throughout the entirety of the text - Complete Text of Norm 009 Delimitation of the public zone corresponding to the estuary- mangrove sectors in the central sector of Quepos, sector 2 "Los Alfaro", sector 3 "Junta Naranjo", sector 4 "Cementerio" in District 01° Quepos, Canton 06° Quepos, Province 06° Puntarenas NATIONAL GEOGRAPHIC INSTITUTE DEPARTMENT OF GEODESY AND GEOPHYSICS NOTICE Nº 009-2023 MARITIME TERRESTRIAL ZONE DELIMITATION OF THE PUBLIC ZONE CORRESPONDING TO THE ESTUARY-MANGROVE SECTORS IN THE CENTRAL SECTOR OF QUEPOS, SECTOR 2 "LOS ALFARO", SECTOR 3 "JUNTA NARANJO", SECTOR 4 "CEMENTERIO" IN DISTRICT 01º QUEPOS, CANTON 06º QUEPOS, PROVINCE 06º PUNTARENAS Based on the provisions set forth in articles 140 and 240 of Law Nº 6227, General Law of Public Administration, dated May 2, 1978, and its amendments; Law Nº 59, Law of Creation and Organization of the National Geographic Institute, dated July 4, 1944, and its amendments; Law Nº 8905, Amendment of article 2 of Law N° 5695, Creation of the National Registry, and its amendments; and modification of Law N° 59, Creation and Organization of the National Geographic Institute, of July 4, 1944, and its amendments, dated December 7, 2010; Law Nº 6043, Law on the Maritime Terrestrial Zone, dated March 2, 1977, with its respective regulation; and articles 2 and 3 of Law Nº 5695, Law of Creation of the National Registry, dated May 28, 1975, and its amendments.

1. 1That through Law Nº 8905, the National Geographic Institute, hereinafter IGN, is established as a dependency of the National Registry, which shall sign the contracts and agreements necessary for the exercise of its functions. Likewise, in accordance with Law Nº 59, the IGN is the scientific and technical dependency governing national cartography, intended for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica, and for the studies, research, or work, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature that are related to said works, in order to support planning processes.
2. 2That Law Nº 59 constitutes the IGN permanently and on behalf of the State, as the official authority in geodetic matters and in the spatial representation of the geography of the Republic of Costa Rica, its authority extending to activities of any order originating from the work entrusted to its charge.
3. 3That in accordance with Law Nº 59; article 62 of Executive Decree N° 7841-P, Regulation to the Law on the Maritime Terrestrial Zone, recognizes the competence of the IGN for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta; article 63 of Executive Decree N° 7841-P indicates that the National Geographic Institute shall publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.
4. 4That in Executive Decree N° 36642-MP-MOPT-MINAET, Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone, it is established according to article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, as indicated in articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of landmarks (mojones) and/or the georeferenced digital delimitation, this with the purpose of streamlining the delimitations and providing greater technical security to interested parties.
5. 5That in Executive Decree N° 33797-MJ-MOPT, Declaring as the official horizontal datum for Costa Rica CR05, linked to the International Terrestrial Reference Framework (ITRF2000) of the International Earth Rotation Service (IERS) for the measurement epoch 2005.83, which among other aspects determines the National Geodetic Network of Horizontal Reference CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral work executed in our country must be referenced, specifically stating in article 11 that: "The National Geodetic Network of Horizontal Reference CR05 and the cartographic projection system CRTM05 shall constitute the only official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities developed in the National Territory by any public dependency, person, or national or foreign private entity must be referenced."; while article 7 indicates that "As cartographic data is produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish through appropriate means that information which has been officialized."
6. 6That Executive Decree Nº 40962-MJP, Update of the Official Horizontal Geodetic Reference System for Costa Rica, declares in its article 1 that the official horizontal geodetic reference system for Costa Rica, named as CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica, linked to the International Terrestrial Reference Framework ITRF2008 (IGb08), for the measurement epoch 2014.59, and henceforth, changes and their updates shall be governed in accordance with the new ITRF definitions implemented in the continental network of the Geocentric Reference System for the Americas (SIRGAS) named SIRGAS-CON, while article 2 establishes that the CRTM05 cartographic projection system shall remain official for the cartographic representation of the continental national territory, extended for the purposes of applying this cartographic projection to the baseline of the territorial sea in the Pacific Ocean and the Caribbean Sea, this line being defined in accordance with articles 5, 6, and 7 of the United Nations Convention on the Law of the Sea, as the starting point for calculating the maximum width of all jurisdictional marine areas of the Costa Rican State.

