BACKGROUND (RESULTANDO):
Appellate Judge Escalante Moncada drafts the decision; and, CONSIDERING (CONSIDERANDO):
I.State Attorney Margoth Avellán Ruíz files an appeal against the judgment concerning written decision number 303-P-2019, issued by the Tribunal de Juicio de Puntarenas.
II.In the first ground, the appellant expresses her disagreement with the trial court’s judgment for the following reasons. She states that, regarding the acquittal entered in favor of defendants [Nombre3] and [Nombre8], the Trial Court acquitted them on the grounds that the criminal action was barred by the statute of limitations (prescripción). She says that, in support of this position, the Trial Chamber argued that both defendants testified that they had spent only one night at the property and that, because the defendants were questioned on 8 y 15 de mayo del 2013, respectively, the limitation period expired on 15 de mayo de 2015, without any other act interrupting the limitation period occurring during that two-year period. She objects to the application of substantive law, contending that the criminal action has not been extinguished by the statute of limitations. She states that, with respect to the offenses of encroachment upon protection areas (invasión a áreas de protección), when the conduct is carried out through the construction of structures, it constitutes a continuing or permanent offense (delito continuado o permanente); in offenses of this kind, the limitation period for the criminal action begins to run only once the permanence of the encroaching structure ceases, because while the structure remains, the unlawful conduct continues over time, and the unlawful activity ceases only when the encroaching structure or construction is removed.
She explains that the calculation of the limitation period (cómputo de la prescripción) is different for this type of offense, since, under the parameters of Article 32 of the Code of Criminal Procedure (Código Procesal Penal), it is not legally possible for an offense to become time-barred while its effects persist over time, because the protected legal interest (bien jurídico)—the environment—continues to be harmed. She says that, in this case, the alleged act consisted of the defendants’ occupation of the maritime-terrestrial zone (zona marítimo terrestre) in the locality of Tambor through the erection of permanent structures, conduct that falls within the offense of usurpation of public-domain property (usurpación de bienes de dominio público), established in Article 227 of the Criminal Code (Código Penal). She asserts that, in this case, because the encroaching structure remains, Article 32 of the Code of Criminal Procedure cannot be applied.
Additionally, she criticizes the trial court for giving full credibility to the testimony that both defendants gave at trial when they stated that they had been at that property for only one night, which contradicts the evidence entered into the record. In this regard, she emphasizes that these persons’ identification information states that they have lived in that area for several years. Moreover, both the testimony of witness [Nombre10] and the reports issued by the Judicial Investigation Agency (Organismo de Investigación Judicial) show that, on the various occasions when the relevant maritime-terrestrial zone was visited, the accused were living in those structures, in addition to the fact that the structures remain on State property. For the foregoing reasons, she considers the conclusion reached by the trial judge to be erroneous. In this section, the appellant challenges the reasoning used to establish that the criminal action against defendants [Nombre3] and [Nombre8] had expired under the statute of limitations.
To properly resolve each claim, the circumstances of each defendant will be analyzed separately. Defendant [Nombre3]. After examining the record and the appealed judgment, it is concluded that the appellant’s argument is unfounded. In this matter, all defendants were charged with the offense of usurpation of public-domain property, and, as explained in the trial court’s judgment, that unlawful conduct is classified as an offense with permanent effects (delito de efectos permanentes). Calculation of the limitation period is governed by the rule established in Articles 32 and 33 of the Code of Criminal Procedure, which provides that, for continuing or permanent offenses, the period runs from the time their permanence ceases. In this regard, the trial judge correctly applied the rules established in procedural law. The issue raised by the representative of the Office of the Attorney General (Procuraduría) concerns determining the point at which the unlawful activity in this type of offense is deemed to have ceased.
According to the Attorney General’s representative (Procuradora), the criminal action does not become time-barred while the structures built in the public zone have not been demolished. Although this position may initially appear reasonable, the fact is that it depends on the specific circumstances of each case, since what matters is determining the conduct attributed to each defendant and what was proven at trial. For purposes of resolving the matter concerning defendant [Nombre3], the Office of the Attorney General alleged the following in its private prosecution complaint (querella): “Without specifying the exact date, but at least from the month of octubre del 2012 and through the present date, in Tambor de Cóbano, Puntarenas, specifically [Dirección1], defendant [Nombre3] has occupied and is currently occupying a portion of the public zone of the maritime-terrestrial zone by residing in a structure built of wood, sheets of zinc, wooden posts, bamboo poles, and an earthen floor.
The structure has an area of 15.62 square meters and is used as the defendant’s dwelling. That structure is located between markers N° 122-2005 and 126-2005 of the Instituto Geográfico Nacional. Defendant [Nombre8] carries out this occupation without holding a land-use, construction, or concession permit and without there being a regulatory plan (plan regulador) issued by the competent authority.” According to that allegation, the defendant occupied public-domain property by building and residing in a house located within the public area of the maritime-terrestrial zone during a specified period. However, as stated in the trial court’s judgment, the criminal action in this case was barred by the statute of limitations because the judge found it proven that defendant [Nombre3] had ceased remaining at that property. In resolving this issue, it is relevant to note that, based on the evidence received at trial, witness [Nombre10], the judicial officer responsible for the investigation, testified that they were unable to determine who had built the various dwellings because, during their visits, they did not observe anyone constructing any structure; rather, those structures already existed at the site.
He likewise explained that some people lived in the houses permanently, while another group did so temporarily: when inspections were conducted and a census of the occupants was taken, certain persons were present on that occasion, but when another inspection of those structures was later conducted, other occupants were living there, or the houses were empty or closed. This information is relevant because, as will be seen below, the judge rejected the contention that defendant [Nombre3] had built that structure or lived permanently in that dwelling. In the case under review, the judge determined from the investigation report, Report 057-13-URC (pages 165 to 167), that when the property was inspected between 06 de noviembre de 20212 and 06 de marzo de 2013, the dwelling was occupied by [Nombre3] at the time of the visit. Also significant is Report 19-14-ORC of the Organismo de Investigación Judicial de Cóbano (page 283), according to which visits conducted on 15 y 22 de abril de 2014 confirmed that [Nombre3] was no longer living in the structure addressed by the factual allegations against him.
In other words, there is evidence that, by abril del 2014, the defendant had ceased the act of occupying public-domain property. The judge considered this evidence together with the accused’s testimony, in which he stated the following at trial: “‘I was passing through the Tambor area and stayed in a small house there because I was looking for work. An OIJ officer came by and asked me whether I lived there, and even so, he asked me for my identification card. I saw no problem with that, and now I find myself here, even though I have never lived there. That little house is there and has always been there, so all I did was stay there to sleep, nothing more. What I did afterward was leave. It had already been built. The house was unoccupied. I stayed one night. I currently live in Villas del Mar, in Cóbano. I have lived there in Villas del Mar for 4 years. Before that, I lived in Ciudad Neilly.
In Villas del Mar, I live with my partner and my two children.’” As discussed in the judgment, this defense account was not discredited. On the contrary, the judge also considered the identification information provided by the defendant to the Public Prosecutor’s Office on 8 de mayo de 2013, in which he stated that he lived in Cóbano, at the home of Ms. Yexi Solano Muñoz; in other words, by that time he was no longer living in the public area. As the judge correctly found, once it had been proven that the act of occupying public-domain land had ceased, calculation of the limitation period had to begin. That period was reduced by half by the formal questioning of the defendant (indagatoria), which occurred on 14 de mayo de 2013, rather than on 08 de mayo de 2013 as stated in the trial court’s judgment. Nevertheless, despite that error in the date of the procedural act, the legal situation does not change, because the next procedural act capable of interrupting the limitation period was the scheduling of the preliminary hearing (audiencia preliminar), dated 04 de agosto de 2015.
In other words, two years, two months, and 21 days elapsed between those two procedural acts. Consequently, under Articles 32 and 33 of the Code of Criminal Procedure, in conjunction with Article 227 of the Criminal Code, the criminal action had become time-barred, since the ordinary limitation period for that offense is four years, which, when reduced by half, is two years—a period that was exceeded in the case of defendant [Nombre3]. In this regard, the position of the State’s prosecuting authority—that the criminal action is not time-barred for as long as the structure remains—is untenable because that interpretation violates the constitutional principle enshrined in Article 39 of the Political Constitution (Constitución Política), from which it follows that criminal responsibility is strictly personal. Accordingly, because there is evidence that the defendant ceased the unlawful activity of occupying a public zone, that fact must be considered when calculating the period for extinguishment of the criminal action, which is what occurred in the case under review.
Following the position of the Office of the Attorney General would lead to the absurd conclusion that, if the structure remained in the public zone for more than ten years without being occupied by anyone, the criminal action against its last occupant would not have been extinguished merely because the property had not been demolished. This interpretation falls outside the scope of the statutory elements (tipicidad) of the offense established in Article 277 of the Criminal Code, which, for the offense to arise and continue, requires that a person occupy public-domain property through specific acts; that is, it must be proven that the person is carrying out that act. The interpretation advanced by the Office of the Attorney General is therefore untenable and even contravenes Article 2 of the Criminal Code and Article 2 of the Code of Criminal Procedure, which establish the principle of strict interpretation (principio de interpretación restrictiva) of criminal offenses and procedural rules.
Additionally, it must not be forgotten that the prosecuting authority bears the burden of proving the continuity or permanence of the criminal activity and that, as reasoned in the trial court’s judgment, the evidence entered into the record establishes that the criminal activity had ceased by a specified time (14 de mayo de 2013). Accordingly, the decision of the court below (a quo) is consistent with the law. For the foregoing reasons, this claim is denied. Regarding defendant [Nombre8]. The appellant’s argument concerning this other claim is also unfounded. This case presents circumstances similar to those previously analyzed.
As stated in the judgment, the trial judge found that the record (autos) contains no evidence indicating that the accused (encartado) continuously occupied the public area, as alleged in the private complaint (querella); rather, there is no evidence establishing that the criminal activity continued after this person was formally examined (indagatoria) on May 15, 2013. To that effect, the following was stated: “In the case of [Nombre8] , the situation is similar: in the statement given in the exercise of his right to present his own defense, the accused stated: ‘The situation is that I work as a fisherman; I currently live in Paquera and have lived there for 7 years. One day I arrived on a motorcycle, sometime around 12 or midnight. The motorcycle had a flat tire, so the young man I work with told me: you can’t travel like that. It is about 28 kilometers from Tambor to Paquera. Walking was impossible, so the young man said to me: why don’t you stay in that house and see what you can do tomorrow?
