PROCEDURAL BACKGROUND (RESULTANDO):
Drafted by Judge Castro García; and, FINDINGS OF LAW (CONSIDERANDOS) I- Proven facts. The proven facts in the appealed judgment are affirmed because they are supported by evidence appearing in the record.
II- Unproven facts. The unproven facts in the appealed judgment are adopted because evidence exists establishing the contrary of what was stated therein. The following fact of this nature is established at this stage: 6) The damages claimed by [[Nombre6] ], allegedly caused by the inability to dispose of the real property or enter into contracts concerning it. There is no evidence in this regard.
III- The executor (albacea) of the Estate (Sucesión) of [[Nombre1] ] appeals, within the statutory period, first-instance judgment N.225-2019 issued at 14:47 on 16 de agosto del 2019 (images 12 to 35 and 43 to 55 of the digital case file in PDF format). The substantive basis for his disagreement is the improper grounds and reasoning of the judgment. Every judgment must set forth the substantive content of the evidence on which it is based and its conclusions. That analysis must encompass the factual and legal aspects. He refers to decision number 2660-94 of the Constitutional Chamber of the Supreme Court of Justice, issued at 15:36 hrs on 07 de junio de 1994. He argues that the grounds stated in the judgment are incomplete and contradictory because the evidence favorable to him was not considered. This violated his due process rights. He notes that the ruling deems it proven that possessory title proceeding (Información Posesoria) expediente number EXPN1 was conducted by [[Nombre3] ] before the Agrarian Court of Santa Cruz.
It concluded with a decision issued at ten hours two minutes on dieciséis de junio del dos mil cinco, ordering that the property described in survey plan [Valor 002] be registered in the name of the assignee, [[Nombre4] ]. He disputes this, asserting that the property belonged to the plaintiff. However, the petitioner in that proceeding commenced it through irregular acts. The proceeding failed to satisfy statutory requirements, and the procedural violations he has identified occurred, without his objections being addressed. The dispute can be resolved only by nullifying the possessory title proceeding that gave rise to this litigation. For that reason, this action was filed seeking nullification of the possessory title proceeding, recovery of the property (reivindicación), and acknowledgment and payment of damages. Those claims were not analyzed in the judgment under appeal. He states that the judgment is inconsistent and that essential evidence for ascertaining the real and objective truth of the facts was not admitted.
This did not occur. As a first category of grounds for appeal, he alleges the following formal defects in the possessory title proceeding whose nullification is sought: a) Failure to notify the adjoining landowner (colindante), [[Nombre9] ] S.A., so that it could provide its consent. He contends that this point was unclear in the judgment and that, although the record contains a certificate of legal representation for the adjoining entity, its authorized representative did not appear in that capacity but rather in his personal capacity. He considers that, under those circumstances, it cannot be inferred that he appeared as the representative of the adjoining company. That capacity must be expressly stated, as required by the statutory requirement that was not satisfied. b) Land-use study (estudio de uso de suelos). It was neither submitted nor was a judicial inspection (reconocimiento judicial) conducted to verify the purported possession of those claimed to be possessors and the proper use of the land.
Although this is mentioned in the judgment in the ordinary proceeding, it is addressed superficially and the deficiency is accepted. Even so, the possessory title proceeding is upheld, which could constitute malfeasance in office (prevaricato). c) With respect to the testimonial evidence and the judicial inspection, he questions whether the witnesses were taken to the disputed site. The record drawn up stated: “Present at the location in question...,” without identifying the site of the legal act (folios 36, 37 and 38 of the possessory title proceeding case file); it does not establish which property it was. Therefore, neither the property visited nor its location was established. He states that further doubt arises because the registered survey plan prepared by the defendants depicts a stream running through the middle, which was not mentioned during the inspection even though it was visible.
He questions whether a nearby parcel that does belong to the defendant was visited instead. He explains that, at folios 71 to 73 of the case file, there is an inconsistency among the purported judicial inspection, the plan submitted in the possessory title proceeding, and the judgment issued in that proceeding with respect to the water sources, springs (manantiales), and other waters depicted on the plan. Neither the judgment nor the inspection record describes those waters or the protection that must be afforded to them, particularly in violation of Ley Forestal. This relates to the failure to forward the matter to the Office of the Attorney General of the Republic when that entity requested it. A series of requested documents was withheld from that office and never provided, and he does not accept the current assertion that this was an inadvertent error, which downplays its significance.
That judicial error deprived the Attorney General’s Office of a proper defense, under penalty of nullity. d) Failure to forward copies of the witness statements and the inspection record to the Office of the Attorney General of the Republic, as requested at folio 77 of that proceeding. He explains that, at folio 78 of the cited case file, an order issued at 15:31 on 13 de mayo del 2005 stated that copies only of the witness statements, and not of the judicial inspection record, were being forwarded, noting that the latter had already been sent according to folio 56. But that folio is a certification dated 26 de enero del 2005. It contains an inconsistency, because it orders that the prior decision be sent to the Attorney General’s Office, while at folio 53 the prior decision is the one appearing at folio 55, issued at 13:02 hrs on 26 de enero del 2005. That decision approved the assignment made within the possessory title proceeding, deemed the certification from the Public Registry to have been submitted, and granted the Attorney General’s Office a hearing for a period of three days. e) Failure to satisfy the requirements for the initial pleading in the possessory title proceeding.
He explains that, at folios 11 and 12 thereof, requirements that should have been satisfied before the proceeding could be admitted and approved were missing. It was not stated whether there were co-owners (condueños), children from another marriage, children born outside marriage or children with disabilities, or interested third parties. This was relevant because the defendant had been married. Neither a certified copy of the divorce judgment nor the judgment in the probate proceeding relating to his former wife was requested, despite the issue of marital property (bienes gananciales). No livestock brand was requested. Nor was the property located, identified, or described, and no evidence was provided of the donation allegedly made in his favor, as he asserted at the appropriate time. He also did not provide the information by sworn declaration (declaración jurada). All of this precluded the proceeding from being admitted. f) Proof of ten years of possession before the property was declared a national reserve.
He alleges that it was not shown that ten years of possession had elapsed before the land became a national reserve. Nor was this requested by the Court. g) Co-ownership and the nature of the disputed property as marital property. He contends that the testimonial evidence establishes that possession of the land was exercised by both him and the defendant, without specifying in what capacity, and therefore he should at least have been regarded as a co-owner. Furthermore, the initial pleading did not state that there were no other owners. He also notes that the defendant stated among his personal particulars that he was divorced. Because he had been married and, according to his own account, possession had been exercised for more than 70 years, the property was acquired during the marriage. He adds that the donation was not proven and that the property would therefore constitute marital property to which his wife was entitled.
None of this was assessed. The following substantive grounds for appeal against the judgment are asserted: a) Historical possession of the land and the capacity in which the defendant was present on the property. The appeal states that it has repeatedly been asserted that the disputed property is unregistered real property that belonged to the father of [[Nombre1] ]. It is located in [...] Guanacaste. Its area is ninety-three hectares, nine thousand three hundred square meters and seventy-five square decimeters. It is bounded by [...]. It is agricultural in nature, with trees native to the area, and is dedicated to conservation. The plaintiff had an interest in environmental preservation. He recounts that the plaintiff’s father acquired it by filing a claim (denuncio) with the relevant authorities in the area. He moved to San José with his family, leaving his property in the care of his brother, [[Nombre3] ], without relinquishing the possession that he had always maintained.
All the residents of [...] in Guanacaste and the surrounding areas are aware of this. Nevertheless, the defendant, [[Nombre3] ], went before the courts and, through the possessory title proceeding, succeeded in obtaining title in his own name to land that did not belong to him. It was registered on 27 de setiembre del 2006. He argues that, subsequently, by deed number six executed at 14:00 on 10 de agosto del 2006, [[Nombre5] ] Sociedad Anónima sold to [[Nombre6] ] the property in Guanacaste registered under matrícula [[Placa3] ]. That property is the one belonging to the plaintiff. b) Challenges to the content of the testimonial evidence given by the defendant’s witnesses. He alleges that the plaintiff’s continuous possession and lawful ownership of the property, as well as the fact that he lived with his family in [...], were proven despite the opposing party’s attempt to refute that fact.
School and birth certificates for the plaintiff’s eldest children were submitted. It was also shown that the defendant was always merely a caretaker. Furthermore, it was proven that the plaintiff built the house located on the property and regularly visited the property. Whether the appellant stayed on the parcel is immaterial. This was unnecessary because he had a place to stay in [...]. The small house on the disputed estate was occupied by the defendant and his family in his capacity as caretaker of the property. He questions the fact that the witnesses called by the defendant do not recognize him or know who he is, even though it was established that the plaintiff lived in [...], where his children were born and raised. He adds that the property was not suited for livestock farming and was therefore never used for that activity. Accordingly, the witnesses’ statements that the property was rented for that purpose are not credible.
He believes they lied. He alleges that they were untruthful when they stated that there were two residential structures on the property, when the judicial inspection record states that there was only one, in which the defendant lived. c) Costs and damages. It is challenged that the Estate of [[Nombre1] ] was ordered to pay costs as a bad-faith litigant. The judgment also awarded the alleged damages in the abstract, to be quantified and fixed during enforcement of the judgment.
