Ordinary proceeding (proceso de conocimiento) brought by Ms. Leana Escoto García against Balneario River Side S.A., represented by its attorney-in-fact (apoderada), Lorena Edith Arrieta Murillo, of legal age, married, a resident of Bagaces; Municipalidad de Bagaces, represented by its Mayor, Mr. William Guido Quijano; the State; and Ms. Marta Lorena Quirós Ortíz. Appearing as special attorney-in-fact (apoderado especial) for the plaintiff is attorney William Sequeira Solís; on behalf of the State, in his capacity as State Attorney (Procurador), attorney Ricardo Jiménez Badilla; as special judicial attorney-in-fact (apoderado especial judicial) for Municipalidad de Bagaces, attorney Rodrigo Flores González; and on behalf of Balneario River Side S.A. and Ms. Quirós Ortíz, attorneys Maylin Chinchilla Vargas and Juan Francisco Loría González.
Justice Vargas Vásquez delivers the opinion; and,
WHEREAS
I.Leana Escoto García sued Balneario River Side S.A., Municipalidad de Bagaces, the State, and Ms. Marta Lorena Quirós Ortíz. She stated that, on 14 de julio del 2013, her 14-year-old son, [Nombre 001], was on an outing with relatives at the BALNEARIO RIVER SIDE tourist center, located in Bagaces, Guanacaste. She asserted that the owner of the tourist center in question, where the swimming facility is located, is BALNEARIO RIVER SIDE S.A. She added that the aforementioned recreational center had been operating since 26 de mayo de 2006 under permits and business licenses (patentes) granted by Ministerio de Salud, Rectoría de Bagaces, and Municipalidad de Bagaces. She argued that, on 14 de julio de 2013, her son was using the tourist center’s facilities, specifically the swimming pool, when he began fighting for his life. She stated that, because no lifeguard trained in rescue and first aid was present, no one was available to assist the child and provide him with support during those dramatic moments.
She recounted that her son was pulled from the pool by other visitors, who attempted to assist him; however, the premises had neither a designated and suitable area for providing medical care nor the necessary emergency equipment, so an ambulance had to be called and they had to wait for it to arrive. She maintained that, as recorded in his death certificate and the certification issued by Registro Civil, he died at 14:06 on 14 de julio de 2013. She stated that he died in the ambulance while being transported to the clinic, without receiving adequate medical care. She asserted that, according to autopsy A2013-01519, the cause of his death was: Asphyxia by submersion. She explained that the swimming facility did not have a first-aid room, as required by the Regulations on the Management of Public Swimming Pools (Reglamento sobre el manejo de Piscinas Públicas), Decreto No. 35309-S, dated 30 de marzo de 2009 and published in La Gaceta N°127 on 2 de julio de 2009, although it was required to have one because it operated under the restricted-public-use swimming pool regime (régimen de piscina de uso público restringido).
She transcribed section 27 of the aforementioned Regulations. She stated that the pool in question is more than 1.70 meters deep at its deepest point and that, regrettably, on that day the swimming facility did not have the personnel required for the safe operation of a swimming-pool center open to the public, as mandated by the aforementioned Regulations. She noted that, although the rules governing the management of public swimming pools required it to have lifeguards, the swimming facility merely displayed signs stating that the public used the facilities at their own risk and under their own responsibility. She warned that this disregarded the provisions of decreto no. 353098S because the required lifeguards were not present on the date of the incident. She stated that, on the date of the incident, the swimming facility had the corresponding operating permits issued by Municipalidad de Bagaces and Ministerio de Salud.
She noted that, by official letter MB-AT-042-2014 of 19 de marzo de 2014, Municipalidad de Bagaces informed them: “(...) The business licenses for Balneario River Side and the Restaurant (Tourist Center – sale of alcoholic beverages and prepared meals) have been in effect since 26 de mayo de 2006, the date on which Ministerio de Salud and this municipality issued the respective permits; this company has complied with the corresponding renewal of the health operating permits, the next renewal being scheduled for 16 de mayo de 2014, and those business licenses are currently paid up (...)”. She stated that it likewise informed them that the business licenses were in the name of Ms. Lorena Arrieta Murillo. She alleged that, by a document dated 17 de marzo de 2014, Ministerio de Salud, Área Rectora de Bagaces, was asked to issue a certification indicating in whose name, and since when, the sanitary operating permits (permisos sanitarios de funcionamiento) had been granted; in response, official letter CH-ARS-B-171-2014 of 24 de marzo de 2014 stated that, before that information could be issued, they had to explain their legitimate interest and the purposes for which it was required.
