Decision: 2020-1002 Case file: 11-000899-0485-PE(16) TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, at fourteen hours and fifty minutes on diecinueve de junio de dos mil veinte.- APPEAL (RECURSO DE APELACIÓN) filed in these proceedings against Nombre01, of legal age, Costa Rican, identity card number CED01, born in Limón, Pococí, Barra del Colorado, on 23 de enero de 1976, son of Nombre02 and Nombre03, married, employed as a Tour Guide, resident of Limón, Pococí, Barra del Tortuguero, Dirección01; for the offense of INVASION OF A PROTECTED AREA (INVASIÓN A UNA ZONA PROTEGIDA), to the detriment of FOREST RESOURCES. Judges Elizabeth Montero Mena and Alejandra Valenciano Chinchilla and Judge Roy Antonio Badilla Rojas participated in the decision. RESULTING:
I.By judgment number 318-2019, issued at sixteen hours on quince de mayo de dos mil diecinueve, the Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica ruled: “POR TANTO: Pursuant to Articles 39 and 41 of the Constitución Política; 8.2 of the Convención Americana sobre Derechos Humanos; 11 of the Declaración Universal de Derechos Humanos; 14.2 of the Pacto Internacional de Derechos Civiles y Políticos; 1, 2, 3, 11, 103 INC 1 30, 31, 45, 50, 59 to 63, 71, 76, 103 and 124 of the Código Penal; 1, 2, 3, 9, 37, 40, 111 to 124, 140, 141, 142, 180 to 184, 265, 267, 328, 330 to 336, 341, 352, 360 to 365 and 366 of the Código Procesal Penal, Articles 33 AND 58 subsection a of the Ley Forestal, 1045 of the Código Civil, 122, 124, 127 of the rules currently in force governing civil liability (responsabilidad civil) under the Código Penal de 1941, 45 and 18, IN APPLICATION OF THE UNIVERSAL PRINCIPLE OF INDUBIO PRO REO, MR.
Nombre01 IS ACQUITTED OF ALL PUNISHMENT AND LIABILITY for the offense of Invasion of a Protected Area, committed to the detriment of natural resources and the environment. The eviction (desalojo) of the persons residing in the structure located in Tortuguero, specifically the structure described in the report at folios 1 to 2, is hereby ordered; for this purpose, the Municipalidad de Pococí and the Fuerza Pública shall be charged with verifying the eviction of the persons residing there within 15 days after the judgment becomes final (firmeza). The demolition of the structure and restoration of the property to its original condition are hereby ordered; the Municipalidad de Pococí shall be charged with carrying this out once the eviction of the persons residing in that structure has been verified. Likewise, the defendant Nombre01 is acquitted of the allegations brought against him in the private prosecution (querella) instituted by the Procuraduría General de la República, and the civil damages action (acción civil resarcitoria) brought against the defendant Nombre01 is dismissed; no award of procedural and personal costs (costas procesales y personales) is made, and each party shall bear its own costs.” (sic).
II.Counsel Luis Grijalba Alfaro, prosecutor for the Ministerio Público; counsel Randall Aguirre Mena, representing the Procuraduría General de la República; and counsel Melvin Acedo Cantón, privately retained defense counsel for the accused, filed appeals against the foregoing decision.
III.Following the corresponding deliberation in accordance with Article 465 of the Código Procesal Penal, the Court considered the issues raised in the appeal.
Appellate Criminal Judgment Judge Gillen Bermúdez drafts the opinion; and,
CONSIDERING:
I.Counsel Luis Grijalba Alfaro, prosecutor for the Ministerio Público; Randall Aguirre Mena, Criminal State Attorney; and Melvin Acevedo Cantón, privately retained defense counsel for the defendant Nombre04, filed an appeal against decision N° 318-2019, issued at 16:00 hours on 15 de mayo de 2019 by the Tribunal de Juicio del II Circuito Judicial de la Zona Atlántica, Pococí seat. Because the appellants have been found to possess both objective and subjective standing (legitimación objetiva y subjetiva), and because the challenges were timely filed, their grounds shall be considered.
II.Appeal by counsel Luis Grijalba Alfaro, prosecutor for the Ministerio Público. FIRST GROUND: “Contradiction between the list of proven facts and the unproven facts, in clear and outright violation of art. 363 subsec. C) and 459 of the Código Procesal Penal.” He states that the judgment deemed the existence of the structure encroaching upon the protected area to be a proven fact, while deeming it unproven that the defendant was building the house at that location. This discredits the testimony of witness Nombre05 of SINAC, who, upon arriving at the location on 09 de marzo de 2011, saw 9 people engaged in construction, asked who was in charge, and was told by the defendant himself that he was the owner. Witness Nombre06, a neighbor of the accused and a Biologist with SINAC and MINAE, knows that the house belongs to the defendant and his partner Nombre07. For her part, defense witness Nombre08 stated that the dwelling under construction belonged to the accused and that she went to visit him at that location because she had been told about the problem he was having with the construction of the property because it was very close to the stream (which she called stagnant water).
Nevertheless, the Court found that it had not been established that the defendant was the person carrying out the construction because no one saw him hauling sacks, as though the owner or contracting party were required to participate personally in the work by mixing the mortar. SECOND GROUND: “Disagreement with the assessment of the evidence.” He argues that the court below (a quo) violated the rules of sound judicial reasoning (sana crítica), contrary to the provisions of sections 142, 184, 363 and 459 of the Código Procesal Penal. He maintains that the judgment contradicts itself by treating the existence of a structure encroaching upon the protected area as a proven fact, while treating it as unproven that the defendant was building the house at that location. He reiterates the testimony given by witnesses Nombre05, Nombre06 and Nombre08. The court below stated that no one saw the accused carry out the construction with his own hands, as though the Municipalidad issued permits to haul sacks or mix mortar, particularly given that none of the area’s inhabitants hold title to property in their own names.
He therefore maintains that the charged facts were proven and, consequently, it was unnecessary for anyone to have seen the accused performing the work at the location. Instead, the court should have considered that, during the first inspection, he identified himself as the person in charge and was warned that he had to halt the work because it was encroaching upon the bank of the stream; one month later, another similar proceeding was conducted, and the defendant and his partner were found at the location, while witnesses Nombre06 and Nombre08 respectively identified the defendant as an occupant of the property and stated that the accused had built the house. He argues that the contradictory reasoning (fundamentación contradictoria) lies in the trial judge’s interpretation of the operative verb (verbo rector), because “to build” is construed in a manner divorced from the criminal offense’s term “to invade,” even though the testimonial and documentary evidence confirms that the structure belongs to the defendant, and not, as the Court appears to have understood it, that the evidence consisted of equivocal indicia (indicios anfibológicos).
He contends that the foregoing demonstrates that the judgment is the product of a contradictory and insufficient reasoned assessment of the evidence, forcing an in favor rei outcome that does not correspond to the truth of the facts. He requests that the appeal be granted, the judgment vacated, and the case remanded for a new trial (juicio de reenvío) and new reasoning solely concerning the defendant’s guilt, while leaving the demolition of the real property in effect.
III.Appeal (recurso) by attorney Randall Aguirre Mena, Criminal Prosecutor. Pursuant to Articles 39 and 41 of the Political Constitution and 458, 459, 460 of the Code of Criminal Procedure, he filed an appeal (recurso de apelación) against judgment number 318-2019, issued by the Criminal Court of Guápiles. Article 458 of the Code of Criminal Procedure establishes that all judgments issued at the trial stage resolving criminal and civil matters may be appealed. In that regard, Article 459 of the aforementioned Code governs the admissibility of an appeal against a judgment, for the purpose of reviewing the decision in its entirety. Given that it has been determined in this matter that both objective and subjective standing (legitimación objetiva y subjetiva) exist, since the Procuraduría General de la República participated in the proceedings as private prosecutor (querellante) and civil plaintiff (actor civil), and that both challenges were filed on time, their grounds shall now be considered.
SOLE GROUND: “LACK OF INTELLECTUAL REASONING AND ERRONEOUS ASSESSMENT OF THE EVIDENCE IN ACQUITTING THE DEFENDANT AND DISMISSING THE CIVIL ACTION.” He alleges a violation of Articles 142, 182 and 184 of the Code of Criminal Procedure. He states that, in this case, the defendant (imputado) was charged with carrying out construction without any type of permit, which encroaches upon the protection area (área de protección) of a stream (quebrada) flowing through the site. The Court based the defendant’s acquittal (absolutoria) on reasonable doubt, stating that it had not been determined that he was carrying out the construction; it relied on the testimonial evidence (prueba testimonial) but failed to properly assess the documentary evidence (prueba documental). He further argues that official communications ACTOGASP- CYP-D004 dated 13 de marzo del 2011 —pages 1 through 3— and ACTOGASP-PNTSubAd-010-11 dated 06 de abril de 2011 —pages 5 through 10— were not assessed harmoniously and correctly together with the remaining prosecution testimonial evidence.