IV- In the appealed judgment, the claim originally filed by [[Nombre1] ], now his Estate, against [[Nombre3] ], now his Estate, [[Nombre4] ], [[Nombre5] ] S.A., and [[Nombre6] ] was dismissed. The defenses of lack of a legal right, lack of standing to sue, and lack of standing to be sued were upheld. The defenses of statute of limitations and sine actione agit raised by the last three defendants were rejected. The counterclaim filed by [[Nombre6] ] against the Estate of [[Nombre1] ] was upheld, and it was declared that: a) said company is the sole owner of the property registered in Guanacaste under registration number [[Placa4] ], depicted on cadastral plan (plano catastrado) [Valor 002], which coincides with the registered area; b) plaintiff [[Nombre1] ] had never possessed the property at issue depicted on cadastral plan [Valor 002] continuously, peacefully, quietly, in good faith, under color of title (justo título), and for the required ten-year period; c) the claim for damages was upheld without specification of amount, which is to be assessed and determined during enforcement of the judgment; and d) defendant [[Nombre1] ] was declared to have no right in the property, and plaintiff was ordered to pay all legal costs.
As to the claims concerning noncompliance with the formal requirements of the possessory title proceeding (proceso de información posesoria), the appeal must be denied for the reasons set forth below. Regarding the absence of the land-use study (estudio de uso de suelos). A review of the copies of the possessory title proceeding conducted under number EXPN2 by [[Nombre3] ] shows that no such study appears in the record or was requested, as the claimant alleges. Notwithstanding the foregoing, this Chamber must note that this omission can be explained by the period in which the non-contentious proceeding whose annulment is sought was initiated. It should be noted that this statutory requirement is based on the Ley de Uso Mantenimiento y Conservación de Suelo Ley 7779 of 30 de abril de 1998 (hereinafter, LUMCS). Its regulations were issued through Decreto 29375-MAG (hereinafter, Reglamento a la LUMCS), Nº Gaceta: 57 del: 21/03/2001.
The purpose of Ley 7779 is the protection and conservation of soils through integrated and sustainable management with other natural resources (artículo 1 Ibídem). The land-use suitability certificate (certificado de uso conforme) under the LUMCS is governed by articulo 47. Ordinal 58 of the Reglamento a la LUMCS establishes that an applicant seeking a registrable title through a possessory title proceeding must demonstrate, by means of a soil study (estudio de suelos), that possession has been exercised in compliance with the land’s suitable use for the activity conducted, in accordance with the applicable methodology and using the best management practices available under existing technology. Artículo 59 Ibidem provides that the study shall be conducted by the Certificador de Uso Conforme del Suelo, who must determine and certify, based on a field inspection, whether possession and the activities conducted on the property have been exercised in accordance with the suitable use of the soil, based on its classification, and whether soil and water management and conservation practices are implemented on the property in accordance with the approved methodology.
In turn, Decreto 30636-MAG, dated 17/7/2002, created the Registro Oficial de Certificadores de Uso Conforme del Suelo to allow “the participation of independent professionals of recognized competence in the field of soil science (Edafología), in fulfillment of the purposes established by Ley N° 7779.” The Ministerio de Agricultura was thus assigned the function of maintaining a Registry of private natural or legal persons engaged in the relevant fields, in order to accredit and authorize the respective professionals as Certificadores de Uso Conforme del Suelo. Pursuant to those provisions, Ley Nº 8149 of 5 de noviembre del 2001 created the Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA) as a body with maximum administrative autonomy within MAG. Among its functions is the creation of the Registro Oficial de Certificadores de Uso Conforme del Suelo, headquartered in the Departamento de Suelos y Evaluación de Tierras de la Dirección de Investigaciones Agropecuarias del Ministerio de Agricultura y Ganadería (MAG-INTA).
The transitional provisions of the decree creating this registry, Nº 30636-MAG Crea el Registro Oficial de Certificadores de Uso Conforme del Suelo, stated: “Transitorio I.—Until the Colegio de Ingenieros Agrónomos de Costa Rica and MAG or its successor entity begin the training process and the Comité Evaluador is established, members of the Colegio de Ingenieros Agrónomos de Costa Rica who provide proof of their degrees and practical experience, as specified in inciso b) del artículo 3º del presente Decreto Ejecutivo, may register as Certificadores de Uso Conforme del Suelo in the Registry maintained for that purpose by the Departamento de Suelos y Evaluación de Tierras del MAG-INTA. The Colegio de Ingenieros Agrónomos de Costa Rica, in coordination with MAG-INTA, shall open the application period for persons interested in taking the corresponding Course. Transitorio II.—The Departamento de Suelos y Evaluación de Tierras del MAG-INTA and the Colegio de Ingenieros Agrónomos de Costa Rica shall prepare the content of the Course for Certificadores de Uso Conforme del Suelo, the standards for evaluating that course, and the minimum requirements governing the format of the reports prepared by the Certificadores de Uso Conforme del Suelo (report format).” Thus, Ley 8149/2001, which created INTA, transferred to it powers assigned to MAG under Ley 7779, pursuant to ordinal 20.
The regulations to the Ley del INTA were issued through decreto 31857/2004 and, insofar as relevant, assigned to the Dirección de Investigación y Desarrollo Tecnológico (Departamento de Servicios) the function of providing land-use suitability certification services, specific studies, and any other services entrusted to it by its head, among others (art. 35, apte 4, inc c). It was at that point that compliance became possible with the statutory function established in artículo 19 de Ley 7779, arts. 19 y 2 de Ley 8149, concerning the performance of investigative work involving soil studies and land-use suitability certifications through a scientific process (sampling, evaluation, and determination of land capability) for the purpose of issuing a certified opinion at the user’s request.” Decreto published in La Gaceta número 146 del 27/07/2004. Accordingly, on the date when the possessory title proceeding began, matters that INTA was required to develop in order to establish the legally created registry of land-use certifiers remained pending; during that year, the institutional structure and logistics established by law were only beginning to be created, as the institution was still undergoing consolidation.
It is therefore unsurprising that neither the judge nor the government counsel required compliance in that possessory title proceeding with the statutory soil-study requirement under the Reglamento a la LUMCS. The asserted ground of error is therefore rejected.
V- Regarding the failure to send the witness statements and the judicial inspection record (acta de reconocimiento judicial) to the Procuraduría General de la República. From its review of the copies of the record of possessory information proceedings (información posesoria) number 04 00049-391-AG (folios 129 to 240, Volume I), this Court observes that, through a filing dated 27 de mayo del 2005 by the State Attorney who had entered an appearance, receipt was acknowledged of the witness statements given in that matter (folio 218, physical Volume I). Therefore, those documents were indeed sent to that office. Regarding the judicial inspection record, in that same filing the procuratorial agency requested that it be forwarded, a request that was denied in the decision on the merits of the titling proceeding issued at 10:02 hours on 16 de junio del año 2005 (folios 221 to 224, Volume I). This was not challenged by the State’s representative at the appropriate procedural time or when it was granted a hearing in these ordinary proceedings.
Accordingly, a matter not challenged by the State is not deemed grounds for annulling the possessory information proceedings as requested. That entity had standing (legitimación) and an interest in challenging that omission (article 24 of the Ley Orgánica de la Procuraduría General de la República). The claim concerning the failure to serve notice on the adjoining landowner (colindante), [[Nombre9] ] S.A., is rejected. The copies of the record of the proceeding whose annulment is sought show that, at folio 134, the legal-person status certification (personería jurídica) of [[Nombre9] ]. was attached; its legal representative is [Nombre10], who, through a filing signed by him, entered an appearance as an adjoining landowner and stated that there was no objection whatsoever. Although the filing does not identify [Nombre10] as the representative of the company adjoining the land for which registration was sought, the fact remains that he acted as a general attorney-in-fact with full powers and without monetary limit (apoderado generalísimo sin límite de suma) and had knowledge of the proceeding.
The company was therefore afforded the opportunity to oppose the proceeding and did not do so. On the contrary, it expressly stated its agreement (folios 134 and 137, Volume I). The adjoining-landowner notice requirement under the Ley de Informaciones Posesorias was thus satisfied. With respect to the judicial inspection, the appellant expands upon two issues raised: the discrepancy between the cadastral survey plan (plano catastrado) used in the possessory information proceedings, what was described in the record, and what was stated in the judgment. This concerns the stream located on the land. Those arguments are unavailing, because the plan submitted in the proceeding whose annulment is sought is number [Valor 002] (folio 2, Volume I), which depicts the property at issue in that proceeding as being crossed from east to west by the La Escuela stream. The record of the judicial inspection conducted on 3 de noviembre del 2004 states in this regard (folios 169 to 170): “There is a stream, which we crossed while touring the property, and its banks are well preserved.” In the judgment approving the proceeding, issued at 10:02 hours on 16 de junio del 2005 (folios 221 to 224), the first proven fact stated, insofar as relevant, that the land is crossed from east to west by the aforementioned body of water, and the operative portion (parte dispositiva) provided: “The area adjacent to Quebrada la Escuela indicated in article 33, subsection b), of Ley Forestal N 7575 constitutes a protected area (área de protección), and the removal, cutting, or elimination of trees is prohibited.
Likewise, the channel and waters of those streams are in the public domain (dominio público).” This Court therefore finds no such inconsistency. The appellant claims that there is doubt as to the place where the judge and witnesses were taken to give their statements and conduct the judicial inspection. Upon review, this Court finds no merit in that claim, because a ruling issued at 08:10 hours on 26 de agosto del 2004 scheduled the oral hearing (comparecencia oral) on the property. Folios 166 to 168 contain three witness statements, and folio 169 contains the judicial inspection record, whose heading indicates that the applicant for title (titulante), the judge, and counsel were present in Santa Rosa de Santa Cruz, and it describes what was observed on the land visited. This Chamber finds no evidence that the witnesses and the judge were directed to property other than that which was the subject of those possessory information proceedings.
