Proceeding heard before the Agrarian Court of the Second Judicial Circuit of Alajuela, Upala.- Judge Castro García authors the decision; and,
WHEREAS:
I.The defendant Association appeals (digital case file/pleadings/date 06:22:39) decision number 2020000072 issued at 19:17 on May 18, 2020 (digital case file/documents/date: 18/05/2020 time 19:17:49). That decision denied the precautionary measure requested by the defendant on the ground that, because the defendant had not filed a counterclaim (reconvención), it had asserted no claims and the precautionary measure therefore could not be granted. The following grounds of appeal are presented: a) The need to file a counterclaim in order to request a precautionary measure. In its first ground of appeal, it invokes Article 77 of the Code of Civil Procedure and alleges infringement of the principles of timeliness, standing, procedural equality, and responsibility applicable to the interim relief (tutela cautelar) to which it is entitled. It contends that it did assert specific claims in its answer to the complaint.
It adds that the aforementioned supplementary legal provision establishes the prerequisite that a counterclaim must be filed in order to obtain a precautionary measure. It notes that the provision states: “Unless expressly provided otherwise, such measures shall be ordered at a party’s request and under that party’s responsibility.” Accordingly, the position taken in the decision has no legal basis, and under the principle of procedural equality set forth in section 2.1 thereof, both parties have rights within the proceeding, including the right to precautionary measures. b) Failure to assess the probability or prima facie plausibility of the claim (verosimilitud de la pretensión). It contends that Articles 78 and 79 thereof were infringed because the denial was based on a failure to satisfy the prerequisites, purpose, and admissibility requirements. It argues that the appellant does have claims in its answer to the complaint intended to defend its rights and interests, but those claims were not examined.
The decision is likewise justified by the alleged absence of any risk of loss, alteration, or damage warranting the measure and, consequently, by the absence of a likelihood of success on the merits (apariencia de buen derecho), proportionality, and reasonableness, as well as by the measure’s alleged lack of connection to the claim and to any potential impact on third parties or the public interest. In response, it argues that, following the declaration of a National Emergency due to the coronavirus that causes COVID-19, the authorities of the Presidencia de la República, the Ministerio de Salud, the Caja Costarricense del Seguro Social, and the Comisión Nacional de Emergencias, among other institutions, recommended and urged families to remain in their homes. School activities were also suspended. This has resulted in more people remaining in their homes, thereby increasing demand for drinking water among users of the water-supply system administered by the Association.
It explains that this greater consumption of drinking water, together with the dry season, reduces the availability of water resources. This situation has made it difficult to keep the drinking-water collection tanks full, as they are supplied with water conveyed through pipes crossing the plaintiff’s property. This has compelled the appellant Association, as a good practice to safeguard the water supply, to conduct inspections along its entire water-supply network. The Association therefore needs to conduct these inspections of the water-supply system, infrastructure, pipes, and valves located within the plaintiff’s property in order to diagnose conditions and recommend measures aimed at protecting the water-supply system during this National Emergency. It states that the access areas, drinking-water distribution pipes, valves, and all water-supply infrastructure installed on the plaintiff’s land have not been inspected in recent months, making an inspection urgent in light of the pandemic crisis.
It adds that public handwashing stations have had to be installed at various locations in the beneficiary communities so that many low-income families and individuals who are not subscribers may have access to drinking water and handwashing facilities and may combat the possible transmission of the coronavirus that causes COVID-19. In addition to the foregoing, it states that the water-supply system holds a statutory easement (servidumbre legal) under Article 73 of the Water Law (Ley de Aguas). Because this is a dispute concerning publicly owned waters (aguas de dominio público), it requested, pursuant to Article 116 of the Water Law, that the precautionary measure be ordered against the plaintiff on an urgent and provisional basis. It argues that the Association’s subscribers face a risk of harm to their human right of access to water if the requested precautionary measure—authorization to conduct inspections of the water-supply system crossing the plaintiff’s property, registered in the Alajuela Public Registry under property record [Placa1]—is not granted.
It states that, in recent years, the plaintiff has prevented the Association from conducting inspections of the condition of the water-supply system, infrastructure, pipes, and valves. On repeated occasions, the Association’s plumbers and workers have been unable to conduct inspections in the disputed area because representatives of the plaintiff company have not granted permission to enter the property and perform the preventive inspections required to ascertain the condition of the water-supply system. Consequently, the access areas, drinking-water distribution pipes, valves, and existing water-supply infrastructure have not been inspected. Such inspections are necessary as part of the measures undertaken by the Association to protect the water-supply system from adverse impacts during the COVID-19 pandemic. c) Failure to assess the request for interim relief and violation of Article 92 of the Code of Civil Procedure.
It argues that this legal provision authorizes the judge to order other precautionary measures, such as access to landlocked properties (fundos enclavados), and any measure of a preservative, innovative, or anticipatory nature. It urgently requests, on a provisional and ex parte basis (sin audiencia), an atypical precautionary access measure (medida cautelar atípica de acceso) provisionally authorizing the Association, during the National Emergency caused by COVID-19, to have the appropriate personnel, including inspectors and plumbers, conduct inspections for possible damage to the water-supply system crossing part of the aforementioned registered property at least twice per month. This would make it possible to inspect and prevent adverse impacts on the water-supply system and to protect and preserve the supply of drinking water to the collection tanks that distribute water to the beneficiary communities.
It would also make it possible to diagnose conditions and recommend the actions necessary to protect and preserve the supply of drinking water to the collection tanks that distribute water to residents. The precautionary measure is therefore preservative, innovative, and anticipatory, which was not assessed. d) Failure to examine the prerequisites and purpose of the precautionary measure. It alleges that there is a risk of harm, a likelihood of success on the merits, proportionality, and reasonableness, given the lack of knowledge regarding the condition of the water-supply system and the absence of the diagnoses and recommendations needed to protect and preserve it. Furthermore, it requested that it remain in possession of, and retain the public-use water-supply easement (servidumbre de uso público de acueducto) over, the plaintiff’s land, and that the plaintiff refrain from interfering with that possession and easement.
The measure seeks to secure the right to inspect the water-supply system for possible damage that could affect the filling of the collection tanks, thereby preventing harm to third parties or the public interest. e) Violation of the right of defense. It requests an extremely urgent precautionary measure (medida cautelar urgentísima) against the plaintiff so that the Court will permit the Association to conduct inspections of the water-supply system crossing part of the plaintiff’s property in order to preserve the public drinking-water service. This is necessary because access has been denied. It also requests a judicial inspection (reconocimiento judicial), witness testimony, documentary evidence, and a party statement as evidence supporting its claims for interim relief. That evidence was disregarded even though it is necessary to verify the appropriateness and conditions of the measure, notwithstanding that this matter is an ordinary proceeding in which the plaintiff seeks an action denying an easement (acción nugatoria de servidumbre), while the defendant seeks recognition of a statutory easement which, because it concerns a drinking-water supply system, does not even require public notice through possession or other outward acts (publicidad material).
It alleges the existence of a formal defect rendering the decision void, which left the defendant without a defense. The requested measure was denied without a factual basis or appropriate evidence that could have assisted the judge in supporting and substantiating her judicial decision. f) Failure to provide reasons. It contends that no reasons were given for denying the precautionary measure; rather, it was denied based on the argument that the Association had not filed a counterclaim. This does not constitute an analysis of the disputed issues and violates the duty to state the reasons for the judgment. It is therefore prevented from knowing the reasoning supporting the judicial decision, thereby infringing the Association’s right of defense. As evidence supporting its appeal, it submits the complaint, the answer, and the documentary evidence contained in the record. It requests that the appeal be granted, together with the concomitant declaration of nullity. It asks that the appealed decision be reversed and the precautionary measure granted. Alternatively, it asks that the decision be annulled.
II- First, it is appropriate to cite this Court’s ruling in Voto número 000942-F-2019 de las quince horas y treinta y ocho minutos del catorce de noviembre de dos mil diecinueve: “The Agrarian Jurisdiction Law (Ley de Jurisdicción Agraria) contains several procedural gaps that must be filled first by the Labor Code and, failing that, by the civil procedural rules. Accordingly, regardless of whether the Agrarian Procedure Code (Código Procesal Agrario) is in force, Labor Code number 9343, as of 25 de julio de 2017, and Civil Procedure Code number 9342, as of 8 octubre de 2018, apply on a supplementary basis. The Agrarian Procedure Code governs standard interim measures (medidas cautelares), such as restraint on departure (arraigo) and prejudgment attachment (embargo preventivo) (articles 33 and 34 ibid.). Given the absence of special provisions in the agrarian procedural legislation concerning non-standard interim measures (medidas cautelares atípicas), and because the Labor Code applies on a supplementary basis, that body of law must be applied first.
It should be clarified that, according to the digital docket, this matter commenced on 14 de mayo del 2019. At that time, the labor procedure law was already in force, regulating interim measures in Section V, provisions 489 through 494. The first provision states as follows: ‘Before proceedings are instituted and during their pendency, including at the enforcement stage, the adjudicatory body may order appropriate and necessary interim measures to provisionally protect and safeguard the subject matter of the proceedings and the effectiveness of the judgment. It may also order any preparatory or anticipatory measure necessary to preserve the exercise of a future right, as well as any other non-standard measure that does not exceed the limits of reasonableness and proportionality. In such cases, the body may prudently order whatever is necessary to achieve the measure’s objective, so that its authority is not exceeded.
With respect to the types of measures, whether interim or preparatory, their effects, and the manner of implementing, replacing, or lifting them, the provisions of civil procedural law shall apply, subject to the exceptions set forth below.’ This provision must be read together with provision 490 of that Code. The foregoing establishes that: 1. They may be ordered before or during the proceedings, including the judgment-enforcement stage. 2. They seek to provisionally protect and safeguard the subject matter of the proceedings and the effectiveness of the judgment, and to preserve the exercise of a future right. 3. Non-standard measures are permitted, provided that they are reasonable and proportionate to safeguard the potential future right. 4. They may be ordered at a party’s request or sua sponte (de oficio). 5. Countersecurity (contracautela) must be addressed sua sponte; it must be prudent and prevent any overreach. 6.
Civil procedure applies supplementally regarding the types of measures, their effects, and the manner of implementing, replacing, or lifting them, subject to the exceptions established by labor legislation. 7. When implementing an interim measure, the court must act diligently to prevent frustration of the objective pursued. Based on the foregoing, this Chamber considers it appropriate to continue applying its longstanding criteria regarding the admissibility requirements for such measures. Those criteria, in addition to having drawn upon the repealed 1989 Civil Procedure Code, were informed by the doctrine emanating from the Constitutional Chamber of the Supreme Court of Justice (Sala Constitucional de la Corte Suprema de Justicia), which is binding erga omnes pursuant to provision 13 of the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional). In judgment número 7190 de las 15 horas 24 minutos del 6 de diciembre de 1994, it stated as follows: ‘...According to the most authoritative legal scholarship, protective or interim measures arise in proceedings from the need to guarantee effective judicial protection (tutela jurisdiccional efectiva) and may therefore be conceptualized as “a set of procedural powers vested in the judge—whether exercising judicial or administrative adjudicatory authority—to issue a ruling before the final decision, specifically in order to preserve the factual conditions essential to the issuance and enforcement of the final act.” Legal scholarship understands instrumentality and provisionality to be two fundamental characteristics of interim measures and requires their principal defining elements to be: a) lawful and legally possible; b) provisional, since they expire upon issuance of the final act; c) grounded, meaning that they must have a genuine factual basis relating to the particular case; d) modifiable, in the sense that they may be expanded or reduced to adapt them to new needs; e) ancillary, since they are justified within principal proceedings; f) preventive in nature, since their purpose is to avert harm to the interests and rights represented in the principal proceedings; g) protective in their effects, insofar as they seek to preserve a factual or legal state of affairs while the proceedings are pending, preventing situations that could impair the effectiveness of the judgment or final act; and h) homogeneous and not identical in character to the substantive right being protected, so that they constitute effective preventive measures rather than anticipatory acts of enforcement.’ From the foregoing detailed explanation, it follows that the likelihood of success on the merits (apariencia de buen derecho) must be considered because, in conducting the proportionality assessment, it is necessary to determine, based on the facts and claims, whether the decision to be made by the judicial body is directed toward preserving a factual or legal state of affairs while the proceedings are pending, thereby preventing situations that could impair the effectiveness of the judgment or final act, as explained by the Constitutional Chamber...