Regarding the first report cited, appearing on pages 1 through 3, it states that although nine people were observed working on the construction at the site, with a mixer and cement, it also specifies that the defendant Nombre01 was the person who approached and voluntarily informed SINAC officials that he was the owner of the construction; it further states that he was asked to stop the work and that the defendant himself said he had no objection to suspending the work until the complaint (denuncia) was resolved. These two facts show that, although nine people were working at the site, it was the defendant who identified himself as the owner and agreed to stop the work. He considers that this refutes the Court’s position that, because nine people were at the site, it was necessary to investigate who was in charge of the work. Witness Nombre05 stated at trial that the defendant was the owner of the construction and was present at the site while the work was being performed on the day of the first visit, matters that were not weighed by the trial court.
Regarding the second official communication, appearing on pages 5 through 10 of the case file, it states that on 6 de abril (nearly one month after the first visit), the owners of the project were located at the site and said that they were not going to stop building because they had already invested a great deal of money. Concerning this matter, witness Nombre06 stated that Mr. Nombre01 was present at the site that day and identified himself as the owner of the construction, as also shown in the photograph appearing on page 8, taken on the day of that visit. She also referred to the presence of bags of sand at the site, from which he considers it clear that the owners were the persons investing money in the construction. He considers that this evidence shows that the defendant was still at the construction site nearly one month after the first visit, and that the photographs on pages 8, 9 and 10 show a structure under construction and bags of cement.
He argues that the Court did not analyze the aforementioned aspects of the documentary and testimonial evidence, nor the statement of defense witness Nombre08, who testified that defendant Nombre09 lives at the site with Nombre07, the president of the Asociación de Desarrollo, thereby establishing that the structure was completed and that the defendant currently lives there. He considers that the judgment is based on a fragmented analysis of the evidence and erroneously concludes that doubt exists, even though, as described in the private complaint (querella) and the indictment (acusación), the structure encroached upon the protection zone (zona de protección), and that the Court thereby clearly breached its duty to provide reasons for the judgment. He further argues that the civil action for damages (acción civil resarcitoria) was dismissed despite proof that the defendant constructed the structure and that it encroaches upon a protection zone; the Court merely stated that the action was dismissed because it had not been determined that the defendant was the person who carried out the construction, a finding resulting from an erroneous assessment of the evidence, notwithstanding that the construction was performed within a protection area and without any type of permit, and that the environmental damage (daño ambiental) and the causal relationship (relación de causalidad) between the presence of the structure within the protection area and the environmental damage were established.
He requests that the appeal be granted, that the challenged judgment be partially vacated with respect to the matters appealed, and that the case be remanded (reenvío) for correction of the identified errors and issuance of a judgment in accordance with law.
IV.Appeal filed by attorney Melvin Acevedo Cantón, private defense counsel for the accused (imputado), Nombre04. The appellant filed an appeal (recurso de apelación) against Judgment Numero 318-19, delivered in full and orally at 16:00 hours on 15 de mayo de 2019, whereby his client was acquitted under the principle of reasonable doubt in favor of the accused (in dubio pro reo). He states that he challenges the provision ordering the demolition (derribo) of the structure pursuant to artículo 140 of the Código Procesal Penal. FIRST GROUND: He states that the evidence was not assessed, leading to erroneous conclusions and, ultimately, to the order to demolish the structure. The appellant transcribes the proven facts (hechos probados) as follows: ““Numero 1. - That on nueve de junto del dos mil once, at approximately nueve horas veinte minutos, MINAE officials from the Area de Conservación Tortuguero found the accused Nombre01 next to a dwelling under construction within the protection area (área de protección) of a natural stream (quebrada), located along the southern boundary of Parque Nacional Tortuguero.
Numero 2.- That on seis de abril del dos mil once, during a new inspection conducted at the aforementioned location by MINAE officials Nombre06, it was found that the accused Nombre01, despite the warning that had been given to him ... (word unintelligible due to defective recording), disregarded it and continued next to the dwelling that was under construction, encroaching upon the stream’s protection zone (zona de protección), because he failed to observe the fifteen-meter setback (retiro) from the bank of the division (word apparently used due to defective recording) of the construction, with this construction being located one meter from the stream” sic. (Verbatim quotation from the appellant’s appeal; see folio 358 of the case file (expediente)). He states that it was deemed proven that the construction is close to a stream, which constitutes a violation of the Ley Forestal attributed to the accused and gave rise to the demolition order.
The existence of a stream was also determined on the basis that this is a conservation area. He argues that the evidence was not sufficiently analyzed when the body of water was described as a stream or brook, since it was merely stated that the witness is a biologist with experience, that she established that it was a stream, and that her testimony was not rebutted. He contends that the question of whether it was a stream was not properly examined in order to establish that the construction is close to it and that the situation falls within artículo 33 of the Ley Forestal; instead, her testimony was not actually analyzed, and he therefore considers that the analysis of this evidence is entirely devoid of reasoning (fundamentación). SECOND GROUND: He states that what the witness referred to in the preceding ground actually said was not examined, even though she stated that she had extensive experience and considerable training, including at the international level; however, she was not consistent in her answers concerning the definition of the body of water about which she was questioned.
According to her opinion, streams “have a strong current,” but this is contradicted by the documentary evidence (prueba documental), namely the photographs appearing at folios 4, 7, 8 and 9, which were not examined by the trial judge (Juzgador) and from which it may readily be inferred that there is no current whatsoever, to the point that it is even difficult to determine whether any body of water exists there. Furthermore, even though the court accorded less weight to the testimony of the witness Nombre08, it did not question the truthfulness of her account, but merely compared it with the account of the biologist and MINAE official who also testified as a witness. Yet, if we examine Nombre06’s testimony, shortcomings are apparent: notwithstanding that she is a professional in the field, she stated that it was a stream, even though, when initially describing what each of those bodies of water consisted of, she indicated that streams “have a strong current.” Thus, the account of the biologist Nombre06 is contradicted not only by what the photographs show, but also by the statement of Ms.
Nombre08, who maintains that the waters are stagnant. Ms. Nombre08’s account is consistent with the photographs in that the waters have no current but simply flow through the lowest part of the land, particularly when it rains, especially after MINAE officials dug a ditch at the site and installed a culvert. The biologist Ms. Nombre06 also agrees on this point, as she admitted knowing that this device had been installed at the site. He argues that Ms. Nombre06’s testimony did not display the strength or certainty that could be expected from a person characterized by the trial judge as possessing substantial knowledge and experience regarding whether a stream was located at the site; instead, she merely indicated that she thought there was one, without stating so conclusively and speaking in a doubtful tone. This again supports Ms. Nombre08’s account. Indeed, in response to a question from the State Attorney (Procurador), she answered that it was a stream, but told the judge that she was no longer certain of that.
He considers that those statements raise serious doubts about the witness’s ability to serve as the basis for finding the existence of a circumstance that will result in the demolition of a structure. It is understood that natural systems do indeed shift, but the data recorded on cartographic sheets (hojas cartográficas) do not. Although the stream may no longer be at the site where it was originally located, on the cartographic sheet it will always appear at the site where it was plotted. He argues that nothing else could be expected, contrary to what the witness biologist contends, because it would be irrational to think that what was drawn on the cartographic sheet in the 1970s would no longer be there because the natural system shifted. The judgment contains no analysis of this issue, leading the trial judge to declare the existence of the stream per se, when the fact of the matter is that the stream does not appear in that official record.
If it shifted in the natural environment, as the witness seeks to suggest, this should be reflected on the cartographic map, but it is not. He states that the matter concerning the Hoja Cartográfica de Tortuguero arose during the trial (debate) as a result of questions asked by the State Attorney of the Procuraduría General de la República and the judge; he therefore offers it as evidence to assist the appellate court in reaching a decision (prueba para mejor resolver en alzada), for the purpose of demonstrating that the stream in question does not exist at that location. THIRD GROUND: He states that the Ley de Aguas requires the Dirección Nacional de Aguas to maintain an inventory of bodies of water through the hydrological information system, which must be consulted to determine whether any such body exists. Regarding this issue, witness Nombre05 testified that this information was not requested because it was evident that the body of water was a stream.
He argues that the witness was entirely evasive, to the point that the trial judge had to ask him to answer the questions. Thus, despite knowing of the existence of the registry of bodies of water and of the obligation to consult it, he failed to do so. The appellant therefore considers that this omission suggests that the stream does not exist, particularly since the witness was unable to identify its source or where its waters originated. FOURTH GROUND: He argues that the demolition order, based on artículo 140 of the Código Procesal Penal, permits the restoration of things to their original condition, but only as a precautionary measure (medida cautelar) and, moreover, only temporarily. From that perspective, the order to demolish the structure is improper because it is not a provisional precautionary measure, and he requests that the court so declare. FIFTH GROUND: He argues that the demolition of the structure is not a precautionary measure and must therefore be based on one of two grounds: the civil consequences of the criminal act (hecho punible), or its criminal consequences.
