SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At six twenty on the twenty-fifth of September, two thousand twenty.- POSSESSORY TITLE PROCEEDING brought by COMERCIAL SÚPER UNIÓN SOCIEDAD RESPONSABILIDAD LIMITADA, legal entity identification number three - one hundred two - zero fifty-five thousand four hundred forty, represented by its general attorney-in-fact with unlimited authority, Alicia María Rodríguez Rodríguez, of legal age, married once, agricultural entrepreneur, resident of San Carlos, identity card number two - three hundred five - nine hundred seventy-nine. Attorney Ronald Córdoba Artavia, identity card number two - three hundred thirty-nine - one hundred thirty-three, bar membership number four thousand one hundred thirty-nine, acts as special judicial attorney-in-fact for the petitioner. The proceeding was heard before the Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, Guápiles. This Tribunal hears the appeal filed against the judgment issued at sixteen hours and four minutes on the twenty-second of May, two thousand twenty.

Judge Sánchez Blanco drafts the decision; and,

CONSIDERING:

I.The petitioner appeals Resolution N.2020-000176, issued at sixteen hours and forty minutes on the twenty-second of May, two thousand twenty, which ordered the final closure of this possessory title proceeding following the objection filed by the Procuraduría General de la República on 12 de mayo del 2020, pursuant to Articles 5 and 8 of the Ley de Informaciones Posesorias, upon the initial service of process.- In its grounds for appeal, the appellant maintains that the State’s representative objects to these proceedings on the theory that, through proceedings conducted before the same court under judicial case file number 11-000160-507-AG, the appellant sought to obtain title to the same property at issue here, which was described at that time by cadastral plan H-1651117- 2013 (initially described by cadastral plan H-1447986-2010, which overlapped with registered property and was therefore replaced in 2013), thereby suggesting that res judicata (cosa juzgada) applies.

It adds that this ground for objection asserted by the Procuraduría General de la República is unfounded because, it contends, formal res judicata (cosa juzgada formal) cannot apply in the absence of the elements necessary for it to arise, particularly with respect to the subject matter. In this regard, it seeks to demonstrate through the report issued by the Catastro Nacional that plan H-1651117-2013 is currently canceled and, it argues, therefore no longer has legal existence; furthermore, the area described by plan H-1651117-2013 is six hundred eighty-four thousand four hundred sixty-one square meters, whereas the area indicated in plan No. H-2089556-2018, which is the subject of this matter, measures only one hundred seventy-two thousand nine hundred fifty-three square meters. It therefore believes that this new proceeding may be brought.- It offers as evidence to assist the court in reaching its decision (prueba para mejor resolver) the registry reports from the Catastro Nacional indicating that cadastral plan H-456840-1997, formerly registered in the name of Ulpiano Vargas Herrera, has been canceled; likewise, a certificate from that Office indicating that cadastral plan H-1651117-2013 has also been canceled, and a certified copy of judicial case file 11-000160-507-AG.-

II.Evidence on appeal (prueba en segunda instancia): At this stage, the appellant offers documentary evidence consisting of the Catastro Nacional registry reports concerning the cancellation of the plan, a certificate from that Office indicating that cadastral plan H-1651117-2013 has been canceled, and a certified copy of judicial case file 11-000160-507-AG.- In this regard, pursuant to Article 590 of the Código de Trabajo and Article 67.2 of the Código Procesal Civil, as incorporated by reference and applied supplementally under Article 60 of the Ley de Jurisdicción Agraria, the admission of evidence on appeal is restrictive and exceptional; only evidence strictly necessary to decide the issues under appeal may be admitted when, for reasons beyond the party’s control, it could not have been offered or presented at first instance. Thus, the possibility of offering evidence on appeal is limited and exceptional and cannot be construed as freely granting an appellant the right to offer any type of evidence unrelated to the subject matter of the appeal.