Given the renewed emphasis placed on reasonableness in the latest labor procedural legislation, this Court has considered it relevant to revisit the development of that assessment based on the criteria of the aforementioned Constitutional Chamber. In decision 732-2001 de las 12 horas 24 minutos del 26 de enero de 2001, the Constitutional Chamber defined the principle of reasonableness as follows: ‘V.- THE PRINCIPLE OF REASONABLENESS AS A CONSTITUTIONAL STANDARD. Constitutional case law has been clear and consistent in holding that the principle of reasonableness constitutes a standard of constitutionality … To conduct the reasonableness assessment, United States legal scholarship calls first for an examination of so-called “technical reasonableness,” under which the specific rule (statute, regulation, etc.) is examined. Once it has been established that the chosen rule is appropriate for regulating a particular subject matter, it must be determined whether the means selected are proportionate to the objective pursued.
Once the “technical reasonableness” test has been satisfied, “legal reasonableness” must be analyzed. For that purpose, this doctrine proposes examining: a) balancing reasonableness, which is a type of legal assessment undertaken when the existence of a particular antecedent (e.g., income) entails a particular obligation (e.g., a tax), in which case it must be determined whether that obligation is equivalent or proportionate; b) equality-based reasonableness, which is the type of legal assessment based on the premise that equal antecedents must have equal consequences, without arbitrary exceptions; and c) purposive reasonableness, which assesses whether the objective to be attained is inconsistent with the purposes contemplated by the legislature when approving the measure. Within this same analysis, it is not enough to assert that a means is reasonably suited to an end; it is also necessary to determine the nature and extent of the restriction that a personal right must bear as a result of that means.
Thus, if the same end can be achieved through another means that imposes a less burdensome restriction on personal rights, the chosen means is not reasonable...’ (To the same effect, Votos Nos. 843-02 del 30 de enero de 2002; 5374-03 del 20 de junio de 2003; 340-04 del 16 de enero de 2004; 846-05 del 28 de enero de 2005; 1800-05 del 23 de febrero de 2005; 2236-05 del 2 de marzo de 2005; 1806-06 del 15 de febrero de 2006; 1807-06 del 15 de febrero de 2006 y 1557-07 del 7 de febrero de 2007 y 1571-08 del 15 de enero de 2008).’ In addition to the foregoing, Voto número 8858-98 de las 16 horas 33 minutos del 15 de diciembre de 1998 of the aforementioned Chamber further develops the case law concerning that principle as follows: ‘Thus, an act restricting rights is reasonable when it satisfies three conditions: it is necessary, suitable, and proportionate. The necessity of a measure refers directly to the existence of a factual basis making it necessary to protect an interest, or a set of interests, of the community—or of a particular group—by adopting a differentiating measure.
That is, if such action is not taken, significant public interests will be harmed. If the restriction is unnecessary, it cannot be deemed reasonable and therefore constitutionally valid. Suitability, for its part, entails an assessment of whether the type of restriction to be adopted does or does not accomplish the purpose of meeting the identified need. The measure’s unsuitability would indicate that other mechanisms may exist that better address the existing need, some of which may accomplish the proposed objective without restricting enjoyment of the right in question. Proportionality, in turn, requires a necessary comparison between the purpose pursued by the act and the type of restriction imposed or sought to be imposed, so that the magnitude of the restriction is not markedly greater than the benefit it is intended to secure for the community. Of the final two elements, the first may be said to be based on a qualitative assessment, whereas the second is based on a quantitative comparison of the two objects analyzed.’ Several considerations relevant to this matter may be inferred from the preceding excerpts.
The first is that if the objective can be attained through another means that imposes a less burdensome restriction on personal rights, then the chosen means is not reasonable; moreover, a reasonable measure must be necessary, suitable, and proportionate. VI. When the Constitutional Chamber analyzes reasonableness, it introduces necessity as one of the conditions—along with suitability and proportionality—when rights are to be restricted. It is therefore appropriate to revisit what that Constitutional Court stated within the framework of provision 41 of the Political Constitution (Constitución Política), insofar as interim measures constitute a fundamental right. In the words of the Constitutional Chamber of the Supreme Court of Justice, interim measures are governed by a procedural necessity: ‘It is in this sense that interim—or protective—measures arise in proceedings as a genuine procedural necessity, insofar as they make it possible to guarantee effective protection of access to justice (both judicial and administrative, as noted above); accordingly, they may be conceptualized as the “set of procedural powers vested in the judge—whether exercising judicial or administrative adjudicatory authority—to issue a ruling before the final decision, specifically in order to preserve the factual conditions essential to the issuance and enforcement of the final act” (sentencia número 7190-94, de las quince horas veinticuatro minutos del seis de diciembre de mil novecientos noventa y cuatro),’ Sala Constitucional de la Corte Suprema de Justicia, voto [Telf1] del primero de febrero de 2006.
Accordingly, this Court understands that a state of necessity (estado de necesidad) refers to a situation of present danger to interests protected by law. Effective protection of the right alleged to be in danger gives rise to a dilemma.
Which entails the diminution of legally protected interests of another litigant or institution. In the specific case of precautionary measures (medidas cautelares) in agrarian matters, their admissibility requires the existence of abnormal and exceptional circumstances, which must be weighed in each case. Procedural necessity has been linked to the danger in delay (peligro en la demora), meaning that the longer the proceeding takes, the more likely its outcome could be rendered ineffective due to a change in the circumstances sought to be protected in the litigation, thereby depriving the litigant of genuine access to justice. Regarding the diminution of the rights of other persons who could be affected by the imposition of the precautionary measure, the limitation is that the relief ordered under the measure must not be unlawful or harmful. Reasonableness and proportionality therefore enter into the balancing process." Decision clarifying the supplementary application (aplicación supletoria) of procedural legislation to agrarian proceedings and the basis for precautionary measures.
III- It should be noted that the basis in the appealed decision for denying the precautionary measure requested by the appellant Association was the absence of a counterclaim (contrademanda) on its part. In this Court’s view, that decision is erroneous, particularly in a case such as this one, where it is logical to infer that the defendant requests authorization to inspect and enter for purposes of maintaining and monitoring the structure that actually exists and forms part of the aqueduct system supplying drinking water to a population. This water resource is administered by this type of association, which is entrusted by law with managing the supply of this vital resource to the public. In other words, this relates to the Right to Water in sufficient quantity and, above all, of optimal quality. That is, it concerns a human right upon which life and health depend. These matters were not analyzed in the precautionary ruling, nor were the body of evidence and materials submitted at the time the precautionary decision was issued, as alleged in the appeal under consideration.
This Chamber infers the foregoing from the claims in the ordinary action denying the existence of an easement (demanda ordinaria negatoria de servidumbre) brought by Alejandro Country Life S.A. against Asociación Específica de Acueductos de San José de Upala. The relevant portion of the claims seeks the following: " PRINCIPAL CLAIM: .... That this action be granted in all respects, upholding this ordinary proceeding asserting full legal rights and an agrarian negatory action, and rejecting any defense raised by the defendant Association. That it be declared that the claimant company is the owner and sole possessor of the property registered under real-property folio [Placa2] of the province of Alajuela, .. survey plan duly registered with Catastro Nacional A0014593-1974. That it be declared that the property registered under real-property folio CED5 of the province of Alajuela is not encumbered by any real charge imposing a compulsory right-of-way, pipeline easement, or similar easement.
That it be declared that the defendant Association, through its officials, infringed the claimant company’s property rights over the property registered under real-property folio CED5 of the province of Alajuela by using it as a passageway, causing environmental damage through the construction of a trail, and maintaining a pipeline crossing that same property without any authorization from the claimant company to do so. That the defendant Association, whether through its representatives or through any intermediary acting at its direction, be ordered to refrain from continuing to interfere with the claimant’s property and be prohibited from crossing the property registered under real-property folio CED5 of the province of Alajuela, and that it be warned that, should it fail to comply with this order, its representatives could face criminal proceedings for the offense of disobedience of authority.
That the defendant Association be ordered to remove, no later than one month after the judgment becomes final, the pipeline, pipes, and materials located within the claimant company’s property; otherwise, it shall be warned that, should it fail to comply with this order, its representatives could face criminal proceedings for the offense of disobedience of authority. That the defendant Association be required to compensate for the damages and losses caused by the construction of the trail made by its officials within the claimant company’s property, which are described and valued as follows: Damages: caused by the construction of a road or trail extending 300 meters through the forested area of the claimant company’s property, covering a total area of 600 square meters, with the damages valued at three million colones (03.000.000,00)..... Losses: caused by the inability to use the affected area, as well as the concern of the claimant company’s representatives regarding an imminent environmental penalty because they are responsible for protecting the forested area; these losses are estimated at two million colones... 8- That the defendant be ordered to pay both categories of litigation costs...
ALTERNATIVE CLAIM: In accordance with the foregoing, I alternatively request that, should the relief sought in point 3 be deemed unavailable (insofar as it seeks a declaration that the property registered under real-property folio CED5 of the province of Alajuela is not encumbered by any real charge imposing a compulsory right-of-way, pipeline easement, or similar easement), the defendant Association be ordered to compensate the claimant company for the establishment of the easement, whether a right-of-way or a pipeline easement (allowing the pipe transporting drinking water to remain), in the amounts established by an expert appointed for that purpose, taking into account the value per square meter of the portions of land over which the easement declared to exist runs. " The allegations in the complaint state that the property was acquired in 2007 free of any easement encumbrance. It states that the land is used for agriculture, with forest-conservation areas, and that they have acted to protect it.
It notes that the defendant Association is responsible for administering the rural aqueduct supplying a large population in the district of San José de Upala. It states that on the eastern portion of the land, within a third party’s property, that entity has a water intake at a spring (naciente). The fifth allegation states that, shortly after purchasing the land, they learned that a main pipe carrying drinking water and operated by the defendant Association passed through it, and that some of the Association’s officials were crossing the property. Specifically, they were crossing the protected forest area in order to avoid walking several additional meters by using the passageway leading directly to the water intake at the spring supplying the district of San José. It states that, upon learning this, no objection was made and, as a matter of mere tolerance, the pipe was allowed to continue crossing the property because there was no dispute with the defendant’s representatives at that time.
The sixth through eighth allegations explain that the disputes arose two years earlier, when the defendant’s officials, in order to reach the water intake located on a third party’s property, crossed the claimant’s land and caused considerable damage to the protected forest to facilitate their passage to that intake. MINAE officials were called to conduct an assessment and prepare a report detailing that environmental damage had in fact been caused to approximately 600 square meters through the construction of a trail. It states that when the Association was questioned about the reason for this act and the measures it would take to restore the area, no response was received, demonstrating utter disregard for the claimant’s property rights and the conservation of natural resources. It asserts that those persons currently continue to cross the property using the trail created there, despite having no easement rights;continuously affecting the protected forest.