And I said yes. I went and stayed in the house. The house was empty. At around 8 in the morning, someone knocked, and I went out to see what it was. A young man asked me my name and requested my identification card; I saw no problem with that. I left and had the motorcycle repaired. And that is why I am here.’ Now, in the case of [Nombre8] , when his identification information was taken, he did not mention this circumstance—that is, that he was living in Paquera—but instead stated that his residence was in Puntarenas, Tambor, at [Dirección2] from the pier. That address is very similar to the one stated in the charging document (pieza acusatoria). For his part, investigating officer Pérez Espinoza clearly stated in his testimony: ‘I have learned that some of them no longer live there, because I have seen them living in other areas. Mr. [Nombre11] in Paquera (…).’ The foregoing (the place of residence) is consistent with the defendant’s statement.
The accused was formally examined regarding the acts under investigation on May 15, 2013; consequently, as of that procedural act, the limitation period (plazo de prescripción) was reduced by half, that is, to two years. Because the offense of Usurpation of Public-Domain Property (Usurpación de Bienes de Dominio Público) is completed immediately but has continuing effects, and because the proceeding contains no evidence that after May 15, 2013, the accused continued to live in that structure, while what we do have is his statement that he has resided in Paquera, Puntarenas, for 7 years—a statement corroborated by investigating officer Pérez Espinoza—it must be concluded that by that time (May 15, 2013) the effects of the alleged offense charged against him had already ceased. Accordingly, the limitation period for the criminal prosecution (prescripción de la acción penal) began to run from that last procedural act.
That period elapsed without any ground for interruption or suspension of the limitation period arising in the interim. Thus, by May 15, 2015, the criminal prosecution was already time-barred, thereby extinguishing the prosecution against the accused [Nombre8] .” The foregoing excerpt shows that, in determining that the criminal prosecution was time-barred, the trial judge considered both the defense’s theory and the evidence entered into the record, and from her combined analysis determined that the case file contained no evidence showing that the accused continued the criminal activity of occupying that public area after May 15, 2013. Instead, she found that the defense’s theory—that the defendant had lived in another area for seven years, specifically in the locality of Paquera—was supported by the evidence submitted by the Prosecutor’s Office, because Officer Pérez Espinoza stated that he had learned that several of the defendants no longer lived in the public area and testified that he knew [Nombre8] resided in Paquera.
In other words, once the cessation of the criminal activity had been established, the proper course was to calculate the limitation periods pursuant to the rules set forth in Articles 32 and 33 of the Code of Criminal Procedure (Código Procesal Penal). Upon reviewing that calculation, the trial judge was correct in stating that the criminal prosecution in the case of defendant [Nombre8] is time-barred. Consequently, this ground for appeal (motivo) must be denied.
III.In the second ground, the appellant challenges the arguments on which the acquittals of defendants [Nombre6], [Nombre7], [Nombre5], [Nombre4], and [Nombre1] were based. She states that the trial court based its decision on the finding that, when the Judicial Investigation Agency officer approached these individuals at their homes and asked whether they lived there, he violated the defendants’ right to remain silent (derecho de abstención); therefore, the evidence produced through that identification was tainted and, because no further evidence was available, the defendants had to be acquitted. She adds that the judge also based the acquittals of defendants [Nombre6], [Nombre7], [Nombre5], and [Nombre4] on the existence of a mistake of fact (error de tipo), finding that these individuals had lived at the location for a long time and therefore did not know that they were there unlawfully, particularly because it is a settlement where public utilities are available, the children attend the public school in Tambor, and the Municipalidad de Cóbano charges fees to various residents of the area.
The appellant objects to these arguments for the following reasons. Regarding the issue of tainted evidence (prueba espuria), she states that it was not established that, during the first visit made by officer [Nombre10] in 2013, the defendants were misled into stating that they lived there. She adds that, even if that hypothesis were accepted, the record demonstrates that the judicial officer subsequently visited that area on several occasions, corresponding reports were prepared, and it was verified that the defendants resided in the structures built there; in other words, it was verified on several occasions that the defendants occupied the public area of the maritime-terrestrial zone (zona marítimo terrestre). In addition, when questioned as defendants and when testifying during the plenary stage (fase plenaria), they stated that they resided at the location where the events occurred.
She adds that the expert evidence (prueba pericial) prepared by the Forensic Engineering Section established that the structures were located within the public area of the maritime-terrestrial zone; consequently, the judge’s other argument concerning uncertainty as to the distance of each structure is irrelevant, because all of them are within the protected area. She also objects to the finding that the defendants acted under a mistake of fact, because no evidence indicates that these individuals had lived in those structures since childhood. Quite the opposite: except for defendant [Nombre1]’s house, their houses are made of materials such as zinc sheeting, bamboo, and fibrolit sheets, which contradicts the defendants’ assertion that those structures have existed for decades. She further states that neither a mistake of fact nor a mistake of law (error de prohibición) may be alleged, because the proximity of the structures to the sea rules out that factual circumstance.
Likewise, she states that the existence of public utilities in a squatter settlement (precario) does not make occupation of a prohibited zone lawful; therefore, whether the individuals had access to those utilities or whether the children attended the local school is legally irrelevant. Regarding the assessment of the evidence (análisis de la prueba), she argues that the judge erred in stating that the fact alleged in the private complaint (hecho querellado) had not been established, because she believes that both the documentary and expert evidence fully proved that the defendants had occupied the public area of the maritime-terrestrial zone. She adds that, in the case of defendant [Nombre1], it was evident that he had not resided at the location for years, because in another proceeding adjudicated under expediente número 01-200031-591-PE, in which he was also a defendant for encroaching upon the public zone, it was established that he did not reside in that sector at that time.
In this section, the appellant challenges the reasoning of the judgment on various grounds; accordingly, to ensure a proper resolution, each issue raised will be addressed separately. Regarding the declaration that the evidence was unlawful (prueba ilícita). Upon reviewing the judgment, the Court finds that the appellant is correct. As stated in the trial judgment, the court below (a quo) based its decision to acquit the defendants on three grounds, one of which was that the conduct of judicial officer Jorge Pérez Espinoza was unlawful because, while carrying out the investigative measures, he went to each defendant’s residence, requested identification information, and asked whether the defendant lived there. According to the judge, although individuals have a duty to identify themselves to judicial authorities, officer Pérez Espinoza exceeded his authority in this case because he went beyond merely establishing the name of each defendant and also asked whether they resided there.
That question, according to the judge, was improper and the defendants had the right to remain silent in response to it. On this point, the judge erred in interpreting the procedural rule. Article 283 of the Code of Criminal Procedure (Código Procesal Penal) provides that the Judicial Police (Policía Judicial) is authorized to carry out the investigative measures necessary in connection with criminal activity, including identifying the defendant. Likewise, Articles 83 and 94 of the Code of Criminal Procedure establish that defendants have a duty to provide the information necessary to identify them, including their personal particulars and address. The latter is relevant because it is the place where the judicial authority must subsequently serve the accused persons with notices to appear for the corresponding proceedings. In other words, judicial officers are authorized to ask persons under investigation for information concerning their address.
Although, in this case, each individual’s place of residence is connected to the area where the criminal activity was carried out, the accused persons have no right to remain silent regarding that identifying information. On the contrary, they have a legal duty to provide it. The trial judge’s interpretation that the defendants’ identification involved unlawful conduct is therefore invalid. Regarding the mistake of fact. Upon reviewing this further argument and the trial judgment, the Court concludes that the appellant is correct. As may be gathered from the trial judgment, the judge acquitted defendants [Nombre6], [Nombre7], [Nombre5], and [Nombre4] on the basis of a mistake of fact, stating as follows: “Accordingly, this Court considers that, in light of these circumstances, the defendants could readily have understood that the conduct they were allegedly engaging in constituted a criminal offense, since all their neighbors were in the same situation, their relatives had lived at the location for years without facing any legal consequences, and no problems had arisen from that circumstance.
On the contrary, there was a form of ‘legalization’ by officials of the Costa Rican State, who not only provided them with access to basic utilities such as water and electricity, but even charged them fees for property taxes. In light of these circumstances, how could the defendants—people of modest means with very basic levels of education—have understood that they were committing a criminal offense and would face criminal consequences for doing so? Under criminal law, for a criminal wrong (injusto penal) to be established, there must be human conduct that meets the statutory elements of the offense (típica) and is unlawful (antijurídica). In determining whether the conduct meets the statutory elements (tipicidad), we must examine the existence of the subjective element, whether intent (dolo) or negligence (culpa). Intent requires the perpetrator to know the objective elements of the offense and also to have the will to fulfill those objective elements.
In the case before us, according to the acts attributed to them in the accusatory pleadings (piezas acusatorias), the defendants have occupied an area belonging to the public domain (dominio público). However, the circumstances we have been analyzing presented them with a situation in which they did not know that the conduct they were allegedly engaging in constituted a criminal offense, since the location contains a large number of homes with all basic public utilities, in a settlement established at least 25 years ago, where there is a small grocery store and even a restaurant. These circumstances lead us to conclude that the defendants did not possess the intent to ‘retain what manifestly does not belong to oneself,’ which is precisely the definition that the Real Academia Española assigns to the verb detentar. Therefore, in the Court’s opinion, the so-called mistake of fact applies. In this regard, Article 34 of the Criminal Code (Código Penal) states: ‘A person who, when committing the act, is mistaken regarding any of the requirements necessary for the offense to exist, as defined, is not culpable.
However, if the mistake results from negligence, the act shall be punished only when the law prescribes a penalty for its negligent commission.’ Based on the provisions of this article, the defendants are not culpable (using that term in its ordinary sense and not in reference to the absence of culpability (culpabilidad) as such because, as explained, one of the constituent elements of the offense would be absent). Moreover, the criminal offense of Usurpation of Public-Domain Property (Usurpación de Bienes de Dominio Público) cannot be committed negligently. Accordingly, the defendants must be acquitted of the conduct attributed to them.” This argument is invalid for the following reasons. First, the judge confuses doctrinal concepts belonging to two distinct categories: namely, a mistake of fact, which is examined in determining whether the conduct meets the statutory elements, and a mistake of law, which must be assessed as part of culpability.
