Decision: 2020-0938 Case file: 11-000707-0573-PE (7) CRIMINAL JUDGMENT APPEALS COURT. Second Judicial Circuit of San José. Goicoechea, at eleven forty-five a.m., on June tenth, two thousand twenty.
APPEALS filed in the present proceeding brought against Nombre01, who is of legal age, Costa Rican, holder of identity card number CED01, born in Guanacaste, Bagaces, on 01 de marzo de 1952, son of Nombre02 and Nombre03, divorced, farmer, resident of Heredia; against Nombre04, who is of legal age, Nicaraguan, holder of identity document number CED02, born in Nicaragua on 04 de setiembre de 1966, son of Nombre05 and Nombre06, married, farmer, resident of Heredia; and against Nombre07, who is of legal age, Nicaraguan, holder of identity document number CED03, born in Nicaragua on 19 de marzo de 1966, daughter of Nombre08 and Nombre09, homemaker, resident of Heredia; for the offenses of ENCROACHMENT UPON A PROTECTION ZONE and UNLAWFUL OCCUPATION, to the detriment of NATURAL RESOURCES and another party. Judges Rosaura Chinchilla Calderón, Patricia Vargas González, and Kathya Jiménez Fernández participated in deciding the appeals. The following appeared before this Court: Luis Salazar Álvarez, public defender for the convicted defendant Nombre01; Margot Avellán Ruiz, in her capacity as criminal-law counsel for the State; Otto Giovanni Ceciliano Mora, as special judicial attorney-in-fact for the private complainant (querellante), Nombre10; and Diana De la O Ferllini, as public defender for the accused Nombre04 and Nombre07; and, BACKGROUND:
I.By judgment number 33-2020, issued at seven a.m. on February tenth, two thousand twenty, the Tribunal Penal de Heredia, Sede Sarapiquí, ruled: "Por tanto: In accordance with the foregoing, applying the rules of sound rational judgment (sana crítica racional) and Articles 8 subsections 1 and 2) of the American Convention on Human Rights; 10 and 11 of the Universal Declaration of Human Rights; 9 subsection 2 and 14 subsection 2) of the International Covenant on Civil and Political Rights; 36, 39, 41, 50 and 89 of the Constitución Política; 1, 2, 3, 4, 11, 12, 13, 14, 18, 19, 20, 30, 33, 34, 103 and 225 subsection 1) of the Código Penal; Articles 33, 58 subsections a) and c), and Article 61 subsection a) of Ley Forestal 7575; Article 100 of the Ley de Conservación de Vida Silvestre; Articles 122, 123 and 124 of the Código Penal de 1941; Article 1045 of the Código Civil; Arancel de Honorarios por Servicios Profesionales de Abogacía y Notariado Decreto Ejecutivo N° 36562; and Articles 1, 2, 3, 4, 9, 11, 12, 16, 28, 40, 70, 71,111,112,113,119, 140,142,184, 265 to 267, 360 to 366 and 488 of the Código Procesal Penal, in deciding this matter, the Court concludes that the proper disposition is to acquit Nombre01 of all punishment and liability for ONE offense of ILLEGAL LOGGING; ONE offense of ILLEGAL USE OF FOREST PRODUCTS; and ONE offense of DISCHARGES, offenses established and punishable under Articles 58 subsection c) and 61 subsection a) of Ley Forestal and Article 100 of the Ley de Conservación de la Ley de Vida Silvestre, because the criminal action is time-barred (prescripción de la acción penal); that the proper disposition, under the in dubio pro reo principle (Principio In dubio Pro Reo), is to acquit Nombre01, Nombre04, and Nombre07 of all punishment and liability for ONE offense of UNLAWFUL OCCUPATION established and punishable under Article 225 subsection 1) of the Código Penal, to the detriment of Nombre11; and that the proper disposition, under the in dubio pro reo principle, is to acquit Nombre01 of all punishment and liability for ONE offense of ENCROACHMENT UPON A PROTECTION AREA, to the detriment of NATURAL RESOURCES.
The CIVIL ACTION FOR DAMAGES (ACCIÓN CIVIL RESARCITORIA) brought by the PROCURADURÍA GENERAL DE LA REPÚBLICA against CIVIL DEFENDANT Nombre01 is GRANTED; he is ordered to pay economic damages, with the amount left UNDETERMINED (ABSTRACTO) for assessment during enforcement of the judgment, and CIVIL DEFENDANT Nombre01 is ordered to pay attorney’s fees and costs pursuant to fee decree 36562, with the amount left UNDETERMINED for assessment during enforcement of the judgment. As a consequence of the civil judgment, and because the litigation was conducted under the PRO NATURA PRINCIPLE (PRINCIPIO PRO NATURA), the affected area is ordered restored to its condition prior to the act by the DEMOLITION of ONE CONSTRUCTED TWO-STORY DWELLING, 40% of which lies within the protection area of a stream, and the DEMOLITION OF ONE DWELLING, 80% of which lies within the protection area of a stream, as well as the demolition of the wooden bridges at the site and the cultivated areas surrounding the unnamed stream.
Officials of the Sistema Nacional de Áreas de Conservación de la Cordillera Volcánica Central, together with the person in possession of the property, Nombre12, who represents TRANSUNION S.A, and personnel of the Fuerza Pública, are ordered to demolish the portions of those structures once the criminal judgment becomes final. Let notice be given." (sic, pages 708 to 731).
II.Luis Salazar Álvarez, as public defender for defendant Nombre01; Margot Avellán Ruiz, in her capacity as criminal-law counsel for the State; and Otto Giovanni Ceciliano Mora, as special judicial attorney-in-fact for the private complainant, Nombre10, appealed the foregoing ruling.
III.After conducting the corresponding deliberation in accordance with Article 465 of the Código Procesal Penal, the Court considered the issues raised in the appeal.
Opinion drafted by Judge Chinchilla Calderón; and,
CONSIDERING:
I.Admissibility and jurisdiction. A) Luis Salazar Álvarez, public defender for defendant Nombre01; Margot Avellán Ruiz, criminal-law counsel for the State; and Otto Giovanni Ceciliano Mora, special judicial attorney-in-fact for the private complainant, Nombre10, filed appeals against the judgment rendered in these proceedings. The appeals were filed through reasoned briefs submitted to the trial court within the statutory period. It should be noted that the first two were filed on 06 de marzo de 2020, as shown on pages 734 and 736, and the last on 09 de marzo de 2020, as shown on page 747; because the full judgment was issued on 17 de febrero de 2020, as shown on page 732, the fifteen-business-day period did not expire until 09 de marzo de 2020. They must therefore be admitted without any further formalities, as otherwise the mandate established in Article 8.2.h of the American Convention on Human Rights and the ruling of the Inter-American Court of Human Rights in Nombre13 v. Costa Rica, judgment of 02 de julio de 2014, would be violated.
Accordingly, the decision must be deemed final with respect to the acquittal of Nombre01, on the ground that the criminal action was time-barred, of the offenses of illegal logging, illegal use of forest products, and one offense of discharges. That portion is therefore no longer subject to challenge because it was not contested, and this panel’s jurisdiction is limited to the other issues raised by the private complainants and the civil defendant (Articles 446 and 444 of the Código Procesal Penal).
II.Licenciada Margot Avellán Ruiz, the complainant prosecutor (procuradora querellante) in the present case, states, as the sole ground for her appeal, her disagreement with the assessment of the evidence and the failure to observe the rules of sound judicial reasoning (sana crítica), which resulted in Nombre01’s acquittal of the offense of encroachment upon a protection zone (invasión a una zona de protección). After unnecessarily setting out the facts supporting the private complaint (querella) and the decision adopted, as well as the statutory provisions and case-law commentary concerning the offense at issue (folios 736 to 740), she states that, in this case, the accused encroached upon the protection zone of an unnamed stream by constructing and occupying a two-story house and a shack used as a kitchen, where he continues to reside to date; the trial judge found this last circumstance proven because all the witnesses who appeared at trial so stated.
She briefly describes what each witness said. Thus, Nombre14 allegedly stated that the defendant remained in the area, that he saw him removing boards for construction and building houses, and that he did so approximately ten meters from the stream, in addition to allegedly entering the property belonging to Transunión. Nombre15 and Nombre16, MINAE officials, allegedly conducted the inspections and detected the two structures (the shack used as a kitchen and the two-story house located seven meters from the stream). During the first visit, the defendant’s brother and a laborer who said that he had been hired by the accused were present; during the second visit, after the shack used as a kitchen had already been removed, the defendant was inside the dwelling, at which time warnings were issued to him. According to the appellant, the prosecution witnesses maintained that the defendant continues to possess the area, and he said the same in his trial testimony.
She argues that, although it has been stated that many people have unlawfully occupied the property belonging to Transunión S.A., including the defendant’s father, this does not exempt the defendant from liability, because he extended his property beyond the lanes marked as boundaries. She criticizes the judge’s finding that there was an unavoidable mistake as to an element of the offense (error de tipo invencible) because the defendant was unaware of the legal prohibition against building there until the year 2014. The appellant contends that this was not so, because the copies of expediente 09-29-507-AG (an ordinary agrarian action for recovery of property between the defendant and the company Transunión S.Nombre17.), which were admitted into evidence at trial, would establish that he had been warned that he could not continue girdling and cutting down trees and that, in the judgment issued in that proceeding in the year 2009, he was ordered to refrain from clearing undergrowth from trees or forest resources near springs (nacientes) and streams.
According to the judge, this would demonstrate that he did not know that he was required to obey the authorities, which the appellant criticizes because the defendant has been in constant contact with environmental and judicial authorities since 2009 and therefore cannot plead ignorance of the law. She maintains that the mistake cannot be deemed unavoidable when it is considered that the accused was formally questioned on 02 de febrero de 2013 and that, consequently, by the second inspection in 2014, when he remained in the house that had been built in 2011, he was already aware that his conduct was unlawful. She considers the judgment acquitting him of that offense to be unsupported and requests that the defendant’s acquittal of the offense of encroachment upon a protection zone be reversed and the case remanded for a new trial (reenvío). During the oral hearing, the State representative maintained the same arguments and expressed agreement with the remainder of the decision, including the civil action and the restoration of matters to their previous condition, requesting that the remainder of the decision be left undisturbed.
Licenciado Otto Giovanni Ceciliano Mora, special judicial attorney-in-fact for Nombre10, who in turn represents Transunión S.A. and has appeared as a private complainant (querellante), argues in the second section of his appeal—which, for reasons of order and thematic affinity, will be considered before the first—that the judgment is contradictory, lacks a statement of reasons, and improperly assesses the evidence concerning the offense of encroachment upon the protection zone. He states that, according to the trial judge, the statutory elements of the offense (tipo penal) of encroachment upon a protection zone were not established because of a mistake as to an element of the offense (error de tipo), since, as an intentional offense, it required the accused to have knowledge of and intent to engage in his unlawful conduct; in this matter, however, it was not established that Nombre01 knew that he was encroaching upon a protection zone, which led him to believe that his conduct did not constitute an offense.
Nevertheless, the appellant states, the court did not objectively assess the evidence in reaching that conclusion; instead, its scrutiny focused solely on that issue, and it therefore failed to provide adequate reasons. He complains that the judgment stated that it was impossible to establish who had built the kitchen and the two-story house in the protection zone, while the same decision found Nombre18 credible when he stated that the persons who erected the buildings, cut down trees, and performed other work within the property of Transunión S.A., which he represents, were Nombre04 and Nombre01, rendering the decision contradictory. He further notes that the court failed to consider the testimony of forestry engineer Nombre19, who stated that in 2011, when he went to the complainant entity’s property to conduct an inspection, he determined that there was a shack near an unnamed stream and that waste was being discharged into it.
On that occasion, he also noted that there was a two-story house located seven meters from the stream and that, in rural areas, structures cannot be located within 15 meters and, in urban areas, within 10 meters, and therefore those structures violated the law. Accordingly, the witness stated that he informed Nombre20 of what had occurred and issued the same warning to the defendant Nombre01, advising him that he had to eliminate the discharge of water into the stream and remain outside the 15-meter setback, which that person had still not done nine years later. The witness also stated that he returned in 2014 and again warned the defendant to remove the two-story house and other works. He asserts that the judge did not even mention this evidence and that it establishes that the defendant did know that he had built in the protection zone, meaning that no mistake as to an element of the offense existed.
The appellant makes additional comments, to similar effect, concerning the evidence provided by the witness Nombre16 and the inspection in which he participated, which would corroborate the defendant’s aforementioned knowledge because many of his communications were directed to a person (Nombre20) who identified himself as the defendant’s laborer. The appellant states that, had those three witnesses’ testimony been considered, that decision would not have been adopted. He requests that a new trial on remand be ordered so that the matter may be duly heard. During the oral hearing, he reiterated those arguments. In responding to the appeals, defense counsel Salazar Álvarez, in a filing at folio 765, requested that they be denied because the acquittal complied with all procedural guarantees and the evidence received at trial failed to establish that his client was the person who built a two-story dwelling and encroached upon the protection zone.
The SINAC officers stated only that, during one of the visits in 2014, they saw him in the area in question, but they did not advise him of any of his constitutional rights or issue any warning other than that he was not to discharge wastewater into the stream; consequently, he lacked the “…knowledge of the unlawful conduct required by the statutory elements of the offense.” He further states that the evidence established that those who originally moved into the area and built there were other persons, including the defendant’s father, who lived there with other children and whom the defendant visited only occasionally. He explains that the judge made no error in his judgment and that the arguments raised in the appeals therefore have no legal “hacidero” [basis] (sic!, see reverse side of folio 765). The appeals must be granted. In the present matter, a written judgment was issued and appears at folios 708 to 731; as stated in the preceding section, it addresses various issues, both criminal and civil, concerning three persons and different offenses.
Some of those issues—those relating to the statute of limitations on the criminal action (prescripción de la acción penal)—were not appealed, and therefore, irrespective of whether the decision was correct, this chamber lacks jurisdiction to examine them. Of the judgment’s 47 pages, the first 20 are devoted to the descriptive statement of reasons (fundamentación descriptiva), consisting of transcriptions of the public and private charges, the civil action, and the summary of the evidence received orally, as well as a reference to the documentary evidence admitted. Those initial pages also address the ruling on the statute of limitations governing the criminal action for other offenses (tree cutting, exploitation of forest products, and discharge of sewage). Beginning at folio 718, the judge sets out what he calls the “descriptive statement of reasons” (although it is not such, because he devotes it to setting out what he considers to be unproven facts, which entails a judicial assessment; it therefore is not a description, which presupposes the presentation of information without judging its content), listing facts not proven; beginning on the front of folio 719, he commences what should have been the legal analysis and assessment of the evidence.
The court divides its evidentiary scrutiny by “offenses,” and the discussion concerning encroachment upon the protection zone thus begins on the front of folio 725 and ends on the front of folio 728. As to this offense, the decision was based on the existence of a “mistake as to an element of the offense”; it should be stated at the outset, however, that Judge Segura Hernández’s application of this doctrine reflects a lack of understanding of substantive criminal-law doctrine, because he repeatedly confuses a mistake as to an element of the offense—which must concern the person’s contemporaneous knowledge of the objective elements of the offense—with awareness of unlawfulness (conocimiento de la ilicitud), which is potential knowledge giving rise to a direct mistake of prohibition (error de prohibición directo), without addressing the differing effects of avoidability and unavoidability (vencibilidad e invencibilidad) as between the two doctrines.
