Goicoechea, at siete horas treinta minutos, on nueve de junio de dos mil veinte.- APPEAL filed in the present proceedings against Nombre01, of legal age, Costa Rican, identity card number CED01, born in Limón on 1 de octubre de 1978, daughter of Nombre01 and Nombre02, single, resident of Limón, Pococí, Cariari; for the offense of ENCROACHMENT INTO A PROTECTION ZONE (INVASIÓN A UNA ZONA DE PROTECCIÓN), to the detriment of THE ENVIRONMENT. Judges Alfredo Araya Vega and Gustavo Rojas Gutiérrez and Judge Iris Valverde Usaga participated in the decision. Attorney Melvin Acedo Cantón, private defense counsel for the accused; the accused Nombre01, in a document authenticated by attorney José Francisco Herrera Umaña; and attorney Luis Vindas Vargas, representative of the Ministerio Público, Fiscalía Adjunta de Pococí, appeared before this Court.

WHEREAS:

I.By judgment number 146-2020, issued at nueve horas treinta minutos on diecisiete de febrero de dos mil veinte, the Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, Pococí, ruled: “THEREFORE: Pursuant to Articles 39 and 41 of the Constitución Política; 8.2 of the Convención Americana sobre Derechos Humanos; 11 of the Declaración Universal de Derechos Humanos; 1, 2, 3, 11, 21, 22, 30, 31, 45, 50, 59 al 63, 71, 75, 76, 103 of the Código Penal; 1, 2, 3, 9, 37, 40, 111 a 124, 140, 141, 142, 180 a 184, 265, 267, 328, 330 a 336, 341, 352, 360 a 365 y 367 of the Código Procesal Penal; Articles 50 and 89 of the Constitución Política; Articles 19, 33, 58 inciso a y b y 61 inciso c of the Ley Forestal; Article 98 of the Ley Conservación de Vida Silvestre; 1045 of the Código Civil; and 122, 124, 127 of the rules currently in force concerning civil liability under the Código Penal de 1941, Nombre01 is hereby found to be the RESPONSIBLE PERPETRATOR of one offense of encroachment into a protection zone, in ideal concurrence of offenses (concurso ideal) with one offense of land-use change (Cambio de Uso de Suelo), and is sentenced to THREE MONTHS’ IMPRISONMENT in accordance with the sentencing rules governing such concurrence; she is also sentenced to ONE YEAR’S IMPRISONMENT for the offense of wetland drainage (Drenaje de Humedal), which is in material concurrence of offenses (concurso material) with one offense of exploitation of forest resources (aprovechamiento de recurso forestal), for which she is sentenced to ONE MONTH’S IMPRISONMENT, all to the detriment of the Environment, for a total of ONE YEAR AND FOUR MONTHS’ IMPRISONMENT.

This sentence shall be served in the appropriate correctional facility, with credit for time served in pretrial detention. Because she meets the requirements established by the Código Penal, the convicted person is granted the BENEFIT OF A CONDITIONALLY SUSPENDED SENTENCE (BENEFICIO DE EJECUCIÓN CONDICIONAL DE LA PENA) for a term of 3 YEARS, during which she may not commit any intentional offense punishable by more than six months’ imprisonment; otherwise, the benefit granted to her may be revoked and she shall be required to serve the sentence imposed. The civil claim for damages (acción civil resarcitoria) filed by the Procuraduría General de la República against Nombre01 is granted, and she is ordered to pay damages and the costs of the civil proceedings, with the amounts to be determined in subsequent proceedings, as well as any statutory interest and default interest accruing until the amounts ordered are paid in full.

The huts and any other structures located on the affected site shall be demolished, the channels created shall be eliminated, and the site shall be restored to its original condition. The accused is granted a period of 6 months to do so under the supervision of MINAET; failing that, this institution is commissioned to carry out the actions ordered. Once the judgment becomes final, notice shall be given to the instituto nacional de criminología, the juzgado ejecución de la pena, and the registro judicial for action within their respective authority. NOTICE SHALL BE GIVEN.” (sic).

II.Attorney Gerardo Anchía Rodríguez, representative of the Ministerio Público, Fiscalía Adjunta de Limón, filed an appeal against the foregoing ruling.

III.After conducting the corresponding deliberation in accordance with Article 465 of the Código Procesal Penal, the Court considered the issues raised in the appeal.

IV. The relevant statutory requirements have been observed in the proceedings

Appellate Judge Araya Vega drafts the decision; and,

CONSIDERING:

I.On 17 de marzo de 2020, attorney Melvin Acedo Cantón, in his capacity as private counsel for the accused Nombre01, and the accused personally, in the exercise of her right to conduct her own defense (defensa material), through a document authenticated by attorney José Francisco Herrera Umaña, filed an appeal against judgment number 146-2020, issued by the Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica at 09:30 hours on 17 de febrero de 2020, which convicted Nombre01 of one offense of encroachment into a protection zone, in ideal concurrence with one offense of land-use change, as well as one offense of wetland drainage in material concurrence, and sentenced her to one year and four months’ imprisonment. A review of the appeals filed establishes that they meet the formal requirements which, under the principles of flexibility, accessibility, breadth, and informality inherent in this means of challenge (medio impugnaticio), are necessary for their proper consideration, for a comprehensive review of the judgment, and to guarantee the right to appeal in criminal matters provided for in Article 8.2h of the Convención Americana sobre Derechos Humanos; moreover, the challenge was filed within the time limit prescribed by the law of criminal procedure.

