Ordinary proceeding (proceso de conocimiento), declared to involve a pure question of law (puro derecho), brought before the Tribunal Contencioso Administrativo y Civil de Hacienda by LA BELLA MASAI M.N.J, SOCIEDAD ANÓNIMA., represented by its general attorney-in-fact without limitation as to amount (apoderada generalísima sin límite de suma), Ana Isabel Ruano Sánchez, a Spanish national, passport number AD 761976, of legal age, married, businesswoman, and resident of Limón; against the STATE, represented by State Attorney Mauricio Castro Lizano. Juan Arturo Abdelnour Granados also appears as special litigation counsel (apoderado especial judicial) for the plaintiff. All are of legal age and, except as stated, married, attorneys, and residents of San José.

PROCEDURAL BACKGROUND (RESULTANDO)

  1. 1Based on the facts alleged and the legal provisions cited, the plaintiff instituted an ordinary proceeding, modifying its claims at the preliminary hearing, seeking a judgment as follows: “-That Resolutions DEA-930-2011 and DEA-1940-2011, issued by the SETENA Environmental Assessment Department, be declared null and void. -That SETENA be ordered to issue the environmental permit (licencia ambiental) in this matter because the company has fulfilled the requirements. -That damages be awarded: pecuniary damages (daño material) for the project delay and objective non-pecuniary damages (daño moral objetivo) suffered by the company due to harm to its name, both to be quantified during the judgment-enforcement stage (etapa de ejecución de sentencia). -That the State be ordered to pay the (sic) costs of these proceedings.”
  2. 2The State’s representative opposed the complaint and raised the defenses (excepciones) of lack of legal entitlement (falta de derecho) and acts not subject to challenge (actos no susceptibles de impugnación).
  3. 3At 8:50 a.m. on June 21, 2012, the preliminary hearing was held, at which the representatives of both parties addressed the court.
  4. 4The Tribunal Contencioso Administrativo y Civil de Hacienda, Sixth Section, composed of José Roberto Garita Navarro, Jonatan Canales H. and José Paulino Hernández G., with the latter drafting the decision, ruled in Judgment 278-2012 at 3:00 p.m. on November 28, 2012: “The defense of lack of legal entitlement is rejected, and the defense of acts not subject to challenge is sustained. Consequently, the complaint filed by LA BELLA MASAI M N J. SOCIEDAD ANÓNIMA against the STATE is declared inadmissible. The plaintiff is exempted from payment of attorneys’ fees and court costs (costas personales y procesales).”

Drafted by Justice Rojas Morales GROUNDS (CONSIDERANDO)

I.On May 31, 2010, La Bella Masai M.N.J., S.A. requested that the Secretaría Técnica Nacional Ambiental (SETENA) conduct an environmental impact assessment (evaluación de impacto ambiental) for the development of a project on a property located within the Refugio Nacional Mixto de Vida Silvestre Gandoca-Manzanillo. SETENA suspended that proceeding until the legal directorate of the Sistema Nacional de Áreas de Conservación (SINAC) issues an opinion regarding Report DFOE-PGAA-59-2008 of the Contraloría General de la República (hereinafter, the Contraloría) and the Zoning Regulations (Reglamento de Zonificación) for that Refuge. The aforementioned company sued the State, seeking a judgment annulling Resolutions DEA-930-2011 and DEA-1940-2011 of the SETENA Environmental Assessment Department, which ordered the suspension. It also sought an order requiring SETENA to issue the environmental permit because the applicable requirements had been met; payment of the pecuniary damages resulting from the project delay and the objective non-pecuniary harm caused by damage to the company’s name, in amounts to be determined during enforcement of the judgment; and payment of both categories of costs.

The defendant raised the defenses of lack of legal entitlement and acts not subject to challenge. The case-management judge (juez tramitador) denied the latter at the preliminary hearing. The court rejected the defense of lack of legal entitlement and sustained the defense of acts not subject to challenge. It declared the complaint inadmissible and exempted the plaintiff from payment of both categories of costs.