For its part, article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which work must be referenced in the continental territory of our country, by stating that the horizontal reference system CRSIRGAS and its associated cartographic projection CRTM05 for the continental territory extended to the baseline of the territorial sea, and the "Universal Transverse Mercator" (UTM) cartographic projection, zones 16 and 17 for the jurisdictional marine and insular areas in the Pacific Ocean and the Caribbean Sea, shall constitute the only official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities developed in the national territory by any public dependency, person, or private entity, national or foreign, that undertake or contract geodetic and cartographic work must be referenced, contributing to avoiding public spending and obtaining, on the other hand, reliable, uniform, and comparable geographic information, which is of general utility and supports decision-making at the different levels of the State.

1. 7That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores), the approval of surveying plans (visado de planos de agrimensura), the granting of concessions in the Restricted Zone, and other aspects of coastal land-use planning.
2. 8That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).
3. 9That the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree N° 7841-P, Regulation to Law N° 6043 on the Maritime Terrestrial Zone, b) Executive Decree N° 33797-MJ-MOPT, Declaring as the official horizontal datum for Costa Rica CR05, and its associated cartographic projection CRTM05, c) Executive Decree N° 36642-MP-MOPT-MINAET, Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone, and d) Executive Decree Nº 40962-MJP, Update of the Official Horizontal Geodetic Reference System for Costa Rica.

10.-That article 16 of the Forest Law (Ley Forestal), Law N° 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall delimit on the ground the boundaries of the areas that form the Natural Heritage of the State (Patrimonio Natural del Estado).

11.-That according to article 11 of CHAPTER I, General Provisions of Law N° 6043, it establishes that the public zone is also, whatever its extension, that occupied by all mangroves of the continental and insular coastlines and estuaries (esteros) of the national territory.

12.-That Executive Decree N° 36786-MINAET, Manual for the classification of lands dedicated to the conservation of natural resources within the Maritime Terrestrial Zone in Costa Rica, published in La Gaceta Nº 217 of November 11, 2011, establishes among its objectives to identify within the Maritime Terrestrial Zone those lands that classify as forests, of forest aptitude (suelos Clase VII y VIII), wetlands (mangroves, estuaries (esteros), rias (rías), salt marshes (marismas), coastal lagoons (lagunas costeras), swamps (pantanos), flooded forests (bosques anegados), salt flats (salitrales)), to certify them and incorporate them as part of the Natural Heritage of the State (PNE).

13.-That Executive Decree N° 36786-MINAET in point III.-Competencies for delimitation and certification establishes that the classification of lands within the ZMT shall correspond to the Conservation Areas (AC) of the National System of Conservation Areas (SINAC) and to duly accredited private professionals from the respective Professional Associations (Colegios Profesionales) to classify forests, lands of forest aptitude (suelos Clase VII y VIII), (mangroves, estuaries (esteros), rias (rías), salt marshes (marismas), coastal lagoons (lagunas costeras), swamps (pantanos), flooded forests (bosques anegados), salt flats (salitrales)), and wetlands.

