In the plenary proceedings (proceso de conocimiento) conducted before the Tribunal Contencioso Administrativo y Civil de Hacienda by LUIS LUBÍN POVEDA ALVARADO and ROSA EMILIA SILVA GONZÁLEZ against the INSTITUTO DE DESARROLLO RURAL, the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN, and the ESTADO, represented by State Attorney Mauricio Castro Lizano, counsel for the plaintiffs files an appeal in cassation (recurso de casación) against judgment no. 103-2020 of 7 hours 30 minutes on December 02, 2020, issued by the Tribunal Contencioso Administrativo y Civil de Hacienda, Sección V, composed of Judges Marianella Álvarez Molina, Ileana Isabel Sánchez Navarro, and Sergio Mena García. WHEREAS
I.According to the facts found to have been proven and not challenged by the appellant, by resolution contained in Article XXXVI of session number 52-99 held on July 21, 1999, the Board of Directors of the Instituto de Desarrollo Agrario (IDA) unanimously and with final effect resolved to award Luis Lubín Poveda Alvarado and Rosa Emilia Silva González parcel 106 of Asentamiento Lajas, located in Abangares, Guanacaste. That property is described in registered cadastral plan number 570674-99, with an area of 9.173,97 m2, and was registered in the names of the aforementioned persons under real-property folio registration number 115009-001 and 002. By means of the field report contained in official letter number IT-OSCR-047-2007 of June 13, 2007, Engineer Luis Alfredo Vásquez Campos, of the Oficina de Fiscalización Agraria of the Oficina Sub Regional en Cañas of the IDA, recommended “…initiating proceedings to revoke the award and subsequently annul the title granted to the beneficiaries, owners of parcel # 106, on the ground of ‘unjustified abandonment of the parcel,’ section 4), subsection 2 of Article 63 of Ley 2825…”.
At 14:30 on December 08, 2008, the Oficina de Asesoría Jurídica de la Región Chorotega of the IDA issued the order commencing the ordinary administrative proceeding (procedimiento administrativo ordinario) to revoke and annul title to the parcel in question. In the record of service of the order commencing the administrative proceeding, the Assistant of the Asesoría Jurídica de la Región Chorotega of the IDA certified that service on Luis Lubín and Rosa Emilia “…was attempted on 2 occasions, on February 23 and 27, 2009, and they could not be located; service by published notice shall therefore be made…”. At 15:10 on August 25, 2009, a formal judicial request (exhorto) was issued to the Director del Registro Público de la Propiedad Inmueble so that the commencement of the administrative proceeding would be duly noted in the registry entry for the property recorded under real-property folio registration number 115009-001 and 002.
That formal request was filed in the Diario del Registro Público on September 09, 2009. By resolution issued at 14:20 on August 25, 2009, the Asesoría Jurídica de la Región Chorotega of the IDA ordered that “…Because ROSA EMILIA SILVA GONZÁLEZ and LUIS LUBIN POVEDA ALVARADO were not found at their residence and their current address is unknown, in accordance with Article 241 of the Ley General de la Administración Pública and Article 108, subsection e), of the currently applicable Reglamento para la Selección y Asignación de Solicitantes de Tierras del Instituto de Desarrollo Agrario, the order commencing the proceeding to revoke the award of parcel 106, Asentamiento Lajas in Abangares, Guanacaste, shall be published on TWO CONSECUTIVE OCCASIONS in the Official Gazette La Gaceta.” The specified notices were published in issues number 177 and 178 of the Official Gazette La Gaceta on September 10 and 11, 2009, respectively.
At 11:00 on August 24, 2010, the Board of Directors of the IDA issued the final administrative decision, the operative portion (parte dispositiva) of which resolved: “…1) To revoke the award of parcel 106 of Asentamiento Lajas, located in District 01 Juntas, Canton 7 Abangares, Province of Guanacaste, on the ground of unjustified abandonment of the parcel, in accordance with Articles sixty-eight, fourth subsection, paragraph b), in relation to Articles 62 and 66 of Ley 2825 and its amendments, to LUIS LUBIN POVEDA ALVARADO, identity card 5-0212-0950, and ROSA EMILIA SILVA GONZÁLEZ, identity card 2-0323-0799, awarded by resolution of the Board of Directors in the Article held on (sic) XXXVI, Session 052-99, held on July 21, 1999. 2) To authorize the Asesoría Legal de la Región Chorotega to notify the Registro Público, by formal request, of the annulment of the title registered under the computerized system for the Guanacaste registration district under number 115009-001-002, property type Lot 106 Asentamiento Lajas, Lot 106 Asentamiento Lajas Land for Agriculture, located in District 01 Juntas, Canton 7 Abangares, measuring two hundred ninety-nine thousand one hundred seventy-three meters and ninety-seven square decimeters, bounded to the North by Lot 15, to the South by Saúl Salas, to the East by Lots 14 and 15, and to the West by Lot 1 05 and a right-of-way easement (servidumbre de paso).
The corresponding encumbrance consisting of the IDA Restrictions under Ley 2825 Article 67, recorded at volume 471-17522-01-0116-001, shall be canceled; furthermore, because the matter has been decided in the terms described, the notation at volume 2009-236119-001 shall be canceled, the described property shall revert, and it shall be registered in the name of the Instituto de Desarrollo Agrario with the encumbrances indicated by the Registry. 3) An Appeal (…) may be filed against the resolution adopted in this regard by the Board of Directors of the Instituto de Desarrollo Agrario within 5 days following service (…) Said Appeal must be filed with the Asesoría Legal de la Región Chorotega…”. On November 24, 2010, the parcel in question was registered in the name of the IDA. On May 27, 2011, Luis Lubín and Rosa Emilia filed an appeal (recurso de apelación) with the Asesoría Jurídica de la Región Chorotega of the IDA against the resolution of the Board of Directors of the IDA contained in Article 50 of ordinary session 23-2010, held on July 26, 2010, by which it was ordered that the award of parcel 106 be revoked and the registration of that property in the names of the aforementioned persons be annulled.