To analyze logically the various arguments presented by the appellants, this Court shall organize and examine them without necessarily following the structure proposed by the parties challenging the judgment. Common or related arguments shall also be grouped together to avoid unnecessary repetition. In each instance, a brief summary shall be provided of each party’s position, both written and oral, and only thereafter shall this panel begin its review.

II.Oral hearing (audiencia oral): The defense, both through counsel and personally, waived the requested oral hearing due to the SARS-Co-V-2 pandemic prevailing worldwide.

III.In the third ground of appeal, private defense counsel alleges a “failure to state reasons regarding the statute-of-limitations defense (excepción de prescripción).” He states that the defense argued that the prosecution was time-barred because two years and six months elapsed between the preliminary hearing (audiencia preliminar) (10 de octubre de 2016) and the scheduling of the trial (señalamiento a debate) (06 de mayo de 2016), but that this argument was rejected without adequate reasons based on the assertion that the mandatory period had not elapsed. The claim cannot succeed. Nombre01 and co-defendant Nombre03 were charged with the offenses of encroachment into a protection zone, land-use change, and wetland drainage for removing soil from the channel of a Ramsar wetland and constructing a dwelling, a storage building, and a wooden structure. The trial court (tribunal a-quo) found that Nombre01 had committed these acts.

These unlawful acts constitute offenses under Articles 58 inc. a y b, 61 of the Ley Forestal and 48 of the Ley de Conservación de Vida Silvestre, each punishable by a maximum term of three years’ imprisonment. A review of the court file shows that two preliminary hearings were scheduled: the first on 10 de octubre de 2016 (cf. folio 46), and the second on 20 de febrero de 2018 (cf. folio 53). A trial was subsequently scheduled for 06 de mayo de 2019 (cf. folio 92). However, the mandatory period of 18 months required for a declaration that the prosecution was time-barred did not elapse between those events. Under Article 33 of the Código Procesal Penal, the limitation period is interrupted by any decision convening a preliminary hearing, not merely the first such decision. The defense position that only the period between the scheduling of the first preliminary hearing and the trial should be considered is therefore erroneous because, under the law, every scheduling of a preliminary hearing must be considered, and in this case the scheduling of the second preliminary hearing again interrupted the limitation period for the criminal prosecution (prescripción de la acción penal). For the foregoing reasons, the claim is denied.

IV.In his first ground of appeal, private defense counsel alleges “Improper determination of the facts found to have been proven.” After transcribing the facts found to have been established, he points to two violations: first, that the proven facts are unclear because they are merely a transcription of the facts alleged in the indictment, private criminal complaint, and civil claim; second, that they duplicate the facts alleged in the private criminal complaint and the civil action for damages (acción civil resarcitoria), such that the same facts apparently were found proven twice. He likewise complains that the introduction to the judgment does not mention the appearance of the private complainant and civil plaintiff. In private defense counsel’s second ground of appeal, he alleges a “failure to state reasons due to erroneous interpretation of the evidence.” He states that the trial court found the defendant’s liability established on the basis of the testimony of Nombre04 and Nombre05, the photographs, and the MINAET report.

He mentions that the reasoning used concerned the training the defendant had received as a tour guide in Barra del Tortuguero and the fact that, because she owned the land, she was deemed responsible for constructing the buildings and draining the canal. He contends that there was no evidence establishing that the accused felled trees, drained the canal, or erected buildings, since the aforementioned witnesses did not see her committing the offense. In private defense counsel’s fourth ground of appeal, he alleges an “erroneous application of substantive law.” He argues that the judgment did not establish intent (dolo) in the proven conduct, because he considers her status as a tour guide and owner of the land insufficient to support her participation in the offense, whether as a principal, co-principal, or under the doctrine of functional control (dominio funcional). In the defendant’s first ground of appeal, she challenges the reasoning of the judgment.

She asserts that the judgment under appeal incorrectly assessed the evidence by disregarding the essential guarantees of due process and the defendant’s presumption of innocence (estado de inocencia). She states that the defendant could not be investigated because she could not report her husband, Nombre03, and, furthermore, did not know the facts being investigated by the Public Prosecutor’s Office. She contends that the charges brought by the Public Prosecutor’s Office and Procuraduría General de la República induced the trial court to commit the offense of judicial misconduct (prevaricato), because intent was not established in the alleged conduct. She mentions that, at trial, the accused stated that she had neither constructed buildings nor felled trees. She maintains that when MINAET arrived at her property, its personnel entered without permission, with one person entering her storage building and another visiting the dock.

In the defendant’s second ground of appeal, she argues that the defense theory concerning the absence of intent and her inability to report her husband for the acts was not considered. She contends that the existing evidence was not assessed as a whole. She states that the judgment made subjective assessments without establishing that it was physically impossible for her to commit the offense. She transcribed the facts alleged by the Public Prosecutor’s Office and Procuraduría General de la República, as well as the operative portion of the judgment. In her third ground of appeal, the accused contends that due process was violated by an erroneous assessment of the evidence. She insists that it was physically impossible for the accused to be the principal offender and that the Constitución Política also guaranteed her right not to report her husband, for which reason no sentence could be imposed on her.