The appellant submitted no evidence in that regard beyond his own assertion and questioning, despite bearing the burden of proof (carga probatoria) pursuant to section 317 of the repealed Código Procesal Civil, which applies supplementarily by virtue of section 26 of the Ley de Jurisdicción Agraria, transitory provision I.2 of Ley 9343, and transitory provision II of Ley 9242. The objections concerning deficiencies in the initial petition—namely, the failure to state that co-owners existed, the marital-property nature (naturaleza ganancial) of the property because the applicant for title had been married, and the failure to request a final and enforceable judgment (sentencia ejecutoria)—must be denied. Review of the initial petition shows that it was filed on 19 de marzo del 2004 (folios 11 to 12), describes the personal particulars of [[Nombre3] ], states that he is a resident of Santa Rosa de Santa Cruz de Guanacaste, and requests, pursuant to Ley 139 and section 479 of the Código Civil, that a registrable title be issued in his name for the property described therein, specifying the duration, manner, and conditions of possession, which he states lasted seventy years.
He stated that he was divorced, that the property had been transferred to him by his mother as a gift 70 years earlier, and that he had exercised peaceful, uninterrupted, and public possession as owner (a título de dueño), without any co-owners. Publication of the legally required notice (edicto de ley) was ordered so that interested parties could enter an appearance and assert their rights; that notice stated that there were no encumbrances (cargas) on the real property and that the proceeding was not intended to evade the procedures and consequences of probate proceedings (proceso sucesorio) (published on 21 de junio del 2004, according to the filing at folio 35). As to the failure to disclose the existence of children from another marriage, children born outside marriage, persons with disabilities, or interested third parties, or the marital-property nature of the asset to be titled, making such disclosures is not legally required because, pursuant to section 5 Ibídem, a notice is published to inform those and other persons of the existence of the proceeding so that anyone may enter an appearance and raise whatever arguments they deem necessary.
Nor is the request for annulment based on the failure to submit a livestock brand (marca de ganado) well-founded, because that requirement instead constitutes evidence of possession. Not all applicants for title carry out that productive activity on the land they seek to register. For that reason, article 1, subsection d), refers to a livestock brand only if the property is used for livestock farming. Regarding the alleged lack of a description of the land, the initial petition contains details of its location, boundaries, area, and nature in the first paragraph of the filing (folios 11 and 12). The argument that proof of the gift should have been submitted is rejected. Under section 1, fourth paragraph, submission of the instrument recording the transfer of the right in the applicant’s favor is required when the applicant intends to rely on possession exercised by the transferor in order to complete the ten-year period.
In this case, the applicant for title stated that he had personally exercised possession for seventy years. He was therefore not required to attach the instrument for the gift that he states his mother made to him, but was required to prove ten-year possession (posesión decenal) under legally sufficient conditions through three witnesses, pursuant to section 6 Ibídem. Regarding the contention that the information in the initial petition was not provided as a sworn statement (declaración jurada), this Court considers that the legal effect of those statements arises not from an express declaration but from the second paragraph of article 3 of that same law, which provides: “In all cases, the applicant for title’s assertions shall constitute a sworn statement, and any falsehood shall subject the applicant to the penalties for perjury, unless it constitutes a more serious offense, as determined by the criminal authority.” Accordingly, such a declaration is not among the requirements for the initial petition.
Its omission does not negate the effect that the cited legal provision imposes on the statements made in that filing. In this Court’s view, the objections raised on appeal concerning the initial petition do not constitute valid grounds for nullity (nulidad) of the possessory information proceedings. Moreover, no claims have been asserted by any persons, apart from the plaintiff in these proceedings, alleging that the property belonged to them because it was acquired during a marital relationship, that it should have been included in the inventory of probate proceedings, or that the statements in the initial petition were untrue and the applicant for title should be prosecuted for perjury. Those objections are denied. Regarding the failure to prove ten-year possession before the property was declared a national reserve (reserva nacional), this objection is raised because, pursuant to article 1, second paragraph, of the Ley de Informaciones posesorias, the period of possession that must be proven for unregistered real property is ten years.
Such possession must be exercised in accordance with the conditions set forth in article 856 of the Código Civil. It should be noted that national reserves are lands located within the boundaries of the Republic that are not registered as private property or as property of municipalities or autonomous institutions; lands not supported by ten-year possession; lands not designated by special laws for the establishment of agricultural colonies; and all lands that, while not privately owned, are not used for public services. The foregoing is pursuant to article 11 of the Ley de Tierras y Colonización, in conjunction with article 261 of the Código Civil. The Sala Primera de la Corte Suprema de Justicia has held: “All land not registered in the Registry in the name of private parties belongs to the State. This is the meaning of articles 276 and 486 of the Código Civil and article 11 of the Ley de Tierras y Colonización” (Judgment N° 243 of 1990, recital XVII).
Within the State policy governing distribution, access to land, and property rights, it is the State itself that issues rules enabling persons to obtain title to land that was not registered. These include the current Ley de Informaciones Posesorias, which establishes the legal procedure through which properties not subject to registry inscription may be titled in the names of persons who satisfy the requirements established by law. Accordingly, the person who obtained title to the property at issue was required to prove that the property sought to be registered was not already registered and that ten-year possession had been exercised before the application was filed, in addition to meeting all other legal requirements. The objection is therefore rejected insofar as it asserts that possession had to be established before the declaration of the national reserve.
VI- As a second category of claims, disagreement is expressed regarding the historical exercise of possession (posesión) of the land and the defendant’s presence on the property as caretaker. The appellant also challenges the substance of the testimony given by the defendant’s witnesses. In his appeal, the plaintiff asserts that his father acquired the property in question through a claim proceeding and transferred it to him. He left his brother, [[Nombre3] ], in charge of the property without relinquishing the possession that had always been exercised. He stated that this situation was publicly known in the community of [...] Guanacaste. However, his brother unlawfully registered the property through possessory title proceedings (información posesoria) on 27 de setiembre del 2006. He then sold it on 10 de agosto del 2006 to [[Nombre5] ] Sociedad Anónima, which sold the Guanacaste property, registration number [[Placa3] ], to [[Nombre6] ].
Regarding the testimony offered by the defendant, he characterizes its substance as false, asserting that he proved his own permanent possession and lawful ownership of the property, where he lived with his family in [...]. This was disputed despite the school and birth certificates of his eldest children. He demonstrated that he built the house that stood on the property and visited it regularly. The dwelling was occupied by the defendant and his family in his capacity as caretaker. He objected to those witnesses stating that they did not know him, even though he lived in [...], where his children grew up. He contends that the witnesses stated that they rented the property for cattle, although the land was not suitable for livestock farming. He alleges that it is untrue that there were two structures on the parcel, as they stated, because the judicial inspection record describes only one, where the defendant lived.
Upon reviewing the appealed decision, this Court observes that Considerandos X and XI set out the factual and legal reasoning, duly supported by the evidence, leading to the conclusion that, with respect to the positions asserted in the complaint and the counterclaim (reconvención), the former should be denied and the latter granted. Considerando X states that the principal relief sought in [[Nombre1] ]’s action is the annulment of the possessory title proceedings No EXPN1 for failure to comply with essential requirements, and the consequent cancellation of the registration of the property recorded in the Public Registry of Guanacaste under registration number [[Placa3] ]. This is because the plaintiff claims that the property belongs to him and that the title applicant (titulante) was the property’s caretaker or farmhand. That judgment stated that, according to the documentary evidence consisting of a copy of those proceedings, the witnesses [[Nombre11] ], [[Nombre12] ], and [[Nombre13] ] testified.
They described [[Nombre3] ]’s possession as lasting thirteen and forty years, respectively. He was recognized as the owner of the property in dispute, which was used for cattle and corn cultivation. The land had a house in which he lived. That decision notes that such facts were confirmed during the judicial inspection conducted in these ordinary proceedings at the disputed site, in Santa Rosa de Santa Cruz. A parcel enclosed by three- and four-strand wire fencing was observed, with natural reforestation and an old wooden house occupied by the title applicant. The record described the land as scrubland, enclosed by three- and four-strand wire fencing with living and dead fence posts, some paddocks, and pastures planted with jaragua grass. It further stated that these observations constituted useful evidence of the title applicant’s exercise of possession. The judgment integrates the foregoing with the statements of three witnesses in these proceedings.
Regarding [[Nombre14] ], it noted that he testified that he recognized only [[Nombre3] ] as the person who worked and tended the land. He also stated that he helped that witness and rented the land from him for cattle because he owned “a few cows.” The judgment stated that the witness reported visiting every week and on Sundays to work growing corn. The judgment reasons that these statements corroborate the testimony given in the possessory title proceedings concerning the title applicant’s possession. This testimony was found credible and consistent with the remainder of the evidence cited. Likewise, the appealed judgment refers to the testimony of [[Nombre15] ], who stated that he was 54 years old and had known the property all his life because it had belonged to his father and was fenced. He stated that when the plaintiff, [[Nombre1] ], came to the property, he said that he had that property there and that his brother was there for him.
The judgment states that this witness mentioned that the parcel was unsuitable for cattle or agriculture, consisted entirely of scrubland, and had fences in poor condition. They later left for San José, but [[Nombre1] ] had lived there with his children. The younger children were born in San José, and the older children were born on the property. The judgment assigns less weight to this testimony because it was deemed hearsay. The witness stated that it was the plaintiff, [[Nombre1] ], who told him that he owned a property on that land. Moreover, the witness did not specify which property it was or state that he had observed [[Nombre1] ] performing work or issuing instructions concerning the property in dispute. It was therefore irrelevant to proving the possession and ownership (dominio) claimed by the plaintiff. The evidentiary assessment in the appealed decision also included the testimony of [[Nombre16] ], who, as relevant here, stated that he had worked for [[Nombre3] ], whom he knew as the owner because he was the person who tended the property by planting corn, rice, and beans and repairing fences.