II.Based on the foregoing, Luis Lubín Poveda Alvarado and Rosa Emilia Silva González sued INDER, seeking the following declarations: “1- That this ordinary action be granted in all respects. 2- That the notice of the Decision of the Instituto de Desarrollo Agrario, Oficina Asuntos Jurídicos Región Chorotega, issued at Catorce horas treinta minutos del tres de diciembre del dos mil ocho, COMMENCING ORDINARY ADMINISTRATIVE PROCEEDINGS FOR REVOCATION, WITH THE SUBSEQUENT NULLIFICATION OF THE TITLE TO PARCEL No 106 OF ASENTAMIENTO LAJAS AGAINST ROSA EMILIA SILVA GONZÁLEZ, IDENTITY CARD 2-233-799, AND LUÍS LUBÍN POVEDA ALVARADO, IDENTITY CARD 5-212-950, effected by PUBLICATION OF AN EDICT IN THE OFFICIAL GAZETTE LA GACETA NUMBERS 177 AND 178, DATED 10 Y 11 DE SETIEMBRE DE 2009, IS ABSOLUTELY NULL AND VOID. THE SUBSEQUENT DECISIONS AND THE ADMINISTRATIVE PROCEEDINGS THEMSELVES ARE LIKEWISE NULL AND VOID. 3- That the proceedings in Administrative Case File for Revocation and Nullification of Title No 082-07, Parcel 106 of Asentamiento Campesino Lajas, Against: Luis Lubín Poveda Alvarado and Rosa Emilia Silva González.
By: Instituto de Desarrollo Agrario, Oficina Asuntos Jurídicos Región Chorotega, commenced on 03 de Diciembre de 2008 and concluded on 24 de Agosto de 2010, a circumstance that clearly exceeded the 6-month period established by law for issuing a decision; that is, the time between notice of the Decision commencing the proceedings in Diciembre de 2008 and the final Decision and/or the INDER Board of Directors’ Resolution, formerly IDA, of 24 de Agosto de 2010, amounted to 1 año 8 meses, thereby exceeding the 6-month period established by law for deciding matters of this kind. Consequently, the proceedings had LAPSED and, therefore, the proceedings and decisions are ABSOLUTELY NULL AND VOID. 4- That the registration with the Registro Nacional, Sección de Bienes Inmuebles, of the property located in the Province of Guanacaste, Real Property Folio Registration 115009-000, Cadastral Plan Number G-57067 4-1999, currently registered in the name of the Instituto de Desarrollo Agrario, be canceled and reversed.
Consequently, that the property at issue be registered in the plaintiff’s name in the Registro Público, so that it is once again registered in the plaintiffs’ names. 5- That the defendant, Instituto de Desarrollo Rural INDER, be ordered to pay both categories of costs.” The action was initially filed before the Juzgado Agrario del Primer Circuito Judicial de Guanacaste, Liberia, on 11 de marzo de 2015. The defendant Institute opposed the action and raised the defenses of lack of standing to sue and be sued and failure to state a legal right. The representative of the State, in the agrarian proceedings, raised the defense of lack of subject-matter jurisdiction, which the Court denied on the ground that, as an interested party, the representative was not authorized to raise defenses. The Procurador who appeared in the proceedings challenged before the Sala Primera de la Corte Suprema de Justicia vote no. 563-C-2016 of 15:03 hours on 16 de junio de 2016, by which the Tribunal Agrario del Segundo Circuito Judicial de San José held that the agrarian jurisdiction had jurisdiction to hear these proceedings.
By decision no. 153-C-S1-2018 of 11:30 hours on 01 de marzo de 2018, the Sala Primera held that jurisdiction over the matter lay with the contentious-administrative jurisdiction. By decision issued at 15:46 hours on 10 de setiembre de 2018, the Case-Management Judge ruled, in pertinent part: “...A review of these proceedings indicates that the State’s natural heritage may be affected, according to official communication N° SINAC-ACAT-D-228-2015 dated 17 de noviembre del 2015; it is therefore appropriate to join SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN as a necessary passive co-litigant (litisconsorcio pasivo necesario), pursuant to article 12.3 of the Código Procesal Contencioso Administrativo. Furthermore, although the State’s participation in this case is as an interested third party, pursuant to the decision issued by the Juzgado Agrario at 14:13 on 22 de enero de 2016, it is appropriate to treat it as a defendant, as provided in numeral 12.2 of the Código Procesal Contencioso Administrativo, because SINAC has been joined...”.
By decision number 416-2018, issued at 10:27 hours on 18 de octubre de 2018, the Sección Segunda del Tribunal de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda affirmed, by majority vote, the joinder of the State and SINAC as necessary passive co-litigants. In the contentious-administrative proceedings, the State and SINAC opposed the action and raised defenses of lapse (caducidad) and failure to state a legal right. SINAC requested recognition as a third party asserting its own claims, seeking: a) A declaration that SINAC is the administrator of the tract of land corresponding to property registered under real-property folio N°5-11-5009-000, and an order that the property be vacated and that SINAC take possession thereof. b) An order directing the Registro Inmobiliario to register property under real-property folio N°5-115009-000 in favor of Estado-MINAE (Ministerio de Ambiente y Energía).
The Tribunal Contencioso Administrativo y Civil de Hacienda, Sección V, composed of Judges Marianella Álvarez Molina, Ileana Isabel Sánchez Navarro, and Sergio Mena García, ruled as follows in judgment no. 103-2020, issued at 7 hours 30 minutes on 02 de diciembre de 2020: “The defenses of lapse renewed by the co-defendants are granted. Consequently, the action filed by Luis Lubín Poveda Alvarado and Rosa Emilia Silva González against Instituto de Desarrollo Rural, Sistema Nacional de Áreas de Conservación, and the State is declared inadmissible. In view of the manner in which the case is decided, no ruling is made on the parties’ remaining claims, including the request by Sistema Nacional de Áreas de Conservación to be treated as an interested third party asserting its own claims—despite the fact that the Tribunal de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda affirmed the decision joining it sua sponte as a necessary passive co-litigant—or on the defenses on the merits.
The plaintiffs are relieved of the obligation to pay attorneys’ fees and litigation costs to Instituto de Desarrollo Agrario because they had sufficient grounds to litigate. The plaintiffs are relieved of the obligation to pay either category of costs to the State and Sistema Nacional de Áreas de Conservación, which were joined sua sponte in these proceedings as necessary passive co-litigants.” Dissatisfied with that ruling, the plaintiffs filed an appeal in cassation (recurso de casación). To facilitate understanding of the ruling to be issued, it is clarified that the grounds for challenge asserted have been reordered and regrouped by this Court of Cassation as set forth below.