The arguments must be rejected. In the view of this Criminal Judgment Appeals Chamber, the judgment’s intellectual reasoning contains no defect; for the reasons stated in the judgment, it reflects coherent, consistent, precise, complete, logical, and noncontradictory reasoning. Indeed, in this particular case, the Court established the facts through a logical argumentative process that respected the rules of sound human understanding. Both the prosecution and defense evidence were examined extensively and meticulously, and a coherent, comparative analysis of the evidence determined that the complainants’ accounts were credible because the information provided was of sufficient quality and evidentiary weight to support the prosecution’s theory. The Court clearly set out the logical path (iter lógico) by which it reached its decision to convict the defendant, Nombre01, and properly supported its assessment of the testimonial and technical evidence by establishing the proven facts and the truthfulness of the prosecution testimony.

The judgment assessed the testimony given at trial by the accused and rejected the possibility that it was true because it lacked external corroboration; instead, the court rejected her account on the basis of a sound and rigorous assessment of the prosecution evidence (cf. pages 20 and 21 of the judgment). Both the claims of defense counsel and those of the defendant focus on asserting that she is not responsible for the offenses with which she was charged because she was not observed while committing them. This theory is untenable, however, because conduct may be established through direct evidence or inferentially through circumstantial evidence (prueba indiciaria). Although direct evidence of a fact—such as a witness—may be unavailable in some cases, the evidentiary showing may instead be circumstantial or indirect. In such cases, strong and interconnected indicia must exist to establish liability through circumstantial evidence, and the judgment must address these matters.

Circumstantial evidence may be defined as a valid conclusion by which the Court, after assessing all the elements as a whole, reaches certainty as to liability on the basis of the indicia. That is, where no direct evidence of the event exists, proof of certain peripheral facts and logical reasoning lead to the conclusion that the event did occur and that, accordingly, the event giving rise to civil liability is present. The requirements for the validity, effectiveness, and existence of circumstantial evidence include: a. The foundational fact (hecho base), whether indicative or an indicator, must be fully proven; otherwise, it would amount merely to suspicion without any real support; b. The indicia must be multiple or, exceptionally, a single indicium of singular evidentiary force; c. The indicia must be concomitant with the fact to be proven and peripheral to the factual matter to be established.

They must also have been obtained legally and by lawful means; d. Where there are several indicia, they must be interrelated so that they reinforce one another and do not exclude the consequential fact; e. In the case of contingent indicia, they must be multiple, consistent, and convergent, and there must be no reliable counter-indicia. Accordingly, the judicial assessment of circumstantial evidence must satisfy the following standards: 1. The indicia must not be assessed in isolation, that is, one by one. They must be assessed as a whole, and the inference must be based on them; 2. The reliability of the maxim of experience (máxima de experiencia) must rest on general or scientific knowledge; there must be no equally well-founded applicable maxims of experience, meaning that it must not be possible to reach alternative conclusions having the same degree of probability; and the conclusion drawn from circumstantial reasoning must not contradict other facts found to have been proven. 3.

As to induction or inference, it must be reasonable; that is, it must not merely be nonarbitrary, nonabsurd, and well-founded, but must also fully accord with the rules of logic and experience, so that the specific fact to be established flows as a natural conclusion from the proven foundational facts, with a prior and direct connection between them under the rules of human judgment. Thus, to reach a conviction through circumstantial evidence, the analysis of the case must be preceded by discussion and adversarial examination regarding whether the substantive prerequisites of the evidence have been met, in order to overcome the presumption of innocence. In this matter, in Considerando IV of the judgment, the trial court conducted a rigorous analysis of the accounts given by Nombre04, a forestry engineer, supervisor, and MINAET official; Nombre05, the MINAET official responsible for the tourism area; and Nombre06, the MINAET official responsible for determining environmental damage; as well as report Acto-GASP-PNT-005-2015 (cf. pages 1 to 8), the environmental assessment (valoración ambiental) (cf. pages 21 to 26), the SINAC certification (cf. pages 30 to 32), the on-site inspection (inspección in situ) (cf. page 33), and SINAC official communications SINAC-ACTO-AL-158-2016, SINAC-ACTO-ASP-PNE-CERT-325, ACTO-GASP-PNT-4E-CP-005-2015, and ACTO-GASP-PNT-ADM86-2016 (cf. pages 43 to 45, 61).

Through that evidence, the court became convinced of the accused’s liability. The inspection conducted by Nombre04 in his capacity as a MINAET official confirmed how the wetland (humedal) had been drained, that approximately 400 square meters of soil had been removed, that felled and sawn trees were located along the road, and that various structures stood at the rear of the property (a storage building, a rustic shelter, and another structure). The plausibility of that testimony was externally corroborated by the statement of Nombre05, who took the photographs submitted to the case file (cf. pages 5 to 8) and who knows the accused because she is a tour operator in Barra del Tortuguero. Defense counsel and the defendant challenge the existence of intent in the accused’s conduct, disregarding the interest theory (teoría del interés) that must be followed for offenses of this kind, under which circumstantial evidence can clearly establish who owned the property, who was the sole beneficiary of the wetland drainage, the structures erected, and the encroachment upon the protected area (zona de protección).

It was established that the accused resided at that location and was solely responsible for it, such that she knew of the work being performed on the property and was its beneficiary. As to the absence of permission to enter the property, that argument is refuted by the MINAET officials’ own testimony and the reports submitted, which establish that the inspection was authorized. It must also be noted, however, that the preventive duties performed by the officials authorize them to conduct such inspections because the property is located within a natural conservation area. The defendant and appellant counsel insist that the co-defendant, Nombre03, was responsible for the acts. It is clear, however, that the evidence submitted refuted that theory, because the co-defendant spends most of his time in the United States of America and the only person who controlled the property was the accused, Nombre01.