In this regard, although judicial case file 11-000160-507-AG must indeed be reviewed ad effectum videndi, this Tribunal considers that, in this particular case, the offered evidence does not meet the required exceptional standard, because whether or not the referenced plans have been canceled does not alter the decision, as explained below.-

III.The possessory title proceeding is a non-contentious jurisdiction proceeding (proceso de jurisdicción no contenciosa) through which a registrable instrument establishing a property right is formalized, provided that the applicable legal requirements are satisfied.- The Ley de Informaciones Posesorias directs the judge to recognize, among others, the State’s representative—the Procuraduría General de la República—and the Instituto de Desarrollo Agrario as parties to the proceeding, in order to safeguard property within the public domain and State-owned agricultural property (Propiedad Agraria estatal). Accordingly, Articles 5 and 8 of the Ley de Informaciones Posesorias provide that, if the objecting party is the State or one of its institutions, the court must determine whether the objection is reasoned; if it is, the immediate closure of the case file is mandatory, and the administrative remedies shall be deemed exhausted so that the person seeking title may bring an action against the objecting entity to adjudicate that person’s right to avail itself of the provisions of the Ley de Informaciones Posesorias.- In this regard, the objection must be substantiated or justified, meaning that it must state the reasons supporting the objection and, when deemed appropriate, provide any documents considered useful for that purpose (see decisions 303 of 19 de abril del 2007, 207 of 7 de abril del 2005, and 694 of 4 de julio del 2011 of the Tribunal Agrario).

In this regard, it has been stated that: “…it is required to ‘conclusively demonstrate’ that its objection is valid and legitimate; if the petitioner disagrees with the reasons given for the objection, those issues must be debated and resolved in contentious proceedings before the court having jurisdiction, whether agricultural, civil, criminal, or administrative-litigation jurisdiction, depending on the relief sought. Therefore, once a timely, substantiated, and reasonable objection has been filed, in light of the allegations and the applicable legal system, the judge must assess the reasonableness and legality of the stated grounds, together with any supporting law or facts submitted, and, if they are pertinent, apply the provisions of the cited Article 8. The judge may not ‘open a debate’ concerning the relevance and proof of the grounds asserted by either the petitioner or the objecting party, because doing so would distort the non-contentious nature of the possessory title proceeding.

It should further be noted that the solution provided in the second paragraph of Article 8, concerning objections by the State or its entities, differs from that in the first paragraph, concerning objections by private persons. This is because, when a public entity files a timely objection, the legislature directly requires termination of the non-contentious proceeding and closure of the case file; when a private person objects, however, it first provides that the proceedings be stayed and grants a period within which to demonstrate that the corresponding proceeding has been filed, in which the parties—the petitioner and the objecting party—will litigate their differences. In the case of objections by public entities, however, the private person bears the burden of determining whether to bring an action in the appropriate forum to rebut the substantiated grounds given by any such entity in requesting that the proceeding be deemed concluded.

A different solution applies when the objection is filed after the statutory deadline, because the cited Article 8 does not apply; this does not mean, however, that the arguments untimely asserted by the objecting party cannot be considered. On the contrary, they must be addressed in the decision on the merits concluding the proceeding—the judgment—but the solution provided by Article 8 may not be applied, since that provision permits the proceeding to be terminated by an interlocutory ruling and the administrative remedies to be deemed exhausted without requiring the judge to rule on the merits. In exceptional and duly substantiated circumstances, for reasons of procedural economy, an untimely objection based on sufficiently established grounds may result in an early order and judgment denying the proceeding.” (See, among others, decision 1105-F-13 issued at nine hours and forty-seven minutes on the twenty-eighth of November, two thousand thirteen; Decision No. 581 of 17 de agosto de 1995; and Resolution No. 577 issued at 15 hours 30 minutes on 11 de agosto de 1995, all from this Tribunal.)

III.In this case, it is observed that the parties to the proceeding included both the Instituto de Desarrollo Rural and the Representative of the State, who filed an objection pursuant to Articles 5 and 8 of the Ley de Informaciones Posesorias, on the grounds that the applicant company had already sought title to the land at issue herein through another possessory title proceeding (información posesoria), processed under expediente número 11-000160-0507-AG, which was denied. In this regard, having reviewed the case file for purposes of examination (efectos videndi), this Chamber, through judgment number 976-F-16 of nine hours and fifty-seven minutes on the twenty-first of October, two thousand sixteen, denied those proceedings, which concerned precisely the land described in survey plan H-1651117-2013, because the applicant failed to establish the chain of possession (cadena posesoria) or ten-year possession (posesión decenal) predating the creation of the Refugio Nacional de Vida Silvestre Barra del Colorado, created by Decreto No. 16358-MAG del 4 de junio de 1985, a matter also noted in the pleadings entered on 12/05/2019 14:35:56 and 15/05/2020 21:11:47.- Indeed, as may be inferred, the objection is sufficient to establish the reasons why the State considers that its interests may be affected, since a new title proceeding is being heard even though the most important fact was already found not to have been established in that prior proceeding, particularly given that the property is located within a protected wilderness area (área silvestre protegida).