She argued that, while her son was drowning, there was no lifeguard to assist him, nor did he receive immediate care in a first-aid room. She emphasized that, at the time of his death, her son was in his second year of secondary school. She requests that the judgment declare the complaint meritorious and hold the co-defendants jointly and severally liable—in the case of Municipalidad de Bagaces and the State, under strict civil liability (responsabilidad civil objetiva) by virtue of their “fault in supervision (culpa in vigilando),” for failing in their duty to conduct adequate inspections and supervise compliance with Reglamento 35309-S—and order them to pay the following items: 1. Pecuniary damages (daño objetivo) for funeral expenses; 2. Pecuniary damages for the life expectancy of the minor [Nombre 001]; 3. Non-pecuniary damages (daño moral); 4. Interest on the amounts awarded from the date the judgment becomes final until actual payment; 5.
An order requiring Balneario River Side to adapt its infrastructure and hire the necessary personnel with the training required by decreto 35309-S in order to protect its users; 6. Costs to be borne by the defendants. The co-defendants denied the claims. Among other defenses, the State raised the statute-of-limitations defense (excepción de prescripción). The Court sustained it. It declared claims 1, 2, 3, and 4 inadmissible and ordered the proceeding to continue as to the remaining matters. Dissatisfied, the plaintiff seeks cassation review (casación).
II.Although the appellant raises two substantive grounds (cargos de naturaleza sustantiva), which she subsequently expands upon, given the manner in which the matter is resolved, only the first will be analyzed. She alleges misapplication and improper interpretation of section 198 of the General Law on Public Administration (Ley General de la Administración Pública, hereinafter LGAP), as well as failure to assess the evidence. She argues that the Court upheld the statute-of-limitations defense (defensa de prescripción) and, consequently, declared claims 1, 2, 3 and 4 of the complaint inadmissible; these constitute a substantial part of the present proceeding and would be subject to res judicata on the merits (cosa juzgada material). She states that the Court erroneously ruled on the statute-of-limitations objection (excepción de prescripción) by adhering to the literal wording of section 876 of the Civil Code, without considering the case law governing the State’s administrative liability for damages (responsabilidad administrativa indemnizatoria) concerning how the limitations period is calculated.
She contends that she pointed this out in her opposition to that defense; nevertheless, it was not considered, and the challenged decision, without any basis, merely transcribed section 876 of the Civil Code. She states that section 198 of the LGAP establishes a four-year limitations period and clearly provides that it is calculated from the event giving rise to liability. She cites a decision of the First Chamber in support of her position. She asserts that the minor [...] [Nombre 001] died on 14 de julio de 2013; that same day, the on-duty judge in Liberia ordered the removal of the body, which was placed in a plastic bag that was sealed and labeled for delivery to the pathology department of Hospital de Liberia, where the cause of death would be established through an autopsy. She explains that at that time, 14 de julio de 2013, the cause of the minor’s death was unknown and, therefore, there was no certainty as to administrative liability (responsabilidad administrativa).
She continues that, on 21 de setiembre de 2013, in summary proceeding (sumaria) 13-001317-0060-PE, the Organismo de Investigación Judicial (hereinafter OIJ), Delegación Regional de Liberia, Guanacaste, Oficialía de Guardia, Inspecciones Oculares y Recolección de Indicios, issued Police Report RSI-2544-1 3-DRG, which established the cause of death as “Asphyxiation by submersion.” In other words, the minor died not from any illness, but because he received no assistance while drowning. In her view, it is only upon learning and becoming certain of the cause of his death that the State’s liability could be discerned, and the limitations period began to run from that time; that is, as provided in section 198 of the LGAP, it must be calculated from 21 de setiembre de 2013 (indeed, it runs from the time the party acquires knowledge, but we shall set the report’s date of issuance as the starting point for the calculation), and not from 14 de julio de 2013, as erroneously stated in the judgment being challenged, because as of that date the cause of death—and therefore administrative liability—could not yet be established.