Another factor establishing intent—which is normative, not subjective, as the appellants appear to understand it—was that the defendant was a tour operator in Barra del Tortuguero and therefore was thoroughly familiar with the legal prohibitions protecting a healthy and balanced environment and knew that the conduct carried out violated the rules protecting environmental areas.

Accordingly, through the testimonial and documentary evidence (elementos de prueba) already identified, the trial court (tribunal de instancia) was able to reconstruct the historical facts, verify that the defendant (imputada) was responsible for controlling the property because she conducted tourism activities in the area, visited the property and occasionally resided there, made use of its resources, and was the person who benefited from the drainage of the wetland (humedal), the construction of the buildings, and the encroachment into the protection zone (zona de protección). That reasoning contains no argumentative deficiency, and the evidence was assessed in accordance with the rules of sound rational judgment (sana crítica racional). There was no violation of the right to a defense (derecho de defensa) merely because the same facts alleged in the indictment (acusación), private complaint (querella privada), and civil action for damages (acción civil resarcitoria) were deemed proven; on the contrary, that was the factual framework within which the court below (tribunal a-quo) was required to rule, being bound by those facts under the principle of congruence (principio de congruencia).

Moreover, it is clear that the trial court (tribunal de mérito) had a set of facts deemed proven, such that repeating them would be pointless and could even cause confusion. In this specific case, however, what matters is that the essential aspects of the various sets of facts coincide; there is no contradiction or logical gap whatsoever, and therefore the factual findings (cuadro fáctico) can be understood by anyone who reviews their content. As to the failure to mention in the introductory portion of the judgment that the Procuraduría General de la República participated at trial, that is merely a clerical error (error material) causing no prejudice, since it was indeed present and represented the State. Under our procedural system, nullity for nullity’s sake (nulidad por la nulidad misma) has no place; therefore, in the absence of prejudice, that claim cannot succeed. In her appeal (recurso), the defense argues that no witnesses testified at trial that they had seen the defendant committing the offense—namely, cutting down trees, draining the wetland, or erecting buildings—but, as already stated, such conduct may be established through circumstantial evidence (forma indiciaria), as occurred in the sub judice.

The legal defense (defensa técnica) further asserts that the defendant had no duty to report her husband, and that is true. It must be recalled, however, that in this case Nombre01 and Nombre03 were charged as co-perpetrators (coautoría), and therefore the defendant was tried on the basis of individual criminal responsibility (responsabilidad penal individual). The appellant’s assertions that the court committed the offense of malfeasance in office (prevaricato) by deciding the case were misguided because, under the democratic rule-of-law system, the Courts of Justice are responsible for resolving disputes, and their decisions must be rendered in accordance with the available evidence and applicable rules—standards that were not disregarded in this case, thereby discrediting any subjective view. Lastly, during the appellate phase (fase de impugnación), the parties’ arguments must be clear and direct, showing how the evidence was improperly weighed, the logical or argumentative defect in the challenged judgment (sentencia recurrida), and the reasons why it must be vacated.

This Court of Appeals (Cámara de Apelaciones) finds nothing in the appeal indicating how the sentencing court (Tribunal sentenciador) violated the rules of sound rational judgment or what the alleged biased weighing of the evidence entailed. No expansive interpretation of the rules was demonstrated, nor was it shown in which section the Court reasoned on the basis of conjecture. Contrary to the appellants’ assertions, the evidence was compelling in establishing the facts, and the court’s reasoning was sound and based on the rules of proper human understanding. Accordingly, because the alleged defects are not present, the claims raised by attorney Acedo Cantón and the defendant Nombre01 are denied.

THEREFORE:

The appeals filed by attorney Melvin Acedo Cantón, in his capacity as private counsel for the accused Nombre01, and by the accused on her own behalf, in the exercise of her right to self-representation, are denied. Resolución: 2020-0916 TRIBUNAL DE APELACIÓN DE SENTENCIA PENAL. Segundo Circuito Judicial de San José. Goicoechea, al ser las siete horas treinta minutos, del nueve de junio de dos mil veinte.- RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra Nombre01, mayor, costarricense, cédula de identidad número CED01, nacida en Limón, el 1 de octubre de 1978, hija de Nombre01 y Nombre02, soltera, vecina de Limón, Pococí, Cariari; por el delito de INVASIÓN A UNA ZONA DE PROTECCIÓN, en perjuicio de EL MEDIO AMBIENTE. Intervienen en la decisión los jueces Alfredo Araya Vega, Gustavo Rojas Gutiérrez y la jueza Iris Valverde Usaga. Se apersonaron en esta sede el licenciado Melvin Acedo Cantón, defensor particular de la encartada; la encartada Nombre01, en documento autenticado por el licenciado José Francisco Herrera Umaña y el licenciado Luis Vindas Vargas, representante del Ministerio Público, Fiscalía Adjunta de Pococí.