The witness stated that he supplied fence posts because [[Nombre3] ] had cattle (25 veinticinco a treinta reces). The judgment notes that, as with the previous witness, reference was made to acts of possession (actos posesorios), and that he emphatically described the defendant and title applicant’s acts of possession. The plaintiff failed to prove the ownership that he claimed to have maintained over the property. The appealed decision concluded that it was the defendant who submitted evidence establishing his status as owner and possessor, which he transferred to [[Nombre4] ]. The land was subsequently sold until it reached its current owner, who performs brush-cutting and clearing work.- Having analyzed the foregoing, the appellant Estate’s ground of appeal—asserting that the plaintiff proved his permanent possession and lawful ownership of the property and that he lived there with his family in [...]—is not accepted.
It contends that this was demonstrated by his children’s birth certificates, that his brother acted as caretaker, that the house was built by the claimant, and that he visited it regularly. The appeal does not identify the evidence that would disprove the statements of the witnesses analyzed in the judgment, and his children’s birth certificates are not suitable evidence for establishing acts of possession over the property or [[Nombre3] ]’s status as a servant of possession (servidor de la posesión). The witnesses whose testimony was analyzed described [[Nombre3] ] as possessing the property as its owner, and only one of them, as reasoned in the challenged judgment, had no direct knowledge that [[Nombre1] ] had been the possessor in that capacity or that [[Nombre3] ] had been his farmhand. The declarant stated that he knew the fact he described directly from the plaintiff during the latter’s lifetime because the plaintiff had told him, not because he had observed anything beyond [[Nombre1] ]’s occasional visits.
The same witness further stated that the older children were born and raised at the site, but that the younger children moved to San José with the plaintiff. This logically explains why the witnesses stated that they did not recognize him, since the same witness, [[Nombre15] ], stated that the plaintiff moved away to live in San José and that his younger children therefore did not grow up at the site. The record contains no evidence of payments for caretaking services, purchases of the supplies necessary to maintain land, payment for utilities, or any other evidence demonstrating that the late [[Nombre1] ] possessed the property as its owner. The latter bore the burden of proof (carga probatoria) because he alleged those facts in his complaint (artículo 317 del Código Procesal Civil de aplicación supletoria, en virtud del ordinal 26 de la Ley de Jurisdicción Agraria, Transitorio I.2 de Ley 9343 y II de Ley 9342).
This Court finds no grounds to reverse the judgment based on the appellant’s argument that the property was not suitable for livestock farming and that the witnesses therefore lied, because he submits no evidence in that regard and the witnesses described livestock activity at the site. Specifically, [[Nombre16] ] stated that [[Nombre3] ] had between 25 and 30 head of cattle. The fact that the property in dispute was not suitable for livestock farming, according to the plaintiff, does not mean that grass was not cultivated there or that the land was not rented for cattle, nor does it mean that the witness lied in his testimony. The appellant submitted no evidence disproving that statement (artículo 317 del Código Procesal Civil de aplicación supletoria, en virtud del ordinal 26 de la Ley de Jurisdicción Agraria, Transitorio I.2 de Ley 9343 y II de Ley 9342). After listening to the testimony, this Court considers the assessment of that testimony in the judgment to be correct because the statements were clear and consistent.
As for the appellant’s argument that the witnesses stated there were two structures, while the judicial inspection of 5 de marzo del 2014 (minuto 02:00 en adelante de grabación primera de disco compacto) did not describe them, he does not identify the testimony to which he refers. It must also be considered that the findings made during a judicial inspection reflect the conditions existing when it is conducted and cannot establish that what was observed had remained unchanged from the past. During that proceeding, it was stated that, although the plaintiff had indicated that a house existed, it was not found, nor were any remains observed of the structure identified by the defendant. Accordingly, the ground of appeal must be rejected pursuant to artículo 278,280, 283, 284 y 285 del Código Civil concerning the possession required to obtain title. His argument is rejected.
VII- Damages and losses (daños y perjuicios). An award of damages and losses is sought because the counterclaim (contrademanda) of [[Nombre6] ] was upheld in the judgment. That counterclaim sought a declaration of ownership rights over the property in Guanacaste, registration [[Placa5] ], with cadastral survey plan (plano catastrado) [[Placa6] ]. Therein, she requests a declaration that the plaintiff has never possessed the property at issue in this litigation continuously, peacefully, undisturbedly, in good faith, under color of title, and for a ten-year period. She further requests an award of damages and losses. She quantified material damages as: "the sum of five million for the inconvenience of having to appear before the courts to defend the right held by [[Nombre6] ] as the registered owner, while to date being unable freely to dispose of property that she registered legitimately and in compliance with all certifications and legal requirements.
LOSSES: in the sum of FIFTEEN MILLION COLONES, consisting precisely of the inability to use, possess, or enjoy the property appropriated by the defendant, completely restricting the availability of her real property, without being able to derive any benefit whatsoever from it or obtain any income from renting or selling it." The facts deemed proven in the judgment that are relevant to this issue are as follows: "2) The property of the Guanacaste District, real-property folio [Valor 001].... survey plan [Valor 002], is registered in the Registro Nacional and is owned by the defendant [[Nombre6] ]. See registry certification at folios 275-276.-
VIII- Costs (costas). Regarding costs, because the appealed judgment is partially reversed, this issue must be reviewed pursuant to article 55 of the Ley de Jurisdicción Agraria. As reasoned above, because the principal claim in the counterclaim is granted but the claim for damages and losses is denied, with each party partially prevailing with respect to that action (article 221 of the Código Procesal Civil, applied supplementally by reference from provision 26 of the Ley de Jurisdicción Agraria, Transitorio I.3 of Ley 9343 and II of Ley 9342), the matter must be resolved without a special award of costs against counterclaimant [[Nombre6] ].
IX- For the reasons stated, based on the cited case law and articles 1, 2, and 55 of the Ley de Jurisdicción agraria, provisions 1045 and 632 of the Código Civil, and 317 and 221 of the repealed Código Procesal Civil, the appealed judgment is reversed, to the extent appealed, insofar as it granted the unliquidated claim for damages and losses asserted in [[Nombre6] ]’s counterclaim against the ESTATE OF [[Nombre1] ], with their amount to be liquidated and determined during enforcement of the judgment. The award of attorney fees and court costs (costas personales y procesales) arising from the counterclaim against the Estate of [[Nombre1] ] is likewise reversed. Instead, the damages and losses sought in [[Nombre6] ]’s counterclaim are denied. The counterclaim is resolved without a special award of costs.
POR TANTO
To the extent appealed, judgment number 225-2019 issued at catorce horas cuarenta y siete minutos del dieciséis de agosto del dos mil diecinueve is reversed insofar as it granted the unliquidated claim for damages and losses asserted in [[Nombre6] ]’s counterclaim against the Estate of [[Nombre1] ], with their amount to be liquidated and determined during enforcement of the judgment. The award of attorney fees and court costs arising from the counterclaim against the Estate of [[Nombre1] ] is likewise reversed. Instead, the damages and losses sought in [[Nombre6] ]’s counterclaim are denied. The counterclaim is resolved without a special award of costs.

RESULTANDO:
Redacta la jueza Castro García;y,
CONSIDERANDOS
I- Hechos probados. Se avalan los hechos probados del fallo recurrido por estar fundado en elementos probatorios que constan en autos.
II- Hechos no probados. Se prohíjan los hechos no probados de la sentencia recurrida, por existir prueba que acredita lo contrario a lo consignado en tales. De esta naturaleza se acreditan en esta instancia: 6) Los daños y perjuicios reclamados por [[Nombre6] ]. ocasionados por la imposibilidad de disponer del inmueble, ni poder realizar contratos respecto al mismo. No hay prueba al respecto.
III- El albacea de la Sucesión de [[Nombre1] ] recurre dentro del plazo legal, la sentencia de primera instancia N.225-2019 de las 14:47 horas del 16 de agosto del 2019 (imágenes 12 a 35 y 43 a 55 de expediente digital modo pdf). Como razón de fondo de su disconformidad la indebida fundamentación y razonamiento de la sentencia. Pues toda sentencia debe consignar el contenido sustancial de las pruebas en las que se fundamenta y sus conclusiones. Análisis que debe abarcar los aspectos fácticos y jurídicos. Refiere al voto de la Sala Constitucional de la Corte Suprema de Justicia de las 15:36 hrs del 07 de junio de 1994, número 2660-94. Reclama, en la sentencia la fundamentación es incompleta y contradictoria, al no considerarse las pruebas que le beneficiaba. Lo cual ha violado su debido proceso. Hace notar, en el fallo se tiene por probado que en el Juzgado Agrario de Santa Cruz se tramitó el expediente de Información Posesoria número EXPN1 por [[Nombre3] ].
Concluido con resolución de las diez horas dos minutos del dieciséis de junio del dos mil cinco, que ordenó inscribir la finca descrita en el plano [Valor 002] a nombre de la cesionaria [[Nombre4] ]. Refuta tal fundo ha pertenecido al actor. Sin embargo, el ahí promovente inició el proceso en uso de actuaciones irregulares. Siendo que el proceso adoleció de requisitos de ley y se cumplieron faltas procesales que ha expuesto: sin que se atendieran sus reclamos. Y la solución del conflicto solo se logrará anulando el proceso de Información Posesoria que originó la litis. Razón por la cual se planteó este proceso de nulidad de información posesoria, reivindicación y reconocimiento pago de daños y perjuicios. Mismas que no han sido analizadas en la sentencia recurrida. Cita, existe incongruencia y no se recibe prueba fundamental para la búsqueda de la verdad real y objetiva de los hechos. Lo cual no ocurrió.
