I.Proven facts (hechos probados): 1) On 9 de setiembre del 2016, at the pier located in El Cocal de Puntarenas, adjacent to the Universidad de Costa Rica, a fire occurred, as described in Technical Report EE: 50885-2016, dated 9 de setiembre del 2016, prepared by the Fire Investigation Program of the Benemérito Cuerpo de Bomberos de Costa Rica, Fire Prevention and Investigation Unit, by investigators Henry Morales Navarro and Ingrid Hutt Pacheco, concerning a fire emergency involving a means of land transportation—a heavy cargo vehicle—in Puntarenas, El Cocal, adjacent to the Universidad de Costa Rica. The report states that the owner of the structures is Nombre113874 and that the area of origin was an open yard on the west side of the structure. The external scene assessment states the following: “3.1 External Assessment: A 656-square-meter, two-story structure, with perimeter walls of mixed construction and galvanized iron (GI) sheet gates in the center and on the west side, used as a pier.
To the north, three fishing vessels were observed in the estuary. (Photograph #1). In the uncovered yard on the west side, a tanker truck was observed to have been completely affected by fire, which spread to the wall and partially to the west side of the structure. (Photograph #2) A large quantity of fuel (diesel) was observed pooled on the yard floor beneath the tanker due to the complete rupture of the tank, as well as a spill into the waters of the estuary, where several fishing vessels were at risk of being affected by the flames. All the vessels were moved to a safer location, preventing them from being damaged. Fuel-transfer operations (labores de trasiego de combustible) from the tanker to a fishing vessel were being conducted at the site. A motor pump generally designed to transfer water is used to perform this work. (Photograph 3) This motor pump drew in the liquid through a rubber-coated hose with an internal steel structure, so that it could be pumped under pressure through other hoses to the fishing vessel’s tanks (Photograph #4).
The hose was connected to the tanker truck’s nozzle system (API adapter, the tanker truck connection valve used for loading and unloading through a hose. (Photograph #5)). The greatest damage was detected in this area, which was therefore determined to be the area of origin. (Photograph # 6) At the time of the incident, the motor pump was started to begin the transfer operation, but apparently the shutoff valve between the tanker and the pump remained closed. Because suction had created a vacuum inside the hose, when the tanker’s shutoff valve was opened, the fuel entered the pump under intense pressure that could not be withstood by the metal clamps securing the hose to the female coupling connecting it to the male fitting at the pump intake. The pressurized fuel spilled beside the tank and ignited from the heat generated by the pump’s normal operation, particularly by the exhaust manifold, causing the fire to become widespread.
(Photograph # 7). The temperatures generated by the fire, together with the time elapsed between ignition and control of the fire, melted the upper portion along the entire length of the tank (Photograph # 8). During the fire, the diesel spill overflowed the yard and fell, while burning, into the waters of the estuary, where it was contained by the Naval Unit of the Cuerpo de Bomberos. (Photograph # 9 and 10). Coordination was undertaken with the Ministerio de Ambiente Minaet and personnel from Nombre1494 so that the spilled fuel could be properly collected for disposal or, alternatively, reuse.” Regarding the internal assessment of the structure, the report provides the following details: “3.2 Internal Assessment of the Pier Structure: A two-story structure with internal partitions of mixed construction, wooden floors on the second story, and concrete floors on the first story. The building is divided into two office areas, cold-storage rooms, and warehouses on the east and west sides, with a common area in the center for loading and unloading goods and for vehicle access.
The greatest structural fire damage was observed on the west side of the structure, in an office on the second story and an adjacent warehouse, affecting 41 square meters. (Photograph # 11). The entire wall of mixed construction (galvanized iron sheets, wood, and concrete blocks on the ground floor) on the west side of the structure exhibited fire damage and marks caused by direct contact with the flames generated by combustion of the diesel from the tanker. The flames spread through the windows on that same side and damaged 41 m2 of offices on the second story and at least10 m2 of a workshop on the ground floor. (Photograph #12).” The report also determined the following concerning the ignition source: “2. IGNITION SOURCE: Heat generated by the deflagration (deflagración) resulting from a fuel spill when the clamps on the transfer hose at the intake of a water motor pump failed.” Regarding the cause of the fire, the report states: “3.
CAUSE OF THE FIRE Fuel was being transferred from a tanker truck containing 7000 gallons of diesel to the tanks of a vessel using a water motor pump. The hose failed, spilling fuel onto the pump and causing a deflagration.” Finally, the report classified the fire as follows: “4. FIRE CATEGORY ACCIDENTAL” (image 322 of the PDF file generated by the virtual desktop).
II.Unproven facts. 1) That there was lawful, unlawful, normal, or abnormal conduct by the State directly connected to the damage caused by the fire (there is no evidence in the record). 2) That the plaintiffs operate as a family business in the form of a commercial enterprise (hacienda mercantil) (there is no evidence in the case file).
III.Arguments of the parties. The female plaintiff and the male plaintiff assert that, for more than thirty years, they have engaged in shrimp-fishing activities as part of a family business and that, through their labor and great effort, they acquired two vessels. As they explain, the boats "Rosaolly" and "Sultana", registrations Placa20967 and Placa20968, are owned by the male plaintiff and the female plaintiff, respectively. They consider it important to clarify, for purposes of understanding the damages they claim, that the registration records differ from the economic reality, since an economic group with commingled assets (grupo económico con confusión patrimonial) exists. According to their account, to conduct their fishing operations they leased a dock located in Cocal de Puntarenas, where, in addition to an office with electronic equipment, they had a warehouse in which they stored tools, fishing gear, life jackets, and other property needed for their work.
They add that they retained the services of the co-defendant Transportes Bellavista to distribute the fuel and fill the tanks at the dock. They also state that Transportes Bellavista S.A. is a fuel-distribution company without a fixed point of sale under Decreto n.° 31502-MINAE-S and official letter DTCC-351-2014, and therefore is a delegate or concessionaire of the hydrocarbon sales service. They indicate that, on 9 de setiembre del 2016, employees of Transportes Bellavista S.A. arrived at the dock with tanker truck license plate Placa20969. They state that, while the fuel was being unloaded, an incipient fire (conato de incendio) broke out because the gasoline pump was mishandled, causing a fire that damaged both vessels. They assert that the defendant company told them that they had to file a claim with Instituto Nacional de Seguros to obtain coverage under the insurance policy. They state that the damage affected not only the property but also the fishing operation itself.
Finally, they indicate that, although Transportes Bellavista had a policy with Instituto Nacional de Seguros and a claim was filed, that entity denied payment. Transportes Bellavista S.A., for its part, considers it true that it is authorized as a fuel distributor under Decreto n.° 31502-MINAE-S, but not as a "peddler." It states that it is true that, on 9 de setiembre del 2016, while a truck owned by it was unloading fuel onto a vessel allegedly owned by the plaintiffs, a fire accidentally broke out for reasons beyond its control. It acknowledges that the motor pump that enables fuel to flow from the tanker truck to the vessel malfunctioned. It states that Instituto Nacional de Seguros denied payment under the policy because it found that Transportes Bellavista S.A. had been grossly negligent (culpa grave). It maintains that its conduct involved neither negligence nor fault. It adds that there were no criminal proceedings in which it was found at fault or any homicide or injury was established.
It also believes that only a Criminal Court has jurisdiction to determine any type of wrongdoing, never a mere statement by an official of the state insurance entity. It further states that the gasoline pump was never mishandled in a manner that created any type of risk. It asserts that there is no evidence showing that the pump was mishandled. It considers that the risk arising from operating the pump was covered by the policy and therefore maintains that Instituto Nacional de Seguros is the party that must compensate the plaintiffs. Finally, the State maintains that it has no knowledge of matters related to the company’s operations and likewise has no personal knowledge of any of the facts, because the events concern a dispute between the plaintiffs and the defendant company in which the State had no involvement.
IV.Subject matter of the proceedings. This is a typical civil proceeding involving the Public Treasury (proceso civil de hacienda), through which the male plaintiff and the female plaintiff seek compensation for the damages and losses (daños y perjuicios) they suffered as a result of a fire that affected their property and shrimp-fishing business activities.
V.The specific case. As indicated above, this is a Treasury civil proceeding (proceso civil de hacienda) for the recovery of damages. Notwithstanding the foregoing, the claim is brought against two distinct legal entities, namely the defendant corporation and the State. Given the manner in which the matter has been presented and the legal nature of each of these entities, they are subject to different liability regimes, each with its own elements that warrant separate analysis. Accordingly, the liability of each of the two defendant entities will be analyzed separately. 1) Liability of the State: The claimants’ theory of the case is based on the strict non-contractual liability regime (régimen de responsabilidad objetiva extracontractual) of the Public Administration, codified in Articles 190 et seq. of the General Law of Public Administration (Ley General de la Administración Pública). The State was named as a defendant in these proceedings because it granted Transportes Bellavista S.A. a concession (concesión) for the transportation of fuel, clean petroleum products, diesel, and gasoline, under transportation code CR-0277, LICENSE PLATE Placa20966.
That concession was solely for the transportation of fuel and not for mobile sales without a fixed location, known as “Peddler,” regulated by Decreto Ejecutivo 31502-MINAE-S. Under this type of strict liability (responsabilidad objetiva), a series of elements must converge for the State’s liability to arise and for it consequently to be required to pay compensation. These elements include the attribution criteria (criterios de imputación) applicable to the conduct, namely lawfulness, unlawfulness, normality, and abnormality. There must also be a causal link (nexo causal) between the conduct attributed to the State and the damages caused. In the case under review, although it has been established that the State granted the aforementioned public-service concession, that conduct alone cannot be regarded as an automatic basis for attributing liability, giving rise ipso facto to the obligation to pay compensation.