Accordingly, the appellant’s arguments that a new possessory title proceeding may be instituted and that the essential elements for a finding of res judicata (cosa juzgada) have not been met are without merit because, on the one hand, when a possessory title proceeding is decided on the merits—that is, based on whether ten-year possession and the other requirements of possession necessary to obtain title to the property have been established—the decision does carry the effect of formal res judicata (cosa juzgada formal). In other words, its disposition entails, where it is denied on substantive grounds relating to possession, the legal impossibility of instituting another possessory title proceeding for the same purpose. This is not the case when the proceeding is denied due to failure to submit a document or satisfy a procedural requirement that results in the matter being closed, in which case it may be instituted again.

In this connection, it is appropriate to note the distinction between formal res judicata and substantive res judicata (cosa juzgada material), the latter of which precludes renewed litigation of a legal issue already decided by a Court, unlike the effect produced by formal res judicata, under which the matter decided may be litigated again, including in ordinary proceedings. Thus, if a possessory title proceeding is denied on substantive grounds, the respective ordinary actions must be filed in defense of the rights of the applicant.- On the other hand, this Court finds that all the elements required for application of the doctrine of formal res judicata are present, since there is identity not only of the parties and the cause, but also of the subject matter, because, contrary to the position advanced by the appellant, it is clear that the land constitutes part of the same property. This Court observes from the plans submitted and from the objection filed by the Procuraduría that the land for which title is sought herein—described as land used entirely for pasture; located in La Aldea de Las Llanuras del Gaspar, fourth district of Sarapiquí, tenth canton of the province of Heredia; bounded to the North by Ramona Rivera Araya and, in part, by quebrada La Venada; to the South by property belonging to the same applicant, Comercial Super Union Ltda.; to the East by a public road or national route 507, with 102.35 linear meters of frontage thereon; and to the West, in part, by quebrada La Venada and Comercial Super Union Ltda.; having an area of one hundred seventy-two thousand nine hundred fifty-three square meters and depicted in registered survey plan H-2089556-2018—constitutes part of the same property for which title was sought in the referenced court case, as described in registered survey plan H-1651117-2013.- In this regard, it should be noted that, on the one hand, the grid references of both plans, the canceled plan and the new plan, correspond to the same location and that, even though the former is identified as a canceled plan, it was in fact used for the 2011 proceeding.

Accordingly, although the plan has no legal effect because it was canceled, the fact remains that title to what is now the subject matter of this proceeding had already been sought through that avenue and had previously been denied. This is also apparent from the transfer document submitted in the record, which is intended to establish that the land at issue in these proceedings was acquired by the applicant in 2003; that same document was also used as the basis for the prior proceeding, as may be seen from the initial filing in that proceeding. Additionally, the certifications issued by the Sistema Nacional de Áreas de Conservación show that, although the land now has a smaller area, it nevertheless lies entirely within the Refugio de Vida Silvestre Barra del Colorado, a circumstance also reflected in the plan under which title is sought.- Accordingly, this Court deems it appropriate to state that reliable proof of possession and its chain of transfer (cadena de transmisión) is, as a substantive matter, one of the most significant aspects of a possessory title proceeding; therefore, because the claim was denied in a prior proceeding, recourse must be had to ordinary proceedings.

V. In accordance with the foregoing, as to the matters appealed, the decision under appeal must be affirmed. -

VI- DISSENTING OPINION (VOTO SALVADO) OF JUDGE FISHER GONZÁLEZ: The undersigned respects but does not agree with the majority opinion. As an initial matter, it should be stated that Article 8 of the Ley de Informaciones Posesorias authorizes the Procuraduría General de la República, as representative of the State, to object to a proceeding of this nature. However, longstanding case law of this Court has held that the objection must be substantiated. A similar provision appears in Article 7 of the Ley de Localización de Derechos, which states that any objection must be substantiated and evaluated by the adjudicating judge. Moreover, the Nuevo Código Procesal Civil, as part of the general principles governing non-contentious proceedings (procesos no contenciosos), imposes the same requirement under Article 178.2, such that the evolution of procedural law has been directed toward evaluating the grounds for an objection.