Thus, it is clear that when the State was served with the proceeding on 4 de agosto de 2017, four years had not yet elapsed, because certainty regarding the event that caused the injury arose when the cause of death was determined, something only the OIJ pathology department could establish; this occurred on 21 de setiembre de 2013, and that is therefore the date from which the limitations period began to run.
III.The Court stated that the plaintiff seeks to hold the State and Municipalidad de Bagaces jointly and severally liable (responsabilidad solidaria), together with Balneario River Side, S.A. It noted that the plaintiff considers that those public entities failed to exercise adequate oversight over the operation of the Balneario. It continued that, in this regard, the plaintiff states that on 14 de julio del 2013, the minor lost his life because there were no lifeguards to come to his rescue and no first aid was provided. It added that, for that reason, she requests a declaration that each of the defendants bears joint and several noncontractual administrative liability (responsabilidad administrativa extracontractual) for that occurrence. It stated that the State raised the preliminary statute-of-limitations defense (defensa previa de prescripción), arguing that more than four years elapsed between the harmful event (14 de julio del 2013) and service of the complaint upon the State, pursuant to section 198 of the LGAP; therefore, by the time the complaint was served on 4 de agosto de 2017, the specified limitations period had already expired.
The Court found that the plaintiff seeks to hold the three defendant entities jointly and severally liable in noncontractual civil liability (responsabilidad civil extracontractual) arising from the death of her son on 14 de julio de 2013, as a result of the events that occurred at the premises of Balneario River Side S.A. It observed that, from the time of that harmful event, the plaintiff was objectively in a position to seek whatever relief she considered appropriate and had a four-year limitations period in which to do so, as established by section 198 of the LGAP, which provides: “The right to claim compensation from the Administration shall be barred after four years, calculated from the event giving rise to liability. (...)” It thus explained that, although she filed the complaint before this Court on 10 de noviembre del 2016, it was not until 4 de agosto del 2017 that notice thereof was served upon the State.
In this regard, it explained that section 876 of the Civil Code provides: “Every limitations period shall be interrupted under civil law: 1º.- By the tacit or express acknowledgment made by the possessor or debtor in favor of the owner or creditor of the property or right sought to be acquired by prescription; and 2º.- By judicial summons, attachment, or sequestration served upon the possessor or debtor.” It therefore found that, by the time notice of the complaint was served upon the State, the four-year limitations period established in section 198 of the LGAP had already elapsed. Consequently, it stated that the substantive right (derecho de fondo) asserted by the plaintiff had become time-barred, rendering claims 1, 2, 3 and 4 of the complaint inadmissible.
IV.This Chamber observes that the appellant bases her grievance (agravio) on the contention that the evidence was not properly assessed for the purpose of calculating the limitations period correctly under the provision applicable to this specific case, namely section 198 of the LGAP, which sets that period at four years. In this regard, it is undeniable—as established by the parties and the Court itself—that the minor [Nombre 001] died on 14 de julio de 2013. Subsequently, through Police Report RSI 2544-13-DRG, issued on 21 de setiembre de 2013 by the Oficialía de Guardia, Inspecciones Oculares y Recolección de Indicios del OIJ, Delegación Regional de Liberia, the cause of death was conclusively determined to be “asphyxiation by submersion.” In view of the foregoing, although this Chamber has repeatedly held that limitations periods must be calculated from the time the facts become known (First Chamber, no. 8-2013 de las 9 horas 30 minutos del 17 de enero de 2013, no. 279-2014 de las 8 horas 55 minutos del 26 de febrero de 2014 y no. 300-2018, de las 13 horas 30 minutos del 5 de abril de 2018), in this case the period should have been calculated from the time the party learned of the minor’s death, since the referenced expert report (dictamen) merely confirmed that the death was caused by asphyxiation by immersion.