As mentioned above, the elements of the strict-liability framework must converge. In these proceedings, the claimants seek to link the State’s grant of the concession to the damages that occurred during the fuel-unloading operation carried out by Transportes Bellavista S.A., in which a regrettable fire occurred that is attributable to the company, as will be discussed in the following subsection. In the Tribunal’s view, no lawful, unlawful, normal, or abnormal conduct by the State having a direct causal link to the damage resulting from the fire has been established. What occurred on the day of the fire cannot be directly attributed to the State’s lawful conduct in granting the concession to the co-defendant company. Thus, these proceedings have not established any irregularity or abnormality in the granting of the concession to Transportes Bellavista S.A., nor that the effective cause (causa eficiente) of the damage can be attributed directly to the State.
According to the evidence in the record, this damage is attributable solely and exclusively to the co-defendant corporation. The damage was therefore caused by a third party, which exempts the State from liability under the same framework set forth in the aforementioned body of law. Accordingly, it is impossible to attribute liability to the State under the framework of the General Law of Public Administration, as proposed by the claimants in their theory of the case, and the complaint against the State must therefore be dismissed. 2) Liability of Transportes Bellavista S.A.: The theory of the case presented by the male and female claimants is based on the regulatory regime established in Section 35 of the Law for the Promotion of Competition and Effective Consumer Protection (Ley de Promoción de la Competencia y Defensa Efectiva del Consumidor), Law No. 7472. This strict-liability regime requires the producer, supplier, or merchant to be liable jointly and independently of the existence of fault if the consumer suffers harm because of the good or service, inadequate or insufficient information concerning it, or its use and risks.
Under this framework, only a person who proves that they had no involvement in the damage (ajenidad al daño) is relieved of liability. The aforementioned provision extends liability to the legal representatives of commercial establishments or, as applicable, the persons in charge of the business, for their own acts or actions or those of their employees or assistants. Under this strict-liability framework based on the risk created through the conduct of the activity, there is an obligation to answer for the damage unless lack of involvement in it is established. All the documentary evidence submitted in the case supports the conclusion that the defendant corporation was responsible for the fire that caused the damages claimed in these judicial proceedings. In this regard, Technical Report EE: 50885-2016, dated September 9, 2016, issued by the Fire Investigation Program of the Meritorious Fire Department of Costa Rica, Fire Prevention and Investigation Unit, and prepared by investigators Henry Morales Navarro and Ingrid Hutt Pacheco in connection with the fire emergency involving a means of land transportation—a heavy cargo vehicle—at Dirección13940, , adjacent to the Universidad de Costa Rica, stated very clearly that the ignition source resulted from the “Heat generated by the deflagration caused by a fuel spill when the clamps on the transfer hose at the intake of a water motor pump gave way.” Regarding the cause of the fire, it further determined that it occurred as follows: “Fuel was being transferred from a tanker truck containing 7000 gallons of diesel to the tanks of a vessel using a water motor pump.
The hose gave way, spilling fuel onto the pump and causing a deflagration.” Moreover, in Report INSPN-02279-2016 dated November 11, 2016, the Instituto Nacional de Seguros declined coverage under the insurance policy after finding that “the acts or omissions of the Insured, its employees, persons acting on its behalf, or persons entrusted with custody of the valuables which, in the Institute’s judgment, cause or aggravate the losses.” It reached this conclusion after determining that the ignition source was the “Heat generated by the deflagration caused by a fuel spill when the clamps on the transfer hose at the intake of a water motor pump gave way.” It similarly found that the cause of the fire was as follows: “Fuel was being transferred from a tanker truck containing 7000 gallons of diesel to the tanks of a vessel using a water motor pump. The hose gave way, spilling fuel onto the pump and causing a deflagration.” Finally, it found as follows: “As can be observed, both descriptions have a common denominator: the use of a water motor pump, which is unsuitable equipment for unloading fuel because it was not designed for that specific task, thereby increasing the risk through the actions of our insured’s representative (the truck driver) and consequently triggering a fire.” (Emphasis not in the original).
Based on the documentary evidence in the record, the Tribunal finds that the conduct of the defendant corporation has been established and that such conduct was negligent and reckless, as stated by the Instituto Nacional de Seguros when it declined coverage under the policy, because the person responsible for operating the pump in situ to transfer the fuel caused the fire. This is further supported by the Fire Department’s Technical Report, which leads to the same conclusion. Negligence and recklessness may be attributed to the conduct of the person responsible for transporting and unloading the fuel because that person used an unsuitable motor pump, thereby causing the fire. Under the liability framework described above, the risk inherent in the activity is sufficient to attribute liability where damage is established. It is impossible to find a lack of involvement in the damage when negligence and recklessness were present in the operation of the motor pump that caused the fire.
At this point, it is relevant to note that the defendant corporation argued in its defense that it was not at fault and that, in any event, only a Criminal Judge could determine fault. That assertion is contrary to the allocation of jurisdiction (separación competencial) among the various strict-liability systems. As already indicated, under the liability framework governing this case, which derives from Section 35 of the Law for the Promotion of Competition and Effective Consumer Protection, a ruling in criminal proceedings is unnecessary because the judge with jurisdiction—here, the judge of the Contentious-Administrative Jurisdiction (Jurisdicción Contenciosa)—may make that determination by evaluating the evidence in relation to the elements of the applicable framework. Furthermore, as indicated, the “onus probandi,” or burden of proving lack of involvement in the damage, rests with the defendant corporation, which has submitted no documentary evidence rebutting the evidence reviewed by the Tribunal, from which fault and negligence are apparent in the conduct of the person responsible for supplying fuel from the tanker truck to the vessels.
Notwithstanding the foregoing—and this is the central issue in the proceeding being decided, because it is a Treasury civil proceeding—it is highly relevant to determine whether the damages claimed by the male and female claimants are those caused by the fire at issue.
VI.Regarding the heads of compensation claimed. At the preliminary hearing, the plaintiffs withdrew their claim against the Instituto Nacional de Seguros, and that entity therefore ceased to be a party to the proceedings from that time onward. This is relevant because the alternative claim automatically ceased to have effect, as the plaintiffs sought to have that institution pay out under Inland Fuel Transportation Policy number 01 09 CAC 000001301. For this reason, the Court will not analyze it. With respect to the principal claim, the plaintiffs seek the following damages: a) actual damages (daño emergente): “payment of: C 182.046.786 (one hundred eighty-two million forty-six thousand seven hundred eighty-six colones) as actual damages.” b) lost profits (lucro cesante): C 36.400.000 (thirty-six million four hundred thousand colones) as lost profits. 2. That the approved amounts be indexed from September 9, 2016, until actually paid. 3.
That the defendant be ordered to pay both sets of costs in this action.” In the complaint, in the section entitled “Compensable Damage,” the plaintiffs state that the actual damages “consist of the heads identified in item number 7 of the statement of facts. They comprise all losses that arose immediately from the fire. They are hereby assessed at 182.046.786.00 (one hundred eighty-two million forty-six thousand seven hundred eighty-six colones).” For their part, with respect to lost profits, they state in the same section of their complaint: “this is the total amount of income that the person harmed by the injurious conduct could have received but ultimately did not receive for reasons attributable to the person responsible. In this case, the losses consist of the reduction in income suffered as a result of the incident. This head is assessed at 36.400.000.00 (thirty-six million four hundred thousand colones).” In the seventh fact alleged in the complaint, the plaintiffs state that they filed a claim with the Instituto Nacional de Seguros and that the relevant details are clearer in the file submitted by plaintiff Nombre24446.
In that allegation, they itemize the damage as follows: Building 12.536.025; Warehouse, spare parts, tools, and work equipment 81.271.434; Vessel Nombre113875 31.417.354; lost profits for Vessel Nombre113875 from September 9 to 22, 2016 18.200.000; Vessel Nombre111382 53.225.688; lost profits for Vessel Nombre111382 from September 9 to 22, 2016 18.200.000; invoice for fuel lost as a result of the accident 3.596.285, for a total of 218.446.786. They state that, in that claim filed with the Instituto Nacional de Seguros, “the vessel ‘Sultana’ was located outside the dock platform at the time of the incident, and because of the urgency of saving the vessel and the lack of manner [sic...], the vessel ran aground, severely damaging the propeller, breaking the vessel’s intermediate shaft, and breaking the teeth of the main drive pinion. In addition, 5 shrimp-fishing nets and their accessories were completely burned, as were the vessel’s electronic fishing, navigation, and communications equipment, and the life jackets stored in the warehouse.” For its part, vessel Nombre113875 “sustained damage to its electronic fishing and navigation equipment, which was entirely burned.
In addition, 5 complete shrimp-fishing nets and their accessories were charred, the entire port side and bow of the vessel were damaged, and the life jackets stored in the warehouse were completely burned.”
Court’s Analysis: Damage under any system of liability has very specific characteristics: to be recognized and compensated, it must be real, actual, quantifiable, and compensable. Furthermore, from a procedural perspective and in an adversarial proceeding such as this case, the burden of proving damages and losses rests on the party claiming them. This is known as the “onus probandi.” This is grounded in principles and guarantees such as the right of defense and due process because, to impose a financial burden on a party to a proceeding, the adjudicators must have complete and absolute certainty that the damage exists. Thus, in practice, the pecuniary loss must be tangible and visible. Based on the evidence reviewed by the Court, there is no doubt regarding the unfortunate event that occurred on September 9, 2016. The documents submitted include certifications issued near the time of the fire attesting to ownership of the vessels involved in this case, such that the vessel known as “Rosaolly” is owned by plaintiff Nombre24446 and the vessel known as “Sultana” is owned by plaintiff Nombre113873.