III.Because they are related, the first and second grounds for challenge will be considered jointly. The appellant alleges a violation of substantive res judicata (cosa juzgada material) and an improper interpretation of article 67 of the Código Procesal Contencioso Administrativo. The appellant states that, by decision no. 197-2019, issued at 10 hours 30 minutes on 08 de febrero de 2019, the case-management judge denied the defense of lapse raised by the co-defendants (in the case of the State and SINAC, raised in their response to the complaint; in the case of INDER, at the preliminary hearing). The appellant objects that, although that decision became final, the Trial Court again considered and granted the defense raised, consequently declaring the action inadmissible. The appellant notes that, in the challenged judgment, the Court stated: “(...) pursuant to subsections a) and b) of article 67 of the Código Procesal Contencioso Administrativo, the defenses of res judicata, settlement, limitation, and lapse may be renewed and, therefore, reconsidered when judgment is rendered.” The appellant argues that the foregoing statement constitutes an erroneous interpretation of the cited provision because it does not permit a defense already denied by a final decision at the preliminary hearing to be renewed at the trial hearing, since the issue is thereby precluded.
According to the appellant’s interpretation, ordinal 67 ibídem provides that the defense of lapse may be raised until before the conclusion of the trial hearing, which is possible when it has not been raised at another procedural stage. However, the appellant insists that once such a defense has been invoked at another procedural stage and resolved at the preliminary hearing, it cannot be renewed at the trial hearing, because doing so would violate due process and legal certainty.
IV.The claims asserted are denied. As a general rule, article 66 subsection 1), subparagraph k), of the CPCA provides that lapse, when clear and manifest, may be raised as a preliminary defense (defensa previa) in the response to the complaint. Nevertheless, pursuant to numeral 67 subsection 1) ibídem, that defense may also be raised at any time before the oral and public trial concludes. Thus, subsection 2) provides that if the defense is raised before the conclusion of the preliminary hearing, it shall be resolved through an interlocutory ruling, without prejudice to its being considered again when judgment is rendered. The latter circumstance is present here because the co-defendants raised the defense of lapse before the conclusion of the preliminary hearing; accordingly, the case-management judge was required to resolve it through an interlocutory ruling, but the Court was also authorized to reconsider it in its judgment, because the procedural provision expressly so provides. Consequently, the alleged errors are not established, and the grounds asserted must therefore be rejected.
V.In the third ground, the appellant alleges a violation of articles 2 subsections f) and h) of the Ley de la Jurisdicción Agraria and 868 of the Código Civil. The appellant argues that when the action was filed on 11 de marzo de 2015, it was filed in accordance with the cited agrarian provisions, which vested the agrarian jurisdiction with jurisdiction over and authority to hear cases of this kind. Therefore, the appellant contends that the limitation period for lapse provided in article 39 of the CPCA was not applicable at that time; instead, the ten-year statute of limitations provided in provision 868 of the Código Civil applied, because agrarian matters are governed supplementarily by the provisions of the Código Civil and Código Procesal Civil, not those of the CPCA. The appellant explains that the State and SINAC became involved after the action had been filed due to a circumstantial development, namely, the classification of the property in question as State heritage, which led the Sala Primera to declare that jurisdiction over the present matter lay with the contentious-administrative jurisdiction.
Accordingly, the appellant contends that if, when the action was filed, jurisdiction lay with the agrarian jurisdiction, the applicable limitation period is not the lapse period provided in the CPCA but rather the ten-year statute of limitations established in the Código Civil.
VI.The appellant’s arguments are without merit. Article 13 of the Ley Forestal provides: “Establishment and administration. The natural heritage of the State (patrimonio natural del Estado) shall consist of the forests and forestlands (terrenos forestales) of national reserves, areas declared inalienable, properties registered in its name, and those belonging to municipalities, autonomous institutions, and other agencies of the Public Administration, except for real property securing credit transactions with the Sistema Bancario Nacional that becomes part of their assets. // The Ministerio del Ambiente y Energía shall administer the natural heritage. Where appropriate, acting through the Procuraduría General de la República, it shall register the lands in the Registro Público de la Propiedad as individually identified properties owned by the State. // Nongovernmental organizations that acquire real property containing forests or suitable for forestry, using funds derived from donations or the public treasury that were obtained on behalf of the State, must transfer such property to the State.” Article 14 of that same Law, in turn, states: “Nonattachable and inalienable status of the natural heritage.
The forestlands and forests constituting the natural heritage of the State, as detailed in the preceding article, shall be nonattachable and inalienable; possession thereof by private parties shall create no right in their favor, and the State’s action for recovery of ownership (acción reivindicatoria) over such lands shall not be subject to prescription. Consequently, they may not be registered in the Registro Público through possessory information proceedings (información posesoria), and both their invasion and occupation shall be punished in accordance with this law.” Provision 15 thereof establishes: “Restrictions. Public Administration agencies may not exchange, assign, alienate in any manner, convey, or lease rural lands owned or administered by them unless those lands have first been classified by the Ministerio del Ambiente y Energía. If they are covered by forest, they shall automatically be incorporated into the natural heritage of the State, and a restriction shall be established and recorded in the Registro Público.” Article 108 of the Ley de Biodiversidad then provides: “In matters concerning biodiversity, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the contentious-administrative courts (jurisdicción contencioso administrativa).
As exceptions to the preceding rule, offenses against biodiversity shall be tried by the criminal courts; likewise, disputes arising between private parties that do not involve an administrative act (acto administrativo) or the public domain shall fall within the jurisdiction of the agrarian courts.” In this matter, as the plaintiffs themselves acknowledged in the third factual allegation of their complaint, before these proceedings were instituted, the property at issue was used for forestry. Accordingly, as may be inferred from the provisions cited above, the forest public domain (dominio público forestal) is determined by the existence of forests, not by their formal designation in cadastral or registry records; that is, the special status of such property is conferred by law, which recognizes its public-domain status by virtue of its nature. The SINAC certification classifying the land awarded by INDER as having forest cover (cobertura forestal) and, therefore, as forest and part of the natural heritage of the State, is not the act creating the designation—as the plaintiffs contend—but rather an administrative act of a declaratory nature.
Consequently, the petitioners’ contention that, when the complaint was filed, the applicable limitations period for bringing the action was the ten-year period contained in the Código Civil, as though the property were land suited merely for agricultural use, cannot be accepted. In their complaint, the plaintiffs themselves acknowledged that the property was used for forestry—even before resorting to the courts—and therefore, in light of the aforementioned provisions, which expressly assign jurisdiction over this type of matter to the contentious-administrative courts, the forfeiture period (plazo de caducidad) applicable here is that established in Article 39 of the CPCA—an issue that will be addressed in greater depth below. Accordingly, this ground of appeal shall be rejected.