Accordingly, in this specific case, the limitations period must be deemed to have begun on 14 de julio de 2013, the date of the minor’s death. Clearly, without this entailing any analysis of the merits of the claim beyond determining the extinguishing period (plazo extintivo), that report confirmed that the minor’s death was due to asphyxiation by immersion, ruling out any other cause that, by its nature, might have affected the decision whether to file the complaint, as well as the identity of the potential defendants (sujetos pasivos). Hypothetically, these could include causes related to the minor’s health conditions or illnesses, or some other circumstance unrelated to immersion in the pool that might have triggered his death. Accordingly, it is beyond dispute that between 14 de julio de 2013—the date of the minor’s death—and 4 de agosto de 2017—the date on which the complaint was served upon the State—the four-year extinguishing period established in section 198 of the LGAP for bringing a claim for compensation (reclamo indemnizatorio) against the Public Administration had more than elapsed; consequently, this ground must be rejected.
X.In view of the foregoing, the appeal shall be denied. Pursuant to Article 150.3 of the CPCA, costs shall be borne by the appellant. Because it is unnecessary, no ruling is made on the remaining objections raised.

The appeal is denied. Interviene como apoderado especial de la actora, el Licenciado William Sequeira Solís, en representación del Estado, en su carácter de Procurador, el licenciado Ricardo Jiménez Badilla, como apoderado especial judicial de la Municipalidad de Bagaces, el licenciado Rodrigo Flores González, y en representación de Balneario River Side S.A. y la señora Quirós Ortíz, los licenciados Maylin Chinchilla Vargas y Juan Francisco Loría González.

CONSIDERANDO
I.Leana Escoto García demandó a Balneario River Side S.A., a la Municipalidad de Bagaces, al Estado y a la señora Marta Lorena Quirós Ortíz. Dijo, el 14 de julio del 2013, su hijo [Nombre 001] , de 14 años, se encontraba de paseo con familiares en el centro turístico BALNEARIO RIVER SIDE, ubicado en Bagaces, Guanacaste. Manifestó, la dueña del Centro Turístico en cuestión, donde se ubica el balneario es la sociedad BALNEARIO RIVER SIDE S.A. Adicionó, el citado centro recreativo se encuentra en operación desde el 26 de mayo de 2006, con permisos y patentes otorgados por el Ministerio de Salud, Rectoría de Bagaces y de la Municipalidad de Bagaces. Argumentó, el 14 de julio de 2013, su hijo estaba haciendo uso de las instalaciones del centro turístico, específicamente la piscina, cuando empezó a batallar por su vida. Reveló, al no estar presente un salvavidas capacitado en rescate y primeros auxilios, no hubo quien auxiliara al pequeño y le brindará apoyo en esos momentos dramáticos.
Relató, su hijo fue sacado de la piscina por otros visitantes, quienes trataron de brindarle auxilio, sin embargo, el lugar no contaba con un área señalada y adecuada para brindar atención médica o el equipo necesario de emergencia, sino que se tuvo que llamar a una ambulancia y esperar hasta que esta llegara. Aseguró, según consta en su certificado de defunción y la certificación del Registro Civil, falleció a las 14:06 horas del 14 de julio de 2013. Afirmó, su muerte ocurrió en la ambulancia, en el trayecto hacia la clínica a la que se dirigían, sin recibir atención médica adecuada. Aseveró, la causa de su muerte según la autopsia A2013-01519, fue: Asfixia por sumersión. Detalló, el Balneario no contaba con una sala de primeros auxilios de conformidad con lo que establece el Reglamento sobre el manejo de Piscinas Públicas Decreto No. 35309-S, del 30 de marzo de 2009 publicado en La Gaceta N°127 del 2 de julio de 2009, a lo cual estaba obligado al operar conforme al régimen de piscina de uso público restringido.