Como un primer tipo de agravios, reclama defectos formales del proceso de información posesoria que se solicita anular que se citan de seguido: a) Falta de notificación de la colindante [[Nombre9] ] S.A. para dar su consentimiento. Aduce, este aspecto no fue claro en la sentencia y si bien consta en autos una certificación de personería de la entidad colindante, no lo es que el personero compareciera en condición de representante, sino que lo hace en lo personal. Estima, bajo esas circunstancias, no es posible interpretar que lo hace a título de representante de la sociedad colindante. Pues debe ser manifestado en forma expresa, según lo exige el requisito legal que se ha incumplido. b) Estudio de uso de suelos. No fue aportado ni se practicó reconocimiento judicial para constatar la supuesta posesión de los que indican son poseedores y el adecuado uso del suelo. Y a pesar de que eso se cita en la sentencia del ordinario, se hace en forma superficial y se acepta la falencia.
Aún así se sostiene el proceso de información posesoria; lo que podría constituir prevaricato. c) Respecto a la prueba testimonial y el reconocimiento judicial cuestiona se hubiera llevado a los declarantes al sitio en litis. Pues el acta levantada indicó: "Presente en el lugar de la cuestión...", sin que se identificase el sitio del acto jurídico (folios 36, 37 y 38 del expediente de Información Posesoria) no se establece cual es la finca. Por lo que no se estableció cual finca se visitó ni donde se ubicaba. Indica, también genera duda que el plano catastrado que los demandados levantan grafica una quebrada en medio, que en el reconocimientos no se cita y era visible. Cuestiona, se visitara un terreno cercano que si pertenece al demandado. Explica, en folios 71 a 73 del expediente existe incongruencia entre la supuesta inspección judicial, el plano presentado en el expediente de Información Posesoria y la sentencia dictada en dicha diligencia, respecto a los ojos de agua, manantiales y demás aguas que se aprecian en el plano.
Ni la sentencia, ni el acta de reconocimiento detallan dichas aguas y la protección que se les debe brindar, violentando en especial la Ley Forestal. Lo que se relaciona con la omisión de remitir a la Procuraduría General de la República, cuando ese ente lo pide. Pues se le negó una serie de documentos pedidos, nunca se le hicieron llegar y no acepta que ahora mencione fue un error involuntario; restándole la importancia que tiene. Y se causa indefensión al ente procurador, bajo pena de nulidad por ese error judicial. d) No remisión de copias de las declaraciones testimoniales y reconocimiento a la Procuraduría General de la República, según solicitó a folio 77 de ese proceso. Explica, a folio 78 del citado expediente, por auto de las 15:31 horas del 13 de mayo del 2005, se indicó remitían las copias de las declaraciones de los testigos solamente y no del acta. de reconocimiento judicial, señalando ya había sido enviada según el folio 56.
Pero tal folio es una constancia de fecha 26 de enero del 2005. En la misma, existe una confusión, al ordenar enviar a la Procuraduría la resolución anterior y en el folio 53, la resolución anterior es la de folio 55 de las 13:02 hrs del 26 de enero del 2005. Que tiene, aprobada la cesión realizada dentro de la información posesoria y se tuvo por aportada la certificación del Registro Público, concediendo audiencia al ente procurador por el plazo de tres días. e) Incumplimiento del requisitos en el escrito inicial del proceso de información posesoria. Detalla, en folio 11 y 12 del mismo, faltaron requisitos que debieron haberse cumplido para dar curso al proceso y aprobarse. No se indicó si existen condueños, si existen hijos de otro matrimonio, extramatrimoniales o inválidos, o terceros interesados. Dado que el demandado estuvo casado. No se solicitó ejecutoria del divorcio o la sentencia de la Sucesión de la que fuera su esposa; por el tema de bienes gananciales.
No se pidió marca de ganado. Tampoco se ubicó, identificó o describió el inmueble, ni prueba de la donación hecha a su favor; como lo alegó en su oportunidad. Tampoco rindió la información a título de declaración jurada. Todo lo cual impedía darle curso. f) Demostración de posesión decenal previa a la declaratoria de reserva nacional del fundo. Acusa, no se demostró ese aspecto que hubieran transcurrido diez años previos de posesión antes de que fueran reservas nacionales. Tampoco fue solicitado por el Despacho. g) Sobre copropiedad y naturaleza de bien ganancial del fundo en litis. Aduce, de la testimonial se concluye que la posesión sobre el terreno era ejercida por él y el demandado, sin citar en que condición, por lo que se le debió tener al menos como condueño. Y en el escrito inicial no se indicó no existieran más dueños. Por otra parte, señala que el demandado citó entre sus calidades, era divorciado.
Y al haber sido casado y ser ejercida una posesión de más de 70 años según su dicho, la finca fue obtenida dentro del matrimonio. Agrega, no se demostró la donación, por lo que sería un bien ganancial al que tenía derecho su esposa. Sin que nada de ello se valorara. Como agravios contra el fondo de la sentencia, se exponen: a) Posesión histórica del terreno y condición de presencia del demandado en el inmueble. Cita el recurso, se ha insistido en que la finca en discusión es un inmueble sin inscribir que perteneció al padre de [[Nombre1] ]. Situada en [...] Guanacaste. Cabida de noventa y tres hectáreas, nueve mil trescientos metros con setenta y cinco decímetros cuadrados. Colinda [...]. Naturaleza agraria, con árboles originarios de la zona dedicada a la conservación. Pues el actor tenía interés de preservación ambiental. Relata, se adquirió por el progenitor del actor por denuncio ante las autoridades respectivas de la zona.
Se trasladó a San José con su familia y su finca quedó al cuidado de su hermano [[Nombre3] ]. Sin desligarse de la posesión que siempre se ha ostentado. De lo que conocen todos los vecinos de [...] de Guanacaste y lugares circunvecinos. Sin embargo, el demandado [[Nombre3] ] acudió a estrados judiciales y mediante la información posesoria logra titular a su nombre el terreno que no le pertenecía. Quedando inscrita registralmente el 27 de setiembre del 2006. Argumenta, en forma posterior, por escritura número seis de las 14:00 horas del 10 de agosto del 2006 [[Nombre5] ] Sociedad Anónima vende a [[Nombre6] ] , el inmueble de Guanacaste matrícula [[Placa3] ]. Que corresponde a la que le pertenece al actor. b) Sobre cuestionamientos al contenido de la prueba testimonial de las personas testigas de la parte demandada. Acusa, se demostró la posesión permanente y propiedad legítima del actor de la finca y que habitó con su familia en [...], pese al intento de la contraria de refutar ese hecho.
Pues se aportaron certificaciones de estudio y nacimiento de los hijos mayores del actor. Además de que el demandado siempre estuvo en condición de cuidador. Además se probó, fue el actor quien construyó la casa que había en el inmueble y que la visitaba la propiedad regularmente. Sin que sea importante si apelante se quedaba en la parcela o no. Lo que no era necesario, pues tenía lugar donde quedarse en [...]. Y la pequeña casa que existe en la heredad en litis era habitada por el demandado y su familia en su calidad de cuidador del inmueble. Cuestiona, los testigos propuestos por la parte demandada no le reconocen, ni saben quien es, a pesar de que ha sido acreditado que el actor vivía en [...] , donde nacen y crecen sus hijos. Agrega, la finca no tenía vocación ganadera, por lo que nunca se dedicó a esa actividad. Por ello no es creíble lo que citaron los declarantes respecto a que la finca era alquilaba para ese fin.
Estima han mentido.Acusa, faltan a la verdad cuando dicen que en el inmueble habían dos construcciones de vivienda, cuando del acta de reconocimiento judicial cita que solo habría una donde vivía el demandado. c) Costas, daños y perjuicios . Se reclama, se condena al pago de costas a la Sucesión de [[Nombre1] ] como litigantes de mala fe. Además de los supuestos daños y perjuicios causados que se otorgaron en abstracto y ser liquidados en ejecución de sentencia y se fije su monto.
IV- En la sentencia recurrida se declaró sin lugar la demanda establecida originalmente por [[Nombre1] ], hoy su Sucesión, contra [[Nombre3] ], hoy su Sucesión. [[Nombre4] ], [[Nombre5] ] S.A. y [[Nombre6] ]. Se acogieron las excepciones de falta de derecho, falta de legitimación activa y falta de legitimación pasiva. Se rechazó la de prescripción y sine actione agit de interpuestas por las últimas tres personas accionadas. Se acogió la contrademanda de [[Nombre6] ] contra la Sucesión de [[Nombre1] ], declarándose: a) esa sociedad es la única propietaria de la finca inscrita de Guanacaste, matricula número [[Placa4] ], graficada en plano catastrado [Valor 002], que coincide con el área inscrita. b) el actor [[Nombre1] ] nunca había poseído en forma continua, pacífica, quieta, de buena fe con justo titulo y de forma decenal, el inmueble en litis con plano catastrado [Valor 002]. c) Se acogió el reclamo del pago de daños y perjuicios en abstracto, a ser liquidados y determinado el monto en ejecución de sentencia. d) declaró el demandado [[Nombre1] ] no tiene derecho sobre la finca y se le impuso al actor el pago de ambas costas.
Respecto de los reclamos por incumplimientos de requisitos formales del proceso de información posesoria, ha de denegarse el recurso por las razones que de seguido se exponen. Sobre la falta del estudio de uso de suelos. De la revisión de las copias del expediente de información posesoria tramitado bajo número EXPN2 por [[Nombre3] ], se observa que tal estudio no consta ni fue solicitado; tal y como lo reclama el accionante. No obstante lo anterior, ha de indicarse por esta Cámara tal omisión logra explicarse en el periodo en que inició ese proceso no contencioso que se pide anular. Cabe reseñar que ese requisito legal encuentra su fundamento en la Ley de Uso Mantenimiento y Conservación de Suelo Ley 7779 del 30 de abril de 1998 (en adelante LUMCS). Cuyo reglamento se emite en el Decreto 29375-MAG ( en adelante Reglamento a la LUMCS) Nº Gaceta: 57 del: 21/03/2001. La finalidad de la Ley 7779 es la protección y conservación de los suelos en una gestión integrada y sostenible con los demás recursos naturales (artículo 1 Ibídem).