In this case, the State’s representative bases the objection on the existence of formal res judicata. The representative explains that a judgment denying the application had already been issued in expediente 11-000160-507-AG, processed before the same court on the basis of registered survey plan H-1651117- 2013, which included part of the land for which title is sought here. The area described in that plan was much larger: six hundred eighty-four thousand four hundred sixty-one square meters. The land sought to be registered through the present possessory title proceeding, according to plan H-2089556-2018, has an area of one hundred seventy-two thousand nine hundred fifty-three square meters. According to that plan and the soil study submitted, it is a tract of pasture and scrubland (tacotal), located in La Aldea, Distrito Cuarto Llanuras del Gaspar del Cantón de Sarapiquí (study in image 37).

It must be clarified that the State may object when it reasonably argues that the property is in the public domain (dominio público), in which case the aforementioned Article 8 applies. The situation is different, however, when title is sought under Article 7 of the Ley de Informaciones Posesorias because, even where a Refugio de Vida Silvestre has been declared, if the law permits the possibility of obtaining title upon proof of ten-year possession before the property became subject to the public domain (demanio público), the possessory title proceeding must be processed. The provision reads as follows: “When the property to which the proceeding refers is located within a protected wilderness area, regardless of its management category, the applicant must demonstrate that it holds legal rights to ten-year possession exercised at least ten years before the effective date of the law or decree creating that protected wilderness area.” In other words, an objection at the outset of the proceeding based solely on the assertion that the real property is located within a Refugio de Vida Silvestre is not legally acceptable, because Article 8 must be interpreted in harmony with the first paragraph of Article 7.

In this connection, because this is a voluntary-jurisdiction or non-contentious proceeding (proceso de jurisdicción voluntaria o no contencioso), there is no res judicata within the meaning of the doctrine underlying Article 64 of the Nuevo Código Procesal Civil, applicable by express provision of Article 26 of the Ley de Jurisdicción Agraria. Any other conclusion would conflict with the principles of the general theory of procedure. In proceedings of this nature, there is no identity of parties understood as plaintiff and defendant, and there is no complaint containing claims and answer asserting defenses, because there is no actual dispute capable of producing a judgment of dismissal or liability. This precludes analysis of the identity of parties, subject matter, and cause within the framework of a legal-procedural relationship (relación jurídico procesal). It is clear that examination of any new possessory title proceeding that may be filed may include consideration, when evaluating the evidence, of elements admitted into evidence in the prior proceeding, in accordance with the principle of free evaluation of evidence (libre valoración) set forth in Article 54 of the Ley de Jurisdicción Agraria and the rules of psychology, logic, and experience, in order to determine whether the application should be granted or denied. For the foregoing reasons, the decision under appeal must be reversed and processing of the possessory title proceeding must continue.

POR TANTO:

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las seis horas veinte minutos del veinticinco de setiembre de dos mil veinte.- INFORMACIÓN POSESORIA promovida por COMERCIAL SÚPER UNIÓN SOCIEDAD RESPONSABILIDAD LIMITADA, cédula jurídica tres - ciento dos - cero cincuenta y cinco mil cuatrocientos cuarenta, representada por su apoderada generalísima sin limite de suma Alicia María Rodríguez Rodríguez, mayor, casada una vez, empresaria agraria, vecina de San Carlos, cédula de identidad dos - trescientos cinco - novecientos setenta y nueve. Intervienen en el proceso la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Daniela Vargas Delgado, mayor, casada una vez, abogada, vecina de Grecia de Alajuela, cédula de identidad dos - seiscientos ocho - cuatrocientos diecisiete, en su condición de procuradora adjunta; y el INSTITUTO DE DESARROLLO RURAL, cédula jurídica cuatro - cero cero cero - cero cuarenta y dos mil ciento cuarenta y tres - once, representado por su apoderada general judicial Marjorie Mayela Madrigal Muñoz, mayor, casada, abogada, vecina de San Ramón de Alajuela, cédula de identidad uno - quinientos noventa y ocho - ciento uno, carné veintiún mil trescientos cuarenta y dos.

Actúa como apoderado especial judicial de la parte promovente el licenciado Ronald Córdoba Artavia, cédula de identidad dos - trescientos treinta y nueve - ciento treinta y tres, colegiado cuatro mil ciento treinta y nueve. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, Guápiles. Conoce este Tribunal del recurso de apelación presentado contra sentencia de las dieciséis horas y cuatro minutos del veintidós de mayo de dos mil veinte.