Nor is this issue developed by any of the appellants, whose arguments focus on evidentiary matters. To illustrate the foregoing and thus explain how that misunderstanding of the theory of the offense (teoría del delito) produced a decision based on erroneous reasoning that cannot stand, it is appropriate first to consider the statutory definition at issue, namely Article 58(a) of the Ley Forestal, which provides: “A term of imprisonment of three months to three years shall be imposed upon anyone who: (a) Encroaches upon a conservation or protection area, regardless of its management category, or upon other forest areas or lands subject to the forestry regime, regardless of the area occupied and irrespective of whether they are privately owned lands belonging to the State or other agencies of the Public Administration or privately owned lands. The perpetrators of or participants in the act shall not be entitled to any compensation for any structure or work that they have constructed on the encroached-upon lands.” Consequently, if a mistake as to an element of the offense consists of a mistaken understanding of its objective elements, any of the following could be unknown to the perpetrator for that doctrine to apply: (a) that he is encroaching (for example, the person believes that he is entering his own property); (b) that he is entering a conservation or protection area (he does not know that the area has that status); (c) that he is entering a forest area (he does not understand the concept of forest, a legal normative element of the offense [elemento normativo del tipo]); or (d) that he is entering land subject to the forestry regime (he likewise does not understand this normative element of the offense).
Because the offense under discussion is an intentional offense (tipo doloso), an avoidable mistake as to an element of the offense (error de tipo vencible) negates intent (dolo) and gives rise to negligence (culpa) if there is a corresponding negligent offense (tipo culposo paralelo), which does not exist in the case at issue; the conduct would therefore be atypical (atipicidad). A mistake as to unlawfulness (error de prohibición), by contrast, when direct, is one in which the perpetrator knows what he is doing (he knows that he is building in a protection zone (zona de protección), for example) but believes that such conduct is not a crime. If that false belief is avoidable, it reduces the sentence, but if it is unavoidable, it negates culpability (culpabilidad). In the present case, the trial judge’s reasoning for making that determination was as follows (quoted at length to demonstrate the contradictions and errors): “...there is uncertainty as to whether defendant Nombre01 is criminally responsible for the offense of Encroachment upon a Protection Zone, since both the documentary evidence and the prosecution and defense testimony raise the question of whether defendant Nombre01 had full knowledge of the offense based on the actions carried out by SINAC (Sistema Nacional de Áreas de Conservación) officials with respect to the subjective element of the offense (elemento subjetivo del tipo penal); that is, whether he encroached upon a protected area based on information of which he may have become aware in 2011, when SINAC officials inspected the site and warned a third party that he had to remove the kitchen that was discharging water into the unnamed stream, on the property belonging to the injured party, Nombre12, as representative of the company TRANSUNIÓN S.A. Also relevant are the events involving Nombre02 from 2007 to 2009, which appear in the agrarian case file, for purposes of determining whether defendant Nombre01 knew the constituent elements of the offense (elementos integrantes del tipo penal).
In this Judge’s opinion, and as will be explained, the prosecution’s theory was not established, due to the existence of a mistake as to an element of the offense. According to the Public Prosecutor’s Office’s theory, as (sic) a consequence of his intentional conduct, defendant Nombre01 constructed two buildings in 2007 within the protection zone of an unnamed stream, seven meters away (one of them a kitchen), on the property located in la Virgen de Sarapiquí, land belonging to TRANSUNIÓN S.A, represented by the injured party Nombre12, who represents TRANSUNIÓN S.A. The testimonial and documentary evidence, assessed in light of reasoned sound judgment (sana crítica racional), revealed uncertainty regarding the identity of the person who encroached upon that land in 2007. The year 2007 has generated uncertainty as to whether the dispossession (usurpación) of the property in question occurred in that precise year because, as has been explained, it was clear that Nombre01’s father, Nombre02, encroached upon TRANSUNIÓN S.A’s property.
Indeed, all the testimonial and documentary evidence indicates that Nombre02 encroached upon (dispossessed) TRANSUNIÓN S.A’s property; that the company’s representative, Nombre12, who represents TRANSUNION S.A, entered into negotiations with the encroachers, including Nombre02 and Nombre21, to resolve the dispute; and that one of the agreements was that Nombre01 and his brother Nombre01, bearing the same surnames, were instructed not to continue girdling and sawing trees. The latter failed to comply, and TRANSUNIÓN S.A, represented by Nombre12, who represents TRANSUNION S.A, therefore initiated agrarian proceedings (proceso agrario) for the damage caused to the property. This is demonstrated by the fact that, in 2007, Nombre12, who represents TRANSUNION S.A, permitted Nombre02 to live in the disputed area. The question this Court therefore asks is: Who was the person obligated to understand the implications of not encroaching upon the protected zone?
Was it Nombre02 or his son Nombre01? The testimonial evidence indicates that it was the former, since Nombre14 stated, as Nombre18 also confirmed, that the person who encroached upon that land was Nombre02. Based on that premise, he was the person obligated to understand the implications of his actions; why, then, is Nombre01 being held to account for allegedly encroaching upon the protection zone of an unnamed stream? The record also included the document concerning the inspection of TRANSUNIÓN’s property by the Agrarian Judge, who recorded in 2009 that he was familiar with the property and that the buildings belonged to Nombre02, one of them being two stories high. Thus, in 2009, the person living at that location was Nombre02, not Nombre01, as confirmed by Nombre18, who explained that Nombre01 occasionally visited his father. At trial, defendant Nombre01 admitted that he purchased an area of land from his father, Nombre02, as shown by documents contained in the agrarian case file bearing a certification of date certain (razón de fecha cierta) (folio 123 of volume I of case file 09-09-000029-507-AG).
This document was prepared (sic) in May 2008, one year after the encroachment upon the protection zone alleged by the Public Prosecutor’s Office, creating doubt as to whether defendant Nombre01 was aware, first, of the objective element of the offense (elemento objetivo del tipo penal) and, consequently, of the subjective element of the offense of encroaching upon a protection area in 2007, as charged. The Court considered defendant Nombre01’s circumstances: he is a person with no schooling who, when providing his personal details, stated that he could neither read nor write and that he works in agriculture. These particular circumstances of the defendant may have limited his ability to understand the implications of the offense with which he was charged. It is well known that there is a principle that no one may plead ignorance of the law, but every principle has its exception, and in criminal-law cases a special situation such as the foregoing must be carefully assessed in order to establish the subjective liability (responsabilidad subjetiva) of an accused person.
Based on the documentary and testimonial evidence, these circumstances may establish whether the defendant was aware of the offense. Did Nombre01 have full knowledge of his liability given those personal circumstances, or did his knowledge arise from the agrarian proceedings? Agrarian ruling N° 122-09 of the Agrarian Court of the Second Judicial Circuit of the Atlantic Zone (folios 283 to 287, case file 09-000029-507-AG, volume I), which adjudicates a provisional measure (medida cautelar) (sic), states in its operative portion: In accordance with the foregoing and with the cited laws and case law, the provisional measure requested by plaintiff TRANSUNIÓN S.A in the ordinary proceedings (proceso ordinario) brought under case file 09-000029-507-AG against Nombre02, Nombre01, and Nombre01 IS GRANTED: 1/ Refrain from girdling, felling, or clearing undergrowth around trees or forest resources within the property at issue in the litigation. 2/- Refrain from sawing timber in the forested area and in areas near springs (nacientes) and streams within the land in question (...) The foregoing is ordered with the warning that certified copies shall be forwarded for prosecution for the offense of Disobedience to Authority in the event of noncompliance.
This action is decided without a special award of costs. This ruling shall be personally served upon defendants Nombre02 and Nombre01 at their residence in Chilamate de la Virgen de Sarapiquí, quinientos metros este del Super Maguiver, for which purpose the Centralized Service Office of the Second Judicial Circuit of the Atlantic Zone is commissioned. Let notice be given. Licda. Silvia E. Sánchez Blanco. The record also contains the certificate of service upon Nombre01 at folio 294 of the agrarian case file. At that time, defendant Nombre01 was aware of the offense of disobedience to authority, not of encroachment upon the protection area of a stream; his circumstances may have limited his ability to understand what his obligations before a judicial authority were. Was it not incumbent upon the Agrarian Judge, with all the evidence in his possession and his knowledge of the law, to warn that there were huts near an unnamed stream, that this situation violated forestry laws, and, from that point onward, to instruct Nombre02 or his children not to encroach upon that area?
The Court raises this question, and the resulting uncertainty therefore benefits defendant Nombre01. But the fact creating even greater uncertainty as to defendant Nombre01’s knowledge of the offense concerns the statements of Nombre16 and Nombre19, public officials of the Sistema de Áreas de Conservación who went to the disputed area to investigate the complaint of dispossession filed against Nombre01. They testified at trial that they visited TRANSUNION S.A’s property on two occasions, the first in 2011 and the second in 2014. During the first inspection, Nombre01 was not present; instead, they encountered a Nicaraguan national who told them that he had been living on the property for at least two years. During the 2011 inspection, however, they confirmed the existence of two huts, one of which contained a kitchen that discharged water into the unnamed stream. They therefore warned that person that he had to remove the kitchen to prevent pollution of the unnamed stream.
That warning appears in report DS-1251-11 of October 10, 2011, the fourth paragraph of which states: The kitchen area lies within the stream’s protection area (2 meters), and soapy water and wastewater are discharged directly into the unnamed stream. At the time of the inspection, Nombre22, a Nicaraguan national, was found at the site; he stated that he had been on the property for two years and was instructed to divert both the wastewater and the soapy water away from the stream. It was the SINAC officials themselves, who are thoroughly familiar with forestry offenses, who did not warn at that time that the huts were encroaching upon the protection area of an unnamed stream; moreover, they issued the warning to a third party who apparently lived at the site, rather than directly to Nombre01. The Court’s question is whether, given the defendant’s personal circumstances and complete lack of schooling, he had full knowledge of the objective and subjective elements of the offense with which the Public Prosecutor’s Office charged him.
It was not until 2014 that SINAC officials again visited TRANSUNIÓN’s property and verified that the kitchen had been removed; it was then that they warned Nombre01 that he was encroaching upon the protection zone of an unnamed stream. These events demonstrate two things: the Public Prosecutor’s Office alleged that the encroachment upon the protected area occurred in 2007, but the defendant was not warned about the offense in question until 2014; there was a mistake as to an element of the offense that negates the elements of the offense (tipicidad), because it was uncertain whether the defendant fully understood the scope of the offense, which protects the legally protected interest (bien jurídico penal) of Natural Resources. Based on the descriptive elements (elementos descriptivos), the conduct attributed to defendant Nombre01 cannot be found to constitute the specific offense of encroachment upon a protection zone.
The mistake as to an element of the offense arose in this case from Nombre01’s lack of awareness that a foundational element of the legal prohibition of that conduct (encroachment) was present. He did not become fully aware of it until 2014, and it therefore entirely negates intent, since knowledge of all the elements of the definition of the wrongful act (tipo de injusto) is required. Nombre01 remained at the site under the mistaken belief that his conduct did not meet the requirements of a criminal offense; as stated above, it was the SINAC officials themselves who, in 2011, warned a third party that he had to remove the kitchen, even though they knew that a protection zone was being encroached upon at that time.” The uncertainty also stems from whether, given his personal circumstances, the accused (imputado) Nombre01 fully understood the warning issued in 2011 and its effects, since the charging document (acusación) states that, as late as 2013, Nombre01 continued to encroach upon the protection area (área de protección) of an unnamed stream, although no one had warned him of this at that time.
In accordance with the foregoing, for a mistake as to the elements of the offense (error de tipo) to prevail, the person acting must have a false perception, mistakenly believing that his conduct does not constitute a criminal offense; this is what occurred with Nombre01, as shown by the documentary and testimonial evidence. The author Francisco Muñoz Conde, in his book Teoría General del delito, tells us (…) In the present case, because of his personal circumstances, the accused Nombre01 could not even have suspected that he was committing an offense; he knew only of the agrarian proceeding against him, which required him to comply with a judge’s order under warning that failure to do so would constitute the offense of disobedience. This, coupled with the errors committed by SINAC officials in failing to inform him that he was encroaching upon the protection area of an unnamed stream, made it impossible, based on his knowledge, for him to know that he was committing an offense.
In this case, the mistake was unavoidable (error invencible), since the accused Nombre01 could not overcome his lack of awareness of the unlawful act so as to have acted with criminal intent (dolo). The unavoidability arises in this case from the factual theory (hipótesis fáctica) charged by the Public Prosecutor’s Office (Ministerio Público), namely, that in 2007 the representative of the company TRANSUNIÓN S.A, Mr. Nombre12, according to the action for recovery of possession (demanda reivindicatoria) in agrarian proceeding 09-000029-507-AG, volume I, allowed the trespasser Nombre02 to occupy part of the property until the action for recovery of possession was resolved, while Nombre01 and Nombre01, both surnamed Nombre01, were warned not to continue causing damage (clearing underbrush, girdling, and sawing trees). How, then, could Nombre01 have possessed the property and thereby have encroached upon the protection area of an unnamed stream?
In other words, he was unaware of the objective elements of the offense (elementos objetivos del tipo penal) under the Ley Forestal.» (Cf. folios 725 to 728; emphasis added). Note, first, that the substantive issue—for example, mistakes under the theory of criminal liability (teoría del delito)—presupposes that the proven facts (hechos probados) have been determined, and this, in turn, entails weighing all the evidence in accordance with the rules of sound judicial reasoning (sana crítica), without disregarding any evidence, either wholly or partially, and deriving each finding from the evidence. In the present matter, the first thing that stands out is that the judge did not undertake this evidentiary scrutiny, since he selectively cited certain items but failed to weigh the remainder or explain why he did or did not find them credible (as, for example, in the case of the various prosecution witnesses and judicial inspections).
On the other hand, he stated that “…there was uncertainty as to the identity of the person who encroached upon those lands in 2007…,” which shifts the decision to evidentiary issues rather than issues of substantive legal doctrine. But, as though the foregoing were not enough—and sufficient to set aside the ruling—he subsequently and repeatedly conflated a mistake as to the elements of the offense with a mistake as to unlawfulness (error de prohibición), erroneously assuming that the authorities must even warn individuals whether or not their conduct is criminal, which is absurd. Note that the reference to the defendant’s personal circumstances and whether he knew that he was committing an offense pertains to awareness of the prohibition, that is, to a direct mistake as to unlawfulness (error de prohibición directo). It is precisely here that the content of a constitutional rule—which is not a principle—comes into play (“no one may plead ignorance of the law”: article 129, second paragraph, of the Political Constitution), which also sets forth the exception: “unless the law itself so permits”; it is therefore not unconstitutional for the Criminal Code to “permit” ignorance of the law to be asserted through a mistake as to unlawfulness.