El certificado de uso conforme en la LUMCS se encuentra regulado en el articulo 47. El ordinal 58 del Reglamento a la LUMCS establece la necesidad del solicitante de titulo inscribible en un proceso de información posesoria la demostración mediante un estudio de suelos, ha ejercido la posesión cumpliendo con el uso conforme del suelo para la actividad que realiza, de acuerdo con la metodología, y ejecutándola con las mejores prácticas de manejo, según la tecnología disponible. En el artículo 59 Ibidem se determina que el estudio será realizado por el Certificador de Uso Conforme del Suelo, quien deberá analizar y certificar con base en visita de campo, si la posesión en las actividades del inmueble, se han ejercido de acuerdo con el uso conforme de suelo según su clasificación y que en el inmueble se realizan prácticas de manejo y conservación de suelos y aguas de acuerdo con la metodología aprobada.
Por su parte, el Decreto 30636-MAG, del 17/7/2002, crea el Registro Oficial de Certificadores de Uso Conforme del Suelo, para permitir “la participación de profesionales de libre ejercicio y de reconocida capacidad en el campo de la Edafología, en cumplimiento de los fines dispuestos por la Ley N° 7779”. Se estableció así como función del Ministerio de Agricultura llevar un Registro de las personas físicas o jurídicas de carácter privado, dedicados, en los de interés a acreditar y autorizar a los profesionales respectivos como Certificadores de Uso Conforme del Suelo. En virtud de esa normativa por Ley Nº 8149 del 5 de noviembre del 2001, se creó el Instituto Nacional de Innovación y Transferencia en Tecnología Agropecuaria (INTA), como un órgano de desconcentración máxima del MAG, que entre sus funciones se encuentra la creación del Registro Oficial de Certificadores de Uso Conforme del Suelo, con sede en el Departamento de Suelos y Evaluación de Tierras de la Dirección de Investigaciones Agropecuarias del Ministerio de Agricultura y Ganadería (MAG-INTA).
En el decreto que creó este registro Nº 30636-MAG Crea el Registro Oficial de Certificadores de Uso Conforme del Suelo, en sus transitorios se estableció: "Transitorio I.—Hasta tanto el Colegio de Ingenieros Agrónomos de Costa Rica y el MAG o su ente sucesor, no inicien el proceso de capacitación y se instale el Comité Evaluador, podrán inscribirse como Certificadores de Uso Conforme del Suelo, en el Registro que para tal fin llevará el Departamento de Suelos y Evaluación de Tierras del MAG-INTA, los miembros del Colegio de Ingenieros Agrónomos de Costa Rica que acrediten sus títulos y su experiencia práctica, según lo consignado en el inciso b) del artículo 3º del presente Decreto Ejecutivo. El Colegio de Ingenieros Agrónomos de Costa Rica, en coordinación con el MAG-INTA, abrirá el período de solicitud de inscripciones para los interesados en recibir el Curso correspondiente. Transitorio II.—El Departamento de Suelos y Evaluación de Tierras del MAG-INTA y el Colegio de Ingenieros Agrónomos de Costa Rica, deberán elaborar el contenido del Curso de Certificadores de Uso Conforme del Suelo, las normas de evaluación de dicho curso, así como los requisitos mínimos de presentación de los informes que realicen los Certificadores de Uso Conforme del Suelo (formato de los informes)." De tal forma que la Ley 8149/2001 que crea el INTA, le traslada competencias atribuidas al MAG en la ley 7779 según el ordinal 20.
Y el reglamento a la Ley del INTA se emite por decreto 31857/2004 en lo de interes estableció a la Dirección de Investigación y Desarrollo Tecnológico (Departamento de Servicios) la función de brindar servicios de certificaciones de uso conforme de suelo, estudios específicos y cualquiera que le encargue la jefatura, entre otros (art. 35, apte 4, inc c). Momento en el cual se hace posible cumplir con la función legal determinada en el artículo 19 de Ley 7779, arts. 19 y 2 de Ley 8149. En cuanto el desarrollo de realizar esa labor investigativa de estudios de suelo y certificaciones de uso conforme, mediante un proceso científico (toma de muestras, evaluación y determinación de la capacidad del terreno) a fin de emitir criterio certificado a petición de la persona usuaria." Decreto publicado en La Gaceta número 146 del 27/07/2004. Por lo que para la fecha en que inició el proceso de información posesoria, aún se encontraba pendientes aspectos que el INTA debía desarrollar a fin de poder tener el registro de certificadores de uso de suelo creado legalmente pero aún en ese año apenas creándose la estructura y logística institucional que la ley estableció.
Pues se encontraba en proceso de afianzamiento. De tal forma, que no resulta extraño que en ese proceso de información posesoria, ni el juez o el ente procurador exigiera ese requisito legal de estudio de suelos de conformidad con el Reglamento a la LUMCS. Por lo que se rechaza su agravio.
V- Respecto a la falta de envío a la Procuraduría General de la República de las declaraciones testimoniales y acta de reconocimiento judicial. Del estudio de las copias del expediente de información posesoria número 04 00049-391-AG (folios 129 a 240 Tomo I) observa esta Instancia que mediante memorial del 27 de mayo del 2005 del Procurador apersonado, se acusó recibo de las declaraciones testimoniales rendidas en ese asunto (folio 218 Tomo I físico). Por lo que tales piezas si le fueron remitidas. Respecto al acta de reconocimiento judicial, en ese mismo memorial citado solicita la remisión el ente procurador, que el es rechazado en la decisión de fondo del proceso de titulación de las 10:02 horas del 16 de junio del año 2005 (folio 221 a 224 Tomo I). Lo cual no fue reclamado por el representante del Estado en el momento procesal oportuno ni cuando se le otorgó audiencia de este proceso ordinario.
Por lo que no se considera que por ese motivo no reclamado por el Estado, sea un motivo para anular el proceso de información posesoria solicitado. Ente con legitimación e interés para reclamar esa omisión ( artículo 24 de la Ley Orgánica de la Procuraduría General de la República). En relación con la omisión de notificación de la colindante [[Nombre9] ] S.A. se rechaza. Consta en las copias del expediente que se solicita anular, que en folio 134 se adjuntó la personería jurídica de la sociedad [[Nombre9] ]. cuyo apoderado legal es [Nombre10] y por memorial rubricado por el mismo, se apersona en condición de colindante, manifestando no tienen oposición alguna. Si bien, en el escrito no se identifica a [Nombre10] como el apoderado de la sociedad que colinda con el terreno que se solicitaba inscribir, lo cierto es que fungía como apoderado generalísimo sin límite de suma y tuvo conocimiento del proceso.
Por lo que a la sociedad se le otorgó la oportunidad de oponerse al proceso y no lo hizo. Mas bien de forma expresa manifestó su conformidad (folios 134 y 137 Tomo I). Cumpliéndose con el requisito de notificación de colindantes de la Ley de Informaciones Posesorias. Sobre el reconocimiento judicial amplia dos temas de reclamos: la discordancia entre el plano catastrado utilizado en el proceso de información posesoria, lo descrito en el acta y lo consignado en la sentencia. Lo anterior en referencia a la quebrada existente en el terreno. Tales alegatos no resultan de recibo, pues el plano aportado en el proceso que se solicita anular es el numero [Valor 002] (folio 2 Tomo I) dibuja la finca objeto de ese proceso, que es atravesada de este a oeste por quebrada La Escuela. En el acta de reconocimiento judicial realizado el 3 de noviembre del 2004 al respecto (folio 169 a 170) se indicó: " Existe una quebrada, la cual atravesamos en el recorrido por la finca, sus márgenes se encuentran bien conservadas".
En la sentencia aprobatoria del proceso de las 10:02 horas del 16 de junio del 2005 (folio 221 a 224) se citó en el hecho probado primero, en lo de interés que el terreno es cruzado por el cuerpo de agua referido, de este a oeste y en la parte dispositiva se dispuso que: "El área contigua la Quebrada la Escuela que señala el artículo 33 , inciso b) de la Ley Forestal N 7575 constituye área de protección y queda prohibida la eliminación la corta o eliminación de árboles. Asimismo, el cauce y las aguas de esas corrientes son de dominio público". Por lo que no encuentra esta Sede la disconformidad apuntada al respecto. Reclama, existe duda respecto al lugar donde fueron llevados el juez y los testigos a rendir las declaraciones y realizar el reconocimiento judicial. De la revisión por esta Sede no se da crédito a este reclamo, pues mediante resolución de las 08:10 horas del 26 de agosto del 2004 se fijó la comparecencia oral en el fundo.
En folios 166 a 168 constan tres declaraciones testimoniales y a folio 169 consta el reconocimiento judicial cuyo encabezado indica que se encuentran presentes el titulante, el juez y abogado en Santa Rosa de Santa Cruz y describe lo observado en el terreno visitado. No encuentra esta Cámara prueba de que los testigos y el juez fuera dirigido a un fundo diverso al que era objeto de ese proceso de información posesoria. No fue aportada prueba al respecto por parte del recurrente más que su dicho y cuestionamiento, cuya carga probatoria le correspondía, al tenor del ordinal 317 del Código Procesal Civil derogado aplicable supletoriamente en virtud del canon 26 de la Ley de Jurisdicción Agraria, transitorio I.2 de Ley 9343 y II de Ley 9242. En relación con el reclamo de las insuficiencias del escrito inicial respecto a la falta de indicación de la existencia de condueños, o la naturaleza ganancial del fundo en virtud de haber estado casado el titulante y falta de solicitud de sentencia ejecutoria, han de denegarse tales reproche.