The validity of the classification documents issued by private professionals shall be subject to the approval issued by the AC with corresponding territorial competence. The ACs of SINAC with jurisdiction in the ZMT shall also be responsible for the verification, oversight, demarcation (deslinde), and certification of the lands of the Natural Heritage of the State and the protection zones. The location and delimitation of the areas of the Natural Heritage of the State within the Maritime Terrestrial Zone must be carried out as part of the approval process for the Coastal Regulatory Plan (Plan Regulador Costero, PRC), defined by Law 6043, since the Coastal Regulatory Plan is the land-use planning instrument that defines and locates all the zones to be concessioned within the ZMT and for the classification thereof at the level of cadastral plans (planos de catastro). Therefore, the Coastal Regulatory Plan must clearly and expressly indicate the areas of the PNE so as not to count them in the total area to be concessioned.

14.-That the IGN used the methodology of Digital Delimitation to delimit the public zone of the Maritime Terrestrial Zone corresponding to the estuary-mangrove (estero-manglar) ecosystem of the central sector in Quepos, district 01 Quepos, canton 06 Quepos, province 06 Puntarenas.

15.-That the delimitation of the estuary-mangrove (estero-manglar) ecosystem of the central sector of Quepos was delimited with the polygons (polígonos) named Sector 2, Sector 3, and Sector 4, located at the sites known as Los Alfaro, Junta Naranjo, and Cementerio.

16.-That the delimitation of the sectors of the public zone in the central part of Quepos corresponds to the ecosystems located in the canton of Quepos, in accordance with what was indicated by the Constitutional Chamber (Sala Constitucional) according to Resolution N° 2021002741 of 09:15 hours on February 12, 2021, which orders the Central Pacific Conservation Area (ACOPAC) and the National Geographic Institute (IGN) the following: "that jointly and coordinately carry out the corresponding actions so that they delimit the mangrove ecosystem of the Quepos area." 17.-That the digital delimitation of the estuary-mangrove (estero-manglar) ecosystem of the Central Sector of Quepos corresponds to Technical Report N° DIG-TOT-INF-104-2023 and SINAC-ACOPAC-OSRP-PNE-0058-2023 dated May 19, 2023, generated jointly by the Subprocess of Official Limits of the Topographic and Territory Observation Department of the IGN and the Aguirre Parrita Sub-Regional Office, ACOPAC.

18.-That article 140 of Law N° 6227, General Law of Public Administration, indicates that "the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce them from the moment it is adopted," a provision that must necessarily be related to numeral 204 subsection 1) of that regulatory body, which defines the suitable instrument for communicating acts of a generic nature by stating that: "General acts shall be communicated by publication and specific acts by notification." COMMUNICATES:

1. 1That, during the month of February 2022, joint fieldwork was carried out between the IGN and ACOPAC to delimit the estuary-mangrove (estero-manglar) ecosystem belonging to the public zone of the Central Sector of Quepos, district 1° Quepos, canton 6° Quepos, province 6° Puntarenas.

2º-The National Geographic Institute publishes the georeferenced digital delimitation of the public zone of the Central Sector of Quepos, comprised between the sites Cementerio, Junta Naranjo, and Los Alfaro, which forms part of the estuary-mangrove (estero-manglar) ecosystem located in district 1° Quepos, canton 6° Quepos, province 6° Puntarenas, based on the Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone and the methodology used and validated by the Central Pacific Conservation Area (ACOPAC) of SINAC-MINAE.

1. 3That the delimited public zone corresponds to the sectors of the estuary-mangrove (estero-manglar) ecosystem of the Central Sector of Quepos, district 01 Quepos, canton 06 Quepos, province 06 Puntarenas, in accordance with Technical Report N° DIG-TOT-INF-1042023 and SINAC-ACOPAC-OSRP-PNE-0058-2023 dated May 19, 2023, issued by the Subprocess of Official Limits of the Topographic and Territory Observation Department of the National Geographic Institute and the Aguirre-Parrita Subregional Office of the Central Pacific Conservation Area (ACOPAC) of SINAC-MINAE.

4º-The sectors located in Quepos, district 1° Quepos, canton 6° Quepos, province 6° Puntarenas, which to date have a delimitation of the public zone of the Maritime Terrestrial Zone through the placement of landmarks (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official status.