Notwithstanding the foregoing, and despite the large number of reports and records entered into evidence, including the Coast Guard Station report, official letter #75-2016-AJSNGP; the Nombre1494 report SAS-DV-UA-0022-2016; and the report from the Nombre7958 Chacarita Health Governing Area PC-ARS-PC-0583-2016 of the Ministerio de Salud, those documents merely report the actions taken within the scope of those bodies’ authority in connection with the fire and do not precisely describe the losses claimed by the plaintiffs. In this regard, Fire Department incident record number 50885-2016 broadly refers to damage to the dock structure in the built-up area—the second floor and the maintenance workshop on the ground floor. Nevertheless, although it mentions that vessel Nombre113875 P7655 sustained damage, it does so only very briefly. On the other hand, the Fire Department Report prepared by investigators Henry Morales Navarro and Ingrid Hutt Pacheco describes the dynamics of the fire within the dock structure in considerable detail.
Its only reference to the vessels states in general terms that the vessels at the site were moved to a safer location, thereby preventing them from sustaining damage. The report contains the following relevant statement: “A large quantity of fuel (diesel) was observed pooled on the yard floor beneath the tanker due to the complete rupture of the tank, with a spill into the waters of the estuary where several fishing vessels were located and were at risk of being affected by the flames. All the vessels were successfully moved to a safer location, preventing them from sustaining damage.” Continuing in sequence, the file concerning the claim submitted to the Instituto Nacional de Seguros, which contains the submissions made by the plaintiff and the female plaintiff in this proceeding, as well as those made by co-defendant Transportes Bellavista S.A., includes a report dated October 31, 2016, signed by Miguel Wong Sánchez, which refers to the damage claimed from the Instituto Nacional de Seguros in the following terms: “The damages represent the replacement of the areas within the property affected by the effects of the conflagration.
Because the damage is partial, it is considered that the property may be rebuilt without affecting the building, unlike the reported magnitude of the event, which was explosive and involved high temperatures, but was quickly brought under control by several fire department units that responded to the fire. Replacement of the equipment shown in the images must be assessed by the Instituto’s appraisers specializing in the relevant field, as must the affected fishing materials and maintenance-workshop tools. Analysis and conclusions: Based on the information gathered from the data supplied by the clients, a data matrix was prepared and is analyzed below so that the institution may have supplementary information regarding the facts. 1. The client lists 32 documents consisting of invoices, pro forma invoices, and quotations, which are contained in three attached documents and one CD with summarized information concerning what, in the clients’ opinion, was damaged as a result of the conflagration accident. 2.
Among these invoices are completed and paid-for jobs whose amounts do not necessarily correspond to the actual replacement value. For example, fiberglass work is mentioned only in invoice No 1, for an amount that is not representative of the listed movable property. This can be seen in the images of the vessels and can be verified at the site. 3. Invoice No 2 concerns repairs to the booms; as can be seen in one of the images, they have not even been touched, although the repairs represent a significant amount. 4. The [sic...] pro forma invoice concerning the transmitters and antennas (No3) did not indicate where the damaged components were located or the nature of their damage. 5. A similar situation exists with invoice No 4 for pulleys and life jackets. 6. A quotation from a supplier is attached for the gillnet with 5 cm mesh openings, but its origin is unknown and there is no certainty that the entire gillnet was damaged [sic...], whereas the invoice provides for its complete replacement. 7.
Similarly, there is no information regarding the echo sounder, antenna, and transformer listed in invoice No 8 or the extent of deterioration they sustained in the fire. 8. The gillnet components are intended to outfit its entire body completely; this assumes that the vessel’s gillnet was on the dock and not aboard the vessel at the time of the fire. Up to this point, all the expended and quoted components correspond to the vessel named Nombre113875. 9. The vessel’s engine equipment would have had to be outside the vessel in order to have been damaged on the dock. It was not shown that either vessel had an engine installed, despite its high cost, or how they could have replaced an engine aboard the vessel with a new or used one within this brief period. Moreover, pro forma invoice No 10 is for replacing the engine with a completely new one. 10. Invoice No 11 includes refrigerants, valves, and components.
The question is which refrigeration components were damaged. 11. The desktop computers valued in invoice No 12, in addition to desks, are also covered by a second pro forma invoice that will be discussed below. 12. It cannot be verified that the quoted workshop equipment was damaged [sic...], and the quotation merely provides a list of new equipment. Indeed, the quoted items include a 10-gallon compressor, which will be discussed below. 13. The PVC hoses are listed on an invoice for fuel that had already been supplied. In general terms, the items that have already been purchased or paid for are essential to the operation of the premises; nevertheless, certain invoices, such as No 1, lack adequate support for replacement. 14. Removal of the debris corresponds to invoice No 15. Compressors have already been itemized above; at least one of the 10-gallon compressors is billed again. In this instance, the clients are seeking compressors of better quality than the one actually damaged [sic...], which can be seen in one of the images. 16.
Quotation line No 17 once again quotes office furniture, although this had already been included in line No 11. 17. Line No 18 concerns cylinders of oxygen, acetylene, and other gases; no cylinders containing these gases that could justify [sic...] their purchase were observed at the site. All these items concern replacement equipment and materials for use in the workshop and offices of the affected property. 18.
The reconstruction of the propeller in line No. 19 must be considered, because if the vessel was in the water, how were that component, the shaft, and the rotor disc damaged (sic...). From this point onward, the components correspond to the vessel Nombre111382. 19. Line 20 again includes fiberglass repair materials that have already been paid for. 20. Invoice No. 21 corresponds to payment for straightening the shaft; in the photographs provided, the shaft can be seen and has not yet been repaired, which raises doubts. 21. Line 225 mentions payment for the right to rent the dry dock; this may correspond to the propeller repair; however, it has been questioned why this entire section was damaged (sic...) if it was submerged. 22. Invoice No. 23 reflects the invoice from Nombre1494 for what was acquired on the day of the event. 23. The repair of the electrical system is presented in line No. 24. 24.
Line No. 25 presents the repair of the starter; these invoices, like the one in line No. 2, were issued without officially stamped invoices. 25. Invoice No. 26 corresponds to hauling the vessel out of and launching it into the water for purposes of the repairs performed. 26. Line No. 27 mentions the transmission-shaft pinion, for which a quotation has been obtained; however, one of the images provided shows that the pinion is already available. In other words, they will install an extra pinion, and if (sic...) the boat has already been in the dry dock, what did they replace? 27. Line 28 proceeds (sic...) to present the invoices for the digital transmitters and antennas, which match the item in invoice 3. In other words, duplicate damage and no equipment to appraise. 28. Similarly, invoice No. 29 again presents the quotation matching line No. 8, duplicating the most expensive equipment for each vessel. 29.
Line No. 30 includes the weights for the gillnet; once again, consideration must be given to items that are not visible among the materials photographed at the site. 30. Line No. 31 again presents the materials needed to assemble a gillnet, in this case for the vessel Sultana. The cost is similar to the value given for the other vessel, without sufficient evidence; alternatively, it must be determined whether the vessels currently have gillnets, because, if so, they apparently want to have a pair of sets of gillnets for future operations. 31. Finally, a quotation is included for a bronze bar constituting the shaft of the boat, which has already been in the dry dock and for which the shaft and other component repairs were apparently paid; therefore, why is there a desire to submit a new invoice for an item that has already been repaired? All of this demonstrates the duplication of items, overpricing, and items for which quotations have been obtained, so that, potentially, once the money is received, replacements will never be purchased, given that some repairs have already been made to render the vessels operational at minimal cost, while seeking compensation from the INS for damage that does not necessarily exist." The foregoing document is relevant to the resolution of this case because of the evidentiary analysis it performs by applying the rules of sound rational criticism (sana crítica racional), since, as is clear from the complaint itself, the evidence submitted by the plaintiffs to itemize the damage caused to the property consists not only of the claims filed with the Instituto Nacional de Seguros, but also of expense invoices and pro forma invoices analyzed by that entity, which raised many doubts for engineer Wong Sánchez in his report and likewise raise doubts for the Court, because there is neither order nor clarity as to which damage they concern.
Notwithstanding this situation, the Collegiate Body (Órgano Colegiado) finds that there is physical evidence indicating the existence of damage caused to the vessel Rosaolly by the fire of 9 de setiembre del 2016, since this is mentioned in the Cuerpo de Bomberos report and shown in the photographs contained in engineer Wong Sánchez’s report, in which it is possible to see that the vessel was exposed to the flames. This is not the case with respect to the damage allegedly sustained by the vessel named Nombre111382. Indeed, the Instituto Nacional de Seguros report casts doubt on the existence of that damage. As for the property damage sustained in the office and warehouses, it is likewise not itemized. Moreover, although compensation is sought for damage to the building, warehouses, tools, and work equipment, there is no clear breakdown of what each item of damage entails or who owned the property.