In addition, the pipe carrying water from the intake on a neighboring property to nearby communities runs through the claimant’s land, although no aqueduct easement was established to encumber the property belonging to it. The establishment of that easement encumbrance was not pursued, whether consensually or compulsorily, nor was any indemnification or compensation received for the impairment of the property right. (images 137 to 146 of the digital expediente in pdf format). A document entitled "FORESTRY SUPERVISION REPORT FOR PROTECTION OR CONSERVATION AND NATURAL REGENERATION" was submitted with the complaint, indicating that it relates to contract (FONAFIFO): SC-01-22-0216-2016, based on the inspection of 09/12/2017, concerning property: 275172 in Alajuela, canton of Upala, [Dirección1] , survey plan A-014593-1974, owner Alejandro Country Lite S.A. Regarding the forest area subject to PSA (ha): Sixty-one point nine hectares (61.9 ha).
The relevant portion states: "An unauthorized trail was made between line [Dirección2] of the boundary description in the PSA Area Sketch, specifically between GPS point ([Dirección3] (coordinates [Dirección4]), extending 300.meters into the PSA forest area. This trail was made by ASADA San José de Upala in order not to continue along the forest line or boundary and to avoid a section with a very steep slope. The affected area is 600 m2 (0.01% of the PSA Area) and consists of - a trail for maintaining the drinking-water transmission lines_....III. RECOMMENDATIONS .... There is no modification to the Technical Study; the effective area remains unchanged. Compliance with the administrative, technical, and legal provisions specified in the Contract entered into with the State must be maintained. The Forestry Supervisor must be notified through a recordable medium of any change in the forest or alteration requiring immediate attention.
ASADA San José de Upala submits a Note (Official Letter ASESAP-1D-006-2017) to justify the work and maintain communication between the parties, thereby avoiding disagreements (See attached Note); this evidence affects 0.01% of the total PSA Area and does not warrant any modification to the Technical Study or Contract. Payment of the corresponding fee is recommended." In its answer to the complaint, the Association states that it is a nonprofit organization and has possessed the area through which the main pipeline runs for 22 years. That pipeline partially crosses the claimant’s property. It is demarcated with visible infrastructure, valve boxes, and other works, and its right has therefore been consolidated as a public-use aqueduct easement. It need not be recorded in the property registry because it supplies the population with the human right to drinking water. It invokes section 119 of the Ley de Aguas, which provides that an aqueduct is an integral component of the estate or building for which the water is intended.
The defendant is therefore the owner. It states that it is an ASADA and that, since the stated date, it has served as administrator of the drinking-water aqueduct in the districts of San José, Delicias, and [Dirección5] Upala de Alajuela. It currently has 2600 drinking-water service subscribers. It explains that water is drawn from an intake built at a spring located in Armenias de Aguas Claras de Upala, on property situated more than 10 kilometers from the claimant’s property, and that a pipeline partially crossing the latter property is maintained. All of this has existed for more than twenty-two years because the former owner, [Nombre3] , was an enthusiastic advocate for the aqueduct, assisted with the construction of the project, and granted the Association a pipeline right-of-way, as well as a right-of-way across the property for officials and plumbers to maintain the intake infrastructure and the area through which the pipeline runs.
A right enjoyed for a long time for the reasons explained, and exercised in accordance with Articles 99 and 73 of Ley de Aguas, which does not require the imposition of an easement (servidumbre) because it is a public-use aqueduct easement (servidumbre de uso público de acueducto). It states that, with respect to the pipeline right-of-way (zona de paso) crossing part of the plaintiff’s property, it has exercised quiet, public, peaceful, notorious, uninterrupted possession as owner, under color of title, in good faith, and for more than twenty-two years. For many years before the plaintiff became the owner, it performed possessory acts (actos posesorios), including brush clearing (chapias), installation of the aqueduct pipeline, and maintenance work in the right-of-way of this drinking-water distribution piping system, keeping the route identified, monitoring for possible leaks and breakdowns, and preventing damage to the infrastructure of the public drinking-water service provided by the Association.
It states that the entire route through the properties is marked and delimited, with visible pipeline and intake infrastructure, valve boxes, and markings along its route; therefore, the aqueduct is indeed apparent, and the right-of-way easement (servidumbre de paso) is also continuous and apparent. Accordingly, it acquired it by acquisitive prescription (prescripción positiva), having possessed it since the property belonged to the previous owner. Moreover, because an essential public service is involved that protects the human right to water, the aqueduct and its distribution infrastructure do not require registration notice (publicidad registral) of the creation of an easement, as they benefit a public service of general interest, under the terms of Article 73 of Ley de Aguas. The literal wording of Article 116 of Ley de Aguas is cited regarding the powers of the owner of an aqueduct, including the possibility of reinforcing the banks with turf, stakes, walls, or embankments of loose stone, but not with plantings of any kind.
Likewise, the owner of the servient estate (predio sirviente) may not carry out any planting or cultivation on those banks; and any roots penetrating them may be cut by the owner of the aqueduct.” It therefore considers that the Association enjoys a right to maintain the portion of the aqueduct crossing the plaintiff’s property. It states that the aqueduct’s components serve a public interest and therefore registration notice is unnecessary to permit their passage. Instead, material notice (publicidad material) suffices because, by its nature, the aqueduct is intended to satisfy the fundamental human right to drinking water of the beneficiary communities and subscribers. It disputes the plaintiff’s position, asserting that when she acquired the property she knew of the aqueduct because the previous owner, [Nombre3] , had promoted it, worked on its construction, and facilitated access through the aqueduct right-of-way for the officials and plumbers who maintain the aqueduct and its rights-of-way.
It denies having caused environmental damage. The track referred to by the plaintiff resulted from maintenance work on the aqueduct pipeline system, which requires constant brush clearing and cleaning of the rights-of-way, as well as access by the Association’s officials and plumbers, in order to monitor the main pipeline route and prevent leaks and breakdowns affecting the public aqueduct service. It has possessed those rights-of-way for twenty-two years and has performed legitimate possessory acts, thereby establishing a continuous and apparent public-use aqueduct easement which, under Article 73 of Ley de Aguas, does not require registration notice because of the nature of the easement. It states that, in October 2018, the plaintiff contacted the Association in writing and proposed that she be provided free drinking water in exchange for use of the land through which the main pipeline passes.
This was not possible because of the existence of a public-use aqueduct easement under Article 73 of Ley de Aguas. On 29 de octubre de 2018, a letter was received from the plaintiff requesting monthly payment of 50 mil colones for the main aqueduct pipeline right-of-way, retroactive to 01/07/2018, as well as legal expenses, a contract, a request for permission to enter, and submission of the matter to the Association’s Ordinary General Assembly. This is legally impossible for the Association given the nature of the service provided. Thus, it was not a disregard for the plaintiff’s property rights; rather, her requests fall outside the law and the proper management of the Association’s interests as the entity administering the aqueduct. Furthermore, the Association has been the lawful possessor of the right-of-way of the main pipeline crossing part of the plaintiff’s property for twenty-two years.
It raises the defense of lack of legal entitlement (falta de derecho), because this involves an existing statutory easement (servidumbre legal) established under Article 73 of Ley de Aguas, and the defense of failure to join necessary parties (litis consorcio pasivo necesario) with respect to Instituto de Acueductos y Alcantarillados and Procuraduría General de la República. As an extremely urgent interim measure (Medida cautelar urgentísima), it requests that, to prevent serious harm to aqueduct maintenance activities and the provision of drinking-water service, considering that the aqueduct is a statutory easement under Article 73 of Ley de Aguas and that the dispute concerns publicly owned waters, an interim measure be ordered against the plaintiff, pursuant to Article 116 of Ley de Aguas, requiring her to allow the Association’s officials and plumbers to access and maintain the pipeline right-of-way crossing part of her property, so that they may perform brush clearing and maintenance work in the right-of-way of this drinking-water distribution piping system, keep the route identified, monitor for possible leaks and breakdowns, and prevent damage to the infrastructure of the public drinking-water service provided by the Association.
As the “relief sought” (pretensión) in its answer, it requests: “1. I request that Your Honor dismiss the complaint. 2. Grant the defenses raised. 3. Grant the interim measure requested. 4. Maintain me in possession of, and preserve the public-use aqueduct easement over, the portion of the plaintiff’s property used by the Association to perform brush clearing and maintenance work in the right-of-way of this drinking-water distribution piping system, in order to keep the route identified, monitor for possible leaks and breakdowns, and prevent damage to the infrastructure of the public drinking-water service provided by the Association. 5. Order the plaintiff henceforth to refrain from disturbing the possession and public-use aqueduct easement exercised by the Association, with the warning that, otherwise, she will be prosecuted for the offense of disobedience of authority. 6. Order the plaintiff to pay the procedural costs and attorney’s fees of these proceedings. ” IV- In the interlocutory judgment on precautionary relief (auto sentencia cautelar), the court reasoned, insofar as relevant: “It is necessary to add to the foregoing that precautionary relief (tutela cautelar) is ancillary to a principal claim brought by one of the parties before the court, and is sought in response to a possible need to safeguard the outcome of the proceedings, whether regarding the complaint or the counterclaim (reconvención).
This legal mechanism is contained in the Code of Civil Procedure, which applies supplementarily to agrarian matters pursuant to the express provision of section 26 of the Agrarian Jurisdiction Act. ... It adds that the likelihood of success on the merits (apariencia de buen derecho), proportionality and reasonableness, its relationship to the claim (meaning the claim asserted by the plaintiff in the complaint or by the defendant in the counterclaim), and any potential impact on third parties or the public interest must be assessed..... In the case under review, the defendant, which seeks precautionary relief, did not file a counterclaim against the claimants; that is, it has not brought an action in defense of its interests. Therefore, because no counterclaim exists, it is not possible to analyze what right of the defendant might ultimately be affected or whether the defendant’s claims relate to the relief invoked.
It should be noted that one characteristic of a precautionary measure (medida cautelar) is that it is ancillary to a principal claim, which the defendant has not asserted in this matter. In light of the foregoing premise, the undersigned finds that the risk posed by delay (peligro en la demora), which is required for the admissibility of precautionary relief, is absent from the defendant’s application for such relief...” The precautionary measure was therefore denied. A reading of the relief sought in the complaint shows that the principal claim requests a declaration that no aqueduct easement encumbrance (gravamen de servidumbre de acueducto) exists over its property and, alternatively, compensation for that right. The defendant opposed the complaint, stating that this right was established by the use of the aqueduct for more than 22 years, that the aqueduct exists, and that it must be properly maintained to guarantee the water supply to the population it serves.
It is protected under the Water Act. As an urgent precautionary measure, to prevent serious harm to aqueduct maintenance activities and the provision of potable water service, the defendant requests that the plaintiff be ordered to allow the Association’s officials and plumbers to enter the area through which the pipeline crosses part of the plaintiff’s property in order to perform maintenance. This would allow them to carry out brush clearing (chapias) and maintenance work in the passage area of this potable-water distribution pipeline system, keep the route identified, monitor possible leaks and breakdowns, and prevent damage to the infrastructure of the public potable-water service provided by the Association.
V- This Court notes that no advance judicial inspection (reconocimiento judicial anticipado) was conducted, nor did the judgment analyze the case file and the available evidence. The application for a precautionary measure was also not properly decided with respect to the harm that could be caused to the public service supplying water for human consumption, or the report by MINAE officials concerning the damage to the forest area. Notwithstanding the foregoing, which is brought to the attention of the lower court, this Chamber will not annul the appealed interlocutory judgment that denied the defendant ASADA’s precautionary measure, because this matter requires prompt and effective judicial protection. The public service supplying potable water is at stake. This Chamber finds that the merits of the case will be decided in the judgment ultimately issued. That judgment will determine whether an aqueduct easement encumbrance exists over the plaintiff’s property or whether compensation is warranted; this is a property-related matter between the litigating parties.