Redacta la jueza Sánchez Blanco; y,

CONSIDERANDO:

I.Plantea la parte promovente apelación contra la resolución N.2020-000176 de las dieciséis horas y cuarenta minutos del veintidós de mayo del dos mil veinte, que ordena el archivo definitivo de la presente información posesoria, ante la oposición formulada por la Procuraduría General de la República de fecha 12 de mayo del 2020 en los términos de los artículos 5 y 8 de la Ley de Informaciones Posesorias con ocasión al traslado inicial del proceso.- Sostiene el recurrente en sus agravios, que la representación estatal se opone a estas diligencias, con la tesis de que mediante las diligencias tramitadas ante el mismo juzgado, expediente judicial número 11-000160-507-AG, su representada pretendió titular el mismo bien objeto de este asunto, describiéndolo en ese momento por el plano catastrado H-1651117- 2013 (inicialmente descrito con plano catastrado H-1447986-2010 que traslapaba con finca inscrita, por lo que luego se sustituyó en el 2013), dejando entre ver que se configura la cosa juzgada.

Agrega que dicho fundamento de oposición realizado por la Procuraduría General de la República, no es procedente, ya que según reclama no es posible que se configure la cosa juzgada formal, ante la falta de los elementos necesarios para su configuración, sea particularmente en relación al objeto. Al respecto, pretende demostrar con el informe emitido por el Catastro Nacional, que el plano H-1651117-2013 al di´a de hoy esta´ cancelado, con lo que dice no existe en la vida jurídica, además que el a´rea que describe el plano H-1651117-2013, es de seiscientos ochenta y cuatro mil cuatrocientos sesenta y un metros cuadrados, y que el área que indica el plano No. H-2089556-2018, objeto de este asunto, corresponde únicamente a una cabida de ciento setenta y dos mil novecientos cincuenta y tres metros cuadrados, por lo que a su juicio puede presentarse este nuevo proceso.- Ofrece se tenga como prueba para mejor resolver, los Informes registrales del Catastro Nacional, que indica que el plano catastrado H-456840-1997, que estuvo inscrito a nombre de Ulpiano Vargas Herrera, se encuentra cancelado. Igualmente constancia de esa Oficina que indica que el plano catastrado H-1651117-2013, también se encuentra cancelado, y certificación del expediente judicial 11-000160-507-AG.-

II.De la prueba en segunda instancia: Ofrece el recurrente, prueba documental en esta instancia referente a los Informes registrales del Catastro Nacional, de cancelación de plano, constancia de esa Oficina que indica que el plano catastrado H-1651117-2013 se encuentra cancelado, así como que se certifique el expediente judicial 11-000160-507-AG.- Al respecto, de acuerdo a lo dispuesto en el artículo 590 del Código de Trabajo y el artículo 67.2 del Código Procesal Civil, por remisión y aplicación supletoria ante lo dispuesto en el artículo 60 de la Ley de Jurisdicción Agraria, la admisión de prueba en segunda instancia tiene un carácter restrictivo y excepcional, la cual se podrá admitir únicamente aquella que sea estrictamente necesaria para resolver los puntos objeto de alzada, cuando no se haya podido ofrecer o practicar en primera instancia por causas ajenas a la parte. De esta manera, se aprecia que la posibilidad de ofrecer prueba en segunda instancia, es limitada y de carácter excepcional, sin que ello pueda atribuirse a una facultad, libremente, para que quien apele pueda ofrecer cualquier tipo de prueba, sino es por el objeto de apelación.

Al respecto, si bien es necesario tener en efecto videndi el expediente 11-000160-507-AG; considera este Tribunal que el ofrecimiento de la prueba propuesta no cumple en el caso en concreto, con esa excepcionalidad requerida, en razón de la cancelación o no de los planos referidos, no varía lo resuelto como adelante se referirá.-

III.El proceso de Información Posesoria es un proceso de jurisdicción no contenciosa, mediante el cual, se tramita la formalización de un título registrable de un derecho de propiedad, si se cumple con los requisitos legales correspondientes.- La Ley de Informaciones Posesorias ordena a la persona juzgadora, tener como partes del proceso, entre otros, al representante del Estado: Procuraduría General de la República y al Instituto de Desarrollo Agrario, a efectos de garantizar el resguardo de la propiedad sujeta al dominio público, y de la Propiedad Agraria estatal. De esta forma, los artículos 5 y 8 de la Ley de Informaciones Posesorias, disponen que si el oponente es el Estado o alguna de sus Instituciones, se analizará si la oposición es razonada; resultando imperativo ordenar en forma inmediata el archivo del expediente, ante lo que tendrá por agotada la vía administrativa con el fin de que el titulante deduzca demanda contra el ente opositor, en discusión de su derecho a acogerse a las disposiciones de la Ley de Informaciones Posesorias.- En este sentido, se ha exigido que la oposición sea fundada o justificada, en el sentido de expresar las razones que justifican el por qué se opone, y cuando lo considere pertinente, aportar los documentos que considere útiles para ello (ver votos 303 del 19 de abril del 2007, 207 del 7 de abril del 2005 y 694 del 4 de julio del 2011 del Tribunal Agrario).