In light of the foregoing, pursuant to section 122 of the Código Procesal Contencioso Administrativo, which provides, insofar as relevant: "ARTICLE 122.- (...) m) Order the payment of damages (daños y perjuicios) under the following terms: i) A ruling on their existence and amount, provided they have been proven in the record when judgment is rendered. ii) A ruling without specification of amount (pronunciamiento en abstracto), when their existence has been established but not their amount. iii) A ruling without specification of amount, when neither their existence nor their amount has been established, provided they are a consequence of the administrative conduct or legal-administrative relationship at issue in the complaint.," it is hereby ruled: a) Regarding the damages to the vessel Nombre113875: Pursuant to section 122, subsection m), subparagraph i), Transportes Bellavista S.A. is ordered to pay only for the property damage caused to the vessel Rosaolly by the fire of 9 de setiembre del 2016 that the plaintiff is able to prove with the corresponding physical evidence during the judgment-enforcement phase (fase de ejecución de sentencia).
Likewise, pursuant to that same provision, Transportes Bellavista S.A. is ordered to pay the lost profits (lucro cesante) resulting from the fire of 9 de setiembre del 2016 that the plaintiff is able to prove with the corresponding physical evidence. The calculation of those amounts is reserved for the judgment-enforcement phase. b) Regarding the damages to the vessel Nombre111382: According to the plaintiff’s account in her claim before the Instituto Nacional de Seguros, which she also brings before this Court, the boat "Sultana" was located outside the dock platform at the time of the incident, and, because of the urgency involved in saving the boat and due to the lack of skill, the boat ran aground, severely damaging the propeller, breaking the boat’s intermediate shaft, and breaking the teeth of the main drive pinion. In addition, 5 shrimp-fishing nets and their accessories, the boat’s electronic fishing, navigation, and communications equipment, and the life jackets stored in the warehouse were completely burned.
In this regard, engineer Miguel Wong’s report stated that the reconstruction of the propeller needed to be considered, since it was unclear how it had been damaged if the vessel was in the water. Beginning at point 19, that report addresses the damage claimed with respect to that vessel and the doubts raised by the alleged losses. The only evidence submitted to prove the damages consists of the claims filed with the Instituto Nacional de Seguros. There is no other evidence substantiating them. In view of this situation, the Court lacks sufficient physical evidence demonstrating the existence of the claimed damages; consequently, plaintiff Nombre113873’s claim for compensation for actual loss (daño emergente) and lost profits must be denied. c) Regarding the damage claimed to the building, warehouse, spare parts, tools, and work equipment: Although this damage is mentioned in fact number seven and an amount is assigned to each item in the following terms: Building 12.536.025; Warehouse, spare parts, tools, and work equipment, it is unclear what the damage entails or how it is itemized.
Moreover, it is likewise unclear who owns this property and these chattels, and whether the owner is the male plaintiff or the female plaintiff. As stated supra, the reports of the Cuerpo de Bomberos, Ministerio de Salud, Guardacostas, and Recope establish the occurrence of the fire, and the Court can infer in general terms that property located at sites near the dock, which may have belonged to the plaintiffs, could have sustained some type of damage; however, there is no clarity, precision, or itemized breakdown regarding that property, its owner, or its individual connection to the cause of the incident. For this reason, it is impossible to determine such damage at this merits phase (fase de conocimiento) so that the corresponding amounts may be calculated during the enforcement phase.
VII.On the defenses. 1) Defenses raised by the State: a) defense of lack of passive standing (falta de legitimación ad causam pasiva): This defense must be rejected because there is a substantive legal relationship between the plaintiffs and the State, since the latter granted a public-service concession to a company for the distribution of fuel. This activity caused loss and damage as a result of a fire. Accordingly, the plaintiffs have sufficient standing to sue the State. Furthermore, the State has standing to appear as the respondent in this legal proceeding and to be sued. b) defense of lack of legal entitlement (falta de derecho): This defense must be upheld, in accordance with the grounds set forth in section V of the preceding recital of this judgment. 2) Defenses raised by Transportes Bellavista S.A.: lack of active and passive standing (falta de legitimación activa y pasiva): This defense must be rejected because there is a substantive procedural legal relationship linking the plaintiffs to the respondent company by virtue of the damage they suffered as a result of the fire caused by the tanker truck that was transporting and unloading fuel. The foregoing establishes a procedural relationship in which the plaintiffs have standing to sue and the respondent company may be named as the respondent.
VII.On legal costs (costas). As provided in section 193 of the Código Procesal Contencioso Administrativo, legal costs shall be borne by the unsuccessful party unless the exceptions established in that same provision apply. Because the case under review involves two parties as plaintiffs and two as respondents, the matter will be decided separately for greater clarity and to avoid confusion. a) Costs relating to the State: Although the plaintiff and the female plaintiff are the unsuccessful parties with respect to the claim against the State, because the defense of lack of legal entitlement was upheld, the Court finds that they had sufficient grounds to litigate, since the fire to which they referred was a proven event and their litigation against the State cannot be deemed to have been brought in bad faith. Therefore, each party shall bear its own legal costs. b) Costs relating to Transportes Bellavista S.A.: In this specific case, the Court finds that the respondent company must pay legal costs solely to the plaintiff Nombre24446, because he alone was awarded some of the damages claimed.
The opposite is true of the female plaintiff Nombre113873, since she failed to prove any loss or damage. Notwithstanding the foregoing, the Court finds that she had sufficient grounds to litigate, since the fire to which they referred was a proven event and her litigation against the respondent company cannot be deemed to have been brought in bad faith. Therefore, each party shall bear its own legal costs, such that the female plaintiff Nombre113873 shall not be required to pay the respondent company’s costs.
Por Tanto
The calculation of those amounts is deferred to the judgment-enforcement phase. Transportes Bellavista S.A. is also ordered to pay legal costs solely in favor of the plaintiff Nombre24446. The female plaintiff Nombre113873 shall bear no legal costs and is exempted from paying such costs to Transportes Bellavista S.A. Let notice be served.

Sentencia n.° 74-2020-V TRIBUNAL CONTENCIOSO ADMINISTRATIVO. SECCI ÓN QUINTA. Segundo Circuito Judicial de San José. Resultando
Redacta el juez Nombre31590 , con el voto afirmativo de la jueza Sá nchez Navarro y el juez Giusti Soto; y,
Considerando
I.Hechos probados: 1) Que el 9 de setiembre del 2016, en el muelle ubicado en El Cocal de Puntarenas, contiguo a la Universidad de Costa Rica, ocurrió un incendio, descrito en el informe Técnico EE: 50885-2016, del 9 de setiembre del 2016, del Programa de Investigaciones de Incendios del Benemérito Cuerpo de Bomberos de Costa Rica, de la Unidad de Prevención e Investigación de Incendios, elaborado por los investigadores Henry Morales Navarro e Ingrid Hutt Pacheco, en relación con la emergencia por fuego en medios de transporte terrestre-vehículo de carga pesada, en Puntarenas, El Cocal, contiguo a la Universidad de Costa Rica, indica que el propietario de las estructuras es Nombre113874 , el área de origen fue en un patio abierto al costado oeste de la estructura. En la evaluación de la escena externa se indica lo siguiente: "3.1 Evaluación Externa: Estructura de 656 metros cuadrados de dos plantas, con paredes perimetrales mixtas, portones de l áminas de hierro galvanizado (HG) al centro y costado Oeste, utilizados como muelle.
Hacia el Norte, en el estero se observaron tres embarcaciones pesqueras. (Fotografía #1). Se observó en el patio al costado Oeste, no techado, un camión cisterna con afectación total por fuego, propagándose a la pared y parcialmente al costado Oeste de la estructura. (Fotografía #2) Sobre el suelo del patio se observó gran cantidad de combustible (diésel) encharcado bajo el cisterna debido a la ruptura total del tanque, y un derrame a las aguas del estero en donde se encontraban varias embarcaciones pesqueras que corrí an riego de ser afectadas por las llamas. Todas las embarcaciones lograron ser desplazadas a un sitio más seguro, evitando que sufrieran daños. En el lugar se encontraban haciendo labores de trasiego de combustible del cisterna a un barco pesquero. Para ejecutar esta labor utilizan generalmente una motobomba diseñ ada para trasegar agua. (Fotografía 3) Esta motobomba succionaba el líquido por una manguera con estructura interna de acero, recubierta por hule, para ser bombeado a presi ón con otras mangueras hasta los tanques del pesquero (Fotografía #4).
La manguera estaba acoplada al sistema de boquillas (adaptador API, válvula de conexión de los camiones cisterna, para la carga y descarga por medio de una manguera. (Fotografía #5) ) del camión cisterna. En este sector se detecta el mayor daño, por lo que se determina como el área de origen. (Fotografía # 6) En el momento del incidente la motobomba se puso a funcionar para empezar la labor de trasiego pero, en apariencia, la llave de paso del cisterna a la bomba permanecía cerrada. Como existía vacío por succión en el interior de la manguera, al abrir la llave de paso del cisterna, el combustible ingresó a la bomba con una fuerte presión que no pudo ser soportada por las gazas metálicas que fijaban la manguera al acople hembra que la unía al macho de la boca de entrada de la bomba. El combustible a presión se derrama al costado del tanque y se enciende por el calor generado del funcionamiento normal de la bomba, especialmente por el manifold de escape, generalizando el incendio.
(Fotografía # 7). Las temperaturas generadas por el incendio aunado al tiempo transcurrido entre la ignición y el control del fuego fundieron la parte superior de todo lo largo del tanque (Fotografía # 8) Durante el incendio el derrame de diésel superó el patio y cayó en llamas a las aguas del estero y fue contenido por la Unidad Naval del Cuerpo de Bomberos. (Fotografía # 9 y 10). Se coordinó con el Ministerio de Ambiente Minaet, y con personal de Nombre1494 para que el combustible derramado fuera recogido adecuadamente para ser desechado o en su defecto reutilizado." En cuanto a la evaluación interna de la estructura, el informe detalla lo siguiente: " 3.2 Evaluación Interna de la estructura del muelle: Estructura de dos plantas con divisiones internas mixtas, pisos de madera en la segunda planta y de concreto en la primera planta. La edificació n está dividida en dos áreas de oficinas, cuartos fríos y bodegas a los costados Este y Oeste, y un área común al centro para descarga y carga de mercadería y entrada de vehículos.