Nevertheless, in this matter the judge repeatedly shifted from stating that the defendant was unaware of the objective elements of the offense—without specifying the particular elements to which he was referring—to referring to ignorance of the offense or the prohibition, which are different matters, and even went so far as to refer to ignorance of the objective and subjective elements of the offense, which does not exist. Since Costa Rica is a state governed by the rule of law (Estado de Derecho), in which the justice system is governed by the principle of legality (principio de legalidad) and proceeds from the maxim iura novit curia, when disregard for that maxim becomes evident, the entire body of legality (bloque de legalidad) is affected and prejudice (gravamen) is caused to the party, who is then left unaware of the criteria by which the matter is being decided, which can only be those contained in the law.
Accordingly, the conceptual confusion displayed by the judge in the cited ruling, together with the other defects arising from the omission of evidence (preterición probatoria), means that, for these reasons, both grounds must be upheld and the judgment acquitting Nombre01 of the offense of encroachment upon a protected area must be vacated, with the case remanded to a newly constituted trial court (órgano de mérito) for such action as may be appropriate under the law. In so ruling, this chamber does not prejudge the type of decision to be adopted, but only the need for that decision to be fully reasoned and for its reasoning to be derived from the evidence presented and assessed in accordance with the rules of sound judicial reasoning, so that a final resolution may be reached in the dispute, which has already continued for nearly a decade.
III.Attorney Otto Giovanni Ceciliano Mora, special judicial attorney-in-fact (apoderado especial judicial) for Nombre10, who represents the private prosecutor (querellante), Transunión S.A., complains in the first section of his appeal of the lack of reasoning (falta de fundamentación) and the erroneous assessment of the evidence (valoración de la prueba) that led to the acquittal of defendants Nombre01, Nombre04, and Nombre07 on the offense of unlawful dispossession (usurpación). He argues that the trial court (a quo) reached that decision by granting full credibility to Nombre18 and Nombre14, but that the latter could not state with certainty that Nombre01 had unlawfully dispossessed his principal of the property, even though the witness stated that he had seen that defendant building a house and cutting down trees. The court based its doubt on the fact that the father of defendant Nombre02 and other persons had invaded the property.
The appellant considers that theory erroneous and the judgment contradictory, because the witness stated that he had seen defendant Nombre02 building and cutting down trees with a chainsaw on his principal’s property, yet the judgment did not address his testimony in its entirety. For his part, Nombre14 referred to who lived in those houses (Nombre01 and Nombre04), stated that they were the ones who had built the houses, and said that he knew the track separating the two properties, which those structures had crossed because Nombre01 moved the boundary markers (mojones). He further stated that both were located on his principal’s property, specifically in a forested area and within the protected area (área de protección). He asserts that the evidence was analyzed only partially, as it was used solely to support the existence of doubt. Citing the provision alleged to have been violated on the merits, he notes that the offense of unlawful dispossession may be committed in various ways, but in this case he emphasizes the clandestine conduct described in subsection 1 and all the elements set forth in subsection 2 of Article 225 of the Criminal Code, none of which were even analyzed by the judge.
He requests that the ruling be vacated and the case remanded (reenvío). During the oral hearing held on his motion, he reiterated those arguments. In responding to this appeal, defense counsel Salazar Álvarez, in a filing at page 765, requested its dismissal because the evidence had been properly assessed, since the acts of interference (actos perturbatorios) had been committed by other persons more than 28 years ago. Attorney de la O Ferlini likewise requested the same outcome for her two clients, arguing that the assessment of the evidence was correct because only Nombre18 stated, based on conjecture, that her clients must have been the ones who built on and invaded the property by moving the boundary markers; however, he said this not because he knew it to be true, but because he was assessing possibilities, presumptions of authorship, and value judgments. She therefore requests that particular attention be paid to the recordings of this testimony, concluding that the witness provided no reliable information establishing who had carried out those acts.
Even the property foreman, Nombre14, said that he did not know her clients. The complaint is well-founded. The judgment begins its examination of the facts concerning unlawful dispossession at page 719. Although the judgment does not contain a list of proven facts (but only of facts not proven), it sets forth there a fact of great importance to the offense of unlawful dispossession (and, because a judgment constitutes a logical and legal whole, the established events may appear anywhere in the decision and not necessarily under a section bearing that title), namely: “At trial, it was established that agrarian possession (posesión agraria) belongs to the company TRANSUNIÓN S.A., based on the testimony of Nombre14, who works as the manager of that property and stated that he has worked for Nombre12 for more than 32 years and that they have engaged in agricultural activities since that time, and that years ago certain persons unlawfully occupied an area of the property designated as a forest zone.
Those persons disregarded the tracks and boundary markers placed to demarcate Nombre12’s property, and local residents knew that the company TRANSUNION S.A. exercised possession of the property, which was demarcated by tracks and boundary markers. This was corroborated by the witness Nombre18, who testified during the adversarial proceedings that approximately 28 to 29 years ago he and other persons invaded a property adjacent to the property at issue, and that later the father of Nombre01, known as Nombre02, unlawfully occupied the property belonging to Nombre12, disregarding the property’s tracks and boundaries. The Court found it established that Nombre12’s property was devoted to agricultural production (orange groves) and that one portion of forested mountain land was protected; all of this appears not only in the criminal case file but also in the agrarian case file…” The foregoing is relevant because the offense of unlawful dispossession protects possession, not ownership or formal title (as the judge erroneously states on the front of page 720).
This is so not because this appellate panel says it is, nor because hundreds of judicial decisions or scholarly texts say so, but for the simple reason that Article 225 of the Criminal Code so provides when it states, by way of example in subsection 1, “deprives another, wholly or partially, of possession or occupancy…” Nevertheless, contradictorily, the trial court immediately states on the reverse of page 719: “…the only fact established at trial with respect to Nombre01 was that he remained on a small area adjacent to an unnamed stream; this despite his statement at trial that he held rights to that real property. In exercising his right of defense, Nombre01 argues at trial that he is protected by a private document recognizing him as the possessor not only of that small area of land but of approximately 6 or 7 hectares, according to a private instrument donating possession of property, a document that, unlike the documents submitted by the company TRANSUNIÓN S.A., appearing at pages 6 to 7 and 9, has neither a cadastral survey nor a registry certification providing public notice to third parties.
Those documents do not prove that Nombre01 is the agrarian possessor of the property; what was established beyond any doubt is that Nombre01 remains on the property and has structures along an unnamed stream.” (Bold added). Thus…if the private prosecutor possesses the property, as the judge found established, and it was also proven that the defendant remains on the property and has structures there…how can it be asserted, without contradiction, that there was no unlawful dispossession? It should be noted that remaining on the property and having structures there are forms of exercising possession over real property that the same judge said was possessed by the other party, and that the documents produced by defendant Nombre01 in support of his purported right were not valid for that purpose. It should also be noted that the following statement renders the judge’s reasoning legally inexplicable: “The legally protected interest in these cases is not merely possession of a property, but its agricultural use or production for subsistence or economic exploitation; Nombre01’s only agricultural activity was maintaining a few banana and black plantain plants along the edge of the unnamed stream and some small paths at the boundaries of the disputed area, as recorded in the reports issued by SINAC (National System of Conservation Areas) officials at pages 22 and 23 of case file 11-000707-573-PE, volume I.” What is the legal or doctrinal basis for that assertion?
From what part of the statutory offense (tipo penal) contained in Article 225 of the Criminal Code does the judge derive the conclusion that the offense of unlawful dispossession is committed only when agricultural or economic exploitation exists? He does not explain it, nor does this appellate panel understand it. Those assertions required the judge to examine why Nombre02’s continued presence and possession of structures on the property did not constitute dispossession (despojo) of the private prosecutor’s possession, which he never did; that alone is sufficient to vacate the decision. With respect to the other co-defendants (coencartados), the judgment is equally confusing. To demonstrate this, it is enough to quote the following paragraph appearing at page 721: “…with respect to Nombre04 and Nombre07, no witness observed them committing acts of unlawful dispossession; indeed, Nombre04 and Nombre07 were linked to the events years after the unlawful dispossession apparently occurred.
The witness Nombre18 observed Nombre04 building houses on the victim’s property and stated as follows: ‘…Nombre01 and Nombre04 was the one who built that house…’ This does not permit an inference or presumption that Nombre04, much less Nombre07, had the criminal intent (intención dolosa) to clandestinely dispossess the property; there may have been many reasons for their presence on the property. Indeed, the witnesses Nombre18 and Nombre14 themselves stated that lots on that property had been sold to third parties, which could explain Nombre04’s and Nombre07’s continued presence on the injured party’s land. It cannot be asserted that Nombre04 and Nombre07 clandestinely dispossessed Nombre12 of the property, because the only time they were identified was pursuant to an order issued to OIJ officers by the prosecutor in charge on March 22, 2013 (report 054-DM/ORS-13); at that time, the investigative acts were directed toward Nombre01, and during those inquiries both defendants were found in a shack, pages 53 to 61.” (Bold added).
Why does building houses on land possessed by other persons not imply an intent to dispossess them? Probably because, once again, the judge confuses natural intent devoid of normative assessment (dolo natural o avalorado)—knowing and understanding that one is building a house and doing so on land possessed by another person—with knowledge of unlawfulness (conocimiento de la ilicitud)—believing that one has permission to do so or that no offense is being committed because one is exercising a right derived from title or is unaware of the prohibition. In other words, the trial judge’s conceptual and legal errors, both concerning the reasoning of the judgment and substantive criminal-law doctrine (dogmática sustantiva), affected the outcome of the ruling and are sufficient grounds for vacating the decision in response to the opposing party’s complaint through this appellate remedy, without any need to continue scrutinizing a decision that displays many other contradictions and inconsistencies.
Accordingly, this ground is sustained, and the judgment acquitting Nombre01, Nombre04, and Nombre07 of the offense of unlawful dispossession shall be vacated, with the case remanded to a newly constituted trial court for such proceedings as may be appropriate under the law.
IV.Luis Salazar Álvarez, counsel with the Public Defender’s Office for Nombre01, alleges, as the sole ground for his appeal, that the civil judgment is improper because there was no criminally unlawful act (injusto penal) and because the subjective and objective elements of the civil action were lacking. He argues that, although the case law has held otherwise, a civil judgment was not warranted because neither a criminally unlawful act nor a direct relationship between his client and the bio-physical and social harm attributed to him was proven, since such an unlawful act makes it possible to establish a direct connection between the accused and the alleged harm. In this case, there was no possibility of proving that his client had any connection with the structures located in a protected area (zona protegida); rather, the witnesses consistently stated that several people had occupied those places approximately 28 to 30 years ago, including the defendant’s father, Nombre02, who was the person who began working and building at that location.
He asserts that the trial also established that, although a series of harms were attributed to Nombre01, the only time he was physically placed at the scene, according to the SUMAC report, was on one occasion in 2014, but it was not determined that he lived in the house. He adds that, on that occasion, several people present there were charged in connection with the events and that other houses were occupied, which renders his client’s civil liability controversial. He mentions that the judge ordered the trial reopened to request a new report from SINAC concerning the location of the houses at the scene, and that report established that there were five dwellings at the location, occupied by other persons unknown to the proceedings who had no knowledge of or connection with the legal matter being adjudicated. He asserts that substantial harm and a defect could result because the demolition of structures is being ordered without precisely determining to whom they belong, since they could belong to a person who is not being tried for these events and whose dwelling could ultimately be demolished without that person having received due process.
He considers it improper, therefore, to find that there is a direct relationship between the harm caused and his client and that the latter must bear a civil judgment despite the criminal acquittal. He requests that, because these are civil matters, this court dismiss the civil action for damages (acción civil resarcitoria) and relieve his client of the obligation to pay civil costs. There were no written or oral responses to this appeal, except for the State Attorney’s brief statement that the civil ruling should be upheld. The appeal cannot succeed. At this point, it would be logical to assume that, given the serious errors affecting the remainder of the decision, something similar would occur with this portion of the ruling. Nevertheless, civil matters are governed by the party-disposition principle (principio dispositivo), and the court must adhere to the appellant’s arguments; in this case, in filing his appeal, the public defender has chosen to proceed from a dilemma for the very interests he claims to defend, because if he asserts, as he does, that the structures in the protection zone (zona de protección), whose demolition is being ordered, were not erected by his client but “may have been erected by third parties not brought into the proceedings,” he would lack standing to appeal that issue; whereas if he accepts that Nombre01 erected them and that they have remained under his control, although this supports his standing to appeal, it simultaneously confirms the position not only that his client must pay civil damages but also that he may bear criminal liability.
Despite this, the court will analyze his position on the assumption that he has standing to raise the complaint—that is, that some responsibility may be attributed to him because he caused the harmful events. First, however, an obvious point must be noted. Counsel appears unaware that the position requiring a criminally unlawful act before a civil action may be granted was superseded several decades ago. This chamber, with a partially different panel (R: Chinchilla, H. Soto and M. Gómez), stated in decision number 2019-1091: «…it must be noted that the appellant’s assertion that there was no criminally unlawful act and that, consequently, a civil judgment is theoretically unavailable is unacceptable. Although the existence of a criminally unlawful act was originally considered necessary, that position has been thoroughly superseded, first by isolated and minority decisions of the court formerly known as the Criminal Cassation Court, and later unanimously and consistently, until it was ultimately adopted by the country’s various criminal cassation bodies then in existence, to the point that today no one questions that possibility, given the force of those arguments.
Thus, decision number 2007-1545 (Judges Nombre23 and Chinchilla and Judge Nombre24) of the former Criminal Cassation Court, followed, among others, in decision 2012-2311 (R. Chinchilla, L. García and Nombre25), analyzed the issue as follows: “...although traditionally, based on the literal wording of Article 103 of the Criminal Code, which refers to a ‘punishable act,’ it has been said that a criminally unlawful act—typical and unlawful conduct—is required for a civil claim to be granted (to that effect, nationally: Nombre26, Nombre27. Civil Liability Arising from a Punishable Act. Editorial Juricentro, San José, 1994 pp. 116-166, 225), the fact is that this position has gradually been abandoned in legal scholarship (cf.: Nombre28, Nombre29. Civil Liability. Areté/Diké, San José, 2001, pp. 56-71), by legislation through a special provision enacted after the former provision (Article 40, third paragraph, of the Code of Criminal Procedure: ‘A judgment of acquittal shall not prevent the court from ruling on a properly asserted civil action for damages, when appropriate’), and in case law (Constitutional Chamber, decision Nº 3603-93: ‘Given that criminal and civil actions are distinct and independent of each other and proceed together solely for reasons of procedural economy, an acquittal on the criminal action does not imply that there must also be an acquittal on the civil action.
Thus, an acquittal on purely criminal grounds does not preclude a ruling on the civil action, specifically the granting thereof by the criminal court, pursuant to Article 11 of the Code of Criminal Procedure, which, in conjunction with Article 398 of the same code, authorizes the judge, even when acquitting the defendant, to order the restitution, compensation, or reparation sought. Accordingly, the judge’s application of those articles complies with the principle of legality, which is a fundamental guarantee forming part of Due Process. It therefore cannot be accepted that the Court failed to provide Due Process, since its conduct is fully supported by procedural rules (...) the granting of a civil action for damages in a judgment of acquittal does not violate the guarantee of due process or the right of defense’). All of these lines of reasoning are based on the premise that a constitutional—and therefore supra-legal—principle exists: access to prompt and effective justice and effective judicial protection (Article 41 of the Constitution), which protects all persons, including civil plaintiffs, and that acting otherwise would violate it.