RESULTANDO:

I.Que mediante sentencia número 146-2020, de las nueve horas treinta minutos del diecisiete de febrero de dos mil veinte, el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, Pococí, resolvió: "POR TANTO: De conformidad con los artículos 39 y 41 de la Constitución Política; 8.2 de la Convención Americana sobre Derechos Humanos; 11 de la Declaración Universal de Derechos Humanos; 1, 2, 3, 11, 21, 22, 30, 31, 45, 50, 59 al 63, 71, 75, 76, 103 del Código Penal; 1, 2, 3, 9, 37, 40, 111 a 124, 140, 141, 142, 180 a 184, 265, 267, 328, 330 a 336, 341, 352, 360 a 365 y 367 del Código Procesal Penal, artículos 50 y 89 de la Constitución Política, artículos 19, 33, 58 inciso a y b y 61 inciso c de la Ley Forestal, artículo 98 de la Ley Conservación de Vida Silvestre. 1045 del Código Civil, 122, 124, 127 de las reglas vigentes sobre responsabilidad civil del Código Penal de 1941, se declara a Nombre01 AUTORA RESPONSABLE de un delito de invasión de una zona de protección, en concurso ideal con Un delito de Cambio de Uso de Suelo imponiéndole la pena de TRES MESES DE PRISIÓN conforme las reglas de penalidad de este concurso, a su vez se le condena a UN AÑO DE PRISIÓN por el delito de Drenaje de Humedal, que concurre materialmente con Un delito de aprovechamiento de recurso forestal se le impone una pena de UN MES DE PRISIÓN todos en perjuicio del Medio Ambiente, para un total de UN AÑO Y CUATRO MESES DE PRISIÓN, sanción que deberá descontar en establecimiento carcelario respectivo previo abono a la preventiva cumplida .

Por reunir los requisitos exigidos por el Código Penal, se le concede a la sentenciada el BENEFICIO DE EJECUCIÓN CONDICIONAL DE LA PENA, ello por el plazo de 3 AÑOS, plazo en el cual no podrá cometer delito alguno doloso con pena de prisión mayor a los seis meses, caso contrario, se le podría revocar el beneficio concedido y deberá descontar la pena impuesta. Se declara con lugar la acción civil resarcitoria incoada por la Procuraduría General de la República en contra de Nombre01, se condena al pago de daños y perjuicios y las costas del proceso civil en forma abstracta, así como de los intereses legales y moratorios que se generen hasta el pago efectivo de los cánones ordenados. Se ordena el derribo de los ranchos o cualquier construcción que se encuentre en el sitio afectado, se eliminen los canales creados y la restitución de las cosas a su estado original, para lo cual se le otorga un plazo de 6 meses a la encartada bajo la supervisión del MINAET o en su defecto se comisiona a esta institución para realizar las acciones ordenadas. Una vez firme la sentencia se ordena comunicar al instituto nacional de criminología, juzgado ejecución de la pena y al registro judicial para lo de su cargo. NOTIFIQUESE." (sic).

II.Que contra el anterior pronunciamiento, el licenciado Gerardo Anchía Rodríguez, representante del Ministerio Público, Fiscalía Adjunta de Limón, interpuso recurso de apelación.

III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.

IV. Que en los procedimientos se han observado las prescripciones legales pertinentes

Redacta el juez de Apelación de Sentencia Penal Araya Vega; y,

CONSIDERANDO:

I.El licenciado Melvin Acedo Cantón, en su condición de abogado particular de la encartada Nombre01 y la imputada en su condición personal, en ejercicio de su defensa material, documento autenticado por el abogado José Francisco Herrera Umaña, interponen en fecha 17 de marzo de 2020, recurso de apelación contra la sentencia número 146-2020 dictada por el Tribunal Penal del Segundo Circuito Judicial de la Zona Atlántica, de las 09:30 horas del 17 de febrero de 2020 que condenó a Nombre01 por un delito de invasión en una zona de protección, en concurso ideal con un delito de cambio de suelo; así como un delito de drenaje de humedal en concurso material, imponiéndole la pena de un año y cuatro meses de prisión. Del estudio de los recursos planteados, se determina que cumplen con los requisitos de forma que de acuerdo a los principios de flexibilidad, accesibilidad, amplitud e informalidad que son propios de dicho medio impugnaticio, son necesarios para su adecuado conocimiento, en orden al examen integral del fallo y para garantizar el derecho al recurso en materia penal, previsto en el artículo 8.2h de la Convención Americana sobre Derechos Humanos, aunado a que la impugnación se presentó dentro del plazo previsto por la ley penal adjetiva.

A fin de efectuar un abordaje lógico en el análisis de los diferentes argumentos expuestos por las personas apelantes, este tribunal procederá a ordenarlas y examinarlos sin seguir, necesariamente, la estructuración propuesta por los impugnantes. Asimismo, cuando se trate de argumentos comunes o conexos, se agruparán para evitar reiteraciones innecesarias. En cada caso se hará un breve resumen de la posición (escrita y oral) de cada parte y sólo después se iniciará su escrutinio por parte de esta cámara.

II.Audiencia oral: La defensa técnica y material renunciaron a la audiencia oral peticionada en virtud de la existencia de la pandemia SARS-Co-V-2 vigente a nivel mundial

III.En el tercer motivo de apelación del defensor particular se queja de “falta de fundamentación de la excepción de prescripción”. Señala que la defensa ha argumentado que la causa se encuentra prescrita, ya que entre la audiencia preliminar (10 de octubre de 2016) y el señalamiento a debate (06 de mayo de 2016) transcurrieron dos años y seis meses, lo cual fue rechazado de forma infundada al indicar que no había transcurrido el plazo perentorio. El reclamo no puede prosperar. A la justiciable Nombre01 y al coimputado Nombre03 se les imputó los delitos de invasión de una zona de protección, cambio de suelo y drenaje de humedal, al proceder a remover tierra del cauce de humedal Ramsar y proceder a construir una vivienda, una bodega y una edificación de madera. Estos hechos fueron acreditados por parte del tribunal a-quo en contra de Nombre01. Esas conductas ilícitas son consideradas delitos por los artículos 58 inc. a y b, 61 de la Ley Forestal y 48 de la Ley de Conservación de Vida Silvestre, cuya pena máxima es de tres años de prisión por cada delito.