Hacia el Oeste de la estructura se observó el mayor daño estructural por fuego, en una oficina de la segunda planta, y en una bodega contigua, afectando 41 metros cuadrados. (Fotografía # 11). Toda la pared de construcción mixta (láminas de hierro galvanizado, madera y bloques de concreto en la planta baja) del costado Oeste de la estructura se observó con dañ os y marcas por fuego por contacto directo con las llamas generadas en la combustión del diésel del cisterna. Las llamas se propagaron por las ventanas de ese mismo costado y dañaron 41 m2 de oficinas en la segunda planta y al menos10 m2 de un taller en planta baja. (Fotografía #12). " A la vez, el informe en cuestión determinó en relación con la fuente de ignición lo siguiente: " 2. FUENTE DE IGNICIÓN: Calor generado por la deflagración producto de un derrame de combustible, al ceder las gazas de la manguera para trasiego en la boca de una motobomba para agua." Por otro lado, sobre la causa del incendio, el informe indica: "3.
CAUSA DEL INCENDIO Desde un camión cisterna con 7000 galones de diésel, se encontraban trasegando el combustible a los tanques de una embarcación, utilizando una motobomba para agua. La manguera cedió derramando el combustible sobre la bomba provocando una deflagración" Finalmente, el informe clasificó la categoría del incendio de la siguiente forma: "4. CATEGORÍA DEL INCENDIO ACCIDENTAL" (imagen 322 del archivo pdf generado por el escritorio virtual).
II.Hechos no probados. 1) Que exista una conducta lícita, ilícita, normal o anormal desplegada por el Estado, que tenga un nexo directo con los daños ocurridos con motivo del incendio (no existe prueba en los autos). 2) Que los actores se desenvuelvan en el marco de una empresa familiar, como una hacienda mercantil (no hay prueba en el expediente).
III.Argumentos de las partes. La actora y el actor afirman que a lo largo de más de treinta años, se han dedicado a labores dirigidas a la pesca camaronera, propias de una empresa familiar, que junto con la mano de obra que aportan, adquirieron con gran esfuerzo dos embarcaciones. Según explican, los botes "Rosaolly" y "Sultana", matrículas Placa20967 y Placa20968, son propiedad del actor y la actora respectivamente. Consideran importante aclarar, a efectos de comprender los daños que reclaman, que la realidad registral es distinta a la económica, pues lo que existe es un grupo económico con confusión patrimonial. Según narran, para el desarrollo de la actividad pesquera arrendaron un muelle ubicado en el Cocal de Puntarenas, en el que además de una oficina con equipo electrónico, contaban con una bodega donde almacenaban herramientas, aditamentos para pescar, chalecos salvavidas y bienes propios para poder laborar.
Agregan que contrataron los servicios de la codemandada Transportes Bellavista, para la distribución del combustible, encargada de llenar los tanques en el muelle. Menciona también que Transportes Bellavista S.A., es una empresa distribuidora de combustible sin punto fijo en los términos del Decreto n.° 31502-MINAE-S y el oficio DTCC-351-2014, por lo cual es delegatoria o concesionaria del servicio de venta de hidrocarburos. Indican que el 9 de setiembre del 2016, funcionarios de Transportes Bellavista S.A., se presentaron al muelle con el camión cisterna placa Placa20969. Señalan que en la descarga de combustible se produjo un conato de incendio, por una mala manipulación de la bomba de gasolina que generó un incendio, que produjeron daños a las dos embarcaciones. Afirma que la sociedad accionada les indicó que debían presentar reclamo ante el Instituto Nacional de Seguros, para hacer efectiva la póliza.
Mencionan que los daños no solo abarcaron los bienes, sino la actividad pesquera como tal. Finalmente, indican, que si bien la empresa Transportes Bellavista contaba con una póliza con el Instituto Nacional de Seguros, pese a que se hizo el reclamo, dicha entidad declinó su pago. Transportes Bellavista S.A., por su parte, considera que es cierto que se encuentra autorizado como distribuidor de combustible, conforme al Decreto n.° 31502-MINAE-S, mas no como "peddler". Indica que es cierto que el 9 de setiembre del 2016, un camión de su propiedad al realizar descarga de combustible en una embarcación presuntamente propiedad de los actores, por razones ajenas a su voluntad y de forma accidental presentó un incendio. Reconoce que se dio un desperfecto en la motobomba que hace posible el flujo de combustible del camión cisterna a la embarcación. Menciona que el Instituto Nacional de Seguros declinó del pago de la póliza, al considerar que medió culpa grave de su parte.
Considera que no hubo negligencia ni culpa en su actuación. Añade que no existió proceso penal en el que se determinara su culpa, o declarara algún homicidio o lesión. A la vez, es su parecer que solamente un Tribunal Penal es el competente para determinar algún tipo de falta, nunca una simple manifestación de un funcionario del ente asegurador estatal. Menciona además, que nunca hubo una mala manipulación de la bomba de gasolina que generara algún tipo de riesgo. Afirma que no hay prueba que demuestra que la bomba fue mal manipulada. Considera que el riesgo generado por la manipulación de la bomba estaba cubierto por la póliza, motivo por el cual, considera que quien debe indemnizar a los accionantes es el Instituto Nacional de Seguros. Finalmente, El Estado , sostiene que desconoce lo relacionado con la actividad de la empresa, de igual modo no le constan ninguno de los hechos, dado que en lo acontecido es un asunto entre los accionantes y la empresa demandada, en la que no tiene que ver el Estado.
IV.Objeto del proceso. Nos encontramos frente a un típico proceso civil de hacienda, mediante el cual, el actor y la actora reclaman los daños y perjuicios sufridos con motivo de un incendio que afectó los bienes y actividad económica relacionada con la pesca del camarón.
V.Sobre el caso concreto. Tal y como se indicó supra, nos encontramos frente a un proceso civil de hacienda, para el cobro de unos daños y perjuicios. Sin perjuicio de lo anterior, el reclamo se hace a dos personas jurídicas distintas como lo son la sociedad anónima accionada y el Estado. Planteadas así las cosas, por la naturaleza jurídica de cada una de estas entidades, se encuentran sujetas a regímenes de responsabilidad distintos, cada uno con sus propios elementos que ameritan ser analizados por separado. Por tal razón, se dividirá el análisis de la responsabilidad de cada una de las dos entidades accionadas. 1) Sobre la responsabilidad del Estado: La teoría del caso de la parte accionante tiene su sustento en el régimen de responsabilidad objetiva extracontractual de la Administración Pública, positivizada en los artículos 190 y siguientes de la Ley General de la Administración Pública.
El Estado es traído como demandado en esta sede, por haber otorgado a la sociedad Transportes Bellavista S.A., una concesión para el transporte de combustible, producto limpio, diésel y gasolina, con código de transporte CR-0277, PLACA Placa20966. La concesión dicha era sólo para el transporte de combustible, no así para la venta sin punto fijo, conocida como "Peddler " regulada en el Decreto Ejecutivo 31502-MINAE-S. De conformidad con este tipo de responsabilidad objetiva, deben converger una serie de elementos, para que se pueda configurar la responsabilidad del Estado y de ese modo se encuentre obligado a indemnizar. Entre estos elementos se encuentran los criterios de imputación que consisten en la atribución a la conducta, que son la licitud, ilicitud, normalidad y anormalidad. Por otro lado, debe existir un nexo causal entre esa conducta imputada al Estado y los daños y perjuicios ocasionados.
En el caso bajo examen, si bien se encuentra demostrado que el Estado otorgó la concesión de servicio público ya mencionada, lo cierto es que esta conducta por sí sola no puede ser considerada como un factor de atribución de responsabilidad automática, que configura ipso facto la obligació n de indemnizar. Como se mencionó supra, deben converger los elementos del esquema de responsabilidad objetiva. Los actores pretenden en esta sede, ligar el hecho de que el Estado otorgara la concesión, a los daños que se produjeron, en la actividad de descarga de combustible desplegada por la empresa Transportes Bellavista S.A., en la que ocurrió un lamentable incendio, atribuible a la empresa, como se verá en el siguiente acápite. Para el Tribunal, no se ha logrado demostrar una conducta lícita, ilícita, normal o anormal al Estado, que tenga un nexo directo con los daños ocurridos con motivo del incendio.
A la conducta lícita del Estado, de haber otorgado la concesión a la empresa coaccionada, no es posible atribuirle de manera directa lo ocurrido el día del incendio. De ese modo, en esta sede no se ha logrado acreditar alguna irregularidad o anormalidad en el otorgamiento de la concesión a Transportes Bellavista S.A., ni que la causa eficiente que produjo el daño se le pueda atribuir directamente al Estado. Estos daños, de acuerdo con la prueba que obra en los autos, es imputable única y exclusivamente a la sociedad codemandada. De ese modo, el causante de los daños es un tercero, lo que exime al Estado de su responsabilidad, conforme al mismo esquema que contiene el cuerpo normativo antes mencionado. Por tal motivo, resulta imposible atribuir responsabilidad bajo el esquema de la Ley General de la Administración Pública al Estado, como lo proponen en su teoría del caso los accionantes, por lo que la demanda en su contra debe ser declarada sin lugar. 2) Sobre la responsabilidad de Transportes Bellavista S.A.: La teoría del caso que vienen a plantear el actor y la actora, tiene como sustento el régimen normativo del canon 35 de la Ley de Promoción de la Competencia y Defensa Efectiva del Consumidor, Ley n.° 7472.