A mistake of fact occurs when the perpetrator lacks knowledge of, or is mistaken about, the existence of one or more of the objective elements constituting the criminal offense. In our legal system, this type of mistake is governed by the first paragraph of Article 34 of the Criminal Code, which reads: “A person who, when committing the act, is mistaken regarding any of the requirements necessary for the offense to exist, as defined, is not culpable. However, if the mistake results from negligence, the act shall be punished only when the law prescribes a penalty for its negligent commission.” In cases of an unavoidable mistake of fact (error de tipo invencible), the conduct ceases to meet the statutory elements of the offense; that is, the intent to carry out the objective elements of the offense is absent, and without that intent there is no criminal intent and, consequently, the conduct does not constitute the offense (atípica).
When the mistake of fact is avoidable (vencible), the conduct continues to meet the statutory elements only for offenses defined as punishable when committed negligently. Returning to the matter under review, the judge states in her reasoning that a mistake of fact exists because the defendants did not know that their conduct was criminal. Similarly, in her analysis, the judge accepts as a proven fact that this group of individuals lives in public-domain land (área demanial), because their houses are built in the public zone. In other words, they know that they are occupying a public area and intend to live in that sector. The foregoing demonstrates that, despite the stated existence of a mistake of fact, the judgment shows that the defendants knew of and intended the act they were carrying out—occupying public land—which establishes that the conduct meets the statutory elements of the criminal offense set forth in Article 227 of the Criminal Code. Therefore, it was incorrect to invoke the existence of a mistake of fact.
Now, if the arguments outlined by the judge are analyzed under the rules governing mistake of prohibition (error de prohibición), the argument advanced is likewise erroneous for the following reasons. The trial judge contends that the defendants were unaware that their conduct was criminal because an entire settlement of people exists in that area and the State even provides several homes with public utilities, such as water and electricity; moreover, the Municipalidad de Cóbano charges other residents the corresponding fee for living in that sector. This argument is illegitimate for the following reasons. A mistake of prohibition arises when the perpetrator believes that he or she is acting lawfully, as well as when the perpetrator does not even consider the unlawfulness of the conduct. Likewise, the mistake may concern the existence of prohibitory rules—a direct mistake of prohibition (error de prohibición directo)—or it may concern the existence of the limits or objective prerequisites of a justification defense.
In Article 35, the Código Penal governs direct mistake of prohibition by providing that a person who, due to an unavoidable mistake, believes that the act committed is not subject to punishment is not culpable. If the mistake was not unavoidable, the penalty prescribed for the act may be reduced in accordance with Article 79. An indirect mistake of prohibition (error de prohibición indirecto), in turn, is governed by the final paragraph of Article 34 of the Código Penal, which states that the same rules shall apply to anyone who mistakenly assumes the existence of circumstances that would justify the act committed. In this case, the trial judge contends that the defendants were unaware that their conduct was prohibited and instead believed that their actions were lawful. In her discussion, the judge is referring to the possible existence of a mistake of prohibition, not a mistake as to the elements of the offense (error de tipo).
This is where another error in the analysis of the specific case becomes apparent, because the trial judge overlooks that, in the case of a mistake of prohibition, the conduct can be exempt from punishment only when an unavoidable mistake has been established, since an avoidable mistake of prohibition merely supports a reduction in the degree of criminal blameworthiness. Here, the trial judge erroneously and without further analysis states that the defendants were unaware that their conduct was criminal because other people lived in that sector. Such reasoning is unacceptable because it would imply that, if other people engage in criminal conduct such as robbery, theft, or drug dealing, the same conclusion should be reached: namely, that because other people perform the same act, it cannot be prohibited by the legal system. That criterion is erroneous because the prohibition of conduct does not depend on whether other people engage in it; rather, the prohibition exists because a criminal-law provision prohibits the performance of that act.
Furthermore, knowledge of the unlawfulness (antijuridicidad) of the conduct is an issue analyzed within the sphere of culpability (culpabilidad), not within the statutory characterization of the offense (tipicidad). Therefore, if a person claims to have been unaware that his or her actions were punishable under the legal system, or believes that those actions were permitted, such cases must be resolved under the criteria outlined above concerning mistake of prohibition. In other words, if that lack of knowledge was avoidable, the conduct does not go unpunished; rather, the conduct remains statutorily defined as an offense, unlawful, and culpable. Nevertheless, because of the conceptual error made by the trial judge, those other components of a mistake affecting culpability were not even analyzed, and the reasoning is therefore illegitimate because it is insufficient. Furthermore, the trial judge refers to very general circumstances, such as the fact that some houses had water and electricity services and that other residents paid a fee to the municipality, but she does not analyze why those factual circumstances induced an unavoidable mistake in the accused persons.
In this respect, the judge disregards the maxims of experience (máximas de la experiencia), which indicate that people living in coastal areas know that there is a public area on the beach where the construction of buildings is prohibited because that area is intended for everyone’s enjoyment and for environmental conservation. Consequently, because the judgment is based on erroneous reasoning, this ground must be upheld. The third argument used by the trial judge to acquit all the defendants appears under the heading “Lack of Evidence Regarding the Temporal and Spatial Circumstances of the Alleged Acts.” The judgment shows that, in this section, the judge found that neither the Ministerio Público’s theory—that the defendants possessed the Maritime-Terrestrial Zone (zona marítimo terrestre) during the period from October 2012 through June 2015—nor the allegation that they continued to usurp that land, as charged by the Procuraduría, had been proven, because no evidence established that fact.
To that end, the judge notes that there were inspections only from 2013 and 2014 and that, after those events, there was no other evidence establishing the period alleged in each of the prosecution’s charging instruments. This argument is invalid because a comprehensive review of the judgment shows that evidence was entered into the record, including complaints, visual inspections (inspecciones oculares), photographic surveys, and site visits, documenting the location of each building, its occupants, and the dates on which those acts occurred. Now, if the trial judge believed that this evidence did not establish the entirety of the alleged period, that did not necessarily mean that an acquittal had to be entered. On the contrary, if the evidence established that the act existed for a period shorter than the one alleged, this in no way prejudiced the right of defense or the principle of congruence between the charge and the judgment (principio de correlación entre acusación y sentencia).
It must be recalled that the guarantee established in Article 365 of the Código Procesal Penal is closely linked to the defendant’s right of defense. Although every prosecution charge must specify the circumstances and manner in which the criminal conduct was carried out, including the date on which the events occurred according to the manner of their commission, the purpose of that statutory requirement is to enable the defendant and defense counsel to exercise the right of defense by offering the evidence they deem necessary and contesting the charge brought against the defendant. Nevertheless, extensive case law from both the Tribunales de Apelación de Sentencia and the Sala Tercera de la Corte Suprema de Justicia has established that this principle of congruence between the charge and the judgment does not mean that the charge cannot be modified by the trial court based on the evidence received at trial.
On the contrary, the factual allegations may be varied, provided that the modification does not concern essential aspects of the charge in a manner that leaves the accused without an adequate defense, which must be analyzed in each specific case. Returning to the matter under review, it is readily apparent from the trial judge’s argument that her objection is directed at the failure to establish that the defendants occupied public-domain lands (tierras demaniales) throughout the period adjudicated, although she acknowledges that evidence exists establishing their possession of that public-domain property for a period shorter than the one alleged but still falling within that period. It is therefore unclear what prevented the trial judge from finding that the occupation occurred over a shorter period when that period was still encompassed by the timeframe specified in the charge. Furthermore, the argument outlined by the trial judge becomes contradictory because, in the section in which she analyzes mistake as to the elements of the offense, she states that the defendants [Nombre6] , [Nombre7] , [Nombre5] and [Nombre4] said that they had lived in those buildings for a long time, as had other members of their families.
In other words, as to these defendants, their statements corroborate the timeframe alleged in the charge, yet the judge nonetheless asserts, without further support, that this timeframe cannot be deemed established. A similar situation arises with the argument that the accused cannot be convicted of the alleged acts because the charge stated that the dwellings were located at a particular distance from the pier, whereas the visual inspections conducted by the judicial experts established that the distance was shorter or longer when measured from the pier, and that this discrepancy in distance made it impossible to deem the alleged act established. Here again, the judge rigidly applies the principle of congruence between the charge and the judgment, finding that the discrepancy concerning the distance between each building and the pier precluded the issuance of a conviction. Under this argument, the essential core of the charge was left unanalyzed: namely, that the defendants possessed the public zone by living in a dwelling located within the public area comprising the Maritime-Terrestrial Zone.
It should be noted that, in the section setting forth the proven facts, the trial judge finds it established that in Tambor de Cóbano de Puntarenas, within the area constituting the Patrimonio Natural del Estado—specifically, the Zona Pública Marítimo Terrestre—there are seven buildings made of various materials and used as residences. In other words, regardless of the discrepancy in meters that was identified, the trial judge found it established that the houses were within the Maritime-Terrestrial Zone, as had been described both in the prosecution’s charging instrument and in the public criminal complaint (querella pública) filed by the Procuraduría General de la República. It is therefore unclear what legal relevance the precise location of each dwelling had to establishing the alleged act when all the dwellings were within the public area, as described in the charge. For the reasons stated, it is concluded that the three arguments offered by the trial judge to support the acquittal entered in favor of [Nombre6] , [Nombre7] , [Nombre5] , [Nombre4] and [Nombre1] contain errors that render it invalid, and the second ground of appeal must therefore be upheld.
Consequently, the judgment is partially vacated with respect to the acquittal entered in favor of the defendants [Nombre6] , [Nombre7] , [Nombre5] , [Nombre4] and [Nombre1] , and the case file is ordered remanded to the Tribunal de Juicio for new proceedings in accordance with law.
IV.In the third ground of appeal, it objects to the failure to order the demolition of the buildings constructed in the public zone (zona pública). It recounts that the trial judge denied the Procuraduría’s claim seeking restoration to the original condition, reasoning that it was unknown whether the buildings were still on the site or whether they had been expanded, and that the third parties residing in those buildings had not been joined in the proceeding so that they could exercise their rights. It challenges these arguments, asserting that the evidence established the existence of buildings in the public area of the maritime-terrestrial zone (zona marítimo terrestre), and that it was therefore appropriate to order the demolition of those structures, since the legislation governing this coastal strip clearly provides that construction in that zone is prohibited and even establishes by law that such buildings must be demolished; accordingly, the court should have acted in accordance with the law.