Verificado el expediente judicial, se verifica que han existido dos señalamientos a audiencia preliminar, el primero, el día 10 de octubre de 2016 (cfr. folio 46) y el segundo, el día 20 de febrero de 2018 (cfr. folio 53). Luego hay un señalamiento a debate el día 06 de mayo de 2019 (cfr. folio 92). Ahora bien, entre ellos no transcurrió el plazo fatal de los 18 meses requerido para la declaratoria de la prescripción. Véase que, conforme al numeral 33 del Código Procesal Penal, la interrupción de la prescripción se da por la resolución que convoca a audiencia preliminar, sea, cualquiera de ellas, no sólo la primera. De esta forma, resulta errónea la postura defensiva que pretende considerar únicamente el plazo acaecido entre el primer señalamiento de audiencia preliminar y de juicio, en tanto, conforme a la ley, deben ponderarse todos los señalamientos de audiencia preliminar y, en este caso, el segundo señalamiento de audiencia preliminar nuevamente interrumpió el plazo de prescripción de la acción penal. Por las razones expuestas, se declara sin lugar el reclamo.

IV.En su primer motivo de apelación, el defensor particular reclama “Indebida determinación de los hechos tenidos por probados”. Luego de transcribir los hechos tenidos por acreditados, señala la existencia de una doble infracción: primero, al no tenerse claros los hechos probados al tratarse de una mera transcripción de los hechos acusados, querellados y demandados civilmente; segundo, al tratarse de una réplica de los hechos querellados y presentes en la acción civil resarcitoria, de modo tal que, en apariencia, se tienen por probados dos veces los mismos hechos. De igual forma, se queja que en la introducción de la sentencia no se indica el apersonamiento del querellante y actor civil. En el segundo motivo de impugnación del defensor particular aduce “falta de fundamentación por interpretación errónea de la prueba”. Indica que el tribunal de sentencia tuvo por acreditada la responsabilidad de la imputada en la declaración de Nombre04, Nombre05, las fotografías e informe del MINAET.

Menciona que el fundamento utilizado versó en las capacitaciones recibidas por le acusada como guía turística de la Barra del Tortuguero y que, al ser ella propietaria del terreno, ella fue la autora de la construcción de edificaciones y drenaje del canal. Considera que no hubo prueba que acreditara que la justiciable talara, drenara el canal y levantara edificaciones, ya que los testigos referidos no la observaron cometiendo el ilícito. En el cuarto motivo de impugnación del defensor particular asevera “errónea aplicación del derecho sustantivo”. Reclama que la sentencia no fundamentó el dolo en la conducta acreditada ya que su condición de guía turística y dueña del terreno considera insuficiente para argumentar su participación en el delito, sea en grado de autora, coautora o dominio funcional. En el primer motivo de apelación formulado por la imputada se queja por la motivación del fallo.

Hace ver que la sentencia recurrida incurre en una incorrecta valoración de la prueba, al inobservar las garantías esenciales del debido proceso y estado de inocencia de la imputada. Indica que la imputada no podía ser investigada porque no podía denunciar a su esposo Nombre03 y además, no conoció los hechos que le investigaba el Ministerio Público. Considera que las imputaciones formuladas por el Ministerio Público y Procuraduría General de la República indujeron al tribunal de mérito a cometer el delito de prevaricato, ya que no se acreditó el dolo en la conducta acusada. Menciona que en juicio, la justiciable declaró que no realizó edificaciones ni taló árboles. Sostiene que cuando el MINAET llegó a su propiedad ingresaron sin permiso, uno ingresó a su bodega y otro visitó el muelle. En el segundo motivo de impugnación de la imputada se argumenta que no se consideró la tesis defensiva respecto a la ausencia de dolo y la imposibilidad de denunciar a su esposo por los hechos.

Considera que no se valoró de forma conjunta la prueba existente. Señala que la sentencia incurrió en valoraciones subjetivas, sin acreditarse que a ella materialmente le era imposible cometer el delito. Transcribió los hechos acusados por el Ministerio Público y la Procuraduría General de la República, así como la parte dispositiva de la sentencia. En el tercero motivo de apelación, la justiciable considera violentado el debido proceso por errónea valoración de la prueba. Insiste que para la encartada era imposible materialmente ser autora del delito, además que la Constitución Política le garantizaba su derecho de no denunciar a su esposo, razón por la cual no podía imponérsele una pena. Los alegatos deben ser rechazados. En criterio de esta Cámara de Apelación de Sentencia Penal el fundamento intelectivo del fallo no contiene ningún defecto, se ha logrado apreciar por las razones expuestas en el fallo conforme a una motivación coherente, congruente, precisa, completa, lógica y no contradictoria.