It is also accepted that civil unlawfulness (antijuridicidad civil), the basis for compensation except in cases of strict liability (responsabilidad objetiva), is much broader than criminal unlawfulness, since the former may arise from breach of contract or tort liability (responsabilidad extracontractual), neither of which necessarily derives from crimes or quasi-offenses. It has been stated in this regard: ‘It bears emphasizing that the civil judgment was based on the same event investigated, understood, however, as a civil wrong, concerning which the accused exercised his right of defense (...) and therefore the Court acted correctly. In this respect, it should be recalled that this Chamber has held that civil liability is independent of the commission of an unlawful act. Thus, for example, it has been established: “…The phrase ‘when appropriate,’ contained in the third paragraph of Article 40 of the Code of Criminal Procedure, must necessarily be interpreted to mean that, despite a criminal acquittal, the court may rule on the civil action when other legal grounds distinct from the crime remain upon which the duty to compensate may be based.
In other words, this applies when the proven facts are sufficient to demonstrate the existence of civil liability, without requiring the substantive rule giving rise to the obligation to compensate for the harm to derive from Criminal Law, and without requiring proof of the criminal or administrative liability of a particular public official. The foregoing is the only possible interpretation arising from the principles of Procedural Economy and Restrictive Interpretation, in accordance with our constitutional order, subject only to the requirement that the defendant be afforded an opportunity to defend…” To this it must be added that such legal grounds may most often arise from tort liability, as well as from contractual liability (…) Accepting the contrary would entail, as this Chamber also held in the same cited precedent, violating the constitutional principle of prompt and effective justice, producing the absurd result of referring a party who has litigated the dispute in the criminal courts back to the judicial system to safeguard that party’s rights’ Third Chamber of the Supreme Court of Justice, decision Nº 102-2007 of 23 February.
To the same effect, from that same chamber, decision Nº 134-2001. From the Criminal Cassation Court, cf. decision Nº 249-F-98.” Accordingly, it is clear that, at the present stage of development of the country’s criminal-law scholarship, a criminally unlawful act need not occur for a civil judgment to be entered; therefore, no defect resulted from the fact that, despite a criminal acquittal based on doubt concerning the defendants’ participation, a civil judgment was entered (…) …» Consequently, the defendant’s acquittal—even on statute-of-limitations grounds for certain legal classifications—does not preclude a civil judgment against him if a causal link (nexo causal) is established between his conduct, subjectively considered, or his objective basis for liability, and a harmful result. The judgment addressed this issue as follows: «VI- REGARDING THE CIVIL ACTION FOR DAMAGES: In the criminal proceeding under review, the State, through the Office of the Attorney General of the Republic, appeared as civil plaintiff, while the defendant in these proceedings, Nombre01, acted as civil defendant; the existence of a connection between the action and the harm was established, and awards were therefore made for bio-physical and social harm.
(…) In the present case, a judgment of acquittal was entered in favor of civil defendant Nombre01 because doubt existed regarding the legal doctrine of mistake as to an element of the offense (error de tipo), which excludes his liability for the offense of Invasion of a Protection Zone; a causal link establishing liability exists based on the knowledge he acquired in 2014, when SINAC officials warned civil defendant Nombre01 that the two-story dwelling that had been built was located 7 meters from the streambed and therefore lay within the stream’s protection area.
The structure in which, as explained, the civil defendant’s father, Nombre02, lived for a time; environmental damage (daño ambiental) existed in the present case, and the documentary evidence is clear. Thus, Volume II of expediente 11-000707-573-PE establishes the existence of two structures encroaching upon a percentage of the unnamed stream. The locations of the huts have been identified on the property since the year 2011, and they appear in separate documents prepared since the year 2011 by OIJ and SINAC officials (DS-1251-11 from SINAC, DM 15-ORS-13 from OIJ); they were verified again in report SINAC-ACAHN-JSS-053-2020, folios 697 to 703 of Volume II of expediente 11-000707-573-PE. Although it is clear to the Court that the property belongs to TRANSUNION S.A., represented by the injured party, Nombre12, who established agrarian possession (posesión agraria) during the adversarial proceedings, and that for a time it was unlawfully occupied by local residents and persons of other nationalities, one of whom was the father, Nombre02.
The structures in the disputed area have been documented since the year 2009, as shown by the Agrarian Judge’s judicial inspection record (acta de reconocimiento judicial) dated 19 de marzo de 2009 in expediente 09-000029-507-AG, Volume I, folios 85 to 86. During that period, Nombre02 was permitted to remain on the property belonging to TRANSUNIÓN S.A., by order of the injured party, Nombre12, who represents TRANSUNIÓN S.A., until the action for recovery of possession (proceso reivindicatorio) was resolved; during that period, however, the father and the civil defendant executed private documents under which the former donated portions of TRANSUNIÓN S.A.’s property to the latter. These questionable actions between the parties are (sic) being resolved in the civil agrarian proceeding in the aforementioned expediente, in which the extent of the land donated by Nombre02 to Nombre01 is unclear: one document donates seven hectares (certification of a date certain (razón de fecha cierta)), whereas the private letter donating possession of the property states six hectares, at folios 122 and 123 of expediente 09-000029-507-AG.
At trial, however, the accused, Nombre01, exercising his constitutional and procedural right, stated that his father had donated those portions of land to him. According to the civil defendant, this statement means that he owns the land and what stands upon it, namely, the buildings constructed within the protection area (área de protección) of a stream; he submitted as evidence the documents previously mentioned herein. At trial, no person other than the civil defendant established possession of the unlawfully occupied portions of land; witnesses Nombre18 and Nombre14 merely recounted that lots from TRANSUNIÓN S.A.’s property had apparently been sold, without affirming that this had in fact occurred. (…) As has been explained, both the testimonial and documentary evidence establish that the disputed structures belong to the civil defendant, Nombre01. (…) The causal link (nexo causal) between the act and the damage must also be certain; this means that there must be absolute certainty.
Costa Rican case law has used one of the classifications that has received the greatest acceptance in jurisprudence, namely property damage (daño patrimonial), but in this case the damage is biophysical and social. The damage caused to natural resources was established at trial; diffuse interests (intereses difusos) were affected and compensation must therefore be awarded. Moreover, under the pro natura principle (principio pro natura) and the principle of the irreducibility of the forest (irreductibilidad del bosque), the encroaching conduct must be brought to an end in order to eliminate the risk of harm to the natural resource and prevent any benefit from being derived from the unlawful act. This must be ordered by the court on its own motion, even in the event of an acquittal and even without a civil action. Separate, duly admitted documents establish the existence of environmental damage, and in the year 2014 the civil defendant was warned in this regard concerning his obligations and the damage he was causing to the Natural Resources; he must therefore compensate for that damage.
The claims of the Procuraduría General de la República have been applicable since the year 2007, when the protection area of an unnamed stream was encroached upon. Nevertheless, biophysical and social damages must be awarded without quantification (en abstracto), because report SINAC-ACAHN-JSS-053-2020, folios 697 to 703 of Volume II of expediente 11-000707-573-PE, documents the locations of two structures with percentages of encroachment (40% and 80%), and it is necessary to determine precisely the biophysical and social damage to the Natural Resources. This circumstance requires that an award of personal costs (costas personales) be entered until the environmental damage is specifically quantified. Witness Nombre18 stated at trial that, to this day, the civil defendant, Nombre01, remains on TRANSUNIÓN S.A.’s property and that he has seen him spend the night in the hut. Witnesses Nombre19 and Nombre16 stated that when they went there in 2014, they warned the civil defendant, Nombre01, that it was necessary for him to remove the huts, which remain there to this day.
Restoration to the previous condition (restitución de las cosas a su estado anterior): (…) after it was established that, throughout the criminal proceedings, the structures had been linked to a location within the protection area of an unnamed stream. In this case, restoration of the property to its previous condition must even be ordered by the court on its own motion. (…) It is ordered that the affected area located in Heredia, Sarapiquí, Pueblo Nuevo La Virgen, on the property of TRANSUNIÓN S.A., be restored to the condition existing before the act by the DEMOLITION of ONE CONSTRUCTED TWO-STORY HUT, 40% of which lies within the protection area of a stream, and the DEMOLITION OF ONE HUT, 80% of which lies within the protection area of a stream, as well as the demolition of the wooden bridges at the site and the cultivated areas surrounding the unnamed stream. The officials of the Sistema Nacional de Áreas de Conservación de la Cordillera Volcánica Central, together with the person exercising possession of the property belonging to TRANSUNIÓN S.A., represented by Nombre11, and personnel from the Fuerza Pública, are ordered to demolish the corresponding percentage of those structures once the criminal judgment becomes final.» (Cf. folios 728 recto to 730 verso; emphasis added and theoretical references omitted).
It is therefore clear that the judge did find the existence of environmental damage to have been established and that it was caused by the accused’s continued presence at the site, irrespective of the fact that the same judge questioned whether that act constituted any offenses, thereby establishing the causal link. All of this was properly derived from the evidence introduced at trial and supported by adequate reasoning, which the appellant does not challenge. The fact that the new SINAC report determined that five houses were located at the scene of the events, occupied by other persons unknown to these proceedings, does not negate the fact that the accused was located in the two-story hut or that the testimonial evidence assessed connects the accused to that structure. The appeal must therefore be denied, and the ruling must be upheld both as to the civil matters and as to the demolition order and costs.
POR TANTO:
The appeals (recursos de apelación) filed by attorney Margot Avellán Ruiz, criminal prosecutor (procuradora penal), and attorney Otto Giovanni Ceciliano Mora, special judicial attorney-in-fact (apoderado especial judicial) for the private complainant (querellante), Nombre10, representing Transunión S.A., are hereby granted. Consequently, the judgment of acquittal (sentencia absolutoria) entered in favor of Nombre01 for the offense of encroachment upon a protected area (invasión a una zona protegida), as well as the acquittal entered in favor of Nombre01, Nombre04, and Nombre07 for the offense of unlawful dispossession (usurpación), is vacated. As to those matters, the case is remanded (reenvío) to a newly constituted trial court (órgano de instancia). The challenge (impugnación) filed by attorney Luis Salazar Álvarez, public defender (defensor público) for defendant Nombre01, is denied. The judgment acquitting Nombre01—on the grounds that the criminal action was time-barred (prescripción de la acción penal)—of the offenses of illegal logging (tala ilegal), unlawful harvesting of forest products (aprovechamiento ilegal de producto forestal), and one offense of unlawful discharge (vertido) remains undisturbed (because it was not appealed), as do the civil judgment (condena civil) against Nombre01 and in favor of the State and the order to restore the affected area to its prior condition, including the demolition of the structures (because the appeal is denied). NOTICE SHALL BE GIVEN.

Resolución: 2020-0938 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, al ser las once horas con cuarenta y cinco minutos, del diez de junio de dos mil veinte.
RECURSOS DE APELACIÓN interpuestos en la presente causa seguida contra Nombre01, quien es mayor de edad, costarricense, con cédula de identidad número CED01, nacido en Guanacaste, Bagaces, el 01 de marzo de 1952, hijo de Nombre02 y de Nombre03, divorciado, agricultor, vecino de Heredia; contra Nombre04, quien es mayor de edad, nicaragüense, con documento de identidad número CED02, nacido en Nicaragua, el 04 de setiembre de 1966, hijo de Nombre05 y de Nombre06, casado, agricultor, vecino de Heredia y contra Nombre07, quien es mayor de edad, nicaragüense, con documento de identidad número CED03, nacida en Nicaragua, el 19 de marzo de 1966, hija de Nombre08 y de Nombre09, ama de casa, vecina de Heredia; por los delitos de INVASIÓN A LA ZONA DE PROTECCIÓN y USURPACIÓN en perjuicio de LOS RECURSOS NATURALES y otro. Intervienen en la decisión de los recursos, las juezas Rosaura Chinchilla Calderón; Patricia Vargas González y Kathya Jiménez Fernández. Se apersonaron en esta sede el licenciado Luis Salazar Álvarez, defensor público del sentenciado Nombre01; la licenciada Margot Avellán Ruiz, en su condición de procuradora penal; el licenciado Otto Giovanni Ceciliano Mora, en calidad de apoderado especial judicial del querellante Nombre10 y la licenciada Diana De la O Ferllini, como defensora pública de los endilgados Nombre04 y Nombre07 y,
RESULTANDO:
I.Que mediante sentencia número 33-2020, de las siete horas del diez de febrero de dos mil veinte, el Tribunal Penal de Heredia, Sede Sarapiquí, resolvió: "POR TANTO: De conformidad con lo expuesto, en observancia de las reglas de la sana crítica racional y artículos 8 inciso 1 y 2) de la Convención Americana de Derechos Humanos; 10 y 11 de La Declaración Universal de Derechos Humanos; 9 inciso 2 y 14 inciso 2) del Pacto Internacional de Derechos Civiles y Políticos, 36, 39, 41, 50 y 89 de la Constitución Política; 1, 2, 3, 4, 11, 12, 13, 14, 18, 19, 20, 30, 33, 34, 103 y 225 inciso 1) del Código Penal; artículos 33, 58 inciso a) y c) y artículo 61 inciso a) de la Ley Forestal 7575, artículo 100 de la Ley de Conservación de Vida Silvestre, artículo 122, 123 y 124 del Código Penal de 1941, artículo 1045 del Código Civil, Arancel de Honorarios por Servicios Profesionales de Abogacía y Notariado Decreto Ejecutivo N° 36562 y artículos 1, 2, 3, 4, 9, 11, 12, 16, 28, 40, 70, 71,111,112,113,119, 140,142,184, 265 a 267, 360 a 366 y 488 del Código Procesal Penal al resolver este asunto, el Tribunal concluye, que lo procedente es absolver de toda pena y responsabilidad a Nombre01 de UN delito de TALA ILEGAL; UN delito de APROVECHAMIENTO ILEGAL DE PRODUCTO FORESTAL y UN delito de VERTIDOS, delitos previstos y sancionados en los artículos 58 inciso c) y 61 inciso a) de la Ley Forestal y artículo 100 de la Ley de Conservación de la Ley de Vida Silvestre en perjuicio de LOS RECURSOS NATURALES al haber prescrito la Acción Penal; lo procedente es absolver de toda pena y responsabilidad por el Principio In dubio Pro Reo a Nombre01, Nombre04 y Nombre07 por UN delito de USURPACIÓN previsto y sancionado en el artículo 225 inciso 1) del Código Penal en perjuicio de Nombre11; lo procedente es absolver de toda pena y responsabilidad por el Principio In dubio Pro Reo a Nombre01 por UN delito de INVASIÓN A UN ÁREA DE PROTECCIÓN en perjuicio de LOS RECURSOS NATURALES.