Additionally, it considers it improper to argue that the third parties who inhabit that site were not joined, since no one may claim a legitimate right over that zone. As its general relief concerning all three claims, it requests that the judgment be vacated and that a remand trial (juicio de reenvío) be ordered. The ground is upheld. Upon review of the judgment, it appears that the judge denied the demolition request on the basis of the following reasoning: “Both the Ministerio Público and the representative of the Procuraduría General de la República requested that the dismantling or demolition of the buildings at issue in this proceeding be ordered. In this regard, in this Court’s view, although Criminal Analysis Report 1496-ING-2012 established that all the buildings were located within the Public Zone of the Maritime-Terrestrial Zone, occupying part of the Patrimonio Natural del Estado, in Tambor de Cóbano de Puntarenas, the fact remains that, after analyzing the evidence in the proceeding, that request must be denied.
As explained in the preceding section, there is considerable uncertainty regarding the location of each dwelling. There is evidence that, in an inconclusive manner, provides conflicting information regarding the distance between the buildings and the Tambor pier, with significant differences among the various measurements. Furthermore, more than six years have elapsed since this proceeding began and since the respective visual inspections (inspecciones oculares) were conducted. Given the passage of time, there is no certainty as to who currently occupies those buildings, whether additional buildings have been constructed adjacent to those at issue (which could lead to confusion as to which building should be demolished if this Court were to so order), whether the structures at issue have been improved (in which case they could appear visibly different from those photographed in the visual inspection reports), or whether they remain on the site.
In the absence of evidence capable of resolving these questions and uncertainties, and as a matter of legal certainty (seguridad jurídica) and to avoid harming third parties who are not parties to this proceeding and have not had an opportunity to exercise their rights herein, the request for demolition or dismantling submitted by the Ministerio Público and the Procuraduría General de la República is denied. At the appropriate time, the representative of the Procuraduría based that request on the existence of pollution and environmental damage (daño ambiental); however, no technical or expert evidence confirming this was received in the proceeding. The Court heard the testimony of Mr. [Nombre12], whose knowledge of the subject is not in doubt; nevertheless, he did not testify in the adversarial proceeding as an expert witness, nor did he state that he had conducted any study using scientific methodologies that concluded that human activities were causing any degree of pollution at the site.
Rather, the witness’s conclusion regarding environmental damage and pollution in the area was the product of a subjective assessment. Accordingly, no evidence was presented to establish that damage or pollution had in fact occurred in the area, much less that it resulted from the activities carried out in the buildings at issue in the case under review.” In this case, the arguments advanced by the judge are contradictory. As stated in the preceding recital (considerando), the judge found it proven that seven buildings had been constructed in the public zone of the maritime-terrestrial zone, yet she denied the Procuraduría’s application seeking the demolition of those buildings, maintaining that there would be confusion as to which property should be demolished. She also stated that there were inconsistencies between the information set forth in the charging document concerning the location of each building and that shown by the forensic expert report.
This argument is legally invalid because it violates the principle of sufficient reason (principio de razón suficiente), since the record contains expert evidence, including inspections of the site, describing the various buildings for which the demolition order was requested; therefore, it is unclear what type of confusion the judge was referring to. Additionally, it is clear that the State entity’s claim was directed at the buildings that were the subject of this investigation; therefore, the assertion that the request could not be granted because other buildings might exist on the site is not a valid reason. Likewise, the reference to the possibility that other residents who did not participate in the proceeding might occupy those properties is incomprehensible, since that argument is entirely speculative. Furthermore, the judgment does not explain what good-faith legal status could legitimize such possession, since the Ley sobre la Zona Marítimo Terrestre establishes that the area belongs to the State and is inalienable (Article 1).
It further provides that the Zona Marítimo Terrestre may not be the subject of possessory title proceedings (informaciones posesorias) and that private parties may not appropriate it (Article 7). It also specifies that constructing buildings in that area is prohibited (Article 12), and recognizes the authority of the State and the municipalities to order the demolition of buildings constructed in that zone in violation of that special legislation. Finally, as far back as Resolution Number 5756 of 30 October 1996, the Sala Constitucional held that the exercise of the demolition power is permissible in pending judicial proceedings that have not yet concluded with a final judgment, and that it does not violate due process or the defendant’s right of defense, provided it is understood that, before adopting the destruction or demolition measure, the judge must verify that the land or structures involved are in fact located within the maritime-terrestrial zone and that they were constructed contrary to the provisions of this Law.
The foregoing review of the applicable law and case law leads to the conclusion that the legislation provides for the demolition of structures illegally constructed in that zone; therefore, in this case, the judicial authority was required to rule on that claim in accordance with the evidence submitted into the record. Additionally, if the judge believed it necessary to verify the buildings’ existence before their demolition, she could have so ordered in the corresponding ruling or, under Article 355 of the Código Procesal Penal, could even have conducted sua sponte any visual inspection she deemed necessary to rule on the Procuraduría’s claim, which had been asserted when the private prosecution (querella) was filed. Accordingly, the claim is upheld, and the judgment is partially vacated insofar as it denied the demolition order sought by the Procuraduría. Consequently, a remand trial is ordered for fresh proceedings on that separate issue.
POR TANTO:
The first ground of appeal filed by the Procuraduría General de la República is denied. The second and third grounds of the appeal filed by the Procuraduría General de la República are upheld. The judgment is partially vacated as follows: A) The acquittal entered in favor of defendants [Nombre6], [Nombre7], [Nombre5], [Nombre4], and [Nombre1] is vacated, and the case record is ordered remitted to the Tribunal de Juicio for fresh proceedings in accordance with law. B) The judgment is partially vacated insofar as it denied the demolition order sought by the Procuraduría. Consequently, a remand trial is ordered for fresh proceedings on that separate issue. In all respects not vacated by this appellate decision, the trial judgment remains undisturbed. Let notice be given.

RECURSO DE APELACIÓN DE SENTENCIA interpuesto en la presente causa seguida contra [Nombre1] , costarricense, documento de identidad número CED1; [Nombre2] , costarricense, cédula de identidad número CED2; [Nombre3] , costarricense, cédula de identidad número CED3; [Nombre4] , costarricense, cédula de identidad número CED4; [Nombre5] , costarricense, cédula de identidad número CED5, [Nombre6] , costarricense, cédula de identidad número CED6, y [Nombre7] , costarricense, cédula de identidad número CED7; por el delito de USURPACIÓN DE BIENES DE DOMINIO PÚBLICO en perjuicio de EL ESTADO. Intervienen en la decisión del recurso, los jueces Adriana Escalante Moncada, Francisco Lemus Víquez y José Asdrúbal Quirós Pereira. Se apersonan en apelación de sentencia, la licenciada Margot Avellán Ruiz en calidad de Procuradora y la licenciada Yosselin Morales Zumbado, en calidad de defensora Pública de los imputados: [Nombre1] , [Nombre8] , [Nombre3] , [Nombre4] , [Nombre6] , [Nombre5] y [Nombre7] .
RESULTANDO:
Redacta la Jueza de Apelación de Sentencia Escalante Moncada; y,
CONSIDERANDO:
I.La Procuradora Margoth Avellán Ruíz, interpone recurso de apelación de sentencia, contra el fallo escrito número 303-P-2019, dictado por el Tribunal de Juicio de Puntarenas.
II.En el primer motivo, la apelante muestra su inconformidad con el fallo de instancia por lo siguiente. Indica que en relación con la absolutoria dictada en favor de los imputados [Nombre3] y [Nombre8] , el Tribunal de Juicio los absolvió al estimar que la acción penal estaba prescrita. Dice que para sustentar esta postura la Cámara de Juicio argumentó que, ambos acusados declararon que solo pernoctaron una noche en el inmueble, y que por haberse indagado a los imputados en fechas 8 y 15 de mayo del 2013, respectivamente, el plazo de prescripción operó el 15 de mayo de 2015, sin que en ese lapso de dos años se diera otro acto interruptor de la prescripción. Objeta la aplicación de la ley sustantiva, al estimar que la acción penal no se ha extinguido por prescripción. Indica que en relación con los delitos de invasión a áreas de protección, cuando la acción se ejecuta mediante la construcción de edificaciones se está en presencia de un delito continuado o permanente, siendo que en este tipo de delincuencias, la acción penal comienza su conteo fatal una vez que cesa la permanencia de la obra invasora, ya que mientras la obra permanezca, el ilícito se perpetua en e tiempo, y es hasta que se elimine la estructura o construcción invasora que cesa la actividad ilícita.
Explica que en este tipo de delitos el cómputo de la prescripción es diferente, ya que jurídicamente no es viable bajo los parámetros del artículo 32 del Código Procesal Penal que prescriba un delito cuando los efectos permanecen en el tiempo, debido a que el bien jurídico (ambiente) se mantiene lesionado. Dice que, en este caso, el hecho acusado consistió en que los imputados detentaron la zona marítimo terrestre de la localidad de Tambor, mediante la edificación de estructuras permanentes, acciones que encuadran en el delito de usurpación de bienes de dominio público, previsto en el artículo 227 del Código Penal. Afirma que, en este caso, al permanecer la obra invasora no es factible aplicar el artículo 32 del Código Procesal Penal. Adicionalmente, critica que el Tribunal de instancia le dio plena credibilidad a la declaración que ambos imputados dieron en juicio, cuando indicaron que solo estuvieron en ese inmueble una noche, lo cual contradice la prueba incorporada en autos.
Al respecto, destaca que en los datos de identificación de estas personas se indican que han vivido en ese sector desde hace varios años; además, tanto de la declaración del testigo [Nombre10] , como de los informes rendidos por el Organismo de Investigación Judicial, se aprecia que en las distintas ocasiones en que se visitó la zona Marítimo terrestre de interés, los encartados habitan esas edificaciones, sumado a que las obras permanecen en propiedad estatal. Por lo anterior, estima que la conclusión a la que arribó la juzgadora es equivocada. En este apartado, la apelante ataca los argumentos con los que se estableció que la acción penal había fenecido por prescripción para los imputados [Nombre3] y [Nombre8] , para resolver de forma adecuada cada uno de los reclamos, se analizará de forma separada la situación de cada uno de ellos. Imputado [Nombre3] . Una vez examinados los autos y la sentencia recurrida se concluye que, no le asiste razón a la recurrente.