En efecto, la acreditación de los hechos para este caso en particular, la realizó el Tribunal mediante un protocolo lógico argumentativo, respetando las reglas del correcto entendimiento humano. De manera profusa y minuciosa fue examinada, tanto la prueba de cargo como de descargo y a partir de un análisis coherente y confrontativo de las probanzas, se determinó que las versiones dadas por los denunciantes resultaron creíbles, ya que la información brindada contó con la calidad y suficiencia probatoria para decantarse por la tesis de la fiscalía. De manera prístina el Tribunal mostró su iter lógico para alcanzar la decisión de condenar a la acusada Nombre01, sustentó de forma correcta el test de acreditación de la prueba testimonial y técnica acudiendo a la consolidación de los hechos probados y la veracidad de las declaraciones de cargo. La sentencia se avocó a la ponderación de la declaración rendida en juicio por la justiciable y descartó la posibilidad que fuera cierta, ya que no contó respaldo externo y en su lugar, el tribunal despreció su relato basado en una sólida y rigurosa ponderación de la prueba de cargo (cfr. folios 20 y 21 de la sentencia).

Tanto los reclamos de la defensa técnica como de la imputada se centran en señalar que la misma no es responsable de los delitos que se le acusaron por cuanto no fue observada en el momento que los cometía, sin embargo, esta tesis en insostenible, ya que las conductas pueden ser acreditadas a través de prueba directa o de manera inferencial a través de la prueba indiciaria. Si bien en algunos casos no se cuenta con prueba directa de un hecho, ante su carencia –como puede resultar un testigo–, la suficiencia probatoria podría tener un carácter indiciario, circunstancial o indirecto. En esos casos, se requiere la existencia de indicios fuertes y concatenados que permitan la acreditación de la responsabilidad a partir de prueba indiciaria, aspectos sobre los cuales la sentencia debe pronunciarse. La prueba indiciaria puede definirse como la conclusión valedera en la cual el Tribunal, luego de apreciar todos los elementos en su conjunto, acude a la certeza de responsabilidad producto de los indicios.

Es decir, al no existir prueba directa del evento, a través de la probanza de ciertos hechos periféricos y de un razonamiento lógico, se llega a la conclusión de que el hecho sí se llevó a cabo, y bajo esa consideración, el hecho generador de responsabilidad civil se encuentra presente. Dentro de los requisitos de validez, eficacia y existencia de prueba indiciaria se encuentran: a. Que el hecho base (indicante o indicador) ha de estar plenamente probado, lo contario sería una mera sospecha sin sustento real alguno; b. Los indicios deben ser plurales, o excepcionalmente únicos pero de una singular fuerza acreditativa; c. Los indicios deben ser concomitantes al hecho que se trata de probar y deben ser periféricos respecto al dato fáctico a probar. Además de ser obtenidos legalmente y por medios lícitos; d. Deben estar interrelacionados, cuando sean varios, de modo que se refuercen entre sí y que no excluyan el hecho consecuencia; e. Cuando se trate de indicios contingentes estos deben ser plurales, concordantes y convergentes, así como que no se presenten contraindicios consistentes.

De este modo, la valoración judicial de la prueba indiciaria debe pasar por los siguientes estándares: 1. La valoración de los indicios no debe efectuarse de manera aislada, es decir uno a uno. Éstos deben ser valorados en su conjunto, y a partir de ellos debe sustentarse la inferencia; 2. La atendibilidad de la máxima de experiencia, debe estar asentada en conocimientos generales o en conocimientos científicos; no deben existir máximas de experiencia aplicables igualmente fundadas, esto es, que no sea posible alcanzar conclusiones alternativas que gocen de un mismo grado de probabilidad; y, la conclusión del razonamiento indiciario no debe entrar en contradicción con otros hechos declarados probados. 3. En cuanto a la inducción o inferencia es necesario que sea razonable, es decir que no solamente no sea arbitraria, absurda e infundada, sino que responda plenamente a las reglas de la lógica y de la experiencia, de manera que de los hechos base acreditados fluya, como conclusión natural, el dato precisado de acreditar, existiendo entre ambos un enlace previo y directo, según las reglas del criterio humano.

De esta manera, para arribar a una sentencia condenatoria a través de prueba indiciaria, el análisis del caso debe estar precedido de una discusión y contradicción en torno a la configuración o no de los presupuestos materiales de la prueba, esto para destruir la presunción de inocencia. En el presente asunto, en el considerando IV de la sentencia, el tribunal de mérito realizó un análisis riguroso de los relatos de Nombre04, ingeniero forestal, supervisor y funcionario de MINAET, Nombre05, funcionario del MINAET encargado del área de turismo, Nombre06, funcionario del MINAET encargado de la determinación de daño ambiental; así como también del informe Acto-GASP-PNT-005-2015 (cfr. folios 1 a 8), valoración ambiental (cfr. folios 21 a 26), certificación de SINAC (cfr. folios 30 a 32), inspección in situ (cfr. folio 33), oficios del SINAC-ACTO-AL-158-2016, SINAC-ACTO-ASP-PNE-CERT-325, ACTO-GASP-PNT-4E-CP-005-2015 y ACTO-GASP-PNT-ADM86-2016 (cfr. folios 43 a 45, 61) y a través de esa prueba adquirió el convencimiento de responsabilidad de la justiciable.

La inspección cumplida por Nombre04 como funcionario de MINAET permitió corroborar como se llevó a cabo el drenaje en el humedal, se removió cerca de 400 metros cuadrados de tierra, se ubicaron en el camino árboles talados y aserrados y al fondo construcciones varias (bodega, rancho rústico y otro). Deposición que fue corroborada de forma externa su verosimilitud con la declaración de Nombre05 quien tomó las fotografías aportadas al expediente (cfr. folios 5 a 8) y quien conoce a la justiciable por ser operadora turística de la barra del Tortuguero. El defensor y la imputada cuestionan el dolo en el actuar de la justiciable, desconociendo la teoría del interés que debe seguirse en este tipo de delincuencias, donde a través de la prueba indiciaria puede verificarse con total claridad quién era la propietaria del inmueble, quién era la única beneficiada con el drenaje del humedal, las edificaciones realizadas y la invasión en la zona de protección.