Dicho régimen objetivo de responsabilidad obliga al productor, al proveedor o al comerciante a responder concurrente e independientemente de la existencia de culpa, si el consumidor resulta perjudicado por razón del bien o el servicio, de informaciones inadecuadas o insuficientes sobre ellos o de su utilización y riesgos. Bajo este esquema, s ólo se libera quien demuestre que ha sido ajeno al daño. El canon mencionado extiende a los representantes legales de los establecimientos mercantiles o, en su caso, los encargados del negocio como responsables por los actos o los hechos propios o por los de sus dependientes o auxiliares. Bajo este esquema de responsabilidad objetiva por el riesgo creado con el ejercicio de la actividad, salvo que sea demostrada la ajenidad al daño, existe la obligación de responder. En los autos, toda la prueba material que ha sido aportada, permite concluir, que el responsable del incendio, que causó los daños que se reclaman en esta sede jurisdiccional, es la sociedad accionada.
En ese sentido, el Informe Técnico EE: 50885-2016, del 9 de setiembre del 2016, del Programa de Investigaciones de Incendios del Benemérito Cuerpo de Bomberos de Costa Rica, de la Unidad de Prevención e Investigación de Incendios, elaborado por los investigadores Henry Morales Navarro e Ingrid Hutt Pacheco, en relación con la emergencia por fuego en medios de transporte terrestre-vehículo de carga pesada, en Dirección13940, , contiguo a la Universidad de Costa Rica, fue muy claro en indicar que la fuente de ignición fue con motivo del "Calor generado por la deflagración producto de un derrame de combustible, al ceder las gazas de la manguera para trasiego en la boca de una motobomba para agua." Por otro lado, sobre la causa del incendio, determinó que se produjo "Desde un camión cisterna con 7000 galones de diésel, se encontraban trasegando el combustible a los tanques de una embarcación, utilizando una motobomba para agua.
La manguera cedió derramando el combustible sobre la bomba provocando una deflagración." Por otra parte, el informe INSPN-02279-2016 del 11 de noviembre del 2016, mediante el cual el Instituto Nacional de Seguros declinó el pago de la póliza, al considerar que "las acciones u omisiones del Asegurado, sus empleados o personas actuando en su representación o a quienes se les haya encargado la custodia de los valores, que a criterio del instituto produzcan o agraven las pé rdidas" Lo anterior al considerar que la fuente de ignición fue por el "Calor generado por la deflagración producto de un derrame de combustible, al ceder las gazas de la manguera para trasiego en la boca de una motobomba para agua." De igual modo, consider ó que la causa del incendio, fue "Desde un camión cisterna con 7000 galones de diésel, se encontraban trasegando el combustible a los tanques de una embarcación, utilizando una motobomba para agua.
La manguera cedió derramando el combustible sobre la bomba provocando una deflagración" Finalmente, consideró lo siguiente: "como se puede observar, en ambas descripciones se cuenta con un común denominador que fue utilizar una motobomba para agua, la cual es un equipo inadecuado para la descarga de combustible por cuanto no fue diseñada para esta labor específica, generando la agravación del riesgo por parte del representante de nuestro asegurado (conductor del cami ón) y por consiguiente, desencadenando en un incendio." (lo resaltado no es del original). Para el Tribunal, con fundamento en la prueba material que obra en los autos, se encuentra acreditada la conducta desplegada por la sociedad demandada, la cual fue negligente e imprudente, conforme lo indicó el Instituto Nacional de Seguros, para declinar el pago de la póliza, al momento en el que el encargado de manipular la bomba in situ para trasegar el combustible produjo el incendio.
Lo anterior, se ve reforzado por lo que se desprende del Informe Técnico del Cuerpo de Bomberos, dado que permite arribar a la misma conclusión. A la conducta desplegada por el encargado de transportar y hacer la descarga del combustible es posible imputar negligencia e imprudencia, al utilizar una motobomba que no era apta, lo que produjo el incendio. Bajo el esquema de responsabilidad expuesto, en la especie, basta el riesgo de la actividad para imputar responsabilidad si se demuestra un daño. Resulta imposible concebir la ajenidad al daño, al haber existido incluso negligencia e imprudencia en el manejo de la motobomba que causó el incendio. En este punto, resulta relevante mencionar, que la sociedad accionada adujo en su defensa, que no había culpa de su parte y, que en todo caso, solamente un Juez Penal era el único que podía determinarla. Dicha afirmación resulta contraria a la separación competencial, que existe en los distintos sistemas de responsabilidad objetiva.
Como ya se indicó, bajo el esquema de responsabilidad en el que se enmarca el caso, derivado del numeral 35 de la Ley de Promoción de la Competencia y Defensa Efectiva del Consumidor, no se hace necesario que exista un pronunciamiento en sede penal, dado que el Juez competente, como es en este caso, el de la Jurisdicción Contenciosa, puede determinarla, al llevar a cabo el análisis probatorio en relación con los elementos del esquema que lo componen. Aunado a lo anterior, como se indicó, el "onus probandi ", o carga de la prueba de la ajenidad al daño le corresponde a la sociedad demandada, que no ha aportado prueba material que contrarreste la que ha tenido a la vista el Tribunal, de la que se desprende la culpa y negligencia en la actuación desplegada por el encargado de suministrar el combustible del camión cisterna a las embarcaciones. Sin perjuicio de lo anterior, y este es el punto medular del proceso que se resuelve, pues se trata de un civil de hacienda, resulta de mucha relevancia determinar, si los daños que reclaman el actor y la actora son los que produjo el incendio en cuestión.
VI.Sobre los extremos indemnizatorios reclamados. En la audiencia preliminar, los accionantes desistieron de su demanda en contra del Instituto Nacional de Seguros, por lo que dicha entidad dejó de ser parte procesal a partir de ese momento. Lo anterior resulta relevante, pues de forma automática, la pretensión subsidiaria dejó de tener vigencia, pues se pretendía que dicha institución hiciera efectiva la póliza de Transporte Interior de Combustibles número 01 09 CAC 000001301. Por esta razón el Tribunal no ingresará a analizarla. En lo que respecta a la pretensión principal, los accionantes solicitan los siguientes daños: a) daño emergente : "el pago de: C 182.046.786 (ciento ochenta y dos millones cuarenta y seis mil setecientos ochenta y seis colones) por concepto de daño emergente." b) lucro cesante: C 36.400.000 (treinta y seis millones cuatrocientos mil colones) por concepto de lucro cesante. 2.
Se ordene indexar los montos aprobados desde el 9 de setiembre del año 2016 hasta su efectivo pago. 3. Se condene a la demandada al pago de ambas costas de esta acció n." En la demanda, en el aparte titulado "Daño Indemnizable", los actores refieren que el daño emergente "lo constituyen los extremos señalados en el punto número 7 de la relación de hechos. Son todos los menoscabos que de manera inmediata surgieron con el incendio. En este acto se tasan en 182.046.786.00 (ciento ochenta y dos millones cuarenta y seis mil setecientos ochenta y seis colones)." Por su parte, en lo que respecta al lucro cesante, en ese mismo aparte de su demanda indican: "es el conjunto de ingresos que el damnificado por la conducta gravosa, pudo haber percibido pero finalmente no obtuvo por causas atribuibles al autor del factor de atribución. En la especie, los perjuicios consisten en la disminución de los ingresos padecida a raíz del siniestro.
Este extremo se tasa en 36.400.000.00 (treinta y seis millones cuatrocientos mil colones). " En el hecho s étimo de la demanda los actores indican que llevaron a cabo un reclamo ante el Instituto Nacional de Seguros y que es en el expediente que presentó el actor Nombre24446 en donde están más claros. En ese hecho desglosan los daños de la siguiente forma: Edificio 12.536.025; Bodega, respuestas, herramientas y equipo de trabajo 81.271.434; Barco Nombre113875 31.417.354; Lucro cesante Barco Nombre113875 del 9 al 22 de setiembre del 2016 18.200.000; Barco Nombre111382 53.225.688; Lucro cesante Barco Nombre111382 del 9 al 22 de setiembre del 2016 18.200.000; Factura de combustible que se perdió por el siniestro del accidente 3.596.285 para un total de 218.446.786. Señalan que en ese reclamo ante el Instituto Nacional de Seguros "el barco "Sultana" se encontraba, en el momento del siniestro, en la parte externa de la plancha del muelle, y por la misma premura de salvar el barco y por la falta de manera (sic...) el barco se encalló por lo que se dañó gravosamente la propela, se quebró el eje intermediario del barco y se rompieron los dientes del piñón principal de tracción.
Aunado a esto se quemaron totalmente 5 redes de pesca de camarón con sus aditamentos, el equipo electrónico de pesca, navegación y comunicación del barco, y los chalecos salvavidas que estaban guardados en la bodega se quemaron totalmente." Por su parte, en lo que respecta al barco Nombre113875 "sufrió daños en la parte electrónica de pesca y de navegación ya que la misma se quemó en su totalidad. Además, se carbonizaron 5 redes de pesca de camarón completa con sus aditamentos, y también los daños en todo el costado del babor y proa de la embarcación y los chalecos salvavidas que estaban guardados en la bodega se quemaron totalmente." Criterio del Tribunal: El daño en cualquier sistema de responsabilidad reviste características muy propias, pues para que este pueda ser reconocido e indemnizado, debe ser real, efectivo, evaluable e indemnizable. Por otra parte, en la perspectiva procesal, de frente a un contradictorio, como lo es la presente causa, la carga de la prueba para demostrar los daños y los perjuicios es de quien lo reclama.