II.Counsel for the plaintiff files an appeal in cassation (recurso de casación) and raises four grounds of error. First: erroneous application of Article 120 of the Administrative Litigation Procedural Code (Código Procesal Contencioso Administrativo). He states that the Court ruled the complaint inadmissible by sustaining the defense that the acts were not subject to challenge. He explains that this defense was raised for the first time at the preliminary hearing and was therefore untimely. He adds that the case-management judge even dismissed it, finding that the matter involved a provision with no time limit, with respect to which any reasonable period had already elapsed by a wide margin. He explains that although SETENA’s decision appears to be a merely procedural act (acto de mero trámite), it has independent effect (efecto propio), because it would make it impossible to continue the ordinary processing of the necessary permits; therefore, pursuant to Article 36, subsection c), Ibid., it is subject to challenge.

He contends that the court ruled similarly in judgment 0248-2012-VI at 16 hours on 02 November 2012, in an identical case. He states: “I emphasize the fact that the suspension of the proceeding initiated almost THREE YEARS AGO before Setena (a prerequisite for continuing to obtain the remaining construction permits), for the development of a project in (sic) occurred on 23 March 2011, almost TWO YEARS AGO.” He adds that, according to SETENA, the suspension was based on the need to wait until SINAC’s legal department issued an opinion concerning a report issued more than four years earlier by the Office of the Comptroller General (Contraloría) (DFOE-PGAA-59-2008 of 10 December 2008) and concerning Decreto 34946-MINAE, which corresponds to the Management or Zoning Plan (Plan de Manejo o Zonificación) for the Gandoca-Manzanillo Mixed National Wildlife Refuge (Refugio Nacional Mixto de Vida Silvestre Gandoca-Manzanillo).

This was so despite compliance with all the requirements of the Zoning Regulations (Reglamento de Zonificación), as SINAC itself had informed SETENA, in response to an inquiry from that agency regarding the specific project, as early as 17 January 2011. He considers that this unjustified, indefinite suspension of the environmental-license proceeding (trámite de licencia ambiental) is not a merely procedural act, but rather one with independent effect, as the court held in the aforementioned judgment 0248-2012-VI. Second: he criticizes the failure to apply Article 36, subsection c), of the aforementioned code. In his view, in the case under review, the indefinite suspension of the environmental-license proceeding makes it impossible to continue obtaining the other permits. Furthermore, that license does not in itself constitute carte blanche to build; rather, municipal and water-service permits must be obtained, and the guidelines of the Instituto Nacional de Vivienda y Urbanismo, the provisions of the Management Plan, and so forth must be observed.

Third: he considers that the contents of the appeal filed by the Consejo Nacional de Áreas de Conservación (CONAC), through the director of SINAC, against one of the reports of the Office of the Comptroller General were not taken into account. That appeal states that the report “…contains defects that affect the contents of the report and alter the conclusions reached therein”; it also states that the agency’s directives concerning the Refuge: “…reveal a weak technical and legal basis for the categorization and classification of National Wildlife Refuges.” He asserts that, in that document, the aforementioned Consejo states that the Office of the Comptroller General: “Refers to purported underlying technical studies that are not attached to the report, on the basis of which it issues mandatory directives devoid of the most elementary principles of reasonableness and proportionality.” It also cites decision 2007-11155 of the Sala Constitucional, which states that the “Refuge Management Plan Regulations” (“Reglamento Plan de Manejo del Refugio”) (Decreto 34946-MINAET) constitute a clearly partial component of a comprehensive or complete management plan and comply with all guidelines required by law.