Al respecto, se ha referido que: “…se le exige "demostrar fehacientemente" que su oposición es válida y legítima, aspecto que, de existir divergencia por la parte promovente respecto de las razones dadas para la oposición, deberán ser debatidas y resueltas en un proceso contencioso, en la sede que corresponda, ya sea agraria, civil, penal o contencioso-administrativa, según lo que se pretenda. Por ello, es que luego de una oposición interpuesta en tiempo, fundada y razonable, en función de lo alegado y lo dispuesto en el ordenamiento jurídico, lo que corresponde a la persona juzgadora es ponderar la razonabilidad y legalidad de las razones expresadas (y el apoyo legal o fáctico que se presente), y de ser pertinentes, procede aplicar lo que dispone el numeral 8 citado, sin que sea posible "abrir un debate", sobre la pertenencia y demostración de las razones de quien promueve o de quien se opone, pues ello desnaturalizaría el proceso no contencioso de información posesoria.

Nótese incluso que la solución del párrafo segundo del artículo 8 (oposición del Estado o sus entes) es diferente a la del párrafo primero (oposición de persona privada). Ello por cuanto, de existir oposición en tiempo de un ente público, el legislador de una vez ordena terminar el proceso no contencioso y archivar el expediente, mientras que cuando es una persona particular la que se opone, primero dispone que se suspenda el trámite y da un plazo para que se compruebe que se planteó el proceso respectivo en el cual las partes (promovente y opositora), discutirán sus diferencias. Pero en el caso de la oposición de entes públicos, es la persona particular la obligada a sopesar si demanda o no, en la vía pertinente, para desvirtuar las razones fundadas que haya dado alguno de ellos para solicitar que el trámite se tenga por concluido. Diferente solución se debe aplicar cuando la oposición se presenta fuera del plazo legal (pues no se aplica lo dispuesto en el numeral 8 citado), sin que ello no signifique que lo argumentado por la persona oponente, extemporáneamente, no sea analizable.

Por el contrario, deberá existir pronunciamiento al respecto, pero en la resolución de fondo que ponga fin al proceso (sentencia), sin que dable sea posible aplicar la solución del artículo 8, que permite terminar interlocutoriamente el proceso y tener por agotada la vía administrativa sin que la persona juzgadora tenga que hacer pronunciamiento de fondo. En situaciones excepcionales y debidamente fundamentadas, por economía procesal, ante una oposición extemporánea fundada en motivos comprobados suficientemente, puede darse un auto-sentencia anticipado que resuelva la denegatoria del proceso.” (ver entre otros, voto 1105-F-13 de las nueve horas y cuarenta y siete minutos del veintiocho de noviembre de dos mil trece. Voto No. 581 del 17 de agosto de 1995 y resolución No. 577 de las 15 horas 30 minutos del 11 de agosto de 1995, todas de este Tribunal.)

III.En este caso, se observa en el proceso se tuvo como partes tanto al Instituto de Desarrollo Rural, como al Representante del Estado, quien en su caso, planteó la oposición de acuerdo a lo preceptuado en los artículos 5 y 8 de la Ley de Informaciones Posesorias, al considerar que la sociedad aquí titulante ya había solicitado la titulación del terreno objeto de este asunto, mediante otro proceso de información posesoria, tramitado en el expediente número 11-000160-0507-AG, que resultó rechazado. En este sentido, teniendo a la vista esta Cámara en efectos videndi el expediente, mediante voto número 976-F-16 de las nueve horas y cincuenta y siete minutos del veintiuno de octubre de dos mil dieciséis de este Tribunal, se rechazó aquellas diligencias tramitadas, que versaron justamente respecto al terreno descrito según plano H-1651117-2013, debido a que no logró demostrar la cadena posesoria ni la posesión decenal anterior a la fecha de creación del Refugio Nacional de Vida Silvestre Barra del Colorado, creado por Decreto No. 16358-MAG del 4 de junio de 1985, aspecto que también hace ver en los memoriales incorporados en fechas 12/05/2019 14:35:56 y 15/05/2020 21:11:47.- Ahora bien, conforme se desprende, en efecto, la oposición resulta suficiente para acreditar las razones por las cuales, considera se le pueden afectar los intereses al Estado, al estarse ventilando, un nuevo trámite de titulación, del cual ya se dispuso la no demostración del hecho más importante en ese otro proceso anterior; máxime al ubicarse el inmueble en un área silvestre protegida.

