2023, suscrito por la Dirección de Ordenamiento Pesquero y Acuícola y la Asesoría Jurídica, en el cual se recomienda modificar el Acuerdo de Junta Directiva AJDIP/280-2014, por cuanto de su lectura se desprende que, en cuanto a la flota comercial de pequeña escala, ésta ha quedado excluida de la posibilidad de realizar la pesca y almacenamiento de carnada viva en viveros dentro de las áreas descritas en los incisos a, b y c del artículo 4, situación que debe ser clarificada, al igual que las limitaciones en cuanto a la pesca comercial de palangre, turística, así como la pesca deportiva.
5Que en razón de evitar un perjuicio a la flota de pesca comercial pequeña escala, turística, así como a la pesca deportiva y siendo evidente que existen errores en la redacción en el Acuerdo AJDIP/280-2014, el cual se emitió con el propósito de regular la pesca con carnada viva que realizan las flotas pesqueras que utilizan palangre de superficie, se recomienda por seguridad jurídica, así como, la necesidad de mantener de manera clara y diáfana la regulación del aprovechamiento del pez vela dirigido a la pesca turística y deportiva, y respetar las actividades que desde hace mucho tiempo realizan los pescadores artesanales de nuestro país, principalmente en la parte interna de los golfos definidos en el artículo 4 de dicho Acuerdo.
6Que los criterios técnicos que sirvieron de base para adoptar el Acuerdo AJDIP/280-2014 no han sufrido lesión que justifique realizar nuevas valoraciones en este sentido dado que el objeto del Acuerdo de marras es enmendar la redacción del mismo.
7Que habiendo recibido las explicaciones por parte de la Dirección de Ordenamiento Pesquero y Acuícola y la Asesoría Jurídica Institucional y realizado el análisis y valoración correspondiente, se ha procedido a ajustar y clarificar las inconsistencias encontradas en el Acuerdo AJDIP/280-2014, cumpliendo con ello el mandato derivado del Acuerdo AJDIP/190-2023 y garantizando el cumplimiento del principio de acceso democrático sostenible a los recursos pesqueros, razón por la cual este último habiendo cumplido sus fines y objetivos no tiene razón jurídica de permanecer vigente, por lo que lo procedente es derogarlo.
8Que el Incopesca debe procurar que el ordenamiento jurídico pesquero sea equitativo y facilitador para todas las flotas pesqueras del país y en razón de ello con el presente Acuerdo se pretende garantizar igualdad de oportunidades a todos los sectores por igual, en este caso subsanando un perjuicio injustificado en contra de la flota pesquera artesanal.
9Que en cumplimiento de lo que dispone el artículo 50 de la Constitución Política de Costa Rica, así como de la aplicación de los principios de desarrollo sostenible, precautorio, preventivo y de acceso democrático sostenible a los recursos pesqueros y de conformidad con lo dispuesto en la Ley 7384 Ley de Creación del Instituto Costarricense de Pesca y Acuicultura, Ley 8436 Ley de Pesca y Acuicultura, luego de analizada la propuesta presentada, la Junta Directiva del Instituto Costarricense de Pesca y Acuicultura, Por tanto;
ACUERDA 1º-Modificar los artículos 4° y 5° del Acuerdo de Junta Directiva AJDIP/280-2014, con el fin de que en adelante se lean en los siguientes términos:
"Artículo 4. Se establece una zona de prohibición para la pesca y almacenamiento de carnada viva en viveros, a la flota comercial excepto la pesca turística y la pesca pequeña escala; así como a la pesca deportiva, salvo en las Áreas Marinas de Pesca Responsable que así lo autoricen; según la siguiente demarcación y características:
a. En el Golfo Dulce a partir de una línea imaginaria comprendida entre Cabo Matapalo (08°22'14",16 Latitud Norte, 83°17'43",01 Longitud Oeste) y Punta Banco (08°21'18",21 Latitud Norte, 83°08'41",05 Longitud Oeste), y de esta línea aguas adentro hasta el final del Golfo Dulce (hacia Rincón de Osa, 08°41'24",83 Latitud Norte, 83°29'00",29 Longitud Oeste), a embarcaciones que no cuenten con los respectivos permisos de pesca vigentes para tal fin.
b. En el Golfo de Nicoya a partir de una línea imaginaria comprendida entre Punta Peñón (09°53'31" Latitud Norte, 84°43'52" Longitud Oeste) e Isla Negritos (09°49'14" Latitud Norte, 84°49'35" Longitud Oeste), y de esta línea aguas adentro hasta la desembocadura del Río Tempisque (10°15'21",6 Latitud Norte, 85°15'59",24 Longitud Oeste), a aquellas embarcaciones que no cuenten con los respectivos permisos de pesca vigentes para tal fin.
c. En el Golfo de Papagayo a partir de una línea imaginaria comprendida entre Cabo Velas (10°21'14",52 Latitud Norte, 85°52'35",74 Longitud Oeste) a Punta Blanca (10°53'23",73 Latitud Norte, 85°57'00",04 Longitud Oeste), y de esta línea aguas adentro, a aquellas embarcaciones que no cuenten con los respectivos permisos de pesca vigentes para tal fin.
Considerando:

Quedan autorizadas tanto la flota comercial turística y pequeña escala que no utilice como arte de pesca palangre de superficie, así como la pesca deportiva, a realizar actividades de pesca utilizando carnada viva dentro de esas 30 millas, de conformidad con su autonomía de navegación en concordancia con las condiciones y especificaciones que le autorice su licencia de pesca vigente.
En las 30 millas indicadas en el primer párrafo de este artículo, las embarcaciones pertenecientes a la flota de pesca comercial de mediana escala y la pesca comercial de avanzada podrán capturar carnada en los sitios autorizados y transportarla en viveros para su utilización en faenas de pesca propias de la embarcación, nunca podrán realizar actividades de pesca con carnada viva utilizando palangre de superficie dentro de las 30 millas establecidas en esta regulación." 2º-Derogar el Acuerdo de Junta Directiva AJDIP/190-2023, al haber cumplido sus fines.
3º-En lo demás el Acuerdo AJDIP/280-2014 y sus reformas permanece incólume.
4º-Acuerdo Firme. Comuníquese este Acuerdo al Servicio Nacional de Guardacostas, Servicio Nacional de Salud Animal, Ministerio de Ambiente y Ministerio de Seguridad Pública, para lo de sus competencias.