Se tuvo por acreditado que la endilgada permanecía residiendo en ese sitio y era la única responsable del mismo, de modo tal que conocía de las labores que se realizaban en el inmueble, de la cual era la beneficiaria. Sobre la ausencia de permisos para el ingreso al inmueble, ese alegato se descarta de la propia declaración de los funcionarios del MINAET y los informes rendidos, donde se verifica que hubo autorización para la inspección, sin embargo, también debe señalarse que las labores preventivas que cumplen los funcionarios lo autoriza a tales revisiones al tratarse de un área de conservación natural. La imputada y el abogado recurrente insisten que el responsable de los actos era el coimputado Nombre03, sin embargo, es claro que la prueba aportada permitió descartar esa tesis, en tanto, el coimputado permanece la mayor cantidad de tiempo en los Estados Unidos de Norteamérica, y la única persona que controla el inmueble era la justiciable Nombre01.

Otro factor para la demostración del dolo, el cual es normativo no subjetivo como parece entenderlo los recurrentes, se basó en que la imputada era operadora turística en la barra del Tortuguero, de modo que conocía muy bien las prohibiciones legales en protección del ambiente sano y equilibrado y que la conducta realizada estaba contra las normas de protección de las zonas ambientales. Por ello, a través de los elementos de prueba ya señalados, testimoniales y documentales, el tribunal de instancia logró reconstruir el hecho histórico, verificar que la imputada era la responsable del control del inmueble, por cuanto, desarrollaba labores de turismo en la zona, visitaba el inmueble y habitaba ocasionalmente en él, aprovechaba sus recursos y era la persona beneficiada con el drenaje del humedal, la construcción de las edificaciones y la invasión en la zona de protección. Ese razonamiento no encuentra ninguna deficiencia argumentativa y la valoración probatoria fue realizada conforme a las reglas de la sana crítica racional.

No existe ninguna violación al derecho de defensa por el hecho de que se hayan tenido por acreditados los mismos hechos de la acusación, querella privada y acción civil resarcitoria, por el contrario, ese es el marco fáctico sobre el cual el tribunal a-quo debía resolver, (estando sometido a ellos) basado en el principio de congruencia. Más aún, es claro que el tribunal de mérito tuvo un grupo de hechos tenidos por acreditados, de modo tal que resulta ociosa la reiteración e incluso, se presta para confusiones. Pero en el caso concreto lo importante es que entre unos y otros hay coincidencia en lo esencial, no existe contradicción ni fisura lógica alguna y por ende el cuadro fáctico puede ser comprendido por cualquier persona que se imponga de su contenido. Respecto a que en la introducción de la sentencia no se hizo referencia a la participación de la Procuraduría General de la República en juicio, eso es un mero error material que no causa agravio, en tanto, sí estuvo presente y ejerció la representación estatal.

En nuestro sistema procesal no tiene cabida la nulidad por la nulidad misma, de modo tal que ante la ausencia de agravio, ese reclamo no puede prosperar. La defensa cuestiona en su recurso que no hubo testigos que declaran en juicio que observaron a la imputada cometiendo el delito, sea, talando árboles, drenando el humedal o levantando edificaciones, pero, como ya se dijo, es posible acreditar dichas conductas de forma indiciaria, tal y como ocurrió en el sub judice. Por otra parte, la defensa técnica establece que la imputada no tenía un deber de denuncia en contra de su esposo, y eso es cierto. Sin embargo, debe recordarse que en la especie a Nombre01 y Nombre03 se les acusó en coautoría, de modo tal que a la imputada se le juzgó basado en criterios de responsabilidad penal individual. Desatinadas resultaron las manifestaciones que realiza la impugnante respecto a que el tribunal cometió el delito de prevaricato al resolver la causa, ya que conforme al sistema democrático de Derecho, corresponde a los Tribunales de Justicia resolver los conflictos y las resoluciones deben ser dictadas conforme a la prueba existente y las normas aplicables, bases que en este caso no se desatendieron, desacreditando cualquier visión subjetiva.

Por último, los alegatos de las partes, en fase de impugnación, deben ser claros y directos, mostrando en qué consistió la indebida ponderación de la prueba, el vicio lógico o argumentativo que posee la sentencia recurrida y las razones por las cuales debe ser anulada. No encuentra esta Cámara de Apelaciones en el recurso planteado de qué forma el Tribunal sentenciador violentó las reglas de la sana crítica o en qué consistió la ponderación sesgada de la prueba. No se evidenció la interpretación extensiva de las normas ni se mostró en qué acápite el Tribunal razonó mediante conjeturas. Contrario a lo que señalan los recurrentes, la prueba fue contundente para la acreditación de los hechos y el razonamiento judicial se realizó de forma sólida y con una argumentación basada en las reglas del correcto entendimiento humano. Así las cosas, al no estar presentes los vicios alegados, se declaran sin lugar los reclamos formulados por el licenciado Acedo Cantón y la imputada Nombre01.

POR TANTO:

Se declaran sin lugar los recursos de apelación formulados por el licenciado Melvin Acedo Cantón, en su condición de abogado particular de la encartada Nombre01 y la imputada en su condición personal, en ejercicio de su defensa material.