De la revisión del escrito inicial se denota que se presentó el 19 de marzo del 2004 (folios 11 a 12) describe las calidades [[Nombre3] ], indicando es vecino de Santa Rosa de Santa Cruz de Guanacaste y de conformidad con la Ley 139 y 479 del Código Civil solicita se expida título inscribible a su nombre del fundo que detalla, el tiempo, modo y condiciones de la posesión que indica es de setenta años. Citó es divorciado, la finca le fue transmitida en donación por su madre 70 años atrás y sobre la cual ha ejercido la posesión pacífica, ininterrumpida, pública y a título de dueño, sin que existieran condueños. Se ordenó la publicación del edicto de ley para que los interesados se apersonaran a hacer valer sus derechos y en tal se citó que se manifestó no existían cargas sobre el inmueble y que el trámite no tiene la intención de de evadir la tramitación y consecuencias de un proceso sucesorio (publicado el 21 de junio del 2004 según escrito de folio 35).
Respecto a la falta de indicación de existencia de hijos de otro matrimonio, extramatrimoniales o inválidos, o terceros interesados, o bien la naturaleza ganancial del bien a titular, no son requisitos legales hacer esas indicaciones, pues acorde con el ordinal 5 Ibídem para notificar a esas personas y otras se publica un edicto para comunicar de la existencia del proceso, a fin de que cualquiera pueda apersonarse a alegar lo que estime necesario. Por otra parte no resulta de recibo que se pida la nulidad por no haber aportado marca de ganado, pues tal requisito constituye más bien una probanza de posesión. Siendo que no todas las personas titulantes ejercen esa actividad productiva en los terrenos que se solicitan inscribir. Por ello es que en el artículo 1 inciso d) se menciona el tema de la marca de ganado, en caso de que la finca fuese ganadera. Respecto a falta de la descripción del terreno, en el escrito inicial se observa contiene los detalles de situación, linderos, cabida y naturaleza en el punto primero del memorial (folios 11 y 12).
Respecto a la prueba de la donación que se indica debió haberse aportado, se le rechaza su alegato. Pues al tenor del ordinal 1 párrafo cuarto, se exige la presentación del título en que conste el traspaso a su favor del derecho, cuando pretenda aprovechar la posesión ejercida por el transmitente, a fin de completar el plazo decenal. En este caso, el titulante indicó haber ejercido una posesión en forma personal de setenta años. Por lo que no requería adjuntar el documento de donación que indica le hiciera su madre y debió demostrar la posesión decenal y en condición idónea con tres testigos, según el canon 6 Ibídem. En referencia a que no se rindió la información del escrito inicial a título de declaración jurada, estima esta Sede que el efecto legal de esas manifestaciones se otorgan no por la manifestación expresa, sino por así establecerlo el párrafo segundo del artículo 3 de la misma norma legal que indica: " En todos los casos, las afirmaciones del titulante, tendrán carácter de declaración jurada, y cualquier falsedad le hará incurrir en las penas de perjurio, sino incurriere en delito de mayor gravedad, a juicio de la autoridad penal".
Por lo que esa omisión no se encuentra como uno de los requisitos del escrito inicial. Lo que no conlleva a dejar sin efecto lo que la norma legal citada impone a lo manifestado en ese memorial. Para esta Instancia, esos aspectos reclamados del escrito inicial en la apelación, no constituyen causas válidas de nulidad del proceso de información posesoria. Amén de que no se han mediado reclamos de personas, salvo el actor de este proceso, que hubieran reclamado la finca como suya por ser bienes habidos dentro de un vínculo matrimonial, por deber de inventariarse dentro de un proceso sucesorio o demostrarse que lo manifestado en el escrito inicial no era cierto y debía juzgarse por perjurio al titulante. Se deniegan esos reclamos. En relación la falta de demostración de posesión decenal previa a la declaratoria de reserva nacional del fundo. Tal reproche se reclama, pues acorde con el artículo 1 párrafo segundo de la Ley de Informaciones posesorias, el plazo que debe ser demostrado de posesión sobre un bien inmueble no inscrito es de diez años.
Posesión que debe ser ejercida según las condiciones del artículo 856 del Código Civil. Cabe indicar que las reservas nacionales son terrenos comprendidos dentro de los límites de la República no inscritos como propiedad privada, de las municipalidades o instituciones autónomas; los no amparados por posesión decenal, o no destinados por leyes especiales a la formación de colonias agrícolas, y todos los que no siendo de propiedad particular, no se ocupen en servicios públicos. LO anterior acorde con la Ley de Tierras y Colonización, artículo 11, en relación con el 261 del Código Civil. La Sala Primera de la Corte Suprema de Justicia ha resuelto que: "Pertenecen al Estado todos los terrenos que no se encuentren inscritos en el Registro a nombre de particulares. Es éste el sentido de los artículos 276 y 486 del Código Civil y 11 de la Ley de Tierras y Colonización" (Sentencia N° 243 de 1990, considerando.
XVII). Dentro de la política estatal de distribución, acceso a la tierra y derecho de propiedad, es el mismo Estado que emite normas para hacer posible que las personas pudieran acceder a la titulación de terrenos que no se encontraban inscritos. Entre tales, la vigente Ley de Informaciones Posesorias que establece la vía legal para que las fincas no sometidas a inscripción registral, puedan ser tituladas a nombre de las personas que cumplan los requisitos requeridos en la norma legal. De ahí que la persona que tituló la finca en litis, debía cumplir con la demostración de que el fundo que se pedía inscribir no lo estaba y la posesión decenal ejercida antes de su solicitud; además del resto de requerimientos legales. Por lo que tal reclamo se rechaza en cuanto indica que debía acreditar la posesión antes de la declaratoria de reserva nacional.
VI- Como segunda especie de reclamos, se expone la disconformidad sobre el tema del ejercicio histórico de la posesión del terreno y condición de presencia del demandado en el inmueble de cuidador. Así como cuestionamientos al contenido de la prueba testimonial de las personas testigas de la parte demandada. Aduce el actor en su recurso, el fundo en cuestión lo adquiere su padre por denuncio que le transmite. Deja a su hermano [[Nombre3] ] al cuidado del inmueble, sin desligarse de la posesión que siempre se ha ostentado. Mencionó, tal situación era de conocimiento público de la comunidad de [...] Guanacaste. Pero su hermano inscribe la finca mediante información posesoria de forma ilegal el 27 de setiembre del 2006. Y luego le vende el 10 de agosto del 2006 [[Nombre5] ] Sociedad Anónima que vende a [[Nombre6] ], la propiedad de Guanacaste matrícula [[Placa3] ]. Respecto a la prueba testimonial ofrecida por el demandado califica de falso el contenido de la prueba testimonial ofrecida por la parte demandada, al haber probado por su parte su posesión permanente y propiedad legítima en la que habitó con su familia en [...] .
Lo que se intentó refutar, a pesar de las certificaciones de estudio y nacimiento de sus hijos mayores. Demostró que él construyó la casa que había en el inmueble y que la visitaba regularmente. Vivienda habitada por el demandado y familia en su calidad de cuidador. Reclamó que esos testigos indicaran no conocerle a pesar de que vivía en [...] donde crecen sus hijos. Reclama, los testigos indican que alquilaban la finca para ganado, pero el terreno no tenía vocación ganadera. Acusa, no ser cierto que en la parcela haya dos construcciones como lo indicaron, pues en el acta de reconocimiento judicial se describe solo una donde vivía el demandado. De la lectura de la pieza apelada se observa por esta Sede que en el considerando X y XI, se expusieron los razonamientos de hecho y derecho con la debida fundamentación probatoria que hicieron concluir respecto a las posiciones de la demanda y reconvención, debía denegarse la primera y acogerse la segunda.
Se cita en el considerando X, la principal pretensión de la acción de [[Nombre1] ] es la nulidad de las diligencias de Información Posesoria.No EXPN1 por transgresión de los requisitos fundamentales, la consecuente nulidad de la inscripción de la finca inscrita en el Registro Público de Guanacaste matrícula [[Placa3] ]. Pues indica el actor le pertenece y el titulante es el cuidador o peón de la finca. Se indicó en esa sentencia, acorde con la prueba documental de copia de ese proceso declararon los testigos [[Nombre11] ], [[Nombre12] ] y [[Nombre13] ]. Que describieron una posesión de trece y cuarenta años respectivamente de [[Nombre3] ]. Reconocido como dueño del inmueble en litis, dedicado a ganado y cultivo de maíz. Terreno con casa que habitaba. Señala ese fallo, tales hechos se constataron en el reconocimiento judicial de este proceso ordinario realizado en el sitio en litis, en la localidad de Santa Rosa de Santa Cruz.
Y donde se observó una parcela cercada a 3 y 4 hilos de alambre, de reforestación natural, con casa vieja de madera donde habita el titulante. Se describió en esa acta naturaleza de charral, cercada con tres y cuatro hilos de alambre con postes vivos y muertos, algunos apartos, potreros de la variedad de pastos jaragua. Y que esas observaciones son prueba útil del ejercicio de la posesión por el titulante. Integra la sentencia lo anterior con las declaraciones de tres testigos dentro de este proceso. Respecto a [[Nombre14] ] citó que declaró reconocer solo a [[Nombre3] ], como la persona que trabajaba y asistía el terreno. Además que ese testigo le ayudaba y le alquilaba también para para ganado, al ser dueño de "unas vaquitas". Se mencionó en la sentencia que el testigo indicó visitar todas las semanas y los domingos para trabajo cultivando maíz. Se razona en la sentencia que con lo dicho se ratifican las declaraciones vertidas en el proceso de información posesoria respecto a la posesión del titulante.