However, because it is undisputed that the pipelines of the aqueduct administered by the defendant run partly through a section of the plaintiff’s property (fundo), that the aqueduct is in use, and that it forms part of the aqueduct system supplying potable water to several communities in the area, the requested precautionary measure must be granted provisionally to protect human health and access to potable water of suitable quality and quantity (articles 489 and 490 of the Labor Code, which apply supplementarily, and article 50 of the Political Constitution). Accordingly, with respect to that measure, the plaintiff must be ordered to allow the officials and plumbers of the defendant Association to enter its property for the sole purpose of maintaining and inspecting the aqueduct in the pipeline passage areas crossing part of the plaintiff’s property. They may carry out brush clearing and maintenance work in the passage area of this potable-water distribution pipeline system in order to keep the route identified, monitor possible leaks and breakdowns, and prevent damage to the infrastructure of the public potable-water service provided by the Association.
There is a risk of harm if the aqueduct structures and pipelines are not monitored, maintained, and serviced, which could impair the supply of water of suitable quantity and quality to those populations. The interest protected by this precautionary measure is the health of the persons who depend on that aqueduct for access to water that is suitably potable.
VI- Counter-security (contracautela). This provisional authorization for precautionary relief is granted, but subject to counter-security imposed on the Asociación Especifica de Acueductos de San José de Upala regarding the manner in which it must carry out such monitoring, maintenance, and repair work. This is due to the confirmed opening by the Association of a trail (trocha) in the forested area of property registration [Placa1] of Alajuela, according to the report entitled: “FORESTRY OVERSIGHT REPORT FOR PROTECTION OR CONSERVATION AND NATURAL REGENERATION,” which the Association stated in its answer fell within its powers as administrator of the aqueduct and of the aqueduct easement that it alleges was established by law. In the MINAE technical report, its officials recorded that damage had occurred to the existing forest, which is also subject to the Pagos por Servicios Ambientales program.
Accordingly, this Court orders the Asociación Especifica de Acueductos de San José de Upala as follows: a) it is prohibited from removing forest species without the respective permits and legally required authorizations; b) the Association’s officials and plumbers must enter the location of the water pipelines on the property of Alejandro Country Life S.A. in a manner that does not harm the forest. The monitoring, management, and maintenance of those structures must necessarily be performed, but with the least possible impairment of the natural resource. All conduct and actions must therefore respect the environment and the ecosystem. In other words, the environmental variable must be incorporated into their work process. No forest area beyond the existing cleared trails may be removed to open trails. c) In addition, entry onto the property for the authorized purpose shall be solely for that purpose and conducted in a manner causing the least possible disturbance to the plaintiff company. d) No improvements may be introduced or the current conditions of the passage areas altered until it is determined whether the plaintiff’s claim is legally viable.
The foregoing shall remain in effect until the lower court urgently conducts a judicial inspection to ascertain the physical conditions of the areas through which the aqueduct pipeline runs and determines whether the measure ordered by this Court should remain in effect, as well as whether the Association’s officials need to enter the property to access those pipelines. This shall be carried out as soon as possible to ascertain the physical conditions and assess the request for precautionary relief.
VII- In light of the reasoning set forth above, pursuant to sections 1,2,26 and 54 of the Agrarian Jurisdiction Act and sections 489 and 490 of the Labor Code, the decision issued at nineteen hours and seventeen minutes on the eighteenth of May of two thousand twenty shall be reversed insofar as it denied the precautionary measure requested by the Asociación Especifica de Acueductos de San José de Upala. In its place, the precautionary measure is granted, and Alejandro Country Life S.A. is ordered temporarily to allow the officials and plumbers of the defendant Association to enter its property for the sole purpose of maintaining and inspecting the aqueduct in the pipeline passage areas crossing part of that company’s property. This is to allow them to carry out brush clearing and maintenance work in the passage area of this potable-water distribution pipeline system, keep the route identified, monitor possible leaks and breakdowns, and prevent damage to the infrastructure of the public potable-water service provided by the Association.
As counter-security, the Asociación Especifica de Acueductos de San José de Upala is ordered as follows: a) it is prohibited from removing forest species; b) the Association’s officials and plumbers must enter the location of the water pipelines in a manner that does not harm the forest. It shall perform the monitoring, management, and maintenance of those structures with the least possible impairment of the natural resource. No forest area beyond the existing cleared trails may be removed to open trails. c) Entry onto the property for the authorized purpose shall be solely for that purpose and conducted in a manner causing the least possible disturbance to the plaintiff company. e) No improvements may be introduced or the current conditions of the passage areas altered until it is determined whether the plaintiff’s claim is legally viable. The foregoing is ordered provisionally due to the urgency of the matter, until the lower court urgently conducts a judicial inspection to ascertain the physical conditions of the areas through which the aqueduct pipeline runs and, by means of a judicial ruling, determines whether the measure ordered should remain in effect and whether the Association’s officials need to enter the property to access those pipelines. This shall be carried out as soon as possible to ascertain the physical conditions and assess the request for precautionary relief.
POR TANTO:
The decision issued at diecinueve horas y diecisiete minutos on dieciocho de mayo de dos mil veinte is reversed insofar as it denied the interim relief (medida cautelar) requested by the Asociación Especifica de Acueductos de San José de Upala. Instead, the interim relief is granted, and Alejandro Country Life S.A. is provisionally ordered to allow the officials and plumbers of the defendant Association to enter its property for the sole purpose of maintaining and inspecting the aqueduct in the pipeline easement areas (zonas de paso de la tubería) crossing part of that company’s property; to perform brush clearing (chapias) and maintenance work in the right-of-way area (área de paso) of this potable-water distribution pipeline system; to keep the route identified; to monitor for possible leaks and damage; and to prevent harm to the infrastructure of the public potable-water service provided by the Association.
As countersecurity (contracautela), the Asociación Especifica de Acueductos de San José de Upala is ordered as follows: a) it is prohibited from removing forest species without the corresponding permits and legally required authorizations; b) the Association’s officials and plumbers must enter the site where the water pipelines are located on the property of Alejandro Country Life S.A. in a manner that does not damage the forest, and the monitoring, management, and maintenance of those structures must be carried out with the least possible harm to the natural resource; c) entry onto the land for the authorized purpose must be undertaken solely for that purpose and in a manner causing the least possible inconvenience to the plaintiff company; e) no improvements shall be introduced or the current conditions of the right-of-way areas altered until it is determined whether the claimant’s claim is viable.
The foregoing is ordered provisionally due to the urgency, until the trial court urgently conducts a judicial inspection (reconocimiento judicial) to verify the physical conditions of the areas through which the aqueduct pipeline runs and determines, by means of a judicial decision that it must issue, whether the ordered measure should remain in effect and whether the Association’s officials need to enter those pipeline areas. This shall be carried out as promptly as possible in order to verify the physical conditions and the application for interim relief.

VOTO N° 490-F-2020 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las dieciocho horas y veinticinco minutos del veintiocho de mayo de dos mil veinte.- MEDIDA CAUTELAR promovida por ASOCIACIÓN ESPECIFICA DE ACUEDUCTOS DE SAN JOSÉ DE UPALA, cédula jurídica CED1 - - , representada por su presidente [Nombre1] , mayor, casado una vez, vecino de Alajuela, cédula de identidad CED2 - - ; dentro de PROCESO ORDINARIO establecido por ALEJANDRO COUNTRY LIFE SOCIEDAD ANÓNIMA, cédula jurídica CED3 - - , representada por [Nombre2] , mayor, casada, oficios del hogar, vecina de Alajuela, cédula de identidad CED4 - - ; contra ASOCIACIÓN ESPECIFICA DE ACUEDUCTOS DE SAN JOSÉ DE UPALA, de calidades antes mencionadas. Actúa como defensor público de la parte actora, el licenciado Dennis Paniagua Navarro, de calidades desconocidas en autos; y como abogado director de la parte demandada, el letrado Miguel Ángel Orozco Velázques, colegiado dieciocho mil seiscientos setenta y tres. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de Alajuela, Upala.- Redacta la jueza Castro García; y,
CONSIDERANDO:
I.Se recurre por la Asociación accionada (expediente digital/escritos/fecha 06:22:39) la decisión numero 2020000072 de las 19:17 del 18 de mayo de 2020 (expediente digital/documentos/fecha: 18/05/2020 hora 19:17:49). En tal resolución se rechazó la medida cautelar pedida por la demandada que no existen pretensiones de la accionada al no haber contrademandado no procede acoger la medida cautelar. Como temas de apelación se exponen: a) Necesidad de reconvenir para solicitar una medida cautelar. En el primer agravio invoca el artículo 77 del Código Procesal Civil y la transgresión del oportunidad, legitimación, igualdad procesal y responsabilidad de la tutela cautelar que le asiste. Reclama, si planteó pretensiones concretas en su contestación de demanda. Agrega, esa norma legal supletoria referida, determina el presupuesto de obligatoriedad de reconvención para acceder a una medida cautelar.
Hace ver, se indica en tal: “Salvo disposición expresa en contrario, estas se decretarán a solicitud de parte y bajo su responsabilidad”. Por lo que la posición de la resolución no tiene asidero legal y conforme el principio de igualdad procesal del numeral 2.1 Ibídem, ambas partes tienen derechos dentro del proceso, incluidas, las medidas cautelares. b) Omisión de valoración de la probabilidad o verosimilitud de la pretensión. Reclama, se han transgredido los artículos 78 y 79 Ibídem, pues se razona el rechazo por el incumplimiento de los presupuestos, finalidad y admisibilidad. Esboza, la apelante si tiene pretensiones en la contestación de la demanda que tienden a defender sus derechos e intereses; las que no se estudiaron. Así mismo se justifica en la ausencia del peligro de pérdida, alteración o daño para dictar la medida y por ello sin apariencia de buen derecho, proporcionalidad y razonabilidad, carente de relación con la pretensión y la eventual afectación a terceros o al interés público.
Ante lo que arguye, con la declaratoria de Emergencia Nacional por el Coronavirus que causa la enfermedad COVID-19, las autoridades de la Presidencia de la República, el Ministerio de Salud, la Caja Costarricense del Seguro Social y la Comisión Nacional de Emergencias, entre otras instituciones, recomendaron y conminaron a las familias a quedarse en sus casas. Además de ser suspendidas las actividades escolares. Lo que ha provocado una mayor cantidad de personas en sus hogares que genera un aumento de la demanda de agua potable por las personas usuarias del acueducto que administra la Asociación. Explica, ese mayor consumo de agua potable y la época seca produce una menor disponibilidad del recurso hídrico: Situación que ha causado dificultades para mantener el llenado de los tanques de captación del agua potable, que se alimentan por el agua que se transporta por las tuberías que atraviesan la finca de la parte accionante.
Lo que ha obligado a la Asociación apelante a realizar los recorridos de inspección de toda su red de acueducto como una buena práctica proteger el abastecimiento. Por lo que la Asociación requiere realizar dichos recorridos de inspección en el acueducto, infraestructura, tubería y válvulas, ubicados dentro de la finca de la parte actora, a fin de poder diagnosticar y recomendar medidas que tiendan a proteger el acueducto en medio de esta Emergencia Nacional. Señala, las zonas de paso, la tubería de distribución de agua potable, válvulas y toda la infraestructura de acueducto instalada en el terreno de la actora, no ha sido inspeccionada en los últimos meses; o que es de urgencia dada la crisis de la pandemia. Agrega, han debido colocar lavatorios de uso público en diferentes puntos de las comunidades beneficiadas, con el fin de lograr que muchas familias y personas de escasos recursos que no son abonados, tengan acceso al agua potable, al lavado de manos y combatir la posible transmisión del coronavirus que enferma a las personas con COVID-19.