De esta manera, los argumentos sostenidos por el recurrente, referentes a que, se puede volver a plantear una nueva información posesoria y que no se cumple con los elementos esenciales para decretar la cosa juzgada, realmente no tienen cabida, debido a que por un lado, el proceso de Información Posesoria, sí conlleva, cuando se resuelve el asunto por el fondo, sea con la demostración o no de la posesión decenal y los demás requisitos de la posesión requerida para titular el inmueble, la característica de la cosa juzgada formal. Es decir, su resolución implica, (en el caso de ser rechazado por motivos de fondo en cuanto a la posesión) la imposibilidad jurídica de volver a plantear una nueva información posesoria con el mismo fin. Situación que no se da así, cuando su rechazo se da en virtud de la falta de presentación de algún documento o requisito procesal que origine al archivo del asunto, en cuyo caso podría plantearse nuevamente.

En este orden, conviene hacer notar la diferencia, entre la cosa juzgada formal y la cosa juzgada material, ésta última por la cual, no puede volverse a discutir un punto jurídico ya resuelto por un Tribunal; contrario efecto, producido por la cosa juzgada formal, con la cual, se presenta la posibilidad de discutirse lo resuelto nuevamente, incluso en procesos ordinarios. Así, debería entonces en caso de ser rechazada la información posesoria por cuestiones de orden sustantivo, procederse al planteamiento de las demandas ordinarias respectivas, en defensa de los derechos de quien promueve.- Por otro lado, encuentra este Tribunal, que se presentan todos los elementos para la configuración del instituto de cosa juzgada formal, debido a que no sólo se presentan en relación a la igualdad de partes y la causa, sino también la del objeto, toda vez que contrario a la tesis planteada por el recurrente; es notorio de que se trata de parte del mismo inmueble.

Observa este Tribunal, de los planos aportados y de la misma oposición planteada por la Procuraduría, que en efecto, el terreno que aquí se pretende titular, el cual se describe como un terreno dedicado en su totalidad a repastos; sito en La Aldea de Las Llanuras del Gaspar, distrito cuarto, de Sarapiquí, cantón décimo de la provincia de Heredia, y que linda al Norte: con Ramona Rivera Araya y en parte con quebrada La Venada, al Sur: con finca de la misma titulante Comercial Super Union Ltda. al Este: con calle publica o ruta nacional 507, con un frente a ella de 102.35 metros lineales y al Oeste: en parte con quebrada La Venada y Comercial Super Union Ltda; el cual cuenta con una medida de ciento setenta y dos mil novecientos cincuenta y tres metros cuadrados, graficado con el plano catastrado H-2089556-2018, constituye parte de mismo que se pretendió titular mediante el expediente judicial referido, al describirse con el plano catastrado H-1651117-2013.- Véase al respecto, que por un lado las cuadriculas de ambos planos (tanto el cancelado como el nuevo) corresponden a la misma ubicación, y aún pese a que se señalada como un plano cancelado, en la realidad este plano fue utilizado para aquel proceso del año 2011.

De esta manera, aunque no surta efectos en la vida jurídica por su cancelación, lo cierto del caso es que ya se intentó mediante aquella vía la titulación de lo que ahora es objeto de este proceso, y que había sido previamente rechazado. Así también, esto se nota de la documental de traspaso aportada a los autos, mediante la cual se pretende acreditar que el terreno objeto de estas diligencias fue adquirido por por la titulante desde el 2003, siendo este mismo documento utilizado también como base de aquel proceso y lo que se nota del escrito inicial de aquel proceso. Adicionalmente, se evidencia de las certificaciones del Sistema Nacional de Áreas de Conservación que pese a que se trate ahora de un terreno con menor cabida, siempre está en su totalidad dentro del área del Refugio de Vida Silvestre Barra del Colorado, aspecto que también se refleja del mismo plano a titular.- De este modo, estima este Tribunal, señalar que la demostración fiel de la posesión y su cadena de transmisión es por el fondo, uno de los aspectos de mayor injerencia para el proceso de Información Posesoria, por lo que al haber sido objeto de rechazo en un proceso anterior, corresponde acudir a la vía ordinaria.