Testimonio que resultó creíble y coherente con el resto de la prueba citada. En igual sentido en la sentencia recurrida, se hace referencia a lo depuesto por [[Nombre15] ], que indicó contar contar con 54 años, conocer la finca de toda su vida, por haber sido de su papá, estar cercada. Citó, cuando el actor [[Nombre1] ] llegaba a la finca, expresaba tenía esa finca ahí y que él tenía ahí a su hermano. Se cita en la sentencia, ese testigo mencionó, la parcela no era apta para ganado ni agricultura y todo era de charral, cercas en mal estado. Luego parten para San José, pero [[Nombre1] ] vivía ahí con los hijos. Los menores nacieron en San José y los mayores nacieron en la finca. En la sentencia se le resta valor a este testimonio por calificarse de referencia. Al mencionar que fue el actor [[Nombre1] ] quien le indicaba que en ese terreno tenía una finca. Que además no se precisó cual era ni indicar que observó a [[Nombre1] ] realizar trabajos o emitir ordenes respecto de la finca en litis.
Por lo que resultó irrelevante para demostrar la posesión y dominio que reclama el actor. También se incluyó en la valoración probatoria de la decisión recurrida la declaración de [[Nombre16] ], que en lo de interés citó haber trabajado para [[Nombre3] ], a quien conoció como dueño porque era la persona que asistía la finca, sembrando maíz, arroz, frijoles y arreglando cercos. El testigo afirmó que suministró postes para la cerca, pues él tenia ganado (25 veinticinco a treinta reces). Menciona la sentencia, que al igual que el anterior testigo se hizo referencia a los actos posesorios y que de forma enfática describió los actos de posesión del demandado y titulante. Sin que el actor probara el dominio que alega haber mantenido en la propiedad. Concluyéndose en el fallo recurrido que fue el demandado quien hizo llega prueba respecto a su condición de dueño y poseedor , que transmitió a [[Nombre4] ].
Terreno que fue vendiéndose hasta su dueño actual que ejercer labores de chapea y limpieza.- Analizado lo anterior, no se recibe el agravio de la Sucesión recurrente, referido a que el actor prueba su posesión permanente y propiedad legítima del actor de la finca y que habitó con su familia en [...]. Ello por así demostrarse con las certificaciones de nacimiento de su hijos Y que su hermano estuvo en condición de cuidador, la casa fue construida por el accionante y la la visitaba de forma regular. No indica el recurso cual es la prueba para desvirtuar los dicho por los testigos analizados en el fallo y las certificaciones de nacimiento de sus hijos no son un medio idóneo para acreditar los actos posesorios en el fundo y la condición de servidor de la posesión de [[Nombre3] ]. Los testigos analizados relatan una posesión de [[Nombre3] ] en la condición de dueño y solo uno de ellos, tal y como se razonó en la sentencia cuestionada, no le constaba de forma directa que [[Nombre1] ] hubiera sido el poseedor en esa condición y que [[Nombre3] ] hubiera sido su peón, pues de tal hecho que citó, indicó el declarante, lo sabía por referencia directa del actor en vida; al habérselo comentado.
No por que hubiera observado más que la visita ocasional de [[Nombre1] ]. Además de indicar el mismo testigo que los hijos mayores nacen y crecen en el lugar, pero los menores se van a San José con el actor. Razón por la cual encuentra lógica explicación, que los testigos indiquen no reconocerle. Pues el mismo testigo [[Nombre15] ] citó que el actor se retira a vivir a San José y sus hijos menores ya no crecen en el sitio. No existe prueba en los autos de pagos de cuido, compra de bienes propios necesarios para el mantenimiento de un terreno, cancelación de servicios o alguna otra prueba que demostrara la posesión en condición de dueño de quien en vida fue [[Nombre1] ]. Carga probatoria que soportaba este último por así alegarlo en su demanda (artículo 317 del Código Procesal Civil de aplicación supletoria, en virtud del ordinal 26 de la Ley de Jurisdicción Agraria, Transitorio I.2 de Ley 9343 y II de Ley 9342).
No encuentra motivos para revocar lo decidido en sentencia esta Sede por la argumentación que hace el recurrente, referente a que la vocación de la finca no era ganadera y por ello los testigos mienten, pues no aporta prueba al respecto y los testigos describen que si lo ha habido en el sitio. En específico [[Nombre16] ] que mencionó que tenia ganado en una cantidad de 25 a 30 reses. El hecho de que no tenga vocación ganadera la finca en litis, según el dicho de la parte actora, no conlleva a entender que esa actividad no se desarrollara cultivo de pastos o alquiler para ganado y que el testigo mintió en su declaración. Pues no fue aportada prueba que desvirtuara esa afirmación por parte del recurrente (artículo 317 del Código Procesal Civil de aplicación supletoria, en virtud del ordinal 26 de la Ley de Jurisdicción Agraria, Transitorio I.2 de Ley 9343 y II de Ley 9342). De la escucha de los testimonios por esta Sede, se considera que la valoración de esos testimonios descrita en la sentencia es correcta, pues las declaraciones fueron claras y concordantes.
Respecto al alegato del impugnante que los testigos mencionan que habían dos construcciones cuando en el reconocimiento judicial del 5 de marzo del 2014 (minuto 02:00 en adelante de grabación primera de disco compacto) no se describió eso. No indica cual testimonio es al que se refiere, y cabe considerarse que lo encontrado en reconocimiento judicial refleja la realidad existente al momento en que se realiza, sin que pueda entenderse que lo observado ha permanecido incólume desde del pasado. En tal acto se mencionó que a pesar de haberse señalado por el actor había una casa, la misma no se encontró y que tampoco se visualizaron vestigios de la que se indicaba por la parte demandada. Por lo que ha de rechazarse el agravio de conformidad con el artículo 278,280, 283, 284 y 285 del Código Civil respecto a la posesión exigida para titular. Su alegato se rechaza.
VII- Daños y perjuicios . Se reclama la condenatoria en daños y perjuicios al haberse acogido la contrademanda de [[Nombre6] ] en la sentencia. Esa reconvención declarativa del derecho de propiedad sobre la finca de Guanacaste, matrícula [[Placa5] ] con plano catastrado [[Placa6] ]. En donde solicita se decrete el actor nunca ha poseído en forma continua, pacifica, quieta, de buena fe con justo titulo, y de forma decenal el inmueble objeto de esta litis. Además se acojan daños y perjuicios. Liquidando por daños material: "la suma de cinco millones por los inconvenientes de acudir a los estrados judiciales a defender el derecho que como propietaria registral ostenta [[Nombre6] ], sin que a la fecha se pueda disponer libremente de un bien que inscribió en forma legítima y cumpliendo con todos los atestados y requisitos de ley. Los PERJUICIOS: en la suma de QUINCE MILLONES DE COLONES, que consisten casualmente en el no uso, ni goce ni disfrute del bien apropiado por la demandada, limitando por completo la disponibilidad del su bien inmueble, sin que se pueda sacar provecho alguno, sin poder producir o lograr algún rubro por alquiler o venta del mismo". Como hechos probados de la sentencia de intepres a este tema se tiene que: "
VIII- Costas. Respecto a las costas, con fundamento en el artículo 55 de la Ley de Jurisdicción Agraria, al revocarse la sentencia apelada parcialmente, procede revisarse este extremo. Como se razonó supra, al acogerse la pretensión princcipal de la reconvención pero denegarse el extremo de los daños y perjuicios, ocurriendo el vencimiento recíproco respecto de esa acción (artículo 221 del Código Procesal Civil supletoriamente aplicado por referencia del ordinal 26 de Ley de Jurisdicción Agraria, Transitorio I.3 de Ley 9343 y II de Ley 9342), deberá resolverse sin especial condenatoria en costas en referencia a la contrademandante [[Nombre6] ].
IX- Por las razones expuestas, con fundamento la jurisprudencia citada y los artículo 1, 2, 55 de la Ley de Jurisdicción agraria, ordinales 1045 y 632 del Código Civil, 317, 221 del Código Procesal Civil derogado, en lo apelado se revoca la sentencia apelada en cuanto acogió la pretensión de daños y perjuicios en abstracto de la contrademanda de [[Nombre6] ]. contra el SUCESORIO DE [[Nombre1] ], a ser liquidados y determinados en su monto en ejecución de sentencia. Así como la condenatoria en costas personales y procesales de la contrademanda a cargo de la Sucesión de [[Nombre1] ]. En su lugar, respecto a los daños y perjuicios reclamados en la contrademanda de [[Nombre6] ] se rechazan. Sobre la contrademanda, se resuelve sin especial condenatoria en costas.
POR TANTO
En lo apelado,se revoca la sentencia número 225-2019 de las catorce horas cuarenta y siete minutos del dieciséis de agosto del dos mil diecinueve en cuanto acogió la pretensión de daños y perjuicios en abstracto de la contrademanda de [[Nombre6] ] contra la Sucesión de [[Nombre1] ] , a ser liquidados y determinados en su monto en ejecución de sentencia. Así como la condenatoria en costas personales y procesales de la contrademanda a cargo de la Sucesión de [[Nombre1] ]. En su lugar, respecto a los daños y perjuicios reclamados en la contrademanda de [[Nombre6] ] se rechazan. Sobre la contrademanda se resuelve sin especial condenatoria en costas.