Cita, además de lo anterior reclaman, el acueducto posee una servidumbre legal en los términos del artículo 73 de la Ley de Aguas. Pues se trata de un conflicto de aguas de dominio público y por esa razón han solicitado se ordene en contra de la actora, con fundamento en el artículo 116 de la Ley de Aguas, de forma urgente y provisional se conceda la medida cautelar. Refuta, existe peligro de daño del derecho humano de acceso al agua de los abonados de la Asociación, en caso de no acogerse la medida cautelar solicitada que consiste en autorizar los recorridos de inspección del acueducto que atraviesa la finca de la actora, inscrita en el Registro Público de Alajuela matrícula [Placa1]. Señala, en los últimos años, la accionante ha impedido a la Asociación realizar recorridos de inspección del estado del acueducto, infraestructura, tubería y válvulas, cuando en reiteradas oportunidades los fontaneros y trabajadores de la Asociación no han podido hacer recorridos de inspección en la zona de conflicto porque los personeros de la sociedad aquí actora, no han otorgado permisos para acceder a la finca y realizar los recorridos preventivos que el acueducto requiere conocer.
Por lo que no ha habido inspección en las zonas de paso, la tubería de distribución de agua potable, válvulas e infraestructura del acueducto existente. Lo cual es necesario en el marco de las acciones que la Asociación realiza para proteger de afectaciones el acueducto, en medio de la pandemia por COVID-19. c) Omisión de valoración de la petición cautelar e infracción del artículo 92 del Código Procesal Civil. Esboza, esa norma legal faculta a la persona juzgadora se dictar otras medidas cautelares como el acceso a fundos enclavados y cualquier de naturaleza conservativa, innovativa o anticipativa. Se pide por su parte, en forma urgente, de forma provisional y sin audiencia, una medida cautelar atípica de acceso, para autorizar provisionalmente a la Asociación, en medio de la Emergencia Nacional por la enfermedad COVID-19.A fin de que los personeros competentes como inspectores y fontaneros, realicen recorridos de inspección de posibles daños en el acueducto que atraviesa parte de la finca inscrita citada, al menos dos veces por mes; ello, para inspeccionar y prevenir afectaciones al acueducto, proteger y conservar el abastecimiento de agua potable a los tanques de captación que distribuyen agua a las comunidades beneficiarias.
Lo que permitiría diagnósticar y recomendar lo necesario para proteger y conservar el abastecimiento de agua potable a los tanques de captación que distribuyen agua a los pobladores. Por lo que la medida cautelar es conservativa, innovativa y anticipativa; lo cual no se valoró. d) Ausencia de estudio de los presupuestos y finalidad de la cautelar. Aduce, existe peligro de daños, apariencia de buen derecho, proporcionalidad y razonabilidad, dada la ausencia del conocimiento del estado del acueducto, diagnósticos y recomendaciones necesarios para proteger y conservar el acueducto. Aunado a que solicitaron por su parte, se le mantenga en la posesión y servidumbre de uso público de acueducto sobre el terreno de la actora, y que la misma se abstenga de perturbar la posesión y servidumbre. LO que busca la medida es el derecho de inspección de posibles daños de dicho acueducto que puedan afectar el llenado de tanques de captación a fin de evitar afectación a terceros o al interés público. e) Violación del derecho de defensa.
Solicitan medida cautelar urgentísima contra la actora, a fin de que el Juzgado le permitiera a la Asociación desarrollar recorridos de inspección del acueducto que atraviesa en parte la finca de la actora, a fin de preservar el servicio público de agua potable. Dado el impedimento. Y piden un reconocimiento judicial, prueba testimonial, prueba documental, declaración de parte, como medio de prueba de las pretensiones cautelares. Prueba que se pasó por alto y que es necesaria para verificar la pertinencia y condiciones de la medida, muy a pesar que el presente asunto es un proceso ordinario en donde la parte actora pretende una acción nugatoria de servidumbre y la demandada busca el reconocimiento de una servidumbre legal que por su naturaleza de acueducto de agua potable no requiere publicidad material si quiera. Acusa, existe un vicio de nulidad de carácter formal, que provocó indefensión a la parte demandada-.
Pues, el rechazo de la medida solicitada se dictó ayuno de elementos fácticos, sin prueba idónea que le hubiera ayudado al la jueza sustentar y fundamentar su decisión judicial. f) Falta de fundamentación. Reclama no se razonó el rechazo de la medida cautelar, sino que se deniega basado en el argumento de la falta de reconvención por su parte. Lo que no es un análisis de las cuestiones debatidas y se viola el deber de motivación de la sentencia. Por lo que se le impide conocer los razonamientos que justifican la decisión judicial, lesionando el derecho de defensa de la Asociación. Aporta como elementos probatorios de su recurso la demanda, contestación y prueba documental que obran en autos. Pide se acoja el recurso de apelación con nulidad concomitante. Se revoque la resolución apelada y se acoja la medida cautelar. En su lugar, se anule la decisión.
II- Antes que nada cabe citar lo decidido por este Tribunal en Voto número 000942-F-2019 de las quince horas y treinta y ocho minutos del catorce de noviembre de dos mil diecinueve: " la Ley de Jurisdicción Agraria contiene varios vacíos procesales que deben ser integrados por el Código de Trabajo en primer orden y en su defecto, por la normativa procesal civil. Por ello, independientemente de la vigencia del Código Procesal Agrario, son de aplicación supletoria el Código de Trabajo número 9343 a partir del 25 de julio de 2017 y del Código Procesal Civil número 9342, el 8 octubre de 2018. En el código del proceso agrario se encuentra reguladas las medidas cautelares típicas, tales como el arraigo y el embargo preventivo (artículos 33 y 34 ibid.). Dada la ausencia de regulación especial en el cuerpo procesal agrario sobre medidas cautelares atípicas, y dada la supletoriedad del Código de Trabajo, se debe emplear en primer orden ese cuerpo legal.
Se aclara este asunto inició el 14 de mayo del 2019 según escritorio digital. Para ese momento ya se encontraba en vigor la ley del proceso laboral la cual regula las medidas cautelares en la sección V, numerales 489 a 494. El primer ordinal regula lo siguiente: “Antes de iniciarse el proceso y durante su tramitación, inclusive en la fase de ejecución, el órgano jurisdiccional podrá ordenar las medidas cautelares adecuadas y necesarias para proteger y garantizar, provisionalmente, el objeto del proceso y la efectividad de la sentencia. También, podrá ordenar cualquier medida preparatoria o anticipada necesaria para la preservación del ejercicio de un futuro derecho, así como cualquier otra medida atípica que no exceda los límites de racionalidad y proporcionalidad. En estos casos, el órgano puede disponer de forma prudente todo lo necesario para lograr el objetivo de la medida, de modo que no se incurra en extralimitaciones.
Con respecto a la tipología de las medidas, tanto cautelares como preparatorias, a los efectos y a la forma de practicarlas, sustituirlas o levantarlas, se estará a lo dispuesto en la legislación procesal civil, con las excepciones que se indican a continuación”. Esta norma se debe complementar con el canon 490 de ese código. De lo anterior se establece: 1. Pueden ser instauradas antes o durante el curso del proceso incluyendo la etapa de ejecución de sentencia. 2. Procuran proteger y garantizar provisionalmente el objeto del proceso y la efectividad de la sentencia, preservar el ejercicio del derecho futuro. 3. Se admiten medidas atípicas las cuales deben ser racionales y proporcionales para garantizar el eventual futuro derecho. 4. Puede ser ordenada a solicitud de parte o de oficio. 5. Se tutela la contracautela de oficio, la cual debe de ser prudente y evitar la extralimitación. 6. Supletoriamente se remite al proceso civil en cuanto a la tipología, los efectos la forma de practicarlas, sustituirlas o levantarlas con las excepciones dada por la legislación laboral. 7.
En la práctica de la cautelar el tribunal debe actuar de manera diligente para evitar se frustre el fin perseguido. De lo anterior considera esta Cámara es dable continuar manteniendo el criterio de vieja data respecto a los requisitos de procedibilidad de las medidas. Las cuales, además, de haber empleado el derogado Código Procesal Civil de 1989, se alimentaban de la doctrina emanada de la Sala Constitucional de la Corte Suprema de Justicia, la cual es vinculante erga omnes de conformidad al numeral 13 de la Ley de la Jurisdicción Constitucional. En la sentencia número 7190 de las 15 horas 24 minutos del 6 de diciembre de 1994, ha indicado lo siguiente: "...Las medidas asegurativas o cautelares, según la más calificada doctrina, surgen en el proceso como una necesidad que permita garantizar una tutela jurisdiccional efectiva y por ello se pueden conceptualizar como "un conjunto de potestades procesales del juez -sea justicia jurisdiccional o administrativa- para resolver antes del fallo, con el específico fin de conservar las condiciones reales indispensables para la emisión y ejecución del acto final".
La doctrina entiende que la instrumentalidad y la provisionalidad son dos características fundamentales de las medidas cautelares y que sus principales elementos configurativos, exigen que deban ser: a) lícitas y jurídicamente posibles; b) provisionales, puesto que se extinguen con el dictado del acto final; c) fundamentadas, es decir, tener un sustento fáctico real con relación al caso particular; d) modificables, en el sentido que son susceptibles de aumentarse o disminuirse para adaptarlas a nuevas necesidades; e) accesorias, puesto que se justifican dentro de un proceso principal; f) de naturaleza preventiva, ya que tienen como objeto evitar inconveniencias a los intereses y derechos representados en el proceso principal; g) de efectos asegurativos, al pretender mantener un estado de hecho o de derecho durante el desarrollo del proceso, previniendo situaciones que puedan perjudicar la efectividad de la sentencia o acto final; h) ser homogéneas y no responder a características de identidad respecto del derecho sustantivo tutelado, con el fin de que sean medidas preventivas efectivas y no actos anticipados de ejecución".
De lo explicado de manera amplia se denota que se debe observar la apariencia de buen derecho, porque en el examen de proporcionalidad es menester observar a partir de la lectura de los hechos y pretensiones que la decisión a tomar por el órgano judicial tienda a mantener un estado de hecho o de derecho durante el desarrollo del proceso, previniendo situaciones que puedan perjudicar la efectividad de la sentencia o acto final, según lo explica la Alta Sala Constitucional...Dado lo reiterado en la novísima regulación procesal laboral sobre la razonabilidad, esta Sede ha considerado relevante retormar el desarrollo de tal examen a partir de los criterios de la Sala Constitucional referida. En la decisión 732-2001 de las 12 horas 24 minutos del 26 de enero de 2001 de la Sala Constitucional se delimitó el principio de razonabilidad de la siguiente manera: “V.- DEL PRINCIPIO DE RAZONABILIDAD COMO PARÁMETRO CONSTITUCIONAL.