1. 5That the public zone of the Maritime Terrestrial Zone concerning the sectors of the estuary-mangrove (estero-manglar) ecosystem verified and delimited by the Central Pacific Conservation Area corresponds to the following coordinates in the official cartographic projection system of Costa Rica CRTM05 of the following polygons (polígonos):

SECTOR 2 ESTUARY-MANGROVE (ESTERO-MANGLAR) "LOS ALFARO"

SECTOR 3 ESTUARY-MANGROVE (ESTERO-MANGLAR) "JUNTA NARANJO"

SECTOR 4 ESTUARY-MANGROVE (ESTERO-MANGLAR) "CEMENTERIO"

6º-The official technical data of the georeferenced digital delimitation of the public zone of the Maritime Terrestrial Zone of the estuary-mangrove (estero-manglar) ecosystem of Sector 2, Sector 3, and Sector 4 in Quepos, district 1° Quepos, canton 6° Quepos, province 6° Puntarenas, has been registered in the Georeferenced Digital Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN in a vector format shape file, under the coding: RN/IGN_GDG-IGN-ZMT_líneas digitales 7º--Effective as of its publication.

Given in Curridabat, San José, on September 19, 2023.

Considering:

1. 1Que mediante Ley Nº 8905 se establece el Instituto Geográfico Nacional, en adelante IGN, como una dependencia del Registro Nacional, quien suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones. Asimismo, de conformidad con la Ley Nº 59, el IGN es la dependencia científica y técnica rectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la Descripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos de planificación.
2. 2Que la Ley Nº 59 constituye al IGN de manera permanente y en representación del Estado, como la autoridad oficial en materia geodésica y de la representación espacial de la geografía de la República de Costa Rica, extendiéndose su autoridad a las actividades de cualquier orden que tengan por origen los trabajos confiados a su cargo.
3. 3Que de conformidad con la Ley Nº 59; el artículo 62 del Decreto Ejecutivo N° 7841-P Reglamento a la Ley sobre la Zona Marítimo Terrestre se reconoce la competencia del IGN para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización a través de publicación en el Diario Oficial La Gaceta; el artículo 63 del Decreto Ejecutivo N° 7841-P señala que El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública.
4. 4Que en el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre, se establece según el artículo 18 que para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a los interesados.
5. 5Que en el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, enlazado al Marco Internacional de Referencia Terrestre (ITRF2000) del Servicio Internacional de Rotación de la Tierra (IERS) para la época de medición 2005.83, el cual entre otros aspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo 11 que: "La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa Rica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad privada nacional o extranjera."; mientras que el artículo 7 indica que "Conforme se produzcan datos cartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por los medios adecuados aquella información que se ha oficializado."
6. 6Que el Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica declara en su artículo 1 que El sistema geodésico de referencia horizontal oficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica Nacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la República de Costa Rica, enlazado al Marco Internacional de Referencia Terrestre ITRF2008 (IGb08), para la época de medición 2014.59, y en adelante, los cambios y su actualización, se regirán de acuerdo a las nuevas definiciones del ITRF que se implementen en la red continental del Sistema de Referencia Geocéntrico para las Américas (SIRGAS) denominada SIRGAS-CON, mientras que el artículo 2 establece que El sistema de proyección cartográfica CRTM05 seguirá siendo el oficial para la representación cartográfica del territorio nacional continental, extendido para efectos de aplicación de esta proyección cartográfica, hasta la línea de base del mar territorial en el océano Pacífico y el mar Caribe, definida esta línea conforme a los artículos 5, 6 y 7 de la Convención de las Naciones Unidas sobre el Derecho del Mar, como punto de partida para el cómputo de la anchura máxima de todas las áreas marinas jurisdiccionales del Estado costarricense.