Transcribe el numeral 27 del citado Reglamento. Estipuló, la piscina en cuestión tiene una profundidad, en su parte más honda, mayor a 1.70 metros, lamentablemente, ese día el Balneario no contaba con el personal que se exige para la segura explotación de un centro de piscinas abiertas al público, de conformidad con lo exigido en el citado Reglamento. Valoró, a pesar de que la normativa que rige el manejo de piscinas públicas los obliga a contar con unos guardavidas, el Balneario únicamente se encontraba rotulado con indicaciones en el sentido de que, el público hace uso de las instalaciones bajo su propio riesgo y responsabilidad. Con ello, advirtió, se obviaba lo señalado en el decreto no. 353098S, al no contar para la fecha del suceso con los guardavidas requeridos. Esbozó, el Balneario contaba para la fecha del suceso con los respectivos permisos de funcionamiento otorgados por la Municipalidad de Bagaces y el Ministerio de Salud.
Apuntó, mediante oficio MB-AT-042-2014 del 19 de marzo de 2014, la Municipalidad de Bagaces les informó: "(...) Las patentes del Balneario River Side y Restaurante (Centro Turístico – venta de licores y comidas servidas) funcionan desde el 26 de mayo de 2006, fecha en que el Ministerio de Salud y esta municipalidad giraron los permisos respectivos, cumpliendo esta sociedad con la renovación que corresponde de los permisos de funcionamiento de salud la próxima actualización está para el 16 de mayo de 2014 actualmente esas patentes están al día en su cancelación (...)". Indicó, de igual manera les comunicó que la patentes estaban a nombre de doña Lorena Arrieta Murillo. Acusó, mediante documento del 17 de marzo de 2014, se le solicitó al Ministerio de Salud, Área Rectora de Bagaces, emitir constancia en la que se indicara a nombre de quien, y desde cuando se otorgaron los permisos sanitarios de funcionamiento, ante lo cual, mediante oficio CH-ARS-B-171-2014 del 24 de marzo de 2014, se indicó, que antes de emitir dicha información debían explicar el interés legítimo que tenían, y los fines para los cuales ello se requería.
Esgrimió, en el momento en que su hijo se estaba ahogando, no contó con un guardavidas que fuera en su ayuda, tampoco con la atención inmediata, en una sala de primeros auxilios. Subrayó, a la data del deceso su hijo se encontraba cursando segundo año de secundaria. Solicita en sentencia se declare: Con lugar la demanda, condenando solidariamente a los codemandados, en el caso de la Municipalidad de Bagaces y el Estado, por responsabilidad civil objetiva en virtud de su "culpa in vigilando", por faltar al deber de llevar los adecuados controles y supervisión de cumplimiento del Reglamento 35309-S, a pagar los siguientes rubros: 1. Daño objetivo por gastos fúnebres; 2. Daño objetivo por la expectativa de vida del menor [Nombre 001]; 3. Daño Moral; 4. Intereses sobre las sumas concedidas a partir de la firmeza de la sentencia y hasta su efectivo pago; 5. Se ordene al Balneario River Side ajustar su infraestructura y contratar al personal necesario con la capacitación exigida por el decreto 35309-S, para el resguardo de sus usuarios; 6.
Son las costas a cargo de los accionados. Los codemandados contestaron en forma negativa. El Estado formuló entre otras la excepción de prescripción. El Tribunal la acogió. Declaró la inadmisibilidad de las pretensiones 1,2,3,4, ordenando en lo demás continuar el proceso. Inconforme la actora acude a casación.
II.Aunque la recurrente formula dos cargos de naturaleza sustantiva, los cuales posteriormente amplía. Por la forma en que se resuelve, solo se entrará al análisis del primero . Alega, aplicación e indebida interpretación del mandato 198 de la Ley General de la Administración Pública (en adelante LGAP), así como falta de valoración de la prueba. Acusa, el Tribunal acoge la defensa de prescripción, por ende, declara inadmisibles las pretensiones 1, 2, 3 y 4 de la demanda, las cuales son una parte sustancial del presente proceso y sobre las que se estaría produciendo cosa juzgada material. Expresa, de manera errónea, el Tribunal resuelve la excepción de prescripción apegándose a la literalidad del canon 876 del Código Civil, sin tomar en cuenta la jurisprudencia que resuelve en materia de responsabilidad administrativa (indemnizatoria) del Estado, sobre la forma de contabilizar el plazo de prescripción.