La jurisprudencia constitucional ha sido clara y conteste en considerar que el principio de razonabilidad constituye un parámetro de constitucionalidad … Para realizar el juicio de razonabilidad la doctrina estadounidense invita a examinar, en primer término, la llamada "razonabilidad técnica" dentro de la que se examina la norma en concreto (ley, reglamento, etc.). Una vez establecido que la norma elegida es la adecuada para regular determinada materia, habrá que examinar si hay proporcionalidad entre el medio escogido y el fin buscado. Superado el criterio de "razonabilidad técnica" hay que analizar la "razonabilidad jurídica". Para lo cual esta doctrina propone examinar: a) razonabilidad ponderativa, que es un tipo de valoración jurídica a la que se concurre cuando ante la existencia de un determinado antecedente (ej. ingreso) se exige una determinada prestación (ej. tributo), debiendo en este supuesto establecerse si la misma es equivalente o proporcionada; b) la razonabilidad de igualdad, es el tipo de valoración jurídica que parte de que ante iguales antecedentes deben haber iguales consecuencias, sin excepciones arbitrarias; c) razonabilidad en el fin, en este punto se valora si el objetivo a alcanzar, no ofende los fines previstos por el legislador con su aprobación.
Dentro de este mismo análisis, no basta con afirmar que un medio sea razonablemente adecuado a un fin; es necesario, además, verificar la índole y el tamaño de la limitación que por ese medio debe soportar un derecho personal. De esta manera, si al mismo fin se puede llegar buscando otro medio que produzca una limitación menos gravosa a los derechos personales, el medio escogido no es razonable...” (En igual sentido Votos Nos. 843-02 del 30 de enero de 2002; 5374-03 del 20 de junio de 2003; 340-04 del 16 de enero de 2004; 846-05 del 28 de enero de 2005; 1800-05 del 23 de febrero de 2005; 2236-05 del 2 de marzo de 2005; 1806-06 del 15 de febrero de 2006; 1807-06 del 15 de febrero de 2006 y 1557-07 del 7 de febrero de 2007 y 1571-08 del 15 de enero de 2008)”. Sumado a lo anterior, en el voto de la Alta Sala en mención número 8858-98 de las 16 horas 33 minutos del 15 de diciembre de 1998 se amplía el desarrollo jurisprudencial de tal principio de la siguiente manera: “Así, un acto limitativo de derechos es razonable cuando cumple con una triple condición: es necesario, idóneo y proporcional.
La necesidad de una medida hace directa referencia a la existencia de una base fáctica que haga preciso proteger algún bien o conjunto de bienes de la colectividad -o de un determinado grupo- mediante la adopción de una medida de diferenciación. Es decir, que si dicha actuación no es realizada, importantes intereses públicos van a ser lesionados. Si la limitación no es necesaria, tampoco podrá ser considerada como razonable, y por ende constitucionalmente válida. La idoneidad, por su parte, importa un juicio referente a si el tipo de restricción a ser adoptado cumple o no con la finalidad de satisfacer la necesidad detectada. La inidoneidad de la medida nos indicaría que pueden existir otros mecanismos que en mejor manera solucionen la necesidad existente, pudiendo algunos de ellos cumplir con la finalidad propuesta sin restringir el disfrute del derecho en cuestión. Por su parte, la proporcionalidad nos remite a un juicio de necesaria comparación entre la finalidad perseguida por el acto y el tipo de restricción que se impone o pretende imponer, de manera que la limitación no sea de entidad marcadamente superior al beneficio que con ella se pretende obtener en beneficio de la colectividad.
De los dos últimos elementos, podría decirse que el primero se basa en un juicio cualitativo, en cuanto que el segundo parte de una comparación cuantitativa de los dos objetos analizados." De los extractos anteriores se infieren varios aspectos, los cuales tienen incidencia en este asunto. El primero radica, si el fin se puede alcanzar buscando otro medio que produzca una limitación menos gravosa a los derechos personales, entonces el medio escogido no es razonable; y por otra parte lo razonable debe ser necesario, idóneo y proporcional.VI. Cuando la Cámara Constitucional analiza la razonabilidad, introduce el tema de la necesidad cuando se va a limitar derechos como una de las condiciones (además de lo idóneo y proporcional) es la necesidad. Conviene en consecuencia retomar lo indicado por esa Instancia Constitucional enmarcado dentro de lo preceptuado en el canon 41 de la Constitución Política en cuanto las medidas cautelares constituyen un derecho fundamental.
En términos de la Sala Constitucional de la Corte Suprema de Justicia se puede determinar en las cautelares prevalece una necesidad de orden procesal: “Es en este sentido que las medidas cautelares –o asegurativas– surgen en el proceso como una verdadera necesidad procesal, en tanto permite garantizar una efectiva tutela al acceso a la justicia (se repite, tanto jurisdiccional como administrativa); de donde, se pueden conceptualizar como el “conjunto de potestades procesales del juez –sea justicia jurisdiccional o administrativa– para resolver antes del fallo, con el específico fin de conservar las condiciones reales indispensables para la emisión y ejecución del acto final” (sentencia número 7190-94, de las quince horas veinticuatro minutos del seis de diciembre de mil novecientos noventa y cuatro)”, Sala Constitucional de la Corte Suprema de Justicia, voto [Telf1] del primero de febrero de 2006.
De ahí comprende esta instancia, el estado de necesidad refiere a una situación de peligro actual para los intereses protegidos por el derecho. Para la tutela efectiva de ese derecho que se alega estar en peligro, conlleva a un dilema. El cual implica la disminución de intereses jurídicos protegidos de otro justiciable u institución. En el supuesto específico de las medidas cautelares en materia agraria, para su procedibilidad se debe estar en presencia de situaciones anormales y excepcionales, las cuales han de ser ponderadas en cada caso. La necesidad de orden procesal se ha unido al peligro en la demora, sea en cuanto más tarde el proceso, su resultado podría ser nugatorio por la variación de las circunstancias que se aspiran a tutelar en el litigio, y con ello carecer la persona justiciable de un acceso real a la justicia. En el punto de la disminución de los derechos de las otras personas que podrían verse involucradas en la asunción de la cautelar, el límite para tal es que lo resuelto en la medida no sea ilícito y dañino.
De ahí ingresa en el proceso de ponderación la razonabilidad y proporcionalidad." Resolución que aclara el régimen de aplicación supletoria de legislación procesal a los procesos agrarios y el fundamento de las medidas cautelares. III- Cabe mencionarse que el fundamento en la decisión recurrida para el rechazo de la medida cautelar solicitada por la Asociación recurrente, es la ausencia de contrademanda de su parte. Para este Tribunal tal decisión es errada, sobre todo en un caso como el presente en donde resulta lógico deducir que la accionada pide se le autorice la inspección e ingreso para mantenimiento y vigilancia a la estructura existente en la realidad y que forma parte del sistema de acueducto que abastece de agua potable a una población. Recurso hídrico administrado por este tipo de asociación que por Ley tiene encomendado gestionar el suministro del vital líquido a la ciudadanía.
Es decir, se vincula con un tema del Derecho al Agua en cantidad y sobre todo calidad óptima. Es decir, sobre un derecho humano del que pende la vida y la salud. Aspectos no analizados en la sentencia cautelar, así como tampoco el elenco de prueba y elementos aportados al momento de la emisión de la decisión cautelar; tal y como se reclama en el recurso que se conoce. Lo anterior se deduce por esta Cámara, de las pretensiones de la demanda ordinaria negatoria de servidumbre que interpuso la sociedad Alejandro Country Life S.A. contra la Asociación Específica de Acueductos de San José de Upala, se pide en el elenco de pretensiones en lo de interés: " PRINCIPAL: .... Con lugar la presente demanda en todos sus extremos acogiendo este proceso ordinario de pleno derecho y de acción negatoria agraria, rechazando cualquier excepción presentada por la asociación demandada. Que se declare que la sociedad actora es propietaria y única poseedora de la propiedad inscrita.. matrícula folio real [Placa2] del partido de Alajuela, .. plano debidamente inscrito en Catastro Nacional A0014593-1974.
Que se declare que sobre la finca matrícula folio real CED5 del partido de Alajuela, no pesa ninguna carga real de obligación forzosa de paso, de cañería o servidumbre similar. Que se declare que la asociación demandada por medio de sus funcionarios, afectó la propiedad de la sociedad actora sobre la finca matrícula folio real CED5 del partido de Alajuela, utilizándola como paso, provocando daños ambientales por medio de la construcción de una trocha y que mantiene una cañería que atraviesa esta misma propiedad, sin que tenga autorización alguna por parte de la sociedad actora para hacerlo. Que se ordene a la asociación demandada a abstenerse tanto por medio de sus representantes como por interpósita persona a su orden, de continuar perturbando la propiedad de la actora, prohibiéndole el paso sobre la finca matrícula folio real CED5 del partido de Alajuela, así se le advierta que de no atender esta orden, a sus representantes se les podría seguir una causa penal por el delito de desobediencia a la autoridad.
Que se ordene a la asociación demandada que deberá quitar a más tardar dentro de un mes firme la sentencia, la cañería, tubos y materiales que tenga dentro de la propiedad de la sociedad actora, caso contrario se le advierta que de no atender esta orden, a sus representantes se les podría seguir una causa penal por el delito de desobediencia a la autoridad. Que se obligue a la asociación demandada a pagar los daños y perjuicios ocasionados por la construcción de la trocha que realizaron sus funcionarios dentro de la propiedad de la sociedad actora, los cuales se describen y valoran de la siguiente manera: Daños: ocasionados por la construcción de un camino o trocha a lo largo de 300 metros sobre el área de bosque de la finca de la sociedad actora, siendo un área total de 600 metros cuadrados, valorados los daños en la suma de tres millones de colones (03.000.000,00)..... Perjuicios: ocasionados al no poder disponer del área afectada, así como la preocupación de los representantes de la sociedad actora por una inminente sanción ambiental al ser ellos los encargados de proteger la zona boscosa, se estiman estos perjuicios en la suma de dos millones de colones... 8- Que se imponga la obligación a la demandada de pagar ambas costas del proceso...
PRETENSIÓN SUBSIDIARIA: De conformidad con lo expuesto solicito que subsidiariamente se ordene en caso de considerarse no procedente lo pretendido en el punto 3 (en cuanto a que sobre la finca matrícula folio real CED5 del partido de Alajuela, no pesa ninguna carga real de obligación forzosa de paso, de cañería o servidumbre similar), que la asociación demandada deberá remunerar a la sociedad actora, por la constitución de la servidumbre ya sea de paso o de cañería (permitir la permanencia del tubo que transporta el agua potable), en los montos que establezca un perito que para estos efectos se designe, tomando en cuenta el valor del metro cuadrado de las porciones de terreno en los que conste la servidumbre que se decrete como existente. " En los hechos de la demanda se reclama que adquirió el inmueble en el año 2007 libre de gravamen de servidumbre. Señala, el uso del fundo es agrícola con áreas de conservación de bosque y han actuado en defensa del mismo.
Cita, la asociación demandada es la encargada de administrar el acueducto rural que abastece a una gran población del distrito de San José de Upala. Menciona, en la parte este del terreno y dentro de la finca de un tercero, esa entidad tiene una toma de agua sobre una naciente. En el hecho quinto se cita que poco tiempo después de la compra del terreno se enteran que a través del mismo pasa un tubo madre por el cual se trasladaba agua potable a cargo de la Asociación accionada y que algunos de sus funcionarios estaban pasando por medio de la finca. Específicamente en el área de bosque protegida. Con la finalidad de evitar caminar algunos metros de más, a través del paso que lleva directamente hacia la toma de agua de la naciente que abastece el distrito de San José. Señala, enterados, no se hizo protesta y se permitió por mera tolerancia, que ese tubo continuara pasando por la finca, por no existir en esa fecha ningún problema con los representantes de la demandada.