En este asunto, a todos los encausados se les acusó del delito de usurpación de bienes de dominio público, y conforme lo desarrolló el fallo de instancia, dicha ilicitud está catalogada como un delito de efectos permanentes, y el cómputo del plazo de la prescripción se rige por la regla prevista en los artículos 32 y 33 del Código Procesal Penal, que establece que para los ilícitos continuos o permanentes, el plazo corre desde que cesó su permanencia. Sobre este aspecto se tiene que la jueza de instancia aplicó de forma correcta la normativa establecida en la Ley procesal. El punto de discusión que propone la representante de la Procuraduría estriba en establecer a partir de qué momento es que se tiene por cesada la actividad ilícita en esta modalidad delictiva. Para la Procuradora, la acción penal no prescribe mientras las edificaciones que se construyeron en la zona pública no hayan sido derribadas.
Al respecto, esta postura si bien en un principio pareciera razonable, lo cierto es que ello dependerá de cada caso en concreto, ya que lo relevante es determinar cuál fue la acción que se le imputó a cada uno de los acusados y qué se demostró en juicio. Para efectos de resolver lo relativo al imputado [Nombre3] , se tiene que la Procuraduría en su escrito de querella imputó lo siguiente: “Sin precisar fecha exacta pero al menos desde el mes de octubre del 2012 y hasta la fecha, en Tambor de Cóbano, de Puntarenas, específicamente [Dirección1] , el acusado [Nombre3] , ha detentado y se encuentra actualmente detentando una porción de la zona pública de la zona marítimo terrestre, esto al habitar dentro de una edificación construida con material de madera, latas de zinc, postes de madera, varillas de bambú y piso de tierra, edificación que cuenta con un área de 15.62 metros cuadrados, destinada a casa de habitación del acusado.
Dicha edificación se localiza entre los mojones N° 122-2005 y 126-2005 del Instituto Geográfico Nacional. La detentación del acusado [Nombre8] la realiza sin contar con el permiso de uso de suelo, construcción o concesión y sin que exista un plan regulador por parte de la autoridad competente.” Según dicha imputación el acusado detentó un bien de dominio público al construir y habitar en una casa que se encuentra dentro del área pública de la zona marítimo terrestre, en un periodo determinado. Ahora bien, según se indica en el fallo de instancia, la acción penal de esta causa se encontraba prescrita porque la jueza tuvo por demostrado que el imputado [Nombre3] , había cesado la permanencia en dicho inmueble. Para resolver el tema, es relevante referir que de la prueba recibida en juicio, el testigo [Nombre10] , que es el agente judicial que tuvo a cargo la investigación, relató que no lograron determinar quién o quiénes habían construido las diversas viviendas, ya que en las visitas que realizaron no lograron observar a alguna persona construyendo edificación alguna, sino que estas edificaciones ya existían en el lugar.
De igual manera detalló que había personas que habitaban las casas de forma permanente, pero otro grupo lo hacía de forma temporal, ya que cuando hacían las inspecciones, y levantaban el censo de los ocupantes, en esa oportunidad había unas personas, pero después, al realizar otra inspección en esas edificaciones habitan otros ocupantes, o las casas estaban vacías, o cerradas. Este dato es relevante, porque como se verá más adelante, la juzgadora descartó que el imputado [Nombre3] construyó esa edificación, o que habitaba de forma permanente en dicha morada. Ahora bien, en el caso bajo examen, la juzgadora determinó que del informe de investigación el Informe 057-13-URC (folio 165 al 167), se estableció que para el momento en que se hace la inspección del inmueble, efectuada entre el 06 de noviembre de 20212 y el 06 de marzo de 2013, dicha vivienda era ocupada en el momento de la visita, por [Nombre3] .
De importancia resulta ser también que a partir del informe 19-14-ORC del Organismo de Investigación Judicial de Cóbano (folio 283), según el cual, en visitas realizadas el 15 y 22 de abril de 2014, se corroboró que [Nombre3] , ya no vivía en la edificación sobre la que versa la imputación de hechos en su contra, es decir existe prueba de que, para el mes de abril del 2014, el imputado había cesado la acción de detentar un bien de dominio público. Estas probanzas, las analizó la jueza de forma conjunta con la declaración del encartado, quien manifestó en juicio lo siguiente: ““Estaba de paso por la zona de Tambor, me quedé en una casilla ahí, porque estaba buscando trabajo, pasó un oficial del OIJ, me preguntó si yo vivía ahí y aún así me pidió la cédula, yo no vi inconveniente, y ahora me encuentro acá, dada la situación de que yo nunca he vivido ahí. Esa casita está ahí, siempre ha estado, entonces yo lo único que hice fue quedarme para dormir ahí, anda más.
Lo que hice después fue irme. Ya estaba construida. La casa estaba desocupada. Me quedé una noche. Actualmente vivo en Villas del Mar, en Cóbano. Tengo 4 años de vivir ahí en Villas del Mar. Anteriormente, vivía en Ciudad Neilly. En Villas del Mar vivo con mi pareja y mis dos hijos”. Como se analiza en el fallo, esta versión defensiva no fue desacreditada, por el contrario, la juzgadora también valoró los datos de identificación dados por el acusado el 8 de mayo de 2013 ante la fiscalía, en los que indicó que vivía en Cóbano, en la casa de la señora Yexi Solano Muñoz, es decir, para esta época ya no habita en el área pública. Como bien, lo examina la juzgadora, al demostrarse que la acción de detentar un terreno de dominio público había cesado se tenía que iniciar el cómputo de la prescripción, la cual se ve reducida a la mitad con el acto de la indagatoria, el cual ocurrió el 14 de mayo de 2013, y no cómo se indica en el fallo de instancia, el 08 de mayo de 2013, pero aún, a pesar de ese yerro en la fecha de dicho acto procesal, la situación jurídica no varía, porque el siguiente acto procesal capaz de interrumpir el cómputo de la prescripción, lo fue el señalamiento a audiencia preliminar, el cual data del 04 de agosto de 2015, es decir, entre ambos actos procesales habría transcurrido dos años dos meses y 21 días, por lo que la acción penal, conforme lo prevé los artículos 32 y 33 del Código Procesal Penal, en relación con el numeral 227 del Código Penal habría prescrito, ya que el plazo ordinario para dicha delincuencia es de cuatro años, el cual reducido a la mitad es de dos años, lapso que se superó en el caso del encartado [Nombre3] .
En este aspecto hay que indicar que no es admisible la postura del órgano acusador del Estado, en la que se afirma que mientras permanezca la construcción no prescribe la acción penal, porque dicha interpretación violenta el principio constitucional consagrado en el artículo 39 de la Constitución Política, del cual se deriva que la responsabilidad penal es personalísima, y de ahí que, al existir prueba de que el imputado cesó en la actividad ilícita de detentar una zona pública, ese hecho debe ser valorado para efectos del cómputo del plazo de extinción de la acción penal, y eso fue lo que ocurrió en el caso bajo examen. Seguir la tesis de la Procuraduría llevaría al absurdo de concluir que, si la edificación permanece en la zona pública por más de diez años, sin ser ocupada por alguna persona, la acción penal no estaría extinta en relación con el último ocupante, debido a que el inmueble no ha sido derribado.
Esta interpretación está por fuera del ámbito de tipicidad del tipo penal previsto en el artículo 277 del Código Penal, el cual requiere para su configuración y permanencia que una persona, mediante actos concretos detente un bien de dominio público, es decir, se requiere de la demostración de que la persona está ejecutando esa acción, por ello, no sería admisible la interpretación que hace la Procuraduría, la cual incluso atenta contra lo establecido en los artículos 2 del Código Penal y 2 del Código Procesal Penal, que fijan el principio de interpretación restrictiva de los tipos penales, y de las normas procesales. Adicionalmente, no hay que olvidar que le corresponde al órgano acusador probar la continuidad o permanencia de la actividad delictiva, y como se razona en el fallo de instancia, la prueba allegada a los autos permite tener por acreditada para una época determinada (14 de mayo de 2013), la cesación de la actividad delictiva, de ahí que, lo resuelto por el a quo es conforme a derecho.
Por lo antes dicho se declara sin lugar este reclamo. Del imputado [Nombre8] . Sobre este otro alegato, no le asiste razón a la recurrente. Para este caso, se da una situación similar a la previamente analizada. Según consta en el fallo, la juzgadora valoró que en autos no existe prueba que indique que el encartado detentaba continuamente el área pública como se afirmaba en la querella, sino que, por el contrario, que no existe prueba que permita acreditar la permanencia de la actividad delictiva, a partir de la indagatoria efectuada a esta persona el 15 de mayo de 2013. A tal efecto se indicó lo siguiente: “En el caso de [Nombre8] , se tiene una situación similar: el encartado manifestó en la declaración que brindó en ejercicio de su defensa material que: “La situación es que yo trabajo pescando, actualmente vivo en Paquera, tengo 7 años de vivir ahí, un día llegué en moto, llegué entre las 12 o medianoche, la moto estaba ponchada, entonces con el muchacho que yo trabajo me dijo: así no se puede ir.
De Tambor a Paquera hay como 28 kilómetros. Caminando era imposible, entonces el muchacho me dijo: ¿por qué no va y se queda en esa casa y mañana ve qué hace? y yo le dije que sí. Fui y me quedé en la casa, la casa estaba sola, como a las 8 de la mañana tocaron y salí a ver qué era, un muchacho me preguntó el nombre y me pidió la cédula, yo no vi problema. Yo me fui y arreglé la moto. Y por eso estoy aquí”. Ahora bien, en el caso de [Nombre8] , tenemos que al momento de recibírsele sus datos de identificación, el mismo no hizo mención de esta circunstancia, es decir, de que estuviera viviendo en Paquera, sino que ubicó su vivienda en Puntarenas, Tambor, a [Dirección2] del muelle. Dirección que resulta muy similar a la que se indica en la pieza acusatoria. Por su parte, el oficial de investigación Pérez Espinoza de forma clara manifestó en su deposición: “Me he enterado que algunos de ellos ya no viven ahí.
Porque los he visto viviendo en otros sectores. A don [Nombre11] en Paquera (…)”. Lo anterior (el lugar de residencia) coincide con lo manifestado por el imputado. Ahora bien, el encartado fue indagado por los hechos que se investigaban en su contra, en fecha 15 de mayo de 2013, por lo que a partir de esta actuación, el plazo de prescripción se redujo a la mitad, es decir, a dos años. Siendo que el delito de Usurpación de Bienes de Dominio Público es de comisión inmediata con efectos permanentes, y que no se cuenta en el proceso con prueba de que posterior a esta fecha, 15 de mayo de 2013, el encartado aún permaneciera viviendo en dicha edificación, sino que lo que tenemos es una manifestación del mismo en el sentido de que reside en Paquera de Puntarenas desde hace 7 años, manifestación que es respaldada por el oficial de investigación Pérez Espinoza, se debe partir de que a ese momento (15 de mayo de 2013) ya habrían cesado los efectos del presunto delito que se le achaca, por lo que a partir de esa última actuación empieza a correr el plazo de prescripción de la acción penal.