Since the civil claim for damages (acción civil resarcitoria) was dismissed, the demolition order cannot be imposed as a civil consequence of the criminal act, leaving only its criminal consequences as a possible basis for that order. For that purpose, it should have been established beyond doubt that there was indeed a violation of artículo 33 of the Ley Forestal; to establish the elements of that criminal offense (tipo penal), the existence of the stream—which is precisely the legally protected interest (bien jurídico tutelado) as a water resource—should have been proven. Not only were the elements of the criminal offense not established, but its consequences are also absent; that is, there was no violation of a protected zone, and therefore the demolition order is likewise improper from the standpoint of the consequences of the unlawful act. He requests that the appeal be granted due to the judgment’s lack of reasoning resulting from an erroneous assessment of the evidence, solely with respect to the existence of a stream, and that the judgment be reversed exclusively as to the demolition order.
He offers the Hoja Cartográfica de Tortuguero as evidence to demonstrate that the stream does not exist. He states that it is being offered at this time because its existence arose during the trial as a result of questions from the Procuraduría General de la República and the trial judge. He also offers the testimony of Nombre10, a biologist residing in Tortuguero de Colorado de Pococí, identification number CED02, who, in his professional capacity, will address whether the body of water at issue in these proceedings constitutes a stream or creek (riachuelo). This testimony is offered because the judgment’s sole basis for determining the existence of the stream was the account of a biologist whose statements were contradictory not only internally, but also in relation to other evidence.
V.With respect to the evidence offered before this appellate court, consisting of a cartographic sheet of the Tortuguero region intended to demonstrate that the stream in question does not exist at the location, as well as the testimony of Mr. Nombre10, a biologist and resident of Tortuguero, the court rules as follows: The Hoja Cartográfica of the Tortuguero region is admitted for consideration because its submission is authorized by artículo 464 of the Código Procesal Penal, insofar as this Chamber is empowered to receive evidence for the comprehensive review (examen integral) of the judgment and, in this case, it was an element that arose from the adversarial proceedings (contradictorio), as the party explains. However, the same does not apply to the offered testimony of Mr. Nombre10, a biologist and resident of Tortuguero, because the record does not show that his testimony was arbitrarily rejected, nor that it emerged as new evidence after the judgment, or that, although it previously existed, the party had no effective opportunity to offer it at the proper time. Accordingly, that testimony is rejected.
VI.The appeals are granted: Once this Chamber conducted a comprehensive review of the challenged oral judgment, which is recorded on the virtual desktop in digital file 110008990485PE-EV-Multi-0, whose reasoning may be heard beginning at minute 26:00, it determined that the errors identified by the appellants have been verified, as explained below. First, the appeals filed by the Public Prosecutor’s Office and the Office of the Attorney General of the Republic will be addressed; because their grounds are interrelated, they will be considered jointly and are granted for the following reasons: The appellants essentially allege that the judgment lacks adequate reasoning, in that the doubt resolved in favor of the accused was not properly explained, and that the judgment is internally contradictory, because it found proven the existence of a structure encroaching upon the protection zone (zona de protección), yet also asserted that it had not been demonstrated that the accused was the person building the house at that location.
In this regard, it must be stated that the appellants are correct, because the following can indeed be drawn from the facts found proven: “PROVEN FACTS. "On 9 de marzo del 2011, at approximately 09:20, MINAET officials from the Área de Conservación Tortuguero, next to a structure that is inside a dwelling within the protection area of a natural stream (quebrada), located at the southern boundary of Parque Nacional Tortuguero, bordering the town of Tortuguero de Colorado de Pococí, at which time the accused was warned by MINAET officials that he could not continue with the construction work. 2.- On 6 de abril del 2011, during a new inspection conducted at the aforementioned location by MINAET officials Nombre05 and Nombre06, it was found that the accused Nombre01, despite the warning given to him during the previous visit, disregarded it and continued next to the dwelling under construction, encroaching upon the stream’s protection zone, and that he failed to observe the fifteen-meter setback (retiro) from the bank, carrying out the construction at a distance of one meter from the stream, sic" (Verbatim transcription of the facts found proven in the judgment; see pages 345 verso and 346 of the case file).
As may be inferred from the foregoing, the court below found it proven that, despite the warning and the accused’s knowledge that the construction he was carrying out was encroaching upon a stream’s protection zone, he continued with it, failing to observe the 15-meter setback because the structure was located one meter from the stream. Notwithstanding the foregoing, and contradictorily, the challenged decision ordered the accused acquitted of all punishment and liability pursuant to the universal principle of in dubio pro reo, on the grounds that witnesses Nombre05 and Nombre06 observed approximately nine people at the location and that the accused was not seen performing construction work. This inference is deemed contrary to the rules of reasoned judgment (sana crítica racional), because witness Nombre05 stated that, upon arriving at the location on 09 de marzo de 2011 and asking who was in charge, the accused himself told him that he was the owner.
Nor does there appear to have been an adequate weighing of the statement given by witness Nombre06, a biologist with SINAC and MINAE, because although the decision relies on that testimony, which it characterizes as expert testimony, it finds it established that the waters flowing through the site constitute a stream. Moreover, witness Nombre08 stated that what existed at the location was stagnant water consisting of wastewater from the other houses at that site, and that, consequently, at approximately 2004 or 2005 they installed a culvert; he further stated that the accused’s house is located five meters from the water that flows toward Tortuguero. An analysis of the accused’s statement also shows that he testified similarly. Consequently, this Chamber finds that significant matters were not analyzed, because a clear and certain determination of the alleged act was necessary to establish the origin of the body of water.
It is therefore essential that the judicial authority establish, through appropriate evidence, whether it is a stream, a wetland (Humedal), or stagnant water of private origin that is not subject to State protection. In light of the foregoing, it is evident that the judgment avoids undertaking a substantive analysis and instead chose to acquit the accused on the grounds that it had not been established that he was the person building the house, because no one saw him performing construction work, without properly weighing the evidence introduced in the adversarial proceedings, as stated above. Furthermore, it is observed that the trial judge admitted the documentary evidence appearing on pages 1-3 and 5-6 of the case file, as well as the fact that the accused Nombre01 voluntarily told SINAC officials that he was the owner of the structure. Nevertheless, the Court held that this spontaneous statement should have been corroborated by evidence from the prosecuting authority and asserted that the investigation had been deficient, thereby disregarding the proper analysis of the evidence that was in fact introduced at trial and required a harmonious and comprehensive assessment, particularly because the witnesses themselves stated that the accused was asked to stop the work and that the accused himself said that he had no objection, but that it was subsequently established during the second inspection that he had not complied.
It was therefore established that on 6 de abril he was at the location and stated, together with his domestic partner, that they would not stop construction because they had already invested a great deal of money. In view of the foregoing, the judgment is deemed to contain contradictory reasoning and an inadequate assessment of the documentary and testimonial evidence, thereby contravening the obligation to conduct a harmonious and comprehensive analysis of the evidence essential to resolving the case. It must also be noted that these defects have likewise been found in connection with the dismissal of the civil action for damages (acción civil resarcitoria), because that determination resulted from an erroneous weighing of the evidence, which led to its denial because it depended on the criminal ruling. Accordingly, at the retrial, the existence or absence of a causal relationship between the construction work and whether it was carried out within the protection area of a publicly owned body of water, thereby causing environmental damage to the State, must be properly assessed.
In this regard, the decision is deemed deficient because it fails to determine with certainty whether the construction was carried out within the limits established by the Ley General de Aguas, which provides as follows: “Article 1º.- The following are waters in the public domain (aguas del dominio público): I.- The waters of the territorial seas, to the extent and under the terms established by international law; II.- The waters of coastal lagoons and estuaries that communicate permanently or intermittently with the sea; III.- The waters of naturally formed inland lakes that are directly connected to permanent watercourses; IV.- The waters of rivers and their direct or indirect tributaries, streams, or springs (manantiales), from the point at which the first permanent waters emerge until their discharge into the sea or into lakes, lagoons, or estuaries; V.- The waters of permanent or intermittent watercourses whose channel, throughout its entire length or any part thereof, serves as a boundary of the national territory, ownership of such watercourses being subject to the provisions of international treaties entered into with neighboring countries and, in the absence thereof or with respect to matters not provided for therein, to the provisions of this law; VI.- The waters of every watercourse flowing directly or indirectly into those listed in subsection V; VII.- Waters extracted from mines, subject to the limitation set forth in Article 10; VIII.- Waters from springs emerging on beaches, in maritime zones, channels, basins, or banks owned by the nation and, in general, all waters originating on publicly owned land; IX.- Groundwaters whose emergence is not achieved by means of wells; and X.- Rainwaters flowing through ravines or dry channels whose beds are in the public domain.” Or, conversely, whether they were privately owned waters (aguas de dominio privado), pursuant to the applicable law: “Article 4º.- The following waters are privately owned and belong to the landowner: I.- Rainwaters falling on the owner’s property while they flow through it.
The owner may therefore construct, within the property, ponds, marshes, cisterns, or reservoirs in which to retain them for that purpose, or employ any other appropriate means, provided that no harm is caused to the public or to any third party; II.- Lagoons or pools formed on land within the respective owner’s domain, provided that they do not fall within the circumstances contemplated in Section II of Article 1º. Those located on communal-use lands belong to the respective communities; III.- Groundwaters obtained by the owner from the owner’s own land by means of wells; and IV.- Thermal, mineral, and mineral-medicinal waters, regardless of the place where they emerge. Such waters shall remain under the control of the Secretaría de Salubridad when declared to be of public utility.” The foregoing is necessary because these are fundamental matters bearing directly upon whether the statutory elements of the offense are met (tipicidad), particularly since the issue debated during the adversarial proceedings was whether the waters constituted a stream or stagnant waters, which is essential to resolving this matter.
That issue must therefore be clearly resolved beyond all reasonable doubt, and these matters must be properly addressed at the retrial. The appeal filed by attorney Melvin Acevedo Cantón, private defense counsel for the accused Nombre04, is granted for the following reasons: The appellant states that he challenges only the order directing demolition of the structure pursuant to Article 140 of the Código Procesal Penal; that is, he agreed with the criminal and civil acquittals ordered in the judgment under appeal. In this regard, it must be stated that because this Chamber has resolved to vacate the judgment insofar as it concerns the civil and criminal acquittals, as follows from the preceding recital (considerando), the party must abide by that ruling and is therefore referred to those considerations. This is especially so because, although the appeal clearly states that it is directed solely against the demolition order, its grounds likewise refer to the failure to assess the evidence concerning whether the structure was in fact located near a stream or conservation area and in violation of the Ley Forestal.
It was precisely in this regard that the appellant offered the Hoja Cartográfica de Tortuguero, and, incidentally, although this Chamber admitted that item into evidence, it is not appropriate at this time to examine its contents in light of the manner in which this matter is being resolved. The retrial court must therefore determine with certainty whether waters protected by the State exist at that location. He further stated that the photographs on pages 4, 7, 8, and 9 were not analyzed and that no inference may be drawn from them that any watercourse or body of water exists at the location.
In this regard, it must be noted that, as held in the preceding appeals, the conclusive determination of the existence of public-domain property (bien de dominio público) was fundamental in this case; however, the judgment is silent on this matter, and it is for that reason that the judgment is being vacated as to its criminal and civil aspects and a remand trial (juicio de reenvío) is being ordered, so that the testimonial and documentary evidence may be thoroughly analyzed in accordance with the rules of rational sound judgment (sana crítica racional). Through technical or specialized evidence, it must be determined whether the stream in fact exists, whether it was recorded on the Tortuguero Cartographic Sheet, or whether that feature underwent a natural shift, as stated by the MINAE witness. All the foregoing is established because, in order to issue a fair and well-founded decision, it is necessary to determine the origin of that body of water present at the site; for this purpose, the judge even has the authority of an expert of experts (perito peritorum) and may personally inspect the site.
Accordingly, it is unacceptable to avoid those fundamental issues and instead rely on peripheral matters, such as the lack of certainty as to whether the accused owned the structure, and on that basis enter a judgment of acquittal which, as reiterated, was not adequately reasoned. Furthermore, with respect to the demolition order (orden de derribo) being challenged, it must be noted that Article 140 of the Code of Criminal Procedure establishes the restoration of things to their original condition as a precautionary and temporary measure (medida cautelar y transitoria); however, Article 367 of the same body of law provides: “Conviction. The judgment of conviction shall precisely specify the applicable penalties and, where appropriate, shall determine the conditional suspension of the sentence and the obligations with which the convicted person must comply. Convictions or penalties shall be consolidated when appropriate.
The judgment shall also decide on costs and on the delivery of seized objects to the person having the superior right to possess them, without prejudice to any claims that may be brought before the civil courts. It shall decide on forfeiture and destruction as provided by law.” An analysis of these two provisions shows that, in the case at hand, the demolition order issued should have been supported by certainty that this body of water is a stream, that it is legally protected, and that it is being affected by the encroachment into the protected area; the judgment under appeal contains no adequate reasoning on these points. It should be noted that, in environmental matters, the course most favorable to nature must be followed; therefore, if a structure was built encroaching upon a protected area, restoration to the prior condition had to be ensured regardless of the outcome of the criminal proceedings.
It is also observed that this order was not based on the civil consequences of the criminal offense, since the civil action for damages (acción civil resarcitoria) was dismissed; the appellant must therefore be found to be correct, and the judgment is accordingly vacated with respect to the demolition of the structure. Consequently, the appeals filed are granted, the judgment is vacated in its entirety, and a remand trial is ordered for new proceedings.
THEREFORE:
The appeals filed by Luis Grijalba Alfaro, attorney-at-law and prosecutor for the Public Prosecutor’s Office; Randall Aguirre Mena, attorney-at-law and Criminal-State Counsel; and Melvin Acevedo Cantón, attorney-at-law and private defense counsel for the accused Nombre04, are hereby granted. The judgment is vacated in its entirety, as to both civil and criminal matters, including the demolition order. A retrial is ordered for new proceedings. NOTICE SHALL BE GIVEN.

Resolución: 2020-1002 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, al ser las catorce horas cincuenta minutos del diecinueve de junio de dos mil veinte.- RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra Nombre01, mayor, costarricense, cédula de identidad número CED01, nacido en Limón, Pococí, Barra del Colorado, el 23 de enero de 1976, hijo de Nombre02 y Nombre03, casado, de oficio Guía Turístico, vecino de Limón, Pococí, Barra del Tortuguero, Dirección01; por el delito de INVASIÓN A UNA ZONA PROTEGIDA, en perjuicio de LOS RECURSOS FORESTALES. Intervienen en la decisión las jueza Elizabeth Montero Mena, Alejandra Valenciano Chinchilla y el juez Roy Antonio Badilla Rojas. Se apersonaron en esta sede el licenciado Luis Grijalba Alfaro, fiscal del Ministerio Público; licenciado Randall Aguirre Mena, en representación de la Procuraduría General de la República y el licenciado Melvin Acedo Cantón, defensor particular del encartado.
RESULTANDO:
I.Que mediante sentencia número 318-2019, de las dieciséis horas del quince de mayo de dos mil diecinueve, el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, resolvió: "POR TANTO: De conformidad con los artículos 39 y 41 de la Constitución Política; 8.2 de la Convención Americana sobre Derechos Humanos; 11 de la Declaración Universal de Derechos Humanos; 14.2 del Pacto Internacional de Derechos Civiles y Políticos; 1, 2, 3, 11, 103 INC 1 30, 31, 45, 50, 59 al 63, 71, 76, 103 y 124 del Código Penal; 1, 2, 3, 9, 37, 40, 111 a 124, 140, 141, 142, 180 a 184, 265, 267, 328, 330 a 336, 341, 352, 360 a 365 y 366 del Código Procesal Penal, artículos 33 Y 58 inciso a de la Ley Forestal, 1045 del Código Civil, 122, 124, 127 de las reglas vigentes sobre responsabilidad civil del Código Penal de 1941, 45 y 18, EN APLICACIÓN DEL PRINCIPIO UNIVERSAL INDUBIO PRO REO, SE ABSUELVE DE TODA PENA Y RESPONSABILIDAD AL SEÑOR Nombre01, por el delito de Invasión a una Zona de Protección cometido en perjuicio de los recursos naturales y el medio ambiente.
Se ordena el desalojo de las personas que se encuentren habitando la construcción situada en Tortuguero propiamente la descrita en el informe de folio 1 al 2, para lo cual se le delegar á a la Municipalidad de Pococí y a la Fuerza Pública constatar el desalojo de las personas que ahí habiten dentro de los 15 días siguientes a la firmeza. Se ordena el derribo de la construcción y la restitución de las cosas a su estado original, para lo cual se delegará a la Municipalidad de Pococí que lo realizará una vez verificado el desalojo de las personas que habiten en dicha construccion. Asimismo, se absuelve al imputado Nombre01 de los hechos que se le venían acusando en la querella incoada por la Procuradur ía General de la República, así como se declara sin lugar la acción civil resarcitoria seguida en contra del imputado Nombre01, no se condena en costas procesales y personales, corriendo éstas por cada una de las partes." (sic).
II.Que contra el anterior pronunciamiento, el licenciado Luis Grijalba Alfaro, fiscal del Ministerio Público; licenciado Randall Aguirre Mena, en representación de la Procuraduría General de la República y el licenciado Melvin Acedo Cantón, defensor particular del encartado, interpusieron recurso de apelación.
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.
Redacta el juez de Apelación de Sentencia Penal Gillen Bermúdez; y,
CONSIDERANDO:
I.Los licenciados Luis Grijalba Alfaro fiscal del Ministerio Público, Randall Aguirre Mena Procurador Penal y Melvin Acevedo Cantón defensor particular del imputado Nombre04, interpusieron recurso de apelación de sentencia penal contra de la resolución N° 318-2019 de las 16:00 horas, del 15 de mayo de 2019, dictada por el Tribunal de Juicio del II Circuito Judicial de la Zona Atlántica, sede Pococí. Dado que se ha determinado que existe legitimación objetiva y subjetiva de los recurrentes, así como que las impugnaciones han sido presentadas en tiempo, se entra a conocer sus motivos.
II.Recurso del licenciado Luis Grijalba Alfaro, fiscal del Ministerio Público. PRIMER MOTIVO: "Contradicción entre el elenco de hechos probados y los hechos no probados, en clara y franca violación al art. 363 inc. C) y 459 del Código Procesal Penal". Indica que, la sentencia tuvo como hechos probados la existencia de la construcción que invade la zona de protección y, como hechos no probados que el imputado se encontrara construyendo la casa en ese lugar. Lo anterior, demerita el dicho de los testigos Nombre05 del SINAC, quien al apersonarse al lugar en fecha 09 de marzo de 2011, vio a 9 personas construyendo, preguntó quien era el encargado y el propio imputado dijo que él era el dueño. La testigo, Nombre06, vecina del encartado y Bióloga del SINAC y MINAE, conoce que esa casa le pertenece al acusado y a su pareja Nombre07. Por su parte, la testigo de descargo Nombre08, manifestó que la vivienda en construcción era del encartado, que ella lo fue a visitar a ese lugar, porque le comentaron del problema que tenía con la construcción del inmueble, por estar muy cerca de la quebrada (a lo cual ella llamó agua estancada).
Sin embargo, el Tribunal estimó que no se había acreditado que el imputado fuera quien estaba construyendo, pues nadie lo vio halando sacos, como que si fuera necesario que el dueño o contratante tenga que participar en la obra con sus propias manos batiendo la mezcla. SEGUNDO MOTIVO: "Inconformidad con la valoración de la prueba". Aduce que el a quo incurrió en una violación a las reglas de la sana crítica, lo cual contraviene lo dispuesto por los numerales 142, 184, 363 y 459 del Código Procesal Penal. Estima que la sentencia se contradice al tener como hechos probados, la existencia de una construcción que invade la zona de protección y como hechos no probados, que el imputado se encontrara construyendo la casa en ese lugar. Reitera lo dicho por los testigos Nombre05, Nombre06 y Nombre08. Indicando el a quo que nadie vio al encartado realizar la construcción con sus propias manos, como si la Municipalidad otorgara permisos para halar sacos o batir mezcla, máxime que ninguno de los habitantes de la zona poseen títulos de propiedad a su nombre, por lo que estima que se tuvieron por demostrados los hechos que se acusaron y consecuentemente, no era necesario que hubieran visto al endilgado realizando las obras en el lugar, sino que se debió considerar que en la primera inspección, este se identificó como la persona encargada y se le hizo la advertencia de que debía paralizar la obra, debido a la invasión que se ocasionaba al margen del arroyo; un mes después se realizó otra diligencia similar y se encontró en el lugar al imputado y su pareja, así como a las testigas Nombre06 y Nombre08, la primera ubicó al imputado como habitante del inmueble y la segunda, dijo que la casa la construyó el acusado.
Aduce que la fundamentación contradictoria radica en la consideración del verbo rector por parte del juzgador, pues “construir”, se interpreta alejándose del tipo penal “invadir”, a pesar de que con la prueba testimonial y documental se corrobora la pertenencia de la obra del acusado, y no como parece haberlo entendido el Tribunal, en el sentido de se trataban de indicios anfibológicos. Considera que lo anterior demuestra que la sentencia resulta de un análisis intelectivo probatorio, contradictorio e insuficiente, forzando una salida in favor rei que no corresponde a la verdad de los hechos. Solicita declarar con lugar el recurso, anular la sentencia y ordenar el juicio de reenvío para nueva fundamentación, únicamente en lo relativo a la culpabilidad del encausado, pero dejando en firme el derribo del bien inmueble.
III.Recurso del licenciado Randall Aguirre Mena, Procurador Penal. Con fundamento en lo dispuesto por los numerales 39 y 41 de la Constitución Política, 458, 459, 460 del Código Procesal Penal, interpuso recurso de apelación en contra la sentencia número 318-2019, dictada por el Tribunal Penal de Guápiles. El artículo 458 del Código Procesal Penal establece que son apelables todas las sentencias dictadas en fase de juicio y que resuelven los aspectos penales y civiles. En ese sentido, el numeral 459 del Código de cita, regula la procedencia del recurso de apelación de sentencia, a efecto de analizar el fallo de manera integral. Dado que en el presente asunto se ha determinado que existe legitimación objetiva y subjetiva, pues la Procuraduría General de la República, intervino en el proceso como querellante y actor civil, así como que ambas impugnaciones han sido presentadas en tiempo, se entra a conocer sus motivos.
ÚNICO MOTIVO: "FALTA DE FUNDAMENTACIÓN INTELECTIVA Y ERRADA VALORACIÓN DE LA PRUEBA AL ABSOLVER AL IMPUTADO Y DECLARAR SIN LUGAR LA ACCIÓN CIVIL". Acusa violación a los numerales 142, 182 y 184 del Código Procesal Penal. Refiere que, en la presente causa se le atribuyó al imputado el haber realizado una construcción sin contar con algún tipo de permiso, la cual se encuentra invadiendo el área de protección de una quebrada que discurre en el lugar. El Tribunal sustenta la absolutoria del imputado por duda, señalando que no se determinó que él estuviera realizando la construcción y, recurre a la prueba testimonial pero no hace una valoración correcta de la documental. Además aduce que, no se valoraron de manera armónica y correcta los oficios ACTOGASP- CYP-D004 de fecha 13 de marzo del 2011 -folios 1 al 3-, así como el ACTOGASP-PNTSubAd-010-11 de fecha 06 de abril de 2011, -folios 5 al 10-, con la demás prueba testimonial de cargo.
En cuanto al primer informe citado el de folios 1 al 3 consta que a pesar que en el lugar se observó en la construcción a nueve personas trabajando, con mezcladora y cemento, también se precisa que el imputado Nombre01 era quien se acercó y voluntariamente indicó a los funcionarios del SINAC que era el dueño de la construcción, también se hace referencia que se procedió a solicitarle que detuviera la obra y que el mismo imputado expresó que no tenía inconveniente en paralizar los trabajos hasta que se procediera con la resolución de la denuncia. Estos dos aspectos dan cuenta que, a pesar que en el sitio habían nueve personas trabajando, es el acusado el que se identifica como dueño y que está anuente a detener los trabajos. Estima que de esa manera se descarta la tesis del Tribunal, en el sentido de que como habían nueve personas en el lugar, se debía indagar quién estaba a cargo de los trabajos.
El testigo Nombre05 afirmó en el debate que el dueño de la construcción era el imputado y que se encontraba en el lugar durante los trabajos el día que realizaron la primera visita, aspectos que no fueron ponderamos por el Tribunal sentenciador. En cuanto al segundo oficio, de folios 5 al 10 del expediente, en el mismo se consigna que el día 6 de abril (casi un mes después de la primera visita) se ubicó en el lugar a los dueños de la obra, quienes afirmaron que no iban a dejar de construir, pues ya habían invertido mucho dinero. Sobre este aspecto la deponente Nombre06 señaló que el señor Nombre01, se encontraba ese día en el sitio y se identificó como el dueño de la construcción, al igual que en la fotografía que consta a folio 8, tomada el día de la mencionada visita. Además refirió de la existencia de sacos de arena en el lugar, por lo que estima que es claro que, quien estaba invirtiendo dinero en la construcción eran los dueños.
Considera que, de dicha prueba se deriva que el imputado todavía se encontraba en el lugar de la construcción casi un mes después de la primera visita, de las fotografías de folios 8, 9 y 10 se observa una obra en construcción y sacos de cemento. Aduce que, el Tribunal no analizó los aspectos referidos, respecto a la prueba documental y testimonial, ni tampoco lo que afirmó la testigo de la defensa Nombre08, quien declaró que el imputado Nombre09 vive en el lugar con Nombre07 quien es la presidenta de la Asociación de Desarrollo, con lo que se acreditó que la obra fue finalizada y que actualmente el imputado vive en el lugar. Estima que el fallo se basa en un análisis fragmentado de la prueba y concluye de manera errada la existencia de una duda, a pesar de que tal y como se describe en la querella y la acusación, la obra se encontraba invadiendo la zona de protección, incurriendo con ello el Tribunal en una clara vulneración del deber de fundamentación del fallo.
Además aduce que, se declaró sin lugar la acción civil resarcitoria, pese a haber acreditado que el imputado fue quien edificó la obra y que la misma se encuentra invadiendo una zona de protección, únicamente se indicó que se declaraba sin lugar porque no se determinó que el acusado fuera quien realizó la construcción, aspecto que fue derivado de una errada valoración probatoria, lo anterior a pesar de que se realizó dentro de un área de protección y sin ningún tipo de permiso, además de que se acreditó el daño ambiental y la relación de causalidad entre la existencia de la edificación dentro del área de protección y el daño ambiental. Solicita declarar con lugar el recurso, anular parcialmente el fallo recurrido en lo que ha sido objeto de impugnación, ordenado un reenvío para que se proceda a resolver los yerros apuntados y a emitir una sentencia ajustada a derecho.
IV.Recurso del licenciado Melvin Acevedo Cantón, defensor particular del imputado Nombre04. El recurrente interpuso recurso de apelación contra la sentencia Numero 318-19, dictada en forma integra y oral a las 16:00 horas del 15 de mayo de 2019, mediante la cual se absolvió a su representado en aplicación del principio de in dubio pro reo, indica que interpone la impugnación contra la disposición que ordena el derribo de la obra, conforme el artículo 140 del Código Procesal Penal. PRIMER MOTIVO: Indica que existe una ausencia de valoración de la prueba, la cual llevó a conclusiones equivocadas, para finalmente ordenar el derribo de la obra. El recurrente transcribe los hechos probados de la siguiente manera. ""Numero 1. - Que el dia nueve de junto del dos mil once, al ser aproximadamente las nueve horas veinte minutos, funcionario del MINAE del Area de Conservación Tortuguero, sorprendieron al acusado Nombre01, junto a una vivienda en construcción que se encontraba dentro del área de protección de una quebrada natural, ubicada en el límite sur del Parque Nacional Tortuguero.
Numero 2.- Que el día seis de abril del dos mil once, en una nueva inspección realizada en el lugar antes citado por los funcionarios del MINAE Nombre06, se encontró que el acusado Nombre01 a pesar de la advertencia que se le había hecho ... (palabra ininteligible por grabacion defectuosa) la desconoció y continuó junto a la vivienda que estaba en construcción, invadiendo la zona de protección de la quebrada, ya que no respetó el retiro de los quince metros de la ribera de la división (palabra en apariencia por grabación defectuosa) de la construcción, estando esta construcción a una distancia de un metro de la quebrada" sic. (Cita textual del recurso del impugnante, ver folio 358 del expediente). Indica que se tuvo por probado que la construcción se encuentra próxima a una quebrada, lo cual constituye una infracción a la Ley Forestal que se endilga al imputado y que, originó la orden de derribo.
Además se determinó la existencia de una quebrada, al considerar que se trata de un área de conservación. Considera que no se realizó un análisis suficiente de la prueba al referirse a un cuerpo de agua como un quebrada o arroyo, solamente se indicó que la testigo es Bióloga, con experiencia y que acreditó que se trataba de una quebrada, que su dicho no fue desvirtuado. Considera que no se examinó adecuadamente si se trata de una quebrada, para establecer que la construcción está cerca de la misma y que nos encontramos ante lo dispuesto por el artículo 33 de la Ley Forestal, pero sin analizar realmente su dicho, por lo que considera que existe una ausencia total de fundamentación en el análisis de esta prueba. SEGUNDO MOTIVO: Indica que en realidad lo que dijo la testigo aludida en el motivo precedente, no fue examinado, a pesar de que ella indicó que tenía una vasta experiencia, y una gran formación, incluso a nivel internacional pero en realidad no fue conteste en sus respuestas, acerca de la definición del cuerpo de agua objeto de las preguntas.
Tenemos que según su criterio, las quebradas "tienen mucha corriente", pero eso se desdice con la prueba documental, las fotografías visibles a los folios 4, 7, 8 y 9, que no fueron examinados por el Juzgador, y de las cuales se puede inferir con facilidad que no existe ninguna corriente, al grado de que incluso es difícil determinar que allí exista algún, cuerpo de agua. Además, aún y cuando resto merito a la declaración de la testigo Nombre08, lo cierto es que no cuestionó la veracidad de su dicho, sino únicamente lo confrontó con la versión de la Bióloga y funcionaria del MINAE que, también declaró como testigo, pero si observamos la deposición de Nombre06, se observan falencias, no obstante ser profesional en la materia, manifestó que se trata de una quebrada, a pesar de que al describir inicialmente en que consistía cada uno de esos cuerpos de agua, indicó que las quebradas "tienen mucha corriente”.
Tenemos entonces que la versión de la Bióloga Nombre06, ya no solo se contradice con lo que muestran las fotografías sino que se contrapone con el dicho de la señora Nombre08 que aduce que se trata de aguas estancadas. Y dado que la versión de doña Nombre08 coincide con las fotografías en el sentido de que las aguas no tienen corriente, sino que simplemente discurren por la parte más baja del terreno, sobre todo cuando llueve, máxime después de que los funcionarios del MINAE confeccionaron un zanjo en el lugar e instalaron una alcantarilla, en lo también coincide doña Nombre06 Bióloga, que admitió tener conocimiento de la colocación de ese dispositivo en el lugar. Considera que la declaración de la señora Nombre06, no demostró la fortaleza o firmeza, como se podía esperar de una persona catalogada por el juzgador como de gran conocimiento y experiencia, respecto a si en el sitio se ubicaba una quebrada, sino que se limitó a indicar que a ella le parece que sí, pero no lo afirmó de manera contundente, sino en tono dudoso, lo que nuevamente otorga la razón a dona Nombre08, inclusive a una pregunta del Procurador respondió que era una quebrada pero al señor Juez le indicó que ya no estaba segura de ello.
Estima que, esas afirmaciones dejan serias dudas de la capacidad de la testigo para tomarla como base de la existencia de una circunstancia que tendrá como consecuencia el derribo de una obra constructiva. Se entiende que efectivamente Ios sistemas naturales se mueven, pero no así Ios datos consignados en las hojas cartográficas. Si bien la quebrada puede ya no estar en el sitio donde originalmente se encontraba, en la hoja cartográfica siempre se encontrara en el sitio donde se ubicó. Aduce que no se puede esperar otra cosa, como lo pretende la Bióloga testigo, pues sería irracional pensar en que lo que en los años setentas se dibujo en la Hoja Cartográfica, ya no va a estar en ahí, porque el sistema natural se movió. Y sobre este aspecto existe un ausencia de análisis en la sentencia, lo que lleva al juzgador a declarar la existencia de la quebrada per se, pero lo cierto del caso, es que la quebrada no existe en dicho registro oficial.
Si es que en la realidad natural se movió, que es lo que pretende hacer creer la testigo, debería evidenciarse en el mapa cartográfico, pero ello no es así. Indica que, lo relativo a la Hoja Cartográfica de Tortuguero surgió durante el debate a raíz de las preguntas realizadas por el señor Procurador de la República y el señor Juez, por tanto la ofrece como prueba para mejor resolver en alzada, a efectos de demostrar que la quebrada en cuestión no existe en el lugar. TERCER MOTIVO: Refiere que la Ley de Aguas, exige que la Dirección Nacional de Aguas lleve un inventario de los cuerpos de agua mediante el sistema de información hidrológica, al cual debe recurrirse para determinar la existencia o no de unos de esos cuerpos. Sobre ese aspecto, el testigo Nombre05 declaró que no se pidió esa información porque era evidente que se trata de una quebrada, estima que el declarante tuvo una actitud totalmente evasiva, al grado de que el Juzgador tuvo que pedirle que contestara las preguntas, por lo que a pesar de tener conocimiento de la existencia del registro de cuerpos de agua, y de la obligatoriedad de consultar el mismo no se hizo, por lo que considera que esa omisión sugiere la inexistencia de la quebrada, máxime que no logró indicar cuál era el origen, dónde se originaban sus aguas.
CUARTO MOTIVO: Aduce que la orden de derribo, sustentada en el artículo 140 del Código Procesal Penal, permite el retorno de las cosas a su estado original, pero únicamente como medida cautelar y además de manera transitoria. Bajo esa perspectiva, no precede la orden de derribo de la obra, pues no se trata de una medida cautelar provisional, por lo que solicita que así se declare. QUINTO MOTIVO: Considera que el derribo de la obra, no se trata de una medida cautelar por lo que debe fundamentarse en uno de dos aspectos: en las consecuencias civiles del hecho punible, o en las consecuencias penales del mismo. Al haberse declarado sin lugar la acción civil resarcitoria, no corresponde la orden de derribo como consecuencia civil del hecho punible, por lo que solo queda como fundamento de esa orden como consecuencia penal. Para ello, debió haber sido acreditado sin lugar a dudas que en efecto nos encontramos ante la infracción al artículo 33 de la Ley Forestal, y para la configuración de ese tipo penal debió demostrarse la existencia de la quebrada, que es precisamente el bien jurídico tutelado como recurso hídrico.
No sólo no se configuró el tipo penal, sino que no existen las consecuencias del mismo, es decir, no existe violación de zona protegida, por lo que tampoco desde la perspectiva de las consecuencias del ilícito procede la orden de derribo. Solicita se declare con lugar el recurso de apelación, por falta de fundamentación de la sentencia por errónea valoración de la prueba, únicamente en lo que concierne a la existencia de una quebrada, y se revoque exclusivamente en lo que corresponde a la orden de derribo. Ofrece como prueba la Hoja Cartográfica de Tortuguero, para demostrar la inexistencia de la quebrada. Indica que se ofrece en este momento por cuanto fue durante el debate que surgió la existencia del mismo, a raíz de preguntas de la Procuraduría General de la República y del juzgador, además del testimonio de Nombre10, Biólogo, vecino de Tortuguero de Colorado de Pococí, cédula CED02, quien en su condición profesional se referirá a si el cuerpo de agua objeto de este proceso constituye quebrada o riachuelo.
Este testimonio se ofrece por cuanto el único fundamento de la sentencia para determinar la existencia de la quebrada lo es la versión de una Bióloga, cuyas afirmaciones fueron contradictorias no solo consigo mismas, sino con otros elementos probatorios.
V.Con respecto a la prueba ofrecida en esta sede, consistente en una hoja cartográfica de la región de Tortuguero, con la finalidad de demostrar la inexistencia de la quebrada en cuestión en el lugar, así como la declaración testimonial del señor Nombre10, Biólogo y vecino de Tortuguero, se resuelve: Se admite para estudio la Hoja Cartográfica de la región de Tortuguero por considerar que el ofrecimiento se encuentra amparado a lo dispuesto por el artículo 464 del Código Procesal Penal, en el tanto esta Cámara está facultada para recibir prueba en orden al examen integral del fallo y en este caso fue un elemento que surgió del contradictorio tal y como lo explica la parte. Sin embargo, no ocurre lo mismo respecto a la declaración testimonial que se ofrece del señor Nombre10, Biólogo y vecino de Tortuguero, pues no consta en autos que su testimonio fuera arbitrariamente rechazado y tampoco que apareciera como novedoso con posterioridad a la sentencia o bien que, aunque existiendo previamente, no estuviera la parte en posibilidad efectiva de ofrecerlo en su momento. En razón de lo anterior se rechaza dicho testimonio.
VI.Los recursos se declaran con lugar: Una vez que esta Cámara ha procedido a realizar la revisión integral de la sentencia oral impugnada y que consta en el escritorio virtual, en el archivo digital 110008990485PE-EV-Multi-0 cuya fundamentación intelectiva puede escucharse a partir del minuto 26:00, ha llegado a la determinación de que los yerros que exponen los impugnantes se han logrado verificar, tal y como de seguido se expone. En primer término se abordarán los recursos interpuestos por el Ministerio Público y de la Procuraduría General de la República, cuyos motivos se conocerán de manera conjunta por encontrarse relacionados entre si y se declaran con lugar, por lo siguiente: Los recurrentes reclaman esencialmente una falta de fundamentación de la sentencia, en el sentido de que la duda que favoreció al justiciable no fue adecuadamente razonada, además de que la sentencia es contradictoria en si misma, pues se tuvo por probada la existencia de una construcción que invadía la zona de protección, pero por otra parte se adujo que no se demostró que fuera el imputado quien se encontraba construyendo la casa en ese lugar.
Al respecto ha de indicarse que llevan razón los impugnantes pues efectivamente de los hechos tenidos por probados se extrae: “HECHOS PROBADOS. "El día 9 de marzo del 2011, al ser aproximadamente las 09:20, funcionarios del MINAET del Área de Conservación Tortuguero, junto a una construcción que esta dentro de una vivienda dentro del área de protección de una quebrada natural, ubicada en el límite sur del Parque Nacional Tortuguero, límite con el pueblo de Tortuguero de Colorado de Pococí, por lo que en ese momento el acusado fue apercibido por los funcionarios del MINAET de que no podía continuar con la obra constructiva. 2.- El día 6 de abril del 2011, en nueva inspección realizada en el lugar antes citado por los funcionarios del MINAET Nombre05 y Nombre06, se encontró que el acusado Nombre01 a pesar de la advertencia que se le habla hecho en la visita anterior, la desconoció y continúo junto a la vivienda que esta en construcción invadiendo la zona de protección de la quebrada, y que no respeto el retiro de los quince metros de la ribera realizando la construcción a una distancia de un metro de la quebrada, sic" (Transcripción literal de los hechos tenidos por probados en la sentencia, ver folios 345 vuelto y 346 del expediente).
Tal y como se deduce de lo anterior, el a quo tuvo por demostrado que, a pesar de la advertencia y el conocimiento que tenía el encausado de que la construcción que estaba realizando se encontraba invadiendo la zona de protección de una quebrada continuó con la misma, no respetando el retiro de 15 metros, ya que la obra se ubicaba a un metro de la quebrada. A pesar de lo anterior y de manera contradictoria la resolución impugnada dispuso absolver al encausado de toda pena y responsabilidad en aplicación del principio universal de in dubio pro reo, bajo la justificación de que, en el lugar los testigos Nombre05 y Nombre06 observaron aproximadamente a nueve personas y que el acusado no fue visto realizando labores propias de construcción, deducción que se estima contraria a las reglas de la sana crítica racional, pues el testigo Nombre05, refirió que al apersonarse al lugar en fecha 09 de marzo de 2011 y, preguntar sobre quién era el encargado, el mismo imputado le manifestó que él era el dueño.
Así, tampoco se aprecia una adecuada ponderación del dicho de la testigo Nombre06, Bióloga del SINAC y MINAE, pues a pesar de que la resolución se asienta en ese testimonio, el cual califica como experto tiene por acreditado que las aguas que discurren en sitio constituyen una quebrada. Por otra parte, respecto al testimonio de Nombre08, quien manifestó que en el lugar lo que existía era agua estancada, residuales provenientes de las demás casas que hay en ese sitio, por lo que aproximadamente en el 2004 o 2005 colocaron una alcantarilla, que la casa casa del acusado se ubica a cinco metros del agua que corre y va hacia Tortuguero. Además del análisis de la declaración del encausado se denota que depuso en sentido similar; consecuentemente, esta Cámara evidencia falta de análisis de aspectos trascendentales, pues la determinación clara y certera del hecho acusado, era necesaria a fin de establecer el origen del cuerpo de agua, así es indispensable, que la autoridad jurisdiccional a través de prueba idónea, establezca si se trata de una quebrada, un Humedal o bien agua estancada de origen privado, que no esta sujeta a la protección del Estado.
En razón de lo anterior, se evidencia que el fallo elude entrar a realizar un análisis de fondo y, se decantó por absolver al encartado bajo el argumento de que no se había acreditado que fuera él quien estaba construyendo la casa, pues nadie lo vio realizando labores propias de construcción, pero sin ponderar debidamente la prueba allegada al contradictorio, tal y como se ha indicado. Por otra parte, se observa que el juzgador tuvo por incorporada prueba documental que consta a folios 1-3 y 5-6 del expediente, así como también que el imputado Nombre01 manifestó voluntariamente a los funcionarios del SINAC que era el dueño de la construcción; sin embargo, el Tribunal consideró que esa manifestación expontánea debió haber sido respaldada con prueba por parte del ente acusador y aduce que existió una deficiente investigación, soslayando así el análisis correcto de la prueba que si se judicializó y que exigía una ponderación armónica y conjunta, máxime que los mismos testigos manifestaron que se procedió a solicitarle al encausado que detuviera la obra y que el mismo imputado expresó que no tenía inconveniente, pero posteriormente, ya en la segunda inspección se pudo establecer que no había cumplido, por lo que se estableció que el 6 de abril él se ubicaba en el lugar y manifestó, junto a su compañera de vida que no iban a detener la construcción, pues ya habían invertido mucho dinero.
En virtud de lo anterior, se estima que el fallo contiene una fundamentación contradictoria, así como la inadecuada valoración de la prueba documental y testimonial, contraviniendo así, la obligación de realizar un análisis armónico y conjunto de la prueba que resulte esencial para la resolución del caso. Además debe indicarse que, estos vicios también se han detectado en relación a la declaratoria sin lugar la acción civil resarcitoria, pues, dicha determinación es producto de una ponderación errónea de la prueba, lo cual incidió en la denegatoria al ser esta dependiente de lo penal, por lo que en el juicio de reenvío deberá ponderarse de manera adecuada la existencia o no de esa relación de causalidad, entre la obra de construcción y, si esta se realizó dentro del área de protección de un cuerpo de agua de dominio público que causó daño ambiental al Estado. Al respecto se estima que la resolución es omisa en cuanto a determinar a ciencia cierta, si la construcción se realizó dentro de los límites dispuestos por la Ley General de Aguas, que al respecto indica: “Artículo 1º.- Son aguas del dominio público: I.- Las de los mares territoriales en la extensión y términos que fija el derecho internacional; II.- Las de las lagunas y esteros de las playas que se comuniquen permanente o intermitentemente con el mar; III.- Las de los lagos interiores de formación natural que estén ligados directamente a corrientes constantes; IV.- Las de los ríos y sus afluentes directos o indirectos, arroyos o manantiales desde el punto en que broten las primeras aguas permanentes hasta su desembocadura en el mar o lagos, lagunas o esteros; V.- Las de las corrientes constantes o intermitentes cuyo cauce, en toda su extensión o parte de ella, sirva de límite al territorio nacional, debiendo sujetarse el dominio de esas corrientes a lo que se haya establecido en tratados internacionales celebrados con los países limítrofes y, a falta de ellos, o en cuanto a lo no previsto, a lo dispuesto por esta ley; VI.- Las de toda corriente que directa o indirectamente afluyan a las enumeradas en la fracción V; VII.- Las que se extraigan de las minas, con la limitación señalada en el artículo 10; VIII.- Las de los manantiales que broten en las playas, zonas marítimas, cauces, vasos o riberas de propiedad nacional y, en general, todas las que nazcan en terrenos de dominio público; IX.- Las subterráneas cuyo alumbramiento no se haga por medio de pozos; y X.- Las aguas pluviales que discurran por barrancos o ramblas cuyos cauces sean de dominio público”.
O bien, si por el contrario se trataba de aguas de dominio privado, conforme lo dispuesto por la normativa: “Artículo 4º.- Son aguas de dominio privado y pertenecen al dueño del terreno: I.- Las aguas pluviales que caen en su predio mientras discurran por él. Podrá el dueño, en consecuencia, construir dentro de su propiedad, estanques, pantanos, cisternas o aljibes donde conservarlas al efecto, o emplear para ello cualquier otro medio adecuado, siempre que no cause perjuicio al público ni a tercero; II.- Las lagunas o charcos formados en terrenos de su respectivo dominio, siempre que no se esté en el caso previsto en la Sección II del artículo 1º. Los situados en terrenos de aprovechamiento comunal, pertenecen a los pueblos respectivos; III.- Las aguas subterráneas que el propietario obtenga de su propio terreno por medio de pozos; y IV.- Las termales, minerales y minero-medicinales, sea cual fuere el lugar donde broten.
Dichas aguas quedarán bajo el control de la Secretaría de Salubridad cuando sean declaradas de utilidad pública.” Lo anterior, por considerar que estos son aspectos fundamentales que inciden directamente en la tipicidad del delito, máxime que la discusión en el contradictorio versó acerca de si se trataba de una quebrada o de aguas estancadas, lo cual resulta esencial para la resolución de este asunto, pues debe dilucidarse ese tema claramente y lejos de toda duda razonable, aspectos deben abordarse de manera adecuada en el juicio de reenvío. El recurso del licenciado Melvin Acevedo Cantón, defensor particular del imputado Nombre04, se declara con lugar por lo siguiente: El recurrente aduce que, interpone la impugnación únicamente contra la disposición que ordena el derribo de la obra conforme el artículo 140 del Código Procesal Penal, es decir, que mostró conformidad con la sentencia absolutoria penal y civil que se dispuso en el fallo venido en alzada.
Al respecto debe indicarse que, debido a que esta Cámara esta resolviendo anular la sentencia en lo que respecta a la absolutoria civil y penal, tal y como se desprende del anterior considerando, la parte debe estarse a lo ahí dispuesto, por tanto se le remite a dichas consideraciones, máxime que, a pesar de que el recurso es claro en el sentido de que se dirige únicamente en contra de la orden de derribo, de igual manera en sus motivos hace referencia a la ausencia de valoración de la prueba, en cuanto a que efectivamente la construcción se encontrara próxima a una quebrada, un área de conservación e infringiendo la Ley Forestal, y es precisamente a ese respecto que el recurrente ofreció la Hoja Cartográfica de Tortuguero, que dicho sea de paso, a pesar de que esta Cámara admitió ese elemento como prueba, en realidad en este momento no resulta pertinente examinar su contenido, dada la manera en la que se está resolviendo, por lo que será el Tribunal de reenvío quien deberá determinar a ciencia cierta la existencia o no de aguas protegidas por el Estado en ese lugar.
Además refirió que, no se analizaron las fotografías de folios 4, 7, 8 y 9, de las cuales no es posible inferir que exista alguna corriente o cuerpo de agua en el lugar. Al respecto ha de indicarse que, tal y como se resolvió en los recursos precedentes, la determinación certera de la existencia de un bien de dominio público era fundamental en este caso; sin embargo, el fallo es omiso al respecto y es por esa razón que se está anulando la sentencia en su parte penal y civil y se está ordenando el juicio de reenvío, con la finalidad de que la prueba testimonial y documental sea analizada ampliamente y de conformidad con las reglas de la sana crítica racional, donde deberá determinarse, a través de prueba técnica o especializada, si dicha quebrada existe en la realidad, si fue registrada en la Hoja Cartográfica de Tortuguero ó bien si existió un movimiento natural de ese elemento tal y como lo indicó testigo del Minae.
Todo lo anterior, se establece así, porque para poder emitir una resolución justa y fundada, es necesario establecer el origen de ese cuerpo de agua, presente en el lugar, para lo cual incluso el juzgador tiene cualidades de perito peritorum y puede concurrir incluso a inspeccionar el lugar. Por ende, no es de recibo que se eludan esos temas que son fundamentales y se recurra a elementos periféricos, tales como que no hay certeza de si el acusado era el dueño de la obra y así disponer una sentencia absolutoria, que tal y como se reitera no ha sido debidamente razonada. Por otra parte, en lo que respecta a la orden de derribo que se está impugnando, ha de indicarse que el artículo 140 del Código Procesal Penal, estable establece la restitución de las cosas al estado original como una medida cautelar y transitoria; pero el numeral 367 del mismo cuerpo legal, establece: “Condenatoria. La sentencia condenatoria fijará, con precisión, las penas que correspondan y, en su caso, determinará la suspensión condicional de la pena y las obligaciones que deberá cumplir el condenado.
Se unificarán las condenas o las penas cuando corresponda. La sentencia decidirá también sobre las costas y sobre la entrega de los objetos secuestrados a quien tenga mejor derecho para poseerlos, sin perjuicio de los reclamos que correspondan ante los tribunales civiles. Decidirá sobre el comiso y la destrucción, previstos en la ley”. Analizando estas dos normas, se tiene que el caso que nos ocupa la orden de derribo dictada debía estar motivada al amparo de la certeza de que, ese cuerpo de agua, corresponde a una quebrada, que tiene protección legal y está siendo afectada por la invasión que se hizo de la zona protegida, extremos sobre los cuales no existe una adecuada motivación en el fallo venido en alzada. Nótese que, en materia ambiental se debe estar a lo más favorable para la naturaleza, de modo que si se hizo una construcción invadiendo una zona de protección, independientemente del resultado en lo penal debía garantizarse que las cosas regresaran a su estado anterior.
También se observa que dicha disposición no se fundó en las consecuencias civiles del hecho punible ya que la acción civil resarcitoria fue declarada sin lugar, motivo por el cual debe darse razón al impugnante, por ende se anula la sentencia en lo que respecta al derribo de la obra. En consecuencia se declaran con lugar los recursos de apelación interpuestos, se anula la sentencia en todos sus extremos y se ordena el juicio de reenvío para nueva sustanciación.
POR TANTO:
Se declaran con lugar los recursos de apelación interpuestos por el licenciado Luis Grijalba Alfaro, fiscal del Ministerio Público, el licenciado Randall Aguirre Mena, Procurador Penal y el licenciado Melvin Acevedo Cantón, defensor particular del imputado Nombre04. Se anula la sentencia en todos sus extremos, civiles y penales, así como en lo que respecta a la orden de derribo. Se ordena el juicio de reenvío para nueva sustanciación. NOTIFÍQUESE.