VII.In the fourth ground of challenge, the petitioners allege a violation of Articles 40 of the CPCA and 176 of the Ley General de la Administración Pública. They argue that the forfeiture period cannot be calculated from May 27, 2011 (the date on which the plaintiffs filed an appeal against the decision ordering revocation of the award of the property), or from the date on which that challenge was rejected (because that date is unknown in this case, as there is no administrative record (expediente administrativo) through which that circumstance can be verified, nor was any decision on the matter added to the case file). They emphasize that the co-defendants were responsible for submitting that decision or the administrative record showing whether the challenge had been decided. They note that, because the co-defendants failed to do so, there is no certain date from which to calculate the forfeiture period.
They further state that the co-defendants raised the defense of forfeiture on the ground that the extinguishing period established in Article 39 of the CPCA elapsed between the final administrative decision—issued on August 24, 2010—and the filing of the complaint—March 11, 2015. They object that calculating the period from the issuance of the final act is entirely untenable in this case because the plaintiffs were unaware that administrative proceedings seeking annulment of their title to the property had been instituted, given that they had been served by publication, as shown in the record. Accordingly, they maintain that it would be entirely improper to begin calculating the period from the issuance of the final administrative act, given the plaintiffs’ lack of knowledge and state of defenselessness. They assert that the issuance of the final administrative act without affording the plaintiffs a hearing renders it absolutely null and void and, consequently, that the provision applicable to forfeiture is Article 40 of the CPCA in conjunction with Article 175 of the LGAP, by virtue of the continuing effects of the void act.
They contend that the administrative acts produced and continue to produce harmful legal effects, namely the revocation or annulment of the title to parcel 106, which is currently registered in the name of INDER. Consequently, they assert that, pursuant to the cited provisions and because the effects of the challenged act remain in force, forfeiture has not occurred in this case.
VIII.This ground shall be rejected. The argument that the forfeiture period cannot be calculated from the date on which the appeal against the final act was filed (May 27, 2011), or from the date on which that challenge was allegedly rejected (an unknown date), is unavailing because the Tribunal used neither date as the starting point for the calculation. The panel of judges stated: “Notwithstanding the foregoing, given that the plaintiffs filed an appeal against Article 50 of ordinary session 023-2010, held on July 26, 2010 by the Junta Directiva del Instituto de Desarrollo Agrario, and that one month elapsed after that appeal was filed without the Asesoría Legal de la Región Chorotega del Instituto de Desarrollo Agrario expressly ruling on its admissibility (see Considerando II, section a, of this judgment), this Tribunal finds that, pursuant to Articles 31(6) and 32 of the Código Procesal Contencioso Administrativo and Article 261(3) of the Ley General de la Administración Pública, the appeal filed by the plaintiffs is deemed denied—through application of negative administrative silence (silencio negativo)—one month after it was filed, that is, as of June 27, 2011.
In view of the foregoing, the one-year period established in Article 39 of the Código Procesal Contencioso Administrativo for filing the complaint that initiated these plenary proceedings, which seek a declaration of absolute nullity of the proceedings to revoke the award of parcel 106 of Asentamiento Lajas and, consequently, of all actions taken and decisions issued therein—including service by publication of the initial order in those proceedings—began to run on June 27, 2011 and expired on June 27, 2012.” The appellant raises no objection regarding the application of negative administrative silence or its effect on calculating the extinguishing period; therefore, the ruling on that issue remains undisturbed. Nor can the argument that the applicable forfeiture period is the one prescribed in Article 40 of the CPCA, because the allegedly void act has continuing effects, be accepted. As the lower Tribunal correctly found, the administrative act revoking the award of parcel 106 of Asentamiento Lajas in Abangares, Guanacaste, to the plaintiffs is an act producing instantaneous and immediate effects, whose impact was exhausted at a single point in time by extinguishing the legal status that had previously benefited the plaintiffs.
That adverse change in the plaintiffs’ legal sphere occurred at a single moment; the change took place only once and with final effect, creating for Poveda Alvarado and Silva González a new legal status different from that which existed before the challenged administrative decision was issued. Although that extinguishment has permanent consequences—because the subjective right (derecho subjetivo) was definitively removed from the award recipients’ legal sphere—it cannot be characterized as having continuing effects or recurring impact, because the change in the plaintiffs’ legal status took place and became final at a single point in time as a direct consequence of the final decision ordering revocation, without any further “changes” or “adverse effects” occurring on more than one occasion thereafter. Accordingly, the alleged violation of Articles 40 of the CPCA and 175 of the LGAP has not been established, and the challenge must be rejected.
IX.In view of the foregoing, the appeal on points of law (recurso de casación) filed by the plaintiffs shall be denied, and they shall be ordered to pay the costs incurred as a result thereof (Article 150(3) of the CPCA).

Revisión del Documento Res. 000101-F-TC-2023 TRIBUNAL DE CASACIÓN DE LO CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA. San José, a las trece horas cincuenta minutos del catorce de junio del año dos mil veintitrés.
En el proceso de conocimiento tramitado ante el Tribunal Contencioso Administrativo y Civil de Hacienda por LUIS LUBÍN POVEDA ALVARADO y ROSA EMILIA SILVA GONZÁLEZ; contra el INSTITUTO DE DESARROLLO RURAL, el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN y el ESTADO, representado por el Procurador Mauricio Castro Lizano; el representante de la parte actora plantea recurso de casación contra la sentencia no. 103-2020 de las 7 horas 30 minutos del 02 de diciembre de 2020, dictada por el Tribunal Contencioso Administrativo y Civil de Hacienda, Sección V, integrado por los jueces Marianella Álvarez Molina, Ileana Isabel Sánchez Navarro y Sergio Mena García. Intervienen, en su calidad de apoderados especiales judiciales: de los actores, el licenciado Miguel Herrera González; del INDER, la señora María Teresa Fernández Chinchilla; del SINAC, los señores Deifilia María Dávila Ruiz y Róger Francisco Gutiérrez Vindas.

CONSIDERANDO
I.Según los hechos tenidos por probados, y no impugnados por la parte recurrente, por acuerdo contenido en el artículo XXXVI de la sesión número 52-99 celebrada el 21 de julio de 1999, la Junta Directiva del Instituto de Desarrollo Agrario (IDA), dispuso por unanimidad y en firme, adjudicar a los señores Luis Lubín Poveda Alvarado y Rosa Emilia Silva González, la parcela 106 del Asentamiento Lajas, sita en Abangares, Guanacaste. Dicho inmueble se describe en el plano catastrado número 570674-99, con un área de 9.173,97 m2 y fue inscrito a nombre de las personas dichas, bajo matrícula de folio real número 115009-001 y 002. Mediante informe de campo contenido en el oficio número IT-OSCR-047-2007 del 13 de junio de 2007, el Ingeniero Luis Alfredo Vásquez Campos, de la Oficina de Fiscalización Agraria de la Oficina Sub Regional en Cañas del IDA, recomendó “…iniciar con los procesos de revocatoria de la adjudicación y subsecuente nulidad de título al administrado, propietarios de la parcela # 106, por la causal de "abandono injustificado de la parcela", acápite 4) inciso 2 del artículo 63 de la Ley 2825…”.