Esto es lo que se conoce como el "onus probandi. " Lo anterior tiene sustento en principios y garantías como lo son el derecho de defensa y el debido proceso, pues, para imponer una carga económica a una parte dentro de un proceso, las personas juzgadoras deben contar con una total y absoluta certeza de la existencia de los daños. De ese modo, en la práctica, ese detrimento patrimonial debe ser palpable y visible. Conforme la prueba que el Tribunal ha tenido a la vista, no duda, del lamentable suceso ocurrido el día 9 de setiembre del 2016. En la documentación aportada, constan certificaciones, cercanas al incendio, que dan fe de la propiedad de las embarcaciones del caso que nos ocupa, de modo tal que denominada "Rosaolly" es propiedad de actor Nombre24446 y la llamada "Sultana" es propiedad de la actora Nombre113873 . Sin perjuicio de lo anterior y, pese a la gran cantidad de reportes e informes que fueron allegados a los autos, como prueba, como lo son el de la Estación de Guardacostas, oficio #75-2016-AJSNGP, el informe de Nombre1494 SAS-DV-UA-0022-2016, y; el informe del Área Rectora de Salud Nombre7958 Chacarita PC-ARS-PC-0583-2016, del Ministerio de Salud, se limitan a informar las acciones que llevaron a cabo en el ámbito de su competencia, en relación con el incendio, mas no describen con precisión los menoscabos que reclaman los accionantes.
En ese sentido, la constancia de incidente del Cuerpo de Bomberos, con el consecutivo 50885-2016, de una manera amplia hace referencia a los daños en la estructura del muelle, en el área donde existía construcción (segunda planta y en el taller de mantenimiento en la planta baja), no obstante, si bien menciona que la embarcación Nombre113875 P7655 sufrió daños, lo hace de una forma muy breve. Por otro lado, el Informe del Cuerpo de Bomberos, que realizaron los investigadores Henry Morales Navarro e Ingrid Hutt Pacheco, describe con mucho detalle la dinámica del incendio en la estructura del muelle. La única referencia a las embarcaciones, de manera genérica indica que las embarcaciones que se encontraban en el lugar fueron desplazadas a un sitio más seguro, evitando que sufrieran daños. Dicho informe indica lo siguiente, que resulta de interés: "Sobre el suelo del patio se observó gran cantidad de combustible (diésel) encharcado bajo el cisterna debido a la ruptura total del tanque, y un derrame a las aguas del estero en donde se encontraban varias embarcaciones pesqueras que corrí an riego de ser afectadas por las llamas.
Todas las embarcaciones lograron ser desplazadas a un sitio más seguro, evitando que sufrieran daños." En el orden que se sigue, en el expediente del reclamo ante el Instituto Nacional de Seguros, en el que constan las gestiones del actor y actora de este proceso, así como los de la co demandada Transportes Bellavista S.A., aparece un informe con fecha de 31 de octubre del 2016, suscrito por Miguel Wong Sánchez, mediante el cual hace mención a los daños reclamados ante el Instituto Nacional de Seguros, en los siguientes términos: "Los daños representan la reposición de las zonas afectadas dentro del inmueble producto de los efectos de la conflagración, siendo que los daños parciales, se considera que la reposición del inmueble puede reconstruirse sin efectos del edificio, a diferencia de la magnitud presentada del evento el cual fue explosivo y alta temperatura, fue controlado rá pidamente por varias unidades de bomberos que atendieron el incendio.
La reposición del equipo como el que se muestra en las imágenes debe ser consultado por los valuadores del Instituto especializados en la materia, como por los materiales de pesca afectados y las herramientas de taller de mantenimiento. Análisis y conclusiones Con base al levantamiento de información de los datos aportados por los clientes, se realiza una matriz de datos que a continuació n se analizan para que la institución tenga información complementaria sobre los hechos 1. Se enumeran de parte del cliente 32 documentos de facturas, proformas y cotizaciones, de las cuales corresponden en tres documentos anexos y un cd con la información resumida de lo que a criterio de los clientes se ha dañ ado como producto del accidente por conflagración. 2. De estas facturas, existen trabajos cancelados, cuyos montos no necesariamente corresponden a un valor real de reposición, por ejemplo se comenta de un trabajo de fibra de vidrio tan solo en la factura No 1, por un monto que no es representativo en los bienes muebles indicados.
Lo cual se puede apreciar en las imá genes de las embarcaciones y se puede comprobar en el sitio. 3. La factura No 2, que corresponde a la reparación de las plumas, como se puede ver en una de las im ágenes las mismas ni siquiera se han tocado, lo cual representa un valor de reparación significativo. 4. Las (sic...) factura proforma correspondiente a los transmisores y antenas (No3) no se indicaron donde estaban los componentes dañ ados y cuá l era su daño. 5. Situación similar con la factura No 4 de carruchas y chalecos salvavidas. 6. El trasmallo de 5 cm de perforación, se adjunta una cotización de un proveedor, donde se desconoce su origen y no se tiene certeza que todo el trasmallo se dañ o (sic...), por cuanto la factura considera la reposición total del mismo. 7. De forma similar la ecosonda, antena y transformador de la factura No 8, no se tiene conocimiento de la misma y el estado del deterioro presentado por el incendio. 8.
Los componentes del trasmallo, son para vestir el cuerpo completo del mismo por completo, esto supone que el trasmallo de la embarcació n estaba en el muelle y no en el barco en el momento del incendio, hasta este punto todos los componentes gastados y presupuestados corresponden a la embarcación de nombre Nombre113875. 9. El equipo del motor de la embarcación, supone que el mismo se encontraba fuera de la nave, para efectos que se daño en el muelle, lo cual no se demostró que las embarcaciones, alguna de ellas tuviese el motor instalado, siendo su costo elevado, como pudieron en este corto período reponer un motor nuevo o usado dentro de la embarcación. Mas que la factura proforma es para sustituir el motor completamente nuevo Factura No 10. 10. Se incluyen en la factura No 11, refrigerantes, vá lvulas y componentes. La pregunta es que componentes de refrigeración se dañaron. 11. Los computadores de escritorio, valorados en la factura No 12, además de escritorios cuenta con una segunda proforma que más adelante se detallará. 12.
El equipo de taller cotizado no se puede comprobar que se ha daño (sic...) y solamente refleja una lista de equipo nuevo, de hecho dentro de los artí culos cotizados se encuentra un compresor de 10 galones. Que más adelante nos referiremos. 13. Las mangueras PVC es una factura de un combustible ya ejecutado. En t érminos generales los artículos que ya han adquirido o pagado son primordiales para el funcionamiento del predio, no obstante algunas facturas como la No 1 no tienen el suficiente sustento de reposició n. 14. Limpieza de los escombros, corresponde a la factura No 15. Compresores, nuevamente se ha detallado previamente, se vuelven a facturar al menos no de los compresores de 10 Galones, en este caso se busca compresores de mejor calidad al que realmente se dañ o (sic...), el cual se puede apreciar en una de las imágenes. 16. La factura de cotización de la línea No 17, se vuelven a cotizar mobiliario de oficina, cuando ya se había incluido en la línea No 11. 17.
La línea No 18 corresponde a la carga de gases con ox ígeno, acetileno y otros gases no se visualizaron botellas de estos gases en el sitio que pudiesen justifica (sic...) su adquisició n. Todos estos elementos corresponden a reposición de equipo y materiales para el uso del taller y las oficinas del inmueble afectado. 18. La reconstrucci ón de la propela en la línea No 19, debe considerarse, por cuanto si la embarcación se encontraba en el agua, cómo se daño (sic...) dicho elemento, el eje y el disco del rotor. A partir de este punto los componentes corresponden a la embarcació n Nombre111382. 19. En la línea 20, se incluyen nuevamente materiales de reparación de fibra de vidrio, ya cancelados. 20. En la factura No 21 corresponde el pago por rectificaci ón del eje, dentro de las fotografías aportadas se puede apreciar el eje, el cual aún no esta reparado, lo cual crea duda. 21. En la línea 225 comenta el pago por derecho de alquiler del dique seco, eventualmente corresponde a la reparació n de la propela, sin embargo se ha cuestionado porque se daños (sic...) toda esta sección si estaba sumergida. 22.
En la factura No 23 se refleja la factura de Nombre1494 por efecto de lo adquirido el día del evento. 23. Se presenta la reparación del sistema eléctrico en la línea No 24. 24. En la línea No 25, se presenta la reparación del arrancador, estas facturas como la de la línea No 2 se hacen sin facturas timbradas. 25. La factura No 26 corresponde al varado y botado de la embarcació n a efectos de las reparaciones cursadas. 26. En la línea No 27 se comenta del piñón del eje de transmisión, el cual se ha cotizado, sin embargo en una de las imágenes aportadas, ya se cuenta con el pi ñón. En otras palabras, colocarán un piñón extra, y bien su (sic...) el barco ya estuvo en el Dique, qué le cambiaron. 27. En la línea 28 de (sic...) a presentar las facturas de los transmisores digitales y las antenas que coinciden con la lí nea de la factura 3. En otras palabras doble daño y sin equipo que valorar. 28.