Se declara CON LUGAR la ACCIÓN CIVIL RESARCITORIA incoada por la PROCURADURÍA GENERAL DE LA REPÚBLICA en contra del DEMANDADO CIVIL Nombre01, se le condena al pago del daño económico esto en ABSTRACTO para que se liquiden en ejecución de sentencia, se le condena al pago de las costas personales al DEMANDADO CIVIL Nombre01 según decreto de honorarios 36562 en ABSTRACTO para que se liquiden en ejecución de sentencia. Como consecuencia de la condena civil y al haber existido litigio bajo el PRINCIPIO PRO NATURA se ordena restituir el área afectada al estado anterior al hecho esto con el DERRIBO de UN RANCHO CONSTRUIDO DE DOS PLANTAS con un 40% dentro del área de protección de una quebrada y el DERRIBO DE UN RANCHO construido con 80% dentro del área de protección de una quebrada y además del derribo de los puentes de madera del lugar y las áreas de cultivo alrededor de la quebrada sin nombre.
Se les ordena a los personeros del Sistema Nacional de Áreas de Conservación de la Cordillera Volcánica Central con la persona que ejerce la posesión del inmueble Nombre12 que representa a la empresa TRANSUNION S.A y personal de la Fuerza Pública el derribo del porcentaje de dichos inmuebles cuando la sentencia penal adquiera firmeza. Comuníquese." (sic, folios 708 a 731).
II.Que, contra el anterior pronunciamiento, interpusieron recurso de apelación el licenciado Luis Salazar Álvarez, en calidad de defensor público del justiciable Nombre01; la licenciada Margot Avellán Ruiz, en su condición de procuradora penal y el licenciado Otto Giovanni Ceciliano Mora, en calidad de apoderado especial judicial del querellante, señor Nombre10.
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.
Redacta la jueza Chinchilla Calderón; y,
CONSIDERANDO:
I.Admisibilidad y competencia. A) El licenciado Luis Salazar Álvarez, defensor público del justiciable Nombre01; la licenciada Margot Avellán Ruiz, procuradora penal y el licenciado Otto Giovanni Ceciliano Mora, en apoderado especial judicial del querellante señor Nombre10, interpusieron recursos de apelación contra la sentencia dictada en autos. Estos se incoaron mediante escritos motivados, aportados ante el órgano de instancia y dentro del plazo legal. Nótese que los dos primeros se entregaron el 06 de marzo de 2020, según folios 734 y 736 y el último el 09 de marzo de 2020 según folio 747 y, por haberse dictado integralmente la sentencia el 17 de febrero de 2020 según folio 732, el plazo de quince días hábiles no vencía sino hasta el 09 de marzo de 2020. Por ello, deben admitirse, sin que sean necesarias ulteriores formalidades pues, de lo contrario, se incumpliría el mandato establecido en el artículo 8.2.h de la Convención Americana sobre Derechos Humanos y lo resuelto por la Corte Interamericana de Derechos Humanos en el caso de Nombre13 contra Costa Rica, sentencia de 02 de julio de 2014.
Por último, se acogió la acción civil resarcitoria establecida por la Procuraduría General de la República en contra de Nombre01, extremo de la decisión que solo es recurrido por el defensor público de este encartado. Por ende, la decisión debe entenderse firme respecto a la absolutoria por prescripción de la acción penal a favor de Nombre01 por los delitos de tala ilegal aprovechamiento ilegal de producto forestal y un delito de vertido y por ello, inexpugnable ante la falta de cuestionamiento de tal extremo y la competencia de esta cámara se encuentra reducida a los otros temas planteados por los querellantes y a la parte demandada civil (artículos 446 y 444 del Código Procesal Penal).
II.La licenciada Margot Avellán Ruiz, procuradora querellante en la presente causa, expone, como único motivo de su recurso, su disconformidad con la valoración de la prueba y la inobservancia de las reglas de la sana crítica que dio lugar a la absolutoria de Nombre01 por el delito de invasión a una zona de protección. Luego de exponer, sin necesidad, los hechos que sustentan la querella y la decisión adoptada, así como la regulación normativa y comentarios jurisprudenciales respecto del delito en comentario (folios 736 a 740), señala que, en este caso, el endilgado efectuó la invasión de la zona de protección de una quebrada sin nombre a través de la construcción y habitación de una casa de dos plantas y un rancho que funcionaba como cocina, en donde se encuentra residiendo a la fecha, aspecto este último que tuvo por demostrado el juez de instancia pues así lo refirieron todos los testigos asistentes al juicio.
Describe, brevemente, lo dicho por cada testigo. Así, Nombre14 habría manifestado que el encartado se mantenía en la zona, lo vio sacando tablas para construir, realizando la construcción de casas y que eso lo hizo a unos diez metros de la quebrada, a más de que se habría introducido en la finca de la empresa Transunión. Nombre15 y Nombre16, funcionarios del MINAE, habrían efectuado las inspecciones, detectado las dos construcciones (rancho como cocina y casa de dos plantas que se ubica siete metros de la quebrada). En la primera visita estaba el hermano del encartado y un peón que dijo ser contratado por el endilgado y en la segunda visita, cuando ya se había eliminado el rancho como cocina, el encartado estaba dentro de la vivienda, ocasión en la que se le hicieron advertencias. Según narra la apelante, los testigos de cargo sostuvieron que el encartado sigue detentando la posesión en la zona y él así lo dijo en su declaración en juicio.
Sostiene que, si bien se ha dicho que en la finca de Transunión S.A. muchas personas han usurpado la propiedad, incluyendo el padre del encartado, eso no exime de responsabilidad a este último, quien extendió su propiedad más allá de los carriles marcados como linderos. Critica que el juez afirmase que había un error de tipo invencible porque el encartado desconociera la prohibición legal de construir ahí, lo que supo hasta el año 2014, a partir de lo cual la apelante sostiene que no fue así pues, con las copias del expediente 09-29-507-AG (proceso ordinario agrario reivindicatorio entre el encartado y la empresa Transunión S.Nombre17.), las cuales se aceptaron como prueba en juicio, se acreditaría que se le hicieron advertencias de que no podía seguir anillando y talando árboles y en la sentencia de dicho proceso, del año 2009, se le ordenó abstenerse de socolar árboles o el recurso forestal cerca de nacientes y quebradas.
Para el juez, eso demostraría que él no sabía que debía obedecer a la autoridad, lo que la apelante critica pues el encartado, desde el 2009, ha estado en constante contacto con las autoridades de ambiente y judiciales, por lo que no puede alegar ignorancia de la ley. Sostiene que se descarta la invencibilidad del error cuando se tiene en cuenta que el endilgado fue indagado el 02 de febrero de 2013, por lo que, en la segunda inspección, de 2014, en que él se mantenía en la casa construida desde el 2011, ya conocía de la ilicitud de su actuar. Considera infundamentada la sentencia absolutoria por ese delito y pide que se revoque la absolutoria del encartado por el delito de invasión a una zona de protección, ordenándose el reenvío. Durante la audiencia oral, la representante estatal mantuvo los mismos argumentos y se manifestó conforme con el resto de la decisión, incluyendo la acción civil y la devolución de las cosas al estado anterior, solicitando que en el resto la decisión se mantuviera incólume.
El licenciado Otto Giovanni Ceciliano Mora, apoderado especial judicial de Nombre10, a su vez representante de Transunión S.A., quien ha figurado como querellante, en el segundo apartado de su recurso (que, por motivos de orden y afinidad temática, se ponderará antes que el primero) alega la contradicción de la sentencia, su falta de fundamentación y la errónea valoración de la prueba en lo referente al delito de invasión a la zona de protección. Narra que, para el juez de mérito, no se configuró el tipo penal de invasión de zona de protección por la existencia de un error de tipo pues, al ser un delito doloso, el imputado debía contener el conocimiento y voluntad de su actuar ilícito pero que, en el asunto, no se acreditó que Nombre01 tuviese conocimiento de que estaba invadiendo una zona de protección, lo cual, lo hizo creer que su conducta no era configurativa de delito. Sin embargo, dice el apelante, el tribunal no valoró objetivamente la prueba para llegar a dicha conclusión, sino que el escrutinio se enfocó solo a ese tópico, por lo que incurrió en una falta de fundamentación.
Se queja de que se indicara, en la sentencia, que no era posible acreditar quiénes construyeron la cocina y la casa de dos plantas en la zona de protección, cuando en la misma resolución se le dio credibilidad a Nombre18, quien dijo que quienes hicieron las edificaciones, talaron árboles y demás, dentro de la finca de su representada Transunión S.A., fueron los señores Nombre04 y Nombre01, lo que hace a la resolución contradictoria. Asimismo, apunta que el tribunal no valoró que el ingeniero forestal Nombre19 dijo que, en 2011, al apersonarse a la finca de la entidad querellante a hacer una inspección, determinó que había un rancho cerca de una quebrada sin nombre y sobre esta se vertían desechos. En esa ocasión también apuntó que existía una casa de dos plantas ubicada a siete metros de distancia de dicha quebrada y que, en zona rural, las construcciones no pueden estar a menos de 15 metros y en las zonas urbanas a menos de 10 metros, por lo cual esas incumplían la ley.
Por ello, el testigo manifestó que comunicó lo sucedido a Nombre20 y le realizó el mismo apercibimiento al encartado Nombre01, a quien le advirtió que debía eliminar el vertedero de aguas a la quebrada, así como alejarse de los 15 metros, lo que dicha persona no ha realizado nueve años después. Asimismo, el testigo dice que fue en 2014 y le volvió a advertir al encartado que eliminara la casa de dos plantas y otras obras. Indica que esto no fue mencionado, siquiera, por el juez y que así se acredita que el encartado sí sabía que había construido en la zona de protección por lo que el error de tipo es inexistente. El apelante hace comentarios adicionales sobre lo aportado, en similar sentido, por el testigo Nombre16 y la inspección en la que él intervino, lo que corroboraría el conocimiento citado del enjuiciado pues muchas de sus intervenciones las hizo a una persona (Nombre20) que se identificó como peón del endilgado.
Dice el apelante que si se hubieran ponderado esos tres testimonios no se habría adoptado aquella decisión. Pide que se ordene el juicio de reenvío para su debida sustanciación. Durante la audiencia oral reiteró tales alegatos. Al contestar los recursos, el defensor Salazar Álvarez, mediante escrito de folio 765, pidió que se rechazaran, ya que la decisión absolutoria cumplió con todas las garantías procesales y, de la prueba recibida en juicio, no se logró acreditar que su patrocinado fuera la persona que construyó una casa de habitación de dos plantas y que invadiera la zona de protección pues los oficiales del SINAC lo que dijeron fue que en una de las visitas, en 2014, lo vieron en el área en mención, pero no le realizaron ninguna prevención de sus derechos constitucionales ni una diferente a que no vertiera aguas residuales en la quebrada, por lo que él no tenía el “…conocimiento sobre el actuar ilícito que requiere el tipo penal”.
Además, menciona que la prueba logró afirmar que quienes originalmente se fueron a vivir a la zona y construyeron fueron otras personas, incluyendo el padre del endilgado, quien vivió ahí con otros hijos y solo ocasionalmente este lo visitaba. Explica que no hubo ninguna equivocación del juez en su sentencia, por lo que los argumentos de los recursos no tienen “hacidero” (¡sic!, ver folio 765 vuelto) legal. Los recursos se deben acoger. En el presente asunto, se emitió una sentencia por escrito que consta en folios 708 a 731 y, como se dijera en el acápite anterior, versa sobre diversos extremos, tanto penales como civiles, alusivos a tres personas y sobre distintos delitos, algunos de cuyos aspectos (los referentes a la prescripción de la acción penal) no fueron recurridos, por lo que, al margen del acierto o no de la decisión, esta cámara carece de competencia para examinar esos extremos.
De las 47 páginas de la sentencia, las primeras 20 se dedican a la fundamentación descriptiva que comprende la transcripción de las acusaciones pública y privada, de la acción civil y del resumen de la prueba recibida oralmente, así como la mención de la prueba documental incorporada. También se trata, en esas páginas iniciales, lo decidido sobre la prescripción de la acción penal para otros delitos (tala, aprovechamiento de productos forestales y vertido de aguas servidas). Es a partir del folio 718 que el juez narra lo que él denomina “fundamentación descriptiva” (que no es tal, pues se dedica a exponer lo que considera hechos indemostrados, lo que implica una valoración judicial, por lo que no hay tal descripción que supone la exposición de información sin juzgar su contenido) para enunciar hechos no probados y desde el folio 719 frente inicia lo que debía ser el análisis jurídico y la ponderación probatoria.
El tribunal divide el escrutinio probatorio por “delitos” y así, lo referente a la invasión a la zona de protección, inicia en el folio 725 frente y finaliza en el folio 728 frente. Para este ilícito, la decisión se basó en la existencia de un “error de tipo” pero, valga decirlo desde ya, la aplicación de este instituto por parte del juez Segura Hernández denota un desconocimiento de la dogmática sustantiva, pues constantemente confunde el error de tipo (que debe recaer sobre el conocimiento actual de los elementos objetivos del tipo penal) con el conocimiento de la ilicitud (que es un conocimiento potencial que hace surgir el error de prohibición directo) sin tampoco aludir a los efectos (diversos) de la vencibilidad e invencibilidad entre uno y otro, tema que tampoco explota ninguna de las partes apelantes quienes centran sus argumentos en temas probatorios. Para ilustrar lo anterior y, entonces, exponer cómo aquel desconocimiento de la teoría del delito generó una decisión con una fundamentación errada que no puede mantenerse, conviene, en primer lugar, partir del tipo penal en comentario, que es el 58 inciso a) de la Ley Forestal, el cual dispone: “Se impondrá prisión de tres meses a tres años a quien: a) Invada un área de conservación o protección, cualquiera que sea su categoría de manejo, u otras áreas de bosques o terrenos sometidos al régimen forestal, cualquiera que sea el área ocupada; independientemente de que se trate de terrenos privados del Estado u otros organismos de la Administración Pública o de terrenos de dominio particular.
Los autores o partícipes del acto no tendrán derecho a indemnización alguna por cualquier construcción u obra que hayan realizado en los terrenos invadidos.” En consecuencia, si el error de tipo es un falso conocimiento de los elementos objetivos del tipo, el agente lo que podría desconocer, para que se dé tal instituto, es cualquiera de estas posibilidades: a) que está invadiendo (por ejemplo, el sujeto cree que ingresa a su propiedad); b) que está ante un área de conservación o protección (desconoce que la zona tiene esa connotación); c) que está ante un área de bosque (no maneja el concepto de bosque, elemento normativo del tipo de carácter jurídico); d) que está ante un terreno sometido a régimen forestal (desconoce también este elemento normativo del tipo). Como el de comentario es un tipo doloso, el error de tipo vencible elimina el dolo y hace surgir la culpa si hubiera tipo culposo paralelo que, en el caso en cuestión, no existe, por lo que se daría la atipicidad.