Explica en los hechos sexto a octavo que los conflictos surgen dos años antes, cuando los funcionarios de la demandada para llegar a la toma de agua ubicado en finca de un tercero, transitan por su terreno y producen daños considerables al bosque protegido, con la finalidad de facilitarse el paso hacia dicha toma. Se procedió a llamar a los funcionarios del MINAE para que realizaran la valoración y un informe donde se detallan que efectivamente se produjo un daño ambiental por cerca de 600 metros cuadrados, al realizar una trocha. Indica, al cuestionar a esa Asociación del motivo de ese hecho y sobre que acciones tomarían para recuperarlo, no se obtuvo respuesta, en total desprecio hacia su derecho de propiedad y la conservación de los recursos naturales. Afirma, actualmente esas personas continúan pasando a través de la trocha creada en su finca, sin tener derecho alguno de servidumbre;afectando continuamente el bosque protegido.
Aunado a que el tubo por el que se conduce el agua desde la toma en una propiedad vecina hacia las poblaciones cercanas, transcurre dentro de su fundo, sin que para ello se constituyera servidumbre de acueducto en afectación de la finca que le pertenece. Pues no se gestionó la constitución del gravamen de esa servidumbres; sea de manera consensuada o forzosa: Sin que se reciba tampoco indemnización o remuneración de resarcimiento de la afectación del derecho de propiedad. (imagen 137 a 146 de expediente digital modo pdf). Con la demanda se aporta un documento denominado: "INFORME DE REGENCIA FORESTAL PARA PROTECCIÓN O CONSERVACIÓN Y REGENERACIÓN NATURAL", que indica corresponde a contrato (FONAFIFO): SC-01-22-0216-2016 por visita del 09/12/2017, sobre el inmueble: 275172 de Alajuela, cantón Upala, [Dirección1] , plano A-014593-1974, titular Alejandro Country Lite S.A. Sobre Área de bosque sometida a PSA (ha): Sesenta y uno punto nueve hectáreas (61.9 ha).
En lo de interés se anotó: "Se realizó una trocha no autorizada entre la línea [Dirección2] del derrotero del Croquis del Área PSA. específicamente entre el punto GPS ([Dirección3] (coordenadas [Dirección4]), la cual se adentra 300.metros sobre el área de bosque PSA. Esta trocha la realiza la ASADA San José de Upala a fin no continuar la línea o lindero del bosque, evitar una sección de pendiente muy fuerte. La afectación es de 600 m2 (0.01% del Área PSA) y corresponde - una trocha para mantenimiento de las líneas de conducción de agua potable_....III. RECOMENDACIONES .... No hay ninguna modificación al Estudio Técnico, el área efectiva se mantiene. Se debe mantener el cumplimiento de las disposiciones administrativas, técnicas y legales señaladas en el Contrato suscrito con el Estado. Informar al Regente Forestal por un medio registrable sobre cualquier cambio en el bosque o alteración que amerite su atención inmediata.
La ASADA San José de Upala entrega Nota (Oficio ASESAP-1D-006-2017) a fin de justificar los trabajos y mantener una comunicación entre las partes, para así evitar desacuerdos (Ver Nota adjunta), esta evidencia afecta en un 0.01% el total del Área PSA y no amerita ninguna modificación del Estudio Técnico o Contrato. Se recomienda el pago de la cuota respectiva". En la contestación de la demanda se indica por la Asociación, es una organización sin fin de lucro, que hace 22 años es poseedora del área de paso de la tubería madre. Misma que en parte, atraviesa la propiedad de la actor. Tal, está demarcado, con infraestructura visible, cajas de válvulas y otras obras, por lo que su derecho se ha consolidado como servidumbre de acueducto de uso público. Que no debe tener publicidad registral, en razón del suministro a la población del derecho humano al agua potable. Invoca el ordinal 119 de la Ley de Aguas, que prescribe que el acueducto es elemento integrante de la heredad o edificio a que van destinadas las aguas.
Por lo que es la demandada la propietaria. Señala, son una ASADA, que desde la fecha indicada funge como administradora del acueducto de agua potable en los distritos de San José, Delicias y [Dirección5] Upala de Alajuela. Con actualmente 2600 abonados del servicio de agua potable. Describe, se capta agua de una toma hecha en una naciente localizada en Armenias de Aguas Claras de Upala. En finca ubicada a más de 10 kilómetros de la propiedad de la actora y se mantiene una tubería que atraviesa en parte esta finca. Todo hace más de veintidós años, en virtud de que el anterior dueño [Nombre3] , fue un entusiasta impulsor del acueducto, para lo que se trabajó en la construcción del proyecto y facilitó a la Asociación el derecho de paso de tubería, así como el derecho de paso en la finca a los funcionarios y fontaneros para darle mantenimiento a la infraestructura de captación y a la zona de paso de la tubería.
Derecho que se goza desde hace mucho tiempo por los motivos explicados y se ha ejercido acorde con el artículo 99 y 73 de la Ley de Aguas y no necesita la imposición de servidumbre por tratarse de una servidumbre de uso público de acueducto. Señala, sobre la zona de paso de la tubería que atraviesa parte de la finca de la actora, se ha ejercido por su parte una posesión de forma quieta, pública, pacífica, notoria, sin interrupción, a título de dueña, con justo título, de buena fe y por más de veintidós años. Por muchos años antes de que la actora fuera la propietaria mediante actos posesorios de chapias, instalación de la tubería de acueducto y en labores de mantenimiento del área de paso de este sistema de tubos de distribución de agua potable, manteniendo identificando la ruta, vigilando posibles fugas y averías y previniendo afectaciones a la infraestructura del servicio público de agua potable que brinda la Asociación.
Menciona, todo el trayecto en las fincas esta demarcada, delimitada, con tubería e infraestructura de captación visible, cajas de válvulas e identificada sobre su ruta de paso, por lo cual, el acueducto sí es aparente y la servidumbre de paso también es continua y aparente, Por lo que la ha adquirido por prescripción positiva, al haberse poseído desde que la finca pertenecía al anterior dueño. Y por estar de por medio un servicio público esencial protege el derecho humano al agua, el acueducto y su infraestructura de distribución no requiere publicidad registral de constitución de servidumbre al estar en beneficio del servicio público de interés general, en los términos del ordinal 73 de la Ley de Aguas. Se menciona la literalidad del artículo 116 de la Ley de Aguas referido a la potestades del dueño de un acueducto sobre la posibilidad de fortificar las márgenes con céspedes, estacadas, paredes o ribazos de piedra suelta, pero no con plantaciones de ninguna clase.
De igual forma, que el dueño del predio sirviente, no podrá hacer plantación ni operación alguna de cultivo en las mismas márgenes; y las raíces que penetren en ellas, podrán ser cortadas por el dueño del acueducto.”. Por lo que estima que la Asociación goza del derecho de mantenimiento sobre el acueducto en la parte que atraviesa la finca de la actora. Cita, los elementos del acueducto, cumplen un interés público y por ello no es necesaria la publicidad registral para permitir su paso. Sino de publicidad material, que por su naturaleza está destinada a satisfacer un derecho humano fundamental como es el agua potable de los poblados beneficiados y las pros abonados. Refuta, la actora, desde que adquiere la finca sabía del acueducto, al ser el anterior dueño, [Nombre3] , el impulsor del mismo y haber trabajado en la construcción y facilitó el derecho de paso del acueducto de los funcionarios y fontaneros que le brindan el mantenimiento al acueducto y sus áreas de paso.
Niega, hubiera producido un daño ambiental. Pues la trocha referida por la actora constituye la realización de labores de mantenimiento del sistema de tubería del acueducto, que requiere de chapias constantes y limpiezas de las áreas de paso, así como acceso de los funcionarios y fontaneros de la Asociación, con el fin de mantener la vigilancia por la ruta de la tubería madre, prevenir fugas y averías que afecten el servicio público de acueducto. Y ha sido poseedora de esas áreas de paso desde hace veintidós años y ha ejercido actos posesorios legítimos, constituyendo una servidumbre continúa y aparente de acueducto, de uso público, que a la luz de la norma del artículo 73 de la Ley de Aguas, no requiere publicidad registral en razón de la naturaleza de la servidumbre. Señala, en octubre de 2018, la actora buscó un acercamiento por escrito con la Asociación en donde propone se le brinde agua potable gratuita a cambio del uso del terreno por donde pasa la tubería madre.
Lo que no fue posible en virtud de la existencia de una servidumbre de uso público de acueducto, al amparo del artículo 73 de la Ley de Aguas. Y el 29 de octubre de 2018, se recibe nota de la actora donde pide se le cancele mensualmente 50 mil colones por el derecho de paso de la tubería madre del acueducto, retroactivo desde el 01/07/2018, gastos jurídicos, contrato, solicitud de permiso para ingreso y poner la situación en conocimiento de la Asamblea General Ordinaria de la Asociación. Lo que es imposible legalmente para la Asociación dada la naturaleza del servicio que se presta. Por lo que no fue desprecio del derecho de propiedad de la actora, sino que sus peticiones se encuentran al margen de la ley y del manejo de los intereses de la Asociación como ente administrador del acueducto. Aunado a que la Asociación es legítima poseedora del área de paso de la tubería madre que atraviesa parte de la finca de la actora, desde hace veintidós años.
Interpone excepción de falta de derecho, por estar de por medio tratarse de una constitución de servidumbre legal existente constituida en los términos del ordinal 73 de la Ley de Aguas, de litis consorcio pasivo necesario respecto al Instituto de Acueductos y Alcantarillados y a la Procuraduría General de la República. Como Medida cautelar urgentísima pide, que en aras de evitar un grave daño a la actividad de mantenimiento de acueducto y a la prestación del servicio de agua potable, considerando que el acueducto es una servidumbre legal en los términos del artículo 73 de la Ley de Aguas y que se trata de un conflicto de aguas de dominio público, se ordene como medida cautelar en contra de la actora, con base en el artículo 116 de la Ley de Aguas, permitir a la Asociación acceder con sus funcionarios y fontaneros a darle mantenimiento a la zona de paso de la tubería que atraviesa parte de la finca de la actora, a fin de ejercer chapias y labores de mantenimiento del área de paso de este sistema de tubos de distribución de agua potable, para mantener identificada la ruta, vigilar posibles fugas y averías y prevenir afectaciones a la infraestructura del servicio público de agua potable que brinda la Asociación.
Como "pretensión" de su contestación pide: "1. Solicito a su Autoridad declarar sin lugar la demanda. 2. Declarar con lugar las excepciones incoadas. 3. Declarar con lugar la medida cautelar incoada. 4. Mantenerme en la posesión y servidumbre de uso público de acueducto sobre el terreno parte la finca de la actora que utiliza la Asociación a fin de realizar chapias y labores de mantenimiento del área de paso de este sistema de tubos de distribución de agua potable, a fin de mantener identificada la ruta, vigilar posibles fugas y averías y prevenir afectaciones a la infraestructura del servicio público de agua potable que brinda la Asociación. 5. Requerir a la actora para que, en lo sucesivo, se abstengan de perturbar la posesión y servidumbre de uso público de acueducto que ejerce la Asociación, bajo el apercibimiento de que, en caso contrario, serán juzgados por el delito de desobediencia a la autoridad. 6.
Condenar a la actora al pago de las costas procesales y personales de este proceso. " IV- En el auto sentencia cautelar se razonó en lo de interés: " Es necesario agregar a lo anterior que la tutela cautelar resulta accesoria a una pretensión principal incoada por alguna de las partes ante el órgano jurisdiccional, y se presenta ante un eventual estado de necesidad por garantizar el resultado del proceso, sea de la demanda o bien de la reconvención. Este instituto jurídico se encuentra contenido en el Código Procesal Civil, el cual es de aplicación supletoria a la materia agraria por disposición expresa del numeral 26 de la Ley de la Jurisdicción Agraria. .. Agrega que deberá apreciarse la apariencia de buen derecho, la proporcionalidad y razonabilidad, su relación con la pretensión (entiéndase la planteada en la demanda por la parte actora o en la reconvención por la parte demandada) y eventual afectación a terceros o al interés público.....