A las 14:30 horas del 08 de diciembre de 2008, la Oficina de Asesoría Jurídica de la Región Chorotega del IDA dictó el auto inicial del procedimiento administrativo ordinario de revocatoria y nulidad del título sobre la parcela en cuestión. En el acta de notificación del auto inicial del procedimiento administrativo, la Asistente de la Asesoría Jurídica de la Región Chorotega del IDA, hizo constar que a los señores Luis Lubín y Rosa Emilia “…se le llegó a notificar en 2 ocasiones, los días 23 y 27 de febrero del año 2009 y no se localizó, se procede a notificar por edicto…”. A las 15:10 horas del 25 de agosto de 2009, se expidió exhorto dirigido al Director del Registro Público de la Propiedad Inmueble, a fin de que se procediera con la anotación respectiva del inicio del procedimiento administrativo al margen registral de la finca con matrícula de folio real número 115009-001 y 002. Dicho exhorto fue presentado al Diario del Registro Público el 09 de setiembre de 2009.
Mediante resolución de las 14:20 horas del 25 de agosto de 2009, la Asesoría Jurídica de la Región Chorotega del IDA dispuso que “…Por no encontrase en su domicilio y desconocerse el domicilio actual de los señores ROSA EMILIA SILVA GONZÁLEZ y LUIS LUBIN POVEDA ALVARADO, de conformidad con el artículo 241 de la Ley General de la Administración Pública y 108 inciso e) del Reglamento para la Selección y Asignación de Solicitantes de Tierras del Instituto de Desarrollo Agrario vigente, publíquese por DOS VECES CONSECUTIVAS en el Diario Oficial La Gaceta”, el auto inicial del procedimiento de revocatoria de la adjudicación de la parcela 106, Asentamiento Lajas en Abangares, Guanacaste. En el Diario Oficial La Gaceta número 177 y 178, del 10 y 11 de setiembre de 2009, respectivamente, se publicaron los edictos indicados. A las 11:00 horas del 24 de agosto de 2010, la Junta Directiva del IDA dictó el acto final del procedimiento, en cuya parte dispositiva acordó: “…1) Revocar la adjudicación de la parcela 106 del Asentamiento Lajas; situada en el Distrito 01 Juntas Cantón 7 Abangares de la Provincia de Guanacaste, por la causal de abandono injustificado de la parcela, de conformidad con lo dispuesto en los Artículos sesenta y ocho inciso cuarto apartado b), en relación con el 62 y 66 de la Ley 2825 y sus reformas a los señores LUIS LUBIN POVEDA ALVARADO, cédula de identidad 5-0212-0950 y ROSA EMILIA SILVA GONZÁLEZ, cédula de identidad 2-0323-0799, adjudicado mediante acuerdo de Junta Directiva, en el Artículo celebrada el (sic) XXXVI, Sesión 052-99, celebrada el 21 de julio de 1999. 2) Autorizar a la Asesoría Legal de la Región Chorotega a comunicar mediante exhorto al Registro Público la nulidad del título inscrito bajo el sistema mecanizado del partido de Guanacaste con número 115009-001-002, naturaleza Lote 106 Asentamiento Lajas, Lote 106 Asentamiento Lajas Terreno para la Agricultura situación Distrito 01 Juntas, Cantón 7 Abangares cabida doscientos noventa y nueve mil ciento setenta y tres metros con noventa y siete decímetros cuadrados, linderos al Norte Lote 15, al Sur Saúl Salas, Este Lotes 14 y 15 y al Oeste Lote 1 05 y Servidumbre de paso.
Se cancele el gravamen respectivo de las Limitaciones del IDA Ley 2825 Artículo 67, al tomo 471-17522-01-0116-001, además por haberse resuelto en los términos descritos se cancele la anotación al tomo 2009-236119-001, se revierta el inmueble descrito y se inscriba a nombre del Instituto de Desarrollo Agrario con los gravámenes que indica el Registro. 3) De la resolución que en este sentido tome la Junta Directiva del Instituto de Desarrollo Agrario, podrá interponerse Recurso de Apelación (…) en el término de 5 días a partir de la notificación (…) Dicho Recurso deberá presentarse ante la Asesoría Legal de la Región Chorotega…”. El 24 de noviembre de 2010, la parcela en cuestión fue inscrita a nombre del IDA. El 27 de mayo de 2011, ante la Asesoría Jurídica de la Región Chorotega del IDA, los señores Luis Lubín y Rosa Emilia plantearon recurso de apelación contra el acuerdo de la Junta Directiva del IDA, contenido en el artículo 50 de la sesión ordinaria 23-2010, celebrada el 26 de julio de 2010, mediante el cual se dispuso revocar la adjudicación dispuesta de la parcela 106 y la nulidad de la inscripción registral de ese inmueble a nombre de las personas dichas.
II.Con fundamento en lo anterior, los señores Luis Lubín Poveda Alvarado y Rosa Emilia Silva González, demandaron al INDER, pretendiendo se declare: “1- Con lugar en todos sus extremos, la presente demanda ordinaria. 2- Que la notificación de la Resolución del Instituto de Desarrollo Agrario, Oficina Asuntos Jurídicos Región Chorotega, a las Catorce horas treinta minutos del tres de diciembre del dos mil ocho, se inicia PROCESO ADMINISTRATIVO ORDINARIO DE REVOCATORIA CON LA SUBSECUENTE NULIDAD DE TÍTULO DE LA PARCELA No 106 DEL ASENTAMIENTO LAJAS CONTRA LOS SEÑORES ROSA EMILIA SILVA GONZÁLEZ, CÉDULA 2-233-799 Y LUÍS LUBÍN POVEDA ALVARADO, CÉDULA 5-212-950, realizada mediante EDICTO EN EL DIARIO OFICIAL LA GACETA NÚMERO 177 Y 178, DE FECHA 10 Y 11 DE SETIEMBRE DE 2009. ES ABSOLUTAMENTE NULA. ASÍ LAS RESOLUCIONES POSTERIORES Y EL PROCEDIMIENTO ADMINISTRATIVO EN SÍ. 3- Que el procedimiento del Expediente Administrativo de Revocatoria y Nulidad de Título No 082-07, Parcela 106 del Asentamiento Campesino Lajas, Contra: Luis Lubín Poveda Alvarado y Rosa Emilia Silva González.