El error de prohibición, en cambio, si es directo, es aquel en donde el agente sabe lo que hace (sabe que está construyendo en una zona de protección, por ejemplo) pero cree que esa conducta no es delito. Si esa falsa representación es vencible disminuye la pena, pero si es invencible elimina la culpabilidad. En el presente caso, el razonamiento del juzgador para adoptar aquella determinación fue el siguiente (se transcribe en extenso para evidenciar las contradicciones y errores): «…existe la incertidumbre, de que al encartado Nombre01 es autor responsable del delito de Invasión de una Zona de Protección, ya que la prueba documental como la testimonial de cargo y descargo derivan que si el imputado Nombre01 tuvo pleno conocimiento del delito a partir de las mismas actuaciones realizadas por los funcionarios SINAC (Sistema Nacional de Áreas de Conservación) en cuanto al elemento subjetivo del tipo penal, es decir si invadió un área protegida a partir de la información que pudo tener conocimiento en el año 2011, cuando los funcionarios del SINAC hacen una inspección al lugar y le advierten a un tercero que debe eliminar la cocina que vierte aguas en la quebrada sin nombre, esto en la finca que le pertenece al ofendido Nombre12 como representante de la empresa TRANSUNIÓN S.A. También de los acontecimientos sucedidos con Nombre02 desde el año 2007 al 2009 y estos constan en el expediente agrario como para determinar que el imputado Nombre01 conocía los elementos integrantes del tipo penal.
La hipótesis fiscal a criterio de este Juzgador y así lo fundamentará no fue acreditada, esto partir de la existencia de un error de tipo. Acorde con la tesis del Ministerio Público que ha (sic) consecuencia del actuar doloso el encartado Nombre01 en el año 2007 construyó dos edificaciones dentro de la zona de protección de una quebrada sin nombre a siete metros (una de ellas cocina) en la finca ubicada en la Virgen de Sarapiquí, terreno que le pertenece a la empresa TRANSUNIÓN S.A representada por el ofendido Nombre12 que representa a la empresa TRANSUNIÓN S.A. La prueba testimonial y documental analizada a luz de la sana crítica racional pudo notar que existió incerteza de la persona autora de la invasión de esas tierras en el año 2007. Dicho año 2007 ha generado incertidumbre si en ese preciso año se dio la usurpación de la finca en mención, como se ha venido motivando quedó claro que fue el papá de Nombre01 el señor Nombre02 quien invadió la finca de TRANSUNIÓN S.A. Es que toda la prueba testimonial y documental apunta que Nombre02 invadió (usurpó) la finca de TRANSUNIÓN S.A, que el representante de la empresa Nombre12 que representa a la empresa TRANSUNION S.A entró en negociaciones con las personas invasoras entre ellos Nombre02 y Nombre21 para solucionar el conflicto y entre los convenios fue que se le indicó a Nombre01 y su hermano Nombre01 de los mismos apellidos que no continuarán con el anillado y aserrío de árboles.
Estos últimos incumplieron por lo que la empresa TRANSUNIÓN S.A procedió representada por Nombre12 que representa a la empresa TRANSUNION S.A a dar inicio al proceso agrario por los daños causados a la finca. Tanto es así que en el año 2007 Nombre12 que representa a la empresa TRANSUNION S.A le permitió vivir a Nombre02 en la zona de conflicto, entonces la pregunta que se hace este Tribunal de ¿Quién era a la persona que tenía la obligación de conocer los alcances de no invadir la zona protegida? Era Nombre02 o su hijo Nombre01. Y es que la prueba testimonial nos refiere que era el primero, es que Nombre14 refirió y así también lo confirmó Nombre18 que la persona que invadió esas tierras fue Nombre02; a partir de la anterior premisa le correspondía a él la obligación de conocer los alcances de sus actos y entonces porque se le cuestiona tal actuación a Nombre01 que invadió una zona de protección de una quebrada sin nombre.
Es que también se contó con el documento de la inspección en la finca de TRANSUNIÓN, esto por el Juez Agrario y que consignó en el año 2009 que la finca la conocía y que las construcciones le pertenecían a Nombre02, una de ellas de dos plantas, entonces para el año 2009 la persona que vivía en ese lugar era Nombre02 y no Nombre01 y que esto lo afirmó Nombre18 que explico que en ocasiones Nombre01 visitaba a su padre. En debate el imputado Nombre01 admitió que compró un área de tierra a su padre Nombre02, documentos que constan en el expediente agrario y con el encabezado de razón de fecha cierta (folio 123 del tomo I del expediente 09-09-000029-507-AG), este documento fue confeccionada (sic) en mayo del 2008, un año después de la invasión de la zona de protección y que es parte de la imputación de hechos del Ministerio Público, generando duda de que si el imputado Nombre01 tenía conocimiento primero del elemento objetivo del tipo penal y de ahí el elemento subjetivo del tipo penal de invadir un parea de protección en el año 2007 como fue acusado.
El Tribunal analizó las condiciones del imputado Nombre01, que es una persona sin escolaridad, que al dar sus datos refirió que no sabía ni leer ni escribir, que se dedica a la agricultura, estas condiciones especiales del encartado pudo ser una limitante en conocer los alcances del delito que se le acusaba. Es bien sabido que existe un principio que nadie puede alegar ignorancia de la ley, pero todo principio tiene su excepción y en casos jurídicos penales debe ser valorado con detenimiento una situación especial como la anterior y poder así construir la responsabilidad subjetiva de una persona acusada. Estas condicionantes pueden ser acreditadas a partir de la prueba documental y testimonial si el imputado tuvo conocimiento del tipo penal. Es que Nombre01 tenía pleno conocimiento en base a esas condiciones personales de su responsabilidad o su conocimiento provenía del proceso agrario y es que el auto de sentencia agraria N° 122-09 del Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica (folios 283 a 287 expediente 09-000029-507-AG tomo I) que resuelve medida cautela (sic) en su parte dispositiva: De conformidad con lo expuesto, normativa y jurisprudencia de cita, SE ACOGE la medida cautelar planteada por la sociedad actora TRANSUNIÓN S.A, en proceso ordinario tramitado bajo el expediente 09-000029-507-AG contra Nombre02, Nombre01 y Nombre01 1/ Abstenerse de anillar, talar o zocolar árboles o recurso forestal dentro del inmueble objeto de Litis. 2/- Abstenerse de aserrar madera en la zona boscosa y zonas cercanas a nacientes y quebradas dentro del terreno en cuestión (…) Lo anterior bajo apercibimiento de testimoniar piezas por el delito de Desobediencia a la Autoridad en caso de incumplimiento.
Se resuelve esta acción sin especial condenatoria en costas. Notifíquese personalmente esta resolución a los demandados Nombre02 y Nombre01 en su domicilio en Chilamate de la Virgen de Sarapiquí quinientos metros este del Super Maguiver para lo cual se comisiona a la Oficina Centralizada de Notificaciones del II Circuito Judicial Zona Atlántica. Notifíquese. Licda. Silvia E. Sánchez Blanco; también consta acta de notificación a Nombre01 a folio 294 del expediente agrario. Para ese momento el imputado Nombre01 tenía conocimiento del delito desobediencia a la autoridad y no de invasión a un área de protección de una quebrada, sus condiciones lo pudieron haber limitado de recrear que eran sus obligaciones ante una autoridad judicial; es que no le correspondía al Juez Agrario con todo el material probatorio que tenía en su manos y conocedor del derecho darse en la tarea de advertir que existían ranchos cerca de una quebrada sin nombre y esa situación era contraria a la normativa forestal y a partir de ese momento indicarle a Nombre02 que no invadiera esa área o sus hijos.
Lo anterior lo cuestiona el Tribunal y por tal la incertidumbre le favorece al encartado Nombre01. Pero el hecho que hace generar mayor incerteza de ese conocimiento del tipo penal en el imputado Nombre01 es respecto a las declaraciones de Nombre16 y Nombre19 funcionarios públicos del Sistema de Áreas de Conservación que se presentaron a la zona en conflicto con el fin de verificar sobre la denuncia de usurpación contra Nombre01, narraron en debate que se presentaron en dos ocasiones a la finca de TRANSUNION S.A, la primera en el año 2011 y la segunda en el año 2014, en la primera inspección no se hallaba en el lugar Nombre01 sino una persona de nacionalidad nicaragüense que les comunicó a estos que tenía al menos dos años de vivir en la finca, pero durante la inspección del 2011 se constató la existencia de dos ranchos, en uno de ellos se construyó una cocina que vertía aguas a la quebrada sin nombre, por tal le advirtieron a esta persona que debía quitar tal cocina para evitar la contaminación a la quebrada sin nombre, tal advertencia consta en el informe DS-1251-11 del 10 de octubre del 2011 y que consigna en el párrafo cuarto: El área de la cocina se encuentra dentro del área de protección de la quebrada (2 metros) y las aguas jabonosas y residuales son vertidas directamente sobre la quebrada sin nombre.
En el momento de la inspección, se encontró en este sitio el señor Nombre22, de nacionalidad nicaragüense, quién indico tener dos años de estar en dicha propiedad a quién se le indicó que debía desviar las aguas residuales como las jabonosas de la quebrada. Son los mismos funcionarios del SINAC que conocen a la perfección respecto a los delitos forestales, que no advirtieron en ese momento la invasión de los ranchos al área de protección de una quebrada sin nombre, además se le hacen a un tercero que en apariencia vivía en el lugar no siendo de manera directa a Nombre01. El cuestionamiento que hace el Tribunal es que ante las condiciones personales del imputado con cero escolaridad, si el encartado tuvo pleno conocimiento de los elementos objetivos y subjetivos del tipo penal que se le acusó por parte del Ministerio Público. No es sino hasta el año 2014 que de nuevo funcionario del SINAC se presentan a la finca de TRANSUNIÓN y verifican que la cocina se eliminó y es en ese momento que le advierten a Nombre01 que estaba invadiendo una zona de protección de una quebrada sin nombre.
Estos eventos hacen denotar dos cosas que la imputación de hechos del Ministerio Público respecto a la invasión al área protegida aconteció en el año 2007, pero no es sino hasta el año 2014 que el imputado es apercibido del delito de marras; existe un error de tipo que elimina la tipicidad, ya que existió incerteza si el imputado tuvo conocimiento pleno de los alcances del tipo penal, lesionando el bien jurídico penal Los Recursos Naturales. Lo anterior a partir de los elementos descriptivos no es posible afirmar el comportamiento examinado al encartado Nombre01 con relación al tipo concreto de invasión de zona de protección. El error de tipo acontece en este caso por el desconocimiento de Nombre01 de la concurrencia de un elemento fundamentado de la prohibición legal de esa conducta (invasión), no tuvo conocimiento pleno de ello sino a partir del año 2014, por tal excluye en todo el dolo, ya se requiere conocimiento de todos elementos del tipo de injusto.
La permanencia del lugar de parte de Nombre01 fue en la errónea creencia que la conducta que estaba desplegando no se adecuaba a las exigencias de un tipo penal; como se dijo líneas atrás son los mismos funcionarios del SINAC que le advierten en el año 2011a un tercero que debía eliminar la cocina a sabiendas que para ese momento se estaba invadiendo una zona de protección. Es que la incerteza deriva también de que si el imputado Nombre01 a partir de sus condiciones personales tuvo conocimiento pleno de la advertencia dada en el 2011 y los efectos de esta; ya que la acusación establece que Nombre01 todavía en el año 2013 permanecía invadiendo el área de protección de una quebrada sin nombre, pero para ese momento nadie se lo había advertido. De acuerdo con lo anterior, para que prevalezca un error de tipo se requiere una falsa representación del sujeto actuante, quien de manera errónea cree que su conducta no es configurativa de delito, así sucedió con Nombre01 esto a partir de la prueba documental y testimonial.
El autor Francisco Muñoz Conde en su libro Teoría General del delito nos dice (…) En el presente caso el imputado Nombre01 por sus condiciones personales no fue posible ni suponer el delito que cometía, solo conocía del proceso agrario en su contra y el cual le obligaba a cumplir la orden de un Juez bajo la advertencia del delito de desobediencia, esto aunado a los errores cometidos por los funcionarios del SINAC de no informar que invadía una zona de protección de una quebrada sin nombre no pudo ser posible a partir de su conocimiento que cometía un delito. En este caso el error es invencible, ya que el imputado Nombre01 no pudo superar su desconocimiento del hecho ilícito a título de dolo. La invencibilidad procede en este caso a partir de la hipótesis fáctica del Ministerio Público acusó, es que para el año 2007 el representante de la empresa TRANSUNIÓN S.A el señor Nombre12 para el año 2007 según demanda reivindicatoria del proceso agrario 09-000029-507-AG tomo I admitió que ocupara parte de la finca al usurpador Nombre02 hasta que se resolviera el proceso reivindicatorio, mientras se le advirtió a Nombre01 y Nombre01 ambos de apellidos Nombre01 que no continuaran haciendo daños (socolando, anillando y aserrando árboles), entonces como podía Nombre01 tener posesión del bien y por tal invadiendo una zona de protección de una quebrada sin nombre.
Es decir no tenía conocimiento de los elementos objetivos del tipo penal de la Ley Forestal.» (Cfr. folios 725 a 728; las negrillas son suplidas). Nótese, en primer lugar, que el tema sustantivo, por ejemplo, de los errores en teoría del delito, parte de haber determinado los hechos probados y esto, a su vez, implica una ponderación de todo el material probatorio conforme a las reglas de la sana crítica, sin preterir ninguna prueba (ni total ni parcialmente en su contenido) y derivando, de cada una de ellas, cada afirmación. En el presente asunto, lo primero que salta a la vista es que el juez no hace ese escrutinio probatorio pues cita, a su antojo, algunos elementos, pero omite ponderar el resto de ellos o los restantes y aludir a por qué les da o no credibilidad (así, por ejemplo, en el caso de los diversos testigos de cargo y las inspecciones judiciales). Por otro lado, afirma que “…existió incerteza de la persona autora de la invasión de esas tierras en el año 2007…” lo que traslada la decisión a temas probatorios y no de dogmática sustantiva.
Pero, si como lo anterior no fuera poco (y suficiente para dejar sin efecto lo resuelto), posteriormente mezcla, constantemente, el error de tipo con el error de prohibición, asumiendo, erróneamente, que las autoridades hasta tienen que advertirles a las personas que sus conductas son, o no, delictivas, lo que es un absurdo. Nótese que la alusión a las condiciones personales del encartado y el hecho de si él sabía que cometía o no un delito es propio de un conocimiento de la prohibición, es decir, de un error de prohibición directo. Justo en este es que entra en juego el contenido de una norma (que no es principio) constitucional (“nadie puede alegar ignorancia de la ley”: artículo 129 párrafo segundo de la Carta Magna) que, además, describe la excepción: “salvo que la misma ley autorice" y, por ello, es que no resulta inconstitucional el que el Código Penal “autorice” a alegar ese desconocimiento de la ley mediante el error de prohibición.