Dicho plazo transcurrió sin que en el ínterin se verificara ninguna causal de interrupción o suspensión de la prescripción. Así las cosas, al 15 de mayo de 2015, la acción penal ya se encontraba prescrita, con lo cual se extinguió la acción en contra del encartado [Nombre8] ”. Del anterior extracto se extrae que para establecer que la acción penal había prescrito, la juzgadora tomó en consideración tanto la tesis defensiva como los elementos de prueba allegados a los autos, y de su análisis conjunto determinó que no existía prueba en el expediente que diera cuenta de que el encartado continuara con la actividad delictiva de detentar aquella zona pública con posterioridad al 15 de mayo de 2013, más bien se valoró que la tesis defensiva que aludía a que el imputado desde hace siete años vivía en otro sector, específicamente en la localidad de Paquera, era respaldada por la prueba aportada por la Fiscalía, porque el oficial Pérez Espinoza indicó que se había enterado que varios de los imputados ya no vivían en el área pública, y declaró conocer que [Nombre8] residía en Paquera.
En otras palabras, al establecerse la cesación de la actividad delictiva, lo correcto era contabilizar los plazos de prescripción, según las reglas previstas en los artículos 32 y 33 del Código Procesal Penal, por lo que una vez examinado ese cómputo, se tiene que lleva razón la jueza de juicio al afirmar que la acción penal para el caso del imputado [Nombre8] se encuentra prescrita. En consecuencia, se debe declarar sin lugar el motivo.
III.En el segundo motivo, la apelante combate los argumentos por los que se absolvieron a los encartados [Nombre6] , [Nombre7] , [Nombre5] , [Nombre4] , y [Nombre1] . Dice que el Tribunal de instancia fundó su decisión al estimar que el Oficial del Organismo de Investigación Judicial, al abordar a estas personas en sus viviendas, y les preguntó si vivían en ese lugar, violentó el derecho de abstención que tenían los acusados, por lo que la prueba generada a partir de esa individualización es espuria y al no contarse con más elementos de prueba, lo procedente era absolver a los encartados. Añade que también la juzgadora sustentó la absolutoria de los encartados [Nombre6] , [Nombre7] , [Nombre5] y [Nombre4] , en la existencia de un error de tipo, al estimar que estas personas tenían mucho tiempo de vivir en el lugar y que por ello desconocían que ese encontraban ilegalmente en el sitio, máxime que es un asentamiento en el que hay servicios públicos, los niños van a la escuela pública de Tambor, y la Municipalidad de Cóbano le cobra cánones a diversas vecinos del lugar.
La recurrente objeta estos argumentos por lo siguiente. En cuanto al tema de la prueba espuria, indica que no es cierto que se acreditara que en la primera visita que realizó el funcionario [Nombre10] en el año 2013, se indujera en error a los imputados, para que estos indicaran que vivían en ese lugar. Añade que, aún si se aceptase esa hipótesis, en autos quedó demostrado que el agente judicial visitó con posterioridad dicha zona, en diversas ocasiones, de las cuales se levantó el informe respectivo, y en las que se constató que los imputados residían en las edificaciones ahí construidas, es decir, en varias ocasiones se constató que los imputados detentaban la zona pública marítimo terrestre. Adicionalmente, los encartados al momento de ser indagados, así como en su declaración en la fase plenaria indicaron que residían en el lugar de los hechos. Añade que, la prueba pericial elaborada por la sección de Ingeniería Forense estableció que las edificaciones se encontraban en el área pública de la zona marítimo terrestre, por lo que el otro argumento esbozado por la juzgadora, en cuanto a la imprecisión de la distancia de cada una de las edificaciones, es irrelevante, porque toda ellas están en el área protegida.
También objeta que se indicara que los encartados incurrieron en un error de tipo, porque no existe prueba que indique que estas personas vivían en esas edificaciones desde su niñez, sino todo lo contrario, las casas de estas personas, con excepción de la del imputado [Nombre1] , están hechas de materiales tales como láminas de zinc, bambú y láminas de fibrolit, lo que descarta el dicho de los acusados de que esas edificaciones tienen décadas de existir. Adicionalmente indica que no se puede alegar un error de tipo ni de prohibición, porque la cercanía de las edificaciones en relación con el mar descarta esa circunstancia fáctica. Asimismo, indica que aunque en un precario existan servicios públicos, ello no torna en lícita la ocupación de una zona prohibida, por lo que no resulta de interés jurídico que las personas contaran con esos servicios, o que los niños asistieran a la escuela de la localidad.
En lo relativo al análisis de la prueba, sostiene que es un error de la persona juzgadora indicar que no se demostró el hecho querellado, ya que estima que con la prueba tanto documental como pericial se comprobaba a cabalidad que los imputados han detentado el área pública de la zona marítimo terrestre. Añade que, para el caso del imputado [Nombre1] , era evidente que dicha persona no tenía años de residir en el lugar, porque en otro proceso que se juzgó bajo el expediente número 01-200031-591-PE, en el que dicha persona figuró como imputado, también por invadir la zona pública, se acreditó que para esa época el encausado no residía en ese sector. En este acápite la apelante ataca la fundamentación de la sentencia por diversas razones, por lo que para una adecuada resolución se resolverá cada uno de los tópicos planteados de forma separada. Sobre la declaratoria de prueba ilícita. Examinado el fallo, se tiene que le asiste razón a la recurrente.
Como consta en el fallo de instancia, el a quo, fundó la decisión de absolver a los imputados por tres razones, siendo una de ellas sustentada en que era ilícita la actuación del agente judicial Jorge Pérez Espinoza, quien al realizar las diligencias de investigación se apersonó a la residencia de cada uno de los imputados y les pidió sus datos de identificación, y les preguntó si vivían en dicho lugar. Según la juzgadora, si bien las personas tienen el deber de identificarse ante las autoridades judiciales, en este caso, el oficial Pérez Espinoza se extralimitó en sus funciones, ya que fue más allá de la mera identificación nominal de cada uno de los encartados, sino que también les preguntó sí residían en ese lugar, pregunta que no era procedente, y sobre la cual los imputados tenían derecho de abstención. En este punto, se advierte que la juzgadora erró en la interpretación de la norma procesal.
El artículo 283 del Código Procesal Penal establece que la Policía Judicial, está legitimada para realizar las diligencias de investigación que sean necesarias en torno a una actividad delictiva, entre ellas, la identificación del imputado. De igual manera, los artículos 83 y 94 del Código Procesal Penal, establecen que los imputados tienen el deber de brindar los datos que sean necesarios para su identificación, y entre ellos se encuentra, sus calidades, y su domicilio, siendo este último dato relevante, porque será en este sitio en el cual, con posterioridad, la autoridad judicial, deberá citar para las diligencias correspondientes a las personas acusadas. En otras palabras, los agentes judiciales están legitimados, para consultarle a las personas investigadas los datos relativos a su domicilio. Si bien en este caso, el lugar de residencia de cada uno de ellos, está vinculado con la zona en la que se ejecuta la actividad delictiva, sobre ese dato de su identificación no le asiste derecho de abstención a las personas acusadas.
Por el contrario, existe un deber legal de suministrar esa información, por lo que es inválida la interpretación que hizo la juzgadora de instancia al estimar que se incurrió en una actuación ilícita, al momento en que se identificó a los imputados. Sobre el error de tipo. Examinado este otro alegato, así como el fallo de instancia se concluye que le asiste razón a la recurrente. Como se deriva del fallo de instancia, la juzgadora absolvió a los encartados [Nombre6] , [Nombre7] , [Nombre5] , [Nombre4] , al argumentar un error de tipo, sobre lo cual indicó lo siguiente: “Así las cosas, considera este Tribunal que ante este panorama, los encartados podían representarse fácilmente que la acción que supuestamente realizaban, era delito, pues todos sus vecinos se encontraban en la misma circunstancia, sus familiares habitaron en el lugar por años sin enfrentar ninguna consecuencia jurídica por ello, y sin que surgieran problemas a partir de esta circunstancia.
Al contrario, existía una especie de “legalización” por parte de funcionarios del Estado costarricense, que no sólo les brindaban acceso a servicios básicos como agua y electricidad, sino que además llegaron a cobrarles cánones por concepto de impuestos territoriales. Ante este panorama, ¿de qué manera los encartados, personas sencillas, con niveles muy básicos de educación, podían representarse que estaban cometiendo un delito y que enfrentarían consecuencias penales por ello? En materia penal, para que se configure el injusto penal, debe existir una conducta humana, que sea típica y antijurídica. En cuanto a la tipicidad debemos analizar la existencia del elemento subjetivo, sea el dolo o la culpa. El primero de ellos requiere que el sujeto activo tenga el conocimiento de los elementos objetivos del tipo, y además la voluntad de cumplir con esos elementos objetivos. En el caso que nos ocupa los encartados, según los hechos que se les imputan en las piezas acusatorias, han detentado un espacio correspondiente a un lugar de dominio público, sin embargo, las circunstancias que hemos venido analizando les representaron un escenario donde desconocían que la acción que supuestamente realizaban, se trataba de un delito, pues en el sitio existen una gran cantidad de viviendas en la zona, que cuentan con todos los servicios públicos básicos, que se estableció al menos desde hace 25 años, donde existe una pulpería e incluso un restaurante.
Estas situaciones nos hacen concluir que no se desprende que existiera en los encartados un dolo de "retener lo que manifiestamente no le pertenece" que es precisamente la definición que la Real Academia Española asigna al verbo detentar, por lo cual a criterio del Tribunal concurre el llamado error de tipo. En este sentido, dice el artículo 34 del Código Penal, que: “No es culpable quien, al realizar el hecho, incurre en error sobre algunas de las exigencias necesarias para que el delito exista, según su descripción. No obstante, si el error proviene de culpa, el hecho se sancionará sólo cuando la ley señale pena para su realización a tal título”. Partiendo de lo establecido en este numeral, tenemos que los encartados no son culpables (entendiendo que esta denominación es en sentido común de la palabra, y no en referencia a la ausencia de la culpabilidad como tal, pues como se ha expuesto, se estaría ante la ausencia de uno de los elementos integrantes del tipo penal), pero además, el tipo penal de Usurpación de Bienes de Dominio Público, no es realizable a título de culpa, por lo que lo que corresponde en la especie, es absolver a los encartados de la conducta que se les achaca”.
Este argumento es inválido por lo siguiente. Lo primero que se debe indicar es que la jueza confunde conceptos dogmáticos comprendidos en dos categorías distintas, a saber, el error de tipo que se analiza en la tipicidad y el error de prohibición que se debe ponderar dentro de la culpabilidad. En cuanto al error de tipo este se configura cuando se verifica un desconocimiento o error por parte del autor sobre la existencia de uno o alguno de los elementos objetivos que conforman el tipo penal. En nuestro ordenamiento jurídico este tipo de error está regulado en el primer párrafo del artículo 34 del Código Penal que reza así: “No es culpable quien, al realizar el hecho, incurre en error sobre algunas de las exigencias necesarias para que el delito exista, según su descripción. No obstante, si el error proviene de culpa, el hecho se sancionará sólo cuando la ley señale pena para su realización a tal título”.
En los casos de error de tipo invencible desaparece la tipicidad, es decir, la voluntad de realizar el tipo objetivo y al no haber ese querer no hay dolo y por ende la conducta es atípica. Cuando el error de tipo es vencible, subsiste la tipicidad solo para aquellas conductas estén tipificadas a título de culpa. Volviendo al asunto bajo examen, se tiene que en su argumentación, la jueza indica que existe un error de tipo porque los imputados desconocían que la conducta que estaban realizando era delictiva. De igual manera en su planteamiento, la jueza admite como hecho probado que este grupo de personas vive en un área demanial, porque sus casas están construidas en la zona pública. Es decir, conocen que están poseyendo un área pública y tienen la voluntad de vivir en ese sector. De lo anterior se evidencia que a pesar de que se indica la existencia de un error de tipo, del fallo se desprende el conocimiento y voluntad de los encartados en cuanto a la acción que están realizando de detentar un terreno que es público, lo que conlleva a tener por acreditada la tipicidad del tipo penal previsto en el artículo 227 del Código Penal.
Por ello, no era correcto que se aludiera a la existencia de un error de tipo. Ahora bien, si se analizan los argumentos esbozados por la jueza, bajo las reglas que sustentan el error de prohibición, se tiene que el argumento esgrimido también resulta equivocado por lo siguiente. La juzgadora de instancia aduce que los imputados desconocían que su conducta era delictiva, porque en esa zona existe todo un asentamiento de personas, y que incluso el Estado les brinda a varias viviendas servicios públicos, como agua y luz; además, a otros pobladores, la Municipalidad de Cóbano les cobra un canon respectivo por habitar en dicho sector. Este argumento es ilegítimo por lo siguiente. El error de prohibición es aquel que se configura cuando el autor cree que actúa lícitamente, así como cuando ni siquiera se plantea la ilicitud de su conducta. De igual manera, el error puede referirse a la existencia de las normas prohibitivas (error de prohibición directo), o también el error puede recaer sobre la existencia de los límites o presupuestos objetivos de una causa de justificación.
El Código Penal, regula el error de prohibición directo, en el artículo 35 al establecer que No es culpable, el que por error invencible cree que el hecho que realiza no está sujeto a pena. Si el error no fuere invencible, la pena prevista para el hecho podrá ser atenuada, de acuerdo con lo que establece el artículo 79. Por su parte, el error de prohibición indirecto está regulado en el párrafo final del artículo 34 del Código Penal, que indica que las mismas reglas se aplicarán respecto de quien supone erróneamente la concurrencia de circunstancias que justificarían el hecho realizado. En este caso, cuando la juzgadora aduce a que los imputados desconocían que su conducta era prohibida, y que más bien su actuación estaba legalizada. En su disertación la jueza a lo que hace alusión es a la eventual configuración de un error de prohibición y no uno de tipo. Aquí es donde se detecta también el otro error en el análisis del caso concreto, ya que la juzgadora olvida que, para el caso del error de prohibición, solo es posible la no punibilidad de la conducta, cuando se ha acreditado un error invencible, ya que el error de prohibición vencible solo da sustento a la disminución del reproche penal.
En este caso, la juzgadora de forma errada y sin mayor análisis indica que los imputados desconocían que su conducta era delictiva porque en ese sector vivían más personas, razonamiento que no es aceptable, porque ello implicaría que, si otras personas cometen conductas delictivas, tales como robo, hurto, o venta de droga, se debería llegar a la misma conclusión, es decir, porque las otras personas ejecutan la misma acción, entonces esta no debe estar prohibida por el ordenamiento jurídico. Criterio que es errado, ya que la prohibición de una conducta no depende de si otras personas la ejecutan o no, por el contrario, su existencia estriba en que una norma penal es la que prohíbe la realización de esa acción. Adicionalmente, el conocimiento de la antijuridicidad de la conducta, es un tema que se analiza en el ámbito de la culpabilidad y no de la tipicidad, por lo que si una persona alega que desconocía que su actuar estaba sancionado por el ordenamiento jurídico, o estima que su actuar estaba permitido, esos casos se deben resolver bajo los criterios antes esbozados referentes al error de prohibición, es decir, si esa desconocimiento era vencible la conducta no queda impune, por el contrario, la actuación sigue siendo típica, antijurídica y culpable.
No obstante, en virtud del error conceptual en el que incurrió la juzgadora esos otros componentes del error de culpabilidad ni siquiera fueron analizados, por lo que la fundamentación deviene en ilegitima por insuficiente. Adicionalmente, la juzgadora hace alusión a situaciones muy genéricas, tales como que algunas casas contaban con servicio de agua y luz, y que otros pobladores pagaban un canon a la municipalidad, pero no analiza porqué esas circunstancias fácticas inducían en un error invencible a las personas acusadas. En este sentido, la jueza desconoce que las máximas de la experiencia que informan que las personas que residen en áreas costeras conocen que existe un área en la playa que es pública, y que está prohibido construir edificaciones en ese sector, porque esa área está destinada para el disfruto de todas las personas, y para la conservación del medio ambiente. En consecuencia, al estar erróneamente fundado el fallo, se impone declarar con lugar el motivo.
El tercer argumento que utilizó la juzgadora para absolver a todos los imputados se encuentra descrito bajo el título “Sobre la falta de prueba en relación a la circunstanciación en tiempo y lugar de los hechos acusados”. Del fallo se desprende que en este apartado la jueza estimó que no se probó ni la hipótesis del Ministerio Público, en la que se endilgó que los imputados detentaron la zona marítimo terrestre para el periodo comprendido de octubre de 2012, hasta junio de 2015, o que incluso continuaran usurpando ese terreno, tal y como lo acusó la Procuraduría, porque no existía prueba que acreditara ese hecho. Para ello, la jueza hace alusión a que solo existen inspecciones del año 2013, y 2014, y que posterior a esos hechos, no existen otros elementos de prueba que permitan acreditar el rango temporal acusado en cada una de las requisitorias fiscales. Este argumento resulta inválido, porque de un examen integral del fallo se desprende que en autos se incorporaron elementos de prueba, tales como denuncias, inspecciones oculares, levantamientos fotográficos y visitas de campo, que dan cuenta de la ubicación de cada una de las edificaciones, de sus ocupantes, y de las fechas en que se ejecutaron esos actos.
Ahora bien, si la juzgadora estimó que con esa prueba no se demostraba la totalidad del rango temporal acusado, ello no implicaba necesariamente que se debiera de dictar una sentencia absolutoria. Por el contrario, si la prueba daba cuenta de la existencia del hecho en un periodo inferior al acusado, ello en nada perjudicaba el derecho de defensa, ni el principio de correlación entre acusación y sentencia. Hay que recordar que la garantía prevista en el artículo 365 del Código Procesal Penal, está vinculada de forma estrecha con el derecho de defensa del imputado, y si bien es un requisito en toda imputación fiscal debe precisar las circunstancias modales de ejecución de la conducta delictiva, entre ellas, la fecha de ocurrencia de los sucesos, según su modalidad de ejecución, ese requisito normativo tiene como finalidad de que el imputado y su defensa técnica puedan ejercer el derecho de defensa, para efectos de ofrecer las pruebas que estiman necesarias, así como para rebatir la imputación que se ha efectuado en su contra.
No obstante, es amplia la jurisprudencia de los Tribunales de Apelación de Sentencia como de la Sala Tercera de la Corte Suprema de Justicia que han establecido que este principio de correlación entre acusación y sentencia no significa que aquella imputación no pueda ser modificada por el Tribunal de sentencia, a partir de la prueba recabada en el juicio. Por el contrario, este cuadro fáctico puede ser variado, siempre y cuando esa modificación no sea sobre aspectos esenciales de la imputación que provoquen indefensión al acusado, lo cual debe ser analizado para cada caso concreto. Volviendo al asunto bajo examen, del argumento que esboza la juzgadora se advierte con facilidad que su cuestionamiento va dirigido a que no se demostró que los imputados estuvieran ocupando las tierras demaniales, durante el lapso que fue juzgado, aunque sí admite que existe prueba que acredite que estuvieron detentando ese bien demanial en un rango menor al acusado, pero siempre dentro de ese rango temporal.
Por lo que no se comprende, entonces cuál era la imposibilidad para la juzgadora de acreditar un rango espacial más corto, si este siempre estaba comprendido dentro del lapso fijado en la imputación. Además, el argumento esbozado por la juzgadora se torna en contradictorio, porque en el apartado en el que la jueza analiza el tópico del error de tipo, establece que los imputados [Nombre6] , [Nombre7] , [Nombre5] y [Nombre4] , han manifestado que viven en esas edificaciones desde mucho tiempo atrás, al igual que lo han hecho otros familiares de ellos. Es decir, en el caso de estos imputados, a partir de su declaración se corrobora el espacio temporal de la imputación, pero aún así, sin mayor sustento la jueza afirma que no es factible tener por demostrado aquel rango temporal. Una situación similar acontece con el argumento en el que se aduce que no es factible condenar a los encartados por los hechos acusados, porque en la acusación se indicó que las viviendas se encontraban a una determinada distancia del muelle, pero en las inspecciones oculares realizadas por los peritos judiciales, se estableció que esa distancia era menor o mayor si se le medía desde el muelle, y por ello, se justifica que al haber una diferencia en cuanto a la distancia no es factible tener por demostrado el hecho acusado.
Aquí nuevamente, la jueza realiza una aplicación rígida del principio de correlación entre acusación y sentencia, al estimar que esa diferencia detectada en la distancia que tiene cada una de las edificaciones en relación con el muelle imposibilitaba la emisión de una sentencia condenatoria. Bajo este argumento, se dejó de analizar el núcleo esencial de la imputación que consistía en que los imputados detentaron la zona pública al habitar una vivienda que está dentro del área pública que comprende la zona marítimo terrestre. Nótese que en el acápite de hechos probados, la juzgadora tiene por acreditado que en Tambor de Cóbano de Puntarenas, dentro del área de Patrimonio Natural del Estado, a saber: la Zona Pública Marítimo Terrestre, existen siete edificaciones hechas de diversos materiales destinadas a la vivienda de personas. Es decir, con independencia de la diferencia en metros que se detectó, la juzgadora tuvo por acreditada que las casas estaban dentro de la zona marítimo terrestre tal y como se había descrito tanto en la requisitoria fiscal, como en la querella pública formulada por la Procuraduría General de la República.
Por ello, no se entiende cuál era la relevancia jurídica de la ubicación precisa de cada una de las viviendas, para efectos de la acreditación del hecho acusado, si todas ellas estaban dentro del área pública, tal y como se describió en la imputación. Por las razones expuestas se concluye que los tres argumentos dados por la juzgadora para sustentar la sentencia absolutoria dictada en favor de [Nombre6] , [Nombre7] , [Nombre5] , [Nombre4] y [Nombre1] , contiene errores que la tornan inválida y por ello, se impone declarar con lugar el segundo motivo de apelación. En consecuencia, se anula parcialmente el fallo, en lo que respecta a la sentencia absolutoria dictada en favor de los imputados [Nombre6] , [Nombre7] , [Nombre5] , [Nombre4] y [Nombre1] , para lo cual se ordena remitir los autos ante el Tribunal de Juicio para una nueva sustanciación conforme a Derecho.
IV.En el tercer motivo de apelación objeta que no se ordenara la demolición de las edificaciones construidas en la zona pública. Relata que la jueza de instancia denegó la pretensión de la Procuraduría de restituir las cosas al estado original, para lo cual argumentó que se desconocía si las edificaciones todavía estaban en el sitio, o si estas habían sido ampliadas, además de que no se citó al proceso a los terceros que residen en esas edificaciones, para que ejercieran sus derechos. Critica estos argumentos al estimar que con la prueba se acreditaba la existencia de edificaciones en el área pública de la zona marítimo terrestre, y por ello, era procedente ordenar la demolición de esas estructuras, ya que la legislación que regula esta franja marítima es clara al indicar que es prohibido construir en esa zona, e incluso, se establece a nivel legal la orden de derribo de esas edificaciones, por lo que se debió actuar en consecuencia con lo que establecía la ley.
Adicionalmente, estima que era improcedente alegar que no se citó a los terceros que habitan en ese sitio, ya que nadie puede alegar un derecho legítimo sobre dicha zona. Como pretensión general para los tres reclamos solicita se anule la sentencia y se ordene el juicio de reenvío. Con lugar el motivo. Revisada la sentencia, se tiene que la jueza denegó la solicitud de derribo con base en la siguiente argumentación: “Tanto el Ministerio Público como la representante de la Procuraduría General de la República, solicitaron que se ordenara el derribo o demolición de las edificaciones sobre las cuales versa el presente proceso. Al respecto, en consideración de este Tribunal, si bien se ha podido constatar a partir del Dictamen de Análisis Criminalístico 1496-ING-2012, que la totalidad de las edificaciones se encontraban dentro de la Zona Pública de la Zona Marítimo Terrestre, ocupando parte del Patrimonio Natural del Estado, en Tambor de Cóbano de Puntarenas, lo cierto es que luego de analizar la prueba existente en el proceso, dicha solicitud debe rechazarse.
Conforme se expuso en el anterior apartado, existe una gran imprecisión con respecto a la ubicación de cada una de las viviendas. Se cuenta con elementos de prueba que de forma dudosa, brindan datos que no coinciden en relación a la distancia que guardaban las edificaciones con respecto al muelle de Tambor, presentando diferencias significativas entre uno y otro dato. Aunado a lo anterior, han transcurrido más de seis años desde que se inició este proceso y desde que se realizaron las inspecciones oculares respectivas, siendo que ante el tiempo transcurrido sin que se pueda tener certeza respecto a quiénes son los actuales ocupantes de dichas edificaciones, si se han construido más edificaciones contiguo a la cuestionadas (lo cual se podría prestar para confusiones con respecto a cuál sería la edificación a demoler si así lo ordenara este Tribunal), si las estructuras cuestionadas han tenido mejoras o no (con lo cual podrían ser visiblemente diferentes de las fotografiadas en los informes de inspección ocular), si permanecen en el lugar o no, y ante la ausencia de prueba que permita suplir estas interrogantes y dudas, por un aspecto de seguridad jurídica y a fin de no causar afectación a terceros que no son parte de este proceso ni han tenido la oportunidad de ejercitar sus derechos en el mismo, se rechaza la solicitud de demolición o derribo, formulada por el Ministerio Público y por la Procuraduría General de la República.
La representante de la Procuraduría, en su oportunidad sustentó dicha solicitud en la existencia de contaminación y daño ambiental, no obstante, en el proceso no se recibió prueba técnica o pericial que así lo confirmara. Se contó con el dicho de don [Nombre12] , de quien no se duda que conozca del tema, sin embargo, su deposición en el contradictorio no fue en condición de perito, así como no expuso que por su parte se llevara a cabo ningún estudio el cual mediante la implementación de metodologías científicas concluyera que en el lugar se estaba presentando algún grado de contaminación por actividades humanas. Si no que la conclusión del testigo respecto al daño ambiental y a la contaminación en la zona, era fruto de una apreciación subjetiva. Así las cosas, no se ha contado tampoco con ningún elemento de prueba que venga a determinar que en efecto se haya ocasionado un daño o contaminación en la zona, y mucho menos, que los mismos fueran fruto de la actividad llevada a cabo en las edificaciones cuestionadas en el caso bajo análisis.” En este caso, los argumentos esbozados por la juzgadora se tornan contradictorios.
Como se indicó en el considerando anterior, la jueza tuvo por demostrado que existían siete edificaciones construidas en la zona pública de la zona marítimo terrestre, pero a pesar de ello denegó la gestión de la Procuraduría que pretendía el derribo de esas edificaciones, al sostener que habría confusión en cuanto a qué propiedad demoler, también indicó que existían inconsistencias entre los datos consignados en la acusación en cuanto a la ubicación de cada edificación, y las que muestra la pericia forense. Este argumento es ilegítimo por violentar el principio de razón suficiente, debido a que consta en autos que existe prueba pericial como inspecciones en el sitio que describen las diversas edificaciones, sobre las que se pidió la orden de derribo, por ello, no se comprende a qué tipo de confusión alude la juzgadora. Adicionalmente, es claro, que la pretensión del órgano estatal, iba dirigida hacia las edificaciones que fueron objeto de esta investigación, por ello, no resulta una razón válida aducir que no se puede aceptar esa petición, ya que podrían existir otras edificaciones en el sitio.
Asimismo, resulta incomprensible que se haga alusión a que en esos terrenos pueden existir otros moradores quienes no han participado del proceso, ya que ese argumento es completamente especulativo. Adicionalmente, no se explica cuál sería la situación jurídica de buena fe que legitimaría esa posesión, ya que la Ley sobre la Zona Marítimo Terrestre, establece que dicha área es propiedad del Estado y es inalienable (artículo 1). Además, se indica que la Zona Marítimo Terrestre no puede ser objeto de informaciones posesorias y los particulares no podrán apropiarse de ella (artículo 7). También se detalla que es prohibido construir edificaciones en la dicha área (artículo 12). Así como la potestad del Estado y de las Municipales de ordenar la demolición de las edificaciones que se hayan construido en dicha zona, en contravención de lo dispuesto por dicha legislación especial. Finalmente, desde vieja data, la Sala Constitucional mediante resolución Número 5756 del 30 de octubre de 1996, declaró que la aplicación de la facultad de demolición es factible en procesos jurisdiccionales pendientes, que aún no concluyen con sentencia firme, y que no es violatorio del debido proceso y del derecho de defensa del imputado, siempre y cuando se interprete que es deber del juzgador, previo a la adopción de la medida de destrucción, demolición, constatar que los terrenos o las obras involucradas se encuentran efectivamente dentro de la zona marítimo terrestre y que éstas, se realizaron al margen de lo dispuesto en la presente Ley.
Del anterior repaso normativo y jurisprudencial se concluye que la legislación prevé la demolición de las estructuras que de forma ilegal se han construido en dicha zona, por lo que, en este caso, le correspondía a la autoridad jurisdiccional resolver aquella pretensión conforme con la prueba que había sido aportada en autos. Adicionalmente, si la jueza estimó que era necesario verificar la existencia de las edificaciones previo al derribo de estas, así lo pudo ordenar en la resolución respectiva, o incluso, al amparo del artículo 355 del Código Procesal Penal, tenía la posibilidad de realizar de oficio la inspección ocular que estimare necesaria para resolver la pretensión de la Procuraduría, la cual había sido gestionada desde la interposición de la querella. En consecuencia, se declara con lugar el reclamo, se anula parcialmente la sentencia en cuanto denegó la orden de derribo gestionada por la Procuraduría. Por ende, se ordene el juicio de reenvío para una nueva sustanciación de ese otro extremo.
POR TANTO:
Se declara sin lugar el primer motivo de impugnación interpuesto por la Procuraduría General de la República. Se declaran con lugar los motivos segundo y tercero del recurso de apelación de la Procuraduría General de la República. Se anula parcialmente la sentencia en los siguientes extremos: A) Se anula la sentencia absolutoria dictada en favor de los imputados [Nombre6] , [Nombre7] , [Nombre5] , [Nombre4] y [Nombre1] , para lo cual se ordena remitir los autos ante el Tribunal de Juicio para una nueva sustanciación conforme a Derecho. B) Se anula parcialmente la sentencia en cuanto denegó la orden de derribo gestionada por la Procuraduría. Por ende, se ordene el juicio de reenvío para una nueva sustanciación de ese otro extremo. En lo no anulado en este fallo de alzada, la sentencia de instancia permanece incólume. Notifíquese.