He notes that the appeal concludes by stating: “…the forcible enforcement of the mandatory administrative acts contemplated by the report of the Office of the Comptroller General... may cause the coastal communities of the Southern Caribbean... serious or irreparable harm, such as the paralysis of construction and investment, increased unemployment, reduced tourism, increased crime, and depopulation… At the level of the country’s legality, legal certainty, and institutional integrity, our democratic system would suffer a severe blow, because the rules established by the State would be changed radically and arbitrarily… also radically and arbitrarily, the rules established by the Management Plan and its Zoning Chapter would be changed after extensive consultation with residents to secure their approval... through an agreement with the state (sic), approved by the highest authorities responsible for administering the country’s conservation areas.” In his view, although the report of the Office of the Comptroller General challenged by CONAC is not the 2008 report cited by SETENA and erroneously relied upon by the adjudicatory body, and although it was not challenged in these proceedings, it does constitute a clear and forceful statement by CONAC, headed by the director of SINAC, whose legal department, according to SETENA, was required to issue an opinion concerning the 2008 report and the Management Plan.

Fourth: he objects that, in attempting to justify why, in its view, the challenged acts are merely procedural and why the ordered suspension, although it has already lasted almost two years, is therefore provisional, temporary, and not indefinite, the court committed a manifest error of fact and, consequently, of law. He explains that the court states that report DFOE-PGAA-59-2008 of the Office of the Comptroller General, addressed to MINAET and SETENA’s executive director, contains the results of a study of management in protected areas, and that report DFOE-AE-IF-03-2011 sets forth the findings concerning the Zoning Regulations. He contends that the latter report was issued after the SETENA official communications challenged in these proceedings. Thus, he maintains, not only was it not part of the grounds asserted by SETENA, but CONAC itself, through the director of SINAC, has stated that it constitutes a severe blow to the democratic system.

The fact remains, he adds, that the judges may not rely on that report, issued after the official communication announcing the suspension, because the action was brought against what SETENA had stated at that time. Under different circumstances, the plaintiff’s argument would also have been different and might even have challenged the report. In conclusion, he states that, irrespective of the fact that the Office of the Comptroller General’s 2008 directives were not challenged in these proceedings, SETENA maintained that SINAC’s legal department was required to issue an opinion concerning them. Until that occurred, the environmental-license proceeding was suspended, which makes the suspension an act with independent effect. It is irrefutable, he asserts, that the Administration could not suspend a proceeding established by law, much less suspend it indefinitely, thereby declining to apply the regulations in force until SINAC issued an opinion concerning the aforementioned report issued in 2008 and concerning the Management Plan or Zoning Regulations, which constitute a decree currently in force and subject to mandatory compliance.

He objects that the suspension remains in effect without a deadline or legal basis, unlawfully curtailing his client’s property rights over land owned by her and recorded in the Registro Público, which the State has made no attempt to acquire, either directly or through the mandatory expropriation proceeding (proceso expropiatorio), while waiting for the required opinion—which SETENA invoked as the reason for maintaining the suspension—to be issued someday, whether in one year, ten years, or never.

III.According to the electronic record, at the preliminary hearing, during the procedural-review phase (fase de saneamiento del proceso), the case-management judge asked the defendant to clarify which defense it had raised in answering the complaint, because the pleading asserting defenses did not make clear whether it referred to the defense of lack of legal entitlement (falta de derecho) or the defense that the acts were not subject to challenge. The State’s representative stated that the defense invoked, with respect to both the complaint and its amendment, was inadmissibility based on the absence of an administrative act with independent effect. It was therefore clear that the defense that the acts were not subject to challenge had been raised, and it was dismissed at that stage. Consequently, there is no basis for finding that the filing was untimely. Moreover, the case-management judge’s dismissal of that defense did not preclude the trial court from sustaining it as grounds for its ruling.

IV.As the appellant in cassation (casacionista) points out, Article 36, subsection c), and Article 120, subsection a), both of the Contentious-Administrative Procedure Code (Código Procesal Contencioso Administrativo), have been violated. The former through failure to apply it and the latter through its improper application. This is because the court declared the complaint inadmissible after upholding the defense that the acts were not subject to challenge (actos no susceptibles de impugnación), even though, as the processing judge reasoned, the administrative conduct (conducta administrativa) at issue involves provisions that may be detrimental to the affected party (administrado), as they reveal the possibility of restricting, without any time limit—and after any reasonable period has already long since elapsed—the processing necessary to obtain the corresponding permits so that the plaintiff may carry out the construction project.

Indeed, SETENA’s decision regarding the suspension of the environmental license proceeding (trámite de licencia ambiental) has remained in effect over time. It has independent effect (efecto propio), because it has made it materially impossible to continue the relevant proceeding intended to satisfy the applicable requirements and thereby complete the project, including obtaining the remaining permits required for that purpose. Accordingly, there is sufficient basis to determine that the challenged acts (actos impugnados) could subject the plaintiff to an obstacle preventing it from exercising the powers arising from its right, which means that they may properly be examined in these proceedings to determine whether the complaint should proceed with respect to the substantive issues involved in this dispute. This Chamber, of course, may not examine the merits implicated in this matter; for example, as stated in the challenge presently before it: the content of the appeal filed by the Consejo Nacional de Áreas de Conservación (CONAC), through the director of SINAC, against one of the reports issued by the Contraloría; that body’s provisions concerning the Refuge; and the rulings of the Sala Constitucional regarding the “Reglamento Plan de Manejo del Refugio” (Decreto 34946-MINAET).

The same must be said of the following statement in the judgment under appeal: “…even if the Court—hypothetically—were to set aside the challenged acts, that is, annul the aforementioned suspension, the underlying issue would remain, because the Contraloría’s act not only covers several projects intended to be developed in the area, but also involves and encompasses the plaintiff’s specific project. Consequently, any annulment that might be ordered would have no practical effect and would provide no significant benefit to the party, as it would be incapable, by itself, of restoring or reestablishing the legal situation asserted…”. These issues must be examined when the ruling on the merits is issued, as part of the trial court’s jurisdiction when resolving the dispute; the same applies to the administrative acts (actos administrativos) challenged in the complaint. For the time being, however, that court must analyze those acts within the context of the complaint seeking to challenge them.

Moreover, the appellant objects to the court’s reliance, among other things, on report DFOE-AE-IF-03-2011 to justify its view that the acts at issue are merely procedural acts (actos de mero trámite) and that, therefore, the ordered suspension, although it had already lasted almost two years when judgment was rendered, is provisional, temporary, and not indefinite. For this Chamber, however, the effects generated by SETENA’s administrative conduct through those acts are sufficient to establish that they are subject to challenge. Thus, at this stage of the proceedings, it is irrelevant to determine whether the court should have relied on that report, given that it was issued after the official communication announcing the suspension and that the proceedings were brought solely against SETENA. As the appellant states, the Administration has suspended a proceeding prescribed by law. It should be emphasized that the allegation that this curtails the rights of the party represented by the appellant over its own land—which the State has not sought to acquire either directly or through expropriation, while keeping that party waiting indefinitely for the required decision—demonstrates that the challenged administrative conduct does have independent effect, insofar as it has halted the environmental impact application proceeding (trámite de solicitud de impacto ambiental), a prerequisite for continuing the construction process.

This remains true even though the Contraloría’s report was not challenged. Accordingly, the conduct at issue may affect the rights of the affected party, requiring it to be reviewed as requested in the complaint.

V. On this basis, the appeal must be granted and the defense under consideration rejected

POR TANTO

The appeal is granted. Contrary to the trial court’s ruling, the defense that the acts were not subject to challenge is rejected. The case file shall be remitted to that court.

RESULTANDO

  1. 1Con base en los hechos que expuso y disposiciones legales que citó, la parte actora estableció proceso de conocimiento, ajustando sus pretensiones en audiencia preliminar, a fin de que en sentencia: “ -Se declare la nulidad de las resoluciones DEA- 930-2011 y DEA-1940-2011, emitidas por el Departamento de Evaluación Ambiental de la SETENA. –Que se ordene a SETENA emitir la licencia ambiental en el presente asunto por haber cumplido la empresa los requisitos. –Que se condene al pago de daños y perjuicios: daño material por atraso del proyecto y daño moral objetivo de la sociedad por afectación al nombre de la empresa, ambos a ser liquidados en etapa de ejecución de sentencia. –Se condene al Estado al pago de la (sic) costas del presente proceso.”
  2. 2El representante estatal contestó negativamente y opuso las excepciones de falta de derecho y actos no susceptibles de impugnación.
  3. 3Al ser las 8 horas 50 minutos del 21 de junio de 2012, se efectuó la audiencia preliminar, oportunidad en que hicieron uso de la palabra los representantes de ambas partes.

CONSIDERANDO

I.El 31 de mayo de 2010, la empresa La Bella Masai M.N.J., S.A. solicitó a la Secretaría Técnica Nacional Ambiental (SETENA), la evaluación de impacto ambiental para desarrollar un proyecto en una finca ubicada dentro del Refugio Nacional Mixto de Vida Silvestre Gandoca-Manzanillo. SETENA suspendió ese trámite hasta que la dirección legal del Sistema Nacional de Áreas de Conservación (SINAC) se pronuncie sobre el informe DFOE-PGAA-59-2008 de la Contraloría General de la República (Contraloría, en lo sucesivo) y el Reglamento de Zonificación del citado Refugio. La referida compañía demandó al Estado, para que en sentencia se anulen las resoluciones DEA-930-2011 y DEA-1940-2011 del Departamento de Evaluación Ambiental de SETENA, que disponen la suspensión. Se le ordene a ésta emitir la licencia ambiental, por haber cumplido con los correspondientes requisitos. Pague el daño material derivado del atraso del proyecto y el detrimento moral objetivo por la afectación al nombre empresarial, según se liquide en ejecución de sentencia.

Asimismo, ambas costas del proceso. El demandado opuso las excepciones de falta de derecho y actos no susceptibles de impugnación. El juez tramitador denegó esta última en la audiencia preliminar. El tribunal rechazó la de falta de derecho y admitió la de actos no susceptibles de impugnación. Declaró inadmisible la demanda y eximió a la actora del pago de ambas costas.

II.El apoderado de la demandante presenta recurso de casación y formula cuatro agravios. Primero: errónea aplicación del artículo 120 del Código Procesal Contencioso Administrativo. Señala, el Tribunal declaró inadmisible la demanda, al acoger la defensa de actos no susceptibles de impugnación. Expone, ésta se opuso por primera vez en la audiencia preliminar, por ende, resulta extemporánea. Incluso, añade, el juez tramitador la declaró sin lugar, considerando que se estaba en presencia de una disposición sin límite de tiempo, respecto de la cual ya había transcurrido, sobradamente, cualquier plazo razonable. Explica, lo resuelto por SETENA, si bien parece un acto de mero trámite, tiene efecto propio, porque implicaría la imposibilidad de continuar con el trámite ordinario de los permisos necesarios, lo cual, de conformidad con el numeral 36, inciso c), Ibid., es susceptible de impugnarse. Aduce, en igual sentido se pronunció el tribunal, en la sentencia 0248-2012-VI de las 16 horas del 02 de noviembre de año 2012, en un caso exactamente igual.

Manifiesta: “Resalto el hecho de que la suspensión del trámite iniciado hace casi TRES AÑOS ante Setena (requisito para continuar con la obtención de los restantes permisos de construcción), para el desarrollo de un proyecto en (sic) ocurrió desde el 23 de marzo del 2011, hace casi DOS AÑOS.” Añade, se sustentó, según SETENA, en que había que esperar hasta que el departamento legal del SINAC se pronunciara sobre un informe emitido hace más de cuatro años por la Contraloría (DFOE-PGAA-59-2008 del 10 de diciembre de 2008) y sobre el Decreto 34946-MINAE, que corresponde al Plan de Manejo o Zonificación del Refugio Nacional Mixto de Vida Silvestre Gandoca- Manzanillo. Ello, pese a cumplir con todos los requisitos del Reglamento de Zonificación, como el mismo SINAC le había informado a la SETENA, ante una consulta de ese ente sobre el proyecto en particular, desde el 17 de enero de 2011. Estima, esa suspensión injustificada del trámite de licencia ambiental por tiempo indefinido, no es un acto de mero trámite, sino uno con efecto propio, como se pronunció el tribunal en la citada sentencia 0248-2012-VI.

Segundo: censura que no se haya aplicado el precepto 36, inciso c), de la aludida codificación. A su juicio, en el caso de examen, la suspensión por tiempo indefinido del trámite de licencia ambiental implica la imposibilidad de continuar con la obtención de los demás permisos. Además, esa licencia no constituye por sí sola una carta abierta para construir, sino que se deben obtener permisos municipales, de servicios de agua, respetar los lineamientos del Instituto Nacional de Vivienda y Urbanismo, disposiciones del Plan de Manejo, etcétera. Tercero: estima, se omitió considerar el contenido del recurso presentado por el Consejo Nacional de Áreas de Conservación (CONAC), a través de la directora del SINAC, contra uno de los informes de la Contraloría, en donde se señala que ”…contiene vicios que repercuten en el contenido del informe y que alteran las conclusiones dadas en el mismo”; también, que las disposiciones de ese ente, en relación al Refugio: “…revela un frágil fundamento técnico y legal sobre la categorización y clasificación de los Refugios Nacionales de Vida Silvestre”.

Asevera, en ese documento, el referido Consejo manifiesta que la Contraloría: “Hace referencia a supuestos estudios técnicos de base que no se anexan al informe, con base en los cuales deriva disposiciones de carácter obligatorio desprovistas de los más elementales principios de racionalidad y proporcionalidad”. Asimismo, se cita el fallo 2007-11155 de la Sala Constitucional, donde se dice que el “Reglamento Plan de Manejo del Refugio” (Decreto 34946-MINAET), constituye un claro componente de carácter parcial, de un plan de manejo integral o total, y cumple con todos los lineamientos exigidos por ley. Acota, ese recurso concluye indicando: “…de ejecutarse de manera forzosa los actos administrativos de carácter obligatorio, que pretende el informe de la Contraloría... puede traer a las poblaciones costeras del Caribe Sur... perjuicios graves o de imposible reparación, como la parálisis de la construcción, de la inversión, el aumento del desempleo, la disminución de la actividad turística, el aumento de la delincuencia y el despoblamiento…

En el nivel de legalidad, seguridad jurídica e institucionalidad del país, se estaría dando un duro golpe a nuestro sistema democrático, toda vez que se estarían cambiando radical y arbitrariamente las reglas del juego planteadas por el Estado… también de manera radical y arbitraria, se les estarían variando las reglas establecidas por el Plan de Manejo y su Capítulo de Zonificación, luego de haber sido consultadas exhaustivamente a los pobladores para lograr su aprobación... mediante un pacto con el estado (sic), aprobado por las más altas autoridades de la administración de las áreas de conservación del país.” En su criterio, aunque el informe de la Contraloría, objetado por el CONAC, no es el del año 2008 aludido por SETENA y acogido erróneamente por el órgano sentenciador, y siendo también que no fue objeto de impugnación en este proceso, sí constituye una manifestación clara y contundente del CONAC, dirigido por la directora del SINAC, cuyo departamento legal, según SETENA, debía pronunciarse sobre el informe de 2008 y respecto al Plan de Manejo.

Cuarto: objeta, el tribunal, para intentar justificar por qué los actos impugnados, según su enfoque, son de mero trámite y, por lo tanto, la suspensión acordada, aunque ya lleve casi dos años, es transitoria, temporal y no indefinida, incurre en un evidente error de hecho y consecuentemente de derecho. Explica, ese órgano señala que el informe DFOE-PGAA-59-2008 de la Contraloría, dirigido al MINAET y al director ejecutivo de SETENA, contiene resultados del estudio sobre la gestión en las áreas protegidas y que mediante informe DFOE-AE-IF-03-2011, se consigna el resultado en relación al Reglamento de Zonificación. Aduce, este último informe fue emitido en fecha posterior a los oficios de SETENA impugnados en este proceso. De esta manera, sostiene, no sólo no es parte de lo alegado por SETENA, sino que el mismo CONAC, a través de la directora del SINAC, se ha pronunciado señalando que es un duro golpe al sistema democrático.

Lo cierto del caso, agrega, es que los juzgadores no pueden utilizar ese informe, emitido posteriormente al oficio de comunicación de la suspensión, porque el proceso se interpuso contra lo dicho por SETENA en ese momento. En diferentes circunstancias, el alegato de la actora hubiera sido también otro, incluso, impugnando el informe. Como conclusión, expresa, independientemente de que lo dispuesto por la Contraloría en el año 2008 no fuera cuestionado en este proceso, respecto a ello, según SETENA, debía pronunciarse el departamento legal del SINAC. Hasta tanto no se produjera, se suspendía el trámite de licencia ambiental, por lo cual es un acto con efecto propio. Es irrebatible, asevera, la Administración no podía suspender un trámite previsto en la ley, mucho menos por tiempo indefinido, lo que conlleva desaplicar la normativa vigente, hasta tanto el SINAC no se pronunciara sobre el aludido informe emitido en el 2008 y respecto al Plan de Manejo o Reglamento de Zonificación, que es un decreto vigente y de acatamiento obligatorio.

Recrimina, la suspensión se mantiene, sin plazo ni fundamento, cercenando ilegalmente los derechos de propiedad de su representada, sobre un terreno suyo, inscrito en el Registro Público, respecto del cual el Estado no ha hecho el intento de adquirir, directamente, ni mediante el obligado proceso se produzca el pronunciamiento requerido, como causa que alegó SETENA para sostener la suspensión.

III.Según el registro electrónico, en la audiencia preliminar, fase de saneamiento del proceso, el juez tramitador le solicitó al demandado aclarar a cuál defensa se refería cuando contestó la demanda, pues de la lectura del alegato de excepciones no quedó claro si aludió a la de falta de derecho o a la de actos no susceptibles de impugnación. El representante estatal manifestó que está invocada, tanto en la demanda como en su ampliación, la de inadmisibilidad por inexistencia de acto administrativo con efecto propio. Quedó claro, en consecuencia, opuso la defensa de actos nos susceptibles de impugnación y en ese sentido se declaró sin lugar en esa fase. En consecuencia, no existe base para determinar que la gestión fue extemporánea. Por otra parte, el rechazo que hizo el juez tramitador, no inhibe al tribunal de juicio para acogerla como justificación de su pronunciamiento.

IV.Como lo señala el casacionista, se han quebrantado los artículos 36, inciso c), y 120, inciso a), ambos del Código Procesal Contencioso Administrativo. El primero por falta de aplicación y el segundo por aplicación indebida. Ello, en virtud de que el tribunal declaró inadmisible la demanda, al acoger la defensa de actos no susceptibles de impugnación, pese a que con la conducta administrativa cuestionada, como lo razonó el juez tramitador, se está en presencia de disposiciones que pueden llegar a ser perjudiciales al administrado, al revelar la posibilidad de restringir, sin límite de tiempo y respecto de las cuales ya ha transcurrido, sobradamente, cualquier plazo razonable, el desarrollo del trámite necesario para lograr los correspondientes permisos a fin de que la actora pueda desarrollar el proyecto constructivo. En efecto, lo resuelto por SETENA, respecto a la suspensión del trámite de licencia ambiental ha perdurado en el tiempo.

Tiene efecto propio, pues ha implicado la imposibilidad material de continuar con el respectivo trámite, encaminado a cumplir con los requerimientos de rigor y así culminar con la ejecución del proyecto, incluyendo el resto de permisos orientados a ese fin. En esta inteligencia, existe base suficiente para determinar que los actos impugnados podrían someter a la actora a un obstáculo para emprender el ejercicio de las facultades dimanantes de su derecho, lo que determina la viabilidad de ser analizados en este proceso y establecer si la demanda procede o no en orden al análisis de los temas sustantivos inmersos en esta contienda. Por supuesto, a esta Cámara no le es dable examinar aspectos de fondo implicados en el presente asunto; por ejemplo, según se expone en la impugnación que ahora ocupa: el contenido del recurso presentado por el Consejo Nacional de Áreas de Conservación (CONAC), a través de la directora del SINAC, contra uno de los informes de la Contraloría; las disposiciones de ese órgano en relación al Refugio; pronunciamientos de la Sala Constitucional sobre el “Reglamento Plan de Manejo del Refugio” (Decreto 34946-MINAET).

Lo propio ha de decirse sobre la afirmación que se hace en el fallo recurrido, tocante a lo siguiente: “…aunque el Tribunal –por vía de hipótesis- removiera los actos impugnados, esto es, que anulara la suspensión aludida, el problema de fondo subsistiría, pues el acto de la Contraloría no solo alcanza varios proyectos que se pretenden desarrollar en el área, sino que involucra y cobija al proyecto específico de la parte actora. De suerte que la nulidad que pudiera acordarse no tendría efecto útil, no representaría mayores ventajas para la parte al ser incapaz por sí mismo de restituir o restablecer la situación jurídica aducida…”. Estos temas deberán examinarse con ocasión del pronunciamiento de fondo, como parte de la competencia del tribunal de juicio al dirimir la controversia; asimismo, los actos administrativos que con la demanda se pretenden cuestionar. Pero, de momento, deberá analizar esos actos dentro del contenido de la demanda donde se pretende impugnar.

Por lo demás, el recurrente objeta que el tribunal se valga, entre otros, del informe DFOE-AE-IF-03-2011 para justificar, según su enfoque, que los actos cuestionados son de mero trámite y, por lo tanto, la suspensión acordada, aunque ya lleve casi dos años (al tiempo de sentenciar), es transitoria, temporal y no indefinida. Sin embargo, para esta Cámara basta los efectos que ha generado la conducta administrativa de SETENA, a través de los referidos actos, para determinar su impugnabilidad. Así las cosas, en este estadio procesal, es irrelevante determinar si el tribunal debió o no ampararse en ese informe, al ser emitido luego del oficio que comunicó la suspensión y en orden a que el proceso sólo se planteó contra SETENA. Como la expresa el recurrente, la Administración ha suspendido un trámite previsto en la ley. Cabe destacar, el alegato de que con ello se cercenan los derechos de su representada sobre el terreno de su propiedad, el cual el Estado no ha pretendido adquirir directamente, ni mediante expropiación, pero la ha mantenido en espera indefinida del pronunciamiento requerido, revela que la conducta administrativa impugnada sí genera efecto propio, en tanto ha paralizado el trámite de solicitud de impacto ambiental, requisito previo para continuar con el proceso constructivo; es así, incluso, aunque no se haya impugnado el informe de la Contraloría. De este modo, existe posibilidad de que la conducta cuestionada afecte los derechos del administrado, lo que impone que sea revisada como se solicita en la demanda.

V. En este predicado, se debe acoger el recurso y rechazar la defensa en estudio

POR TANTO

Se declara con lugar el recurso. Contrario a lo dispuesto por el tribunal de juicio, se rechaza la defensa de actos no susceptibles de impugnación. Remítase el expediente a ese despacho.