De: Instituto de Desarrollo Agrario, Oficina Asuntos Jurídicos Región Chorotega, inició el 03 de Diciembre de 2008 y finalizó el 24 de Agosto de 2010, situación que a todas luces superó el plazo de los 6 meses, que la Ley establece para resolver, esto es que el tiempo entre la notificación de la Resolución que iniciaba el procedimiento en Diciembre de 2008 y la Resolución final y/o el Acuerdo de Junta Directiva del INDER, anteriormente IDA, del 24 de Agosto de 2010, lo cual implica una duración de 1 año 8 meses, lo que superó el plazo establecido por Ley de 6 meses para resolver este tipo de asuntos. Consecuentemente, el procedimiento estaba CADUCO, por lo tanto deviene el procedimiento y las resoluciones en ABSOLUTAMENTE NULOS. 4- Se anule y revierta la inscripción en el Registro Nacional, Sección de Bienes Inmuebles, del Inmueble Partido de Guanacaste Folio Real Matrícula 115009-000, Plano Catastrado Número G-57067 4-1999, actualmente a nombre del Instituto de Desarrollo Agrario.
Consecuentemente se inscriba el inmueble en litis, a nombre de la actora, en el Registro Público. Para que vuelva a estar inscrito a nombre de los actores. 5- Se condene a la demandada Instituto de Desarrollo Rural INDER, al pago de ambas costas”. La demanda fue inicialmente planteada ante el Juzgado Agrario del Primer Circuito Judicial de Guanacaste, Liberia, en fecha 11 de marzo de 2015. El Instituto demandado contestó negativamente e interpuso las excepciones de falta de legitimación activa y pasiva, y falta de derecho. El representante del Estado, en sede agraria, interpuso la defensa de incompetencia en razón de la materia, la cual fue denegada por el Juzgado, por considerar que, al ser parte interesada, no estaba facultado para interponer excepciones. El Procurador apersonado en el proceso interpuso inconformidad ante la Sala Primera de la Corte Suprema de Justicia, contra el voto no. 563-C-2016 de las 15:03 horas del 16 de junio de 2016, mediante el cual el Tribunal Agrario del Segundo Circuito Judicial de San José dispuso que la jurisdicción agraria era la competente para conocer de este proceso.
Mediante resolución no. 153-C-S1-2018 de las 11:30 horas del 01 de marzo de 2018, la Sala Primera dispuso que el conocimiento de ese asunto correspondía a la jurisdicción contencioso administrativa. Por resolución de las 15:46 horas del 10 de setiembre de 2018, el Juez Tramitador dispuso -en lo que interesa-: "...De un estudio del presente proceso al determinar que puede existir una afectación al patrimonio natural del Estado según oficio N° SINAC-ACAT-D-228-2015 de fecha 17 de noviembre del 2015, lo procedente es integrar como litisconsorcio pasivo necesario al SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN de conformidad con el artículo 12.3 del Código Procesal Contencioso Administrativo. Por otro lado, si bien es cierto la participación del Estado en la presente causa es de tercer interesado según la resolución de las 14:13 del 22 de enero de 2016 emitida por el Juzgado Agrario, lo procedente es tenerlo como parte pasiva, según lo previsto en el numeral 12.2 del Código Procesal Contencioso Administrativo, por haberse integrado el SINAC...".
Mediante resolución número 416-2018 de las 10:27 horas del 18 de octubre de 2018, la Sección Segunda del Tribunal de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda confirmó, por voto de mayoría, la integración del litis consorcio pasivo necesario con el Estado y el SINAC. En sede contencioso administrativa, el Estado y el SINAC contestaron negativamente y opusieron defensas de caducidad y falta de derecho. El SINAC solicitó se le tuviera como un tercero con pretensiones propias, peticionando: a) Se declare que el SINAC es el administrador del área de terreno de la finca matrícula de folio real N°5-11-5009-000; se ordene el desalojo y toma de posesión del inmueble por parte suya. b) Se ordene al Registro Inmobiliario la inscripción registral a favor del Estado-MINAE (Ministerio de Ambiente y Energía), la finca matrícula de folio real N°5-115009-000. El Tribunal Contencioso Administrativo y Civil de Hacienda, Sección V, integrado por los jueces Marianella Álvarez Molina, Ileana Isabel Sánchez Navarro y Sergio Mena García, mediante sentencia no. 103-2020 de las 7 horas 30 minutos del 02 de diciembre de 2020, dispuso: “Se acogen las excepciones de caducidad reiteradas por los codemandados.
En consecuencia, se declara inadmisible la demanda interpuesta por Luis Lubín Poveda Alvarado y Rosa Emilia Silva González contra el Instituto de Desarrollo Rural, el Sistema Nacional de Áreas de Conservación y el Estado. Por la forma en que se resuelve, se omite pronunciamiento tanto sobre los demás extremos planteados por las partes, incluida la solicitud del Sistema Nacional de Áreas de Conservación de que se le tuviera como tercero interesado con pretensiones propias -a pesar de que el Tribunal de Apelaciones de lo Contencioso Administrativo y Civil de Hacienda, confirmó la resolución en que se le integró de oficio como litis consorcio pasivo necesario-, como sobre las excepciones de fondo. Se exonera a los actores del pago de costas personales y procesales al Instituto de Desarrollo Agrario, por tener motivo suficiente para litigar. Se exonera a los demandantes del pago de ambas costas al Estado y al Sistema Nacional de Áreas de Conservación, a los que se integró de oficio a este proceso como litis consorcios pasivos necesarios”.
Inconforme con lo resuelto, la parte actora plantea recurso de casación. Para un mejor entendimiento de lo que se resolverá, se aclara que los agravios aducidos han sido reordenados y reagrupados por este Tribunal de Casación, en la forma como se expone a continuación.