No obstante, el juez, en este asunto, constantemente pasa de mencionar que el encartado desconocía los elementos objetivos del tipo (sin indicar a cuáles elementos específicos se refiere) a aludir al desconocimiento del delito o de la prohibición, lo que son cosas distintas y llega, inclusive, a aludir al desconocimiento de los elementos objetivos y subjetivos del tipo, lo que no existe. Si el costarricense es un Estado de Derecho en donde, en el sistema de justicia, rige el principio de legalidad y se parte del adagio iura novit curia, cuando este se evidencia como irrespetado, se afecta todo el bloque de legalidad y se genera un gravamen a la parte que, entonces, desconoce los criterios con los que se le resuelve, que solo pueden ser los contenidos en la ley. Por ende, la sola confusión conceptual que evidencia el juez en la citada resolución, más los demás defectos de preterición probatoria implica que, por estas razones, se deban acoger ambos motivos y anularse la sentencia absolutoria dictada a favor de Nombre01 por el delito de invasión a una zona protegida, ordenándose el reenvío ante una nueva conformación del órgano de mérito, para lo que en derecho proceda, sin que esta cámara prejuzgue sobre el tipo de decisión a adoptar sino, solo, sobre la necesidad de que esta sea completamente fundamentada y que dicha motivación sea derivada de la prueba evacuada y apreciada conforme a las reglas de la sana crítica, a fin de resolver, en definitiva, el diferendo que lleva ya casi una década.
III.El licenciado Otto Giovanni Ceciliano Mora, apoderado especial judicial de Nombre10, quien es representante de la querellante Transunión S.A., en el primer acápite de su recurso se queja de la falta de fundamentación y la errónea valoración de la prueba que condujo a la absolutoria de los encartados Nombre01, Nombre04 y Nombre07 por el delito de usurpación. Sostiene que el a quo adoptó dicha decisión al otorgarle total credibilidad a Nombre18 y Nombre14 pero que este último no pudo afirmar, con certeza, que Nombre01 usurpara la finca de su representada, pese a que el testigo afirmó haber visto al referido encartado construyendo una casa y cortando árboles. La duda la fundamentó en que el padre del encartado Nombre02 y otras personas invadieron el inmueble. El apelante considera errónea esa tesis y contradictoria la sentencia pues el testigo afirmó haber visto al encartado Nombre02 construyendo y cortando árboles con motosierra dentro de la finca de su representado, pero la sentencia no se refirió a la totalidad de su testimonio.
Por su parte, Nombre14 aludió a quiénes habitan esas casas (Nombre01 y Nombre04), que fueron estos quienes construyeron las casas y que él conoce el carril que separaba las dos fincas, que fue superado por dichas edificaciones pues Nombre01 movió los mojones. Además, afirmó que ambas se ubican en la finca de su representada, específicamente en una zona boscosa y dentro del área de protección. Afirma que se hizo un análisis parcial de las probanzas pues estas se usaron solo para afirmar la duda. Con cita del numeral acusado como violentado en el tema de fondo, señala que el delito de usurpación puede configurarse por diversas formas, pero, en este caso, destaca la clandestinidad del inciso 1 y la totalidad de elementos referidos por el inciso 2 del artículo 225 del Código Penal, los cuales ni siquiera fueron analizados por el juez. Pide que se anule lo resuelto y se ordene el reenvío. Durante la audiencia oral celebrada ante su gestión, reiteró tales alegatos.
Al contestar este recurso, el defensor Salazar Álvarez, mediante escrito de folio 765, pidió que se rechazara porque la prueba fue correctamente valorada, ya que los actos perturbatorios los cometieron otras personas hace más de 28 años. Por su parte, la licenciada de la O Ferlini pidió el mismo resultado a favor de sus dos representados, aduciendo que la valoración de la prueba que se hizo fue correcta, porque solo Nombre18 fue el que manifestó, mediante conjeturas, que sus representados tenían que haber sido quienes construyeron e invadieron moviendo los mojones, pero que eso lo dijo no porque lo supiera, sino haciendo una valoración de posibilidades, presunciones de autoría y juicios de valor, para lo que pide que se presente especial atención a las grabaciones de este testimonio, concluyendo que el testigo no dio información veraz que permitiera acreditar quién o quiénes fueron los encargados de realizar aquellos actos.
Inclusive, el capataz de la finca, Nombre14, dijo no conocer a sus representados. La queja es de recibo. La sentencia inicia el examen de los hechos relativos a la usurpación a partir del folio 719 en que, pese a que la sentencia no contiene un elenco de hechos probados (sino solo de improbados) allí se indica uno de gran importancia para lo referente al delito de usurpación (y debe partirse que como la sentencia es una unidad de sentido lógico-jurídico, los sucesos acreditados pueden estar en cualquier parte de la decisión y no necesariamente en un acápite así denominado), a saber: “En debate se acreditó que la posesión agraria le pertenece a la empresa TRANSUNIÓN S.A a partir de los testimonios de Nombre14 que labora como administrador de dicha finca y quién refirió que tiene más de 32 años de laborar para Nombre12 y que desde esa época se dedican a actividades agrícolas y que años atrás personas usurparon un área de la finca destinada a zona forestal.
Que las personas irrespetaron los carriles y mojones colocados que delimitaban la finca de Nombre12 y que los lugareños tenían conocimiento que la empresa TRANSUNION S.A era la que ejercía la posesión de la finca, que estaba delimitaba por carriles y mojones. Lo anterior lo ratificó el testigo Nombre18 que narró en el contradictorio que hace aproximadamente entre 28 y 29 años el con otras personas invadieron una finca aledaña a la finca en conflicto, que luego el papa de Nombre01 conocido como Nombre02 usurpó la finca que le pertenece a Nombre12, esto irrespetando los carriles y linderos de la finca. Para el Tribunal se acredito que la finca de Nombre12 estaba destinada a la producción agrícola (naranjales) y que una parte de montaña era protegida, todo esto consta no solo en expediente penal sino también del expediente agrario…” Lo anterior es relevante porque el delito de usurpación tutela la posesión, no la propiedad o titularidad formal (como erróneamente lo indica el juez en folio 720 frente).
Y esto es así no porque esta cámara lo diga, ni porque haya cientos de pronunciamientos jurisprudenciales o textos doctrinales que lo afirmen, sino por la sencilla razón de que el artículo 225 del Código Penal lo estipula al mencionar, a modo de ejemplo en el inciso 1, “despojare a otro, total o parcialmente, de la posesión o tenencia…” Ahora bien, en forma contradictoria, el a quo, inmediatamente señala, en folio 719 vuelto: “…lo único que se acreditó en debate respecto a Nombre01 era que permanecía en una pequeña área aledaña a una quebrada sin nombre; esto aún y cuando en debate indicara que tenía derechos sobre ese bien inmueble. Nombre01 arguye en debate en su derecho de defensa que lo ampara un documento de carácter privado que lo constituye como poseedor no solo de esa pequeña área de terreno sino de aproximadamente 6 o 7 hectáreas, esto según carta de donación privada de posesión de propiedad, documento que no tiene ni plano catastrado ni certificación registral a diferencia de los documentos que aportó la empresa TRANSUNIÓN S.A, visibles a folios 6 a 7 y 9 que acreditan frente a terceros su publicidad.
Tales documentos no prueban que Nombre01 sea poseedor agrario de la finca, lo que se acreditó sin ninguna duda es que Nombre01 permanece dentro de la finca y que tiene construcciones en una quebrada sin nombre.” (Se suplen las negritas). Entonces…si la parte querellante detenta la posesión del inmueble, según lo tuvo por acreditado el juez, y también se probó que el encartado permanece en el inmueble y tiene allí construcciones…¿cómo llegar a afirmar, sin incurrir en contradicciones, que no hay usurpación? Nótese que permanecer en el inmueble y tener construcciones son formas de detentar posesión sobre un inmueble que ya el mismo juez dijo que poseía la otra parte y que los documentos que el encartado Nombre01 exhibía en apoyo a su supuesto derecho no eran válidos con tal fin. Nótese que la siguiente frase hace inexplicable, desde un punto de vista jurídico, el razonamiento del juez: “El interés en estos casos no es solo es la posesión de una finca sino la explotación o producción agrícola para fines de subsistencia o de explotación económica; la única explotación agrícola de parte de Nombre01 era que tenía unas cuantas matas de banano y guineo negro al borde de la quebrada sin nombre y unos pequeños senderos en los límites del conflicto, así lo hace constar los informes rendidos por funcionarios del SINAC (Sistema de Áreas de Conservación) folio 22 y 23 del expediente 11-000707-573-PE tomo I.” ¿Cuál es el fundamento jurídico o dogmático de tal afirmación?
¿De qué parte del tipo penal contenido en el artículo 225 del Código Penal extrae el juez que el delito de usurpación se configura solo cuando hay explotación agrícola o económica? No lo explica ni esta cámara lo comprende. Aquellas afirmaciones derivaban en la necesidad de que el juez examinara por qué esa permanencia de Nombre02 y la tenencia de construcciones en el inmueble no era un despojo de la posesión de la entidad querellante, lo que nunca hizo y eso es suficiente para anular dicha decisión. Respecto a los otros coencartados, la sentencia es igualmente confusa y, para evidenciarlo, baste esta transcripción de un párrafo contenido a folio 721: “…con respecto a Nombre04 y Nombre07 ya que ningún testigo los observa realizando actos de usurpación; tanto es así que Nombre04 y Nombre07 son vinculados en los hechos años después en apariencia de sucedido la usurpación. El testigo Nombre18 observa a Nombre04 construyendo casas dentro de la propiedad de la finca del ofendido y así lo refirió: ‘…Nombre01 y Nombre04 fue el que construyó esa casa…’ esto no es óbice para intuir o presumir que Nombre04 y mucho menos Nombre07 tuvieron la intención dolosa de despojar de manera clandestina de la finca, pudieron darse muchas razones de su instancia en la finca, tal es así, que los mismos testigos Nombre18 y Nombre14 indicaron que en dicha finca se vendieron lotes a terceros, siendo hasta una posibilidad de permanencia de Nombre04 y Nombre07 en las tierras del agraviado.
No es posible afirmar que tanto Nombre04 como Nombre07 despojaron clandestinamente la propiedad a Nombre12 debido a que la única ocasión que se les identificó a estos fue por orden emanada por el Fiscal a cargo esto a oficiales del OIJ en fecha 22 de marzo del 2013 (informe 054-DM/ORS-13) y que en ese momento los actos de investigación iban dirigidos hacia Nombre01 y mientras se daban las pesquisas se ubican a ambos imputados en un rancho, folios 53 a 61.” (Las negritas son suplidas). ¿Por qué construir casas en una tierra poseída por otras personas no implica intención de despojar? Probablemente porque una vez más el juez confunde los alcances de un dolo natural o avalorado (saber y conocer que se está construyendo una casa y que se hace en terreno poseído por otra persona) con el conocimiento de la ilicitud (creer que se tiene permiso para ello, o que no se está cometiendo delito, por ejercer un derecho derivado de un título o porque se ignore la prohibición).
Es decir, los errores conceptuales y jurídicos que posee el juez de mérito, tanto en materia de fundamentación como de dogmática sustantiva, incidieron en el resultado de lo resuelto y son motivo suficiente para que, ante la queja de la contraparte a través de este medio recursivo, la decisión deba anularse, sin que sea necesario continuar auscultando la resolución que muestra muchas otras contradicciones e inconsistencias. Así las cosas, se acoge este motivo y se anulará la sentencia absolutoria dictada a favor de Nombre01, Nombre04 y Nombre07 por el delito de usurpación, ordenándose el reenvío ante una nueva conformación del órgano de mérito, para lo que en derecho proceda.
IV.El licenciado Luis Salazar Álvarez, defensor público de Nombre01 alega, como único motivo de su recurso, la improcedencia de la condena civil por falta de un injusto penal y por falta de elementos subjetivos y objetivos de la acción civil. Sostiene que, aunque la jurisprudencia ha indicado lo contrario, no cabía la condena civil pues no se ha demostrado el injusto penal ni tampoco una relación directa del daño biofísico y social que se le atribuye a su representado ya que el injusto permite establecer una conexión directa entre el imputado y el daño invocado. En este caso, no hubo ninguna posibilidad de demostrar que su representado tuviera relación alguna con las construcciones que se ubicaron en una zona protegida, y más bien los testigos refirieron, de forma homogénea, que fueron varias personas las que invadieron esos lugares hace unos 28 a 30 años y, entre ellas, estuvo el padre del encartado, Nombre02 quien fue la persona que inició con labores de trabajo y construcción en ese sitio.
Afirma que también se evidenció, durante el debate, que a pesar de se le atribuyeron una serie de daños a Nombre01, la única vez que se le ubica físicamente en el lugar de los hechos, según informe del SUMAC, fue en una ocasión en el año 2014, pero no se determinó que él viviera en la casa. Agrega que, en esa oportunidad, se acusó a varias personas que estaban allí por los hechos y había otras casas habitadas, lo que hace controversial la responsabilidad civil de su patrocinado. Menciona que el juez ordenó la reapertura del debate para solicitar un nuevo informe al SINAC sobre la ubicación de las casas en el lugar de los hechos, y dicho informe estableció que había cinco viviendas en el lugar, con otras personas desconocidas para el proceso y que no tienen ningún conocimiento ni relación con la situación jurídica que se está dilucidando. Afirma que se podría ocasionar un perjuicio grande y un vicio en cuanto se está ordenando el derribo de unas edificaciones que no se determina con exactitud a quién le pertenecen, pues podría ser de una persona que no está siendo juzgada por estos hechos y se le llegaría a demoler su casa de habitación sin haberle realizado un debido proceso.
Estima improcedente que, por eso, se afirme la existencia de una relación directa entre el daño ocasionado y su representado y que este tenga que soportar condena en lo civil, pese a la absolutoria penal. Pide que, desde esta sede por tratarse de cuestiones civiles, se declare sin lugar la acción civil resarcitoria y se absuelva del pago de las costas civiles a su representado. No hubo respuestas a este recurso, ni escritas ni orales salvo la breve referencia de la procuradora de que se mantuviera lo resuelto en lo civil. La apelación no puede prosperar. Llegados a este punto, es lógico suponer que, dados los serios yerros que tiene el resto de la decisión, sucederá algo similar con este segmento de lo decidido. No obstante, se da la particularidad de que en materia civil rige el principio dispositivo y hay que atenerse a los argumentos del apelante y, en este caso, el defensor público, al plantear su recurso, ha elegido hacerlo a partir de una encrucijada para los propios intereses que dice defender pues si afirma, como lo hace, que las construcciones en la zona de protección (cuyo derribo se está ordenando) no fueron efectuadas por su patrocinado sino que “pudieron serlo por terceros no traídos al proceso”, carecería de legitimación para recurrir ese extremo y si acepta que fue Nombre01 quien las efectuó y que han estado bajo su dominio, aunque avala su legitimación para recurrir, a la vez confirma la tesis no solo de que su patrocinado debe indemnizar civilmente sino que también tendría alguna responsabilidad penal.