V. De conformidad con lo expuesto, en lo apelado, procede confirmar la resolución venida en alzada. -

VI- VOTO SALVADO DE LA JUEZA FISHER GONZÁLEZ: La suscrita respeta pero no comparte el voto de mayoría. En un primer orden de consideraciones debe indicarse, que el ordinal 8 de la Ley de Informaciones Posesorias faculta a la Procuraduría General de la República, como representante del Estado, a oponerse a un proceso de esta naturaleza. Sin embargo, se ha sostenido por parte de jurisprudencia de vieja data de este Tribunal que la oposición debe de ser fundada. Una norma similar se encuentra en la Ley de Localización de Derechos, artículo 7, al referir que en caso de oposición la misma deberá de ser fundada y valorada por la persona juzgadora. A mayor abundamiento, en el Nuevo Código Procesal Civil, como parte de los principios generales de los procesos no contenciosos, se exige ese mismo requisito, según artículo 178.2, de manera que la evolución de la normativa procesal lo es en función de valorar los fundamentos de la oposición.

En la especie, la representación del Estado fundamenta su oposición, apelando a la existencia de la cosa juzgada formal. Explica que en este proceso ya se había dictado sentencia improbatoria, en expediente 11-000160-507-AG, tramitado ante el mismo juzgado, con base en el plano catastrado H-1651117- 2013, que incluía parte de lo que se pretende acá titular. El área que describía ese plano era mucho mayor, de seiscientos ochenta y cuatro mil cuatrocientos sesenta y un metros cuadrados. El terreno que se pretende inscribir con la presente información posesoria, de acuerdo al plano H-2089556-2018, corresponde a una cabida de ciento setenta y dos mil novecientos cincuenta y tres metros cuadrados. Se trata de un fundo de repastos y tacotal según dicho plano y el estudio de suelos aportado , situado en La Aldea, Distrito Cuarto Llanuras del Gaspar del Cantón de Sarapiquí (estudio en imagen 37).

Es menester precisar, puede existir oposición de parte del Estado porque se argumente con razonabilidad, que el bien es de dominio público, en cuyo caso aplica el artículo 8 mencionado. Pero es distinto, cuando lo que se pretende titular lo es al amparo del artículo 7 de la Ley de Informaciones Posesorias, pues aunque exista una declaratoria de un Refugio de Vida Silvestre, al permitir la la ley la posibilidad de su titulación, si se demuestra la posesión decenal antes de esa afectación al demanio público, debe de darse trámite a la información posesoria. La norma reza de la siguiente manera: "Cuando el inmueble al que se refiera la información esté comprendido dentro de un área silvestre protegida, cualquiera que sea su categoría de manejo, el titulante deberá demostrar ser el titular de los derechos legales sobre la posesión decenal, ejercida por lo menos con diez años de antelación a la fecha de vigencia de la ley o decreto en que se creó esa área silvestre".

Es decir, no es legalmente aceptable una oposición al inicio del proceso, por el único alegato de que el bien inmueble se ubica dentro de un Refugio de Vida Silvestre, pues el artículo 8 debe de interpretarse en armonía con el ordinal 7 párrafo primero. En este orden de ideas, por tratarse de un proceso de jurisdicción voluntaria o no contencioso, no existe cosa juzgada, en los términos de la doctrina que informa el ordinal 64 del Nuevo Código Procesal (aplicable por disposición expresa del 26 de la Ley de Jurisdicción Agraria). Ello reñirían con los principios de la teoría general de proceso. En procesos de esta naturaleza, no hay identidad de partes entendidas como actor y demandado, no hay una demanda (con pretensiones) y contestación (con excepciones), pues es inexistente una contención propiamente que pueda generar una sentencia de absolutoria o de condena. Ello impide el análisis de la identidad subjetiva, objetiva y de la causa, en el marco de una relación jurídico procesal.

Claro está, que el examen del nuevo proceso de información posesoria que se presente, podrá ser sin perjuicio que en la valoración de la prueba se puedan ponderar elementos que se hayan evacuado en el proceso anterior, conforme al principio de libre valoración contenido en el artículo 54 de la Ley de Jurisdicción Agraria, y las reglas de la psicología, la lógica y la experiencia, a fin de determinar si se aprueba o imprueba. En razón de lo anterior, debe de revocarse la resolución recurrida, para continuarse con el trámite de la información posesoria.

POR TANTO:
