Appeal filed in the present proceedings brought against [Nombre1], of legal age, born on dieciocho de agosto de mil novecientos cincuenta y nueve, holder of identity card number CED1 - - , for the offenses of illegal harvesting of forest products and land-use change (cambio en el uso de la tierra), to the detriment of Los Recursos Naturales. Judges Christian Fernández Mora and Jaime Robleto Gutiérrez and Judge Ivette Carranza Cambronero participated in deciding the appeal. The accused, [Nombre1], entered an appearance on appeal by means of a filing authenticated by attorney Rodolfo Montero Pacheco.

Background:

1. By judgment 09-2018, issued at nueve horas treinta minutos on diecinueve de enero de dos mil dieciocho, the Tribunal de Juicio del Segundo Circuito Judicial de la Zona Sur, sede Osa, ruled: “POR TANTO: Pursuant to the foregoing and Articles 35, 37, 39 and 41 of the Political Constitution; Article 8, subsection 2, of the American Convention on Human Rights; Article 11 of the Universal Declaration of Human Rights; Article 14 of the International Covenant on Civil and Political Rights; Articles 1, 11, 18, 20, 30, 31, 45, 50 and 51 of the Criminal Code; Article 19 and Article 61, subsections a) and c), of Ley Forestal 7575; Articles 1, 2, 3, 6, 8, 75 through 77, 111 through 116, 142 et seq., 265, 267, 269, 324 et seq., 360, 361, 363, 364, 365 and 366 of the Code of Criminal Procedure; [Nombre1] IS ACQUITTED OF ALL PENALTIES AND LIABILITY for the offenses of VIOLATION OF LEY FORESTAL IN THE FORM OF ILLEGAL HARVESTING OF FOREST PRODUCTS AND LAND-USE CHANGE, committed to the detriment of LOS RECURSOS NATURALES. No award of costs is entered in the criminal proceedings. The civil action for damages (acción civil resarcitoria) brought by the Procuraduría General de la República against the civil defendant, [Nombre1], is dismissed. Once the judgment becomes final, the case shall be closed and removed from the docket. NOTICE SHALL BE GIVEN BY READING. FRANNIA CHAVARRÍA FLORES, JUDGE. (sic).”

2. The accused, [Nombre1], filed an appeal against the foregoing ruling.

3. After the corresponding deliberation was conducted pursuant to Article 466 of the Code of Criminal Procedure, as amended by Ley 8837 published on nueve de diciembre de dos mil once (Creation of an Appeal from the Judgment), the Court considered the issues raised in the appeal.

4. The relevant legal requirements were observed throughout the proceedings.

Considerations:

I.Because it satisfies the legal requirements, the appeal filed by the defendant, [Nombre1], is admitted for consideration on the merits, since review of the record shows that it was filed within the legally prescribed period and in accordance with the requirements for the proper and correct consideration of the appellant’s claims of error, for purposes of a comprehensive review of the challenged judgment, as established by Article 8.2h of the American Convention on Human Rights and Articles 458, 459, 460 and 462 of the Code of Criminal Procedure.

II.On 20 de noviembre de 2019, the hearing requested by the appellant was held before the same judges deciding this matter. At that hearing, attorney Rodolfo Montero Pacheco, representing the defendant, reiterated the arguments set forth in the written appeal and stated that only in a totalitarian judicial system could the demolition of the house built by the defendant be ordered without the owner of the property even having been notified. For his part, prosecutor Julián Martínez Madriz of the Fiscalía de Impugnaciones del Ministerio Público argued that this Court should affirm the challenged judgment in all respects, because there would be no point in ordering a retrial (juicio de reenvío), given that the house was built in a forest area where any type of construction is illegal, as another panel of this Tribunal de Apelaciones held in decision number 292-2014, since a construction permit could never have been granted for that location; this position was also reiterated in decision 291-2015 of this Court.

He concluded by stating that it would be pointless to hold a retrial merely to provide exactly the same grounds as those stated by the trial court. The defendant, [Nombre1], chose to exercise her right to testify and stated that the area where the house was built had never been forest and that she had devoted herself to protecting it for 35 years; that it had been pastureland and that, in fact, she had protected the forest. She stated that the cleared area was an area without forest and that she cared for the place like “the apple of her eye.”

III.In the sole ground for appeal, the appellant alleges deficient analytical and intellectual reasoning, which led the court to make an excessive, disproportionate, and chiefly arbitrary decision that infringes fundamental rights. The available evidence was not analyzed, nor was any record made of the respects in which the evidence was coherent or incoherent, or of the consistency or inconsistency, truthfulness or falsity of the witnesses and the remaining evidence. Specifically, there are two defects or errors arising from the foregoing: A. The court did not properly assess the evidence, because ever since Mr. [Nombre2] acquired property registration [Placa1] of the Puntarenas Registry District in 2003, the nature of the property has remained unchanged: land containing cabins and scrubland, since cabins had already been built there at that time. At that time, there was no notation or restriction whatsoever indicating that the land was classified as forest.

According to the registry certification appearing at page 438 of the principal case file, the land measures 5.799 square meters and is privately owned, with no notations or encumbrances of any kind; it is therefore clear that it is not located in an area previously classified as environmentally protected, except with respect to compliance with the setback lines required because of the streams located there, which were duly observed in accordance with the plan duly approved (Cadastre P-743355-2001) by the Instituto Nacional de Vivienda y Urbanismo, appearing at page 448 of the principal case file. It was precisely this fact that allowed construction of the house to continue until completion, because the Municipalidad de Osa had found that requirement lacking. She states that when, in her capacity as her husband’s special attorney-in-fact, she applied for construction permits from the Municipalidad de Osa, no official warned of any irregularity arising from a forest classification; instead, they allowed the construction at issue.

On one occasion, they even shut down the work because the setback approval issued by INVU had not been submitted, but once that requirement was met, construction was allowed to continue. She states that the witness [Nombre3] indicated that, when he inspected the site, there were signs that it formed part of a forest block, and that he therefore sent a second group of officials who inventoried the standing and felled trees in order to determine its extent using a georeferenced map. This witness stated that many owners do not know that they have a forest and that, had the officials gone to the site, they would have said that another type of permit was required. This account was corroborated by the witness [Nombre4], who said that the second group was the one that determined that the area was a forest. How, then, could the accused have known that there was a forest within her property whose land use had been changed?

She points out that neither she nor her husband had any way of knowing that the land at issue was a forest. She criticizes the fact that, although she was acquitted of both criminal and civil liability, the court ordered the demolition of the house, which had been built with all municipal permits, thereby exceeding its authority because the land had never been classified as forest, a status that remained unchanged even ten years later. B. As a result of its deficient and biased analysis of the evidence, the court made the serious error of using a technical opinion issued after the events to interpret and apply a provision retroactively and arbitrarily. Although it is clear that citizens have a fundamental right to enjoy a healthy and ecologically balanced environment and that acquired rights cannot be asserted in areas previously designated in accordance with the law, that is not the case here, because her husband acquired the property without any notation, encumbrance, or restriction indicating that it was a forest.

In early 2008, he decided to build a small house and therefore granted her a special power of attorney to process the permits before the Municipalidad de Osa. When the work was 50 complete, several MINAET officials arrived to request the construction permits and, after confirming that they existed, stated that the land constituted a forest; however, they did not order the suspension of the work or give notice of any precautionary measure (medida cautelar). After construction was completed, she was summoned to the Prosecutor’s Office, where she was informed that criminal proceedings had been instituted against her for violations of the Ley Forestal. From the time of her preliminary examination (indagatoria), she stated that the property was not hers but was registered in another person’s name, and that a mere subsequent technical opinion did not constitute a limitation on her husband’s private property.

She alleges a defective procedural act (actividad procesal defectuosa) because the house was ordered demolished without her husband, [Nombre2], having an opportunity to defend himself, challenge the SINAC technical reports, or make any submissions whatsoever in the proceedings. She states that the court below (a quo) overlooks the fact that, regardless of the public interest involved, it is ordering a house demolished without even first ordering an administrative proceeding. She requests that the claim of defective procedural activity be granted and that the a quo’s order concerning the demolition of the dwelling owned by Mr. [Nombre2] be declared absolutely null and void. The appeal is granted: In the view of the majority of this Chamber, the decision ordering the demolition of the dwelling built on property registration [Placa1] of the Puntarenas Registry District not only lacks adequate reasoning, but, given the particular circumstances of the case, the trial judge did not even have jurisdiction to address the matter.

Regarding the first of the foregoing statements, it must be noted that the trial did in fact establish that there was no way to determine that the accused knew that the dwelling was being built in a forest area in which she should first have requested an environmental impact study (estudio de impacto ambiental) or permits from the Ministerio del Ambiente y Energía to undertake the construction, to the extent that the Municipalidad de Osa itself had authorized all permits necessary for the construction (see page 56 of volume I of the principal case file). As the appellant notes, the property on which the structure was erected was not subject in the registry to any limitation or restriction on construction. Rather, as shown at page 438 of volume II of the principal case file, the Registro Nacional identifies the nature of the property as “cabins and scrubland” and nowhere indicates that it is a forest area.

Furthermore, the property at issue measured 5.799 square meters and therefore did not contain an area meeting the requirements established by article 3 of the Ley Forestal to constitute a forest area (a forest ecosystem with an area of two or more hectares, characterized by the presence of mature trees of different ages, species, and sizes, with one or more canopies covering more than seventy percent (70%) of that area, and containing more than sixty trees per hectare with diameters of fifteen or more centimeters measured at breast height), such that she should have suspected that she was in a forest area where she was required to apply for a permit for land-use change (cambio de uso del suelo). It was only after the municipal construction permits had been issued and the dwelling was well advanced that MINAET forestry engineers appeared at the site and maintained that the area constituted a forest because it had a density of 342,9 trees per hectare.

However, the environmental-damage expert report (peritaje del daño ambiental) offered as evidence in support of the civil action for damages (acción civil resarcitoria) itself states that the area does not meet all the statutory requirements to constitute a forest (see page 153 of the case file), which could explain why the Municipalidad de Osa did not require the accused or Mr. [Nombre2] to submit a permit from the Forestry Administration (Administración Forestal) and an environmental impact study from the Secretaría Técnica Ambiental (SETENA). In light of the foregoing, it is apparent that the construction was erected in accordance with the law. Accordingly, if the State seeks to demolish the dwelling at issue, it must first issue a declaration that the administrative act granting the dwelling’s construction permit is harmful to the public interest (lesividad), as provided by article 34 of the Código Procesal Contencioso Administrativo, which states: ARTICLE 34.-

  • 1)When the Administration itself, as the issuer of an act declaring rights, seeks to bring an action for its annulment before the Contentious-Administrative Jurisdiction (Jurisdicción Contencioso-Administrativa), the highest hierarchical authority must first declare it harmful to public, economic, or other interests. The maximum period for doing so shall be one year, calculated from the day following the date on which the act was issued, except where the act contains defects causing absolute nullity (nulidad absoluta), in which case that declaration may be made for as long as its effects continue. In the latter situation, the one-year period shall run from the time its effects cease, and the judgment declaring nullity shall do so solely for purposes of its annulment and future inapplicability.
  • 2)A declaration of harm concerning the protection of public-domain property shall not be subject to any time limit.
  • 3)The Consejo de Gobierno shall be responsible for declaring harmful those administrative acts issued by two or more ministries, or by such ministries together with a decentralized entity. In such cases, they may not be declared harmful by a minister from a different portfolio.
  • 4)A declaration that acts issued by administrative bodies possessing instrumental legal personality are harmful shall be made by the highest hierarchical authority.
  • 5)A claim seeking a declaration of harm (pretensión de lesividad) may not be brought by way of counterclaim.” As can be seen, the judicial bodies with jurisdiction to adjudicate the legality of the State’s administrative functions are none other than the courts of the Jurisdicción Contencioso-Administrativa, not the criminal courts, as established by article 49 of the Constitución Política. That is why criminal proceedings are not the proper forum for adjudicating the matter, nor does the criminal judge have jurisdiction to decide the issue of demolishing the dwelling at issue. It is precisely because the construction is protected by administrative acts that have not been declared invalid or unlawful by the judicial authority constitutionally empowered to do so that the precedents of this Tribunal cited by the representative of the Ministerio Público during the hearing held before this Chamber are inapplicable here. This is not a case in which it was determined that the structures were built unlawfully, but rather one involving private property subject to no restriction or encumbrance affecting the property right, where it was not evident that the area was a forest. The Tribunal Contencioso Administrativo, Sección Primera, ruled in similar terms in Decision No. 385-2006, at ten twenty a.m. on September sixth, two thousand six, stating: “III.- In the case at bar (sub-lite), it is evident that the establishment known as “El Barrilito” operates as a restaurant, bar, and nightclub under a tacit permit that legitimized the use and exploitation of a specified space within the public area of the maritime-terrestrial zone.

Consequently, if, in the Municipality’s judgment, there is a serious discrepancy between the content of the aforementioned decision and the public interest as a result of a new weighing of the factual circumstances or factual background (grounds)—determined primarily by the criminal judgment referenced above—or of the public interest involved, it must institute ordinary administrative proceedings (procedimiento administrativo ordinario)—sufficiently guaranteeing adversarial proceedings (contradictorio), due process (debido proceso), and the right of defense (defensa)—to revoke the tacit use permit (permiso de uso tácito) granted to [Dirección1]. Likewise, because property rights (derechos patrimoniales) are involved—the investment in the construction, the business location, and the customer base—the territorial authority must obtain an opinion from the Contraloría General de la República and, where appropriate, the final act issued must include recognition and, if possible, a calculation of the corresponding compensation.

The respondent Municipality may not purport to enforce a criminal judgment directly, immediately, and without warning, because criminal proceedings do not fully address or adjudicate whether a public administration’s exercise of its revocation authority (potestad revocatoria) is lawful. A Criminal Judge lacks jurisdiction to review the legality of the administrative function; that jurisdiction was assigned exclusively by a constitutional provision (constitutional reservation (reserva de constitución))—Article 49—to the Administrative Litigation Judge. In this regard, it should be added that any public administration may protect or defend the public domain (dominio público) through direct action (vías de hecho) when an administered party (administrado) enters it to use and exploit it through the same means. It follows that when an administered party uses the public domain through legal means—e.g., a tacit permit—the party may be excluded from its use only through means of the same nature, that is, through administrative proceedings in which the regularity and legality of the exercise of the revocation authority are guaranteed.

Furthermore, Article 13 of the Ley de la Zona Marítimo Terrestre must be interpreted systematically in conjunction with the rest of the legal system and in conformity with Constitutional Law (Derecho de la Constitución). That provision does indeed authorize any authority within the jurisdiction and the municipalities to evict persons who violate that law and to destroy or demolish the structures, alterations, and installations they have made, without incurring any liability. It should be noted that Article 13 itself refers to a preliminary inquiry (información previa) conducted for that purpose—which is nothing more than an administrative proceeding—“if deemed necessary.” That necessity is determined by whether the occupation is lawful or unlawful, such that—as stated supra—if the administered party entered through direct action, that party may be excluded and expelled in the same manner; but if the party is supported by a permit issued by the municipal administration itself, even if tacit, proceedings or a preliminary inquiry must inevitably be initiated.

In the latter situation—which is the one under examination (sub-examine)—the administered party is protected by the principle of legitimate expectations (principio de la confianza legítima) in the administration, because the administration previously issued acts or took actions that support the party’s conduct and on which the party relied. In this case, the appellant’s legitimate expectations were created by official letter No. UR-101, dated April 20, 1990, from the Directora de Urbanismo, in which she stated to the prior possessor or permit holder—[Nombre5]—that the structure he intended to build was located within the “Zoning of the Regulatory Plan for the western sector of Esterillos as commercial use. Therefore, the urban use as a restaurant and bar is consistent with what the Regulatory Plan proposes for that sector,” as well as by the occasions on which the Municipality accepted money from him for “occupancy rights” and “rental of land in the maritime-terrestrial zone.” An administered party who has legitimately relied on the public administration when it permitted the party to take a particular action must be guaranteed, at a minimum, proceedings in which there is a full examination of the new assessment of the factual and legal circumstances requiring the revocation of a prior and valid administrative act (acto administrativo).

This Court makes clear that it does not question the authority of every public administration to defend the public domain by virtue of its immunity from acquisitive prescription (imprescriptible) and inalienability (inalienable), or the inherent, implicit, or fundamental authority of every administration to revoke its own acts for reasons of expediency, appropriateness, or merit. Nevertheless, the legal system does prescribe clear and specific procedural channels for public administrations to guarantee the regularity and legitimacy of the exercise of such authority and the rights and legitimate interests of the administered parties to whom it is directed, under penalty of nullity of the act issued.” (Emphasis supplied). It follows from the foregoing that only after the State has declared the act granting the municipal construction permit adverse to the public interest (lesivo) could it consider whether demolition is warranted, since it is even possible that the defect could be cured (convalidarse) and the forestry permit granted, because the accused lacked an environmental impact study (estudio de impacto ambiental), which might be granted to her, thereby eliminating the need to demolish the dwelling.

In this case, given the criminal courts’ lack of jurisdiction to address the legality of the administrative function, it would be unnecessary to order a remand trial (juicio de reenvío) to hear the matter again; instead, the competent authorities must institute proceedings at the administrative level and comply with due process so that the registered owner (propietario registral) may properly exercise her right of defense. Accordingly, the appeal against the criminal judgment filed by the accused, [Nombre1], is granted. The judgment under appeal is partially reversed, and the order to demolish the dwelling built on the property registered in the Partido de Puntarenas under record [Placa1], between boundary markers 26-27-28 and described in survey plan P-0743355-2001, is hereby vacated. In all other respects, the judgment remains undisturbed. Judge Robleto Gutiérrez dissents.

IV.Judge Robleto Gutiérrez dissents for the following reasons: I.- Background: Ms. Natalia Hidalgo Porras, Appeals Prosecutor, filed an appeal in cassation (recurso de casación) against judgment number 2018-283 of 13:30 hours on June 8, 2018, issued by the Criminal Judgment Appeals Court of Cartago, which granted the appeal filed by private defense counsel, declaring ineffective the judgment under appeal insofar as it ordered the demolition of the dwelling built on the property registered in the Puntarenas Registry under record [Placa1], between boundary markers 26-27-28, described in survey plan P-0743355-2001, but without ordering the corresponding remand (reenvío) for renewed consideration of this issue, instead ruling that the demolition must be addressed by the Administration in the appropriate administrative and judicial forums and through the corresponding procedures. By ruling 2019-00119 of 10:08 hours on February 8, 2019, the Third Chamber of the Supreme Court of Justice admitted the sole ground of the appeal in cassation filed by the representative of the Public Prosecutor’s Office, alleging failure to observe a procedural legal provision, specifically that established in section 142 ibid. She argues that the challenged judgment provides no reasoning for the decision not to order the corresponding remand proceeding and, instead, requires the Administration to pursue another avenue to address the demolition of the dwelling, thereby denying the prosecution this possibility.

The merits of the duly admitted prosecution appeal were decided by ruling number 2019-01117 of 10:14 hours on September 13, 2019, by the same Criminal Cassation Chamber, which ruled, insofar as relevant: “Por Tanto: The appeal in cassation filed by prosecutor Natalia Hidalgo Porras is granted. Consequently, judgment N°2018 - 283, issued by the Criminal Judgment Appeals Court of Cartago at 13:30 hours on June 8, 2018, is partially vacated. The matter is remanded to that Court so that a differently constituted panel may decide whether the demolition of the dwelling built within the protected area may be ordered in the criminal proceedings or, alternatively, through a different avenue, with proper reasoning. Notice shall be given.” [sic]. II.- From the foregoing, it is clear that the purpose of the remand to this Chamber is not to reconsider the criminal acquittal of [Nombre6], which is final, but rather a specific aspect of ruling number 2018-283 of 13:30 hours on June 8, 2018, issued by the Criminal Judgment Appeals Court of Cartago, that was partially vacated.

The Third Chamber of the Supreme Court of Justice determined that the aforementioned judgment was partially vacated because: “the ruling issued lacks proper reasoning concerning the impossibility of ordering a remand so that the request for demolition of the structures, sought by the civil claimant and the Public Prosecutor’s Office, could be decided; consequently, the Appeals Court breached its duty to state the legal grounds and reasons for the ruling at issue in accordance with our legal system. Since the reasoning requirements established in sections 142 and 184 of the Code of Criminal Procedure are mandatory for the Appeals Courts, in this case they required it to issue a final decision not only on the legal position of the affected third party but also on the alteration sustained by the protected area, which called for more than merely referring the matter to a forum other than the criminal courts.” [sic], (see folio 187 of the electronic case file).

III.- Concerning the subject matter for decision (thema decidendum) on remand: the crux, (essence or key point), of the matter to be decided is whether the building constructed on the property registered in the Puntarenas Registry under record [Placa1], corresponding to cadastral plan (plano catastrado) P-743355-2001 and endorsed by the INVU, which apparently allowed construction of the dwelling through completion, must be demolished as ordered by the trial court or not. It is a fact that the registered owner of the property—namely, [Nombre6]’s husband, [Nombre2], who acquired that property on April 3, 2003—was not joined in the proceedings. These facts as such are not disputed by the parties. The 120-square-meter house is located in Bahía Ballena de Osa. Indeed, the trial judge ruled: “...The Municipalidad de Osa is ordered to demolish the structure located on the property registered in the Puntarenas Registry, Bahía Ballena sector, at boundary markers 26L27-28, described in plan P-0743355-2001 and registered in the name of [Nombre2]; the registry certification at folios 437 and 438 establishes that this property corresponds to plan P-0743355-2001, which the defendant herself acknowledged as belonging to her husband, [Nombre2], and herself.

There is therefore no confusion that this is the property on which the ten trees were cut and the dwelling was built. Now, based on Articles 103 of the Criminal Code and 140 of the Code of Criminal Procedure, and Article 50 of the Political Constitution, although it has been shown that the property’s registered owner is [Nombre2], husband of [Nombre1], Costa Rica recognizes the fundamental right to a healthy and ecologically balanced environment, and protection of that right entails restrictions on the right of property, as well as on certain rights derived from or related to it. In this case, we are addressing land with forest cover (cobertura de bosque), for which the prohibitions against land-use change (cambio en el uso de la tierra) without authorization from MINAE are well known. Based on the foregoing, as established at trial, the construction carried out within the property registered to [Nombre2] has no authorization whatsoever and is therefore unlawful; since the consequence of this unlawfulness is demolition, because the construction does not comply with the law.” (folio 483). [sic] (see folio 143 of the electronic case file).

What ruling number 2019-01117 of 10:14 hours on September 13, 2019, of the Third Chamber of the Supreme Court of Justice criticized in judgment 2018-283 of 13:30 hours on June 8, 2018, of the Cartago Appeals Court, which had reversed the decision to demolish the dwelling, was that the Appeals Court failed to explain why it did not remand the case for the court of origin to decide whether demolition of the dwelling was appropriate. Instead, after finding that due process had been violated because the registered owner of the property, [Nombre2], had not been summoned, it deprived the Public Prosecutor’s Office and the civil claimant of the procedural opportunity to litigate that issue in adversarial proceedings (contradictorio), because, without stating its reasons, it referred the dispute to the appropriate forum on the ground that [Nombre2]’s participation in a remand proceeding would not “permit the full exercise of his rights” (see folio 147 of the electronic case file).

This judge disagrees with the position of the respected judges in the majority opinion for the following reasons: a) we consider that no reasoned decision on whether to order demolition of the building at issue can be made without adversarial proceedings concerning that issue, with all parties present so that they may examine and cross-examine regarding all admitted evidence; b) the decision made by the court below (a quo) is subject to the system of appeals exhaustively prescribed by criminal procedure, so that no party is deprived of the procedural opportunity to exercise its right to appeal; c) a determination on the merits as to whether demolition of the dwelling is appropriate can arise only from applying the principles of immediacy (inmediatez) and adversarial process afforded by the trial, and it is therefore a decision for the trial judge, who must summon all interested parties and decide the issue.

Consequently, no ruling on the merits concerning demolition of the building is issued; that decision shall be made by the court on remand. The ruling issued by the a quo in judgment number 09-2018 of 9:30 hours on January 19, 2018, delivered by the Court of the Second Judicial Circuit of the Southern Zone, Osa, is partially vacated insofar as it orders the Municipalidad de Osa to demolish the structure located on the property registered in the Puntarenas Registry, Bahía Ballena sector, between boundary markers 26-27-28, described in plan P-0743355-2001 and registered in the name of [Nombre2]. In all other respects, the judgment remains undisturbed.

POR TANTO

By majority vote, the appeal against the criminal judgment filed by defendant [Nombre1] is granted. The judgment under appeal is partially reversed, and the order to demolish the dwelling built on the property registered in the Puntarenas Registry under record [Placa1], between boundary markers 26-27-28, described in plan P-0743355-2001, is hereby set aside. In all other respects, the judgment remains undisturbed. Judge Robleto Gutiérrez dissents. Notice shall be given. Recurso de apelación interpuesto en la presente causa seguida contra [Nombre1] , mayor, nacida el dieciocho de agosto de mil novecientos cincuenta y nueve, con cédula de identidad número CED1 - - , por los delitos de Aprovechamiento ilegal de productos forestales y Cambio en el uso de la tierra, en perjuicio de Los Recursos Naturales. Intervienen en la decisión del recurso los jueces Christian Fernández Mora y Jaime Robleto Gutiérrez y la jueza Ivette Carranza Cambronero. Se apersonó en apelación la encartada [Nombre1] , mediante escrito autenticado por el licenciado Rodolfo Montero Pacheco.

Resultando:

1. Que mediante sentencia 09-2018 de las nueve horas treinta minutos del diecinueve de enero de dos mil dieciocho, el Tribunal de Juicio del Segundo Circuito Judicial de la Zona Sur, sede Osa, resolvió: "POR TANTO: De conformidad con lo expuesto y artículos 35, 37, 39 y 41 de la Constitución Política; 8 inciso 2 de la Convención Americana sobre Derechos Humanos; 11 de la Declaración Universal de Derechos Humanos; 14 del Pacto Internacional de Derechos Civiles y Políticos, 1, 11, 18, 20, 30, 31, 45, 50, 51 del Código Penal, artículo 19, 61 inciso a) y c) de la Ley Forestal 7575, artículos 1, 2, 3, 6, 8, 75 al 77, 111 al 116, 142 y siguientes, 265, 267, 269, 324 y siguientes, 360, 361, 363, 364, 365, 366 del Código Procesal Penal; SE ABSUELVE DE TODA PENA Y RESPONSABILIDAD a [Nombre1] por los delitos de INFRACCIÓN A LA LEY FORESTAL EN LA MODALIDAD DE APROVECHAMIENTO ILEGAL DE PRODUCTOS FORESTALES Y CAMBIO EN EL USO DE LA TIERRA, coMetido en perjuicio de LOS RECURSOS NATURALES. Se resuelve sin condenatoria en costas en lo penal. Se declara sin lugar acción civil resarcitoria incoada por la Procuraduría General de la República en contra de la demandada civil [Nombre1] . Se exime del pago de las costas a la actora civil por haber litigado de buena fe. Se ordena la demolición por parte de la Municipalidad de Osa de la construcción ubicada en la propiedad del partido de Puntarenas, sector de Bahía Ballena; en los mojones 26-27-28, y que se encuentra descrita en el plano P-0743355-2001 perteneciente registralmente a [Nombre2] . Firme el fallo, archívese y cancélese del libro de entradas. POR LECTURA NOTIFÍQUESE. FRANNIA CHAVARRÍA FLORES, JUEZA. (sic)."

2. Que contra el anterior pronunciamiento, la endilgada [Nombre1] interpuso el recurso de apelación.

3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 466 del Código Procesal Penal, reformado por Ley 8837 publicada el nueve de diciembre de dos mil once (Creación de Recurso de Apelación de la Sentencia), el Tribunal se planteó las cuestiones formuladas en el recurso.

4. Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el Juez Fernández Mora, y;

Considerando:

I.Por cumplir con los requisitos legales, se admite para su estudio de fondo el recurso incoado por la imputada [Nombre1] , pues del estudio del sumario se colige que dicho recurso se presentó en tiempo, conforme al plazo de ley, y de acuerdo a los presupuestos que se requieren para el adecuado y correcto conocimiento de las inconformidades planteadas por el recurrente, en orden al examen integral de la sentencia impugnada, tal y como lo establece el artículo 8.2h de la Convención Americana sobre Derechos Humanos, y los artículos 458, 459, 460 y 462 del Código Procesal Penal.

II.El pasado 20 de noviembre de 2019, se llevó a cabo ante los mismos jueces que aquí resuelven la audiencia solicitada por la recurrente, oportunidad en la que el abogado Rodolfo Montero Pacheco, en representación de la imputada reiteró los argumentos plasmados en el recurso planteado por escrito y señaló que solo en un sistema judicial totalitario se podría ordenar el derribo de la vivienda construida por la imputada sin siquiera haberle notificado al propietario de la finca. Por su parte, el fiscal de la Fiscalía de Impugnaciones del Ministerio Público, Julián Martínez Madriz, consideró que este Tribunal debía mantener la sentencia impugnada en todos sus extremos, puesto que no tendría sentido ordenar un juicio de reenvío porque la construcción de la vivienda se hizo en una zona de bosque, en donde es ilegal cualquier tipo de construcción, tal como lo ha indicado otra integración de este Tribunal de Apelaciones en el voto número 292-2014, pues nunca se podría haber brindado una autorización para construcción en ese sitio y esta posición también fue reiterada en el voto 291-2015 de este Tribunal.

Finalizó señalando que resultaba ocioso realizar un juicio de reenvío para fundamentar exactamente lo mismo que se resolvió en primera instancia. Por su parte, la imputada [Nombre1] , decidió hacer uso de su derecho de declarar y manifestó que el área donde se construyó la vivienda nunca fue bosque y que desde hace 35 años ella se ha dedicado a protegerla, que esa era una zona de potrero y más bien el bosque ella lo ha protegido. Indicó que lo que se cortó fue un área que no tenía bosque y que el lugar lo cuida como “la niña de sus ojos”.

III.En el único motivo de impugnación, la recurrente alega la fundamentación analítica e intelectiva deficiente, llevándolo a tomar una decisión excesiva, desproporcionada y principalmente arbitraria, que transgrede derechos fundamentales. No se analizan los elementos de juicio con que se cuenta ni se deja constancia de los aspectos en que consistió la coherencia o incoherencia de la prueba, ni de la consistencia o inconsistencia, veracidad o falsedad de los testigos y el resto de la prueba. En concreto, existen dos vicios o errores derivados de lo anterior: A. El tribunal no valoró correctamente la prueba, pues desde que en el año 2003 el señor [Nombre2] adquirió la finca matrícula [Placa1] del Partido de Puntarenas, la naturaleza de la propiedad se ha mantenido incólume: terreno de cabañas y charral, pues desde ese momento existían cabañas construidas. Desde ese momento no existía anotación o restricción alguna que indicara que se trataba de un terreno catalogado como bosque.

Según la certificación registral, visible a folio 438 del expediente principal, se trata de un terreno de 5.799 metros cuadrados y es una propiedad privada, sin anotaciones o afectaciones de ningún tipo, por lo que es claro que no se encuentra en un área que previamente haya sido catalogada como de protección ambiental, salvo en lo que se refiere al cumplimiento de los alineamientos que debían guardarse por las quebradas que ahí existen, lo cual se cumplió debidamente, de acuerdo al plano debidamente visado (Catastro P-743355-2001) por el Instituto Nacional de Vivienda y Urbanismo, visible a folio 448 del expediente principal. Fue precisamente este hecho lo que permitió continuar con la construcción de la casa hasta su terminación, ya que la Municipalidad de Osa echaba de menos ese requisito. Indica que al momento de solicitar los permisos de construcción en su condición de apoderada especial de su esposo ante la Municipalidad de Osa, ningún funcionario advirtió ninguna irregularidad por alguna clasificación de bosque, sino que permitieron la construcción en cuestión.

Incluso en una ocasión clausuraron las obras por no haberse aportado el alineamiento aprobado por el INVU, pero una vez cumplido se permitió continuar la construcción. Refiere que el testigo [Nombre3] indicó que cuando inspección el sitio había indicios de que el lugar era parte de un bloque de bosque, por eso envió un segundo grupo de funcionarios que realizaron el inventario de árboles en pie y cortados, para determinar con un mapa georreferenciado su extensión. Este testigo indica que muchos propietarios no saben que tiene un bosque y que los funcionarios hubiera llegado al sitio y hubieran dicho que procedía otro tipo de permiso. Esta versión fue corroborada por el testigo [Nombre4] , quien dijo que el segundo grupo fue el que determinó que se trataba de un bosque. Entonces cómo podía saber la imputada que dentro de su propiedad existía un bosque al que se le cambió el uso de la tierra.

Señala que tanto ella como su esposo nunca tuvieron posibilidad de saber que el terreno en cuestión se trataba de un bosque. Fustiga que a pesar de que se le absolvió en lo penal y en lo civil, se ordenó la demolición de la casa construida con todos los permisos municipales, excediendo sus competencias el tribunal porque ese terreno nunca fue calificado como bosque, lo que se mantiene incluso diez años después. B. Producto del deficiente y sesgado análisis de los elementos probatorios, el tribunal cometió el enorme yerro de utilizar un criterio técnico emitido con posterioridad a los hechos para interpretar y aplicar una norma de manera retroactiva y arbitraria, pues aunque está clara que existe una derecho fundamental de los ciudadanos de gozar de un ambiente sano y ecológicamente equilibrado y que en las áreas determinadas previamente y de acuerdo con la ley, no se pueden alegar derechos adquiridos, este no es el presente caso porque su esposo adquirió la finca sin anotación, gravamen o restricción alguna que señalara que era un bosque y a inicios del año 2008 decidió construir una pequeña casa, por lo que le otorgó un poder especial para tramitar los permisos ante la Municipalidad de Osa.

Cuando la obra se encuentra con un avance del 50 se presentaron varios funcionarios del MINAET a solicitar los permisos de construcción y al corroborar que existían indicaron que el terreno constituía un bosque, pero no ordenaron la suspensión de la obra ni notificaron ninguna medida cautelar. Posteriormente a la finalización de la construcción se le citó a la fiscalía donde se le informó que existía una causa penal en su contra por infracciones a la Ley Forestal. Desde su indagatoria informó que la propiedad no era suya que se encontraba a nombre de otra persona y el simple criterio técnico posterior no constituye una limitación a la propiedad privada de su esposo. Plantea una actividad procesal defectuosa porque se ordenó demoler la casa sin que su esposo [Nombre2] tuviera oportunidad de defenderse, de oponer cuestionamientos a los informes técnicos del SINAC, y de manifestarse de forma alguna en el proceso.

Señala que el a quo olvida que por más interés público que exista, se está ordenando demoler una casa sin ordenar siquiera un proceso administrativo previo a la demolición. Solicita que se declare con lugar la actividad procesal defectuosa y se declare absolutamente nula la disposición del a quo en relación con la demolición de la vivienda, propiedad del señor [Nombre2] . El recurso se declara con lugar: Para la mayoría de esta Cámara, la decisión que ordenó la demolición de la vivienda construida en la finca del Partido de Puntarenas matrícula [Placa1] no solo carece de la debida fundamentación, sino que por las particularidades del caso, ni siquiera la juzgadora de mérito tenía competencia alguna para referirse al tema. En cuanto a la primera de las afirmaciones antes realizadas, debe señalarse que ciertamente durante el debate se logró determinar que no había forma para establecer que la imputada conocía que la vivienda se estaba construyendo en una zona de bosque en la que tuviese que haber solicitado previamente un estudio de impacto ambiental o los permisos al Ministerio del Ambiente y Energía para realizar la construcción, al punto de que la propia Municipalidad de Osa había autorizado todos los permisos para realizar la construcción (ver folio 56 del tomo I del expediente principal).

Tal como lo señala la recurrente, la propiedad donde se levantó la construcción no se encontraba afectada registralmente por ningún tipo de limitación o restricción para construir, sino que tal como se observa a folio 438 del tomo II del expediente principal, en el Registro Nacional se establece que la naturaleza de la finca es de “cabañas y charral” y no indica en ningún momento que se trate de una zona de bosque. Por otra parte, el área de la finca en cuestión tenía una medida de 5.799 metros cuadrados, por lo que tampoco albergaba un área que cumpliera con los requisitos establecidos por el artículo 3 de la Ley Forestal para constituir un área de bosque ( ecosistema boscoso con una superficie de dos o más hectáreas, caracterizada por la presencia de árboles maduros de diferentes edades, especies y porte variado, con uno o más doseles que cubran más del setenta por ciento (70%) de esa superficie y donde existan más de sesenta árboles por hectárea de quince o más centímetros de diámetro medido a la altura del pecho), como para que sospechara que se encontraba en un área de bosque en la que tuviera que solicitar un permiso para el cambio de uso del suelo.

Es con posterioridad a que se otorgan los permisos municipales para construir y que la vivienda está muy avanzada, que los ingenieros forestales del MINAET se presentaron en el lugar y sostienen que la zona constituye un bosque por la densidad de 342,9 árboles por hectárea. Sin embargo, el propio peritaje del daño ambiental que se ofrece como prueba para sustentar la acción civil resarcitoria, indica que la zona no cumple con todos los requisitos de ley para ser un bosque (ver folio 153 del expediente), lo que podría explicar la razón de por qué la Municipalidad de Osa no requirió a la imputada o al señor [Nombre2] que aportara el permiso a la Administración Forestal y el estudio de impacto ambiental de la Secretaría Técnica Ambiental (SETENA). De acuerdo con el anterior panorama, se observa que la construcción se levantó conforme a derecho, razón por la que si el Estado pretende demoler la vivienda en cuestión, primero debe declarar la lesividad del acto administrativo que otorgó el permiso de construcción de la vivienda, según lo dispone el artículo 34 del Código Procesal Contencioso Administrativo, que dispone: ARTÍCULO 34.-

  • 1)Cuando la propia Administración, autora de algún acto declarativo de derechos, pretenda demandar su anulación ante la Jurisdicción Contencioso-Administrativa, previamente el superior jerárquico supremo deberá declararlo lesivo a los intereses públicos, económicos o de cualquier otra naturaleza. El plazo máximo para ello será de un año, contado a partir del día siguiente a aquel en que haya sido dictado, salvo si el acto contiene vicios de nulidad absoluta, en cuyo caso, dicha declaratoria podrá hacerse mientras perduren sus efectos. En este último supuesto, el plazo de un año correrá a partir de que cesen sus efectos y la sentencia que declare la nulidad lo hará, únicamente, para fines de su anulación e inaplicabilidad futura.
  • 2)La lesividad referente a la tutela de bienes del dominio público no estará sujeta a plazo.
  • 3)Corresponderá al Consejo de Gobierno la declaratoria de lesividad de los actos administrativos dictados por dos o más ministerios, o por estos con algún ente descentralizado. En tales supuestos, no podrán ser declarados lesivos por un ministro de distinto ramo.
  • 4)La declaratoria de lesividad de los actos dictados por órganos administrativos con personalidad jurídica instrumental, será emitida por el superior jerárquico supremo.
  • 5)La pretensión de lesividad no podrá deducirse por la vía de la contrademanda”. Como se observa, los órganos jurisdiccionales competentes para discutir el tema de la legalidad de la función administrativa del Estado no son otros que los tribunales de la Jurisdicción Contencioso-Administrativa y no los tribunales penales, tal como lo establece el artículo 49 de la Constitución Política. Esa es la razón por la que el proceso penal no es el adecuado para discutir el tema, ni el juez penal el competente para resolver el tema del derribo de la vivienda en cuestión. Precisamente por encontrarse la construcción amparada en actos administrativos que no han sido declarados inválidos o ilegales por la autoridad jurisdiccional que por disposición constitucional correspondería hacerlo es que no resultan de aplicación en este caso los precedentes de este Tribunal que citó el representante del Ministerio Público durante su participación en la audiencia llevada a cabo ante esta Cámara, pues no se trata de asuntos en los que se haya determinado que las construcciones se hayan realizado al margen de la legalidad, sino precisamente en una propiedad privada sin ningún tipo de restricción o afectación al derecho de propiedad y sin que fuera evidente conocer que se estaba en presencia de una zona de bosque. En términos similares a los que aquí se señala ha resuelto el Tribunal Contencioso Administrativo, Sección Primera, en la resolución No. 385-2006, de las diez horas con veinte minutos del seis de setiembre de dos mil seis, en donde indicó: “III.- En el sub-lite, es evidente que el referido establecimiento denominado “El Barrilito” funciona como restaurante, bar y discoteca bajo el amparo de un permiso tácito que legitimó el uso de un espacio determinado del área pública de la zona marítimo terrestre y su explotación. Consecuentemente, si a juicio del Ayuntamiento existe una discordancia grave entre el contenido del acuerdo referido y el interés público por una nueva ponderación de las circunstancias de hecho o antecedentes fácticos (motivo) –determinada, básicamente, por la sentencia penal a que se ha hecho referencia- o del interés público involucrado, debe incoar un procedimiento administrativo ordinario –que garantice suficientemente el contradictorio, el debido proceso y la defensa- para la revocación del permiso de uso tácito otorgado a [Dirección1] . De igual forma, al existir derechos patrimoniales de por medio –inversión en la construcción, el punto comercial y la clientela- la corporación territorial debe recabar el dictamen de la Contraloría General de la República y, si es el caso, el acto final vertido debe contener un reconocimiento y, de ser posible, el cálculo de la indemnización respectiva. No puede pretender la Municipalidad recurrida ejecutar de forma directa, inmediata e intempestiva una sentencia penal, puesto que, en los procesos penales no se discute o debate ampliamente sobre la regularidad o no del ejercicio de la potestad revocatoria por parte de una administración pública. El Juez Penal no tiene competencia para revisar la legalidad de la función administrativa, esa competencia le fue atribuida de forma exclusiva y excluyente por norma constitucional (reserva de constitución) –artículo 49- al Juez Contencioso Administrativo. Al respecto, conviene agregar que cualquier administración pública puede proteger o defender el dominio público por las vías de hecho cuando el administrado se introduce al mismo a usarlo y explotarlo por la misma vía. Síguese de lo anterior, que cuando el administrado usa el dominio público por una vía de derecho –v. gr. permiso tácito-, únicamente, puede ser excluido de su uso por una vía de igual naturaleza, es decir, a través de un procedimiento administrativo en el que se garantice la regularidad y legalidad en el ejercicio de la potestad revocatoria. De otra parte, el artículo 13 de la Ley de la Zona Marítimo Terrestre debe ser interpretado de forma sistemática con el resto del ordenamiento jurídico y de manera conforme con el Derecho de la Constitución. Ciertamente, ese último ordinal habilita a cualquier autoridad de la jurisdicción y a las municipalidades al desalojo de los infractores de esa ley y a la destrucción o demolición de las construcciones, remodelaciones e instalaciones realizadas por aquéllos sin responsabilidad ninguna. Obsérvese que el propio artículo 13 habla de una información previa levantada al efecto –que no es más que un procedimiento administrativo- “si se estimare necesaria”. Esa necesidad se encuentra impuesta por la legitimidad o ilegitimidad de la ocupación, de tal manera que –como se indicó supra- si el administrado ingresó por la vía de hecho puede ser excluido y expulsado por la misma vía pero si lo respalda un permiso emanado de la propia administración municipal, aunque el mismo sea tácito, irremisiblemente, debe abrirse un procedimiento o información previa. En este último caso –que es el del sub-examine-, el administrado se encuentra amparado por el principio de la confianza legítima en la administración, puesto que, ésta previamente ha dictado actos o realizado actuaciones que amparan su actuación y en los cuales confía. En la especie la confianza legítima del recurrente fue creada por el oficio No. UR-101 de la Directora de Urbanismo de 20 de abril de 1990, en la que le afirmó al anterior poseedor o permisionario –[Nombre5] - que el rancho que pretendía construir se ubicaba en la “Zonificación del Plan Regulador del sector Oeste de Esterillos como de uso comercial. Por lo tanto el uso urbano para restaurant y bar es afín a lo que el Plan Regulador propone para ese sector”, así como por las ocasiones en que la Municipalidad le recibió dinero por concepto de “derecho de ocupación” y “alquiler de terrenos en la zona marítimo terrestre”. Al administrado que ha confiado legítimamente en la administración pública, al permitirle realizar una actuación determinada se le debe garantizar, como mínimo, un procedimiento en el que se discutan ampliamente la nueva valoración de las circunstancias fácticas y jurídicas que imponen revocar un acto administrativo previo y válido. Este tribunal deja claro que no pone en tela de duda la potestad que asiste a toda administración pública de defender el dominio público por sus características de imprescriptible e inalienable o la potestad virtual, implícita o de principio de toda administración de revocar sus propios actos por razones de oportunidad, conveniencia o mérito. No obstante, el ordenamiento jurídico sí le fija a las administraciones públicas cauces procedimentales claros y específicos para garantizar la regularidad y legitimidad en su ejercicio y los derechos e intereses legítimos de los administrados destinatarios de las mismas, so pena de nulidad del acto dictado". (Los resaltados son suplidos). De lo anterior se desprende que solo hasta que el Estado haya declarado lesivo el acto de otorgamiento del permiso municipal de construcción, podría entrar a discutir sobre la procedencia de la demolición, pues incluso hasta es posible que el vicio pueda convalidarse y otorgarse el permiso forestal, pues a la imputada le faltó el estudio de impacto ambiental y podría ser que se le otorgue y no haya necesidad de derribar la vivienda. En este caso, dada la falta de competencia de los tribunales penales para referirse a la legalidad de la función administrativa, resulta superfluo ordenar un juicio de reenvío para sustanciar nuevamente el asunto, sino que deberá ser en sede administrativa que deberá las autoridades competentes entablar el proceso y cumplir con el debido proceso, a fin de que el propietario registral pueda ejercer adecuadamente su derecho de defensa. Por lo anterior, se declara con lugar el recurso de apelación de la sentencia penal interpuesto por la encartada [Nombre1] . Se revoca parcialmente el fallo venido en alzada, y en su lugar, se deja sin efecto la orden de derribo de la de la casa de habitación construida en la finca del Partido de Puntarenas matrícula [Placa1], entre los mojones 26-27-28, descrita en el plano P-0743355-2001. En todo lo demás, el fallo permanece incólume. El juez Robleto Gutiérrez salva el voto.

IV.El Juez Robleto Gutiérrez salva el voto por las siguientes razones: I.- Antecedentes: La licenciada Natalia Hidalgo Porras, Fiscal de Impugnaciones, interpuso recurso de casación contra la sentencia número 2018-283 de las 13:30 horas del 8 de junio de 2018, dictada por el Tribunal de Apelación de la Sentencia Penal de Cartago, la cual resolvió declarar con lugar el recurso de apelación interpuesto por la defensa particular, declarando la ineficacia de la sentencia venida en alzada, en cuanto dispuso el derribo de la casa de habitación construida en la finca del Partido de Puntarenas matrícula [Placa1], entre los mojones 26-27-28, descrita en el plano P-0743355-2001, pero sin ordenar el reenvío correspondiente, para la discusión nuevamente de este aspecto, estableciendo por el contrario, que esa demolición, deberá ser discutida por la Administración, en la sede y por los procedimientos administrativos y jurisdiccionales que correspondan.

Mediante resolución 2019-00119 de las 10:08 horas del 8 de febrero de 2019, la Sala Tercera de la Corte Suprema de Justicia, admitió el único motivo del recurso de casación interpuesto por la representante del Ministerio Público, en donde se acusa la inobservancia de un precepto legal procesal, propiamente el establecido en el numeral 142 ibid. Arguye que en el fallo recurrido existe ausencia de fundamentación con relación a la decisión de no ordenar el correspondiente juicio de reenvío, y por el contrario, obliga a que sea la Administración la que acuda a otra vía con el fin de discutir lo relativo a la demolición de la vivienda, negando así a la representación fiscal esta posibilidad. El fondo de la impugnación fiscal debidamente admitida, fue resuelta por la resolución número 2019-01117 de las 10:14 horas del 13 de septiembre de 2019, por la misma Sala de Casación Penal, en donde se dispuso en lo conducente: “Por Tanto: Se declara con lugar el recurso de casación presentado por la señora fiscal Natalia Hidalgo Porras .

En consecuencia , se anula parcialmente la sentencia dictada por el Tribunal de Apelación de Sentencia Penal de Cartago , N°2018 - 283 , dictada al ser las 13:30 horas del 8 de junio de 2018. Se dispone ordenar el reenvío a dicho Tribunal para que una integración diferente resuelva lo concerniente a la posibilidad de ordenarse la demolición de la vivienda construida dentro de la zona protegida, dentro del proceso penal, o bien, mediante una vía distinta a éste, último; bajo una debida fundamentación. Notifíquese.” [sic]. II.- De lo anterior, queda claro que el objeto del reenvío a esta Cámara no es discutir la absolutoria penal de [Nombre6] , la cual está firme, sino, un aspecto puntual de lo que se anuló parcialmente de la resolución número 2018-283 de las 13:30 horas del 8 de junio de 2018, dictada por el Tribunal de Apelación de la Sentencia Penal de Cartago. La Sala Tercera de la Corte Suprema de Justicia, determinó que la sentencia supra citada fue anulada parcialmente porque: “la resolución dictaminada carece de una debida argumentación sobre la imposibilidad de ordenar el reenvío para que se resolviera la solicitud de derribo .de las obras , pretendida por la parte actora civil y el Ministerio Público, vulnerando el Tribunal de Apelación por consiguiente, su deber de fundamentar y motivar acorde a nuestro ordenamiento jurídico la resolución de marras .

Siendo que las reglas de fundamentación establecidas en los numerales 142 y 184 del Código Procesal Penal, son de obligatorio acatamiento para los Tribunales de Apelación , que en este caso , lo conminaba a resolver, de manera definitiva , no solo la situación jurídica del tercero afectado, sino que , además, debía referir lo correspondiente a la alteración sufrida en la zona protegida, lo que exigía más que una simple remisión a otra vía distinta de la sede penal.” [sic], (ver folio 187 del expediente virtual). III.- Acerca del thema decidendum del reenvío: el quid, (esencia o punto clave), del tema a dirimir, consiste en resolver fundadamente si el inmueble construido sobre la propiedad del partido de Puntarenas, matrícula [Placa1], que cuenta con el plano catastrado P-743355-2001, visado por el INVU, lo cual aparentemente, permitió la construcción de la vivienda hasta finalizarla, debe ser demolida como se ordenó por el Tribunal de instancia o no. Siendo, que, es un hecho, que no se convocó al proceso al propietario registral de la propiedad, es decir el esposo de [Nombre6] , sea [Nombre2] , quien adquirió ese bien el 3 de abril de 2003.

Estos datos como tales, no son controvertidos por las partes. La casa de 120 metros cuadrados se encuentra en Bahía Ballena de Osa. En efecto la jueza de instancia dispuso. “...Se ordena la demolición por parte de la Municipalidad de Osa de la construcción ubicada en la propiedad del partido de Puntarenas, sector de Bahía Ballena, en los mojones 26L27-28, y que se encuentra descrita en el plano P-0743355-2001 perteneciente registralmente a [Nombre2] , dato que se acredita mediante la certificación registral de folios 437 y 438 que esa propiedad pertenece al plano P-0743355-2001, misma que reconoció la propia imputada como de su esposo [Nombre2] y su persona. Es por ello que no hay confusión de que sea la propiedad donde se realizó la corta de los diez árboles y la construcción de la vivienda. Ahora bien, basada en los artículos 103 del Código Penal y 140 del Código Procesal Penal, 50 de la Constitución Política, aunque se haya demostrado que registralmente el dueño de la propiedad es [Nombre2] esposo. - de [Nombre1] _ , en Costa Rica existe el derecho fundamental a un ambiente sano y ecológicamente equilibrado y en tutela a ese derecho existen restricciones al derecho de propiedad, así como a algunos de aquellos derechos derivados o relaciones con el mismo, en este caso hablamos de terrenos con cobertura de bosque, para el cual son conocidas las prohibiciones para el cambio en el uso de la tierra sin autorización del Minae.

Con base en lo anterior, tal como se logró acreditar en jüicio, la construcción realizada. dentro de la propiedad registral de [Nombre2] no tiene autorización alguna, por lo que es ilegal, y siendo que su consecuencia es el derribo, por no cumplir con esa legalidad." (folio 483). [sic] (ver folio 143 del expediente virtual). Lo que se reprochó de la sentencia 2018-283 de las 13:30 horas del 8 de junio de 2018 del Tribunal de Apelación de Cartago que revirtió esa decisión de demoler la vivienda, por parte del voto número 2019-01117 de las 10:14 horas del 13 de septiembre de 2019 de la Sala Tercera de la Corte Suprema de Justicia, es que el Tribunal de Apelación no dio razones del por qué no ordenó el reenvío de la causa para que se resolviera ante el Tribunal de origen la procedencia o no del derribo de la vivienda, sino que, constatando que se había violentado el debido proceso, por no convocar al propietario registral del inmueble, sea [Nombre2] , cercenó la posibilidad al Ministerio Público y a la parte actora civil, de la oportunidad procesal de discutir en un contradictorio ese punto, pues, sin motivar, remitió la discusión a la vía que corresponde, por considerar que la participación de [Nombre2] en un juicio de reenvío, no “permitiría el pleno uso de sus derechos” (ver folio 147 del expediente virtual).

Este juzgador difiere del criterio de los respetables jueces del voto de mayoría, ello por cuanto: a) consideramos que no se puede tomar una decisión fundada acerca de ordenar o no la demolición del inmueble de marras sin que se realice un contradictorio sobre ese extremo con la presencia de todas las partes para que puedan interrogar y contra interrogar acerca de la totalidad de las probanzas admitidas; b) la decisión que tome el a quo está sujeta al régimen de impugnaciones que tiene previsto taxativamente el proceso penal, de tal manera que no se le cercene a ninguna de las partes la oportunidad procesal de ejercer su derecho a recurrir; c) la convicción de fondo acerca de la procedencia o no del derribo de la vivienda, solo puede provenir del ejercicio de los principios de inmediatez y contradictorio que brinda el debate, por lo que es una resolución que corresponde a la persona juzgadora de instancia que debe convocar a todas las partes interesadas y decidir el punto.

En consecuencia, no se emite un pronunciamiento de fondo acerca del derribo del inmueble, decisión que corresponderá al Tribunal de reenvío. Se anula parcialmente lo resuelto por la a quo en la sentencia número 09-2018 de las 9:30 horas del 19 de enero de 2018, dictada por el Tribunal del Segundo Circuito Judicial de la Zona Sur, Osa, en cuanto ordena la demolición por parte de la Municipalidad de Osa de la construcción ubicada en la propiedad del partido de Puntarenas, sector de Bahía Ballena, en los mojones 26-27-28, y que se encuentra descrita en el plano P-0743355-2001 perteneciente registralmente a [Nombre2] . En lo demás, el fallo permanece incólume.

POR TANTO

Por mayoría, se declara con lugar el recurso de apelación de la sentencia penal interpuesto por la encartada [Nombre1] . Se revoca parcialmente el fallo venido en alzada, y en su lugar, se deja sin efecto la orden de derribo de la de la casa de habitación construida en la finca del Partido de Puntarenas matrícula [Placa1], entre los mojones 26-27-28, descrita en el plano P-0743355-2001. En todo lo demás, el fallo permanece incólume. El juez Robleto Gutiérrez salva el voto. Hágase saber. El Juez Robleto Gutiérrez salva el voto y anula parcialmente lo resuelto por la a quo en la sentencia número 09-2018 de las 9:30 horas del 19 de enero de 2018, dictada por el Tribunal del Segundo Circuito Judicial de la Zona Sur, Osa, en cuanto ordena la demolición por parte de la Municipalidad de Osa de la construcción ubicada en la propiedad del partido de Puntarenas, sector de Bahía Ballena, en los [Dirección2] , y que se encuentra descrita en el plano P-0743355-2001 perteneciente registralmente a [Nombre2] . En lo demás, el fallo permanece incólume. Ordena el reenvío ante el Tribunal de origen, únicamente para que se sustancie ese extremo, con la comparecencia en una audiencia, de todas las partes interesadas.