Pese a ello, el tribunal analizará su posición, asumiendo que tenga legitimación para plantear la queja, es decir, que sí pueda hacérsele alguna atribución de responsabilidad por haber sido él el causante de los eventos dañosos. Antes, empero, es preciso indicar una obviedad. El citado profesional aquí parece desconocer que la tesis de que sea necesario un injusto penal para acoger una acción civil, ha sido superada desde hace varias décadas. Esta cámara, con una integración parcialmente diferente (R: Chinchilla, H. Soto y M. Gómez) a través del voto número 2019-1091 indicó al respecto: «…es menester indicar que la referencia del quejoso de que no hay injusto penal y que, por ello, no cabe teóricamente la condena civil, no es aceptable. Aunque originalmente se planteaba la necesidad de que existiera el injusto penal, esa es una tesis ampliamente superada, primero por votos aislados y de minoría del antes denominado Tribunal de Casación Penal y luego, en forma unánime y constante, para, finalmente, ser asumida por los diversos órganos de casación penal del país de aquel entonces, al punto que hoy por hoy nadie cuestiona tal posibilidad, dada la contundencia de aquellos argumentos.
Es así como en el voto número 2007-1545 (juezas Nombre23 y Chinchilla y juez Nombre24) del antiguo Tribunal de Casación Penal, asumido, entre otros, en el voto 2012-2311 (R. Chinchilla, L. García y Nombre25) se analizó el tema indicando: "...aunque tradicionalmente, partiendo de la literalidad del artículo 103 del Código Penal que se refiere a "hecho punible", se ha dicho que se requiere un injusto penal (conducta típica y antijurídica) para poder acoger una demanda civil (en tal sentido, a nivel nacional: Nombre26, Nombre27. La responsabilidad civil derivada del hecho punible. Editorial Juricentro, San José, 1994 pp. 116-166, 225), es lo cierto que dicha posición paulatinamente ha sido abandonada tanto doctrinariamente (cfr.: Nombre28, Nombre29. Responsabilidad civil. Areté/Diké, San José, 2001, pp. 56-71), legalmente mediante norma especial y posterior a aquella (artículo 40 párrafo tercero del Código Procesal Penal: "La sentencia absolutoria no impedirá al tribunal pronunciarse sobre la acción civil resarcitoria válidamente ejercida, cuando proceda") como jurisprudencialmente (Sala Constitucional, voto Nº 3603-93: "Partiendo del hecho de que acción penal y acción civil son diferentes e independientes entre sí y que marchan juntas solo para efectos de economía procesal; el hecho de que se absuelva en cuanto a la acción penal no implica que se haya de absolver también en cuanto a la civil.
De tal modo, la absolución por razones puramente penales no obsta el pronunciamiento sobre la acción civil y específicamente su acogimiento por la autoridad penal, de conformidad con el artículo 11 del Código de Procedimientos Penales, que en relación con el 398 del mismo cuerpo normativo faculta al Juez para que aun cuando absuelva ordene la restitución, indemnización o reparación demandada. Así las cosas, la aplicación de tales artículos por parte del juzgador obedece al cumplimiento del principio de legalidad, el cual es garantía fundamental integrante del Debido Proceso. Por ello, no es posible admitir que el Tribunal haya incumplido con el Debido Proceso, pues su actuación se encuentra plenamente amparada en normas procesales (...) la declaratoria con lugar de una acción civil resarcitoria en sentencia absolutoria, no constituye violación a la garantía del debido proceso, ni al derecho de defensa").
En todos los razonamientos se parte de la base de que hay un principio de rango constitucional (ergo supra legal) como es el de acceso a una justicia pronta y cumplida y la tutela judicial efectiva (artículo 41 de la Carta Magna) que ampara a todas las personas, incluyendo a las actoras civiles y que actuar en sentido contrario sería violarlo. Además, se acepta que la antijuridicidad civil, base de la indemnización (salvo en la responsabilidad objetiva) es mucho más amplia que la penal desde que la primera puede surgir de incumplimiento contractual o de responsabilidad extracontractual, en ambos casos no derivada de delitos o cuasidelitos. Se ha dicho en este sentido: "Debe insistirse en que la condena civil se fundamentó en el mismo evento investigado, entendido, eso sí, como ilícito civil, sobre el que el imputado ejerció su derecho de defensa (...) de modo que resulta correcto el proceder del Tribunal.
Al respecto, recuérdese que esta Sala ha considerado que la responsabilidad civil es independiente de la comisión de un ilícito. Así, por ejemplo, se ha establecido: “…La frase ‘cuando proceda’, contenida en el párrafo tercero del artículo 40 del Código Procesal Penal debe necesariamente interpretarse en el sentido de que, a pesar de la absolutoria penal, el tribunal puede pronunciarse sobre la acción civil cuando subsistan otros supuestos normativos distintos al delito en los cuales pueda sustentarse ese deber de indemnizar. Es decir, cuando los hechos acreditados sean suficientes para demostrar la existencia de responsabilidad civil, sin necesidad de que la norma sustantiva que genera la obligación de indemnizar el daño proceda del Derecho Penal, y sin necesidad de que se demuestre la responsabilidad penal o administrativa de un funcionario público determinado. La anterior interpretación es la única posible a derivar de los principios de Economía Procesal e Interpretación Restrictiva, en consonancia con nuestro ordenamiento constitucional, con el único requisito de que debe concederse al demandado oportunidad de defensa…” A lo que habrá que añadirse que tales supuestos normativos pueden provenir de una responsabilidad civil extracontractual, las más de las veces, y, contractual (…) Admitir lo contrario implicaría, como también lo entendió esta Cámara en el mismo precedente citado, violentar el principio constitucional de justicia pronta y cumplida, resultando un absurdo remitir a la parte, que ha ventilado su conflicto en sede penal, que acuda nuevamente al aparato judicial en resguardo de sus derechos" Sala Tercera de la Corte Suprema de Justicia, voto Nº 102-2007 del 23 de febrero.
En igual sentido y de esa misma sala el voto Nº 134-2001. Del Tribunal de Casación Penal cfr. el voto Nº 249-F-98." Entonces, queda claro que, en el estado actual de desarrollo de la ciencia jurídico-penal en el país, no es necesario que se produzca un injusto penal para que se dé una condena civil, por lo que ningún vicio se ha producido con que, habiéndose absuelto en lo penal por duda respecto a la participación de los encartados, se haya condenado (…) en lo civil…» Por ende, ningún impedimento existe en que se haya absuelto al encartado (aún por prescripción para algunas calificaciones) con que se le condene en lo civil si se determina la existencia de un nexo causal entre una conducta suya (subjetiva) o entre su nexo objetivo de respuesta y un resultado dañoso. La sentencia razonó este tema de la siguiente forma: «VI- SOBRE LA ACCIÓN CIVIL RESARCITORIA: En el proceso penal bajo estudio, el Estado por medio de la Procuraduría General de la República se constituyó en actor civil, fungiendo como demandado civil el aquí encausado Nombre01, se logró acreditar la existencia entre acción y el daño y por tal se estableció partidas por daño biofísico y social.
(…) En el presente caso se dictó sentencia absolutoria a favor al demandado civil Nombre01, por la existencia de una duda respecto a la figura jurídica del error de tipo y que lo excluye de responsabilidad en cuanto al delito de Invasión de una Zona de Protección, ya existe un nexo causal de responsabilidad a partir del conocimiento que tuvo a partir del año 2014 respecto a la advertencia que le hicieron los funcionarios del SINAC al demandado civil Nombre01 con relación al rancho construido de dos plantas se ubica a 7 metros del cauce de la quebrada por lo que se encuentra dentro del área de protección de la quebrada. Construcción que como se explicó vivió el padre del demandado civil Nombre02 en una época, el daño ambiental existió en la presente causa y por tal la prueba documental es clara y así consta en el tomo II del expediente 11-000707-573-PE la existencia de dos construcciones que invaden un porcentaje de la quebrada sin nombre.
La ubicación de los ranchos son identificados en la finca a partir del año 2011 y estos constan en sendos documentos desde el año 2011 funcionarios del OIJ y el SINAC (DS-1251-11 del SINAC, DM 15-ORS-13 del OIJ) y estas se verifican de nuevo en el informe del SINAC-ACAHN-JSS-053-2020 folios 697 a 703 del tomo II del expediente 11-000707-573-PE. Aún y cuando le queda claro al Tribunal que la finca pertenece a la empresa TRANSUNION S.A representada por el ofendido Nombre12 que durante el contradictorio acreditó la posesión agraria y que durante una época fue usurpada por personas lugareñas y de otras nacionalidades, uno de ellos el padre Nombre02. Ya las construcciones en la zona de conflicto constan desde el año 2009, esto por el acta de reconocimiento judicial del Juez Agrario de fecha 19 de marzo de 2009 del expediente 09-000029-507-AG tomo I folios 85 a 86. Durante ese período se le permitió a Nombre02 de la permanecer en la finca de la empresa TRANSUNIÓN S.A por orden del ofendido Nombre12 que representa a la empresa TRANSUNIÓN S.A hasta que se resolviera el proceso reivindicatorio; pero en ese período el padre y el demandado civil confeccionaron documentos privados donde el primero le donó extensiones de tierra de la finca de la empresa TRANSUNIÓN S.A. Estas acciones dudosas entre las partes se está (sic) resolviendo en el proceso agrario civil del expediente antes mencionado, donde no queda claro la extensión de tierra donada por Nombre02 a Nombre01, en un documento que dona siete hectáreas (razón de fecha cierta) mientras que la carta de donación privada de posesión de propiedad indica seis hectáreas de folios 122 y 123 del expediente 09-000029-507-AG.
Pero en debate el imputado Nombre01 en su derecho constitucional y procesal declaró que su padre le donó esas extensiones de tierra, ante tal manifestación según el demandado civil es dueño del terreno y lo que existe en el lugar, esto las edificaciones construídas dentro del área de protección de una quebrada, aportó como prueba los documentos antes aquí mencionados. En debate ninguna otra persona aparte del demandado civil acreditó la posesión de las extensiones de tierra usurpada, es que los testigos Nombre18 y Nombre14 narraron que en apariencia hubo venta de lotes de la finca de la empresa TRANSUNIÓN S.A, eso sin asegurar que tal circunstancia sucediera. (…) Tal cual como se ha venido motivando tanto la prueba testimonial y documental acredita que las construcciones en conflicto pertenecen al demandado civil Nombre01 (…) El nexo causal entre el hecho y el daño también debe ser cierto; esto quiere decir que debe existir certeza absoluta.
La corriente jurisprudencial costarricense ha utilizado una de las clasificaciones que ha tenido mayor eco en la corriente jurisprudencial es el daño patrimonial, pero en este caso el daño biofísico y social. Este se acreditó en debate el daño causado a los recursos naturales, existió una afectación a intereses difusos y que por tal debe existir indemnización al respecto, pero también por el principio pro natura y de irreductibilidad del bosque, la conducta invasora debe ser suprimida a fin de eliminar el riesgo de perjuicio al recurso natural e impedir que se saque provecho del ilícito, ello de oficio, aún en absolutorias y hasta sin acción civil. Consta en sendos documentos debidamente admitidos de la existencia de un daño ambiental y que en el año 2014 al demandado civil se le advirtió de tal aspecto con respecto a sus obligaciones y el daño que le causaba a los Recursos Naturales y por tal debe indemnizar ese daño.
Es que las pretensiones de la Procuraduría General de la República prevalecen desde del año 2007 donde se da la invasión de una zona de protección de una quebrada sin nombre; pero el daño biofísico y social se debe conceder en abstracto ya que consta el informe SINAC-ACAHN-JSS-053-2020 folios 697 a 703 del tomo II del expediente 11-000707-573-PE, la ubicación de dos construcciones con porcentajes (40% y 80%) de invasión es necesario determinar con exactitud el daño biofísico y social hacia los Recursos Naturales; tal circunstancia hace que debe condenarse al pago de las costas personales hasta que se determine en concreto el daño ambiental. El testigo Nombre18 relató en debate que al día de hoy el demandado civil Nombre01 permanece en la finca de TRANSUNIÓN S.A, que lo ha visto pernoctar en el rancho. Los testigos Nombre19 y Nombre16 manifestaron que cuando se presentaron en el 2014 le advirtieron al demandado civil Nombre01 en la condición que era necesario que eliminara los ranchos, los cuales se mantienen al día de hoy.
Restitución de las cosas a su estado anterior: (…) luego de acreditado de que las construcciones han sido vinculadas en todo el proceso penal que se ubican dentro de un área de protección de una quebrada sin nombre. La restitución de la cosa debe ser en este caso hasta de manera oficiosa la restitución del bien a su estado anterior (…) Se ordena restituir el área afectada ubicada en Heredia, Sarapiquí, Pueblo Nuevo La Virgen en la finca de la Empresa TRANSUNIÓN S.A. al estado anterior al hecho esto con el DERRIBO de UN RANCHO CONSTRUIDO DE DOS PLANTAS con un 40% dentro del área de protección de una quebrada y el DERRIBO DE UN RANCHO construido con 80% dentro del área de protección de una quebrada y además del derribo de los puentes de madera del lugar y las áreas de cultivo alrededor de la quebrada sin nombre. Se les ordena a los personeros del Sistema Nacional de Áreas de Conservación de la Cordillera Volcánica Central con la persona que ejerce la posesión del inmueble de la empresa TRANSUNIÓN S.A representada por Nombre11 y personal de la Fuerza Pública el derribo del porcentaje de dichos inmuebles cuando la sentencia penal adquiera firmeza.» (Cfr. folios 728 frente a 730 vuelto; se suplen los destacados y se suprimen referencias teóricas).
Es claro, entonces, que el juez sí tuvo por demostrada la existencia de un daño ambiental y que este fue causado por la permanencia del encartado en el sitio (al margen de que el mismo juez dudara de si dicho acto generaba o no delitos), determinándose así el nexo causal, todo lo cual fue correctamente derivado de la prueba allegada al debate y mediante una motivación adecuada, que el apelante no impugna. El que el nuevo informe al SINAC determinara la ubicación de cinco casas en el lugar de los hechos, con otras personas desconocidas para el proceso, no excluye que en el rancho de dos plantas se ubique al encartado y que la prueba testimonial valorada relacione al endilgado con dicha construcción, por lo que el recurso debe rechazarse y mantenerse lo resuelto tanto en lo civil como respecto a la orden de derribo y las costas.
POR TANTO:
Se declaran con lugar los recursos de apelación interpuestos por la licenciada Margot Avellán Ruiz, procuradora penal y por el licenciado Otto Giovanni Ceciliano Mora, apoderado especial judicial del querellante Nombre10 en representación de Transunión S.A.. En consecuencia, se anula la sentencia absolutoria emitida a favor de Nombre01 por el delito de invasión a una zona protegida, así como la absolutoria dictada a favor de Nombre01, Nombre04 y Nombre07 por el delito de usurpación. Sobre tales extremos se ordena el reenvío ante una nueva conformación del órgano de instancia. Se declara sin lugar la impugnación planteada por el licenciado Luis Salazar Álvarez, defensor público del justiciable Nombre01. Se mantiene incólume (por no haberse recurrido) la sentencia absolutoria por prescripción de la acción penal a favor de Nombre01 por los delitos de tala ilegal, aprovechamiento ilegal de producto forestal y un delito de vertido, así como (por rechazarse el recurso) la condena civil contra Nombre01 y a favor del Estado y la orden de restitución de la zona afectada al estado anterior, lo que incluye el derribo de las edificaciones. NOTIFÍQUESE.