En la factura No 29, similarmente se vuelve a presentar la factura de cotización que coincide con la línea No 8 Duplicando para cada embarcación los equipos más caros. 29. En la línea No 30 se incluyen los pesos del trasmallo, nuevamente se deben de considerar los elementos que no está n a la vista de los materiales fotografiados en el sitio. 30. Nuevamente en la línea No 31 se presenta el material para montar un trasmallo, en este caso para la embarcación Sultana. Costo similar al valor dado por la otra embarcación, sin prueba suficientes, o bien determinar si en la actualidad las embarcaciones cuentan con trasmallo de ser así , aparentemente desean tener un par de juegos de trasmallos para operaciones futuras. 31. Finalmente se incluye una cotización de una barra de bronce que es el eje del barco que ya estuvo en el dique seco y que aparentemente se pago por las reparaciones del eje y demá s componentes, entonces para que se desea presentar una nueva factura de un artículo reparado.
Todo esto demuestra la dualidad de artículos, sobre precios y artículos que se han cotizado, pare que eventualmente al ingresar el dinero nunca se comprarán sus reposiciones, dado que ya han realizado algunas reparaciones para poner en funcionalidad las embarcaciones a un costo mí nimo pretendiendo obtener del INS una indemnización de daños no necesariamente existente." Este documento antes citado resulta de relevancia para resolver la presente causa, en el análisis probatorio que lleva a cabo, aplicando las reglas de la sana crítica racional, dado que, como se desprende de la misma demanda, la prueba que aportaron los demandantes, a efecto de detallar los daños ocasionados en los bienes, consiste no sólo en los escritos de reclamo ante el Instituto Nacional de Seguros, sino las facturas de gastos, las proformas que fueron analizadas por dicha entidad y que produjeron muchas dudas a ingeniero Wong Sánchez en su informe y que a su vez le generan dudas al Tribunal, pues no existe un orden ni claridad a qué daños se refiere.
Sin perjuicio de esta situación, para el Órgano Colegiado, existe prueba material que apunta a la existencia de daños producidos por el incendio del día 9 de setiembre del 2016 a la embarcación Rosaolly, pues se hace mención en el informe del Cuerpo de Bomberos y en las fotografías del informe del ingeniero Wong Sánchez, en las cuales es posible apreciar que fue objeto de las llamas. No así, en lo que respecta a los daños ocurridos a la embarcación de nombre Nombre111382. Incluso, el informe del Instituto Nacional de Seguros pone en duda la existencia de estos daños. En lo que respecta a los daños materiales ocurridos en la oficina y bodegas, tampoco se encuentran detallados. Por otro lado, si bien se reclama los daños ocurridos en el edificio en las bodegas, herramientas y equipos de trabajo, no está desglosado con claridad en qué consiste cada uno de estos daños y quién era su propietario.
Por lo expuesto, de conformidad con el canon 122 del Código Procesal Contencioso Administrativo, en lo que interesa, que dispone lo siguiente: "ART ÍCULO 122.- (...) m) Condenar al pago de los daños y perjuicios, en los siguientes términos: i) Pronunciamiento sobre su existencia y cuantía, siempre que consten probados en autos al dictarse la sentencia. ii) Pronunciamiento en abstracto, cuando conste su existencia, pero no su cuantí a. iii) Pronunciamiento en abstracto, cuando no conste su existencia y cuantía, siempre que sean consecuencia de la conducta administrativa o relación jurídico-administrativa objeto de la demanda. " se resuelve: a) Sobre los daños y perjuicios a la embarcación Nombre113875 : Con base en el canon 122 inciso m), sub inciso i), se condena a la sociedad Transportes Bellavista S.A. a cancelar únicamente los daños materiales producidos por el incendio del 9 de setiembre del 2016, a la embarcación Rosaolly, que el actor logre demostrar, en fase de ejecución de sentencia, con la prueba material correspondiente.
De igual modo, con base en esa misma norma, se condena a la sociedad Transportes Bellavista S.A. a cancelar el lucro cesante, que logre demostrar el actor con la prueba material correspondiente, producto del incendio del 9 de setiembre del 2016. Se deja para la ejecución de sentencia la liquidación de dichas sumas. b) Sobre los daños y perjuicios a la embarcación Nombre111382: Según narra la actora, en su reclamo ante el Instituto Nacional de Seguros, el cual trae a esta misma sede, el barco "Sultana" se encontraba, en el momento del siniestro, en la parte externa de la plancha del muelle, y por la misma premura de salvar el barco y por la falta de manera el barco se encalló por lo que se dañó gravosamente la propela, se quebró el eje intermediario del barco y se rompieron los dientes del piñón principal de tracción. Aunado a esto se quemaron totalmente 5 redes de pesca de camarón con sus aditamentos, el equipo electrónico de pesca, navegación y comunicación del barco, y los chalecos salvavidas que estaban guardados en la bodega se quemaron totalmente.
Al respecto, el informe del Ingeniero Miguel Wong indicó que debía considerarse la reconstrucción de la propela, pues no estaba claro cómo se dañó, si la embarcación se encontraba dentro del agua. Dicho informe a partir del punto 19, se refiere a los daños reclamados sobre dicha embarcación y las dudas que le generaban los menoscabos reclamados. Para demostrar los daños y perjuicios la única prueba aportada, es la de los reclamos ante el Instituto Nacional de Seguros. No existe otra prueba que los acredite. Dada esta situación, el Tribunal no cuenta con prueba material suficiente que demuestre la existencia de los daños y perjuicios reclamados, motivo por el cual debe ser rechazada la pretensión del resarcimiento por daño emergente y lucro cesante de la actora Nombre113873 . c) Sobre los daños reclamados en el edificio, bodega, repuestos, herramientas y equipos de trabajo: Si bien estos da ños se mencionan en el hecho número siete y se les asigna un suma a cada uno, en los siguiente términos: Edificio 12.536.025; Bodega, repuestos, herramientas y equipo de trabajo, no está claro en qué consisten o cómo se desglosan.
Por otro lado, tampoco existe claridad sobre quién es el dueño de estos bienes y enseres y, si es el accionante o la actora. Como se mencionó, supra, de los informes del Cuerpo de Bomberos, Ministerio de Salud, Guardacostas y Recope, se acredita la existencia del incendio y el Tribunal puede inferir en términos generales que pudo existir algún tipo de afectación en bienes ubicados en los sitios cercanos al muelle, que pudieron haber sido propiedad de los accionantes, sin embargo, no se tiene claridad ni precisión ni un desglose de éstos, tampoco quién era su propietario, así como su vínculo individual con el móvil del siniestro. Por esta razón, resulta imposible determinarlos en esta fase de conocimiento para que puedan ser liquidados sus montos en la fase de ejecución.
VII.Sobre las excepciones. 1) Defensas interpuestas por el Estado: a) defensa de falta de legitimación ad causam pasiva : Dicha defensa debe ser rechazada en virtud de que existe una relación jurídica material entre los accionantes y el Estado, en virtud de que este último otorgó una concesión de servicio público a una empresa para distribución de combustible. Con motivo de esta actividad se produjeron daños y perjuicios a raíz de un incendio. De ese modo, los accionantes cuentan con la suficiente legitimación para demandar al Estado. Por otra parte, el Estado se encuentra legitimado para ser la parte pasiva de esta relación jurídico procesal y ser el demandado. b) defensa de falta de derecho: Esta defensa debe ser acogida, de acuerdo con lo expuesto en el considerando anterior, con el número V de la presente sentencia. 2) Defensas interpuestas por Transportes Bellavista S.A.: falta de legitimación activa y pasiva: Debe ser rechazada en virtud de que existe una relación jurídica procesal material, que vincula a los actores con la empresa accionada, en virtud de los daños que sufrieron, con motivo del incendio que ocasionó el camión cisterna que transportaba y descargaba combustible. Lo anterior permite establecer un vínculo procesal, en el que los accionantes cuentan con la legitimación de demandar y la sociedad demandada ser el sujeto pasivo.
VII.Sobre las costas. Conforme lo dispone el canon 193 del Código Procesal Contencioso Administrativo, las costas corren a cargo del vencido, salvo que concurran las excepciones dispuestas en la misma norma. Dado que en el caso bajo examen, figuran como accionantes y demandados dos partes, se resolverá por separado para mayor claridad y no crear confusión. a ) Costas del Estado : Si bien para el caso de la demanda contra el Estado, el actor y la actora son la parte vencida, al haber sido acogida la defensa de falta de derecho, considera el Tribunal, que tenían motivo suficiente para litigar, en virtud de que el incendio al que hicieron referencia fue un hecho que se demostró y su litigio en contra del Estado no puede ser considerado de mala fe. Por lo que se resuelve sin especial condenatoria en costas. b) Costas de Transportes Bellavista S.A.: Para el caso concreto, considera el Tribunal, que la sociedad accionada debe cancelarle las costas ú nicamente al actor Nombre24446 , pues es a é solamente, quien se le reconocieron algunos de los daños reclamados.
Lo contrario sucede con la actora Nombre113873 , dado que no logró acreditar ninguno de los daños y perjuicios, Sin perjuicio de lo anterior, se considera, tenía motivo suficiente para litigar, en virtud de que el incendio al que hicieron referencia fue un hecho que se demostró y su litigio en contra del la sociedad accionada, no puede ser considerado de mala fe. Por lo que se resuelve sin especial condenatoria en costas, de modo tal que la actora Nombre113873 no debe sufragar costas a la sociedad demandada.