Por su parte, el artículo 12 del decreto de cita, refuerza la aplicación de la proyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el territorio continental de nuestro país, al señalar que El sistema de referencia horizontal CRSIRGAS y su proyección cartográfica asociada CRTM05 para el territorio continental extendido hasta la línea de base del mar territorial y, la proyección cartográfica "Universal Transversal de Mercator" (UTM), zonas 16 y 17 para las áreas marinas e insulares jurisdiccionales en el océano Pacífico y el mar Caribe, constituirán el único sistema oficial de coordenadas para la República de Costa Rica, a partir del cual, se deben referenciar todos los levantamientos y actividades cartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública, persona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y cartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información geográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de decisiones en los distintos niveles del Estado.

1. 7Que la georreferenciación al sistema nacional de coordenadas como mecanismo para delimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta delimitación de la zona pública a los efectos de la elaboración de planes reguladores, el visado de planos de agrimensura, el otorgamiento de concesiones en la Zona Restringida y otros aspectos de ordenamiento territorial costero.
2. 8Que la información digital georreferenciada sobre delimitación de la zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).
3. 9Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre, b) el Decreto Ejecutivo N° 33797-MJ-MOPT Declara como datum horizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05 c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre, y d) el Decreto Ejecutivo Nº 40962-MJP Actualización del Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica.

10.-Que el artículo 16 de la Ley Forestal, Ley N° 7575 del 13 de febrero de 1996, establece que el Ministerio del Ambiente y Energía delimitará en el terreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.

11.-Que según el artículo 11 del CAPÍTULO I, Disposiciones Generales de la Ley N° 6043, establece que la Zona pública es también, sea cual fuere su extensión, la ocupada por todos los manglares de los litorales continentales e insulares y esteros del territorio nacional.

12.-Que el Decreto Ejecutivo N° 36786-MINAET Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica publicado en La Gaceta Nº 217 del 11 de noviembre del 2011, establece entre sus objetivos Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE).

13.-Que el Decreto Ejecutivo N° 36786-MINAET en el punto III.-Competencias para la delimitación y certificación establece que La clasificación de los terrenos dentro de la ZMT corresponderá a las Áreas de Conservación (AC) del Sistema Nacional de Áreas de Conservación (SINAC) y a profesionales privados debidamente acreditados por los Colegios Profesionales respectivos para que clasifiquen los bosques, terrenos de aptitud forestal (suelos Clase VII y VIII), (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales) y humedales.

La validez de los documentos de clasificación emitidos por profesionales privados quedará sujeta a la aprobación que emita el AC que por competencia territorial le corresponda. A las AC del SINAC con jurisdicción en la ZMT les competerá, además, la verificación, fiscalización, deslinde y certificación de las tierras del Patrimonio Natural del Estado y las zonas de protección. La ubicación y delimitación de las áreas del Patrimonio Natural del Estado dentro de la Zona Marítimo Terrestre, debe realizarse como parte del proceso de aprobación del Plan Regulador Costero (PRC), definido por la Ley 6043, ya que el Plan Regulador Costero es el instrumento de ordenamiento territorial, que define y ubica todas las zonas a concesionar dentro de la ZMT y para la clasificación de ésta a nivel de los planos de catastro. Por tanto, el Plan Regulador Costero debe indicar clara y expresamente, las áreas del PNE para no contabilizarlas en el área total a concesionar.

14.-Que el IGN utilizó la metodología de Delimitación Digital para delimitar la zona pública de la Zona Marítimo Terrestre correspondiente al ecosistema de estero-manglar del sector central en Quepos, distrito 01 Quepos, cantón 06 Quepos, provincia 06 Puntarenas.

15.-Que la delimitación del ecosistema de estero-manglar del sector central de Quepos, se delimitó con los polígonos denominados Sector 2, Sector 3 y Sector 4, localizados en los sitios conocidos como Los Alfaro, Junta Naranjo y Cementerio.

16.-Que la delimitación de los sectores de la zona pública en la parte central de Quepos corresponde a los ecosistemas ubicados en el cantón de Quepos, de acuerdo a lo indicado por la Sala Constitucional según Resolución N° 2021002741 de las 09:15 horas del 12 de febrero de 2021, la cual ordena al Área de Conservación Pacífico Central (ACOPAC) y al Instituto Geográfico Nacional (IGN) lo siguiente: que de manera conjunta y coordinada realicen las actuaciones correspondientes para que, delimiten el ecosistema de manglar de la zona de Quepos." 17.-Que la delimitación digital del ecosistema de estero-manglar del Sector Central de Quepos corresponde al Informe Técnico N° DIG-TOT-INF-104-2023 y SINAC-ACOPAC-OSRP-PNE-0058-2023 de fecha 19 de mayo de 2023, generado en conjunto por el Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del IGN y la Oficina Sub-Regional Aguirre Parrita, ACOPAC.

18.-Que el artículo 140 de la Ley N° 6227 Ley General de la Administración Pública señala que "el acto administrativo producirá su efecto después de comunicado al administrado, excepto si le concede únicamente derechos, en cuyo caso lo producirá desde que se adopte", disposición que necesariamente debe relacionarse con el numeral 204 inciso 1) de ese cuerpo normativo, mismo que define el instrumento idóneo para comunicar actos de naturaleza genérica al señalar que: Se comunicarán por publicación los actos generales y por notificación, los concretos.

COMUNICA:

1. 1Que, durante el mes de febrero 2022, se realizó el trabajo de campo conjunto entre el IGN y ACOPAC para delimitar el ecosistema de estero-manglar perteneciente a la zona pública del Sector Central de Quepos, distrito 1° Quepos, cantón 6° Quepos, provincia 6° Puntarenas.

2º-El Instituto Geográfico Nacional publica la delimitación digital georreferenciada de la zona pública del Sector Central de Quepos, comprendido entre los sitios Cementerio, Junta Naranjo y Los Alfaro, que forma parte del ecosistema de estero-manglar ubicado en el distrito 1° Quepos, cantón 6° Quepos, provincia 6° Puntarenas, con base al Reglamento de Especificaciones para la Delimitación de la zona pública de la Zona Marítimo Terrestre y la metodología usada y validada por el Área de Conservación Pacífico Central (ACOPAC) del SINAC-MINAE.

1. 3Que la zona pública delimitada corresponde a los sectores del ecosistema de estero-manglar del Sector Central de Quepos, distrito 01 Quepos, cantón 06 Quepos, provincia 06 Puntarenas en conformidad con el Informe Técnico N° DIG-TOT-INF-1042023 y SINAC-ACOPAC-OSRP-PNE-0058-2023 de fecha 19 de mayo de 2023 emitido por Subproceso de Límites Oficiales del Departamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional y la Oficina Subregional Aguirre-Parrita del Área de Conservación Pacífico Central (ACOPAC) del SINAC-MINAE.

4º-Los sectores ubicados en Quepos, distrito 1° Quepos, cantón 6° Quepos, provincia 6° Puntarenas que cuentan a la fecha con delimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones y respectiva publicación en el Diario Oficial La Gaceta, mantienen su condición oficial.

1. 5Que la zona pública de la Zona Marítimo Terrestre concerniente a los sectores del ecosistema de estero-manglar verificado y delimitado por el Área de Conservación Pacífico Central corresponde a las siguientes coordenadas en el sistema de proyección cartográfica oficial de Costa Rica CRTM05 de los siguientes polígonos:

SECTOR 2 ESTERO-MANGLAR "LOS ALFARO"

SECTOR 3 ESTERO-MANGLAR "JUNTA NARANJO"

SECTOR 4 ESTERO-MANGLAR "CEMENTERIO"

6º-Los datos técnicos oficiales de la delimitación digital georreferenciada de la zona pública de la Zona Marítimo Terrestre del ecosisitema de estero-manglar del Sector 2, Sector 3 y Sector 4 en Quepos, distrito 1° Quepos, cantón 6° Quepos, provincia 6° Puntarenas, han quedado registrados en la Geodatabase Digital Georreferenciada de la Zona Marítimo Terrestre (ZMT) del IGN en archivo con formato vectorial shape, bajo la codificación: RN/IGN_GDG-IGN-ZMT_líneas digitales 7º--Rige a partir de su publicación.