En el caso que se analiza la parte demandada y que solicita la tutela cautelar, no planteó reconvención en contra de los accionantes, es decir no existe una acción incoada de la parte en defensa de sus intereses, por lo que al no existir reconvención, no se tiene la posibilidad de entrar a analizar cual es el derecho que puede eventualmente afectársele al accionado, así como si las pretensiones del demandado se relacionan con la tutela que se invoca, véase que una de las características de la medida cautelar, es, que es accesoria a una pretensión principal, la cual no se encuentra presente en este asunto por parte del demandado. Ante la premisa expuesta es criterio de quien suscribe que el peligro en la demora que se requiere para la admisibilidad de la tutela cautelar se echa de menos en la solicitud cautelar planteada por el demandado..". Por lo que se rechazó la medida cautelar. De conformidad con la lectura de las pretensiones incluidas en la demanda, se denota solicita como pretensión principal sea decretada la inexistencia de un gravamen de servidumbre de acueducto sobre su terreno y subsidiariamente se indemnice ese derecho.
La parte accionada contestó de manera negativa, indicando tal derecho está constituido en virtud del uso del acueducto por más de 22 años, el cual existe y debe brindarse mantenimiento debido en aras de garantizar el suministro de agua a la población que abastece. Encontrándose amparado en la Ley de Aguas. Como medida cautelar urgente, para evitar un grave daño a la actividad de mantenimiento de acueducto y a la prestación del servicio de agua potable peticiona se ordene a la actora permita a la Asociación acceder con sus funcionarios y fontaneros a brindar mantenimiento a la zona de paso de la tubería que atraviesa parte de la finca de la actora. Para hacer chapias y labores de mantenimiento del área de paso de este sistema de tubos de distribución de agua potable, mantener identificada la ruta, vigilar posibles fugas y averías y prevenir afectaciones a la infraestructura del servicio público de agua potable que brinda la Asociación.
V-Cabe señalarse por esta Instancia, no se hizo reconocimiento judicial anticipado, ni en la sentencia se hizo una análisis del expediente y las probanzas existentes. Tampoco se resolvió de forma adecuada la petición de medida cautelar en cuanto al daño que pudiera ser ocasionado en el servicio público de suministro de agua para el consumo humano. Ni el informe de los funcionarios del MINAE respecto al daño al área de bosque. A pesar de lo anterior sobre lo cual se llama atención al despacho de instancia, no se procede por esta Cámara a dictar la nulidad del auto sentencia recurrida que denegó la cautelar de la ASADA demandada, en virtud de estarse ante un tema cuya tutela judicial merece una actuación rápida y efectiva. Al estar de por medio el servicio público de suministro de agua potable. Se estima por esta Cámara, el fondo del proceso será decidido en la eventual sentencia que llegue a emitirse.
En la cual se definirá si existe o no el gravamen de servidumbre de acueducto sobre la finca de la actora o procede la indemnización; el cual es un tema de nivel patrimonial entre las personas en contienda. Sin embargo, dado que no es un hecho controvertido que las tuberías del acueducto que administra la demandada, discurren en parte por un sector del fundo de la actora, que el mismo se encuentra en uso y forma parte de la estructura del sistema de acueducto que suministra agua potable a varias comunidades de la zona, de forma provisional ha de acogerse la medida cautelar solicitada en aras de la tutela de la salud humana y el acceso al agua potable en calidad y cantidad idónea (artículo 489 y 490 del Código de Trabajo de aplicación supletoria, artículo 50 de la Constitución Política). Por lo que respecto a esa cautelar deberá ordenarse a la actora permita a los funcionarios y fontaneros de la Asociación demandada el ingreso a su finca, con el único fin de dar mantenimiento y revisión del acueducto en las zonas de paso de la tubería que atraviesa parte de la finca de la accionante.
Y poder realizar las chapias y labores de mantenimiento del área de paso de este sistema de tubos de distribución de agua potable, con el objetivo de mantener identificada la ruta, vigilar posibles fugas y averías, así como prevenir afectaciones a la infraestructura del servicio público de agua potable que brinda la Asociación. Pues existe un riesgo de daño en caso de desatenderse la vigilancia, mantenimiento y atención de las estructuras y tuberías del acueducto que pueden lesionar el suministro de agua en cantidad y calidad idónea de esas poblaciones. El bien protegido mediante este medida cautelar lo es la salud de las personas que dependen de ese acueducto para acceder al recurso hídrico en estado de potabilidad adecuada.
VI- Contracautela. Esa licencia provisional cautelar se otorga, pero bajo el cumplimiento de una contracautela a la Asociación Especifica de Acueductos de San José de Upala en cuanto la forma en que esas labores de vigilancia, mantenimiento y reparación debe desarrollarse por su parte. Lo anterior en virtud de la constatación de la apertura por su parte de una trocha en la zona boscosa de la finca matrícula [Placa1] de Alajuela, según el informe : "INFORME DE REGENCIA FORESTAL PARA PROTECCIÓN O CONSERVACIÓN Y REGENERACIÓN NATURAL", que indicó en su contestación es parte de sus facultades como administradora del acueducto y la servidumbre de acueducto que alega se ha constituido por ley. En el informe técnico del MINAE se anotó por sus funcionarios, se produjo un daño en el bosque existente que además está sometido al régimen de Pagos por Servicios Ambientales. Por lo que se ordena por esta Sede a la Asociación Especifica de Acueductos de San José de Upala: a) se le prohíbe la eliminación de especies forestales, sin contar con los respectivos permisos y requisitos de ley, b) el ingreso de los funcionarios y fontaneros de la Asociación al sitio donde se ubican las tuberias de paso de agua en la finca de la Alejandro Country Life S.A., debe hacerse de forma tal que no se lesione el bosque.
Pues la labor de vigilancia, gestión y mantenimiento de esas estructuras deben ser desarrolladas necesariamente, pero con el menor menoscabo posible al recurso natural. Por lo que las conductas y los actos deben ser en respeto del entorno y el ecosistema. Es decir, internalizando la variable ambiental en el proceso de trabajo que desarrollen. Sin que puedan eliminarse mayores extensiones de bosque para abrir trochas que las existentes. c) Ademas, se ordena que el ingreso al terreno para el fin autorizado, debe ser ejecutado solo para ese objeto y de forma tal, que ocasione la menor molestia posible a la sociedad actora. d) No se introduzcan mejoras o se alteren las condiciones actuales de las zonas de paso, hasta tanto se defina si es viable o no la pretensión del actor. Lo anterior, hasta que el juzgado de instancia proceda a realizar con urgencia un reconocimiento judicial para constatar la realidad material de las zonas por donde discurre la tubería de paso del acueducto y determine la necesidad de conservar la medida dictada por esta Instancia, así como la necesidad de ingreso de los funcionarios de la Asociación de ingreso a esas tuberías. Lo cual deberá ejecutar a la mayor brevedad posible a efectos de constatar la realidad material y la pretensión cautelar.
VII- En virtud de los razonamientos expuestos, con fundamento en el ordinal 1,2,26 y 54 de la Ley de Jurisdicción Agraria, canon 489 y 490 ambos del Código de Trabajo, deberá revocarse la resolución de las diecinueve horas y diecisiete minutos del dieciocho de mayo de dos mil veinte en cuanto denegó la medida cautelar solicitada por la Asociación Especifica de Acueductos de San José de Upala. En su lugar, se acoge la medida cautelar y se ordena a Alejandro Country Life S.A. de forma temporal permita a los funcionarios y fontaneros de la Asociación demandada el ingreso a su finca, con el único fin de dar mantenimiento y revisión del acueducto en las zonas de paso de la tubería que atraviesa parte de la finca de esa sociedad. Con el fin de poder realizar las chapias y labores de mantenimiento del área de paso de este sistema de tubos de distribución de agua potable, mantener identificada la ruta, vigilar posibles fugas y averías, así como prevenir afectaciones a la infraestructura del servicio público de agua potable que brinda la Asociación.
Como contracautela, se le ordena a la Asociación Especifica de Acueductos de San José de Upala lo siguiente: a) se le prohíbe la eliminación de especies forestales, b) el ingreso de los funcionarios y fontaneros de la Asociación al sitio donde se ubican las tuberías de paso de agua, debe hacerse de forma tal que no se lesione el bosque. Desarrolle la labor de vigilancia, gestión y mantenimiento de esas estructuras con el menor menoscabo posible al recurso natural. Sin que puedan eliminarse mayores extensiones de bosque para abrir trochas que las existentes. c) el ingreso al terreno para el fin autorizado, debe ser ejecutado solo para ese objeto y de forma tal, que ocasione la menor molestia posible a la sociedad actora. e) No se introduzcan mejoras o se alteren las condiciones actuales de las zonas de paso, hasta tanto se defina si es viable o no la pretensión del actor. Lo anterior se dicta en virtud de la urgencia de forma provisional, hasta que el juzgado de instancia proceda a realizar con urgencia un reconocimiento judicial, para constatar la realidad material de las zonas por donde discurre la tubería de paso del acueducto y determine la necesidad de conservar la medida dictada y la necesidad de ingreso de los funcionarios de la Asociación de ingreso a esas tuberías, mediante resolución judicial que debe emitir. Lo cual deberá ejecutar a la mayor brevedad posible a efectos de constatar la realidad material y la pretensión cautelar.
POR TANTO:
Se revoca la resolución de las diecinueve horas y diecisiete minutos del dieciocho de mayo de dos mil veinte en cuanto denegó la medida cautelar solicitada por la Asociación Especifica de Acueductos de San José de Upala. En su lugar, se acoge la medida cautelar y se ordena a Alejandro Country Life S.A. de forma provisional, permita a los funcionarios y fontaneros de la Asociación demandada el ingreso a su finca, con el único fin de dar mantenimiento y revisión del acueducto en las zonas de paso de la tubería que atraviesa parte de la finca de esa sociedad. Y poder realizar las chapias y labores de mantenimiento del área de paso de este sistema de tubos de distribución de agua potable, mantener identificada la ruta, vigilar posibles fugas y averías, así como prevenir afectaciones a la infraestructura del servicio público de agua potable que brinda la Asociación. Como contracautela, se le ordena a la Asociación Especifica de Acueductos de San José de Upala lo siguiente: a) se le prohíbe la eliminación de especies forestales, sin contar con los respectivos permisos y requisitos de ley. b) el ingreso de los funcionarios y fontaneros de la Asociación al sitio donde se ubican las tuberías de paso de agua en la finca de Alejandro Country Life S.A., debe hacerse de forma tal que no se lesione el bosque.
Y se desarrolle la labor de vigilancia, gestión y mantenimiento de esas estructuras con el menor menoscabo posible al recurso natural. c) El ingreso al terreno para el fin autorizado, debe ser ejecutado solo para ese objeto y de forma tal, que ocasione la menor molestia posible a la sociedad actora. e) No se introduzcan mejoras o se alteren las condiciones actuales de las zonas de paso, hasta tanto se defina si es viable o no la pretensión del actor. Lo anterior se dicta en virtud de la urgencia de forma provisional, hasta que el juzgado de instancia proceda a realizar con urgencia un reconocimiento judicial, para constatar la realidad material de las zonas por donde discurre la tubería de paso del acueducto y determine la necesidad de conservar la medida dictada y la necesidad de ingreso de los funcionarios de la Asociación de ingreso a esas tuberías, mediante resolución judicial que debe emitir. Lo cual deberá ejecutar a la mayor brevedad posible a efectos de constatar la realidad material y la pretensión cautelar.