III.En razón de su conexidad, el primero y segundo agravio serán conocidos en forma conjunta. La parte recurrente acusa violación de la cosa juzgada material e indebida interpretación del artículo 67 del Código Procesal Contencioso Administrativo. Señala, mediante resolución no. 197-2019 de las 10 horas 30 minutos del 08 de febrero de 2019, la jueza tramitadora declaró sin lugar la defensa de caducidad planteada por los codemandados (en el caso del Estado y del SINAC, interpuesta con la contestación de la demanda; en el caso del INDER, en la audiencia preliminar). Reprocha, pese a que dicha resolución adquirió firmeza, el Tribunal de Juicio nuevamente conoció de la excepción planteada y la acogió, con la consecuente declaratoria de inadmisibilidad de la demanda. Acota, en la sentencia recurrida, el Tribunal aseveró: “(…) de conformidad con lo dispuesto en los incisos a) y b) del artículo 67 del Código Procesal Contencioso Administrativo, las excepciones de cosa juzgada, transacción, prescripción y caducidad, pueden ser reiteradas y por ende, analizadas nuevamente con el dictado de la sentencia”.
La anterior afirmación, censura, resulta ser una interpretación errónea de la citada norma, pues en ningún momento permite reiterar en audiencia de juicio una excepción que ya fue denegada en audiencia preliminar mediante resolución firme (lo cual precluye el tema). Según su interpretación, el ordinal 67 ibídem dispone que la excepción de caducidad puede interponerse hasta antes de finalizar la audiencia de juicio, lo que es posible cuando no haya sido alegada en otra etapa procesal. Pero, insiste, una vez que tal excepción ha sido invocada en otra fase procesal y resuelta en audiencia preliminar, no puede ser reiterada en audiencia de juicio, pues ello atentaría contra el debido proceso y la seguridad jurídica.
IV.No ha lugar a los reclamos aducidos. Como regla general, el artículo 66 inciso 1) subinciso k) del CPCA, dispone que la caducidad (evidente y manifiesta) puede ser planteada como defensa previa con la contestación de la demanda. No obstante, de conformidad con el numeral 67 inciso 1) ibídem, esa excepción también puede ser opuesta hasta antes de concluido el juicio oral y público. Así, dispone el inciso 2), en caso de que la defensa sea interpuesta antes de concluida la audiencia preliminar, ésta será resuelta de forma interlocutoria, sin perjuicio de que sea nuevamente analizada con el dictado de sentencia. En la especie, se cumple este último supuesto, toda vez que la excepción de caducidad fue formulada por los codemandados antes de concluida la audiencia preliminar, con lo cual la jueza tramitadora debía resolverla de manera interlocutoria, pero también el Tribunal se encontraba habilitado para conocerla de nuevo en sentencia, pues la norma procesal así lo dispone expresamente. Por consiguiente, no se evidencian los yerros reclamados, imponiéndose entonces el rechazo de los cargos planteados.
V.En el tercer motivo alega violación de los artículos 2 incisos f) y h) de la Ley de la Jurisdicción Agraria, y 868 del Código Civil. Argumenta, al momento de presentar la demanda, el día 11 de marzo de 2015, se hizo de conformidad con lo establecido en las normas agrarias citadas, que otorgaban la competencia y el conocimiento de este tipo de causas a la jurisdicción agraria. Por ende, interpreta, en ese momento no resultaba aplicable el plazo de caducidad previsto en el artículo 39 del CPCA, sino el plazo decenal de prescripción contemplado en el precepto 868 del Código Civil, pues en materia agraria rigen supletoriamente las normas del Código Civil y Procesal Civil, no las del CPCA. Explica, la participación del Estado y del SINAC sobrevino con posterioridad a la interposición de la demanda, por razones circunstanciales, cual fue la calificación del inmueble en cuestión como patrimonio estatal, lo cual conllevó a que la Sala Primera declarara que el conocimiento del presente asunto correspondía a la jurisdicción contencioso administrativa. Así las cosas, interpreta, si al momento de presentar la demanda, la competencia correspondía a la jurisdicción agraria, el plazo de caducidad aplicable no es el previsto en el CPCA, sino el de prescripción decenal contemplado en el Código Civil.
VI.No lleva razón la parte recurrente en sus alegatos. El artículo 13 de la Ley Forestal dispone: “Constitución y administración. El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio. // El Ministerio del Ambiente y Energía administrará el patrimonio. Cuando proceda, por medio de la Procuraduría General de la República, inscribirá los terrenos en el Registro Público de la Propiedad como fincas individualizadas de propiedad del Estado. // Las organizaciones no gubernamentales que adquieran bienes inmuebles con bosque o de aptitud forestal, con fondos provenientes de donaciones o del erario, que se hayan obtenido a nombre del Estado, deberán traspasarlos a nombre de este”.
Por su parte, el ordinal 14 de esa misma Ley, señala: “Condición inembargable e inalienable del patrimonio natural. Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley”. El precepto 15 ibídem establece: “Impedimentos. Los organismos de la Administración Pública no podrán permutar, ceder, enajenar, de ninguna manera, entregar ni dar en arrendamiento, terrenos rurales de su propiedad o bajo su administración, sin que antes hayan sido clasificados por el Ministerio del Ambiente y Energía.
Si están cubiertos de bosque, automáticamente quedarán incorporados al patrimonio natural del Estado y se constituirá una limitación que deberá inscribirse en el Registro Público”. Luego, el cardinal 108 de la Ley de Biodiversidad, indica: “En materia de biodiversidad y mientras no exista una jurisdicción ambiental, toda controversia será competencia exclusiva de la jurisdicción contencioso administrativa. Como excepciones de la regla anterior, los delitos contra la biodiversidad serán juzgados por la jurisdicción penal; de igual modo, las controversias que se susciten entre particulares, donde no medie un acto administrativo ni del dominio público, serán competencia de la jurisdicción agraria”. En este asunto, como la propia parte actora lo reconoció en el hecho tercero de su demanda, de previo a la interposición de este proceso, el inmueble en cuestión tenía uso forestal. Así las cosas, según se colige de las normas supra citadas, el dominio público forestal viene determinado por la existencia de bosques, y no por su afectación formal a nivel catastral o registral; es decir, la condición especial de esos bienes viene dada por ley, la cual les reconoce el carácter demanial en virtud de su naturaleza.
La certificación del SINAC que calificó el terreno adjudicado por el INDER como de cobertura forestal y, por ende, como bosque y patrimonio natural del Estado, no es la razón constitutiva de la afectación (como lo entienden los actores), sino que se trata de un acto administrativo con carácter declarativo. Por consiguiente, no resulta atendible el alegato de la parte casacionista en el sentido de que, al momento de interponer la demanda, el plazo para accionar era el plazo de prescripción decenal contenido en el Código Civil, como si se tratase de un terreno con vocación meramente agraria. La propia parte actora, en su demanda, reconoció que el inmueble tenía uso forestal -incluso antes de acudir a estrados judiciales-, por lo que, en atención a las normas antes mencionadas, que expresamente asignan la competencia jurisdiccional de este tipo de asuntos a los tribunales contencioso administrativos, el plazo de caducidad de la acción aplicable a la especie es el establecido en el artículo 39 del CPCA -aspecto sobre el cual se ahondará más adelante-. En consecuencia, se rechazará el agravio planteado.