Esgrime, así lo hizo ver en su oposición a dicha defensa, sin embargo, ello no se tomó en cuenta, sino que, sin fundamento alguno, la resolución recurrida, se limita a trascribir el precepto 876 del Código Civil. Expresa, el numeral 198 de la LGAP, establece un plazo de prescripción de cuatro años, y claramente señala que el cómputo se realiza a partir del hecho que motiva la responsabilidad. Cita fallo de la Sala Primera en apoyo de su tesis. Considera, el menor [...] [Nombre 001] falleció el 14 de julio de 2013, ese mismo día el Juez de Turno de Liberia, ordenó el levantamiento del cuerpo, lo colocaron en una bolsa plástica la cual se cerró y se rotuló para ser remitido a Patología del Hospital de Liberia, donde se establecerían las causas de muerte mediante autopsia. Explica, a ese momento, 14 de julio de 2013, no se sabía la causa de la muerte del menor y por tanto no existía certeza de la responsabilidad administrativa.
Continúa, el 21 de setiembre de 2013, en la sumaria 13-001317-0060-PE, el Organismo de Investigación Judicial (en lo sucesivo OIJ), Delegación Regional de Liberia, Guanacaste, Oficialía de Guardia, Inspecciones Oculares y Recolección de Indicios, emitió el Informe Policial RSI-2544-1 3-DRG, en el cual se estableció como causa de muerte "Asfixia por sumersión". Es decir, que el menor falleció no por una alguna enfermedad, sino por no recibir auxilio cuando se estaba ahogando. Valora, es a partir del conocimiento y certeza de la causa de su fallecimiento que se puede vislumbrar la responsabilidad del Estado, y es a partir de ese momento que da inicio el cómputo del plazo de prescripción, es decir, que según lo establece el numeral 198 de la LGAP, debe contabilizarse a partir del 21 de setiembre de 2013 (incluso corre a partir del conocimiento de la parte, pero fijaremos para el inicio del cómputo la fecha de emisión del informe) y no del 14 de julio de 2013, como erróneamente se señala en la sentencia que se impugna, pues a esa data no se podía establecer aún la causa de muerte y por ende la responsabilidad administrativa.
De esa forma es claro, al notificarse al Estado el proceso el 4 de agosto de 2017, aún no habían transcurrido cuatro años, pues la certeza del hecho que ocasionó la lesión nace con la determinación de la causa de muerte que únicamente la podía establecer el departamento de patología del OIJ, lo cual acaeció el 21 de setiembre de 2013, y, por ende, es ese el momento a partir del cual inicia el cómputo del plazo de prescripción. III.- El Tribunal indicó, la actora reclama la responsabilidad solidaria del Estado y de la Municipalidad de Bagaces, en conjunto con Balneario River Side, S.A. Refirió, la demandante estima que aquellas entidades públicas, no efectuaron una adecuada fiscalización sobre la operación del Balneario. Continuó, en tal sentido, la actora manifiesta que el 14 de julio del 2013, el menor perdió la vida al no haber salvavidas que acudiera en rescate, ni primeros auxilios. Prosiguió, por esa razón solicita declarar la responsabilidad administrativa extracontractual, en forma solidaria, de cada una de las demandadas por ese hecho ocurrido.
Manifestó, sobre el particular, el Estado opuso la defensa previa de prescripción y alegó, que desde el hecho dañoso (14 de julio del 2013), hasta la notificación de la demanda al Estado, transcurrieron más de cuatro años, según el ordinal 198 de la LGAP, de modo que, para el momento en que se notifica la demanda, el 4 de agosto de 2017, ya había transcurrido el plazo indicado de prescripción. Para el Tribunal, se constató que la actora reclama la responsabilidad civil extracontractual solidaria, de las tres entidades demandadas, a partir de la muerte de su hijo, producida el 14 de julio de 2013, producto de los hechos acaecidos en las instalaciones del Balneario River Side S.A. Comentó, es a partir de ese hecho dañoso, que la actora se encontraba en posibilidad objetiva de reclamar la reparación que estimara pertinente y, para ello, contaba con un plazo cuatrienal de prescripción, establecido en el numeral 198 de la LGAP, cuando señala: " El derecho de reclamar la indemnización a la Administración prescribirá en cuatro años, contados a partir del hecho que motiva la responsabilidad.
(...) ". De esa manera, esbozó, a pesar de que interpone la demanda ante este Tribunal el 10 de noviembre del 2016, no es sino hasta el 4 de agosto del 2017, que se notificó su traslado al Estado. Sobre el particular, explicó el ordinal 876 del Código Civil, establece: " Toda prescripción se interrumpe civilmente: 1º.- Por el reconocimiento tácito o expreso que el poseedor o deudor haga a favor del dueño o acreedor de la propiedad o derecho que trata de prescribirse; y 2º.- Por el emplazamiento judicial, embargo o secuestro notificado al poseedor o deudor." De esa forma, consideró, para el momento en que se notifica el traslado de la demanda al Estado, había ya transcurrido el plazo cuatrienal de prescripción, establecido en el numeral 198 de la LGAP. De consiguiente, expone, había acaecido la prescripción del derecho de fondo reclamado por la actora, lo cual provoca la inadmisibilidad de las pretensiones 1, 2, 3 y 4 de la demanda.
IV.Observa esta Cámara, la recurrente enfoca su agravio en el alegato de no haberse valorado correctamente la prueba, a fin de establecer el adecuado cómputo de la prescripción, conforme al mandato aplicable al caso concreto, a saber, el precepto 198 de la LGAP, que fija dicho plazo en cuatro años. Sobre el particular, resulta innegable, según lo establecen las partes y el propio Tribunal, el fallecimiento del menor [Nombre 001], tuvo lugar el 14 de julio de 2013. Posteriormente, mediante la emisión del Informe Policial RSI 2544-13-DRG, emitido el 21 de setiembre de 2013 por la Oficialía de Guardia, Inspecciones Oculares y Recolección de Indicios del OIJ, Delegación Regional de Liberia, se logró determinar con certeza, la causa de muerte como “asfixia por sumersión”. Visto lo anterior, aunque esta Cámara ha reiterado que los plazos de prescripción deben computarse desde el momento del conocimiento de los hechos (Sala Primera, no. 8-2013 de las 9 horas 30 minutos del 17 de enero de 2013, no. 279-2014 de las 8 horas 55 minutos del 26 de febrero de 2014 y no. 300-2018, de las 13 horas 30 minutos del 5 de abril de 2018); en la especie, el plazo en cuestión debió computarse, desde el momento en que la parte tuvo conocimiento del fallecimiento del menor, puesto que el dictamen de referencia solo vino a ratificar que se trataba de una muerte causada por asfixia por inmersión.
De esa manera, en el caso concreto, el inicio del plazo de cómputo de la prescripción debe datarse el 14 de julio de 2013, fecha de del fallecimiento del menor. Evidentemente, (sin que eso implique análisis del fondo de lo reclamado más allá de la determinación del plazo extintivo), dicho dictamen vino a ratificar que la muerte del menor se debió a asfixia por inmersión, descartando cualquier otra causa, que por su naturaleza pudiera haber afectado la decisión de presentar o no la demanda, así como los eventuales sujetos pasivos. Cítese entre ellas, -en grado de hipótesis-, aquellas que pudieran estar relacionadas con situaciones de salud o padecimientos del menor, u otra situación ajena a la inmersión en la piscina, que pudiera haber desencadenado el fallecimiento. Así las cosas, es incuestionable, entre el 14 de julio de 2013, -data de fallecimiento del menor-, y el 4 de agosto de 2017, -fecha de notificación de la demanda al Estado-, transcurrió de sobra el plazo extintivo de cuatro años que establece el numeral 198 de la LGAP, para formular el reclamo indemnizatorio contra la Administración Pública, de donde el cargo deberá rechazarse.
X.En mérito de lo expuesto, se rechazará el recurso. De conformidad con el artículo 150.3 del CPCA, son las costas a cargo de la recurrente. Por innecesario, se omite pronunciamiento sobre los restantes reproches formulados.