VII.En el cuarto reparo aduce violación de los numerales 40 del CPCA y 176 de la Ley General de la Administración Pública. Refuta, no cabe computar el plazo de caducidad de la acción desde el 27 de mayo de 2011 (fecha cuando los actores plantearon recurso de apelación contra el acuerdo que dispuso revocar la adjudicación del inmueble), ni a partir de la fecha cuando esa impugnación fue rechazada (porque es un dato que no se conoce en este caso, al no existir expediente administrativo para verificar tal circunstancia, y tampoco se agregó a los autos ninguna resolución sobre el particular). Recalca, les correspondía a los codemandados aportar esa resolución o el expediente administrativo donde conste si la impugnación fue o no resuelta. Advierte, al no hacerlo así, no hay fecha cierta para computar el plazo de caducidad. Por otra parte, expone, la excepción de caducidad fue interpuesta por los codemandados bajo el argumento de que entre la resolución administrativa final -emitida el 24 de agosto de 2010- y la interposición de la demanda -11 de marzo de 2015-, transcurrió el plazo extintivo establecido en el artículo 39 del CPCA.
Reprocha, el cómputo del plazo desde la emisión del acto final resulta totalmente inviable en este caso, porque los actores no tenían conocimiento de la interposición del procedimiento administrativo que pretendía la nulidad de su título de propiedad, dado que habían sido notificados mediante edictos, según consta en autos. Así las cosas, sostiene, sería totalmente improcedente iniciar el cómputo a partir de la emisión del acto administrativo final, dado el desconocimiento y estado de indefensión en que se encontraban los accionantes. Asevera, el dictado del acto administrativo final, sin conferir audiencia a los actores, deviene absolutamente nulo y, por consiguiente, la norma aplicable en materia de caducidad es el precepto 40 del CPCA en relación con el 175 de la LGAP, en virtud de los efectos continuados del acto nulo. Afirma, los actos administrativos produjeron y siguen produciendo efectos jurídicos lesivos, como lo son la revocatoria o nulidad del título de propiedad sobre la parcela 106, la cual actualmente está inscrita a nombre del INDER. Por consiguiente, asevera, en aplicación de los ordinales citados, y en razón de la vigencia de los efectos del acto impugnado, la caducidad no ha operado en la especie.
VIII.El cargo será rechazado. Resulta inútil el alegato referido a que no cabe computar el plazo de caducidad a partir de la fecha de interposición del recurso de apelación contra el acto final (27 de mayo de 2011), ni de la fecha cuando esa impugnación fue supuestamente rechazada (fecha desconocida), pues el Tribunal no utilizó ninguna de ellas como punto inicial del cómputo. El colegio de jueces indicó: “No obstante lo anterior, dado que los accionantes plantearon un recurso de apelación contra el artículo 50 de la sesión ordinaria 023-2010, celebrada el 26 de julio del 2010 por la Junta Directiva del Instituto de Desarrollo Agrario, y de que transcurrió un mes desde que se interpuso dicho recurso sin que la Asesoría Legal de la Región Chorotega del Instituto de Desarrollo Agrario se pronunciara de manera expresa sobre la admisibilidad del mismo (ver considerando II aparte a de esta sentencia), este Tribunal considera que de acuerdo a lo dispuesto en los artículos 31 inciso 6), 32 del Código Procesal Contencioso Administrativo y 261 inciso 3) de la Ley General de la Administración Pública, se tiene por desestimado el recurso que plantearon los actores -en aplicación del silencio negativo- un mes después de interpuesto, o sea, a partir del 27 de junio del 2011.
En razón de lo anterior, el plazo de un año establecido en el artículo 39 del Código Procesal Contencioso Administrativo para presentar la demanda que dio origen a este proceso de conocimiento, en que se pretende la declaratoria de nulidad absoluta del procedimiento de revocatoria de la adjudicación de la parcela 106 del Asentamiento Lajas y por ende, de todas las actuaciones y resoluciones dictadas en el mismo -incluida la notificación por edictos de auto inicial del mismo-, empezó a computarse a partir del 27 de junio del 2011 y feneció el 27 de junio del 2012”. Respecto de la aplicación de la figura del silencio negativo y su incidencia en el cómputo del plazo extintivo, la parte recurrente no esboza ninguna objeción, por lo cual, lo resuelto sobre el particular se mantiene incólume. Luego, tampoco resulta atendible el argumento en el sentido de que el plazo de caducidad aplicable es el previsto en el ordinal 40 del CPCA, dado que el acto -considerado- nulo reviste efectos continuados.
Como bien lo apreció el Tribunal de instancia, el acto administrativo mediante el cual se revocó la adjudicación de la parcela 106 del Asentamiento Lajas en Abangares, Guanacaste, a favor de los actores, constituye un auto de efecto instantáneo e inmediato, cuya incidencia se agotó en un solo momento, extinguiendo la situación jurídica que otrora benefició a los accionantes. Esa modificación negativa en la esfera jurídica de los demandantes ocurrió en un único instante; la mutación se concretó una sola vez y de manera definitiva, creando una nueva situación jurídica para los señores Poveda Alvarado y Silva González, distinta de la que existía antes del dictado de la resolución administrativa cuestionada. La extinción acontecida, si bien tiene consecuencias permanentes -pues el derecho subjetivo fue suprimido definitivamente de la esfera jurídica de los adjudicatarios-, no puede ser catalogada como de efectos continuados o de incidencia repetida, pues la modificación de la situación jurídica de los actores se concretó y se consolidó en un solo espacio temporal, como consecuencia directa de la resolución firme que dispuso la revocatoria, sin que con posterioridad se hayan producido nuevas “transformaciones” o “afectaciones” en más de una ocasión. Así las cosas, no se verifica la infracción aducida respecto de los artículos 40 del CPCA y 175 de la LGAP, debiéndose rechazar la censura formulada.
IX.En mérito de lo expuesto, procederá declarar sin lugar el recurso de casación formulado por la parte actora, a quien se impondrán las costas generadas con su ejercicio (precepto 150 inciso 3 del CPCA).
POR TANTO
